<paragraph id="HA350781F31F9428F99BCBB43B363FC8B" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Section 102(a)(1)(B) of the Ethics in Government Act of 1978 is amended in clause (iv) by striking <quote>$15,000</quote> and inserting <quote>$25,000</quote> and by striking clauses (v) through (ix) and inserting the following new clauses:</text>

<subsection id="HC718BF858B4449BABF025DBCADC92B38"><enum>(b)</enum><header>More frequent disclosure of financial transactions involving large sums of money</header> 
<paragraph id="H341566C2DD0F4DDF89AC70245F78D7CD" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Section 101 of the Ethics in Government Act of 1978 is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H57C9E0789D7E4B4DA355AA0AC0812369" display-inline="no-display-inline"> 
<subsection id="H6764DBD8B2E6475FA982361B6D1FFCA7"><enum>(i)</enum><text display-inline="yes-display-inline">In addition to any other report required to be filed by a Member of Congress or officer or employee of the Congress, each such individual is required to file a quarterly report on April 30, July 30, October 30, and January 30 of each year covering the preceding calendar quarter if that individual (or the spouse or any dependent child of that individual) purchased, sold, or exchanged any property described in subsection (a)(5) valued at not less than $250,000 during that calendar quarter. For any such transaction of not less than $250,000, such report shall contain all of the information required under subsection (a)(5).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFB1C1929C1FC4E6086964AF5391F255E" indent="up1"><enum>(2)</enum> 
<subparagraph id="HFE3FB100A53D4D4A820B795A88BE79C6" display-inline="yes-display-inline"><enum>(A)</enum><text>Clause 1 of rule XXVI of the Rules of the House of Representatives is amended by inserting <quote>(a)</quote> after <quote>1.</quote> and by adding at the end the following new paragraphs: </text> 
<quoted-block style="OLC" id="H5BF4370EF95F4DB9A6D1D15347F7FD2B" display-inline="no-display-inline"> 
<rules-paragraph id="H95D94B3820664D4594B26BD10BDE6DC9"><enum>(b)</enum><text display-inline="yes-display-inline">If any report is filed with the Clerk for a calendar quarter pursuant to section 101(i) of the Ethics in Government Act of 1978, the Clerk shall compile all such reports sent to the Clerk by Members and have them printed as a House document, which shall be made available to the public, as soon as practicable.</text></rules-paragraph> 
<rules-paragraph id="H63574443880C480EB55BE4804755BE05"><enum>(c)</enum><text display-inline="yes-display-inline">Each individual required to file a report with the Clerk under title I under the Ethics in Government Act of 1978 shall file and maintain such report in electronic form.</text></rules-paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HEEEE2BB08B1044AFADE8E612FF56FB61" indent="up1"><enum>(B)</enum><text>Comparable language to be added by the Senate.</text></subparagraph></paragraph></subsection> 
<subsection id="H99E9353282F643A4A067981FB4323651"><enum>(c)</enum><header>Availability on the Internet of reports filed under this title with the Clerk of the House or the Secretary of the Senate</header><text display-inline="yes-display-inline">Section 103 of the Ethics in Government Act of 1978 is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H21B148E418D84E519A88C58A4D8C0139" display-inline="no-display-inline"> 
<subsection id="HE88F84F28EB244539F6A8F9ADB7AD5FE"><enum>(l)</enum><text display-inline="yes-display-inline">The Clerk of the House of Representatives and the Secretary of the Senate shall each make available any report filed with them under this title within 48 hours of the applicable submission deadline on the website of the Clerk or the Secretary, as applicable, in a searchable, sortable, downloadable, machine-readable format.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8FCEC030690C4902A9EB6FCCDDF4CF87"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to reports filed for calendar years or calendar quarters beginning after the date of enactment of this Act.</text></subsection></section> 
<section id="H11CF6086CE354B73B4CD8B685465C1B3"><enum>102.</enum><header>Greater disclosure of travel reports</header> 
<subsection id="H9165B8F5C321472EAF8B6FE141BC8918"><enum>(a)</enum><header>Foreign travel</header><text display-inline="yes-display-inline">Clause 8(b)(3) of rule X of the Rules of the House of Representatives is amended by adding at the end the following new sentence: <quote>Within 48 hours after any such report is filed with the chair of a committee, the chair shall post the report on the Internet site of the committee in a searchable, sortable, downloadable, machine-readable format.</quote>.</text></subsection> 
<subsection id="H40BA13C1C6D340A79E5FC883A9809609"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to travel commencing after the date of enactment of this Act.</text></subsection></section> 
<section id="H38D94F74D46D4095B43FB983F64ABEC1"><enum>103.</enum><header>Greater disclosure of gift reports</header> 
<subsection id="H975D4F8DB36C4523810343A77E7BBD70"><enum>(a)</enum><header>Requiring Clerk of the House To Post Reports on Internet Not Later Than 48 Hours After Receipt</header> 
<paragraph id="H98ECA6A46BEE4254A205F3E7A81B5E11" display-inline="yes-display-inline"><enum>(1)</enum><text>Clause 5(b)(5) of rule XXV of the Rules of the House of Representatives is amended—</text> 
<subparagraph id="H6996E56A1666497C89B452801BD13E38"><enum>(A)</enum><text>by striking <quote>shall make available</quote> and inserting <quote>shall post on the public Internet site of the Clerk and otherwise make available</quote>; and</text></subparagraph> 
<subparagraph id="HDC380A201BF44EB1BD374AB49AA12BAF"><enum>(B)</enum><text>by striking <quote>as possible</quote> and inserting the following: <quote>as possible, but in no event later than 48 hours,</quote>.</text></subparagraph></paragraph> 
<paragraph id="H337ED67510EB45D8AC1775E5C57517B3" indent="up1"><enum>(2)</enum><text>Comparable language to be added by the Senate.</text></paragraph></subsection> 
<subsection id="HCD1542E6E1014D1EAAD24552B75556FF"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall apply with respect to reports filed on or after the date of the adoption of this resolution.</text></subsection></section> 
<section id="HCDAB45411A87442EB8A3E025598680B5"><enum>104.</enum><header>Greater disclosure of earmarks</header> 
<subsection id="HF8D9A13D2E0E4B69BE37DE5F9FC195C7"><enum>(a)</enum><header>Electronic disclosure by Members</header> 
<paragraph id="H76125A71E8B64034843F21B366EEA7C4" display-inline="yes-display-inline"><enum>(1)</enum><text>Rule XXIII of the Rules of the House of Representatives is amended by redesignating clause 18 as clause 19 and by inserting after clause 17 the following:</text> 
<quoted-block style="OLC" id="H15F0887F352441ED90E139A011385C3D" display-inline="no-display-inline"> 
<rules-clause id="H6A705BB665634E968525ABAA8DB01032" indent="down1"><enum>18.</enum><text display-inline="yes-display-inline">A Member, Delegate, or Resident Commissioner who requests a congressional earmark, a limited tax benefit, or a limited tariff benefit shall, within 24 hours after making such request—</text> 
<rules-paragraph id="H954DE8F0D4B7433EAF8AC6CEA3F497DF"><enum>(1)</enum><text display-inline="yes-display-inline">post on his or her public website for the remainder of the Congress the following—</text> 
<rules-subparagraph id="HE9DCF16AB9054D77930D9EBE18CB8557"><enum>(A)</enum><text display-inline="yes-display-inline">the name and address of the intended recipient;</text></rules-subparagraph> 
<rules-subparagraph id="HEE1C2998966640DFB2F88006E2DC2784"><enum>(B)</enum><text>whether the intended recipient is a for-profit or not-for-profit entity;</text></rules-subparagraph> 
<rules-subparagraph id="H403910AAADEF41EEBE98E28672E87787"><enum>(C)</enum><text display-inline="yes-display-inline">the requested amount (only in the case of congressional earmarks); and </text></rules-subparagraph> 
<rules-subparagraph id="HAFBAC03C5180476799B124AC5C1B38CD"><enum>(D)</enum><text>an explanation of the request, including the purpose, and why it is a valuable use of taxpayer funds;</text></rules-subparagraph></rules-paragraph> 
<rules-paragraph id="H3719D3EF45384376AF2187212F3B5193"><enum>(2)</enum><text display-inline="yes-display-inline">electronically submit to the committee of subject-matter jurisdiction the webpage address where such information is posted;</text></rules-paragraph> 
<rules-paragraph id="H11EABBF1B3BE4DBB9DBBEB2DAB0878B3"><enum>(3)</enum><text display-inline="yes-display-inline">identify each request as having been submitted to the committee of subject-matter jurisdiction; and</text></rules-paragraph> 
<rules-paragraph id="H5832758C7311459882B231C26A2228A3"><enum>(4)</enum><text display-inline="yes-display-inline">display on the homepage of such website a hypertext link that contains the words <quote>Earmarks</quote>, <quote>Appropriations Requests</quote>, <quote>Limited Tax Benefits</quote>, or <quote>Limited Tariff Benefits</quote> and that directs to such webpage address, and maintain that link for at least 30 calendar days after the last such request is made during the Congress.</text></rules-paragraph></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2541C1FB2869495F9DF95B19D90AF3A8" indent="up1"><enum>(2)</enum><text>The last sentence of clause 16 of rule XXIII of the Rules of the House of Representatives is amended by striking <quote>and clause 17</quote> and inserting <quote>, clause 17, and clause 18</quote>.</text></paragraph></subsection> 
<subsection id="H0004C056564F48DCAA0BBCF33B9E041A"><enum>(b)</enum><header>Electronic disclosure by committees</header><text display-inline="yes-display-inline">Rule XI of the Rules of the House of Representatives is amended by adding at the end the following new clause: </text>

Earmark disclosure websites</rules-clause-header><enum>(s)</enum> 
<rules-paragraph id="HC1F664004AE34180BB067B887167BE41" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Any committee that accepts any request of a Member, Delegate, or Resident Commissioner for a congressional earmark, a limited tax benefit, or a limited tariff benefit shall maintain a public website with an earmark disclosure webpage that contains the following for each such request—</text></rules-paragraph> 
<rules-paragraph id="H233ECADC0C6A40B5B814B7A4B9599D33"><enum>(A)</enum><text display-inline="yes-display-inline">the bill name;</text></rules-paragraph> 
<rules-paragraph id="H99BF151A3AD744A2850E6F78099E9FD9"><enum>(B)</enum><text>the name, State, and district of that individual;</text></rules-paragraph> 
<rules-paragraph id="HF8DFBCBF315A4D119DB9DFE4FFA98C4B"><enum>(C)</enum><text>the name and address of the intended recipient;</text></rules-paragraph> 
<rules-paragraph id="H3D11B26ECE2A48F7B035DDA5720E58B1"><enum>(D)</enum><text>whether the intended recipient is a for-profit or not-for-profit entity;</text></rules-paragraph> 
<rules-paragraph id="HF97E376E981F4AACA342A7F066285AD4"><enum>(E)</enum><text>the requested amount (only in the case of congressional earmarks); </text></rules-paragraph> 
<rules-paragraph id="HDC181D563E60448CB879201C2C8E7A78"><enum>(F)</enum><text>a brief description; and</text></rules-paragraph> 
<rules-paragraph id="H1923796B156F47718006B982C8147AF2"><enum>(G)</enum><text>the applicable department or agency of the Government, and the account or program (if provided to the committee in the request);</text></rules-paragraph><continuation-text continuation-text-level="subsection" indent="subsection">and is in a downloadable format that is searchable and sortable by such characteristics.</continuation-text></rules-clause> 
<rules-clause id="HB48A4698E05D4307838B995E6A5FFACC"><enum>(2)</enum><text>Any written statement received by a committee under clause 17(a) of rule XXIII shall be posted on the earmark disclosure webpage of the committee.</text></rules-clause> 
<rules-clause id="HA92510DDA4EF4D90B4909E69928183E8"><enum>(3)</enum><text display-inline="yes-display-inline">The earmark disclosure webpage of a committee shall list the names of any Member, Delegate, and Resident Commissioner who requests a congressional earmark, a limited tax benefit, or a limited tariff benefit and link directly to their webpage addresses referred to in clause 18(2) of rule XXIII.</text></rules-clause> 
<rules-clause id="HC534BBCE330E4F789DB2F19AEC940239"><enum>(4)</enum><text display-inline="yes-display-inline">The earmark disclosure webpage of a committee shall post the information required under subparagraphs (1) through (3) within one week of receipt, and shall maintain that information on that webpage for the remainder of the Congress.</text></rules-clause> 
<rules-clause id="H55EE8E53BEBA4AE1BF2C667A08A916FB"><enum>(5)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the terms <term>congressional earmark</term>, <term>limited tax benefit</term>, and <term>limited tariff benefit</term> shall have the meaning given them in clause 9 of rule XXI.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4EE7E78F8FCA431097E93A6213DE0FB2"><enum>(c)</enum><header>Point of order</header><text display-inline="yes-display-inline">Clause 9 of rule XXI of the Rules of the House of Representatives is amended by redesignating paragraphs (e), (f), and (g) as paragraphs (f), (g), and (h), respectively, and by inserting after paragraph (d) the following: </text> 
<quoted-block style="OLC" id="H48F3ACFF35D743B49833847BCCFAE926" display-inline="no-display-inline"> 
<rules-paragraph id="H3F843EE50ECD4E0A9F7F7FCF0CB10F4B" indent="up1"><enum>(e)</enum><text display-inline="yes-display-inline">It shall not be in order to consider any bill or joint resolution, or an amendment thereto or conference report thereon, that carries a congressional earmark, limited tax benefit, or limited tariff benefit for which a Member, Delegate, or Resident Commissioner failed to comply with any applicable requirement of clause 18 of rule XXIII. </text></rules-paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H13CE3F9EE8C24D5493636A4501028EF6"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to requests for congressional earmarks, limited tax benefits, and limited tariff benefits made after the date this resolution is agreed to.</text></subsection> 
<subsection id="H67E4453A9CBE42A9B4DE8320C6FAB461"><enum>(e)</enum><header>Centralized database for earmarks, limited tax benefits, and limited tariff benefits</header> 
<paragraph id="HEB2C601F46BB43CC93D44551230AEC93" display-inline="yes-display-inline"><enum>(1)</enum><text>The Clerk of the House of Representatives, the Secretary of the Senate, and the chairs of the Committee on Appropriations of the House of Representatives and the Senate shall collaborate to create one centralized database where all requests for earmark, limited tax benefits, and limited tariff benefits are available on the Internet in a searchable, sortable, downloadable format to the public. The data available to the public for each earmark should include—</text> 
<subparagraph id="H04CC242452BE4404AF241BED091F2C1A" indent="up1"><enum>(A)</enum><text>an identification of the bill into which the earmark is to be inserted;</text></subparagraph> 
<subparagraph id="HF88B7328656441A3A7147850F34FE427" indent="up1"><enum>(B)</enum><text>the name, State, and district of the Member of Congress requesting the earmark;</text></subparagraph> 
<subparagraph id="H8CD474A25C0B428B8B1C253CD10DC03A" indent="up1"><enum>(C)</enum><text>the name and address of the intended recipient;</text></subparagraph> 
<subparagraph id="H17A1F73917104480841E5C8CB601669A" indent="up1"><enum>(D)</enum><text>whether the intended recipient is a for-profit or not-for-profit entity;</text></subparagraph> 
<subparagraph id="H419D9C506EBD4714B785993AE57C57F5" indent="up1"><enum>(E)</enum><text>the requested amount (only in the case of congressional earmarks);</text></subparagraph> 
<subparagraph id="HA8F0E58B54724282AE4E3FAB15883F53" indent="up1"><enum>(F)</enum><text>a brief description of the earmark; and</text></subparagraph> 
<subparagraph id="H6836BDB996624CCBB2646EF5517A3EB0" indent="up1"><enum>(G)</enum><text>the applicable department or agency of the Government, and the account or program (if provided to the committee in the request).</text></subparagraph></paragraph> 
<paragraph id="H8C33E2D05F41427092FBF7632109888E" indent="up1"><enum>(2)</enum><text>The centralized database for earmarks referred to in paragraph (1) shall be implemented within six months after the date of enactment of this Act.</text></paragraph></subsection></section></title> 
<title id="HCA139D0A09EC4919A885CCAD5489546A"><enum>II</enum><header>Enhancing Public Access to the Work of Congressional Committees, Legislation, and Votes</header> 
<section id="HFDB6CD86FFFE4E708953AB484978B5A3"><enum>201.</enum><header>Increase transparency of committee work</header> 
<subsection id="H7E82D525417D482CB8466164C935E337"><enum>(a)</enum><header>In the House of Representatives</header><text>Clause 1 of rule XI of the Rules of the House of Representatives is amended by adding at the end the following new paragraph:</text>

<rules-subparagraph id="HDDF832C346614CBD9599852C957EF334" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For each hearing and markup for which information is posted under subparagraph (1), the committee shall post on its Internet website within 45 days the following: the topic, related legislation, testimony of witnesses, opening statements of the chair and ranking minority member, transcripts, and audio and video recordings.</text></rules-subparagraph> 
<rules-subparagraph id="HCBA45969CC51414F8569ACC3A6FA6554" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Within 24 hours after a committee or subcommittee orders any bill or resolution to be reported, the committee or subcommittee, as applicable, shall post on its Internet website all amendments that were agreed to, except for technical and conforming changes authorized by the committee or subcommittee.</text></rules-subparagraph></rules-paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC816C074B3934AE785EBB59A18B71FA5"><enum>(b)</enum><header>In the Senate</header><text display-inline="yes-display-inline">Comparable language to be added by the Senate.</text></subsection></section> 
<section id="HAF05D155F0674E5680C3BE657C420221"><enum>202.</enum><header>Increase transparency of committee schedules through the Clerk</header><text display-inline="no-display-inline">Clause 2 of rule II of the Rules of the House of Representatives is amended by adding at the end the following new paragraph:</text>

<section id="H2019B64A81E64F26A767166DC534D8BC"><enum>203.</enum><header>Increased transparency of recorded votes</header> 
<subsection id="HB5393195B2054674A1865ADC195C9004"><enum>(a)</enum><header>Additional duties of the Clerk of the House and the Secretary of the Senate</header><text display-inline="yes-display-inline">The Clerk of the House of Representative and the Secretary of the Senate shall post on the public Internet site of the Office of the Clerk or of the Secretary, respectively, a record, organized by the name of each Member or Senator, in a structured data format, of the recorded votes of that Member or Senator, including the roll, date, issue, question, result, and title or description of the vote, and any cost estimate of the Congressional Budget Office related to the vote.</text></subsection> 
<subsection id="H6D9330D948294C3A9E2B2F1949AF5BD1"><enum>(b)</enum><header>Web link</header><text>Each Member shall provide a link to the Clerk of the House of Representatives of a list of recorded votes from that Member’s Web site, and each Senator shall provide a link to the Secretary of the Senate of a list of recorded votes from that Senator’s Web site.</text></subsection> 
<subsection id="H6AA6439FA007455CA4C7BAE1AF2454B7"><enum>(c)</enum><header>Definition</header><text>As used in this section, the term <term>Member</term> means a Representative in Congress, a delegate to Congress, or the Resident Commissioner from Puerto Rico.</text></subsection> 
<subsection id="H1366071C46614E529F58CA35C39268F8"><enum>(d)</enum><header>Effective date</header><text>This section shall apply to recorded votes occurring after the date of enactment of this Act.</text></subsection></section></title> 
<title id="HF519DA8124AF44BFB79E471B9823C5C4"><enum>III</enum><header>Enhancing Public Access to Congressional Research Service</header> 
<section id="H15669DA9C0394EECB1C21F009A4E3E2D"><enum>301.</enum><header>Enhance access to CRS</header> 
<subsection id="H81987B5E99084E9AAA703947E46746A6"><enum>(a)</enum><header>Availability of CRS information on the Internet</header><text display-inline="yes-display-inline">Except as provided by subsection (b) and (c), the Clerk of the House of Representatives, in consultation with the Director of Congressional Research Service (hereafter in this section referred to as <quote>CRS</quote>), shall make publically available on the Internet the following CRS information:</text> 
<paragraph id="H0D78F3A5C91340F7B7408A97575FD1F3"><enum>(1)</enum><text display-inline="yes-display-inline">CRS Issue Briefs;</text></paragraph> 
<paragraph id="H6A11D27C6BDE4CD4B34B8600B2D3C691"><enum>(2)</enum><text>CRS Reports that are available to Members of Congress through the CRS Web site; and</text></paragraph> 
<paragraph id="H0FAB819050AB4F8DBBE017A11BFADC51"><enum>(3)</enum><text>CRS Authorization of Appropriations and Appropriations Products.</text></paragraph></subsection> 
<subsection id="H41314C0CF95745C69267D450ABAF212A"><enum>(b)</enum><header>Exemption for confidential information</header><text display-inline="yes-display-inline">Information deemed confidential by the Director of CRS and any document that is a confidential research request made by an individual, office, or committee shall be exempt from disclosure under subsection (a).</text></subsection> 
<subsection id="H7A51BA63F1034BECA7FB3BD699EDE4DE"><enum>(c)</enum><header>Additional exemptions</header><text display-inline="yes-display-inline">The Clerk of the House of Representatives, in consultation with the Director of CRS, shall—</text> 
<paragraph id="HCDB13DFCF9784EA1A8B3179EEF465B9D"><enum>(1)</enum><text display-inline="yes-display-inline">remove the personal information of CRS employees, including names and phone numbers;</text></paragraph> 
<paragraph id="H4593163FB1DA4F8CB4048B694C9A58C8"><enum>(2)</enum><text>remove material that may infringe the copyright of a work protected under title 17, United States Code; and</text></paragraph> 
<paragraph id="H5FE7C84F33374626BC271D71C459FF5B"><enum>(3)</enum><text>make any changes to information that s/he deems necessary to ensure its accuracy and currency.</text></paragraph></subsection> 
<subsection id="H3814674D70124211B5F3CA404AD5D257"><enum>(d)</enum><header>Conforming provision</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require the Director of CRS to respond to any inquiry made by a member of the public respecting the information covered by this section.</text></subsection> 
<subsection id="H1B2280601EB64F71AAE6B419B7AD0A48"><enum>(e)</enum><header>Access to CRS Web site</header><text>Members and standing committees of the House of Representatives shall provide a link to the CRS database on their Web sites.</text></subsection> 
<subsection id="H4A05A8F014A543B0A2DF7D5037C2B688"><enum>(f)</enum><header>Establishing, maintaining, and updating the database</header><text>Within 6 months after the date of enactment of this Act, the Clerk of the House of Representatives shall establish the database necessary to carry out this section. The Clerk shall be responsible for maintaining and updating the information on that database.</text></subsection></section></title> 
<title id="H6590A96C8953406E8B6B19F1B58AA410"><enum>IV</enum><header>Lobbying Disclosure</header> 
<section id="H58362B46778746968DCE76587B109E70" section-type="section-one"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Lobbyist Disclosure Enhancement Act</quote>. </text> </section> 
<section id="HD14A5B106D284F4A96048F5A56AB1346"><enum>402.</enum><header>Modifications to enforcement</header> 
<subsection id="H9373D2D5D3EB40DFABBB0B992D325C9F"><enum>(a)</enum><header>Lobbying Disclosure Act Task Force</header> 
<paragraph id="HF6BBB91331664DAE8623657F0D89B8A1"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Attorney General shall establish the Lobbying Disclosure Act Enforcement Task Force (in this subsection referred to as the <quote>Task Force</quote>).</text></paragraph> 
<paragraph id="HF24149B2371F498AB2EAB7F7FFB60193"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The Task Force—</text> 
<subparagraph id="H5D5060676928462690B79BEF273B395C"><enum>(A)</enum><text display-inline="yes-display-inline">shall have primary responsibility for investigating and prosecuting each case referred to the Attorney General under section 6(a)(8) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605(a)(8)</external-xref>); </text></subparagraph> 
<subparagraph id="H3B773A5114D2442388E1550987C30812"><enum>(B)</enum><text display-inline="yes-display-inline">shall collect and disseminate information with respect to the enforcement of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="H37B2173AAFAF4C1E86CB51C94876C077"><enum>(C)</enum><text display-inline="yes-display-inline">shall audit, at a minimum on an annual basis, and as frequently as deemed necessary by the Task Force, the extent of compliance or noncompliance with the requirements of the Lobbying Disclosure Act of 1995 by lobbyists, lobbying firms, and registrants under that Act through a random sampling of lobbying registrations and reports filed under that Act during each calendar year; and</text></subparagraph> 
<subparagraph id="H1F3D7842629B4949BA612F35DEACFF9B"><enum>(D)</enum><text>shall establish, publicize, and operate a toll-free telephone number to serve as a hotline for members of the public to report noncompliance with lobbyist disclosure requirements under the Lobbying Disclosure Act of 1995, and shall develop a mechanism to allow members of the public to report such noncompliance online.</text></subparagraph></paragraph> </subsection> 
<subsection id="HE8705093B5D44609844C7BDBEE80A986"><enum>(b)</enum><header>Referral of cases to the Attorney General</header><text display-inline="yes-display-inline">Section 6(a) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605(a)</external-xref>) is amended—</text> 
<paragraph id="H9F422BB9498945C29EFD34C9009B5E88"><enum>(1)</enum><text>in paragraph (8), by striking <quote>United States Attorney for the District of Columbia</quote> and inserting <quote>Attorney General</quote>; and</text></paragraph> 
<paragraph id="HAFFDF80899904828A9F9FF4025B008DE"><enum>(2)</enum><text>in paragraph (11), by striking <quote>United States Attorney for the District of Columbia</quote> and inserting <quote>Attorney General</quote>.</text></paragraph></subsection> 
<subsection id="H9EDEC259573B4B55BA136DC7BDFFA71B"><enum>(c)</enum><header>Recommendations for improved enforcement</header><text>The Attorney General may make recommendations to Congress with respect to—</text> 
<paragraph id="H1DCDDA8F939245609546CD36242A1CA6"><enum>(1)</enum><text>the enforcement of and compliance with the Lobbying Disclosure Act of 1995; and</text></paragraph> 
<paragraph id="H637EBD3FB67149B18C547A7F20B404F0"><enum>(2)</enum><text>the need for resources available for the enhanced enforcement of the Lobbying Disclosure Act of 1995.</text></paragraph></subsection> 
<subsection id="H906BE3144E9445A4A1ADBC09A49837A3"><enum>(d)</enum><header>Information in enforcement reports</header><text>Section 6(b)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605(b)(1)</external-xref>) is amended by striking <quote>by case</quote> and all that follows through <quote>public record</quote> and inserting <quote>by case and name of the individual lobbyists or lobbying firms involved, any sentences imposed</quote>.</text></subsection></section> 
<section id="HD267BBE70D874A54B64B36399728BDE2"><enum>403.</enum><header>Definition of lobbyist</header><text display-inline="no-display-inline">Section 3(10) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602(10)</external-xref>) is amended by striking <quote>, other than an individual</quote> and all that follows through <quote>period</quote>. </text></section> 
<section id="HEAD564F02B3F472CBDE51363777F22CC" display-inline="no-display-inline" section-type="subsequent-section"><enum>404.</enum><header>Expedited online registration of lobbyists; expansion of registrants</header><text display-inline="no-display-inline">Section 4(a)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(a)(1)</external-xref>) is amended—</text> 
<paragraph id="HFD3E9B0B2BAF4272B655DCABD7B3EB02" display-inline="no-display-inline"><enum>(1)</enum><text>by striking <quote>45 days</quote> and inserting <quote>5 days</quote>;</text></paragraph> 
<paragraph id="H2502AA068C4F43A794B100D699F9079F"><enum>(2)</enum><text>by striking <quote>, or on the first business day after such 45th day if such 45th day is not a business day,</quote> and inserting <quote>, or on the first business day occurring after such 5th day if such 5th day does not occur on a business day,</quote>; and</text></paragraph> 
<paragraph id="H963C171649B94AF89C64188D2E07B771"><enum>(3)</enum><text>by inserting <quote>online</quote> after <quote>shall register</quote>.</text></paragraph> </section> 
<section id="HA9DEDA2A0F224BF18DAAAB257BCCB293" display-inline="no-display-inline" section-type="subsequent-section"><enum>405.</enum><header>Disclosure of additional information by lobbyists</header><text display-inline="no-display-inline">Section 5(b)(2)(A) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(b)(2)(A)</external-xref>) is amended—</text>

<item id="H0FBFE14F51B245ACBDFB12C6E0EC3BB8"><enum>(aa)</enum><text> if the official is an employee of a Member of Congress, the name of that Member of Congress; or</text></item> 
<item id="H0D075792F75B4053A5A58B8AD8F95B50"><enum>(bb)</enum><text>if the official is an employee described in clause (ii), (iii), (iv), or (v) of section 3(4), the name of the Member or Members of Congress who hired the official or for whom the official performs duties as such official; and</text></item></subclause> 
<subclause id="HE730772DF6E842838BF7F309E146ED20"><enum>(III)</enum><text>the date of each lobbying contact; </text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H9EB00D90AAC146EB9E18AEB167E184D5" display-inline="no-display-inline" section-type="subsequent-section"><enum>406.</enum><header>Disclosure of political contributions</header><text display-inline="no-display-inline">Section 5(d)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(d)(1)</external-xref>) is amended—</text> 
<paragraph id="H910327D87A53473AB85683D3AEE1FA23" display-inline="no-display-inline"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>30 days after</quote> and all that follows through <quote>30th day is not</quote> and inserting <quote>20 days after the end of the quarterly period beginning on the first day of January, April, July, and October of each year, or on the first business day after such 20th day if such 20th day is not</quote>; and</text></paragraph>

<subsection id="H4DC84FB6E30F4B63AC56F8F32C1DB3EC"><enum>(a)</enum><header>Section <enum-in-header>402</enum-in-header></header><text display-inline="yes-display-inline">Section 402 and the amendments made by that section take effect upon the expiration of the 90-day period beginning on the date of the enactment of this Act.</text></subsection>

<section id="HE882628B0FC94288ACD73C4C46445A6C"><enum>501.</enum><header>Improving application programming interface and Web site data elements</header> 
<subsection id="H0C3BD6E7464348D891A5DCA45273213E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text>

<paragraph id="H23AB5C5D50B04F28A1029556D764F66F"><enum>(4)</enum><header>Congressionally directed spending item</header><text display-inline="yes-display-inline">The term <term>congressionally directed spending item</term> means a provision or report language included primarily at the request of a Member of Congress providing, authorizing, or recommending a specific amount of discretionary budget authority, credit authority, or other spending authority for a contract, loan, loan guarantee, grant, loan authority, or other expenditure with or to an entity, or targeted to a specific State, locality, or congressional district, other than through a statutory or administrative formula-driven or competitive award process.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6FADF583F8764DD99E1784FE13D8CA25"><enum>(2)</enum><text>in subsection (b)(1)—</text> 
<subparagraph id="H54E8C7DDAA874DA59556F776F0953DB1"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> after the semicolon; </text> </subparagraph>

<clause id="HED6B43CBE6B14DC693A0CBF5FC6AFBFC"><enum>(i)</enum><text>information about the extent of competition in making the award, including the number of bids or proposals determined to be responsive during the competitive process, and if the award was not competed, the legal authority and specific rationale for making the award without full and open competition;</text></clause> 
<clause id="H591719D21A74422C87CB1B970333AA3A"><enum>(ii)</enum><text>the full amount of money that is awarded under a contract or, in the case of lease agreements or assignments, the amount paid to the Government, and the full amount of any options to expand or extend under a contract;</text></clause> 
<clause id="H3A9ED61A84804EF18669B7CE231BAC19"><enum>(iii)</enum><text>the amount of the profit incentive, such as award fees;</text></clause> 
<clause id="H290C88FAC8394A31ACE30287DA359BD2"><enum>(iv)</enum><text>the type of contract, such as fixed price, cost plus pricing, labor hour contracts, and time and materials contracts;</text></clause> 
<clause id="HC82470AE47194AEF8241C8B5A089659C"><enum>(v)</enum><text>an indication if the contract is the result of legislative mandates, set-asides, preference program requirements, or other criteria, and whether the contract is multi-year, consolidated, or performance based; and</text></clause> 
<clause id="HAA40780CE16A422DB24B0A594802F0A8" commented="no"><enum>(vi)</enum><text>an indication if the contract is a congressionally directed spending item; </text></clause></subparagraph> 
<subparagraph id="H00951B27A60A4EEC99A4BDF54ABA5BCE" commented="no"><enum>(I)</enum><text>after January 1, 2012, for all grants, subgrants, loans, awards, cooperative agreements, and other forms of financial assistance, an indication if the funding is a congressionally directed spending item; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H26B2281DFCC04596BE7ADF4E9C489CA0"><enum>(b)</enum><header>Effective date</header><text>Except as otherwise provided, the amendments made by subsection (a) shall be implemented not later than 6 months after the date of the enactment of this Act.</text></subsection></section> 
<section id="HA71A0D94E4F74B64896EB42DE766A2C8"><enum>502.</enum><header>Improving data quality</header> 
<subsection id="HACF6D5625DCE485A9A7380749C0E2F47"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as amended by section 501, is further amended by adding at the end the following:</text>

<section id="H960865E654944846BC0F4D0A6722439E"><enum>5.</enum><header>Improving data quality</header> 
<subsection id="HE14455811E8B4BC6895D45D4A5BB5922"><enum>(a)</enum><header>Inspector General data audit</header><text display-inline="yes-display-inline">Each Inspector General shall annually audit for the previous fiscal year the data used on the website created by this Act for the relevant Federal agency of the Inspector General, in compliance with generally accepted Government auditing standards, and submit a report on such audit to the Director of the Office of Management and Budget that includes at least the following:</text> 
<paragraph id="HD255DF1542E14D1BAC5B71378791D1DF"><enum>(1)</enum><text>A review of data used for the website to verify accuracy of the data and assess the process used for improving data quality.</text></paragraph> 
<paragraph id="H1637BB4CC2C7400E82CDD46C43585ACE"><enum>(2)</enum><text display-inline="yes-display-inline">A review of a statistically representative sample of Federal awards to determine whether Federal agencies have appropriate measures in place to review data submissions under this Act for accuracy and completeness.</text></paragraph> 
<paragraph id="H259A2E7B148E49AD9780DBDE2E62D03E"><enum>(3)</enum><text>An identification and report on new standards that Inspector General recommends for implementation by agencies to improve data quality. </text></paragraph> </subsection> 
<subsection id="HE1495600B7D94C6388544DF0167E648F" commented="no"><enum>(b)</enum><header>OMB report</header><text display-inline="yes-display-inline">Not later than April 1 of each year, the Director of the Office of Management and Budget shall make each report submitted under subsection (a) for the previous fiscal year available to the public, including a review of the findings of the audit and recommendations to improve data quality, through the website created by this Act.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="H0708BAD69BB34129A40C2E6BAFCC0DBB" commented="no"><enum>503.</enum><header>Requirements relating to reporting of award data</header> 
<subsection id="H8EF268CED0B146228E798AF8BC801516" commented="no"><enum>(a)</enum><header>Revision of guidance</header><text>The Director of the Office of Management and Budget shall revise the Office’s guidance to Federal agencies on reporting Federal awards to clarify—</text> 
<paragraph id="H551F93D0557041D88E7D1CFFB24AF2B6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the requirement that award titles describe the award’s purpose; and </text></paragraph> 
<paragraph id="H42447DFE4B3A4EA1A94929821341C73F" commented="no"><enum>(2)</enum><text>requirements for validating and documenting agency award data submitted by Federal agencies.</text></paragraph></subsection> 
<subsection id="HAD86CB00E17D4810899618B9F8E8A36A" commented="no"><enum>(b)</enum><header>Inclusion of city information</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall include information on the city where work is performed in the Office’s public reporting of the completeness of agency data submissions.</text> </subsection></section> 
<section id="H5453040F84D24C5A9711D28F7D1FC3B6"><enum>504.</enum><header>Recipient performance transparency</header> 
<subsection id="H935DFE3BA3E044D886C1FB1D3642FC19"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as amended by sections 501 and 502, is further amended by adding at the end the following:</text>

<section id="H14D67D94FBBD41D9A052BC5CE02D1C46"><enum>6.</enum><header>Recipient performance transparency and past performance</header><text display-inline="no-display-inline">The Director of the Office of Management and Budget shall ensure that the unique identifier required in section 2(b)(1)(E) that is used to link information about the entity receiving the award on the searchable website is also used to link information about that entity on the Federal Awardee Performance Integrity Information System.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H79A75CBBC2EE4F0388707B5107AD6DBE"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall be implemented not later than June 30, 2012.</text></subsection></section> 
<section id="HC163F1C51EE4430E993F9160B171CBB8"><enum>505.</enum><header>Improvement of Federal Awardee Performance and Integrity Information System Database</header> 
<subsection id="H545CA87CF77746A88290C6FDEE931D53"><enum>(a)</enum><header>Requirement To include in database 10 years of information on certain persons awarded Federal contracts or grants</header><text display-inline="yes-display-inline">Section 872 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/417">Public Law 110–417</external-xref>; 122 Stat. 4555) is amended in subsection (c) by striking <quote>5-year</quote> and inserting <quote>10-year</quote>.</text></subsection> 
<subsection id="H0401C1243B234F928B17C784F04E724C"><enum>(b)</enum><header>Requirement To include information in database regarding certain judgments and settlements</header><text>Section 872 of such Act is further amended in subsection (c)(1) by adding at the end the following new subparagraphs: </text>

<section id="HE88C7E33D7D141EB9CC1387CDF28532C"><enum>506.</enum><header>Federal contractor compliance</header> 
<subsection id="H8A1943D4E8084B61B22F7D5ACECE1E48"><enum>(a)</enum><header>Self-Reporting requirement</header><text>Subsection (f) of <external-xref legal-doc="usc" parsable-cite="usc/41/2313">section 2313</external-xref> of title 41, United States Code, is amended to read as follows:</text>

<subsection id="HB4A3225A54C84D998F8592BBC82C86A6"><enum>(f)</enum><header>Self-Reporting requirement</header> 
<paragraph id="HC52F8A95783D4ECC871D104640625B4F"><enum>(1)</enum><header>Contracts in excess of simplified acquisition threshold</header><text>No funds appropriated or otherwise made available by any Act may be used for any Federal contract for the procurement of property or services in excess of the simplified acquisition threshold unless the contractor has first made the certifications set forth in section 52.209–5 of the Federal Acquisition Regulation.</text></paragraph> 
<paragraph id="HDD289AD7DEB24595866F586CCFC62736"><enum>(2)</enum><header>Contracts in excess of $500,000</header><text>No funds appropriated or otherwise made available by any Act may be used for any Federal contract for the procurement of property or services in excess of $500,000 unless the contractor—</text> 
<subparagraph id="H42A4E7A4B5FB4BD58A2EB5D9D3B8E95D"><enum>(A)</enum><text>certifies that the contractor has submitted to the Administrator the information required under subsection (c) and that such information is current as of the date of such certification; or</text></subparagraph> 
<subparagraph id="HAEDDCF1124024D0E9D2044194733E5D1"><enum>(B)</enum><text>certifies that the contractor has cumulative active Federal contracts and grants with a total value of less than $10,000,000.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8AA2021A03B34DF49DB42ADBE1DA1295"><enum>(b)</enum><header>Periodic inspection or review of contract files</header><text>Section 2313(e)(2) of such title is amended by adding at the end the following new subparagraph:</text> 
<quoted-block id="H0C36FA4466574905A2E4708361A4C5E5" style="OLC"> 
<subparagraph id="HF8EA860D01E8435A8EEE16987CBABCC4"><enum>(C)</enum><header>Periodic inspection or review</header><text>The Inspector General of each Federal agency shall periodically—</text> 
<clause id="HFE8D72CF25494B07ACE1FFA6FF753BDB"><enum>(i)</enum><text>conduct an inspection or review of the contract files required under subparagraph (B) to determine if the agency is providing appropriate consideration of the information included in the database created pursuant to subsection (c); and</text></clause> 
<clause id="H6FBF1D0E5A4049AD853C7394D85A4A3B"><enum>(ii)</enum><text>submit a report containing the results of the inspection or review conducted under clause (i) to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H78335B4ACF154AE5AFE4F58DA01DFF61"><enum>(c)</enum><header>Annual report</header><text>The Comptroller General of the United States shall annually submit a report to the appropriate congressional committees describing the extent to which suspended or debarred contractors on the Excluded Parties List System—</text> 
<paragraph id="H4D89842C61EF449B87BDD6C99F65E8FB"><enum>(1)</enum><text>are identified as having received Federal contracts on USAspending.gov; or</text></paragraph> 
<paragraph id="HE1363500F23E4FDDB61A816D59042450"><enum>(2)</enum><text>were granted waivers from Federal agencies from suspension or debarment for purposes of entering into Federal contracts.</text></paragraph></subsection></section> 
<section id="HEA6D587542964DDDBBEF346C7DE85E6A"><enum>507.</enum><header>Unique identifying number</header> 
<subsection id="HD4CBA998E21B4CDBA34C1BDAF4980B83"><enum>(a)</enum><header>Study</header><text>The Inspector General of the General Services Administration shall conduct a study on the use of identifying numbers for Federal awardees to—</text> 
<paragraph id="H2172A1FBCB9D4006BA5D2CA59834B996"><enum>(1)</enum><text>determine if the system of awardee identifying numbers in use as of the date of the enactment of this Act is adequately tracking Federal awardees;</text></paragraph> 
<paragraph id="H543BCB8628354C65A4713229166AF36C"><enum>(2)</enum><text>assess the feasibility of developing and adopting a new unique Federal awardee identification system; and</text></paragraph> 
<paragraph id="H36335A234D7F469CA5C9C0199421A832"><enum>(3)</enum><text>determine whether such system would more effectively track Federal awardees.</text></paragraph></subsection> 
<subsection id="H816DBE7E7CB6498C964CC73C9D4D1E51"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Inspector General shall submit to the appropriate congressional committees a report on the study conducted under subsection (a).</text></subsection></section></title> 
<title id="H96EAD6F5C540496EAA3546FA3021C8A1"><enum>VI</enum><header>Executive Branch Transparency</header> 
<section id="HC734A45D827B48D49ACCDEEC3D540B55"><enum>601.</enum><header>Requirement for disclosure of Federal sponsorship of all Federal advertising or other communications</header> 
<subsection id="H482E30B89A2D45CCB08C380496EA7A8E"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Every advertisement or other communication paid for by an agency, either directly or through a contract awarded by the agency, shall include a prominent notice informing the target audience that the advertisement or other communication is paid for by that agency. </text></subsection> 
<subsection id="H8E67BE121A2442B097AC8F48E5AAAFEF"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H219478B984314E529D9C63AAA254809C"><enum>(1)</enum><header>Advertisement or other communications</header><text display-inline="yes-display-inline">In this section, the term <term>advertisement or other communication</term> includes—</text> 
<subparagraph id="HA5BEA7AAD27F493BB85C3ACFDA4602A2"><enum>(A)</enum><text>an advertisement disseminated in any form, including print or by any electronic means; and</text></subparagraph> 
<subparagraph id="H2AF2982CD298488DA9A3CA89A8E668C0"><enum>(B)</enum><text>a communication by an individual in any form, including speech, print, or by any electronic means.</text></subparagraph></paragraph> 
<paragraph id="HD16200D5D8DF4D3B9F6629AC266B1E52"><enum>(2)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given that term under <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text></paragraph> </subsection></section></title>

<section id="HD5C3AFACC530467983810E2B0EE14521"><enum>701.</enum><header>Digital access to completed responses to the Freedom of Information Act</header> 
<subsection id="H70042024B3C740AF8DDA6EAE2D9C88D2"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="HDC485F4A144F44F6B4AFEB5D249D82DB"><enum>(1)</enum><header>Database of completed FOIA requests</header><text display-inline="yes-display-inline">Each agency shall make available all materials contained in the agency’s completed response to a request under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (in this section referred to as a <term>FOIA request</term>) in a structured database or in a searchable, sortable, downloadable, machine-readable database within one month after the date the FOIA request was completed.</text></paragraph> 
<paragraph id="HC2C853F9911C476F9DC854213A4CB908"><enum>(2)</enum><header>Electronic format</header><text>All information is presumed to be available in an electronic format as described in paragraph (1) unless the agency demonstrates that excessive cost would place an undue burden on the agency. </text> </paragraph></subsection> 
<subsection id="HB7AA6C9AC96D4A6994200AD8624AD4EB"><enum>(b)</enum><header>Public availability</header><text>All information included in the agency’s completed response to a FOIA request shall be made available to the public electronically and without cost through each agency’s Web site.</text></subsection> 
<subsection id="HA884AA9C390E41E988378FC919C4C8C9"><enum>(c)</enum><header>Agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>agency</term> has the meaning given that term under <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text></subsection></section> </title> 
<title id="H68A835B89F994A6893FF20E435D29D93"><enum>VIII</enum><header>Enforcement</header> 
<section id="H79918CACD9F94D8DBAFA9325FBA60ABB"><enum>801.</enum><header>Audits by the Government Accountability Office</header> 
<subsection id="H23D575529E084E838AF4AA7D9A617B11"><enum>(a)</enum><header>Audit requirement</header><text display-inline="yes-display-inline">The Comptroller General shall conduct annual audits of the implementation of the provisions in this Act, and shall submit annually to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the results of the audits. </text></subsection> 
<subsection id="HBB70CA97026944E193AE95AF67EA65F2"><enum>(b)</enum><header>Matters covered by audits</header><text>Audits conducted under this section shall address whether the congressional and executive branch data that is required to be provided to the public through the Internet is each of the following:</text>

<paragraph id="H1787EB4C0B4B4CBFBB995BD3B69E6E98"><enum>(2)</enum><header>Primary</header><text display-inline="yes-display-inline">Collected at the source, with the highest possible level of granularity, not in aggregate or modified forms.</text></paragraph> 
<paragraph id="HA100F419CB114150961C1CB8027E0824"><enum>(3)</enum><header>Timely</header><text display-inline="yes-display-inline">Made available as quickly as necessary to preserve the value of the data.</text></paragraph> 
<paragraph id="H27A0692392F74EB68AD167278B19BDBA"><enum>(4)</enum><header>Accessible</header><text display-inline="yes-display-inline">Available to the widest range of users for the widest range of purposes.</text></paragraph>
