		<section id="H70351C8D2F884E6BB5FB146E301FE29B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Flood Research and Education
			 Act of 2011</short-title></quote>.</text>
		</section><section id="HC30DE9EA8E0647B8B5F9EC0185DB2855"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HEF2CCBDC9645428995DB98F7D5DC7F00"><enum>(1)</enum><text display-inline="yes-display-inline">According to the National Oceanic and
			 Atmospheric Administration (NOAA) three-fourths of all presidential disaster
			 declarations are associated with flooding.</text>
			</paragraph><paragraph id="H0754FA1B1FF84A3B8AFDEB15E6465E0D"><enum>(2)</enum><text>According to NOAA,
			 in most years flooding causes more damage in the United States than any other
			 severe weather related event, an average of $5.3 billion a year for the 30-year
			 period, 1975–2004.</text>
			</paragraph><paragraph id="H869A232B088F44D08E63260916BD6B9A"><enum>(3)</enum><text>Flooding, flood
			 prevention, and flood-related socio-economic, environmental, health and policy
			 issues are highly complex with implications for loss of life and billions in
			 damage to all sectors of our economy.</text>
			</paragraph><paragraph id="H08B7C030C4FA46D9968D0F6305DF9F8E"><enum>(4)</enum><text>There is not
			 currently a national-level comprehensive effort to research flooding, flood
			 prevention, and flood-related issues.</text>
			</paragraph><paragraph id="HA25F22707557438E92091A6B38F8FFCD"><enum>(5)</enum><text>Flooding, flood
			 prevention, and flood-related issues require a national-level comprehensive and
			 collaborative research effort to help advance understanding of the variety of
			 issues on causes of flooding, and implementation of prediction methods as well
			 as policies that would help prevent future damage and natural disasters.</text>
			</paragraph><paragraph id="H914D0A480D8F44E6B38007371510AFC9"><enum>(6)</enum><text>A
			 national-level effort should include partnerships between the Federal
			 Government and institutions of higher education all with expertise in the areas
			 of physical and environmental science, including hydrology, hydraulics,
			 hydrometeorology, climate, as well as in engineering, sociology and
			 economics.</text>
			</paragraph><paragraph id="HAA4F297DD97746DEAC5407E2975D5FE5"><enum>(7)</enum><text>A
			 national-level effort should include research on climate and weather and any
			 other area related to flooding, flood prevention, and other flood-related
			 issues, including—</text>
				<subparagraph id="HF837C51FBC654FEBA02223B7DB1272CA"><enum>(A)</enum><text>analysis of the
			 economic effects of flooding;</text>
				</subparagraph><subparagraph id="H505EA73217994BFC80B4533EB528FBC8"><enum>(B)</enum><text>evaluation and
			 development of strategies, techniques, and technologies to reduce, manage,
			 monitor, and prevent flooding;</text>
				</subparagraph><subparagraph id="H4D17BDB554904A06BB638A6FACE6E710"><enum>(C)</enum><text>analysis of
			 Federal, State, regional, and local flood policy;</text>
				</subparagraph><subparagraph id="H53E0D3CAE1E5422F9AB7BD4140A17915"><enum>(D)</enum><text>and development of
			 risk-assessment tools, methods, and models.</text>
				</subparagraph></paragraph><paragraph id="HC43B85CB3E3E4221ADF505308C870027"><enum>(8)</enum><text>A
			 national-level effort should also include development of recommendations and
			 identification of best practices for predicting, preventing, and minimizing
			 flooding and its effects, including—</text>
				<subparagraph id="H4F473E948E88468D8E4C2FC952F42A06"><enum>(A)</enum><text>risk-assessment
			 tools, methods, and models;</text>
				</subparagraph><subparagraph id="HE16AC1ACC86B45BFAA81BC914FC36E06"><enum>(B)</enum><text>strategies and
			 techniques for monitoring and predicting flooding;</text>
				</subparagraph><subparagraph id="H515F8ADF61FF4982A223834F6FA4779B"><enum>(C)</enum><text>strategies and
			 techniques for flood management and prevention;</text>
				</subparagraph><subparagraph id="HCF9207DE37604A37BEDED6910373C58A"><enum>(D)</enum><text>the adoption and
			 use of relevant technologies;</text>
				</subparagraph><subparagraph id="H91C8A09EC7014FF4B41CE414059CDFC8"><enum>(E)</enum><text>Federal, State,
			 regional, and local flood policies; and</text>
				</subparagraph><subparagraph id="H006BDE9629124950A975C22F3FA335B2"><enum>(F)</enum><text>coordination and
			 cooperation among local, State, and Federal flood-related efforts.</text>
				</subparagraph></paragraph><paragraph id="HE8C8EAC07333440A813E5305F46B7C31"><enum>(9)</enum><text>Research,
			 recommendations, and best practices should be developed by taking into account
			 regional differences in hydrology, weather, geography, economy, and population
			 density while ensuring inland and non-oceanic flooding situations, among
			 others, are represented.</text>
			</paragraph><paragraph id="H5C6C6C544237449EA8DF5CC384A04D32"><enum>(10)</enum><text>Demonstration
			 projects should be used to test the efficacy of new strategies, techniques and
			 technologies for assessing flood risk, monitoring, and predicting and provide
			 local governments the opportunity to participate in areas where new strategies
			 are needed.</text>
			</paragraph><paragraph id="H6025CE8768BE4880B68ED59500219991"><enum>(11)</enum><text display-inline="yes-display-inline">There are multiple areas of Federal, State,
			 and local government responsibility for flooding and water-related issues.
			 Thus, a national-level research effort should involve the development of
			 collaborative networks on regional flooding, flood prevention, and
			 flood-related issues, including the following entities—</text>
				<subparagraph id="H2814DA09153C4D3998BE9F7BEF47F7AD"><enum>(A)</enum><text display-inline="yes-display-inline">relevant Federal departments and agencies,
			 including water-research efforts within NOAA and other Federal entities;</text>
				</subparagraph><subparagraph id="H6162DDB3722A465BAF9BEE6BD9A87733"><enum>(B)</enum><text>State, county, and
			 local governments;</text>
				</subparagraph><subparagraph id="HE2ABFB2F5FFC4CFAA5CF54F9D516F04F"><enum>(C)</enum><text>local Councils of
			 Governments or regional and Metropolitan Planning Organizations;</text>
				</subparagraph><subparagraph id="H3DCFD516AE794E719CD10BF2DAE1088C"><enum>(D)</enum><text>State agriculture,
			 natural resource, environment, economic development, homeland security, and
			 water agencies;</text>
				</subparagraph><subparagraph id="H853A398AD7534E54B37E1EEE4FA824DF"><enum>(E)</enum><text>county disaster
			 recovery coordinators, emergency management personnel, and first
			 responders;</text>
				</subparagraph><subparagraph id="HFFE9FA36493D468A8BEC683E31285E74"><enum>(F)</enum><text>public or private
			 colleges and universities;</text>
				</subparagraph><subparagraph id="HF066A42A77FF4FA4821A36CA684D0263"><enum>(G)</enum><text>floodplain
			 managers;</text>
				</subparagraph><subparagraph id="HA90AEB7D30F5452A8AE6EF5EB844F02A"><enum>(H)</enum><text>watershed
			 organizations and boards;</text>
				</subparagraph><subparagraph id="H9CE89AE84DF94274AE9AB42F45ECE347"><enum>(I)</enum><text>agriculture and
			 commodity Organizations;</text>
				</subparagraph><subparagraph id="HFC14826956034292B92B65E2C1E36C16"><enum>(J)</enum><text>resource,
			 conservation, preservation and environmental organizations;</text>
				</subparagraph><subparagraph id="HC9F1ED9D31C04605ADBDD5529C7FEF22"><enum>(K)</enum><text>homeowners
			 associations and organizations; and</text>
				</subparagraph><subparagraph id="HE92680C7AF63470BB0698368F3D9F46E"><enum>(L)</enum><text>business and
			 development organizations.</text>
				</subparagraph></paragraph></section><section id="HFDD8E026F0584938BDE27DD1B952A26E" section-type="subsequent-section"><enum>3.</enum><header>Office of Flood
			 Research and Policy</header>
			<subsection id="H4050E377DB7D410DB82CBF026E3DF2B2"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="H9BD0D50C08AF428D9D9ADE97AD26FA27"><enum>(1)</enum><header>In
			 general</header><text>There is hereby established within the National Oceanic
			 and Atmospheric Administration (NOAA) an Office of Flood Research and
			 Policy.</text>
				</paragraph><paragraph id="HACD74C68461649BF9CDCCDE933418F53"><enum>(2)</enum><header>Director</header>
					<subparagraph id="HF4502E7190E54995AAF3A8D164C025AA"><enum>(A)</enum><header>In
			 general</header><text>The Office shall be headed by a Director, who shall be
			 appointed by the Administrator of NOAA.</text>
					</subparagraph><subparagraph id="H7F9A940D90A04AE1824903F8D9D3AACD"><enum>(B)</enum><header>Salary</header><text display-inline="yes-display-inline">The rate of pay for the Director shall not
			 exceed the rate payable for level IV of the Executive Schedule under section
			 5316 of title 5, United States Code.</text>
					</subparagraph></paragraph><paragraph id="H0825E8D0836C49AAB89E523D7D9467FA"><enum>(3)</enum><header>Staff</header>
					<subparagraph id="H34872DDF34E445E5AE45061F3EF211EB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director may
			 appoint and fix the pay of personnel as the Director considers
			 appropriate.</text>
					</subparagraph><subparagraph id="H94C1BFA163DE486FB434F83AFCD33A6F"><enum>(B)</enum><header>Detail of
			 Government employees</header><text display-inline="yes-display-inline">Upon
			 request of the Director, the head of any Federal department or agency may
			 detail, on a reimbursable basis, any of the personnel of that department or
			 agency to the Office to assist the Director in carrying out his duties under
			 this Act.</text>
					</subparagraph><subparagraph id="H7ED815E85DC9490C80295041121E607B"><enum>(C)</enum><header>Experts and
			 consultants</header><text display-inline="yes-display-inline">The Director may
			 procure temporary and intermittent services under section 3109(b) of title 5,
			 United States Code.</text>
					</subparagraph></paragraph></subsection><subsection id="H2152919C201B45469A3950384384AA58"><enum>(b)</enum><header>Duties</header><text>The
			 Director shall—</text>
				<paragraph display-inline="no-display-inline" id="H3CA78D1F534040889838B3136C51104A"><enum>(1)</enum><text>establish and
			 oversee the National Flood Research and Education Consortium described in
			 <internal-xref idref="H9A511BA225A14E7498BC59A13804736B" legis-path="4.">section 4</internal-xref>;</text>
				</paragraph><paragraph id="HB39CA654962044DEBECB6E0DEBBDBA82"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations and identify best
			 practices for predicting, preventing, and minimizing flooding and its effects
			 in accordance with
			 <internal-xref idref="H94F7CC7CEFD049EABD4148F614A50CDE" legis-path="3.(c)">subsection (c)</internal-xref>;</text>
				</paragraph><paragraph id="HDE321202FF684206BAEF2A786F99E8E1"><enum>(3)</enum><text>submit to Congress
			 an annual report in accordance with
			 <internal-xref idref="HF9BAEF7533CC4E5C93BE09E017A57835" legis-path="3.(d)">subsection (d)</internal-xref>;</text>
				</paragraph><paragraph id="H15F5C9C3BE064BAD878CFF7F64CF77F9"><enum>(4)</enum><text>establish and
			 maintain a page on the public NOAA Web site in accordance with
			 <internal-xref idref="HDC99C322079947E6B15960C31790F6FE" legis-path="3.(e)">subsection (e)</internal-xref>; and</text>
				</paragraph><paragraph id="H4719E38E731B407F97E63C2DA02BEFBC"><enum>(5)</enum><text display-inline="yes-display-inline">review applications that have been approved
			 by the Lead Partner Institution (LPI) and award grants for demonstration
			 projects in accordance with
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>.</text>
				</paragraph></subsection><subsection id="H94F7CC7CEFD049EABD4148F614A50CDE"><enum>(c)</enum><header>Recommendations
			 and best practices</header>
				<paragraph id="H716392A1E5B14A109A9F117EF8DED649"><enum>(1)</enum><header>In
			 general</header><text>The Director, in consultation with the Director of the
			 United States Geological Survey, the Commanding General of the United States
			 Army Corps of Engineers, and the heads of other relevant Federal agencies,
			 shall develop recommendations and identify best practices for predicting,
			 preventing, and minimizing flooding and its effects, including—</text>
					<subparagraph display-inline="no-display-inline" id="H260F96FE25164099A747A1DAE5BB6B16"><enum>(A)</enum><text>risk-assessment
			 tools, methods, and models;</text>
					</subparagraph><subparagraph id="H64BC6D6DB75B40A1884C3E385412677B"><enum>(B)</enum><text>strategies and
			 techniques for monitoring and predicting flooding;</text>
					</subparagraph><subparagraph id="H1CF2B0F2C73A4B1DAA0BCC139B273721"><enum>(C)</enum><text>strategies and
			 techniques for flood management and prevention;</text>
					</subparagraph><subparagraph id="H4804294BAF3F4DFD8569A54A951DE825"><enum>(D)</enum><text>the adoption and
			 use of relevant technologies;</text>
					</subparagraph><subparagraph id="HB36C9778A2804ED5ABDDDCBC93437E15"><enum>(E)</enum><text display-inline="yes-display-inline">Federal, State, regional, and local flood
			 policies; and</text>
					</subparagraph><subparagraph id="H5251B33297DD48B3874B44E0CD14AB1D"><enum>(F)</enum><text display-inline="yes-display-inline">coordination and cooperation among local,
			 State, and Federal flood-related efforts.</text>
					</subparagraph></paragraph><paragraph id="H7528CED2AA2F48B282E3B872DF11B8B2"><enum>(2)</enum><header>Additional
			 considerations</header><text>In developing the recommendations and best
			 practices described in
			 <internal-xref idref="H716392A1E5B14A109A9F117EF8DED649" legis-path="3.(c)(1)">paragraph (1)</internal-xref>, the Director shall
			 consider—</text>
					<subparagraph id="HF8D67C1846EC46B094BF87F9B8668AC1"><enum>(A)</enum><text>the annual report
			 submitted by the LPI in accordance with
			 <internal-xref idref="HC8C68E4CCF984C28B0E7A4EB9A6C5747" legis-path="4.(f)">section 4(f)</internal-xref>; and</text>
					</subparagraph><subparagraph id="H04C4DED0D7C24A39ADBA304A479CC8A7"><enum>(B)</enum><text>regional
			 differences in hydrology, weather, geography, economy, and population
			 density.</text>
					</subparagraph></paragraph></subsection><subsection id="HF9BAEF7533CC4E5C93BE09E017A57835"><enum>(d)</enum><header>Report</header><text>The
			 Director shall submit to Congress an annual report on the activities of the
			 Office and the Consortium.</text>
			</subsection><subsection id="HDC99C322079947E6B15960C31790F6FE"><enum>(e)</enum><header>Web
			 site</header><text display-inline="yes-display-inline">The Director shall
			 establish and maintain a page on the public NOAA Web site on which the Director
			 shall publish—</text>
				<paragraph id="HC530AAD58601494899D535E882ACC5AC"><enum>(1)</enum><text>the
			 recommendations and best practices described in
			 <internal-xref idref="H94F7CC7CEFD049EABD4148F614A50CDE" legis-path="3.(c)">subsection (c)</internal-xref>; and</text>
				</paragraph><paragraph id="H802DB5011F814FFC9A4F727A0D0530A1"><enum>(2)</enum><text>the annual report
			 described in
			 <internal-xref idref="HF9BAEF7533CC4E5C93BE09E017A57835" legis-path="3.(d)">subsection (d)</internal-xref>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HD14CD311965B411B9FF84F3CF3206AF6"><enum>(f)</enum><header>Oversight</header>
				<paragraph id="H47A16C82E916421C8381A296ACB18DA9"><enum>(1)</enum><header>Research</header><text display-inline="yes-display-inline">The Director shall establish procedures to
			 ensure that there is full and effective review of the research conducted by the
			 Consortium.</text>
				</paragraph><paragraph id="H981F99FDE7AB485BA8397A12D3683112"><enum>(2)</enum><header>Periodic
			 review</header><text display-inline="yes-display-inline">Periodically (and not
			 less than every year), the Director shall review the activities of the
			 Consortium to ensure that—</text>
					<subparagraph id="HCC6D2089693D43CE88E5AC074711AE18"><enum>(A)</enum><text>Consortium members
			 are fulfilling their duties under section 3; and</text>
					</subparagraph><subparagraph id="HC907AE8996834D2F92B9574812A90003"><enum>(B)</enum><text display-inline="yes-display-inline">funds received under this Act are used
			 solely for such purposes.</text>
					</subparagraph></paragraph><paragraph id="H2AF3C15976F740539727FDD7F70F057C"><enum>(3)</enum><header>Information</header><text>Consortium
			 members shall provide the Director with any information that the Director
			 considers necessary to carry out his responsibilities under this
			 section.</text>
				</paragraph></subsection></section><section id="H9A511BA225A14E7498BC59A13804736B"><enum>4.</enum><header>National Flood
			 Research and Education Consortium</header>
			<subsection id="HEB45D335FE6F4646880556AE41E454F1"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="H85DFC432789A464A834D915AFE03552F"><enum>(1)</enum><header>In
			 general</header><text>The Director shall establish a National Flood Research
			 and Education Consortium.</text>
				</paragraph><paragraph id="H39558B60A5A449BB9E4D95ADDEFEFE8D"><enum>(2)</enum><header>Members</header>
					<subparagraph id="H865FE9D332D84E3BB0E45F7F46C54B0C"><enum>(A)</enum><header>Composition</header><text>The
			 Consortium shall consist of—</text>
						<clause display-inline="no-display-inline" id="H69C596A836C74BF1AFA67CBC5F6F3912"><enum>(i)</enum><text display-inline="yes-display-inline">a LPI selected by the Director as described
			 in <internal-xref idref="H61A67868360543C39D32C338599BE6EA" legis-path="5.(a)">section 5(a)</internal-xref>; and</text>
						</clause><clause id="H2F1063F8BC3441FC99ECF36E0F817D52"><enum>(ii)</enum><text>additional
			 partner institutions selected by the Director and LPI as described in
			 <internal-xref idref="HAE5ADABC66BE4D7498C4E5317DC79785" legis-path="5.(b)">section 5(b)</internal-xref>.</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HD2AFE13121E94405A54F5925B5626BD6"><enum>(B)</enum><header>Limitation to
			 institutions of higher education</header><text>Members of the Consortium shall
			 be institutions of higher education.</text>
					</subparagraph></paragraph></subsection><subsection id="H4594A0D352CC4273B812F1BEA6152075"><enum>(b)</enum><header>Duties of
			 Consortium members</header><text display-inline="yes-display-inline">Each
			 Consortium member shall—</text>
				<paragraph id="HF891B4A4B1A2427D860ECBCB1315830F"><enum>(1)</enum><text display-inline="yes-display-inline">conduct research on flooding, flood
			 prevention, and other flood-related issues, including—</text>
					<subparagraph id="H641ED3110D1547598F1068F8E878C8E4"><enum>(A)</enum><text>analysis of the
			 economic effects of flooding;</text>
					</subparagraph><subparagraph id="H69ECC63A85B54FC28746F7B5AFFAB226"><enum>(B)</enum><text>evaluation and
			 development of strategies, techniques, and technology to reduce, manage,
			 monitor, and prevent flooding;</text>
					</subparagraph><subparagraph id="H8F37C6857A1D412DB270B6417562415B"><enum>(C)</enum><text display-inline="yes-display-inline">analysis of Federal, State, regional, and
			 local flood policy; and</text>
					</subparagraph><subparagraph id="H9E1A5BFCA4D54D8DA70A8567C4521E5E"><enum>(D)</enum><text display-inline="yes-display-inline">development of risk-assessment tools,
			 methods, and models; and</text>
					</subparagraph></paragraph><paragraph id="H69ACFD5D1886497FAFF6961392321EA4"><enum>(2)</enum><text>develop
			 undergraduate and graduate courses on flooding, flooding prevention, and other
			 flood-related issues.</text>
				</paragraph></subsection><subsection id="H2A7017311FD543038E37CA1090438FAF"><enum>(c)</enum><header>Additional
			 duties of Lead Partner Institution</header><text display-inline="yes-display-inline">In addition to fulfilling the duties
			 described in
			 <internal-xref idref="H4594A0D352CC4273B812F1BEA6152075" legis-path="4.(b)">subsection (b)</internal-xref>, the LPI shall—</text>
				<paragraph display-inline="no-display-inline" id="H616CB750058441C58A142BB230416C10"><enum>(1)</enum><text>establish a center
			 to plan, coordinate, and facilitate research and information sharing among the
			 Consortium members;</text>
				</paragraph><paragraph id="H8531A22C566943278DD4FA1ADC4C8011"><enum>(2)</enum><text>review and approve
			 applications for grants under
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>;</text>
				</paragraph><paragraph id="H308A3BA7DFE74F7FAA2B181DB1AD8421"><enum>(3)</enum><text>oversee
			 demonstration projects funded by grands awarded under
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>;</text>
				</paragraph><paragraph id="H9FECA64243C84F468780735C43BDCF02"><enum>(4)</enum><text>submit to the
			 Director an annual report in accordance with
			 <internal-xref idref="HC8C68E4CCF984C28B0E7A4EB9A6C5747" legis-path="4.(f)">subsection (f)</internal-xref>; and</text>
				</paragraph><paragraph id="H8679A9F6506A469290E557C07C49620E"><enum>(5)</enum><text>establish and
			 maintain an Internet Web site in accordance with
			 <internal-xref idref="H351A15E560464F50808069D500AF3C67" legis-path="4.(g)">subsection (g)</internal-xref>.</text>
				</paragraph></subsection><subsection id="H5ECC3DB587374E57AA6F672DD17EB1D9"><enum>(d)</enum><header>Improvement of
			 Lead Partner Institution facilities</header>
				<paragraph id="HA42259AAAD4E48AA823D854E57841D6A"><enum>(1)</enum><header>In
			 general</header><text>Subject to the requirements of
			 <internal-xref idref="H846DBEE90A2A4B34AD04AE8C6F6FD001" legis-path="4.(e)(2)">paragraph (2)</internal-xref>, the LPI may use funds
			 authorized pursuant to
			 <internal-xref idref="HFE55B3135294450EA946A2C54604BADA" legis-path="7.(a)(2)">section 7(a)(2)</internal-xref> to improve facilities
			 used by the LPI in carrying out its duties under this section.</text>
				</paragraph><paragraph id="H846DBEE90A2A4B34AD04AE8C6F6FD001"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In order for the LPI to be eligible to
			 receive funds under this subsection—</text>
					<subparagraph id="H42FCFB8CBCC343499B3B0422BA12E427"><enum>(A)</enum><text display-inline="yes-display-inline">the LPI shall submit to the Director a plan
			 detailing the proposed improvements, including—</text>
						<clause id="H67D58B56DC384CB1AC6A094A7B9FE859"><enum>(i)</enum><text>the
			 projected cost of such improvements;</text>
						</clause><clause id="H0DF568CA179B4FFFA76132EC07BE4FF5"><enum>(ii)</enum><text>a
			 description of engineering, design, staffing, and equipment needs; and</text>
						</clause><clause id="HAEAE79F528614DD0B6E4376C67D41232"><enum>(iii)</enum><text display-inline="yes-display-inline">such additional information as the Director
			 shall require; and</text>
						</clause></subparagraph><subparagraph id="H77DAB71A73154A63B6958D02EACC27BB"><enum>(B)</enum><text>the Director shall
			 approve such plan.</text>
					</subparagraph></paragraph></subsection><subsection id="HC8C68E4CCF984C28B0E7A4EB9A6C5747"><enum>(e)</enum><header>Annual
			 Report</header>
				<paragraph display-inline="no-display-inline" id="HE898FDD178524F4F89ED255FDE5914F5"><enum>(1)</enum><header>Contents</header><text>For
			 each fiscal year in which the Consortium is funded under this Act, the LPI
			 shall prepare a report that includes—</text>
					<subparagraph id="HCA55563FD47F4295A8EEA5AAD60E1803"><enum>(A)</enum><text>a summary of the
			 research and activities—</text>
						<clause id="HB778F3F3979A45898D5AFF2D14970771"><enum>(i)</enum><text>conducted by each
			 Consortium member during the fiscal year in accordance with this Act;
			 and</text>
						</clause><clause id="HB521E34249CE44588844884A34086920"><enum>(ii)</enum><text display-inline="yes-display-inline">planned by each Consortium member for the
			 next fiscal year in accordance with this Act;</text>
						</clause></subparagraph><subparagraph id="H2744E2E3765E4661926370BB86BF20EC"><enum>(B)</enum><text display-inline="yes-display-inline">a detailed accounting of the
			 amounts—</text>
						<clause id="H5B6C186BB7074F56A959D2E0C7FBFA95"><enum>(i)</enum><text>expended by each
			 Consortium member during the fiscal year in carrying out this Act; and</text>
						</clause><clause id="H02D9FE91FB9E4C25A38C6AD6391D30BD"><enum>(ii)</enum><text display-inline="yes-display-inline">planned to be expended by each Consortium
			 member for the next fiscal year in carrying out this Act;</text>
						</clause></subparagraph><subparagraph id="H85AAA4F22AD74DC09D75744FB6A43CDC"><enum>(C)</enum><text>the number of
			 applications for grants under section 5 received during the fiscal year, a list
			 of such grants awarded during the fiscal year, and the status of demonstration
			 projects funded by such grants; and</text>
					</subparagraph><subparagraph id="H000D80A5CECE41BFA9434315CFA6010C"><enum>(D)</enum><text>such additional
			 information as the Director shall require.</text>
					</subparagraph></paragraph><paragraph id="H7546BD3A076A48669D2DF1D2F781D871"><enum>(2)</enum><header>Final
			 report</header><text>In the case of the final annual report, the LPI may
			 exclude the information described in
			 <internal-xref idref="HB521E34249CE44588844884A34086920" legis-path="4.(f)(1)(A)(ii)">paragraph (1)(A)(ii)</internal-xref> and
			 <internal-xref idref="H02D9FE91FB9E4C25A38C6AD6391D30BD" legis-path="4.(f)(1)(B)(ii)">paragraph (1)(B)(ii)</internal-xref>.</text>
				</paragraph><paragraph id="H6CAA3B59E5EF47599D20CFED05045E3C"><enum>(3)</enum><header>Timing</header><text display-inline="yes-display-inline">The LPI shall submit the report described
			 in
			 <internal-xref idref="HE898FDD178524F4F89ED255FDE5914F5" legis-path="4.(f)(1)">paragraph (1)</internal-xref> to the Director no later
			 than 30 days after the end of the fiscal year.</text>
				</paragraph></subsection><subsection id="H351A15E560464F50808069D500AF3C67"><enum>(f)</enum><header>Web
			 site</header><text>The LPI shall establish and maintain an Internet Web site
			 for the Consortium on which the LPI shall publish—</text>
				<paragraph id="H9C93835781664D8EB939E83562B54047"><enum>(1)</enum><text>information about
			 the purpose of the Consortium;</text>
				</paragraph><paragraph id="HD6EC389DC27249A494402F85CBA2F9C8"><enum>(2)</enum><text>the location and
			 contact information of Consortium members;</text>
				</paragraph><paragraph id="H98F0272FBB5F455AB057998B85394CB0"><enum>(3)</enum><text>a
			 link to the page of the Office on the public NOAA Web site;</text>
				</paragraph><paragraph id="H2EFD59DD9E0E406DA45E906D242A10A8"><enum>(4)</enum><text display-inline="yes-display-inline">a detailed description of all research
			 conducted by Consortium members in accordance with this Act;</text>
				</paragraph><paragraph id="HB424FFB6A4734EB68E577EF252068FD4"><enum>(5)</enum><text display-inline="yes-display-inline">articles on flooding, flood prevention, and
			 flood-related issues published in peer-reviewed academic journals by professors
			 of Consortium members;</text>
				</paragraph><paragraph id="H543D16B26CA94B83BCED4BD26AF244F1"><enum>(6)</enum><text>information about
			 the grant program described in
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>, including the application and
			 criteria for selection;</text>
				</paragraph><paragraph id="HA3744759F3E74545AA388332492482BC"><enum>(7)</enum><text>the status of
			 demonstration projects funded by the grant program described in
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>; and</text>
				</paragraph><paragraph id="H8AD4DB9A227642A9AACD9932CA5B159E"><enum>(8)</enum><text>such additional
			 information as the Director shall require.</text>
				</paragraph></subsection><subsection id="H94B44BCA30074876AA0B7FDE85202FE9"><enum>(g)</enum><header>Information</header><text display-inline="yes-display-inline">Consortium members shall provide the LPI
			 with any information the LPI considers relevant to carry out its
			 responsibilities under this section.</text>
			</subsection></section><section id="H26F0F5E9DF2547C281D38D7000C5DF0E"><enum>5.</enum><header>Selection of
			 Consortium Members</header>
			<subsection id="H61A67868360543C39D32C338599BE6EA"><enum>(a)</enum><header>Lead Partner
			 Institution</header>
				<paragraph id="HEB66B734F215468386FC25030D02723C"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Director shall select an institution of higher education to serve
			 as the lead partner institution to head the Consortium.</text>
				</paragraph><paragraph id="H9EFFF0025CC34099B371DD1C513557BD"><enum>(2)</enum><header>Application</header><text>An
			 institution of higher education desiring to be selected as the LPI of the
			 Consortium shall submit an application to the Director at such time, in such
			 form, and containing such information and assurances as the Director shall
			 reasonably require. Such application shall include—</text>
					<subparagraph display-inline="no-display-inline" id="HAE3DEC94E2A5407AB6AAF097BFF17717"><enum>(A)</enum><text>a comprehensive
			 prospectus for the operation of the Consortium;</text>
					</subparagraph><subparagraph id="H69BA0E57F1374E9DBC94F2B659EE05F3"><enum>(B)</enum><text>a research
			 proposal;</text>
					</subparagraph><subparagraph id="HBFE7BA6921094A19B39C2C6434CA340E"><enum>(C)</enum><text>a description of
			 relevant current and past research conducted by the institution;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H3B21ABC19DBE420D8FE6CC15D8AC10A0"><enum>(D)</enum><text display-inline="yes-display-inline">a plan to develop undergraduate and
			 graduate courses on flooding, flooding prevention, and other flood-related
			 issues;</text>
					</subparagraph><subparagraph id="H78B7BD27D0184DA8B06AF4A385A3F861"><enum>(E)</enum><text>a plan to
			 incorporate undergraduate and graduate students in the work of the
			 Consortium;</text>
					</subparagraph><subparagraph id="H264C595C37B54305A0FF5AD97FFE01F1"><enum>(F)</enum><text>a proposed budget;
			 and</text>
					</subparagraph><subparagraph id="H3D512265DC7D4DADA88FB4751D7451C3"><enum>(G)</enum><text>a certification
			 that the applicant will provide non-Federal matching funds in an amount that is
			 at least equal to 20 percent of any funds received under this Act.</text>
					</subparagraph></paragraph><paragraph id="H1B305A20216F40E48A9BD0D92F71876F"><enum>(3)</enum><header>Priority</header><text>In
			 selecting the LPI, the Director shall give priority to an applicant
			 that—</text>
					<subparagraph id="HDE6BAC70D2C94C7499B03E4B84680901"><enum>(A)</enum><text display-inline="yes-display-inline">has significant research expertise in the
			 areas of physical and environmental science, flooding, hydraulics,
			 hydroscience, engineering, and meteorology;</text>
					</subparagraph><subparagraph id="HACB27003D919428099AE18AD5718623B"><enum>(B)</enum><text>is located in a
			 State that frequently experiences non-oceanic and inland flooding;</text>
					</subparagraph><subparagraph id="HC8F556E18F124000ADCFFB4678D5F107"><enum>(C)</enum><text>has previously
			 partnered with or received funds from the Federal Government to research
			 flooding, hydrology, and watershed issues;</text>
					</subparagraph><subparagraph id="HC3A926515EF541DB8CCBC6A64F4F17EB"><enum>(D)</enum><text>has experience
			 operating a flood research center serving the State or region in which the
			 institution is located;</text>
					</subparagraph><subparagraph id="H7112578DBC414FE69E65B6C85E624573"><enum>(E)</enum><text>has the capability
			 to take a leading role in coordinating and fulfilling the purposes of the
			 Consortium; and</text>
					</subparagraph><subparagraph id="H23D15D838FE34A59A779523C022AB828"><enum>(F)</enum><text>has the capacity
			 to administer the demonstration project grant program described in
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>.</text>
					</subparagraph></paragraph></subsection><subsection id="HAE5ADABC66BE4D7498C4E5317DC79785"><enum>(b)</enum><header>Additional
			 Members</header>
				<paragraph id="HE35B72C8FF6E487FB0E5C8B360A8CEE4"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the selection of the LPI,
			 the Director, in coordination with the LPI, shall select additional
			 institutions of higher education to participate in the Consortium.</text>
				</paragraph><paragraph id="HEBA9F7AE7EF94E3D92137FD1867E5E91"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">An institution of higher education desiring
			 to be selected as a member of the Consortium shall submit an application to the
			 Director at such time, in such form, and containing such information and
			 assurances as the Director shall reasonably require. Such application shall
			 include—</text>
					<subparagraph id="H73C3E3A9C14C4BA2800F842B75656FB8"><enum>(A)</enum><text display-inline="yes-display-inline">a research proposal;</text>
					</subparagraph><subparagraph id="H945EBBFC10E747D9B56AE420AD596E16"><enum>(B)</enum><text>a description of
			 relevant current and past research conducted by the institution;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H16A905735A8A4C548585F12F08FA26C7"><enum>(C)</enum><text display-inline="yes-display-inline">a plan to develop undergraduate and
			 graduate courses on flooding, flooding prevention, and other flood-related
			 issues;</text>
					</subparagraph><subparagraph id="HE3BAD93013DC4044BE56D325BFE32565"><enum>(D)</enum><text>a plan to
			 incorporate undergraduate and graduate students in the work of the
			 Consortium;</text>
					</subparagraph><subparagraph id="H300A009A87B640C7A8AD89FD83A60A39"><enum>(E)</enum><text>a proposed budget;
			 and</text>
					</subparagraph><subparagraph id="H2C03F93DA69A4F3F9294F04DAB30F18E"><enum>(F)</enum><text>a certification
			 that the applicant will provide non-Federal matching funds in an amount that is
			 at least equal to 20 percent of any funds received under this Act.</text>
					</subparagraph></paragraph><paragraph id="H66802F1570414168973C7B8321F2A55E"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting additional members of the
			 Consortium, the Director shall give priority to an applicant that—</text>
					<subparagraph id="HAB05FD5B34C9419391182783320BE094"><enum>(A)</enum><text display-inline="yes-display-inline">has demonstrated research expertise in an
			 area or areas related to flooding; and</text>
					</subparagraph><subparagraph id="HE94B3C59E69C4118968E26B36DDCA535"><enum>(B)</enum><text>has the ability to
			 plan, coordinate, and conduct research related to flooding, flood prevention,
			 and flood-related issues.</text>
					</subparagraph></paragraph></subsection></section><section id="HA1B7578601744D578E11722AD868A8CF"><enum>6.</enum><header>Grant program for
			 demonstration projects</header>
			<subsection id="H427B07DDC1A74F8E8E545CFC34F36D91"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">From funds made available under
			 <internal-xref idref="HF6A4FA2961CE4266B41033EE6E18E9C8" legis-path="7.(a)">section 7(a)</internal-xref>, the Director shall award
			 grants to States and units of local government for the purpose of funding
			 eligible demonstration projects.</text>
			</subsection><subsection id="H65D72EED59084502A9D69065E90AF93D"><enum>(b)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section, a State or unit of local
			 government shall submit an application to the LPI at such time and in such
			 manner as the LPI, in consultation with the Director, shall reasonably
			 require.</text>
			</subsection><subsection display-inline="no-display-inline" id="H841D1803C29A442DAB5C78B0A55A9091"><enum>(c)</enum><header>Approval of
			 grant</header>
				<paragraph id="HB5893A45506B40E0915DE3A8BEA770B7"><enum>(1)</enum><header>In
			 general</header><text>The award of a grant under
			 <internal-xref idref="H427B07DDC1A74F8E8E545CFC34F36D91" legis-path="6.(a)">subsection (a)</internal-xref> shall require the approval of
			 both the LPI and the Director.</text>
				</paragraph><paragraph id="HFA4C7CF3D8864B16A47C2D6944B8D4DF"><enum>(2)</enum><header>Timing</header>
					<subparagraph id="H9FA2A78CE00947B79304E52021D0F7BE"><enum>(A)</enum><header>LPI</header><text display-inline="yes-display-inline">The LPI shall approve or reject an
			 application for a grant under
			 <internal-xref idref="H427B07DDC1A74F8E8E545CFC34F36D91" legis-path="6.(a)">subsection (a)</internal-xref> not later than 60 days after
			 receiving the completed application.</text>
					</subparagraph><subparagraph id="HAEDB202EDAB242D2BB3C77E093905774"><enum>(B)</enum><header>Director</header><text display-inline="yes-display-inline">If the LPI approves an application for a
			 grant under
			 <internal-xref idref="H427B07DDC1A74F8E8E545CFC34F36D91" legis-path="6.(a)">subsection (a)</internal-xref>, the Director shall approve
			 or reject such application not later than 30 days after approval by the
			 LPI.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H375EE3689FC04D848F98F2185C82DB1E"><enum>(d)</enum><header>Eligible
			 demonstration projects</header><text display-inline="yes-display-inline">A
			 State or unit of local government that receives a grant under
			 <internal-xref idref="H427B07DDC1A74F8E8E545CFC34F36D91" legis-path="6.(a)">subsection (a)</internal-xref> shall use such grant to fund
			 demonstration projects that—</text>
				<paragraph id="HB18B1203973E4B1A9E70DD4E9E5A594C"><enum>(1)</enum><text display-inline="yes-display-inline">implement the recommendations and best
			 practices described in
			 <internal-xref idref="H94F7CC7CEFD049EABD4148F614A50CDE" legis-path="3.(c)">section 3(c)</internal-xref>; or</text>
				</paragraph><paragraph id="HD3659556BEAA46FBA099E161143E8D40"><enum>(2)</enum><text display-inline="yes-display-inline">test new or improved techniques,
			 strategies, technologies, methods, tools, and models for predicting,
			 preventing, and minimizing flooding and its effects.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H8904A5EADEE24EF78302329405C0D88E"><enum>(e)</enum><header>Grant
			 amount</header>
				<paragraph id="HDA9072DFC2314C0D9C83DCBFF14476A0"><enum>(1)</enum><header>Limit</header><text>Except
			 as provided in
			 <internal-xref idref="H760DEB488F6C46FDB430FB96EE20D424" legis-path="6.(e)(2)">paragraph (2)</internal-xref>, a grant under this section
			 shall not exceed $250,000.</text>
				</paragraph><paragraph id="H760DEB488F6C46FDB430FB96EE20D424"><enum>(2)</enum><header>Exception</header><text>A
			 grant under this section may exceed $250,000 if—</text>
					<subparagraph id="H2D9CE2EF07564B1582D62D6F32232850"><enum>(A)</enum><text>all Consortium
			 members waive the limitation of
			 <internal-xref idref="HDA9072DFC2314C0D9C83DCBFF14476A0" legis-path="6.(e)(1)">paragraph (1)</internal-xref>;</text>
					</subparagraph><subparagraph id="H3B8BC073A01047FCA2C871D5CD3BB0EB"><enum>(B)</enum><text>the Director
			 waives the limitation of
			 <internal-xref idref="HDA9072DFC2314C0D9C83DCBFF14476A0" legis-path="6.(e)(1)">paragraph (1)</internal-xref>; and</text>
					</subparagraph><subparagraph id="HC90F861B69C44B1B915410B633303368"><enum>(C)</enum><text>the demonstration
			 project involves multiple watersheds or jurisdictions and benefits multiple
			 communities.</text>
					</subparagraph></paragraph><paragraph id="H59EDA86ED25D45148BE14B472185F2A3"><enum>(3)</enum><header>Matching
			 funds</header><text>States and units of local government that receive funds
			 under this section shall contribute non-Federal funds in an amount equal to or
			 greater than 20 percent of the amount received.</text>
				</paragraph></subsection></section><section id="H1615241DA722402FAE2886387B50F9B0"><enum>7.</enum><header>Funding</header>
			<subsection id="HF6A4FA2961CE4266B41033EE6E18E9C8"><enum>(a)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="HDB5764A5903B43F2957D700895BC8401"><enum>(1)</enum><header>In
			 general</header><text>In addition to the funds authorized to be appropriated
			 under paragraph (2), for each of the fiscal years 2012 through 2017, there is
			 authorized to be appropriated to the Administrator of NOAA $11,000,000 to carry
			 out this Act.</text>
				</paragraph><paragraph id="HFE55B3135294450EA946A2C54604BADA"><enum>(2)</enum><header>Improvement of
			 LPI facilities</header><text>There is authorized to be appropriated to the
			 Administrator of NOAA such sums as may be necessary for payments to the LPI for
			 the purposes described in
			 <internal-xref idref="H5ECC3DB587374E57AA6F672DD17EB1D9" legis-path="4.(e)">section 4(e)</internal-xref>.</text>
				</paragraph></subsection><subsection id="H0FAB36D9D6144BA999FB2203121A21DE"><enum>(b)</enum><header>Availability of
			 funds</header>
				<paragraph id="HBA06E1F59CBD43F6B83594C07EA39517"><enum>(1)</enum><header>Office of Flood
			 Research and Policy</header><text display-inline="yes-display-inline">Of the
			 amounts made available under
			 <internal-xref idref="HDB5764A5903B43F2957D700895BC8401" legis-path="7.(a)(1)">subsection (a)(1)</internal-xref> for a fiscal year, not
			 more than $2,000,000 may be used to fund the activities of the Office.</text>
				</paragraph><paragraph id="H6BAE049284E6452A98D83F56F252972A"><enum>(2)</enum><header>Lead Partner
			 Institution</header><text display-inline="yes-display-inline">Of the amounts
			 made available under
			 <internal-xref idref="HDB5764A5903B43F2957D700895BC8401" legis-path="7.(a)(1)">subsection (a)(1)</internal-xref> for a fiscal year, not
			 more than $3,000,000 may be used to fund the activities of the LPI.</text>
				</paragraph><paragraph id="H7A68F2571BBF48EFB7AF6562F966A61B"><enum>(3)</enum><header>Additional
			 members of the Consortium</header>
					<subparagraph id="H380D032A90CC43FBB8D0A7D087108135"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Of the amounts made
			 available under
			 <internal-xref idref="HDB5764A5903B43F2957D700895BC8401" legis-path="7.(a)(1)">subsection (a)(1)</internal-xref> for a fiscal year, not
			 more than $3,000,000 may be used to fund the activities of the members of the
			 Consortium other than the LPI.</text>
					</subparagraph><subparagraph id="H8ECFE08F45774A7EB2B868946A4144DC"><enum>(B)</enum><header>Limit per
			 member</header><text>Of the amounts made available under
			 <internal-xref idref="H380D032A90CC43FBB8D0A7D087108135" legis-path="7.(b)(3)(A)">subparagraph (A)</internal-xref>, not more than
			 $500,000 may be used to fund the activities of a member of the Consortium other
			 than the LPI.</text>
					</subparagraph></paragraph><paragraph id="H593425825E4B4A598851A9F0FF66955B"><enum>(4)</enum><header>Grant
			 program</header><text display-inline="yes-display-inline">Of the amounts made
			 available under
			 <internal-xref idref="HDB5764A5903B43F2957D700895BC8401" legis-path="7.(a)(1)">subsection (a)(1)</internal-xref> for a fiscal year, not
			 more than $3,000,000 may be used to fund the grant program described in
			 <internal-xref idref="HA1B7578601744D578E11722AD868A8CF" legis-path="6.">section 6</internal-xref>.</text>
				</paragraph></subsection></section><section id="HA09809F5DA984AEEBEBDCFCEB724320A"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF0D73AA5309E4C838965AC4D54A2CBF2"><enum>(1)</enum><header>Consortium</header><text>The
			 term <term>Consortium</term> means the National Flood Research and Education
			 Consortium established in section 3.</text>
			</paragraph><paragraph id="H7979F1F2596E43CEA37C85C3BFF2EA8A"><enum>(2)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the Office of Flood Research
			 and Policy established within NOAA in section 2.</text>
			</paragraph><paragraph id="HB7D430BC0F01488EA3F4DB0FA3F2E241"><enum>(3)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given such term in section 101(a) of the
			 Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text>
			</paragraph><paragraph id="HD6E5930D6DAA4DBC8C769D367FA91B22"><enum>(4)</enum><header>LPI</header><text>The
			 term <term>LPI</term> means the Lead Partner Institution described in section
			 4(a).</text>
