		<section id="HD501509452454C51A91735B5E560A791" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ending Federal Marijuana Prohibition
			 Act of 2011</short-title></quote>.</text>
		</section><section id="H18FBFAB7DB434CCEB33F4275862D218D"><enum>2.</enum><header>Application of
			 the Controlled Substances Act to marihuana</header><text display-inline="no-display-inline">Part A of the Controlled Substances Act (21
			 U.S.C. 801 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HDE54B9AA4E5D4D6AB6D73BE3AAEEAF51" style="OLC">
				<section id="H3CC1A66D280E4F4DBAA5DAAB8897FCF1"><enum>103.</enum><header>Application of
				this Act to marihuana</header>
					<subsection id="HFFC465F4370B4718BB27B5B7CAD46A2B"><enum>(a)</enum><header>Prohibition on
				certain shipping or transportation</header><text display-inline="yes-display-inline">This Act shall not apply to marihuana,
				except that it shall be unlawful only to ship or transport, in any manner or by
				any means whatsoever, marihuana, from one State, Territory, or District of the
				United States, or place noncontiguous to but subject to the jurisdiction
				thereof, into any other State, Territory, or District of the United States, or
				place noncontiguous to but subject to the jurisdiction thereof, or from any
				foreign country into any State, Territory, or District of the United States, or
				place noncontiguous to but subject to the jurisdiction thereof, when such
				marihuana is intended, by any person interested therein, to be received,
				possessed, sold, or in any manner used, either in the original package or
				otherwise, in violation of any law of such State, Territory, or District of the
				United States, or place noncontiguous to but subject to the jurisdiction
				thereof.</text>
					</subsection><subsection commented="no" id="H928C7BF729234A71BD862D210349178D"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Whoever knowingly violates subsection (a)
				shall be fined under title 18, United States Code, or imprisoned not more than
				one year, or
				both.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA4DEB0006A5D4A4DA37418D31872D9A8"><enum>3.</enum><header>Deregulation of
			 marihuana</header>
			<subsection id="H8F29945C932841C7A23EA5B233374B3D"><enum>(a)</enum><header>Removed from
			 schedule of controlled substances</header><text display-inline="yes-display-inline">Schedule I(c) of section 202(c) of the
			 Controlled Substances Act (21 U.S.C. 812(c)) is amended—</text>
				<paragraph id="HA4571C63F91C4A57ACD55F29778107E3"><enum>(1)</enum><text>by striking
			 <quote>marihuana</quote>; and</text>
				</paragraph><paragraph id="H055D682D8F5949F2B51531A3D9461FB0"><enum>(2)</enum><text>by striking
			 <quote>tetrahydrocannabinols</quote>.</text>
				</paragraph></subsection><subsection id="H306F34A3491248A2BC61117CD63EDFFB"><enum>(b)</enum><header>Removal of
			 prohibition on import and export</header><text display-inline="yes-display-inline">Section 1010 of the Controlled Substances
			 Import and Export Act (21 U.S.C. 960) is amended—</text>
				<paragraph id="H3956587735AD4E24B137A6114790E180"><enum>(1)</enum><text>by striking
			 subparagraph (G) of subsection (b)(1);</text>
				</paragraph><paragraph id="HFC666F47E8EC415EB9F349475986BF0D"><enum>(2)</enum><text>by striking
			 subparagraph (G) of subsection (b)(2); and</text>
				</paragraph><paragraph id="H8414A513E1EB45FBA9FB8B3F449CEF99"><enum>(3)</enum><text>by striking
			 paragraph (4) of subsection (b).</text>
				</paragraph></subsection></section><section id="H3CF6CD6744A84433A1CB32682FCB5821"><enum>4.</enum><header>Conforming
			 amendments to Controlled Substances Act</header>
			<subsection id="HFFC0DAD0F87F409386C547D776A4D52A"><enum>(a)</enum><text display-inline="yes-display-inline">Section 102(44) of the Controlled
			 Substances Act (21 U.S.C. 802(44)) is amended by striking
			 <quote>marihuana</quote>.</text>
			</subsection><subsection id="H020080F0D2554D809434263818BCF8B8"><enum>(b)</enum><text display-inline="yes-display-inline">Part D of the Controlled Substances Act (21
			 U.S.C. 841 et seq.) is amended as follows:</text>
				<paragraph id="H347C12613CB7419FB0DF0CCF5B8E03FD"><enum>(1)</enum><text>In section
			 401—</text>
					<subparagraph id="H29C51CF062724066B2D48F3EEFCF0F22"><enum>(A)</enum><text>by striking
			 subsection (b)(1)(A)(vii);</text>
					</subparagraph><subparagraph id="HBCA0BED342BA48EB8D8D1D73AD628574"><enum>(B)</enum><text>by striking
			 subsection (b)(1)(B)(vii);</text>
					</subparagraph><subparagraph id="H5FBD83AE171844B59802FB13D3EEAF2E"><enum>(C)</enum><text>by striking
			 subsection (b)(1)(D); and</text>
					</subparagraph><subparagraph id="HADE2DD1E587F4941A5BA1CE17C1E4CE6"><enum>(D)</enum><text>by striking
			 subsection (b)(4).</text>

				</paragraph></subsection></section><section id="H4D54DE3F82A34C078077A7510CB34288"><enum>5.</enum><header>Construction</header><text display-inline="no-display-inline">No provision of this Act shall be construed
			 to affect Federal drug testing policies, and each Federal agency shall conduct
			 a review of its drug testing policies not later than 30 days after the date of
			 enactment of this Act to ensure that the language of any such policy is in
			 accordance with this section.</text>
