		<official-title>To amend the Magnuson-Stevens Fishery Conservation and
		  Management Reauthorization Act of 2006 to provide the necessary scientific
		  information to properly implement annual catch limits, and for other
		  purposes.</official-title>

		<section id="H7BF8D47081D348E3A7250F3804FDA9F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fishery Science Improvement Act of
			 2011</short-title></quote>.</text>
		</section><section id="HCCDB8A2B7E814527BD645C4848599A99"><enum>2.</enum><header>Improvement of
			 scientific data for annual catch limits</header>
			<subsection id="H74C2290A38F9486C87305D78FEF41897"><enum>(a)</enum><header>Scientific data
			 required for annual catch limits</header>
				<paragraph id="H0AF90951FA7441CCA5CE5A3D071767DF"><enum>(1)</enum><header>In
			 general</header><text>Section 104(b) of the Magnuson-Stevens Fishery
			 Conservation and Management Reauthorization Act of 2006 (16 U.S.C. 1853 note)
			 is amended—</text>
					<subparagraph id="H8E6B1E3124DD4613AF4D2727D295DE78"><enum>(A)</enum><text>in paragraph
			 (1)(B)—</text>
						<clause id="HE078401DDB5A4749807824CBA7E8FC94"><enum>(i)</enum><text>by
			 striking <quote>2011</quote> and inserting <quote>2014</quote>; and</text>
						</clause><clause id="HD68171D5F9F645199DBC42120918583D"><enum>(ii)</enum><text>by
			 striking <quote>and</quote> after the semicolon;</text>
						</clause></subparagraph><subparagraph id="H15176216B23E4560854564D176738AAB"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="H41E0A575862C4019934992E8C449B3FB"><enum>(C)</enum><text>by redesignating
			 paragraph (3) as paragraph (5); and</text>
					</subparagraph><subparagraph id="HA805BEAE90724948923495059273EE92"><enum>(D)</enum><text>by inserting after
			 paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H7C2F4C125A234E99A14FA887B96CA4EF" style="OLC">
							<paragraph id="H11141BDC9AA0407DA44628B1DD123EB3"><enum>(3)</enum><text display-inline="yes-display-inline">shall not apply to a fishery for any stock
				of fish for which—</text>
								<subparagraph id="H72CF56EBE8FE451787ED50818CEE3610"><enum>(A)</enum><text>a peer reviewed
				stock survey and stock assessment have not been performed during the five-year
				period that ends on the date of enactment of the Fishery Science Improvement
				Act of 2011; and</text>
								</subparagraph><subparagraph id="H28DE9E3D775B43ADA3A1FB6E165223A2"><enum>(B)</enum><text>the Secretary
				determines that overfishing is not occurring;</text>
								</subparagraph></paragraph><paragraph id="H834E25CD38A54E2C8C8AFB7C0F0A7213"><enum>(4)</enum><text display-inline="yes-display-inline">shall not apply to a fishery for any stock
				of fish that is an ecosystem stock;
				and</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H17396989C64D42219ABB6F05BE9E0020"><enum>(2)</enum><header>Definition of
			 ecosystem stock</header><text display-inline="yes-display-inline">Section 104
			 of the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act
			 of 2006 (16 U.S.C. 1853 note) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H3CECFC57900546C6A24FE580C42AF267" style="OLC">
						<subsection id="HD126C8FEAF874A4491037561A9D24391"><enum>(e)</enum><header>Definition of
				ecosystem stock</header><text display-inline="yes-display-inline">In this
				section, the term <quote>ecosystem stock</quote> means a stock of fish that the
				Secretary determines—</text>
							<paragraph id="HBEB2A0F01AB642ECA316FA905F45EC05"><enum>(1)</enum><text display-inline="yes-display-inline">is a nontarget stock; and</text>
							</paragraph><paragraph id="H7CFE9BD89583456AB090A0900519D9C7"><enum>(2)</enum><text>is not overfished
				or likely to become
				overfished.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5C77F660BD314457BD65729D521B6385"><enum>(b)</enum><header>Stock assessment
			 for overfished fisheries</header><text display-inline="yes-display-inline">Section 304(e)(2) of the Magnuson-Stevens
			 Fishery Conservation and Management Act (16 U.S.C. 1854) is amended—</text>
				<paragraph id="HA47E25B4972947A1BA8A9F51810CF05B"><enum>(1)</enum><text>by striking
			 <quote>(2) If the Secretary</quote> and inserting <quote>(2)(A) If the
			 Secretary</quote>; and</text>
				</paragraph><paragraph id="H785E1810219A4BB4871E40BE537191C1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9921B996B8D54FC38BD24D84941F8CB0" style="OLC">
						<subparagraph id="HA9F737DED88F47DF9F8851EB61CBF92C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 270 days after the Secretary
				makes a determination described in subparagraph (A), the Secretary shall
				perform a stock survey and stock assessment of each of the stocks that are
				overfished in the fishery and transmit the assessment to the appropriate
				Council.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
