		  to provide that the statute of limitations must be raised as an affirmative

		<section id="H81374AC5CE0C4097B7B12C4F618EB2F6" section-type="section-one"><enum>1.</enum><header>Statute of limitations in
			 certain civil actions</header><text display-inline="no-display-inline">Section
			 1605A(b) of title 28, United States Code, is amended by adding at the end the
			 following flush sentence:</text>
			<quoted-block display-inline="no-display-inline" id="H78B1A783464049159C62C662012815C9" style="OLC">
				<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The
				limitations period provided in this subsection is an affirmative defense that
				is waived if it is not timely raised in a responsive
				pleading.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H153FE291D6FB48589899DBADDA27AFA4"><enum>2.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendment made by
			 section 1 applies to any case that is pending on, or is brought on or after,
			 the date of the enactment of this Act.</text>
