		<section display-inline="no-display-inline" id="H1144094AB8ED49EAA032856785CB43E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children’s Act for Responsible
			 Employment of 2011</short-title></quote> or the <quote><short-title>CARE Act of 2011</short-title></quote>.</text>
		</section><section id="HA6A39AD895AB4A9B9B4DF53527275BE5"><enum>2.</enum><header>Amended
			 Definitions</header><text display-inline="no-display-inline">Section 3(l) of
			 the Fair Labor Standards Act of 1938 (29 U.S.C. 203(l)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H985FFDF58C064287859301F1B81B14E0" style="traditional">
				<subsection id="H1776D9B9CB87471FABD629DC97241C54"><enum>(l)</enum><text><term>Oppressive
				child labor</term> means a condition of employment under which—</text>
					<paragraph id="HA7038110F0B949DEBBB21359A605A753"><enum>(1)</enum><text>any employee who
				is 16 or 17 years of age is employed by an employer in any occupation found by
				the Secretary and by order declared to be particularly hazardous for the
				employment of children between such ages or detrimental to their health or
				well-being;</text>
					</paragraph><paragraph id="H662C6CCD0E254C10A09177EDEE0AA141"><enum>(2)</enum><text>any employee who
				is 14 or 15 years of age is employed by an employer, unless the Secretary has
				determined that the employment is confined to periods which will not interfere
				with the schooling of the employee, and that the conditions of employment will
				not interfere with the health and well-being of the employee; or</text>
					</paragraph><paragraph id="H31420E45A6BA458D8A9204624A91B388"><enum>(3)</enum><text display-inline="yes-display-inline">any employee who is under 14 years of age
				is employed by an
				employer.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA835DABBEFF443169836F56F5B4B0B93"><enum>3.</enum><header>Revised age
			 requirement for child agricultural employment; repeal of waiver provision for
			 hand harvest laborers</header>
			<subsection id="HAC850610648D461D8EF137EA6B635315"><enum>(a)</enum><header>Revised age
			 requirement</header><text display-inline="yes-display-inline">Section 13(c) of
			 the Fair Labor Standards Act of 1938 (29 U.S.C. 213(c)) is amended by striking
			 paragraphs (1) and (2) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1847C0574A7A46F798F179F7FC4CC557" style="traditional">
					<paragraph id="HFD7943DF2275441D800A634B938DB24A"><enum>(1)</enum><text display-inline="yes-display-inline">The provisions of section 12 relating to
				child labor shall not apply to any employee under 18 years of age who is
				employed in agriculture by his or her parent, or by a person standing in the
				place of the parent, on a farm owned by the parent or person.</text>
					</paragraph><paragraph id="HB694047A98844BFFADF6B4015F6054DC"><enum>(2)</enum><text display-inline="yes-display-inline">The provisions of section 12 relating to
				child labor shall not apply to any employee under 16 years of age who is
				employed by his or her parent, or by a person standing in the place of the
				parent, in employment other than agricultural employment, manufacturing,
				mining, or any other employment the Secretary finds to be particularly
				hazardous for the employment of a child 16 or 17 years of age or detrimental to
				their health or well
				being.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H85AABD557D1A4CC2AD359C5B45030DCB"><enum>(b)</enum><header>Repeal of waiver
			 provision</header><text>Section 13(c) of such Act (29 U.S.C. 213(c)) is further
			 amended by striking paragraph (4) and redesignating paragraphs (5) through (7)
			 as paragraphs (4) through (6), respectively.</text>
			</subsection></section><section id="H4C5E86328BA24B0994CCED8BF1754942"><enum>4.</enum><header>Increased civil
			 penalties for child labor violations</header><text display-inline="no-display-inline">Paragraph (1) of section 16(e) of the Fair
			 Labor Standards Act of 1938 (29 U.S.C. 216(e)(1)) is amended—</text>
			<paragraph id="HBFF33D83D4C142ECB4FC0F856663BC62"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>person</quote> each
			 place it appears and inserting <quote>employer</quote>;</text>
			</paragraph><paragraph id="H830FDEB514154AF3B527FFCE6880A6D4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>
				<subparagraph id="HE66B76DF32174A498D98CE5B616C58EE"><enum>(A)</enum><text>by striking
			 <quote>not to exceed</quote> and inserting <quote>of</quote>; and</text>
				</subparagraph><subparagraph id="HAC4452598BF642A29278461DE34AF0E2"><enum>(B)</enum><text>by amending
			 clauses (i) and (ii) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H44F8FE0E65464785B289DE1F69824683" style="traditional">
						<clause id="H4182EAFD778B4BC3B39B60225262AB66" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">not less than $500 and not more than
				$15,000 for each employee who was the subject of such a violation; or</text>
						</clause><clause id="H2538C58C9F4F4BA196B59E88F31F1F37" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">not less than $15,000 and not more than
				$50,000 with regard to each such violation that causes the serious injury,
				serious illness, or death of any employee under the age of 18 years, which
				penalty may be doubled where the violation is a repeated or willful
				violation.</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HC5F0D78F1D6648ED8A6772506B6986F7"><enum>(3)</enum><text>in subparagraph
			 (B) by striking <quote>the term <term>serious injury</term> means</quote> and
			 inserting <quote>the terms <term>serious injury</term> and <term>serious
			 illness</term> mean</quote>.</text>
			</paragraph></section><section id="H4528C284D0EF4F9B960130C6163899F0"><enum>5.</enum><header>Special criminal
			 penalties for certain aggravated child labor violations</header><text display-inline="no-display-inline">Section 16 of the Fair Labor Standards Act
			 of 1938 (29 U.S.C. 216) is amended—</text>
			<paragraph id="H688EB78AC03A4E56A81B88660F08EFED"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>Any
			 person</quote> and inserting <quote>Except as provided in subsection (f), any
			 person</quote>; and</text>
			</paragraph><paragraph id="H5F8832D4146C486FBC2F003E60728AC2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H58337A4ABF6E431FA370B8F1AE905435" style="OLC">
					<subsection id="HAAA3F573E2344AEAB4C3C09D3932C685"><enum>(f)</enum><text display-inline="yes-display-inline">Any person who repeatedly or willfully
				violates any of the provisions of section 12, and such violations result in or
				cause the death or serious injury or serious illness of an employee under 18
				years of age at the time of such violation, shall be subject to imprisonment
				for not more than 5 years or a fine under title 18, United States Code, or
				both.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB7C45DE14FC84DE789BE3CDCA58B0149"><enum>6.</enum><header>Pesticide-related
			 worker protection standard</header><text display-inline="no-display-inline">Congress finds and declares that the
			 employment of children under the age of 18 in the occupation of a pesticide
			 handler as defined in the worker protection standard for workers exposed to
			 pesticides in part 170 of title 40, Code of Federal Regulations, is
			 particularly hazardous to such children and detrimental to their health and
			 well-being. The Secretary of Labor shall revise part 570 of title 29, Code of
			 Federal Regulations, to prohibit the employment of a child under the age of 18
			 to perform any of the tasks or duties described in the definition of the term
			 <quote>handler</quote> in section 170.3 of title 40, Code of Federal
			 Regulations.</text>
		</section><section id="H77963E687138429094280A75E83A4778"><enum>7.</enum><header>Application of
			 fair labor standards amendments</header>
			<subsection id="HC9D9B40D1BD74C58AD2672F3698A9432"><enum>(a)</enum><header>Rulemaking</header><text>The
			 Secretary of Labor may prescribe rules as necessary to implement the amendments
			 made by sections 2 through 5 and the revision required by section 6. Any such
			 rules issued shall take effect not later than 30 days after the date on which
			 such rules are published in the Federal Register.</text>
			</subsection><subsection id="H8B3C77EB72FE4F4DA7F294637673565A"><enum>(b)</enum><header>Violations</header><text>The
			 amendments made by sections 2, 3, 4, and 5 and the revision required by section
			 7 shall apply to violations of the Fair Labor Standards Act of 1938 (29 U.S.C.
			 201 et seq.) that occur after the date on which the rules issued under
			 subsection (a) take effect.</text>
			</subsection><subsection id="HE74A3EA80F5043898B42C3A90AC25E54"><enum>(c)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in the
			 amendments made by section 3, 4, or 5 or in the revision required by section 7
			 shall be construed to preempt any State law that provides protections or
			 remedies for employees that are greater than the protections or remedies
			 provided under such amendments or such revision.</text>
