			 contents</header>
			<subsection id="HC6C4E4E897A94C71A5A03C89D2EE4D85"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Medical Gas Safety
			 Act</short-title></quote>.</text>

			</subsection></section><section id="H2C7B6195DDDE475B99F6554B53422F98"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H8FC02A45737343D29DF00C2B7A896DBD"><enum>(1)</enum><text>Medical gases have
			 been used broadly by the medical community for many decades and are critical to
			 ensuring the public health.</text>
			</paragraph><paragraph id="HEC2E7AB929C0499FA281992B94B2A7F1"><enum>(2)</enum><text>Most medical gases
			 predate the new drug approval provisions in the Federal Food, Drug, and
			 Cosmetic Act (21 U.S.C. 301 et seq.) and, consequently, medical gases have been
			 marketed for many years without new drug approval.</text>
			</paragraph></section><section id="H6E682495C7984A6A99A7DC84D5A7B3A1"><enum>3.</enum><header>Regulation of
			 medical gases</header>
			<subsection id="H744547AC4FA84C6CB7AD3E87DCEF9678"><enum>(a)</enum><header>Adulteration</header>
				<paragraph id="H82D810BC68D64CCE9854B0A1ECAEB448"><enum>(1)</enum><header>In
			 general</header><text>Section 501(a)(2) of the Federal Food, Drug, and Cosmetic
			 Act (21 U.S.C. 351(a)(2)) is amended by striking <quote>; or (3)</quote> and
			 inserting <quote>; or (D) if it is a medical gas (as defined in section 575)
			 and it is manufactured, prepared, processed, packed, or held in violation of
			 subchapter G or regulations thereunder; or (3)</quote>.</text>
				</paragraph><paragraph id="HD682BA51BC0E49509186C5CAB5A26E40"><enum>(2)</enum><header>Applicability</header><text>The
			 amendment made by paragraph (1) applies beginning on the date that is 2 years
			 after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="H7DBBD50D77F14E6394988908947C8B65"><enum>(b)</enum><header>Regulation</header><text display-inline="yes-display-inline">Chapter V of the Federal Food, Drug, and
			 Cosmetic Act (21 U.S.C. 351 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HFE09B5F90B474FCAB3B88EDF41C13E15" style="OLC">
					<subchapter id="H4D131582B87442289FF9444F67AAC287"><enum>G</enum><header>Medical
				Gases</header>
						<section id="HE2E86D202F8F42C5BF4E0ECA6AFF25A4"><enum>575.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text>
							<paragraph commented="no" id="H711E864C95044B7A8BD56495607F49F1"><enum>(1)</enum><text>The term
				<term>designated medical gas</term> means any of the following:</text>
								<subparagraph commented="no" id="H5CA5CD36C8164CB9819FE4352A90DEA0"><enum>(A)</enum><text>Oxygen, as defined
				in the United States Pharmacopeia (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="HA3DFAA372E194BA2BFD331A9B2D95109"><enum>(B)</enum><text>Nitrogen, as
				defined in the National Formulary (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="H3E429C460ED6439981887509E2B73FEC"><enum>(C)</enum><text display-inline="yes-display-inline">Nitrous oxide, as defined in the United
				States Pharmacopeia (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="HA91A324998624D17A1F36011F1C6F445"><enum>(D)</enum><text display-inline="yes-display-inline">Carbon dioxide, as defined in the United
				States Pharmacopeia (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="HC3545CC4756C4BF1A75F6EF3A79401CD"><enum>(E)</enum><text display-inline="yes-display-inline">Helium, as defined in the United States
				Pharmacopeia (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="H840B6724A17A45C393060D2B0F8DBB75"><enum>(F)</enum><text display-inline="yes-display-inline">Medical air, as defined in the United
				States Pharmacopeia (or any successor publication).</text>
								</subparagraph><subparagraph commented="no" id="H502904D6F3534201BE871F50C90A7918"><enum>(G)</enum><text>Any other medical
				gas deemed appropriate by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H467EB553FE8D41CAA3419F512D9EB269"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>medical gas</term> means a
				drug that is—</text>
								<subparagraph id="H7553C07FF02042749D78BE9077A0A47B"><enum>(A)</enum><text>manufactured or
				stored in a liquefied, non-liquefied, or cryogenic state; and</text>
								</subparagraph><subparagraph id="HE341D8D56F2F4208AEF0EBD16B625B7E"><enum>(B)</enum><text>is administered as
				a gas.</text>
								</subparagraph></paragraph><paragraph id="H7CF9260BB5044836A613BAE71CB0BCBB"><enum>(3)</enum><text>The term
				<term>Medical Gas Advisory Committee</term> means the Medical Gas Advisory
				Committee established under section 577.</text>
							</paragraph><paragraph id="HFDF39C9DB75D40FAA8CB523DB48D356E"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>medical gas
				manufacturer</term> means an entity that owns or operates an establishment
				registered under section 510 that manufactures, prepares, processes, packages,
				repackages, or labels a medical gas or that fills high-pressure medical gas
				cylinders or cryogenic medical gas containers by any of the following methods:
				liquid to liquid, liquid to gas, or gas to gas.</text>
							</paragraph></section><section id="H92B763320668439F858571FEFACEFC21"><enum>576.</enum><header>Regulation of
				medical gases</header>
							<subsection id="HABE469C1B466420E87D03A2BB7C2DE1F"><enum>(a)</enum><header>Certification of
				designated medical gases</header>
								<paragraph id="H1BEDF73CAD114BA9AFD83F311B16C500"><enum>(1)</enum><header>Submission</header><text>Any
				person may file with the Secretary a certification that a medical gas is a
				designated medical gas.</text>
								</paragraph><paragraph id="H507CD56D75134AC9AE92FADFCE8E5089"><enum>(2)</enum><header>Approval of
				certification</header><text>The Secretary shall approve a certification
				submitted under paragraph (1) with respect to a medical gas if the
				certification demonstrates to the Secretary’s satisfaction that the medical gas
				is a designated medical gas.</text>
								</paragraph><paragraph id="H77675A43CE1B473BA59CB0C6070CC875"><enum>(3)</enum><header>Effect of
				approval of certification</header>
									<subparagraph id="H846DF1A79F284793A96244B21B5327BC"><enum>(A)</enum><header>In
				general</header><text>A medical gas subject to a certification for which an
				approval is in effect under paragraph (2) is deemed to be approved pursuant to
				an application filed pursuant to section 505(b) or 512(b)(1), as applicable,
				for—</text>
										<clause id="H133C318E8AE9418B90F874708B02BAD7"><enum>(i)</enum><text>those indications
				for which the medical gas has been marketed to a material extent for a material
				time; or</text>
										</clause><clause id="H2A0BC5FE3B73406E83C8AE10A93F2959"><enum>(ii)</enum><text>for
				administration in a supervised clinical setting under the direction of a
				medical or veterinary, as applicable, professional.</text>
										</clause></subparagraph><subparagraph id="HD7A9F4D0ED714937873F41A632165CD8"><enum>(B)</enum><header>Inapplicability
				of exclusivity provisions</header><text>Sections 505(c)(3)(E), 505(j)(5)(F),
				and 512(c)(2)(F) do not apply with respect to the approval of a designated
				medical gas under this subsection.</text>
									</subparagraph></paragraph><paragraph id="H169473DF58754F5F945465A8C28F1158"><enum>(4)</enum><header>Registration and
				listing under section 510</header><text>To the greatest extent possible, the
				Secretary shall streamline the certification and approval process under this
				subsection with the registration and listing process under section 510.</text>
								</paragraph></subsection><subsection id="H873CD0A632494E06B8CE19536E9378F0"><enum>(b)</enum><header>Approval of
				non-Designated medical gases</header>
								<paragraph id="H06F41E33E7D24C15BCCCFE310174DC60"><enum>(1)</enum><header>Procedures</header><text>Not
				later than 2 years after the date of the enactment of this subchapter, the
				Secretary, in consultation with the Medical Gas Advisory Committee, shall
				establish by rule appropriate procedures for the approval of medical gases that
				are not designated medical gases pursuant to section 505 or 512, as
				applicable.</text>
								</paragraph><paragraph id="H0CA15A16B2294DF385E72B18B5881546"><enum>(2)</enum><header>Submission of
				new drug applications and abbreviated new drug applications</header>
									<subparagraph id="HB718A9AE3E9841BB949B336A7D7FE81C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (B), the Secretary shall not require the submission of a new drug
				application or an abbreviated new drug application under subsection (b) or (j)
				of section 505, or a new animal drug application or an abbreviated new animal
				drug application under subsection (b)(1) or (b)(2) of section 512, for any
				medical gas that is not a designated medical gas during the period ending on
				the later of—</text>
										<clause id="H04AB9CD043CB48CF8FAAFF8373AAC1B2"><enum>(i)</enum><text>4
				years after the date of the enactment of this subchapter; or</text>
										</clause><clause id="HB8B8CCBE0A854BF08D22FB3711950540"><enum>(ii)</enum><text>2
				years after the date on which the Secretary establishes applicable procedures
				under paragraph (1).</text>
										</clause></subparagraph><subparagraph id="H9851E4A1BE2B42A8A91A7042D719AD37"><enum>(B)</enum><header>Exceptions</header><text>Nothing
				in this subchapter—</text>
										<clause id="H24B62DAD6382453FA9A60686FE833A14"><enum>(i)</enum><text>prohibits the
				voluntary submission of an application under subsection (b) or (j) of section
				505 or subsection (b)(1) or (b)(2) of section 512 for a medical gas; or</text>
										</clause><clause id="H2FE192F37A7C43838C6452DDB5FB954D"><enum>(ii)</enum><text>constitutes an
				exemption from the requirements under section 505(i) or section 512(j)
				(relating to investigational new drugs and investigational new animal drugs,
				respectively).</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H009626A7F0354A5B9C526AA2F413FA09"><enum>(c)</enum><header>Separate
				regulations for medical gases</header>
								<paragraph id="H30BEE37697A24FAAADC5C94658B0FF7F"><enum>(1)</enum><header>In
				general</header><text>Not later than 2 years after the date of the enactment of
				this subchapter, the Secretary, in consultation with the Medical Gas Advisory
				Committee, shall establish by separate and specific regulation—</text>
									<subparagraph id="HC033ACA4393F4ABD9B42BD37AC1616A9"><enum>(A)</enum><text>appropriate
				current good manufacturing practice requirements for medical gases;</text>
									</subparagraph><subparagraph id="H0EAB756FD70347A187053C0CEEDAFC96"><enum>(B)</enum><text>separate labeling
				requirements for medical gases;</text>
									</subparagraph><subparagraph id="H8431912EA4394EBC811E3169B32E355E"><enum>(C)</enum><text>separate wholesale
				distribution requirements for medical gases;</text>
									</subparagraph><subparagraph id="H239F750EF50A4F4CAE21A51B3ADC2D70"><enum>(D)</enum><text>a streamlined
				electronic process for registration, and listing of medical gases, under
				section 510 by medical gas manufacturers that are small business concerns (as
				defined in section 3 of the Small Business Act); and</text>
									</subparagraph><subparagraph id="HE9F14A8604F141A1B724A748CD5610A4"><enum>(E)</enum><text>separate and
				proportionate product tracking and anticounterfeiting rules for medical
				gases.</text>
									</subparagraph></paragraph><paragraph id="H77E11172F06949E0B34EE0E15745AC2F"><enum>(2)</enum><header>Evaluation in
				rulemaking</header><text>In any regulation of the Food and Drug Administration
				pertaining to drugs or drug manufacturers that is pending finalization as of
				the date of the enactment of this subchapter or is proposed after such date,
				the Secretary shall specifically evaluate the effect of such regulation on, and
				the suitability of such regulation for, medical gases and medical gas
				manufacturers. Based on such evaluation, the Secretary shall include in the
				regulation an accommodation, unique application, or exemption for medical gases
				and medical gas manufacturers as appropriate given the special characteristics
				of medical gases.</text>
								</paragraph><paragraph id="H5BBFBCB33EC74B678C72DE6901682C94"><enum>(3)</enum><header>Coordination
				with States</header>
									<subparagraph id="H6D51BFF6AE824CE1843A917282132654"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the Medical Gas Advisory Committee, shall establish a
				separate risk-based inspection regime specific to medical gas manufacturers
				that ensures coordination with State and local inspection activities and seek
				to enter into partnership agreements in order to improve the coordination and
				efficiency of Federal and State efforts to regulate medical gas manufacturers
				and medical gases. Such agreements shall—</text>
										<clause id="H74C10D7B0F014866A7C2BFBF69EB29D8"><enum>(i)</enum><text>ensure consistent
				inspector training between State and Federal authorities;</text>
										</clause><clause id="HC665D4C5ECD14E6085F164A883094641"><enum>(ii)</enum><text>eliminate, to the
				extent practicable, any overlapping fees or inspection fees or activities
				between State and Federal inspectors;</text>
										</clause><clause id="H5A8DC5C9F8EB448995ABE8ADD97DD832"><enum>(iii)</enum><text>promote current
				good manufacturing practice compliance;</text>
										</clause><clause id="H900DBA131AEA4940AF07178E1B12F625"><enum>(iv)</enum><text>ensure consistent
				application of Federal regulations with respect to medical gas manufacturers;
				and</text>
										</clause><clause id="HF0C4BA57B93B44A0AAE5B8E44475503C"><enum>(v)</enum><text>include any
				mechanisms determined by the Secretary, in consultation with the Medical Gas
				Advisory Committee, to improve the coordination and efficiency of Federal and
				State efforts to regulate medical gas manufacturers and medical gases.</text>
										</clause></subparagraph><subparagraph id="H5D8097815392481CB47B0BE0C318B234"><enum>(B)</enum><header>Dissemination of
				information</header><text display-inline="yes-display-inline">The Secretary
				shall disseminate appropriate information to States regarding application of
				Federal regulations to medical gas manufacturers and medical gases in order to
				improve the consistency of enforcement of applicable regulations.</text>
									</subparagraph></paragraph></subsection></section><section id="H21290DE1449B4E0394EFA59269A7CCD7"><enum>577.</enum><header>Medical gas
				advisory committee</header>
							<subsection id="H42BF5D8B07E3414B9E0AB28CD5737F13"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
				the enactment of this subchapter, the Secretary shall establish a permanent
				advisory committee to be known as the Medical Gas Advisory Committee.</text>
							</subsection><subsection id="HEF0789F5FC99421C95323126ABE3BAB8"><enum>(b)</enum><header>Membership</header><text>The
				Medical Gas Advisory Committee—</text>
								<paragraph id="HBEF6BB7CA80F4FF19111E32770AD3B76"><enum>(1)</enum><text>shall include
				representatives of medical gas manufacturers and medical gas safety standards
				development organizations; and</text>
								</paragraph><paragraph id="HFABD30D541834362894573AF737C748A"><enum>(2)</enum><text>may include
				representatives of patient advocacy groups, professional associations,
				physicians, scientists, other medical professionals licensed to manufacture or
				use medical gases (such as pulmonologists, respiratory therapists,
				veterinarians, and anesthesiologists), and other stakeholders as determined
				appropriate by the Secretary.</text>
								</paragraph></subsection><subsection id="H81A047B2D3AF43A9BEFF886DB3999637"><enum>(c)</enum><header>Duties</header><text>The
				Medical Gas Advisory Committee shall provide the Secretary with regular
				guidance and specific advice on medical gas regulatory initiatives, including
				with respect to regulations concerning the approval of medical gases under
				sections 505 and 512, the manufacture of medical gases, and related
				activities.</text>
							</subsection><subsection id="H33626AF19369408B8D31852E6B2CADF3"><enum>(d)</enum><header>FACA</header><text>Except
				as inconsistent with this section, the Medical Gas Advisory Committee shall be
				subject to the Federal Advisory Committee
				Act.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H5B02B6FDCF7141458C4010F61402BA82"><enum>4.</enum><header>Fees relating to
			 medical gas regulation</header>
			<subsection id="H3C3FF3FD95B4467EAF3F757392B08F76"><enum>(a)</enum><header>Finding</header><text>The
			 Congress finds that the fees authorized by the amendment made in subsection (b)
			 will be dedicated towards the costs of the Food and Drug Administration’s
			 regulation of non-designated medical gases, as set forth in the goals
			 identified for purposes of part 6 of subchapter C of chapter VII of the Federal
			 Food, Drug, and Cosmetic Act, in the letters from the Secretary of Health and
			 Human Services to the Chairman of the Committee on Health, Education, Labor,
			 and Pensions of the Senate and the Chairman of the Committee on Energy and
			 Commerce of the House of Representatives, as set forth in the Congressional
			 Record.</text>
			</subsection><subsection id="H5068C0AADE034D14961E2D5218A22F27"><enum>(b)</enum><header>Authority To
			 assess and collect fees</header><text display-inline="yes-display-inline">Subchapter C of chapter VII (21 U.S.C. 379f
			 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H08DBBA4F8E2643F69391AF0F12C273E3" style="OLC">
					<part id="H4CA646D26B894C87BB4C05E0A5D23035"><enum>6</enum><header>Fees
				relating to medical gases</header>
						<section id="HEE120A9D874B4E44937D3AE6754F8F21"><enum>744.</enum><header>Authority to
				assess and collect fees</header>
							<subsection id="H70C459EFBF18406C9C4B7CDCB7F341B6"><enum>(a)</enum><header>Fees relating to
				non-Designated medical gases</header><text display-inline="yes-display-inline">For fiscal year 2013 and each subsequent
				fiscal year, the Secretary, in consultation with the Medical Gas Advisory
				Committee, shall assess and collect fees under this section from each category
				of persons that, with respect to drugs that are non-designated medical gases,
				would be subject to a fee under section 736(a), 740(a), or 741(a) but for the
				operation of subsection (c).</text>
							</subsection><subsection id="HE4107D26D25B4CE797DE0A808219829F"><enum>(b)</enum><header>Exemption for
				designated medical gases</header><text>Subsection (a) does not authorize the
				assessment or collection of any fee with respect to drugs that are designated
				medical gases.</text>
							</subsection><subsection id="H089EC75E44314D448734C3706030C979"><enum>(c)</enum><header>Inapplicability
				of other drug fees to medical gases</header><text>Fees under sections 736(a),
				740(a), and 741(a) shall not be assessed or collected insofar as such fees
				relate to drugs that are medical gases.</text>
							</subsection><subsection id="HCA2A9C362C654418AFCE1F54733F87D1"><enum>(d)</enum><header>Establishment</header><text>The
				Secretary shall by regulation establish the amount of fees under this section
				for a fiscal year—</text>
								<paragraph id="H44C8F8F132AB476892E85DF670DE2269"><enum>(1)</enum><text>so as to generate
				a total revenue amount not exceeding the Secretary’s estimate of 100 percent of
				the costs of the Food and Drug Administration’s regulation of non-designated
				medical gases during such year; and</text>
								</paragraph><paragraph id="H345C940F096447F88BF832BD11408B83"><enum>(2)</enum><text display-inline="yes-display-inline">taking into consideration the special
				characteristics of non-designated medical gases, including the unique
				manufacturing and distribution system required to produce non-designated
				medical gases.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H8B66C7F722CF46D88FFE987FED61F5E4"><enum>(e)</enum><header>Crediting and
				Availability of Fees</header>
								<paragraph id="H5F5A1D4BEADD4AA88CB54F3ABC0B0B16"><enum>(1)</enum><header>In
				general</header><text>Fees authorized under subsection (a) shall be collected
				and available for obligation only to the extent and in the amount provided in
				advance in appropriations Acts. Such fees are authorized to remain available
				until expended. Such sums as may be necessary may be transferred from the Food
				and Drug Administration salaries and expenses appropriation account without
				fiscal year limitation to such appropriation account for salaries and expenses
				with such fiscal year limitation. The sums transferred shall be available
				solely for the costs of the Food and Drug Administration’s regulation of
				non-designated medical gases.</text>
								</paragraph><paragraph id="H9530E01580734673B040271FA4655BCD"><enum>(2)</enum><header>Collections and
				appropriation acts</header>
									<subparagraph id="HCC9368EC77E7448690A018E4B07572E4"><enum>(A)</enum><header>In
				general</header><text>The fees authorized by this section—</text>
										<clause id="H92020E60A5C24FD8942260CD41B0FE40"><enum>(i)</enum><text>shall be retained
				in each fiscal year in an amount not to exceed the amount specified in
				appropriation Acts, or otherwise made available for obligation, for such fiscal
				year; and</text>
										</clause><clause id="H9D31D218FB2840669A7224B65879B9A9"><enum>(ii)</enum><text>shall only be
				collected and available to pay the costs of the Food and Drug Administration’s
				regulation of non-designated medical gases.</text>
										</clause></subparagraph><subparagraph id="HE8C979A4CED44BF48D0A647F699D3708"><enum>(B)</enum><header>Compliance</header><text>The
				Secretary shall be considered to have met the requirements of subparagraph
				(A)(ii) in any fiscal year if the costs funded by appropriations and allocated
				for the costs of the Food and Drug Administration’s regulation of
				non-designated medical gases—</text>
										<clause id="H3D00C922C87542E98507E93BD4C2EE20"><enum>(i)</enum><text>are not more than
				3 percent below the level specified in subparagraph (A)(ii); or</text>
										</clause><clause id="HFB6BA9773697468E924DB5E2651116D4"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H0406B5193098437DBA7516E794E35409"><enum>(I)</enum><text>are more than 3 percent
				below the level specified in subparagraph (A)(ii), and fees assessed for the
				fiscal year following the subsequent fiscal year are decreased by the amount in
				excess of 3 percent by which such costs fell below the level specified in such
				subparagraph; and</text>
											</subclause><subclause id="H902D465A544D4CB2A2B4BE452782397C" indent="up1"><enum>(II)</enum><text>such costs are not more than 5 percent
				below the level specified in such subparagraph.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="HAA88A11E62D44721992E292ABE29B834"><enum>(3)</enum><header>Authorization of
				appropriations</header><text>For each of the fiscal years 2013 through 2017,
				there is authorized to be appropriated for fees under this section an amount
				equal to the total revenue amount determined under subsection (d) for the
				fiscal year.</text>
								</paragraph><paragraph id="HA2BA4288F1CB4A70815E17E9F5D9165C"><enum>(4)</enum><header>Offset</header><text>If
				the sum of the cumulative amount of fees collected under this section for the
				fiscal years 2013 through 2015 and the amount of fees estimated to be collected
				under this section for fiscal year 2016 exceeds the cumulative amount
				appropriated under paragraph (3) for the fiscal years 2013 through 2016, the
				excess shall be credited to the appropriation account of the Food and Drug
				Administration as provided in paragraph (1), and shall be subtracted from the
				amount of fees that would otherwise be authorized to be collected under this
				section pursuant to appropriation Acts for fiscal year 2017.</text>
								</paragraph></subsection><subsection id="H7D7579464C2644C1A8DC03283ADD7EB2"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H929B9314F61E4E268F2CC6E49D644195"><enum>(1)</enum><text>The terms
				<term>designated medical gas</term> and <term>medical gas</term> have the
				meanings given to such terms in section 575.</text>
								</paragraph><paragraph id="HB89E8F6701C34DC9810DA6D8752DA74A"><enum>(2)</enum><text>The term
				<term>non-designated medical gas</term> means a medical gas that is not a
				designated medical
				gas.</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9531152A46FD45DE92E55D12DEBD9F79"><enum>(c)</enum><header>Reauthorization;
			 reporting requirements</header><text display-inline="yes-display-inline">Part 6
			 of subchapter C of chapter VII (21 U.S.C. 379f et seq.), as added by subsection
			 (a), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H17B60B9F7BAE47B6A7E2758D78C93776" style="OLC">
					<section id="H1F35D77B4CC44CEFA1534B2B361DEE9C"><enum>744A.</enum><header>Reauthorization;
				reporting requirements</header>
						<subsection id="HB85B5E8C85F24EE2A218E5D3F3515B22"><enum>(a)</enum><header>Performance
				Report</header><text display-inline="yes-display-inline">Beginning with fiscal
				year 2013, not later than 120 days after the end of each fiscal year for which
				fees are collected under this part, the Secretary shall prepare and submit to
				the Committee on Energy and Commerce of the House of Representatives and the
				Committee on Health, Education, Labor, and Pensions of the Senate a report
				concerning the progress of the Food and Drug Administration in achieving the
				goals identified in the letters described in section 4(a) of the
				<short-title>Medical Gas Safety Act</short-title> during
				such fiscal year and the future plans of the Food and Drug Administration for
				meeting the goals.</text>
						</subsection><subsection id="HCEC7E53CCD9B4C70BDCE6CEBC3D3C41A"><enum>(b)</enum><header>Fiscal
				Report</header><text>Beginning with fiscal year 2013, not later than 120 days
				after the end of each fiscal year for which fees are collected under this part,
				the Secretary shall prepare and submit to the Committee on Energy and Commerce
				of the House of Representatives and the Committee on Health, Education, Labor,
				and Pensions of the Senate a report on the implementation of the authority for
				such fees during such fiscal year and the use, by the Food and Drug
				Administration, of the fees collected for such fiscal year.</text>
						</subsection><subsection id="H72C74501C3414103B09AF8C983CEA278"><enum>(c)</enum><header>Public
				Availability</header><text>The Secretary shall make the reports required under
				subsections (a) and (b) available to the public on the Internet Web site of the
				Food and Drug Administration.</text>
						</subsection><subsection id="HED2382836ADC46C1B65853B551366AB3"><enum>(d)</enum><header>Reauthorization</header>
							<paragraph id="H07B6AFF971B14BF6BF6700AC5162918F"><enum>(1)</enum><header>Consultation</header><text>In
				developing recommendations to present to the Congress with respect to the
				goals, and plans for meeting the goals, for the Food and Drug Administration’s
				regulation of non-designated medical gases for the first 5 fiscal years after
				fiscal year 2017, and for the reauthorization of this part for such fiscal
				years, the Secretary shall consult with—</text>
								<subparagraph id="HB683269D2919408BA70004D6C8B7D5FF"><enum>(A)</enum><text>the Committee on
				Energy and Commerce of the House of Representatives;</text>
								</subparagraph><subparagraph id="H3233693D6A8F412CB11C0CCE8C04DBC2"><enum>(B)</enum><text>the Committee on
				Health, Education, Labor, and Pensions of the Senate;</text>
								</subparagraph><subparagraph id="HA8C7109CD2DE4AFD96902B52DA4B9CB3"><enum>(C)</enum><text>scientific and
				academic experts;</text>
								</subparagraph><subparagraph id="H0A4799F79B844A3086FADD81DBC6E66D"><enum>(D)</enum><text>health care
				professionals;</text>
								</subparagraph><subparagraph id="H8B8EADB25C3548239DEC636B72BECA6F"><enum>(E)</enum><text>representatives of
				patient and consumer advocacy groups; and</text>
								</subparagraph><subparagraph id="H5EB6BC4980264AF8BD7E2587F331A7B3"><enum>(F)</enum><text>the regulated
				industry.</text>
								</subparagraph></paragraph><paragraph id="H9F606066C93B4C9C9A16AE856F86251E"><enum>(2)</enum><header>Prior public
				input</header><text>Prior to beginning negotiations with the regulated industry
				on the reauthorization of this part, the Secretary shall—</text>
								<subparagraph id="HF8ECD103E4804E259590F9EF63FF266B"><enum>(A)</enum><text>publish a notice
				in the Federal Register requesting public input on the reauthorization;</text>
								</subparagraph><subparagraph id="H96AE3D15C5694F76819F8BCA22864A61"><enum>(B)</enum><text>hold a public
				meeting at which the public may present its views on the reauthorization,
				including specific suggestions for changes to the goals referred to in
				subsection (a);</text>
								</subparagraph><subparagraph id="HC4149679440E4C1F990AB04455E17D41"><enum>(C)</enum><text>provide a period
				of 30 days after the public meeting to obtain written comments from the public
				suggesting changes to this part; and</text>
								</subparagraph><subparagraph id="HAE502CD25DCB4566A8545159EAE97A2E"><enum>(D)</enum><text>publish the
				comments on the Food and Drug Administration's Internet Web site.</text>
								</subparagraph></paragraph><paragraph id="HACC90F2AAF8940EDBEC313B73E824176"><enum>(3)</enum><header>Periodic
				consultation</header><text>Not less frequently than once every month during
				negotiations with the regulated industry, the Secretary shall hold discussions
				with representatives of patient and consumer advocacy groups to continue
				discussions of their views on the reauthorization and their suggestions for
				changes to this part as expressed under paragraph (2).</text>
							</paragraph><paragraph id="HE06EE9B3F41A49A2B2A4E80C9A5960B8"><enum>(4)</enum><header>Public review of
				recommendations</header><text>After negotiations with the regulated industry,
				the Secretary shall—</text>
								<subparagraph id="HE0BAD0DB95294AE79FC89D3ECED8C07F"><enum>(A)</enum><text>present the
				recommendations developed under paragraph (1) to the Congressional committees
				specified in such paragraph;</text>
								</subparagraph><subparagraph id="H619C818A07E34747A4230BDDBAA3335E"><enum>(B)</enum><text>publish such
				recommendations in the Federal Register;</text>
								</subparagraph><subparagraph id="HA2DA6584D5F9498A96F4F3EA9B4DF106"><enum>(C)</enum><text>provide for a
				period of 30 days for the public to provide written comments on such
				recommendations;</text>
								</subparagraph><subparagraph id="HECF5AF632F8940679982350139B6C222"><enum>(D)</enum><text>hold a meeting at
				which the public may present its views on such recommendations; and</text>
								</subparagraph><subparagraph id="H7ED2ACC1E3C04AD88C135A4E83EF3D1F"><enum>(E)</enum><text>after
				consideration of such public views and comments, revise such recommendations as
				necessary.</text>
								</subparagraph></paragraph><paragraph id="H5BA4FEC74B82498DADEDCB9F20ADD297"><enum>(5)</enum><header>Transmittal of
				recommendations</header><text>Not later than January 15, 2017, the Secretary
				shall transmit to the Congress the revised recommendations under paragraph (4),
				a summary of the views and comments received under such paragraph, and any
				changes made to the recommendations in response to such views and
				comments.</text>
							</paragraph><paragraph id="H727BA3475F7646D2A1E6460432C0CA57"><enum>(6)</enum><header>Minutes of
				negotiation meetings</header>
								<subparagraph id="HD86B1B4A7C2D4F578D4382F586E09165"><enum>(A)</enum><header>Public
				availability</header><text>Before presenting the recommendations developed
				under paragraphs (1) through (5) to the Congress, the Secretary shall make
				publicly available, on the public Web site of the Food and Drug Administration,
				minutes of all negotiation meetings conducted under this subsection between the
				Food and Drug Administration and the regulated industry.</text>
								</subparagraph><subparagraph id="HAAEBEFAD56844F718F5C5BC403FDD454"><enum>(B)</enum><header>Content</header><text>The
				minutes described under subparagraph (A) shall summarize any substantive
				proposal made by any party to the negotiations as well as significant
				controversies or differences of opinion during the negotiations and their
				resolution.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC8BA39C9CEEB4299BAB4E9D24A0DCDA6"><enum>(d)</enum><header>Sunset
			 dates</header>
				<paragraph id="HA8E665CFF66C44DD8EFE9D8B1284BAF5"><enum>(1)</enum><header>Authorization</header><text>The
			 amendment made by subsection (b) ceases to be effective October 1, 2017.</text>
				</paragraph><paragraph id="HF3020E88FB824984827F3CA4733BF895"><enum>(2)</enum><header>Reporting
			 requirements</header><text>The amendment made by subsection (c) ceases to be
			 effective January 31, 2018.</text>
				</paragraph></subsection></section><section id="H69BF189E7D234B479FE76EA24755473F"><enum>5.</enum><header>Miscellaneous
			 provisions</header>
			<subsection id="H2205510EBBB7493CAED21F3625FCFC95"><enum>(a)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 Act and the amendments made by this Act shall be construed to impair any
			 approval of an application submitted under section 505 or 512 of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 355) for a medical gas (as defined in
			 section 575 of the Federal Food, Drug, and Cosmetic Act, as added by section
			 3(b) of this Act) that occurred prior to the date of the enactment of this
			 Act.</text>
			</subsection><subsection id="H0659D9CA730B48A18C931397E2E91C15"><enum>(b)</enum><header>Savings
			 clause</header><text display-inline="yes-display-inline">Except as expressly
			 set forth in this Act and the amendments made by this Act, a medical gas (as
			 defined in section 575 of the Federal Food, Drug, and Cosmetic Act, as added by
			 section 3(b) of this Act) shall be subject to all applicable requirements for
			 drugs under the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et
			 seq.).</text>
