		  process improvement methods to reduce waste and improve the effectiveness of
		  the Federal Government, and for other purposes.</official-title>

		<section id="H4C2BCCB6CB12475AAA462544408452A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>LESS Government
			 Act</short-title></quote>.</text>
		</section><section id="H1123BF54E58D47109866CB30DB327172"><enum>2.</enum><header>Findings;
			 policy</header>
			<subsection id="H1B9D26E0A21A4600AD6698AF587E5F3D"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
				<paragraph id="H2694B818E7A9437FA4A4416C6A798F07"><enum>(1)</enum><text display-inline="yes-display-inline">Nearly 100 major United States
			 corporations, and many government entities around the world, have reduced waste
			 in their operations and improved the quality of the goods and services they
			 provide by implementing a continuous process improvement methodology known as
			 lean six sigma.</text>
				</paragraph><paragraph id="HA70F2C24C2534E04A45659DAFC33FF88"><enum>(2)</enum><text>Use of this
			 methodology has resulted in average cost reductions greater than 25 percent
			 while also improving the quality of goods and services.</text>
				</paragraph><paragraph id="H10F17294097F4D379CBF76E2394A26C6"><enum>(3)</enum><text>The piloted use of
			 lean six sigma within the Department of Defense and several other departments
			 and agencies has demonstrated that it can successfully be applied across the
			 Federal Government.</text>
				</paragraph><paragraph id="HCE1B7EE1960E495EB68557E74E77B9D9"><enum>(4)</enum><text>Continuous process
			 improvement is essential for Federal agencies to be successful in setting and
			 meeting performance goals and is a key component that is missing from current
			 statutory requirements for performance improvement efforts.</text>
				</paragraph><paragraph id="H7B1C278C12C54E4D9DF51DD6F8FD6285"><enum>(5)</enum><text>Clear direction
			 and authority from Congress is needed to ensure this innovative management
			 process from the private sector is applied across the Federal Government to
			 achieve waste reduction and optimal efficiency.</text>
				</paragraph></subsection><subsection commented="no" id="H1380DEE8303A4E07BC05EA0CE2E12163"><enum>(b)</enum><header>Congressional
			 statement of policy</header><text display-inline="yes-display-inline">It shall
			 be the policy of the United States—</text>
				<paragraph id="HDB2DDEFEEAA84D9EA2B38A1D7ABECD1C"><enum>(1)</enum><text>to reduce waste
			 and improve the effectiveness of the Federal Government through the use of
			 continuous process improvement methods;</text>
				</paragraph><paragraph id="HA0E9FB636ABA486C8E45D9625883F740"><enum>(2)</enum><text>to require each
			 Federal agency to implement the necessary capabilities to fully
			 institutionalize such methods within such agency to reduce waste while
			 maintaining or improving the level of services provided by the Federal
			 Government; and</text>
				</paragraph><paragraph id="H0B64E6E8A34F4B6C81B4A5DAA9BB4230"><enum>(3)</enum><text>to return savings
			 from such methods to the United States Treasury to reduce the deficit.</text>
				</paragraph></subsection></section><section id="H512CBD73C78B4C1192E11FA35A83BE29"><enum>3.</enum><header>Continuous
			 process improvement</header>
			<subsection id="HCC5EED0273164649831A1D401B4C3052"><enum>(a)</enum><header>Continuous
			 process improvement defined</header><text display-inline="yes-display-inline">Section 1101 of title 31, United States
			 Code, is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H033A6523FC9A43CBB7954FCA74310D4D" style="USC">
					<paragraph id="HE37C52BB398D4AE89750A6F44D664EDC"><enum>(3)</enum><text display-inline="yes-display-inline"><quote>continuous process
				improvement</quote> means a management methodology (commonly referred to as
				lean six sigma) that combines tools to improve process speed, reduce waste, and
				incorporate requirements with data driven project analysis to provide products
				and services with improved quality at lower
				cost.</text>
					</paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
			</subsection><subsection id="H3BFA0C79E6414671AE42F446D8972DA1"><enum>(b)</enum><header>Agency
			 performance reporting</header><text>Subsection (c) of section 1116 of such
			 title is amended—</text>
				<paragraph id="HEDF916BFBCA74969B24DBBD6A57563BE"><enum>(1)</enum><text>in paragraph
			 (6)(E), by striking <quote>; and</quote>;</text>
				</paragraph><paragraph id="H18CA8E60D292470B8A8DFBF56F22F513"><enum>(2)</enum><text>in paragraph (7),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HA4B5675F2D9A4F77B660434AEC818D22"><enum>(3)</enum><text>by inserting at
			 the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HBF25233B87F24A7B9348CB3A0E2A1965" style="USC">
						<paragraph commented="no" id="HEEB26569C0C944729ECCC08E0441EB68"><enum>(8)</enum><text display-inline="yes-display-inline">describe the implementation of continuous
				process improvement, including information on each of the following:</text>
							<subparagraph commented="no" id="H4D464BB9F7D8410887EFFBC2B3EE2EA6"><enum>(A)</enum><text>The extent to
				which employees have received continuous process improvement training
				appropriate to the position of such employee, and its relation to the
				deployment goals in a typical application of continuous process
				improvement.</text>
							</subparagraph><subparagraph commented="no" id="HBB3833FF9FD94F2091F70F0408C37BEE"><enum>(B)</enum><text>A description of
				the application of continuous process improvement in cost-reduction projects,
				including any performance or quality improvements and cost savings realized as
				a result of such application.</text>
							</subparagraph><subparagraph commented="no" id="H8443551E6B544026909B21647EFEDE1F"><enum>(C)</enum><text display-inline="yes-display-inline">A comparison of the implementation results
				to the goal of a 25 percent cost reduction per
				project.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9DFCC867159744358DBCBE6CCA04B07D"><enum>(c)</enum><header>Implementation
			 results</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 1122 of such title is amended—</text>
				<paragraph id="H3F6EF47AB0CB49D08DA735E40B1C383A"><enum>(1)</enum><text>in paragraph (8),
			 by striking <quote>; and</quote>;</text>
				</paragraph><paragraph id="HD7E74A338FB2417390D5C08BFB7CF299"><enum>(2)</enum><text>in paragraph (9),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H6F49021AFE2A4B1C9133BC4C107800AD"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H932C5F7DA99D4678ACD19E3CA721B39E" style="USC">
						<paragraph id="H9E43688A3D26473D932B85F18C7B9875"><enum>(10)</enum><text display-inline="yes-display-inline">a description of the results of the
				government-wide implementation of continuous process improvement.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC4416AB54A0341F6810AA142EAB2AD06"><enum>(d)</enum><header>Chief Operating
			 Officer requirement</header><text>Subsection (b) of section 1123 of such title
			 is amended—</text>
				<paragraph id="H8FC6F5FA972A4874AD22D1B50D8D9E7C"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>; and</quote>;</text>
				</paragraph><paragraph id="H664AC50E27C744D0A15868DD7121668F"><enum>(2)</enum><text>in paragraph (4),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H47FEE742272940F48A728E5301F63E73"><enum>(3)</enum><text>by inserting at
			 the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H9614EB54BB744A8797C38E72D8A054EF" style="USC">
						<paragraph id="H923F0894A4484EABB8B22CC4626F29B3"><enum>(5)</enum><text display-inline="yes-display-inline">implement continuous process improvement
				within the
				agency.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC9ECD3B8B2B4481EA8B1DF39D557CCA8"><enum>(e)</enum><header>Performance
			 Improvement Officer requirement</header><text>Paragraph (2) of section 1124(a)
			 of such title is amended—</text>
				<paragraph id="H04F0858BC490474AAACA9D632F00A5DC"><enum>(1)</enum><text>in subparagraph
			 (E), by striking <quote>; and</quote>;</text>
				</paragraph><paragraph id="H184E583D99BB4AD3B3A8ECFF43FE27B3"><enum>(2)</enum><text>in subparagraph
			 (F), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HE1D4D22F588B4459A8BD97AF2DA43CB3"><enum>(3)</enum><text>by inserting at
			 the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H67BB3B37F67C4D68A7637547695F08AE" style="USC">
						<subparagraph id="H8312320D061D48E4B0C43A3D9E45EE55"><enum>(G)</enum><text display-inline="yes-display-inline">advise and assist the head of the agency
				and the Chief Operating Officer on implementing the continuous process
				improvement within the
				agency.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H94EFB7AD02094109B6170010ED26D580"><enum>(f)</enum><header>Performance
			 Improvement Council</header><text>Subsection (b) of section 1124 of such title
			 is amended—</text>
				<paragraph id="H23D816852CE642A1A9B974C70F284B47"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H4495CA986E4D4DEC9BF0E23A0270765B"><enum>(A)</enum><text>by redesignating
			 subparagraphs (C) and (D) as (D) and (E), respectively; and</text>
					</subparagraph><subparagraph id="H31526E41487B458F97541742D88730A1"><enum>(B)</enum><text>by inserting after
			 subparagraph (B), the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HD5ED28B132F6496D91C55373E2004101" style="USC">
							<subparagraph id="H67EF755C7AB64CF0B5D38FE13D234313"><enum>(C)</enum><text display-inline="yes-display-inline">an appropriate expert designated by the
				Director of the Office of Management and Budget pursuant to paragraph
				(4);</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H561E515EC10346DFA66B2737D7CE8FE7"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H98CF723EA9FA48B9B4EDB69105CFD7FE" style="USC">
						<paragraph id="H1CFDD4B3B256496087C0315F93AAB228"><enum>(4)</enum><header>Designation of
				expert on continuous process improvement</header><text display-inline="yes-display-inline">The Director of the Office of Management
				and Budget shall appoint a highly-qualified expert on continuous process
				improvement to serve as a member of the Performance Improvement Council to
				advise on the implementation of continuous process improvement across
				agencies.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HB2951B00E71E4B3B80CE7E8870A8659B"><enum>4.</enum><header>Center of
			 excellence for continuous process improvement</header>
			<subsection id="H7245B2759F884D3E8003B311ED28A315"><enum>(a)</enum><header>In
			 general</header><text>Chapter 11 of title 31, United States Code, is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HE7F3996F541D4C48A9988B77AD35F5CB" style="USC">
					<section id="HCFE102D36F9E417E9CE92E67C809F892"><enum>1126.</enum><header>Center of
				Excellence for continuous process improvement</header>
						<subsection id="HEE34DA83991F4FD2A569928387F10692"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director of the
				Office of Management and Budget shall designate a center of excellence for
				continuous process improvement training, from within the Department of Defense.</text>
						</subsection><subsection id="HB928DC28B7B14340A3BB3D582C9EC704"><enum>(b)</enum><header>Functions</header><text>The
				Director shall ensure that the center designated under subsection (a) provides
				agencies with a common set of approaches to training and deployment of
				continuous process
				improvement.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0CCA6FB507D8478A9AA12F34D05D85E8"><enum>(b)</enum><header>Designation</header><text>The
			 Director of the Office of Management and Budget shall designate the center of
			 excellence required under section 1126(a) of title 31, United States Code, as
			 added by subsection (a), not later than 90 days after the date of the enactment
			 of this Act.</text>
			</subsection><subsection id="H9D97EEB445C64D10B36CD957028310A8"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text display-inline="yes-display-inline">The
			 table of contents for chapter 11 of title 31, United States Code, is amended by
			 inserting after the item relating to section 1125 the following new item:</text>
				<quoted-block display-inline="no-display-inline" id="H341858DADCD3429A919488085DBF3DC6" style="USC">
					<toc regeneration="no-regeneration">
						<toc-entry level="item">1126. Center of excellence for continuous
				process
				improvement.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="HA52A7F4CF7F645689643C4C50FE562E1"><enum>5.</enum><header>Preparation and
			 submission of appropriations requests to the President</header><text display-inline="no-display-inline">Paragraph (1) of section 1108(b) of title
			 31, United States Code, is amended by adding at the end the following:
			 <quote>The head of each agency shall include information on the results of
			 cost-reduction projects using continuous process improvement in each relevant
			 appropriation request for the agency, and an explanation of how any savings
			 from such implementation have impacted the agency’s request.</quote>.</text>
		</section><section id="HFF19E0F7902C4CD6ACABFC4FF5F411D1"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as otherwise
			 expressly provided under this Act, this Act and the amendments made by this Act
			 shall take effect 6 months after the date of the enactment of this Act.</text>
