		<official-title>To amend title XVIII of the Social Security Act to
		  prevent the application of payment adjustments for eligible professionals who
		  are not successful electronic prescribers, to remove any electronic prescribing
		  requirement as an element for demonstrating meaningful use of certified EHR
		  technology, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="idF9F107821E3A44469DCB89E947C25EA2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>STEAM (Stripping The E-Prescribe
			 Arbitrary Mandates) Act of 2011</short-title></quote>.</text>
		</section><section id="HBF0D75E52A4341FC8DE3A0C1A0BD9596" section-type="subsequent-section"><enum>2.</enum><header>Preventing application
			 of Medicare payment adjustments for eligible professionals not successful
			 electronic prescribers</header>
			<subsection id="H9B286220979D4BB8B92355692C798D5D"><enum>(a)</enum><header>Repeal of
			 e-prescribing payment adjustment</header><text display-inline="yes-display-inline">Paragraph (5) of section 1848(a) of the
			 Social Security Act (42 U.S.C. 1395w–4(a)) is repealed.</text>
			</subsection><subsection display-inline="no-display-inline" id="HA6C7BE91DEA941C5938000CFD4BBC48A"><enum>(b)</enum><header>Removing
			 e-prescribing as element of demonstrating meaningful use of certified EHR
			 technology</header>
				<paragraph id="HD3E99153714F4D3C8218C260A71C81A7"><enum>(1)</enum><header>Eligible
			 professionals</header><text>Section 1848(o)(2)(A) of the Social Security Act
			 (42 U.S.C. 1395w–4(o)(2)(A)) is amended—</text>
					<subparagraph id="H80AF3ECBD0C94DC09E1524C30729DFD1"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>, which shall include the use of electronic prescribing as
			 determined to be appropriate by the Secretary</quote>;</text>
					</subparagraph><subparagraph id="H115A82017BBD45559594277D32AA8014"><enum>(B)</enum><text>in clause (iii),
			 by inserting <quote>(other than electronic prescribing quality
			 measures)</quote> after <quote>such other measures</quote>; and</text>
					</subparagraph><subparagraph id="H3062260EEF594251B61987736DBCE259"><enum>(C)</enum><text>by adding at the
			 end the following new sentence: <quote>In no case shall an eligible
			 professional be required to use (or demonstrate the use of) electronic
			 prescribing in order for such professional to be treated as a meaningful EHR
			 user in accordance with this subparagraph.</quote>.</text>
					</subparagraph></paragraph><paragraph id="H782A3997AB0C4258A766281D9DADF8ED"><enum>(2)</enum><header>Eligible
			 hospitals</header><text>Section 1886(n)(3)(A) of the Social Security Act (42
			 U.S.C. 1395ww(n)(3)(A)) is amended—</text>
					<subparagraph id="H4D1EC54D026D4C2696722FF32F554EF6"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (iii), by inserting <quote>(other
			 than electronic prescribing quality measures)</quote> after <quote>such other
			 measures</quote>; and</text>
					</subparagraph><subparagraph id="HBADD19F650E14B4F8F3D378B6074849C"><enum>(B)</enum><text>by adding at the
			 end the following new sentence: <quote>In no case shall an eligible hospital be
			 required to use (or demonstrate the use of) electronic prescribing in order for
			 such hospital to be treated as a meaningful EHR user in accordance with this
			 subparagraph.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HF191E1EFF93145459B963C3B635C4962"><enum>(3)</enum><header>Effective
			 date</header><text>The amendments made by paragraphs (1) and (2) shall apply
			 with respect to EHR reporting periods beginning after the date of the enactment
			 of this Act.</text>
				</paragraph></subsection><subsection id="HEAEBA19D490D4EA1827110652E3FA28E"><enum>(c)</enum><header>Excluding
			 e-prescribing from shared savings program reporting requirements</header><text display-inline="yes-display-inline">Section 1899(b)(3)(D) of such Act (42
			 U.S.C. 1395jjj(b)(3)(D)) is amended—</text>
				<paragraph id="H44EFEDFFE3C44639AA537125884557EF"><enum>(1)</enum><text>by striking
			 <quote>electronic prescribing,</quote>; and</text>
				</paragraph><paragraph id="H0CF776DF3AF04289BE38C9A9E2CA38D6"><enum>(2)</enum><text>inserting
			 <quote>(but not including such requirements and such payments related to
			 electronic prescribing)</quote> after <quote>other similar initiatives under
			 section 1848</quote>.</text>
				</paragraph></subsection><subsection id="HDA710C37CA50456A88C4DA22A909C4C5"><enum>(d)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H0C0D9D061BFC4765B7CA1FEC00529896"><enum>(1)</enum><text>Subsection (a) of
			 section 1848 of such Act (42 U.S.C. 1395w–4) is amended—</text>
					<subparagraph id="H277BFCB5A6DF4718A42591C41E9CCCB5"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (4)(A), by striking <quote>,
			 except as provided in paragraph (5)</quote>;</text>
					</subparagraph><subparagraph id="H39BC3CC1366B4785B756FB68C31E3199"><enum>(B)</enum><text>in paragraph
			 (7)(A)(ii)(I), by striking <quote>(or, in the case of an eligible professional
			 who was subject to the application of the payment adjustment under section
			 1848(a)(5) for 2014, 98 percent)</quote>; and</text>
					</subparagraph><subparagraph id="HB5B4C047DD0F44C1BCEC6A35B40DB0A5"><enum>(C)</enum><text>in paragraph
			 (8)(A)(i), by striking <quote>paragraphs (3), (5), and (7)</quote> and
			 inserting <quote>paragraphs (3) and (7)</quote>.</text>
					</subparagraph></paragraph><paragraph id="HBA6CC394009947BC9342A13013548EC0"><enum>(2)</enum><text>Subsection (m) of
			 such section is amended—</text>
					<subparagraph id="H7FF7C36D95C0464791300F61B2762610"><enum>(A)</enum><text>in paragraph
			 (2)(B), by striking <quote>and subsection (a)(5)</quote> and by striking
			 <quote>(or, for purposes of subsection (a)(5), for the reporting period for a
			 year)</quote>;</text>
					</subparagraph><subparagraph id="HB2E7D72B3C1A43258A0BA50929332BFB"><enum>(B)</enum><text>in paragraph
			 (3)(B)(i), by striking <quote>and subsection (a)(5)</quote> and by striking
			 <quote>(or, for purposes of subsection (a)(5), for the reporting period for a
			 year)</quote>;</text>
					</subparagraph><subparagraph id="HF6674A4D5E88451DBFAA09AF387C37DB"><enum>(C)</enum><text>in each of clauses
			 (ii) and (iii) of paragraph (3)(B), by striking <quote>(or, for purposes of
			 subsection (a)(5), for the reporting period for a year)</quote>;</text>
					</subparagraph><subparagraph id="HA731DCF637DA4CED9FE9EB9B95261E73"><enum>(D)</enum><text>in paragraph
			 (3)(C), by striking <quote>or, for purposes of subsection (a)(5), for a
			 reporting period for a year,</quote>;</text>
					</subparagraph><subparagraph id="H3096896359334D3393A83FBB58538C73"><enum>(E)</enum><text>in paragraph
			 (5)(E)(iii), by striking <quote>, the limitation under paragraph (2)(B), and
			 the exception under subsection (a)(5)(B)</quote> and inserting <quote>and the
			 limitation under paragraph (2)(B)</quote>; and</text>
					</subparagraph><subparagraph id="H8AF5C186627A4B54861A31BB9D508F88"><enum>(F)</enum><text>in paragraph
			 (6)(C)(iii), by striking <quote>(a)(5)</quote> and by striking <quote>the
			 reporting period under subsection (a)(5)(D)(iii)</quote>.</text>
