		<section id="H89C1011718F747C5901E4DA457FC9760" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>High Risk Rural Roads Safety Act of
			 2011</short-title></quote>.</text>
		</section><section id="H827154D7EA974AC6AC6095921928F748"><enum>2.</enum><header>High Risk Rural
			 Roads Safety Program</header><text display-inline="no-display-inline">Title 23,
			 United States Code, is amended by inserting after section 149 the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H6CEAE05F9F564CECBA1649D18783822E" style="USC">
				<section id="H70CFBA85CB434FDD8432DC1845192300"><enum>150.</enum><header>High risk rural
				roads safety program</header>
					<subsection id="H7B2137613BC8459FB52B6D240FE16365"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				carry out a program to improve the safety of high risk rural roads in
				accordance with this section.</text>
					</subsection><subsection id="HE78E1AEBD3DD499AB9F2F4F56FEC6E05"><enum>(b)</enum><header>High risk rural
				road projects</header><text>Funds apportioned to a State under this section may
				be used for any of the following projects and activities to improve the safety
				of a high risk rural road:</text>
						<paragraph id="H06128C65FD3245EFA3F3B4AE343F2306"><enum>(1)</enum><text>A road safety
				audit.</text>
						</paragraph><paragraph id="H76AB08E9A89143378E39D87005FAF9CB"><enum>(2)</enum><text>An intersection
				safety improvement.</text>
						</paragraph><paragraph id="H384D957B3A4048A0AC16CF28093EE369"><enum>(3)</enum><text>Installation of
				rumble strips or another warning device, if the rumble strips or other warning
				devices do not adversely affect the safety or mobility of bicyclists,
				pedestrians, and the disabled.</text>
						</paragraph><paragraph id="HCB02D0E110374BE3B0DDBCEB28C0149A"><enum>(4)</enum><text>An improvement for
				pedestrian or bicyclist safety or safety of the disabled.</text>
						</paragraph><paragraph id="HE3AAE9850CE846CD990A213681420FE2"><enum>(5)</enum><text>Construction of a
				railway-highway crossing safety feature, including installation of protective
				devices.</text>
						</paragraph><paragraph id="H2541DB8323E24F198B3C22077BF241CD"><enum>(6)</enum><text>Construction of a
				traffic calming feature.</text>
						</paragraph><paragraph id="H47A8F3D3966C4E6799BE3EB3841EA6FE"><enum>(7)</enum><text>Improvement of
				highway signage and pavement markings, including to meet minimum levels of
				retroreflectivity established by the Department of Transportation.</text>
						</paragraph><paragraph id="HF1D6CA9390B8470694A71C6FD679499C"><enum>(8)</enum><text>Installation of a
				priority control system for emergency vehicles at signalized
				intersections.</text>
						</paragraph><paragraph id="HFB130C1946D246B1B1EF835F52AA4510"><enum>(9)</enum><text>Installation of a
				traffic control or other warning device at a location with high accident
				potential.</text>
						</paragraph><paragraph id="HC8EB7E0D76CF41929620822561DFA9B4"><enum>(10)</enum><text>Installation of
				guardrails, barriers (including barriers between construction work zones and
				traffic lanes for the safety of motorists and workers), and crash
				attenuators.</text>
						</paragraph><paragraph id="HE8E6157FF37F484CA43739AD4A3F31A3"><enum>(11)</enum><text>The addition or
				retrofitting of structures or other measures to eliminate or reduce accidents
				involving vehicles and wildlife.</text>
						</paragraph><paragraph id="H9390A9F0503C4A1F86A9275940E25F9F"><enum>(12)</enum><text>Installation and
				maintenance of signs (including fluorescent, yellow-green signs) at
				pedestrian-bicycle crossings and in school zones.</text>
						</paragraph><paragraph id="H36EEDD3493B94869850AFF625E0C5469"><enum>(13)</enum><text>Installation of a
				skid-resistant surface at an intersection or other location with a high
				frequency of accidents.</text>
						</paragraph><paragraph id="H4961A99F9EA04B5390D3634DD45EB151"><enum>(14)</enum><text>Improvement of an
				edge drop-off that is greater than 4 inches.</text>
						</paragraph><paragraph id="H6C9B6C457AB341FE8975EF838A18FCE1"><enum>(15)</enum><text>Spot pavement and
				shoulder widening.</text>
						</paragraph><paragraph id="H50B589CF07DD4F06A706D2F7AF944E06"><enum>(16)</enum><text>Elimination of a
				roadside obstacle.</text>
						</paragraph><paragraph id="HF92AD3A824C5424C9B1544734240357F"><enum>(17)</enum><text>Systemic
				improvements focusing on low-cost safety infrastructure investments.</text>
						</paragraph><paragraph id="HCD9FA153EA6A4A938312E99418F1F2B8"><enum>(18)</enum><text>Traffic
				enforcement or other activities relating to work zone safety.</text>
						</paragraph></subsection><subsection id="H682C0E46569942499D98A4A3949D5C67"><enum>(c)</enum><header>Apportionment of
				funds</header><text>On October 1 of each fiscal year, the Secretary shall
				apportion the sums authorized to be appropriated to carry out this section for
				such fiscal year among the States in accordance with the following:</text>
						<paragraph id="H3802C578D9C34450A89A078581D03B0E"><enum>(1)</enum><text>25 percent in the
				ratio that—</text>
							<subparagraph id="H4CE00E2DE9994B97B2C048BBBFB7CCAB"><enum>(A)</enum><text>the total rural
				major collector lane miles in each State; bears to</text>
							</subparagraph><subparagraph id="H34694FF045C84B93B60497FF0E54A29F"><enum>(B)</enum><text>the total rural
				major collector lane miles in all States.</text>
							</subparagraph></paragraph><paragraph id="HD9EC029BAA30414D89C233BDDD75D638"><enum>(2)</enum><text>25 percent in the
				ratio that—</text>
							<subparagraph id="H49B1394227824B639FC80FDDBD904F29"><enum>(A)</enum><text>the total rural
				minor collector lane miles in each State; bears to</text>
							</subparagraph><subparagraph id="HDA3C9B1A63104FB29D3A2FC3C08A3C39"><enum>(B)</enum><text>the total rural
				minor collector lane miles in all States.</text>
							</subparagraph></paragraph><paragraph id="H7B63D9B07F1442F4BA7ABF280B564050"><enum>(3)</enum><text>25 percent in the
				ratio that—</text>
							<subparagraph id="H68707DC6C49B460489301ACE729E9435"><enum>(A)</enum><text>the total rural
				local road lane miles in each State; bears to</text>
							</subparagraph><subparagraph id="H7115A7D45771421EAB156C74ABD42A6E"><enum>(B)</enum><text>the total rural
				local road lane miles in all States.</text>
							</subparagraph></paragraph><paragraph id="HB37EE5F44BDA4086B7C742CCB4E5DEF3"><enum>(4)</enum><text>25 percent in the
				ratio that—</text>
							<subparagraph id="HE0F04933F9F94CC3BDB70CC22CCF2B47"><enum>(A)</enum><text>the total number
				of fatalities, in the most recent fiscal year for which data is available, on
				rural major collector, rural minor collector, and rural local roads in each
				State; bears to</text>
							</subparagraph><subparagraph id="H6F215F70B3214C8EBCE08505B2F2C021"><enum>(B)</enum><text>the total number
				of fatalities, in the most recent fiscal year for which data is available, on
				rural major collector, rural minor collector, and rural local roads in all
				States.</text>
							</subparagraph></paragraph></subsection><subsection id="HB685699209E34D129A6DF6E89BED4CCB"><enum>(d)</enum><header>Federal
				Share</header><text>The Federal share of the cost of a high risk rural road
				project carried out with funds apportioned to a State under this section shall
				be 90 percent.</text>
					</subsection><subsection id="H54F5FEAA46BB48EB939CD820EBBBC58D"><enum>(e)</enum><header>Road assessment
				programs</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (b), a State may use not more than 1.25 percent or $100,000 of the
				funds apportioned to the State under this section in a fiscal year, whichever
				is greater, for a road assessment program, under which any of the following may
				be carried out to improve the safety of a high risk rural road:</text>
						<paragraph id="H935943B2F30A441CAF7B203104F310F7"><enum>(1)</enum><text>Risk mapping to
				document the safety performance of a road.</text>
						</paragraph><paragraph id="HAE61A34FFE1949D1B58D56F7E96D0010"><enum>(2)</enum><text display-inline="yes-display-inline">Documenting the risk of death or serious
				injury from an accident with respect to a road, including specifying the
				locations where that risk is high or low.</text>
						</paragraph><paragraph id="H7D7ED2C885B14634AFA08C6746F21604"><enum>(3)</enum><text>Monitoring changes
				in the safety performance of a road segment over time and determining how those
				changes relate to safety improvement activities.</text>
						</paragraph><paragraph id="H4C27453C74FF4043A3A31ED88E7E1A17"><enum>(4)</enum><text>Examining the
				effectiveness of road infrastructure improvements with respect to protecting
				road users from accidents, including accidents that result in death or serious
				injury.</text>
						</paragraph><paragraph id="H6B3F4D9A8F6B4D10BC12E831546AE1CD"><enum>(5)</enum><text>Identifying roads
				eligible to be assisted under subsection (b).</text>
						</paragraph><paragraph id="H12455160E4494EC886D3023D47BA20EF"><enum>(6)</enum><text>Identifying
				cost-effective improvements for a specific road segment.</text>
						</paragraph></subsection><subsection id="H4DCEB61E0244412A9081DFA6D909EBDD"><enum>(f)</enum><header>Reports</header><text display-inline="yes-display-inline">The Secretary shall submit annually to the
				Committee on Environment and Public Works of the Senate and the Committee on
				Transportation and Infrastructure of the House of Representatives a report
				describing progress made in reducing the number of fatalities and
				incapacitating injuries on each of the high risk rural roads with respect to
				which a project was carried out under this section.</text>
					</subsection><subsection id="H3B5350E58E10484D98FAA4F7DF15D8DE"><enum>(g)</enum><header>High risk rural
				road defined</header><text>In this section, the term <term>high risk rural
				road</term> means any roadway functionally classified as a rural major or minor
				collector or a rural local road—</text>
						<paragraph id="H0E75BD7B7ED341D09AB5B47D56E1DE5D"><enum>(1)</enum><text>with respect to
				which there is a significant likelihood of accidents resulting in fatalities or
				incapacitating injuries; or</text>
						</paragraph><paragraph id="H14F845FD693F4C3D86086832C7DB01A4"><enum>(2)</enum><text>with respect to
				which there is a physical condition that presents to users of the roadway an
				increased risk of an accident, including an accident resulting in a serious
				injury.</text>
						</paragraph></subsection><subsection id="HF97D6B76B327486FA05246745CE54A68"><enum>(h)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated out of the
				Highway Trust Fund (other than the Mass Transit Account) to carry out this
				section $400,000,000 for each of fiscal years 2012 through 2017. Funds made
				available to carry out this section shall not be transferrable and shall remain
				available until
				expended.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2F1F343B1DC549F5A8DB7E7BDA46FC6F"><enum>3.</enum><header>Conforming
			 amendments</header><text display-inline="no-display-inline">Section 148 of
			 title 23, United States Code, is amended—</text>
			<paragraph id="H908C01FADD1C446FB97AEF0C72DD6297"><enum>(1)</enum><text>by striking
			 subsection (f); and</text>
			</paragraph><paragraph id="H736FA79F45724F13B93ABFC2832DCE3C"><enum>(2)</enum><text>by redesignating
			 subsections (g) and (h) as subsections (f) and (g), respectively.</text>
			</paragraph></section><section id="H0AE7C320A2C9476BA149C6E1CEDADDE2"><enum>4.</enum><header>Clerical
			 amendment</header><text display-inline="no-display-inline">The analysis for
			 chapter 1 of title 23, United States Code, is amended by inserting after the
			 item relating to section 149 the following:</text>
