			</subsection></section><section display-inline="no-display-inline" id="H0C4831E41D0646829C34E00C091ECC71"><enum>2.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It shall be the policy
			 of the United States to fully implement and enforce sanctions against Iran,
			 North Korea, and Syria for their proliferation activities and policies.</text>
		</section><section display-inline="no-display-inline" id="H529C8D9FB6404919882C2D0D1C467516"><enum>3.</enum><header>Reports on
			 proliferation relating to Iran, North Korea, and Syria</header>
			<subsection id="HD7420BF1484B4961A85A75CCD0521AE4"><enum>(a)</enum><header>Reports</header><text>Not
			 later than 90 days after the date of the enactment of this Act and every 120
			 days thereafter, the President shall transmit to the appropriate congressional
			 committees a report identifying every foreign person with respect to whom there
			 is credible information indicating that such person—</text>
				<paragraph id="H9F88A4BED6784A448F1AC43BB038CE98"><enum>(1)</enum><text display-inline="yes-display-inline">on or after January 1, 1999, transferred to
			 or acquired from Iran, on or after January 1, 2005, transferred to or acquired
			 from Syria, or on or after January 1, 2006, transferred to or acquired from
			 North Korea—</text>
					<subparagraph id="HBFC345D1239244088CCFB4BA99D6CEC5"><enum>(A)</enum><text>goods, services,
			 or technology listed on—</text>
						<clause id="H4E72F490DF5345FF956E5F89452186AD"><enum>(i)</enum><text>the
			 Nuclear Suppliers Group Guidelines for the Export of Nuclear Material,
			 Equipment and Technology (published by the International Atomic Energy Agency
			 as Information Circular INFCIRC/254/Rev. 3/Part 1, and subsequent revisions)
			 and Guidelines for Transfers of Nuclear-Related Dual-Use Equipment, Material,
			 and Related Technology (published by the International Atomic Energy Agency as
			 Information Circular INFCIRC/254/Rev. 3/Part 2, and subsequent
			 revisions);</text>
						</clause><clause id="H6F67D1A42BF74D448B72B214ECEC858F"><enum>(ii)</enum><text>the
			 Missile Technology Control Regime Equipment and Technology Annex of June 11,
			 1996, and subsequent revisions;</text>
						</clause><clause id="H7840C1A1E7BA446BBC9F2E1F15E96429"><enum>(iii)</enum><text>the lists of
			 items and substances relating to biological and chemical weapons the export of
			 which is controlled by the Australia Group;</text>
						</clause><clause id="HCAB5972F1D34499EBD8FE998658E8B17"><enum>(iv)</enum><text>the
			 Schedule One or Schedule Two list of toxic chemicals and precursors the export
			 of which is controlled pursuant to the Convention on the Prohibition of the
			 Development, Production, Stockpiling and Use of Chemical Weapons and on Their
			 Destruction; or</text>
						</clause><clause id="HD95C303168A4432BA34CFB924EDE2BFE"><enum>(v)</enum><text>the
			 Wassenaar Arrangement list of Dual Use Goods and Technologies and Munitions
			 list of July 12, 1996, and subsequent revisions; or</text>
						</clause></subparagraph><subparagraph id="HBBD2248DE8D049D49520E3E65307FEEC"><enum>(B)</enum><text>goods, services,
			 or technology not listed on any list specified in subparagraph (A) but which
			 nevertheless would be, if such goods, services, or technology were United
			 States goods, services, or technology, prohibited for export to Iran, North
			 Korea, or Syria, as the case may be, because of the potential of such goods,
			 services or technology to make a material contribution to the development of
			 nuclear, biological, or chemical weapons, or of ballistic or cruise missile
			 systems or destabilizing types and amounts of conventional weapons;</text>
					</subparagraph></paragraph><paragraph id="H7630A28541E845199CD22EFA2DDC8C8F"><enum>(2)</enum><text>except as provided
			 in subsection (b), on or after the date of the enactment of this Act, acquired
			 materials mined or otherwise extracted within the territory or control of Iran,
			 North Korea, or Syria, as the case may be, for purposes relating to the
			 nuclear, biological, or chemical weapons, or ballistic or cruise missile
			 development programs of Iran, North Korea, or Syria, as the case may be;</text>
				</paragraph><paragraph id="H7CC8DF39A6B6407E84A065D1C4AB77D8"><enum>(3)</enum><text display-inline="yes-display-inline">on or after the date of the enactment of
			 this Act, transferred to Iran, Syria, or North Korea goods, services, or
			 technology that could assist efforts to extract or mill uranium ore within the
			 territory or control of Iran, North Korea, or Syria, as the case may be;</text>
				</paragraph><paragraph id="H9F2068728EEF4C94A94A8BE54CBC0364"><enum>(4)</enum><text display-inline="yes-display-inline">on or after the date of the enactment of
			 this Act, provided to Iran, Syria, or North Korea destabilizing types and
			 amounts of conventional weapons and technical assistance; or</text>
				</paragraph><paragraph id="H2B0F1228B7914D84B0AC5A355AB98431"><enum>(5)</enum><text display-inline="yes-display-inline">on or after the date of the enactment of
			 this Act, provided a vessel, insurance or reinsurance, or any other shipping
			 service for the transportation of goods to or from Iran, North Korea, or Syria
			 for purposes relating to the nuclear, biological, or chemical weapons, or
			 ballistic or cruise missile development programs of Iran, North Korea, or
			 Syria, as the case may be.</text>
				</paragraph></subsection><subsection id="HF07B307BCD864D778C3CDC7FC3041108"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Any foreign person who—</text>
				<paragraph id="H08E49F64BC1344CEADDB1075B5E68A31"><enum>(1)</enum><text>was identified in
			 a report transmitted in accordance with subsection (a) on account of a
			 particular transfer, or</text>
				</paragraph><paragraph id="H265AC72D1E3E44DEB55CFA8FDC6CD0B5"><enum>(2)</enum><text>has engaged in a
			 transfer on behalf of, or in concert with, the Government of the United
			 States,</text>
				</paragraph><continuation-text continuation-text-level="subsection">shall not
			 be identified on account of that same transfer in any report submitted
			 thereafter under this section, except to the degree that new information has
			 emerged indicating that the particular transfer at issue may have continued, or
			 been larger, more significant, or different in nature than previously reported
			 under this section.</continuation-text></subsection><subsection commented="no" id="H8293306ED75544CBABF8909308336FA5"><enum>(c)</enum><header>Transmission in
			 classified form</header><text display-inline="yes-display-inline">If the
			 President considers it appropriate, reports transmitted in accordance with
			 subsection (a), or appropriate parts thereof, may be transmitted in classified
			 form.</text>
			</subsection><subsection id="H32931F29422A4389909EA9735D44897F"><enum>(d)</enum><header>Content of
			 reports</header><text display-inline="yes-display-inline">Each report required
			 under subsection (a) shall contain, with respect to each foreign person
			 identified in each such report, a brief description of the type and quantity of
			 the goods, services, or technology transferred by such person to Iran, North
			 Korea, or Syria, the circumstances surrounding such transfer, the usefulness to
			 the nuclear, biological, or chemical weapons, or ballistic or cruise missile
			 development programs of Iran, North Korea, or Syria of such transfer, and the
			 probable awareness or lack thereof of the transfer on the part of the
			 government with primary jurisdiction over such person.</text>
			</subsection><subsection id="H1BFDF23CC75045EB843AF7EF9F43AC30"><enum>(e)</enum><header>Additional
			 contents of reports</header><text>Each report under subsection (a) shall
			 contain a description, with respect the transfer or acquisition of the goods,
			 services, or technology described in such subsection, of the actions taken by
			 foreign governments to assist in interdicting such transfer or
			 acquisition.</text>
			</subsection><subsection commented="no" id="HF4134B80F8E7498FBCDAAE9D9ADBF286"><enum>(f)</enum><header>Expediting
			 sanctions for nuclear, chemical, biological and missile proliferation transfers
			 to iran</header>
				<paragraph commented="no" id="HE64E7F5B9D814F1683B14D9D4AB29A91"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding the requirement to submit the report
			 under subsection (a), the President shall establish a process to assess
			 information in the possession of the President on an ongoing basis regarding
			 possible transfers to Iran of goods, services, or technology relating to
			 nuclear, chemical, or biological weapons or ballistic missiles in accordance
			 with the requirements of subsection (a).</text>
				</paragraph><paragraph commented="no" id="HB67DF31D75654A219250F53C93DF6D82"><enum>(2)</enum><header>Application of
			 sanctions</header><text>Upon a determination of the President that credible
			 information exists that a transfer described in paragraph (1) has occurred, the
			 President shall apply the sanctions to the foreign person that made the
			 transfer in accordance with the requirements of section 4 of this Act.</text>
				</paragraph></subsection><subsection id="HF89A5DFDB59744C5B4796FE02B3DAB21"><enum>(g)</enum><header>Requirement for
			 plan to expedite implementation of reporting and sanctions</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the President
			 shall transmit to the appropriate congressional committees a plan, to include
			 any necessary legislation, to expedite the implementation of this Act with
			 regard to the reports required under subsection (a) and the sanctions under
			 section 4 of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="HBAC074D17EF24C2392BDD957A41AFE3B"><enum>4.</enum><header>Application of
			 measures to certain foreign persons</header>
			<subsection id="HA460B20D2C2A47B5BC574FC51E0C8F2E"><enum>(a)</enum><header>Application of
			 measures</header>
				<paragraph id="H9D4762D8FAE94A3DB25E740C5EA0408A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to section 5,
			 the President shall apply, for a period of not less than two years, the
			 measures specified in subsection (b) with respect to each foreign person
			 identified in a report transmitted under section 3(a).</text>
				</paragraph><paragraph id="HD16BD0CB11054A57AB1AE35B9DF99B31"><enum>(2)</enum><header>Related
			 persons</header><text display-inline="yes-display-inline">Subject to section 5,
			 the President may apply, for a period of not less than two years, the measures
			 specified in subsection (b) with respect to one or more of the
			 following:</text>
					<subparagraph id="H49D38228C443401B8B1662C7F56A012A"><enum>(A)</enum><text>Each person that
			 is a successor, subunit, or subsidiary of a foreign person referred to in
			 paragraph (1).</text>
					</subparagraph><subparagraph id="H85C8B11F59A0447C94AFF24FF6210B0E"><enum>(B)</enum><text>Each person that
			 owns more than 50 percent of, or controls in fact—</text>
						<clause id="H9CA6DF7818154BFA80DEC3CA09F4B7FF"><enum>(i)</enum><text>a
			 foreign person referred to in paragraph (1); or</text>
						</clause><clause id="HE4FCB5C7847E407789618540EAE6EC39"><enum>(ii)</enum><text>a
			 person described in subparagraph (A).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HA40ADB0492054ED597AD93990D7A9056"><enum>(b)</enum><header>Description of
			 measures</header><text>The measures referred to in subsection (a) are the
			 following:</text>
				<paragraph commented="no" id="H094448AD3341404EAD6132AB63DB3EBF"><enum>(1)</enum><header>Executive Order
			 12938 prohibitions</header><text display-inline="yes-display-inline">The
			 measures specified in the first sentence of subsection (b) and subsections (c)
			 and (d) of section 4 of Executive Order 12938 (50 U.S.C. 1701 note; relating to
			 proliferation of weapons of mass destruction) prohibiting any department or
			 agency of the United States Government from procuring, or entering into any
			 contract for the procurement of, any goods or services from any foreign person
			 described in subsection (a) of section 4 of Executive Order 12938.</text>
				</paragraph><paragraph id="HC87F66DB70BB4AB3994D6C2ABE15FA35"><enum>(2)</enum><header>Arms export
			 prohibition</header><text>Prohibition on United States Government sales to a
			 person described in subsection (a) of any item on the United States Munitions
			 List and termination of sales to such person of any defense articles, defense
			 services, or design and construction services under the Arms Export Control Act
			 (22 U.S.C. 2751 et seq.).</text>
				</paragraph><paragraph id="H1E2D280199224B39A2D58CCAFEDCE656"><enum>(3)</enum><header>Dual use export
			 prohibition</header><text>Denial of licenses and suspension of existing
			 licenses for the transfer to a person described in subsection (a) of items the
			 export of which is controlled under the Export Administration Act of 1979 (50
			 U.S.C. App. 2401 et seq.), as in effect pursuant to the International Emergency
			 Economic Powers Act, or the Export Administration Regulations.</text>
				</paragraph><paragraph id="H66FF6FDDE06646EFBFD199F9B23DC32D"><enum>(4)</enum><header>Investment
			 prohibition</header><text>Prohibition on any investment by a United States
			 person in property, including entities, owned or controlled by a person
			 described in subsection (a).</text>
				</paragraph><paragraph id="HC8E6048D779C42D3BAE30AAA9E28F107"><enum>(5)</enum><header>Financing
			 prohibition</header><text>Prohibition on any approval, financing, or guarantee
			 by a United States person, wherever located, of a transaction by a person
			 described in subsection (a).</text>
				</paragraph><paragraph id="H2E17BAF394E84891918DEE1742DD138B"><enum>(6)</enum><header>Financial
			 assistance prohibition</header><text>Denial by the United States Government of
			 any credit, credit guarantees, grants, or other financial assistance by any
			 agency of the United States Government to a person described in subsection
			 (a).</text>
				</paragraph></subsection><subsection commented="no" id="HB4B001C002EB4B1689A6B536FA4BB092"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Measures applied
			 pursuant to subsection (a) shall be effective with respect to a foreign person
			 no later than—</text>
				<paragraph commented="no" id="H92D550CBF4D34B58888511FB607E07F9"><enum>(1)</enum><text>90 days after the
			 report identifying the foreign person is submitted, if the report is submitted
			 on or before the date required by section 3(a);</text>
				</paragraph><paragraph commented="no" id="H2CEAB1A771C84F079256A05184DF02DE"><enum>(2)</enum><text>90 days after the
			 date required by section 3(a) for submitting the report, if the report
			 identifying the foreign person is submitted within 60 days after that date;
			 or</text>
				</paragraph><paragraph commented="no" id="H19A0A813FDDC4419A66A0C604D738511"><enum>(3)</enum><text>on the date that
			 the report identifying the foreign person is submitted, if that report is
			 submitted more than 60 days after the date required by section 3(a).</text>
				</paragraph></subsection><subsection id="H0F217474AE494123BAF48F1B82F02FF3"><enum>(d)</enum><header>Publication in
			 Federal Register</header>
				<paragraph id="H2B85BAF1CCCA4F279EBE96F4D5196950"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of the Treasury shall publish in the
			 Federal Register notice of the application against a person of measures
			 pursuant to subsection (a).</text>
				</paragraph><paragraph id="H3347F143286647D1959DBDB0BCBA78B5"><enum>(2)</enum><header>Content</header><text>Each
			 notice published in accordance with paragraph (1) shall include the name and
			 address (where known) of each person to which measures have been applied
			 pursuant to subsection (a).</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H4201997AD20546DDA6A531D25EFEFD79"><enum>5.</enum><header>Determination
			 exempting a foreign person from the application of certain measures</header>
			<subsection id="H2CEDE5D20FEB445F82C1B69DC6D03F4C"><enum>(a)</enum><header>In
			 general</header><text>The application of any measure described in section 4(b)
			 to a person described in section 4(a) shall cease to be effective beginning 15
			 days after the date on which the President determines and certifies to the
			 appropriate congressional committees, on the basis of information provided by
			 such person or otherwise obtained by the President, that—</text>
				<paragraph id="H0A95E85115724DAD8DBCCD775FFAABB1"><enum>(1)</enum><text>in the case of a
			 transfer or acquisition of goods, services, or technology described in section
			 3(a)(1)—</text>
					<subparagraph id="H2F4C39E0C7614BC280BFC31802C48F4A"><enum>(A)</enum><text>such person did
			 not, on or after January 1, 1999, knowingly transfer to or acquire from Iran,
			 North Korea, or Syria, as the case may be, such goods, services, or technology
			 the apparent transfer of which caused such person to be identified in a report
			 submitted pursuant to section 3(a);</text>
					</subparagraph><subparagraph id="H5500BD6DB41D4DAEA1E079041F4FC108"><enum>(B)</enum><text display-inline="yes-display-inline">the goods, services, or technology the
			 transfer of which caused such person to be identified in a report submitted
			 pursuant to section 3(a) did not contribute to the efforts of Iran, North
			 Korea, or Syria, as the case may be, to develop—</text>
						<clause id="HD3941BAB90E04378B74B48A128A020EE"><enum>(i)</enum><text>nuclear,
			 biological, or chemical weapons, or ballistic or cruise missile systems, or
			 weapons listed on the Wassenaar Arrangement Munitions List of July 12, 1996, or
			 any subsequent revision of such List; or</text>
						</clause><clause id="H9C0EB1B0A644486AA28D2BCBF477E485"><enum>(ii)</enum><text display-inline="yes-display-inline">destabilizing types or amounts of
			 conventional weapons or acquire technical assistance;</text>
						</clause></subparagraph><subparagraph id="H00A40AAC1AD54EFF8B6D11493F5CE784"><enum>(C)</enum><text>such person is
			 subject to the primary jurisdiction of a government that is an adherent to one
			 or more relevant nonproliferation regimes, such person was identified in a
			 report submitted pursuant to section 3(a) with respect to a transfer of goods,
			 services, or technology described in section 3(a)(1)(A), and such transfer was
			 made in accordance with the guidelines and parameters of all such relevant
			 regimes of which such government is an adherent; or</text>
					</subparagraph><subparagraph id="HBAC4882C58CB48588698BDFB750510BE"><enum>(D)</enum><text>the government
			 with primary jurisdiction over such person has imposed meaningful penalties on
			 such person on account of the transfer of such goods, services, or technology
			 that caused such person to be identified in a report submitted pursuant to
			 section 3(a);</text>
					</subparagraph></paragraph><paragraph id="H430E28DCE838411E9C2851C51D36C86A"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an acquisition of materials
			 mined or otherwise extracted within the territory of Iran, North Korea, or
			 Syria, as the case may be, described in section 3(a)(2) for purposes relating
			 to the nuclear, biological, or chemical weapons, or ballistic or cruise missile
			 development programs of Iran, North Korea, or Syria, as the case may be, such
			 person did not acquire such materials; or</text>
				</paragraph><paragraph id="H364E3727619347DF9F178B2B24A90C45"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of the provision of a vessel,
			 insurance or reinsurance, or another shipping service for the transportation of
			 goods to or from Iran, North Korea, or Syria, as the case may be, described in
			 section 3(a)(3) for purposes relating to the nuclear, biological, or chemical
			 weapons, or ballistic or cruise missile development programs of Iran, North
			 Korea, or Syria, as the case may be, such person did not provide such a vessel
			 or service.</text>
				</paragraph></subsection><subsection id="H2AC614D3A37F484F8022ECB795C85B16"><enum>(b)</enum><header>Opportunity To
			 provide information</header><text>Congress urges the President—</text>
				<paragraph id="H8CB6DC4B172143F29E6AF615C49067B7"><enum>(1)</enum><text>in every
			 appropriate case, to contact in a timely fashion each person described in
			 section 3(a), or the government with primary jurisdiction over such person, in
			 order to afford such person, or such government, the opportunity to provide
			 explanatory, exculpatory, or other additional information with respect to the
			 transfer that caused such person to be identified in a report submitted
			 pursuant to section 3(a); and</text>
				</paragraph><paragraph id="HA4722D645DA04F118856635A1259E6C4"><enum>(2)</enum><text>to exercise the
			 authority described in subsection (a) in all cases in which information
			 obtained from each person described in section 3(a), or from the government
			 with primary jurisdiction over such person, establishes that the exercise of
			 such authority is warranted.</text>
				</paragraph></subsection><subsection id="HCB04C647C0C744E8AF13A2BD94009BB6"><enum>(c)</enum><header>Form of
			 transmission</header>
				<paragraph id="H903F43493BE34EB3BDA9168C2B9F66DD"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the determination
			 and report of the President under subsection (a) shall be transmitted in
			 unclassified form.</text>
				</paragraph><paragraph id="H679A018497FF45588CD54EF275DA478F"><enum>(2)</enum><header>Exception</header><text>The
			 determination and report of the President under subsection (a) may be
			 transmitted in classified form if the President certifies to the appropriate
			 congressional committees that it is vital to the national security interests of
			 the United States to do so.</text>
				</paragraph></subsection></section><section commented="no" id="H13EE8FFC04B040FAA4DB0687AF032366"><enum>6.</enum><header>Restrictions on
			 nuclear cooperation with countries aiding proliferation by Iran, North Korea,
			 or Syria</header>
			<subsection commented="no" id="H9A2156A8356043D2A87B9FEBBC98B6C8"><enum>(a)</enum><header>In
			 general</header>
				<paragraph commented="no" id="HEE8A75B39DD540509A668C67758FE323"><enum>(1)</enum><header>Restrictions</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 on or after the date of the enactment of this Act—</text>
					<subparagraph commented="no" id="H34472E8BC3D044C2A1F86B3A3BB98557"><enum>(A)</enum><text>no agreement for
			 cooperation between the United States and the government of any country that is
			 assisting the nuclear program of Iran, North Korea, or Syria, or transferring
			 advanced conventional weapons or missiles to Iran, North Korea, or Syria may be
			 submitted to the President or to Congress pursuant to section 123 of the Atomic
			 Energy Act of 1954 (42 U.S.C. 2153),</text>
					</subparagraph><subparagraph commented="no" id="HD184798DE9774A32BB1FB88C3CF3825B"><enum>(B)</enum><text>no such agreement
			 may enter into force with respect to such country,</text>
					</subparagraph><subparagraph commented="no" id="HBF015ED82BC54DA0855C8BA2D163A1AE"><enum>(C)</enum><text>no license may be
			 issued for export directly or indirectly to such country of any nuclear
			 material, facilities, components, or other goods, services, or technology that
			 would be subject to such agreement, and</text>
					</subparagraph><subparagraph commented="no" id="H0C1F7AAD28604787B2E2365299798A4F"><enum>(D)</enum><text>no approval may be
			 given for the transfer or retransfer directly or indirectly to such country of
			 any nuclear material, facilities, components, or other goods, services, or
			 technology that would be subject to such agreement,</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">until the
			 President makes the determination and report under paragraph (2).</continuation-text></paragraph><paragraph commented="no" id="H86C5CA26E0564097ACB946D7BD86633A"><enum>(2)</enum><header>Determination
			 and report</header><text>The determination and report referred to in paragraph
			 (1) are a determination and report by the President, submitted to the Committee
			 on Foreign Affairs of the House of Representatives and the Committee on Foreign
			 Relations of the Senate, that—</text>
					<subparagraph commented="no" id="HCF0971757DC843B0964A93BB24BE5458"><enum>(A)</enum><text>Iran, North Korea,
			 or Syria, as the case may, has ceased its efforts to design, develop, or
			 acquire a nuclear explosive device or related materials or technology;
			 or</text>
					</subparagraph><subparagraph commented="no" id="HD9DEA1EF0C494A82BEC7F3EE33B1BA8C"><enum>(B)</enum><text>the government of
			 the country that is assisting the nuclear programs of Iran, North Korea, or
			 Syria, as the case may be, or transferring advanced conventional weapons or
			 missiles to Iran, North Korea, or Syria, as the case may be—</text>
						<clause commented="no" id="H7EBDDB63C08041179D3CDDA6169F29DE"><enum>(i)</enum><text>has suspended all
			 nuclear assistance to Iran, North Korea, or Syria, as the case may be, and all
			 transfers of advanced conventional weapons and missiles to Iran, North Korea,
			 or Syria, as the case may be; and</text>
						</clause><clause commented="no" id="H06CF07790F4741578A8E30FE39C5D44E"><enum>(ii)</enum><text>is committed to
			 maintaining that suspension until Iran, North Korea, or Syria, as the case may
			 be, has implemented measures that would permit the President to make the
			 determination described in subparagraph (A).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H45ADBD16A09147809BF29E359A2D9066"><enum>(b)</enum><header>Rules of
			 construction</header><text>The restrictions described in subsection
			 (a)(1)—</text>
				<paragraph commented="no" id="H2111A04B27E649FA82EB6EA4485224E2"><enum>(1)</enum><text>shall apply in
			 addition to all other applicable procedures, requirements, and restrictions
			 described in the Atomic Energy Act of 1954 and other applicable Acts;</text>
				</paragraph><paragraph commented="no" id="HD91352212ED94A4995DC46399F98F6B6"><enum>(2)</enum><text>shall not be
			 construed as affecting the validity of an agreement for cooperation between the
			 United States and the government of a country that is in effect on the date of
			 the enactment of this Act; and</text>
				</paragraph><paragraph id="H75B9DF2BA9CE4409B2F6FAAC339F610A"><enum>(3)</enum><text>shall not be
			 construed as applying to assistance for the Bushehr nuclear reactor, unless
			 such assistance is determined by the President to be contributing to the
			 efforts of Iran to develop nuclear weapons.</text>
				</paragraph></subsection><subsection commented="no" id="HD4B4B1B2C81A4127AA986624FEC290B9"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph commented="no" id="HB1507853E5C1457BAE86468A99F2C601"><enum>(1)</enum><header>Agreement for
			 cooperation</header><text>The term <term>agreement for cooperation</term> has
			 the meaning given that term in section 11 b. of the Atomic Energy Act of 1954
			 (42 U.S.C. 2014 b.).</text>
				</paragraph><paragraph commented="no" id="HDAEE5E82A1274E349638718E5AFAA85C"><enum>(2)</enum><header>Assisting the
			 nuclear program of iran, north korea, or syria</header><text>The term
			 <term>assisting the nuclear program of Iran, North Korea, or Syria</term> means
			 the intentional transfer to Iran, North Korea, or Syria by a government, or by
			 a person subject to the jurisdiction of a government with the knowledge and
			 acquiescence of that government, of goods, services, or technology listed on
			 the Nuclear Suppliers Group Guidelines for the Export of Nuclear Material,
			 Equipment and Technology (published by the International Atomic Energy Agency
			 as Information Circular INFCIRC/254/Rev. 3/Part 1, and subsequent revisions),
			 or the Nuclear Suppliers Group Guidelines for Transfers of Nuclear-Related
			 Dual-Use Equipment, Material, and Related Technology (published by the
			 International Atomic Energy Agency as Information Circular INFCIR/254/Rev.
			 3/Part 2, and subsequent revisions).</text>
				</paragraph><paragraph commented="no" id="H8597D868A89943839055344BA6839169"><enum>(3)</enum><header>Country that is
			 assisting the nuclear programs of iran, north korea, or syria or transferring
			 advanced conventional weapons or missiles to iran, north korea, or
			 syria</header><text>The term <term>country that is assisting the nuclear
			 program of Iran, North Korea, or Syria or transferring advanced conventional
			 weapons or missiles to Iran, North Korea, or Syria</term> means any country
			 determined by the President to be assisting the nuclear program of Iran, North
			 Korea, or Syria or transferring advanced conventional weapons or missiles to
			 Iran, North Korea, or Syria.</text>
				</paragraph><paragraph commented="no" id="H5AF13B82C37E4338908E563C839AEE5E"><enum>(4)</enum><header>Transfer</header><text>The
			 term <term>transfer</term> means the conveyance of technological or
			 intellectual property, or the conversion of intellectual or technological
			 advances into marketable goods, services, or articles of value, developed and
			 generated in one place, to another through illegal or illicit means to a
			 country, the government of which the Secretary of State has determined, for
			 purposes of section 6(j)(1)(A) of the Export Administration Act of 1979 (as in
			 effect pursuant to the International Emergency Economic Powers Act; 50 U.S.C.
			 1701 et seq.), section 40(d) of the Arms Export Control Act (22 U.S.C.
			 2780(d)), and section 620A of the Foreign Assistance Act of 1961 (22 U.S.C.
			 2371), is a government that has repeatedly provided support for acts of
			 international terrorism.</text>
				</paragraph><paragraph commented="no" id="HBF542439F88C4DF897D9B97442FCB835"><enum>(5)</enum><header>Transferring
			 advanced conventional weapons or missiles to iran, north korea, or
			 syria</header><text>The term <term>transferring advanced conventional weapons
			 or missiles to Iran, North Korea, or Syria</term> means the intentional
			 transfer to Iran, North Korea, or Syria by a government, or by a person subject
			 to the jurisdiction of a government with the knowledge and acquiescence of that
			 government, of goods, services, or technology listed on—</text>
					<subparagraph commented="no" id="H5AF5F9D7BFC04BABA92B2377B0551D64"><enum>(A)</enum><text>the Wassenaar
			 Arrangement list of Dual Use Goods and Technologies and Munitions list of July
			 12, 1996, and subsequent revisions; or</text>
					</subparagraph><subparagraph commented="no" id="H245FF5F7E46741118721579E6404A97C"><enum>(B)</enum><text>the Missile
			 Technology Control Regime Equipment and Technology Annex of June 11, 1996, and
			 subsequent revisions.</text>
					</subparagraph></paragraph></subsection></section><section id="H2899BBDE56144D05BDFE6C3DDBAC6553"><enum>7.</enum><header>Identification of
			 countries that enable proliferation to or from Iran, North Korea, or
			 Syria</header>
			<subsection display-inline="no-display-inline" id="HF06C7C5DEDCC41489E437F4E39B9043F"><enum>(a)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The President shall
			 transmit to the appropriate congressional committees and make available to the
			 public on an annual basis a report that identifies each foreign country that
			 allows one or more foreign persons under the jurisdiction of such country to
			 engage in activities described in section 3 that are sanctionable under section
			 4 despite requests by the United States Government to the government of such
			 country to prevent such activities.</text>
			</subsection><subsection id="H3F01E76E0E4E4451A689A59DDF7D7B71"><enum>(b)</enum><header>Form</header><text>The
			 report required under subsection (a) shall be submitted in unclassified form,
			 but may contain a classified annex if necessary.</text>
			</subsection></section><section id="H4082B61D123241AB84C1CE6298DF9878"><enum>8.</enum><header>Prohibition on
			 United States assistance to countries assisting proliferation activities by
			 Iran, North Korea, or Syria</header>
			<subsection id="HA5AF8E4875BF4B7E87497DB9DDF7FBB3"><enum>(a)</enum><header>In
			 general</header><text>The President shall prohibit assistance (other than
			 humanitarian assistance) under the Foreign Assistance Act of 1961 and shall not
			 issue export licenses for defense articles or defense services under the Arms
			 Export Control Act to a foreign country the government of which the President
			 has received credible information is assisting Iran, North Korea, or Syria in
			 the acquisition, development, or proliferation of weapons of mass destruction
			 or ballistic missiles.</text>
			</subsection><subsection id="HA68EE1E788F0408E8425345117C23601"><enum>(b)</enum><header>Resumption of
			 assistance</header><text display-inline="yes-display-inline">The President is
			 authorized to provide assistance described in subsection (a) to a foreign
			 country subject to the prohibition in subsection (a) if the President
			 determines and notifies the appropriate congressional committees that there is
			 credible information that the government of the country is no longer assisting
			 Iran, North Korea, or Syria in the acquisition, development, or proliferation
			 of weapons of mass destruction or ballistic missiles.</text>
			</subsection><subsection id="HFF1BC6A3E79F44659799EF423DF243FC"><enum>(c)</enum><header>Definition</header><text>In
			 this section, the term <quote>assisting</quote> means providing material or
			 financial support of any kind, including purchasing of material, technology or
			 equipment from Iran, North Korea, or Syria.</text>
			</subsection></section><section display-inline="no-display-inline" id="H82E442C4127F4F209E95299963044235"><enum>9.</enum><header>Restriction on
			 extraordinary payments in connection with the International Space
			 Station</header>
			<subsection id="HAFA36DC54C504D5FBDE9C5C2D15D6B67"><enum>(a)</enum><header>Restriction</header>
				<paragraph id="HD12DC39A1FF44AE3B530CD975EFA4A8D"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, no agency of
			 the United States Government may make extraordinary payments in connection with
			 the International Space Station to the Russian Aviation and Space Agency, any
			 organization or entity under the jurisdiction or control of the Russian
			 Aviation and Space Agency, or any other organization, entity, or element of the
			 Government of the Russian Federation, unless, during the fiscal year in which
			 such extraordinary payments are to be made, the President has made the
			 determination described in subsection (b), and reported such determination to
			 the Committee on Foreign Affairs and the Committee on Science, Space, and
			 Technology of the House of Representatives and the Committee on Foreign
			 Relations and the Committee on Commerce, Science, and Transportation of the
			 Senate.</text>
				</paragraph><paragraph id="H3E776FB3DE934A758924B93850C7096F"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">If the President is unable to make the
			 determination described in subsection (b) with respect to a fiscal year in
			 which extraordinary payments in connection with the International Space Station
			 are to be made, the President is authorized to waive the application of
			 paragraph (1) on a case-by-case basis with respect to the fiscal year if not
			 less than 15 days prior to the date on which the waiver is to take effect the
			 President submits to the appropriate congressional committees a report that
			 contains—</text>
					<subparagraph commented="no" id="H4813D91B6C284E2CBCCA60229859FBF6"><enum>(A)</enum><text display-inline="yes-display-inline">the reasons why the determination described
			 in subsection (b) cannot be made;</text>
					</subparagraph><subparagraph id="H09E283A361B24AE2ADC588C5B1329046"><enum>(B)</enum><text>the amount of the
			 extraordinary payment to be made under the waiver;</text>
					</subparagraph><subparagraph commented="no" id="HA81A7C14D2F347F5A6AA448D426BAC2B"><enum>(C)</enum><text>the steps being
			 undertaken by the United States to ensure compliance by the Russian Federation
			 with the conditions described in subsection (b); and</text>
					</subparagraph><subparagraph id="HA052A35F5C7A429E832BDC1473602295"><enum>(D)</enum><text>a determination of
			 the President that the waiver is vital to the national interests of the United
			 States.</text>
					</subparagraph></paragraph></subsection><subsection id="H679675C2DFCE4663BD75042850991548"><enum>(b)</enum><header>Determination
			 regarding Russian cooperation in preventing proliferation relating to Iran,
			 North Korea, and Syria</header><text>The determination referred to in
			 subsection (a) is a determination by the President that—</text>
				<paragraph id="H297EAE69358D431E870338B9F581977C"><enum>(1)</enum><text>it is the policy
			 of the Government of the Russian Federation (including the law enforcement,
			 export promotion, export control, and intelligence agencies of such Government)
			 to oppose the proliferation to or from Iran, North Korea, and Syria of weapons
			 of mass destruction and missile systems capable of delivering such
			 weapons;</text>
				</paragraph><paragraph id="H2DDC60E177DA44A4B57B2196BFD836FF"><enum>(2)</enum><text>the Government of
			 the Russian Federation (including the law enforcement, export promotion, export
			 control, and intelligence agencies of such Government) has demonstrated and
			 continues to demonstrate a sustained commitment to seek out and prevent the
			 transfer to or from Iran, North Korea, and Syria of goods, services, and
			 technology that could make a material contribution to the nuclear, biological,
			 or chemical weapons, or of ballistic or cruise missile systems development
			 programs of Iran; and</text>
				</paragraph><paragraph id="HFC6B1608826E4999A2FDF46C194098D5"><enum>(3)</enum><text>neither the
			 Russian Aviation and Space Agency, nor any organization or entity under the
			 jurisdiction or control of the Russian Aviation and Space Agency, has, during
			 the one-year period ending on the date of the determination under this
			 subsection made transfers to or from Iran, North Korea, or Syria reportable
			 under section 3(a) (other than transfers with respect to which a determination
			 pursuant to section 5 has been or will be made).</text>
				</paragraph></subsection><subsection id="H49B5128C4DE4419A901D1E3013301A04"><enum>(c)</enum><header>Prior
			 notification</header><text>Not less than five days before making a
			 determination under this section, the President shall notify the Committee on
			 Foreign Affairs and the Committee on Science, Space, and Technology of the
			 House of Representatives and the Committee on Foreign Relations and the
			 Committee on Commerce, Science, and Transportation of the Senate of the
			 President’s intention to make such a determination.</text>
			</subsection><subsection id="H1F1FF2A6831349D7B3D637B70DB8D535"><enum>(d)</enum><header>Written
			 justification</header><text>A determination of the President under this section
			 shall include a written justification describing in detail the facts and
			 circumstances supporting the President’s conclusion.</text>
			</subsection><subsection id="HC8A2552671384285A47038AB5AAFDA34"><enum>(e)</enum><header>Transmission in
			 classified form</header><text display-inline="yes-display-inline">If the
			 President considers it appropriate, a determination of the President under this
			 section, a prior notification under subsection (c), and a written justification
			 under subsection (d), or appropriate parts thereof, may be transmitted in
			 classified form.</text>
			</subsection><subsection id="H7C6B3DCC011D4A559F7B2A00E31502E7"><enum>(f)</enum><header>Exception for
			 crew safety</header>
				<paragraph id="H505ED844AAAE4488AF64F8884B39A0D9"><enum>(1)</enum><header>Exception</header><text display-inline="yes-display-inline">The National Aeronautics and Space
			 Administration may make extraordinary payments in connection with the
			 International Space Station to the Russian Aviation and Space Agency or any
			 organization or entity under the jurisdiction or control of the Russian
			 Aviation and Space Agency, or any subcontractor thereof, that would otherwise
			 be prohibited under this section if the President notifies Congress in writing
			 that such payments are necessary to prevent the imminent loss of life of or
			 grievous injury to individuals aboard the International Space Station.</text>
				</paragraph><paragraph id="HC8948A4A0A6F4EC5AFCFB8BAAF534CF4"><enum>(2)</enum><header>Report</header><text>Not
			 later than 30 days after notifying Congress that the National Aeronautics and
			 Space Administration will make extraordinary payments under paragraph (1), the
			 President shall transmit to Congress a report describing—</text>
					<subparagraph id="H721C61719EF349E4B0507021940B8FCC"><enum>(A)</enum><text>the extent to
			 which the provisions of subsection (b) had been met as of the date of
			 notification; and</text>
					</subparagraph><subparagraph id="H991DBF70A690467DB3048C291A463C57"><enum>(B)</enum><text>the measures that
			 the National Aeronautics and Space Administration is taking to ensure
			 that—</text>
						<clause id="HF889D16F658D4FDFB0517302B5D9373D"><enum>(i)</enum><text>the
			 conditions posing a threat of imminent loss of life of or grievous injury to
			 individuals aboard the International Space Station necessitating the
			 extraordinary payments are not repeated; and</text>
						</clause><clause id="H7AC155E8A21A48B3A30A2A56DCAEBD14"><enum>(ii)</enum><text>it
			 is no longer necessary to make extraordinary payments in order to prevent
			 imminent loss of life of or grievous injury to individuals aboard the
			 International Space Station.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H4D18232108244E8F855D12C21FBF15C5"><enum>(g)</enum><header>Service Module
			 exception</header>
				<paragraph id="HB8E3CFF1E58142EFBD6D4C9D6B95E5B4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The National
			 Aeronautics and Space Administration may make extraordinary payments in
			 connection with the International Space Station to the Russian Aviation and
			 Space Agency, any organization or entity under the jurisdiction or control of
			 the Russian Aviation and Space Agency, or any subcontractor thereof, that would
			 otherwise be prohibited under this section for the construction, testing,
			 preparation, delivery, launch, or maintenance of the Service Module, and for
			 the purchase (at a total cost not to exceed $14,000,000) of the pressure dome
			 for the Interim Control Module and the Androgynous Peripheral Docking Adapter
			 and related hardware for the United States propulsion module, if—</text>
					<subparagraph id="H254A3CA146C84F72A2D3A275D8C0A8AA"><enum>(A)</enum><text>the President has
			 notified Congress at least five days before making such payments;</text>
					</subparagraph><subparagraph id="HE636D23199E54F2CAD58027D038F6E95"><enum>(B)</enum><text>no report has been
			 made under section 3(a) with respect to an activity of the entity to receive
			 such payment, and the President has no credible information of any activity
			 that would require such a report; and</text>
					</subparagraph><subparagraph id="H9B00296657294856A7C854118A873564"><enum>(C)</enum><text>the United States
			 will receive goods or services of value to the United States commensurate with
			 the value of the extraordinary payments made.</text>
					</subparagraph></paragraph><paragraph id="H4F2F75418F684C9F888F4D7937869A71"><enum>(2)</enum><header>Definition</header><text>For
			 purposes of this subsection, the term <term>maintenance</term> means activities
			 that cannot be performed by the National Aeronautics and Space Administration
			 and which must be performed in order for the Service Module to provide
			 environmental control, life support, and orbital maintenance functions which
			 cannot be performed by an alternative means at the time of payment.</text>
				</paragraph><paragraph commented="no" id="H37067BE3141B472DA08E8A620724FA24"><enum>(3)</enum><header>Termination</header><text>This
			 subsection shall cease to be effective on the date that is 60 days after the
			 date on which a United States propulsion module is in place at the
			 International Space Station.</text>
				</paragraph></subsection><subsection id="H28990C8BD93747609779BE4C468D49DC"><enum>(h)</enum><header>Exception</header><text>No
			 agency of the United States Government may make extraordinary payments in
			 connection with the International Space Station, or any other payments in
			 connection with the International Space Station, to any foreign person subject
			 to measures applied pursuant to section 4 of Executive Order 12938 (November
			 14, 1994), as amended by Executive Order 13094 (July 28, 1998).</text>
			</subsection><subsection id="HC79544DFA95C449D8EAD3C8D006466B9"><enum>(i)</enum><header>Report on
			 certain payments related to International Space Station</header>
				<paragraph id="H2F80E48CC1F5476F962574DCDA02B589"><enum>(1)</enum><header>In
			 general</header><text>The President shall, together with each report submitted
			 under section 3(a), transmit to the Committee on Foreign Relations of the
			 Senate and the Committee on Foreign Affairs of the House of Representatives a
			 report that identifies each Russian entity or person to whom the United States
			 Government has, since November 22, 2005, made a payment in cash or in kind for
			 work to be performed or services to be rendered under the Agreement Concerning
			 Cooperation on the Civil International Space Station, with annex, signed at
			 Washington January 29, 1998, and entered into force March 27, 2001, or any
			 protocol, agreement, memorandum of understanding, or contract related
			 thereto.</text>
				</paragraph><paragraph id="H373B19A1A4DA46CD821E984F0918D49A"><enum>(2)</enum><header>Content</header><text>Each
			 report transmitted under paragraph (1) shall include—</text>
					<subparagraph id="H7770EBBF1F0E4B57ADB1F6C6D0BC76BB"><enum>(A)</enum><text>the specific
			 purpose of each payment made to each entity or person identified in such
			 report; and</text>
					</subparagraph><subparagraph id="H2A62749B35644C08BC529F54F3473A0A"><enum>(B)</enum><text>with respect to
			 each such payment, the assessment of the President that the payment was not
			 prejudicial to the achievement of the objectives of the United States
			 Government to prevent the proliferation of ballistic or cruise missile systems
			 in Iran and other countries that have repeatedly provided support for acts of
			 international terrorism, as determined by the Secretary of State under section
			 620A(a) of the Foreign Assistance Act of 1961 (22 U.S.C. 2371(a)), section 6(j)
			 of the Export Administration Act of 1979 (50 U.S.C. App. 2405(j)), or section
			 40(d) of the Arms Export Control Act (22 U.S.C. 2780(d)).</text>
					</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H68AC7F20A87843A39AD2A7CC8C67C9BD"><enum>10.</enum><header>Exclusion from
			 the United States of senior officials of foreign persons who have aided
			 proliferation relating to Iran</header><text display-inline="no-display-inline">Except as provided in subsection (b), the
			 Secretary of State shall deny a visa to, and the Secretary of Homeland Security
			 shall exclude from the United States, any alien whom the Secretary of State
			 determines is an alien who, on or after the date of the enactment of this Act,
			 is a—</text>
			<paragraph id="H8432E07419AB46319ED6EBD4C4D1EA78"><enum>(1)</enum><text>corporate officer,
			 principal, or shareholder with a controlling interest of a foreign person
			 identified in a report submitted pursuant to section 3(a);</text>
			</paragraph><paragraph id="HAE0F36CA15DA4C85965F530C730140F8"><enum>(2)</enum><text>corporate officer,
			 principal, or shareholder with a controlling interest of a successor entity to,
			 or a parent or subsidiary of, a foreign person identified in such a
			 report;</text>
			</paragraph><paragraph id="H2D05802F838C426B8EF20AD6387B9F04"><enum>(3)</enum><text>corporate officer,
			 principal, or shareholder with a controlling interest of an affiliate of a
			 foreign person identified in such a report, if such affiliate engaged in the
			 activities referred to in such report, and if such affiliate is controlled in
			 fact by the foreign person identified in such report; or</text>
			</paragraph><paragraph id="HB29BBB507A314A62ADB29F6A4CE1D607"><enum>(4)</enum><text>spouse, minor
			 child, or agent of a person excludable under paragraph (1), (2), or (3).</text>
			</paragraph></section><section id="H0B91630213214E739FCF3FF89D2C0BD7"><enum>11.</enum><header>Prohibition on
			 certain vessels landing in the United States; enhanced
			 inspections</header><text display-inline="no-display-inline">The Ports and
			 Waterways Safety Act (33 U.S.C. 1221 et seq.) is amended by adding at the end
			 the following:</text>
			<quoted-block id="H0EE50F4D7A3341B8B1F480AD8B6FD395">
				<section id="H002261B8BB2E4D839286D9C2E389C87E"><enum>16.</enum><header>Prohibition on
				certain vessels landing in the United States; enhanced inspections</header>
					<subsection id="HB10F18FB7DC940C4AC8D07905B64092B"><enum>(a)</enum><header>Certification
				requirement</header>
						<paragraph id="H65E4DAEE06914B9F9942D06F68A33924"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Beginning on the date
				of enactment of the Iran, North Korea, and Syria Nonproliferation Reform and
				Modernization Act of 2011, before a vessel arrives at a port in the United
				States, the owner, charterer, operator, or master of the vessel shall certify
				that the vessel did not enter a port in Iran, North Korea, or Syria during the
				180-day period ending on the date of arrival of the vessel at the port in the
				United States.</text>
						</paragraph><paragraph id="H9621D553C5B348238570E4ECAB762B99"><enum>(2)</enum><header>False
				certifications</header><text>The Secretary shall prohibit from landing at a
				port in the United States for a period of at least 2 years—</text>
							<subparagraph id="HBA6E2692BA4E4411B1D373012A2D4E6C"><enum>(A)</enum><text>any vessel for
				which a false certification was made under section (a); and</text>
							</subparagraph><subparagraph id="HC8F7B762840B4F98AFE964FD502037DC"><enum>(B)</enum><text>any other vessel
				owned or operated by a parent corporation, partnership, association, or
				individual proprietorship of the vessel for which the false certification was
				made.</text>
							</subparagraph></paragraph></subsection><subsection id="HAEDA851D77FF40B4A0BADDA6CBDA2259"><enum>(b)</enum><header>Enhanced
				inspections</header><text>The Secretary shall—</text>
						<paragraph id="HA6F8B61B69C94F6A8FAEABED9BF2C956"><enum>(1)</enum><text>identify foreign
				ports at which vessels have landed during the preceding 12-month period that
				have also landed at ports in Iran, North Korea, or Syria during that period;
				and</text>
						</paragraph><paragraph id="HD2DC8295BCB640659A9B5383539DB5BD"><enum>(2)</enum><text>inspect vessels
				arriving in the United States from foreign ports identified under paragraph (1)
				to establish whether the vessel was involved, during the 12-month period ending
				on the date of arrival of the vessel at the port in the United States, in any
				activity that would be subject to sanctions under the Iran, North Korea, and
				Syria Nonproliferation Reform and Modernization Act of
				2011.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H16B0C3B472284237A76B528A980833B4"><enum>12.</enum><header>Sanctions with
			 respect to critical defense resources provided to or acquired from Iran, North
			 Korea, or Syria</header>
			<subsection id="H57C5398BEB294405BE4FC7DBB380BDF9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The President shall
			 apply the sanctions described in subsection (b) to any person the President
			 determines is, on or after the date of the enactment of this Act, providing to,
			 or acquiring from, Iran, North Korea, or Syria any good or technology that the
			 President determines is used, or is likely to be used, for military
			 applications.</text>
			</subsection><subsection id="HCB5ACD82E90A49F19BF3D8B3C6205E63"><enum>(b)</enum><header>Sanctions
			 described</header><text>The sanctions described in this subsection are, with
			 respect to a person described in subsection (a), the following:</text>
				<paragraph id="H9591E0276A484ACCADA4B0BBEC23A873"><enum>(1)</enum><header>Foreign
			 exchange</header><text>Prohibiting any transactions in foreign exchange that
			 are subject to the jurisdiction of the United States and in which that person
			 has any interest.</text>
				</paragraph><paragraph id="HE11B39133A274481BB64E39A89BFAC49"><enum>(2)</enum><header>Banking
			 transactions</header><text>Prohibiting any transfers of credit or payments
			 between financial institutions or by, through, or to any financial institution,
			 to the extent that such transfers or payments are subject to the jurisdiction
			 of the United States and involve any interest of that person.</text>
				</paragraph><paragraph id="H1493E623A6E64DB39481E7B1D69AEF0C"><enum>(3)</enum><header>Property
			 transactions</header><text>Prohibiting any person from—</text>
					<subparagraph id="H786942134709440B8A693E2A31577CBD"><enum>(A)</enum><text>acquiring,
			 holding, withholding, using, transferring, withdrawing, transporting, or
			 exporting any property that is subject to the jurisdiction of the United States
			 and with respect to which the person described in subsection (a) has any
			 interest;</text>
					</subparagraph><subparagraph id="HB5114833402B4405A7561624A94654AC"><enum>(B)</enum><text>dealing in or
			 exercising any right, power, or privilege with respect to such property;
			 or</text>
					</subparagraph><subparagraph id="H913E73B1A45A43F28D879F18D6703BE1"><enum>(C)</enum><text>conducting any
			 transaction involving such property.</text>
					</subparagraph></paragraph><paragraph id="H79EB67386E5E41C495CA99EC895E29AA"><enum>(4)</enum><header>Loan
			 guarantees</header><text>Prohibiting the head of any Federal agency from
			 providing a loan guarantee to that person.</text>
				</paragraph><paragraph id="H4BA4E9D669B3417E9FBDB09C38DCD423"><enum>(5)</enum><header>Additional
			 sanctions</header><text display-inline="yes-display-inline">Additional
			 sanctions, as appropriate, in accordance with the International Emergency
			 Economic Powers Act (50 U.S.C. 1701 et seq.).</text>
				</paragraph></subsection><subsection id="H6DEE31A7974D4C4DB2FBC6A72E94AC8F"><enum>(c)</enum><header>Restrictions on
			 export licenses for nuclear cooperation and certain loan
			 guarantees</header><text>Before issuing a license for the exportation of any
			 article pursuant to an agreement for cooperation under section 123 of the
			 Atomic Energy Act of 1954 (42 U.S.C. 2153) or approving a loan guarantee or any
			 other assistance provided by the United States Government with respect to a
			 nuclear energy project, the Secretary of Energy, the Secretary of Commerce, and
			 the Nuclear Regulatory Commission shall certify to Congress that issuing the
			 license or approving the loan guarantee or other assistance (as the case may
			 be) will not permit the transfer of any good or technology described in
			 subsection (a) to Iran, North Korea, or Syria.</text>
			</subsection><subsection commented="no" id="HA7C44C50BABA4A5B85B9C6449D7E35C3"><enum>(d)</enum><header>Exception</header><text display-inline="yes-display-inline">The sanctions described in subsection (b)
			 shall not apply to the repayment or other satisfaction of a loan or other
			 obligation incurred under a program of the Export-Import Bank of the United
			 States, as in effect as of the date of the enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H1FAAAE853C4C4DC19A321E36C61F0CA2"><enum>13.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF8BBC7653C8E44108D4BDD95850DCEBD"><enum>(1)</enum><header>Adherent to
			 relevant nonproliferation regime</header><text>A government is an
			 <quote>adherent</quote> to a <quote>relevant nonproliferation regime</quote> if
			 such government—</text>
				<subparagraph id="H842A969C05BE4005BFA6510A27853705"><enum>(A)</enum><text>is a member of the
			 Nuclear Suppliers Group with respect to a transfer of goods, services, or
			 technology described in section 3(a)(1)(A)(i);</text>
				</subparagraph><subparagraph id="H5092A127D3444ABFBEDBCA8114DB4377"><enum>(B)</enum><text>is a member of the
			 Missile Technology Control Regime with respect to a transfer of goods,
			 services, or technology described in section 3(a)(1)(A)(ii), or is a party to a
			 binding international agreement with the United States that was in effect on
			 January 1, 1999, to control the transfer of such goods, services, or technology
			 in accordance with the criteria and standards set forth in the Missile
			 Technology Control Regime;</text>
				</subparagraph><subparagraph id="HC0A02B777A0047A49A6E0BDE8D7449AE"><enum>(C)</enum><text>is a member of the
			 Australia Group with respect to a transfer of goods, services, or technology
			 described in section 3(a)(1)(A)(iii);</text>
				</subparagraph><subparagraph id="H2A8514904BCF42FCB8035D3F7A120E1D"><enum>(D)</enum><text>is a party to the
			 Convention on the Prohibition of the Development, Production, Stockpiling and
			 Use of Chemical Weapons and on Their Destruction with respect to a transfer of
			 goods, services, or technology described in section 3(a)(1)(A)(iv); or</text>
				</subparagraph><subparagraph id="H07A063CA4442441F957C44CAC8A5FCFC"><enum>(E)</enum><text>is a member of the
			 Wassenaar Arrangement with respect to a transfer of goods, services, or
			 technology described in section 3(a)(1)(A)(v).</text>
				</subparagraph></paragraph><paragraph id="H0C28F64F092C4F91A56F32D5B274FAF5"><enum>(2)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means the Committee on Foreign Affairs of the House of
			 Representatives and the Committee on Foreign Relations and the Committee on
			 Banking, Housing, and Urban Affairs of the Senate.</text>
			</paragraph><paragraph id="HD571259597124FAD9A41B89D0C790C10"><enum>(3)</enum><header>Extraordinary
			 payments in connection with the International Space Station</header><text>The
			 term <term>extraordinary payments in connection with the International Space
			 Station</term> means payments in cash or in kind made or to be made by the
			 United States Government—</text>
				<subparagraph id="H2E01AFA995BE43F5A72D7CEE00AD65EC"><enum>(A)</enum><text>for work on the
			 International Space Station which the Government of the Russian Federation
			 pledged at any time to provide at its expense, or</text>
				</subparagraph><subparagraph id="H442CE2BC72D8424F8202830DFCBE82BB"><enum>(B)</enum><text>for work on the
			 International Space Station, or for the purchase of goods or services relating
			 to human space flight, that are not required to be made under the terms of a
			 contract or other agreement that was in effect on January 1, 1999, as such
			 terms were in effect on such date,</text>
				</subparagraph><continuation-text continuation-text-level="paragraph">except that
			 such term does not mean payments in cash or in kind made or to be made by the
			 United States Government before December 31, 2020, for work to be performed or
			 services to be rendered before such date necessary to meet United States
			 obligations under the Agreement Concerning Cooperation on the Civil
			 International Space Station, with annex, signed at Washington January 29, 1998,
			 and entered into force March 27, 2001, or any protocol, agreement, memorandum
			 of understanding, or contract related thereto.</continuation-text></paragraph><paragraph id="H4E440A7EC9FA40AA80AFC3A10BE43ECC"><enum>(4)</enum><header>Foreign
			 person</header><text>The term <term>foreign person</term> means—</text>
				<subparagraph id="H00DCD8E213C84DD08FE37BC1754F8D18"><enum>(A)</enum><text>a natural person
			 who is an alien;</text>
				</subparagraph><subparagraph id="H6B9B03EE301A413A8BFDAD27D71044C7"><enum>(B)</enum><text>a corporation,
			 business association, partnership, society, trust, or any other nongovernmental
			 entity, organization, or group, successor, subunit, or subsidiary organized
			 under the laws of a foreign country or that has its principal place of business
			 in a foreign country; and</text>
				</subparagraph><subparagraph id="H0B01BA63CF3A48B784AD2643833282DB"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H7B5E17C9C84F4B75B3C5836B4FA00A5C"><enum>(i)</enum><text>any foreign government;
			 or</text>
					</clause><clause id="H4F0C3D99278F41F592A45287A9F11D4E" indent="up1"><enum>(ii)</enum><text>any foreign government agency or
			 entity.</text>
					</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H56EE4823DD36450488920D0374EC8615"><enum>(5)</enum><header>Knowingly</header><text>The
			 term <term>knowingly</term>, with respect to conduct, a circumstance, or a
			 result, means that a person has actual knowledge, or should have known, of the
			 conduct, the circumstance, or the result of such conduct, circumstance, or
			 result.</text>
			</paragraph><paragraph id="H9EDBE655301D4CBB8794B0C0E8CC9F93"><enum>(6)</enum><header>Organization or
			 entity under the jurisdiction or control of the Russian Aviation and Space
			 Agency</header>
				<subparagraph id="H2B4141C49B41428CA659B4D03D225841"><enum>(A)</enum><header>Definition</header><text>The
			 term <term>organization or entity under the jurisdiction or control of the
			 Russian Aviation and Space Agency</term> means an organization or entity
			 that—</text>
					<clause id="H667405A4813440979BB97FF14445D76D"><enum>(i)</enum><text>was
			 made part of the Russian Space Agency upon its establishment on February 25,
			 1992;</text>
					</clause><clause id="HF48C5E1F29D84E2D9A2DFB04AE7B54B9"><enum>(ii)</enum><text>was
			 transferred to the Russian Space Agency by decree of the Government of the
			 Russian Federation on July 25, 1994, or May 12, 1998;</text>
					</clause><clause id="HC80DD1F9128148E0971F03DD4709E79B"><enum>(iii)</enum><text>was or is
			 transferred to the Russian Aviation and Space Agency or Russian Space Agency by
			 decree of the Government of the Russian Federation at any other time before,
			 on, or after March 14, 2000; or</text>
					</clause><clause id="H9B5E02A4F46B46BD9173EC5AF829F7F6"><enum>(iv)</enum><text>is
			 a joint stock company in which the Russian Aviation and Space Agency or Russian
			 Space Agency has at any time held controlling interest.</text>
					</clause></subparagraph><subparagraph id="H718D465471CD4AF59DBE9D38A925AEC3"><enum>(B)</enum><header>Extension</header><text>Any
			 organization or entity described in subparagraph (A) shall be deemed to be
			 under the jurisdiction or control of the Russian Aviation and Space Agency
			 regardless of whether—</text>
					<clause id="H1694E256480444BF989B17DDDEF1436C"><enum>(i)</enum><text>such
			 organization or entity, after being part of or transferred to the Russian
			 Aviation and Space Agency or Russian Space Agency, is removed from or
			 transferred out of the Russian Aviation and Space Agency or Russian Space
			 Agency; or</text>
					</clause><clause id="HE65AC154419742CD88775559A1C8812F"><enum>(ii)</enum><text>the
			 Russian Aviation and Space Agency or Russian Space Agency, after holding a
			 controlling interest in such organization or entity, divests its controlling
			 interest.</text>
					</clause></subparagraph></paragraph><paragraph id="HB9CEF97776F34096B2F2B785C64AD763"><enum>(7)</enum><header>Subsidiary</header><text display-inline="yes-display-inline">The term <term>subsidiary</term> means an
			 entity (including a partnership, association, trust, joint venture,
			 corporation, or other organization) of a parent company that controls, directly
			 or indirectly, the other entity.</text>
			</paragraph><paragraph commented="no" id="HCADAF8C1148A46A0838E76B987B495E7"><enum>(8)</enum><header>Transfer or
			 transferred</header><text>The term <term>transfer</term> or
			 <term>transferred</term>, with respect to a good, service, or technology,
			 includes—</text>
				<subparagraph id="H944C9F972BA6441FA1319BE4ABD4546B"><enum>(A)</enum><text>the conveyance of
			 technological or intellectual property; and</text>
				</subparagraph><subparagraph id="H97FAE99FBFF342B39E5147413F0AF7C0"><enum>(B)</enum><text display-inline="yes-display-inline">the conversion of technological or
			 intellectual advances into marketable goods, services, or technology of value
			 that is developed and generated in one location and transferred to another
			 location through illegal or illicit means.</text>
				</subparagraph></paragraph><paragraph id="HBEA321F662674BF3AD6E8D6F42135B40"><enum>(9)</enum><header>United States
			 person</header><text>The term <term>United States person</term> means—</text>
				<subparagraph id="HE2220AB6905D40959540603DADAC762B"><enum>(A)</enum><text>a natural person
			 who is a citizen or resident of the United States; or</text>
				</subparagraph><subparagraph id="H4264F02310704D9E99E5D27E37ED9B60"><enum>(B)</enum><text>an entity that is
			 organized under the laws of the United States or any State or territory
			 thereof.</text>
				</subparagraph></paragraph><paragraph id="H943E581A62AB47888F8A4E060D9680B3"><enum>(10)</enum><header>Vessel</header><text>The
			 term <term>vessel</term> has the meaning given such term in section 1081 of
			 title 18, United States Code. Such term also includes aircraft, regardless of
			 whether or not the type of aircraft at issue is described in such
			 section.</text>
			</paragraph><paragraph id="H5AD1F22AACBE40478F7C85A77158A2A4"><enum>(11)</enum><header>Technical
			 assistance</header><text>The term <term>technical assistance</term> means
			 providing of advice, assistance, and training pertaining to the installation,
			 operation, and maintenance of equipment for destabilizing types and forms of
			 conventional weapons.</text>
			</paragraph></section><section id="H8EC005A27B454208B6F0A9DFA130AFE6"><enum>14.</enum><header>Repeal of Iran,
			 North Korea, and Syria Nonproliferation Act</header>
			<subsection id="H7B84385A6BD44E6A9166EF6911A1FE11"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">The Iran, North Korea, and Syria
			 Nonproliferation Act (50 U.S.C. 1701 note) is repealed.</text>
			</subsection><subsection id="H48EA9137B89742D49435D23111F2AE73"><enum>(b)</enum><header>References</header><text display-inline="yes-display-inline">Any reference in a law, regulation,
			 document, or other record of the United States to the Iran, North Korea, and
			 Syria Nonproliferation Act shall be deemed to be a reference to this
			 Act.</text>
