<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend title 28, United States Code, to clarify the statutory authority for the longstanding practice of the Department of Justice of providing investigatory assistance on request of State and local authorities with respect to certain serious violent crimes, and for other purposes. </official-title>

<section id="H6AB916361C854221ADA2789BF1CC66EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investigative Assistance for Violent Crimes Act of 2012</short-title></quote>.</text></section> 
<section id="H6F257B12AB0F4EC0BFCE40970B25ADEA"><enum>2.</enum><header>Investigation of certain violent acts, shootings, and mass killings</header> 
<subsection id="HE04CDA9C77814623A47A5D3FB9354B28"><enum>(a)</enum><header>Attorney general</header><text>Title 28, United States Code, is amended—</text> 
<paragraph id="HC3F0D2606FA24204832822A0ADD98829"><enum>(1)</enum><text>in section 530C(b)(1)(L)(i), by striking <quote>$2,000,000</quote> and inserting <quote>$3,000,000</quote>; and</text></paragraph> 
<paragraph id="HFD81A8B214A44CC1B7DF923F8A43C742"><enum>(2)</enum><text>in section 530C(b)(1), by adding at the end the following—</text>

<subparagraph id="H1F42FB9F38D648F1B57CCAEC5CC0C371"><enum>(M)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H09D4F14199CB450E9FA8E148954B50D2"><enum>(i)</enum><text>At the request of an appropriate law enforcement official of a State or political subdivision, the Attorney General may assist in the investigation of violent acts and shootings occurring in a place of public use and in the investigation of mass killings and attempted mass killings. Any assistance provided under this subparagraph shall be presumed to be within the scope of Federal office or employment.</text></clause> 
<clause id="H5B02341A2C3047D098D662844EC0F52A" indent="up1"><enum>(i)</enum><text>For purposes of this subparagraph—</text> 
<subclause id="H92D297DDF6F7426789F14540C7356AA4"><enum>(I)</enum><text>the term <term>mass killings</term> means 3 or more killings in a single incident; and</text></subclause> 
<subclause id="H05E42E89B40B4538BDC8CE6C8D70B827"><enum>(II)</enum><text>the term <term>place of public use</term> has the meaning given that term under section 2332f(e)(6) of title 18, United States Code.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4BD61FE4907D464BA6BD72C0735C3E04"><enum>(b)</enum><header>Secretary of Homeland Security</header><text>Section 875 of the Homeland Security Act of 2002 (6 U.S.C. 455) is amended by adding at the end the following:</text>

<subsection id="HDD90F547E83640EEAA0BD7716B944BD0"><enum>(d)</enum><header>Investigation of certain violent acts, shootings, and mass killings</header> 
<paragraph id="H9E8FF62C15A44E78A51DC6DC348AF18C"><enum>(1)</enum><header>In general</header><text>At the request of an appropriate law enforcement official of a State or political subdivision, the Secretary, through deployment of the Secret Service or United States Immigration and Customs Enforcement, may assist in the investigation of violent acts and shootings occurring in a place of public use, and in the investigation of mass killings and attempted mass killings. Any assistance provided by the Secretary under this subsection shall be presumed to be within the scope of Federal office or employment.</text></paragraph> 
<paragraph id="HCB0BF7151A32438CBB8C1AAED9D57FAE"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection—</text> 
<subparagraph id="H31721462251443B9B8906151EA42ACA2"><enum>(A)</enum><text>the term <term>mass killings</term> means 3 or more killings in a single incident; and</text></subparagraph> 
<subparagraph id="HC0114F87C56C4AFE8681D9E7C975DF24"><enum>(B)</enum><text>the term <term>place of public use</term> has the meaning given that term under section 2332f(e)(6) of title 18, United States Code.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
