		<section id="H58A986C5C9EE48A29A27EAEA853EFC8B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans’ Disability Claims Efficiency
			 Act of 2011</short-title></quote>.</text>
		</section><section id="HA7E654A8B4AD460F8E9D844EE01D5ACD"><enum>2.</enum><header>Improvement of
			 disability claims processing</header>
			<subsection id="H73578C95530549E5B16C366243AC97F4"><enum>(a)</enum><header>Establishment of
			 fast track interim disability ratings</header><text>Section 1157 of title 38,
			 United States Code, is amended—</text>
				<paragraph id="HF2F11CC3BFE34409A87097B976F0AF4B"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting</text>
					<quoted-block display-inline="yes-display-inline" id="HE8158B05549B4EA6A89C9E3733EC8751" style="USC">
						<subsection display-inline="yes-display-inline" id="H63ACB9E020694B7DBCA3E9C48DD26741"><enum>(a)</enum><text display-inline="yes-display-inline">The
				Secretary</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD8E0CB8C01B24DD2A2B0932E5071EB9F"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block id="HC98ACA623F074E5788BB3C7458D29FB6" style="OLC">
						<subsection id="HA8E939A7F38C47978B4A01BAFB845F15"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA92D98161DCA4C5C9C6D41BEC4563AC8"><enum>(1)</enum><text>In the case of a veteran
				who submits to the Secretary a claim for compensation under this chapter for
				more than one condition and the Secretary determines that a disability rating
				can be assigned without further development for one or more conditions but not
				all conditions in the claim, the Secretary shall—</text>
								<subparagraph id="H48B7A5BB733442EA929FE8D6F86C17EE" indent="up1"><enum>(A)</enum><text>expeditiously review the claim in
				accordance with section 5103B of this title;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H5C23B02DEC5A4E04A9D709AA814B6A86" indent="up1"><enum>(B)</enum><text>assign an interim disability rating
				for each condition that the Secretary determines could be assigned without
				further development (except as provided in paragraph (3)(A)); and</text>
								</subparagraph><subparagraph id="H54D819BF92E84CD49A684DE016A4AE53" indent="up1"><enum>(C)</enum><text>continue development of the remaining
				conditions.</text>
								</subparagraph></paragraph><paragraph id="HD954FF265F944171ACF6EB8107E144C4" indent="up1"><enum>(2)</enum><text>If the Secretary is able to assign a
				disability rating for a condition described in paragraph (1)(C) with respect to
				a claim, the Secretary shall assign such rating and combine such rating with
				each interim rating previously assigned under paragraph (1)(B) with respect to
				that claim.</text>
							</paragraph><paragraph commented="no" id="H2ED264133E2044488BE6EBDDA7ABE573" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE8AEC5805BF842B4A2E748F72DBE0487"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to an interim disability
				rating assigned under paragraph (1)(B) for a condition that is rated less than
				the maximum rate, the Secretary shall continue development of such
				condition.</text>
								</subparagraph><subparagraph id="H151D773791524D74BCAF6852D34C54D7" indent="up1"><enum>(B)</enum><text>Except as provided in subparagraph
				(C), an interim disability rating assigned under paragraph (1)(B) for a
				condition shall remain in effect unless the Secretary later assigns an
				increased rating for such condition.</text>
								</subparagraph><subparagraph commented="no" id="HBEBED75C476B4AE4BA6DD8762A22538E" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the
				Secretary, subparagraph (B) shall not apply to an interim disability rating
				assigned under paragraph (1)(B) for a condition if—</text>
									<clause commented="no" id="H339126EFF30342D9BD0F20AEA1D1F7BE"><enum>(i)</enum><text>such rating was based on fraud;
				or</text>
									</clause><clause commented="no" id="H8F02F4F4BEF546EC88DE94A8AE889506"><enum>(ii)</enum><text>such condition
				improves.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0EC35390029F4023AFB075975EE17A93"><enum>(b)</enum><header>Establishment of
			 fast track claim review process</header>
				<paragraph id="H5BAF9DEB03ED43EFB5C9CBB5C5B28E07"><enum>(1)</enum><header>In
			 general</header><text>Subchapter I of chapter 51 of title 38, United States
			 Code, is amended by inserting after section 5103A the following new
			 section:</text>
					<quoted-block display-inline="no-display-inline" id="H7D0A8D3B732A4F0D9BDCD5F0576C29A2" style="USC">
						<section id="H48AC4BA2D5124393934E4B57AC36FAEA"><enum>5103B.</enum><header>Expedited
				review of initial claims for disability compensation</header>
							<subsection id="HA2F37760DD754A8DA42386F020416DBE"><enum>(a)</enum><header>Process
				Required</header><text>The Secretary shall establish a process for the rapid
				identification of initial claims for disability compensation that should, in
				the adjudication of such claims, receive priority in the order of
				review.</text>
							</subsection><subsection commented="no" id="H889EB00627B745EF804112F6C3628972"><enum>(b)</enum><header>Review of
				Initial Claims</header><text>As part of the process required by subsection (a),
				the Secretary shall carry out a preliminary review of all initial claims for
				disability compensation submitted to the Secretary in order to identify
				whether—</text>
								<paragraph commented="no" id="H3292BECA0FDF45EAB113E8ED42A023A4"><enum>(1)</enum><text>the claims have
				the potential of being adjudicated quickly, including claims where an interim
				disability rating could be assigned under section 1157(b)(1)(B) of this
				title;</text>
								</paragraph><paragraph commented="no" id="H0A069DEE08124396ABF4D94389AF11B7"><enum>(2)</enum><text>the claims qualify
				for priority treatment under paragraph (2) of subsection (c); and</text>
								</paragraph><paragraph commented="no" id="HA73F6546C2AD4787902733020372D5FE"><enum>(3)</enum><text>a temporary
				disability rating could be assigned with respect to the claims under section
				1156 of this title.</text>
								</paragraph></subsection><subsection id="H4A4D2AB352DD4C25AED879DFC9636DEB"><enum>(c)</enum><header>Priority in
				Adjudication of Initial Claims</header><paragraph commented="no" display-inline="yes-display-inline" id="HEB110E84D6A948C4897C37D241FC658F"><enum>(1)</enum><text>As part of the process
				required by subsection (a) and except as provided in paragraph (2), the
				Secretary shall, in the adjudication of initial claims for disability
				compensation submitted to the Secretary, give priority in the order of review
				of such claims to claims identified under subsection (b)(1) as having the
				potential of being adjudicated quickly.</text>
								</paragraph><paragraph id="H885307B1CBAB4481AD73C963C6EE1954" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Under regulations prescribed for such
				purpose, the Secretary may provide priority in the order of review of initial
				claims for disability compensation based on the effect such priority would have
				on a
				claimant.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H40BC7AD808F14110914A12B20DF476E8"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 51 of
			 such title is amended by inserting after the item relating to section 5103A,
			 the following new item:</text>

							<toc-entry level="section">5103B. Expedited review of initial claims
				for disability
				compensation.</toc-entry>
						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H28D50904664F4624998547FB21E06AE8"><enum>(c)</enum><header>Reports</header>
				<paragraph commented="no" id="H05BF70F5A0424E54B83FB73DDADA39ED"><enum>(1)</enum><header>First interim
			 report</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Secretary of Veterans
			 Affairs shall submit to the appropriate congressional committees a report
			 on—</text>
					<subparagraph commented="no" id="HD505348161C6455FBD6966786536551B"><enum>(A)</enum><text>the implementation
			 of sections 1157(b) and 5103B of title 38, United States Code, as added by this
			 section;</text>
					</subparagraph><subparagraph commented="no" id="H33828EAD25184FEFACC0CB280858FF8F"><enum>(B)</enum><text display-inline="yes-display-inline">the workflow of the employees of the
			 Department of Veterans Affairs who review and process claims for disability
			 compensation, including an analysis of—</text>
						<clause commented="no" id="H17CE6AE04BCB4288A611DEF38605A914"><enum>(i)</enum><text>the efficiency of
			 such employees; and</text>
						</clause><clause commented="no" id="H30A6B92DC40049249D9BDCA734D0B047"><enum>(ii)</enum><text>whether such
			 claims are directed to such employees based on the complexity of the claim in
			 relation to the experience and skill of the employee; and</text>
						</clause></subparagraph><subparagraph id="HF564368AF1B1466BA2135A6E89614F59"><enum>(C)</enum><text>pilot programs
			 carried out by the Secretary relating to the review and process of claims for
			 disability compensation, including—</text>
						<clause id="H364CE6B284A14FC089FC936EB17A04E1"><enum>(i)</enum><text>the
			 status of such pilot programs;</text>
						</clause><clause id="HDCD603F30B5F4AE394E8CFCF7687AAC4"><enum>(ii)</enum><text>an
			 evaluation of any best practices learned from such pilot programs; and</text>
						</clause><clause id="H0FD82C39D71E4017A651298A4895EEF6"><enum>(iii)</enum><text>whether such
			 practices should be expanded.</text>
						</clause></subparagraph></paragraph><paragraph id="H534834CC896D402AAC365B8C497D45B8"><enum>(2)</enum><header>Second interim
			 report</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of the enactment of this Act, the Secretary shall submit
			 to the appropriate congressional committees an update to the report submitted
			 under paragraph (1).</text>
				</paragraph><paragraph id="H6204040F432246BCB9C3FE04E4E82AEA"><enum>(3)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than two
			 years after the date of the enactment of this Act, the Secretary shall submit
			 to the appropriate congressional committees an update to the report submitted
			 under paragraph (2).</text>
				</paragraph><paragraph id="H8FCD0582CC5E4B32A945070D1D83026B"><enum>(4)</enum><header>Appropriate
			 congressional committees</header><text display-inline="yes-display-inline">In
			 this subsection, the term <term>appropriate congressional committees</term>
			 means the Committee on Veterans’ Affairs of the House of Representatives and
			 the Committee on Veterans’ Affairs of the Senate.</text>
				</paragraph></subsection><subsection commented="no" id="HD82D9223D43D4660B6E71725A4CF43BA"><enum>(d)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims for disability compensation filed on or
			 after the date that is two years after the date of the enactment of this
			 Act.</text>
