		<section id="HE5A413A3CAC040C9A5128AC3AF86F6D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Children From Internet
			 Pornographers Act of 2011</short-title></quote>.</text>
		</section><section id="H8C23FC9FB68E4374AB72FFF024A1D305"><enum>2.</enum><header>Financial facilitation
			 of access to child pornography</header>
			<subsection id="H6C7AF15A3A934E60B8AE5EEFA13B0E0E"><enum>(a)</enum><header>Offense</header><text>Chapter
			 95 of title 18, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H5F4EA31EE41143B1A5B4DA3B512F6BB2" reported-display-style="italic" style="USC">
					<section id="HA5F23BFA70CD4673BAA4FE1355138F56"><enum>1960A.</enum><header>Financial
				facilitation of access to child pornography</header>
						<subsection id="H3337B2CE66DF4252A8EBFEB8E5977855"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever knowingly
				conducts, or attempts or conspires to conduct, a financial transaction (as
				defined in section 1956(c)) in or affecting interstate or foreign commerce,
				knowing that such transaction will facilitate access to, or the possession of,
				child pornography (as defined in section 2256) shall be fined under this title
				or imprisoned not more than 20 years, or both.</text>
						</subsection><subsection id="H1A432BAF88B14CD396B13BE2CF4D9EB2"><enum>(b)</enum><header>Exclusion from
				offense</header><text display-inline="yes-display-inline">This section does not
				apply to a financial transaction conducted by a person in cooperation with, or
				with the consent of, any Federal, State, or local law enforcement
				agency.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB56F70C5571A47A98EC1EC3FCABC3A26"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 95 of title 18, United States Code, is
			 amended by adding at the end the following new item:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HB21FAF623E14467D9AF8E710E9C9953F"><enum>3.</enum><header>Money laundering
			 predicate</header><text display-inline="no-display-inline">Section
			 1956(c)(7)(D) of title 18, United States Code, is amended—</text>
			<paragraph id="H753D1754F0FB425FBFEE8F1F9BE9AB36"><enum>(1)</enum><text>by inserting <quote>1466A
			 (relating to obscene visual representation of the abuse of children),</quote>
			 before <quote>section 1708</quote>; and</text>
			</paragraph><paragraph id="HD941AD7126CF4B5E801C14AD409C8795"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>1960A (relating to
			 financial facilitation of access to child pornography),</quote> before
			 <quote>section 2113</quote>.</text>
			</paragraph></section><section id="H98D1533A2DD748C68FE0AEA64E966DC7"><enum>4.</enum><header>Retention of certain
			 records by electronic communication service providers</header>
			<subsection id="HB31CE5E1825641C6BDB1C61A5496600E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2703 of title
			 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H1AB11CA617A9407492BC698E51A6FE72" reported-display-style="italic" style="USC">
					<subsection id="H22B92C8C4D534CA3BA9B9F52BC2A1650"><enum>(h)</enum><header>Retention of certain
				records</header>
						<paragraph id="H236A9381969C4B6492BD662E2D38C5B0"><enum>(1)</enum><text display-inline="yes-display-inline">A commercial provider of an electronic
				communication service shall retain for a period of at least one year a log of
				the temporarily assigned network addresses the provider assigns to a subscriber
				to or customer of such service that enables the identification of the
				corresponding customer or subscriber information under subsection (c)(2) of
				this section.</text>
						</paragraph><paragraph id="H450052469D9A4AD8B87CCC5DFE7C0D52"><enum>(2)</enum><text display-inline="yes-display-inline">Access to a record or information required
				to be retained under this subsection may not be compelled by any person or
				other entity that is not a governmental entity.</text>
						</paragraph><paragraph id="HE9F9EE7E907749DA859C709506C6A00C"><enum>(3)</enum><text>The Attorney General
				shall make a study to determine the costs associated with compliance by
				providers with the requirement of paragraph (1). Such study shall include an
				assessment of all the types of costs, including for hardware, software, and
				personnel that are involved. Not later than 2 years after the date of the
				enactment of this paragraph, the Attorney General shall report to Congress the
				results of that study.</text>
						</paragraph><paragraph id="H2B9879BF01514E6C8ECCA6FF1C243903"><enum>(4)</enum><text display-inline="yes-display-inline">In this subsection—</text>
							<subparagraph id="H42467BEE7DA74423A01A22E97D949CEB"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>commercial provider</quote>
				means a provider of electronic communication service that offers Internet
				access capability for a fee to the public or to such classes of users as to be
				effectively available to the public, regardless of the facilities used;
				and</text>
							</subparagraph><subparagraph id="H2CA656F22D284ECB84C1A5D7845CAA35"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>Internet</quote> has the
				same meaning given that term in section 230(f) of the Communications Act of
				1934.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0A92DC6C2EB3432492B43C11B9BFD9E7"><enum>(b)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress—</text>
				<paragraph id="H547F357C084F43299F284B00C76417DC"><enum>(1)</enum><text>to encourage electronic
			 communication service providers to give prompt notice to their customers in the
			 event of a breach of the data retained pursuant to section 2703(h) of title 18
			 of the United States Code, in order that those effected can take the necessary
			 steps to protect themselves from potential misuse of private information;
			 and</text>
				</paragraph><paragraph id="H893920F6E1CD48158ADC7BB91B534EC3"><enum>(2)</enum><text>that records retained
			 pursuant to section 2703(h) of title 18, United States Code, should be stored
			 securely to protect customer privacy and prevent against breaches of the
			 records.</text>
				</paragraph></subsection><subsection id="H300BBD4C3755466AA6B3F663BC363051"><enum>(c)</enum><header>Transition
			 rule</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall not apply until 180 days after the date of the enactment of
			 this Act to a provider of an electronic communications service that does not,
			 on that date of enactment, have in effect a system of retention of records that
			 complies with the requirements of that amendment.</text>
			</subsection><subsection id="HCB1ABA5B7FD44479AEEF9B9116B15B07"><enum>(d)</enum><header>Study</header>
				<paragraph id="HFE35FD5C314146AEAF27B1A47F60A766"><enum>(1)</enum><text display-inline="yes-display-inline">The Attorney General, not later than 2
			 years after the date of the enactment of this Act, shall complete a study of
			 providers affected by section 2703(h) of title 18, United States Code.</text>
				</paragraph><paragraph id="H3E68B4453EEE4F9C880F3C166844CC65"><enum>(2)</enum><text display-inline="yes-display-inline">Such study shall include—</text>
					<subparagraph id="HB9C35B7B78D140AE9AF5B0EDE658E911"><enum>(A)</enum><text>the privacy standards and
			 considerations implemented by those providers as they comply with the
			 requirements of section 2703(h); and</text>
					</subparagraph><subparagraph id="H43CD2333C953426491B217ADDD0E5F4A"><enum>(B)</enum><text display-inline="yes-display-inline">the frequency of any reported breaches of
			 data retained pursuant to section 2703(h).</text>
					</subparagraph></paragraph><paragraph id="H14CA5213C1C841AFB6BFF8A12EB08223"><enum>(3)</enum><text>The Attorney General
			 shall, upon the completion of the study, report the results of the study to
			 Congress.</text>
				</paragraph></subsection></section><section commented="no" id="H9671A066FCCD4C17B188EB124529F053"><enum>5.</enum><header>No cause of action
			 against a provider disclosing information under this chapter</header><text display-inline="no-display-inline">Section 2703(e) of title 18, United States
			 Code, is amended by inserting <quote>retaining records,</quote> after
			 <quote>other specified persons for</quote>.</text>
		</section><section display-inline="no-display-inline" id="H7FAA356247924252A3221C69F8CCE817"><enum>6.</enum><header>Good faith reliance on
			 requirement</header><text display-inline="no-display-inline">Section 2707(e)(1)
			 of title 18, United States Code, is amended by inserting <quote>, or the
			 requirement to retain records under section 2703(h),</quote> after
			 <quote>section 2703(f)</quote>.</text>
		</section><section id="H316B273E8F514A9F92FF0EBB5528331B"><enum>7.</enum><header>Subpoena
			 authority</header><text display-inline="no-display-inline">Section 566(e)(1) of
			 title 28, United States Code, is amended—</text>
			<paragraph id="H59C11FD596AE4AE5919EB445D78AADFF"><enum>(1)</enum><text>in subparagraph (A), by
			 striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H54396EDEDD8944B2990E98BDF628D964"><enum>(2)</enum><text>in subparagraph (B), by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
			</paragraph><paragraph id="HA8EDA42265D3446B9F23B9FF3F6BCFDF"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="HJU00" id="H0E86F2A39A21480BA921CCAB07F8AFFC" reported-display-style="italic" style="OLC">
					<subparagraph id="H42F4AB19DC64428795A692FAC98986B2" indent="up1"><enum>(C)</enum><text>issue administrative
				subpoenas in accordance with section 3486 of title 18, solely for the purpose
				of investigating unregistered sex offenders (as defined in such section
				3486).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB9C7B52BE2CD453692FA17619DBC8EC0"><enum>8.</enum><header>Protection of child
			 witnesses</header><text display-inline="no-display-inline">Section 1514 of
			 title 18, United States Code, is amended—</text>
			<paragraph id="HA60E029BB6DB46A2A87C315CFE91B0D8"><enum>(1)</enum><text>in subsection (b)—</text>
				<subparagraph id="H3993822AE7BB418FAECA2A5B21148B99"><enum>(A)</enum><text>in paragraph (1)—</text>
					<clause id="HDF2C35CAAF3F4E138CEC3763EFFD6DB2"><enum>(i)</enum><text>by inserting <quote>or
			 its own motion,</quote> after <quote>attorney for the Government,</quote>;
			 and</text>
					</clause><clause id="H695084E7AA1249CBA7010E2A1C434D12"><enum>(ii)</enum><text>by inserting <quote>or
			 investigation</quote> after <quote>Federal criminal case</quote> each place it
			 appears;</text>
					</clause></subparagraph><subparagraph id="H89B1FCCC1F9F41BB8C9F32F4C345DC4A"><enum>(B)</enum><text>by redesignating
			 paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5),
			 respectively;</text>
				</subparagraph><subparagraph id="HB88911E6565A4BEB964BEFB30A08A442"><enum>(C)</enum><text>by inserting after
			 paragraph (1) the following:</text>
					<quoted-block changed="added" committee-id="HJU00" id="H1F7726F93E9C4EB083466EC63A99ADE6" reported-display-style="italic" style="OLC">
						<paragraph id="H7D42175D1D6A40A383E87F9E7AFD2762" indent="up1"><enum>(2)</enum><text>In the case of a minor
				witness or victim, the court shall issue a protective order prohibiting
				harassment or intimidation of the minor victim or witness if the court finds
				evidence that the conduct at issue is reasonably likely to adversely affect the
				willingness of the minor witness or victim to testify or otherwise participate
				in the Federal criminal case or investigation. Any hearing regarding a
				protective order under this paragraph shall be conducted in accordance with
				paragraphs (1) and (3), except that the court may issue an ex parte emergency
				protective order in advance of a hearing if exigent circumstances are present.
				If such an ex parte order is applied for or issued, the court shall hold a
				hearing not later than 14 days after the date such order was applied for or is
				issued.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HE84656EDD19F4F4DAC592BFECB0EC65D"><enum>(D)</enum><text>in paragraph (4), as so
			 redesignated, by striking <quote>(and not by reference to the complaint or
			 other document)</quote>; and</text>
				</subparagraph><subparagraph id="HBE92081C833B46EA87EED36A2ABB30A8"><enum>(E)</enum><text>in paragraph (5), as so
			 redesignated, in the second sentence, by inserting before the period at the end
			 the following: <quote>, except that in the case of a minor victim or witness,
			 the court may order that such protective order expires on the later of 3 years
			 after the date of issuance or the date of the eighteenth birthday of that minor
			 victim or witness</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H0AAF16D8D8A14FADA21BE7F35B2A8557"><enum>(2)</enum><text>by striking subsection
			 (c) and inserting the following:</text>
				<quoted-block changed="added" committee-id="HJU00" id="H74CDE2C5637B4220B03DA1BDE3A709FC" reported-display-style="italic" style="OLC">
					<subsection id="H8C9B458BE26843CBAD6EB0851C562B3B"><enum>(c)</enum><text>Whoever knowingly and
				intentionally violates or attempts to violate an order issued under this
				section shall be fined under this title, imprisoned not more than 5 years, or
				both.</text>
					</subsection><subsection id="HA9E752FF52C1456C89FB1F4C3D391EB2"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H670AF4427EE1431F8D9694737707214E"><enum>(1)</enum><text>As used in this
				section—</text>
							<subparagraph changed="added" committee-id="HJU00" id="HD8369427C6A74D638DE2565F85501ADF" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the term <quote>course of
				conduct</quote> means a series of acts over a period of time, however short,
				indicating a continuity of purpose;</text>
							</subparagraph><subparagraph changed="added" committee-id="HJU00" id="HB3D7294F71A1470C9602EE6D2E4B0B70" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the term
				<quote>harassment</quote> means a serious act or course of conduct directed at
				a specific person that—</text>
								<clause id="H863DBC598887456499708FA013DEADC7"><enum>(i)</enum><text>causes substantial
				emotional distress in such person; and</text>
								</clause><clause id="HD02330CC76DC4A1E81ECD85551F821D5"><enum>(ii)</enum><text>serves no legitimate
				purpose;</text>
								</clause></subparagraph><subparagraph changed="added" committee-id="HJU00" id="H156C48F5E24649338EED02120ECDC6B9" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>the term <quote>immediate
				family member</quote> has the meaning given that term in section 115 and
				includes grandchildren;</text>
							</subparagraph><subparagraph changed="added" committee-id="HJU00" id="HA10482E6935248239B9903E9836C4589" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>the term
				<quote>intimidation</quote> means a serious act or course of conduct directed
				at a specific person that—</text>
								<clause id="HC0CC0B47F77C497F98C30F67D007FCA4"><enum>(i)</enum><text>causes fear or
				apprehension in such person; and</text>
								</clause><clause id="H5D90FA2FE5054BA89A26B457A9471B15"><enum>(ii)</enum><text>serves no legitimate
				purpose;</text>
								</clause></subparagraph><subparagraph changed="added" committee-id="HJU00" id="HB54A8A2FF403466199DD2487DBB9A716" indent="up1" reported-display-style="italic"><enum>(E)</enum><text>the term
				<quote>restricted personal information</quote> has the meaning give that term
				in section 119;</text>
							</subparagraph><subparagraph changed="added" committee-id="HJU00" id="HA243A50333FD411B884F50379A7654A5" indent="up1" reported-display-style="italic"><enum>(F)</enum><text>the term <quote>serious
				act</quote> means a single act of threatening, retaliatory, harassing, or
				violent conduct that is reasonably likely to influence the willingness of a
				victim or witness to testify or participate in a Federal criminal case or
				investigation; and</text>
							</subparagraph><subparagraph changed="added" committee-id="HJU00" id="H18D17680207C48A6B18A68238268DAFF" indent="up1" reported-display-style="italic"><enum>(G)</enum><text>the term <quote>specific
				person</quote> means a victim or witness in a Federal criminal case or
				investigation, and includes an immediate family member of such a victim or
				witness.</text>
							</subparagraph></paragraph><paragraph changed="added" committee-id="HJU00" id="HB480E6A2A8F3436A89EBF163713E50B3" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>For purposes of
				subparagraphs (B)(ii) and (D)(ii) of paragraph (1), a court shall presume,
				subject to rebuttal by the person, that the distribution or publication using
				the Internet of a photograph of, or restricted personal information regarding,
				a specific person serves no legitimate purpose, unless that use is authorized
				by that specific person, is for news reporting purposes, is designed to locate
				that specific person (who has been reported to law enforcement as a missing
				person), or is part of a government-authorized effort to locate a fugitive or
				person of interest in a criminal, antiterrorism, or national security
				investigation.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD0A0E7B4D75D4013894B8B65946AC704"><enum>9.</enum><header>Sentencing
			 guidelines</header><text display-inline="no-display-inline">Pursuant to its
			 authority under section 994 of title 28, United States Code, and in accordance
			 with this section, the United States Sentencing Commission shall review and, if
			 appropriate, amend the Federal sentencing guidelines and policy statements to
			 ensure—</text>
			<paragraph id="H3D7D25E37A4A42A49E84C19D9C79ADD3"><enum>(1)</enum><text>that the guidelines
			 provide an additional penalty increase above the sentence otherwise applicable
			 in Part J of Chapter 2 of the Guidelines Manual if the defendant was convicted
			 of a violation of section 1591 of title 18, United States Code, or chapters
			 109A, 109B, 110, or 117 of title 18, United States Code; and</text>
			</paragraph><paragraph id="HECBADF1863CF4C0F8CBBE702E0E3E6D7"><enum>(2)</enum><text>if the offense described
			 in paragraph (1) involved causing or threatening to cause physical injury to a
			 person under 18 years of age, in order to obstruct the administration of
			 justice, an additional penalty increase above the sentence otherwise applicable
			 in Part J of Chapter 2 of the Guidelines Manual.</text>
			</paragraph></section><section id="H27CEA203EA4A4C4399DBC74EEAA4FC16"><enum>10.</enum><header>Enhanced penalties for
			 possession of child pornography</header>
			<subsection id="H268CBB5B82904172B70123D0B59FED34"><enum>(a)</enum><header>Certain activities
			 relating to material involving the sexual exploitation of
			 minors</header><text>Section 2252(b)(2) of title 18, United States Code, is
			 amended by inserting after <quote>but if</quote> the following: <quote>any
			 visual depiction involved in the offense involved a prepubescent minor or a
			 minor who had not attained 12 years of age, such person shall be fined under
			 this title and imprisoned for not more than 20 years, or if</quote>.</text>
			</subsection><subsection id="H2334FF574D0D49A495889C9309426D92"><enum>(b)</enum><header>Certain activities
			 relating to material constituting or containing child
			 pornography</header><text>Section 2252A(b)(2) of title 18, United States Code,
			 is amended by inserting after <quote>but, if</quote> the following: <quote>any
			 image of child pornography involved in the offense involved a prepubescent
			 minor or a minor who had not attained 12 years of age, such person shall be
			 fined under this title and imprisoned for not more than 20 years, or
			 if</quote>.</text>
			</subsection></section><section id="HF4920C20071F42DEB162E318214EEC38"><enum>11.</enum><header>Administrative
			 subpoenas</header>
			<subsection id="HB23756A1323F440A950733C7FEDD1725"><enum>(a)</enum><header>In
			 General</header><text>Section 3486(a)(1) of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H2B21F346F9FF412881C96A488BB29B25"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="HF9EF1BAE7FC34C469ED58B45990DA613"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HC906F6DE8B034DACBB84DC988BD0829D"><enum>(B)</enum><text>by redesignating clause
			 (ii) as clause (iii); and</text>
					</subparagraph><subparagraph id="H2FF8E8D5FE9C4D6DACC4DA3B785C1610"><enum>(C)</enum><text>by inserting after clause
			 (i) the following:</text>

			 (D)—</text>

			 <quote>paragraph, the term</quote> and inserting the
			 following:</text>

			 Code, is amended—</text>
				<paragraph id="H862DD86D7F8A41BD845BC8822B92CCE0"><enum>(1)</enum><text>in paragraph (6)(A), by
			 striking <quote>United State</quote> and inserting <quote>United
			 States</quote>;</text>
				</paragraph><paragraph id="H8F4EE59E2A7A42149AC831BB9FB2B1B6"><enum>(2)</enum><text>in paragraph (9), by
			 striking <quote>(1)(A)(ii)</quote> and inserting <quote>(1)(A)(iii)</quote>;
			 and</text>
