		<section id="H21A99C4D7E394F4B887F45F06C20414A" section-type="section-one"><enum>1.</enum><header>Reductions in contributions
			 to multiemployer plans to implement self-help measures adopted by labor and
			 management</header>
			<subsection id="HADC5BC15C14E4E089DA0EED03A71046C"><enum>(a)</enum><header>Amendments to
			 ERISA</header><text>Section 305 of the Employee Retirement Income Security Act
			 of 1974 (29 U.S.C. 1085) is amended—</text>
				<paragraph id="HA4820B60D2C6473E910E2713C0246179"><enum>(1)</enum><text>by redesignating
			 subsection (i) as subsection (j); and</text>
				</paragraph><paragraph id="H7E01867BCEBE4ABCBBDFE08710FFB3CD"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFBDC776045FE4C65BBBBABCF314470DA" style="OLC">
						<subsection id="H3306F442B68B4C7C802F4F3A308C08E0"><enum>(i)</enum><header>Discretion To
				accept reduced contributions</header>
							<paragraph id="H650F0B71ED3B442E86C8AE64C0EF1161"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this section,
				during the funding plan adoption period, funding improvement period,
				rehabilitation plan adoption period, and the rehabilitation period, the Pension
				Benefit Guaranty Corporation may permit a plan sponsor to accept from an
				employer a ratified collective bargaining agreement with respect to the
				multiemployer plan that provides for a reduction in the level of contributions
				made by a contributing employer and appropriate reduction in level of future
				benefit accruals for any participants for a period of not more than 5 years (or
				such shorter period as determined by such Corporation) provided that such
				Corporation determines that—</text>
								<subparagraph id="HB4E2844914E64EE2A8EAADAC7C6D54CC"><enum>(A)</enum><text>the contributing
				employer will be unable to pay its debts when due and will be unable to
				continue business without a reduction in its contribution rates;</text>
								</subparagraph><subparagraph id="H442BF79E0ECC4294A2378A907F593A23"><enum>(B)</enum><text>the aggregate
				withdrawal liability of the contributing employer with respect to all
				multiemployer pension plans exceeds $750,000,000, or such lower amount as
				determined to be appropriate by such Corporation;</text>
								</subparagraph><subparagraph id="HBC5DA6E9F03D41A596DB869A07157ACE"><enum>(C)</enum><text>there is
				substantial doubt as to the collectability of the withdrawal liability if the
				contributing employer were to withdraw from the plan;</text>
								</subparagraph><subparagraph id="H4A2D29694B334FA886C1427841621DA1"><enum>(D)</enum><text>the reduced
				contributions are not reasonably expected to have an adverse effect on the
				deficit of such Corporation;</text>
								</subparagraph><subparagraph id="HB24F1E947BD84648A5E319DB2EF06F4F"><enum>(E)</enum><text>other creditors,
				stakeholders, and other parties to which the contributing employer is obligated
				have accepted reductions that are comparable to those of the pension plan;
				and</text>
								</subparagraph><subparagraph id="H5DD765612F4F4F0BA957F61302B0B7AD"><enum>(F)</enum><text>such other
				conditions are satisfied as may be imposed in accordance with regulations
				prescribed by such Corporation.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H542AB720D7C54333BB014108572F9DB3"><enum>(2)</enum><header>Impact on
				withdrawal liability determinations</header><text>Any reduction in the level of
				contributions under this subsection shall be disregarded in determining any
				limitation on annual payments under subparagraphs (B) and (C) of section
				4219(c)(1) and in determining withdrawal liability under section 4201 with
				respect to the employer subject to the reduced contribution
				rate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4BFE0A98E9A1469A8B0B14CA59B8C9A2"><enum>(b)</enum><header>Amendments to
			 Internal Revenue Code</header><text>Section 432 of the Internal Revenue Code of
			 1986 is amended—</text>
				<paragraph id="HAACCE0E68DD0439B87F2E9415B08C582"><enum>(1)</enum><text>by redesignating
			 subsection (i) as subsection (j); and</text>
				</paragraph><paragraph id="HCEB7CCBB490F457AA35E16A97F760DB7"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEB7FAF295D4F4F2C9E6C3F15D379985D" style="OLC">
						<subsection id="H726C9C6B39EA440EB8FF64E855C4B0A2"><enum>(i)</enum><header>Discretion To

							<paragraph id="H1C2702B5D4364F88B4225104DD84DB2D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this section, during the funding plan adoption period,
				funding improvement period, rehabilitation plan adoption period, and the

				determined by such Corporation;</text>
								</subparagraph><subparagraph id="HD09D4681C33841B18214F1605AC61E44"><enum>(C)</enum><text>there is
				substantial doubt as to the collectability of the withdrawal liability if the
				contributing employer were to withdraw from the plan;</text>
								</subparagraph><subparagraph id="HA483A83AC5B344A09C2E078247BD70FE"><enum>(D)</enum><text>the reduced
				contributions are not reasonably expected to have an adverse effect on the
				deficit of such Corporation;</text>
								</subparagraph><subparagraph id="HABF1F4B23E344A76B668F27AB7A5B00B"><enum>(E)</enum><text>other creditors,
				stakeholders, and other parties to which the contributing employer is obligated
				have accepted reductions that are comparable to those of the pension plan;
				and</text>
								</subparagraph><subparagraph id="H1912297EC86242CA9FF0926C9AF15A3F"><enum>(F)</enum><text>such other
				conditions are satisfied as may be imposed in accordance with regulations
				prescribed by such Corporation.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8EA88CDFB4D44CC39FBD2D7EDABA1DD6"><enum>(2)</enum><header>Impact on
				withdrawal liability determinations</header><text>Any reduction in the level of
				contributions under this subsection shall be disregarded in determining any
				limitation on annual payments under subparagraphs (B) and (C) of section
				4219(c)(1) of the Employee Retirement Income Security Act of 1974 and in
				determining withdrawal liability under section 4201 of such Act with respect to
				the employer subject to the reduced contribution
				rate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC4A67623747B42518AA66FB9EECA3406"><enum>(c)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="HC7AC624D5EE44233BA576A905B765B7A"><enum>(1)</enum><text>Section
			 4971(g)(4)(C)(ii) of the Internal Revenue Code of 1986 is amended by striking
			 <quote>432(i)(9)</quote> and inserting <quote>432(j)(9)</quote>.</text>
				</paragraph><paragraph id="HDA7EEE6743C4461D82549649F108E787"><enum>(2)</enum><text>Sections
			 101(f)(2)(B) and 103(f)(1)(B) of the Employee Retirement Income Security Act of
			 1974 (29 U.S.C. 1021(f)(2)(B) and 1023(f)(1)(B)) are each amended by striking
			 <quote>305(i)</quote> each place such term appears and inserting
			 <quote>305(j)</quote>.</text>
