		<official-title>To amend title XVIII of the Social Security Act to exempt
		  blood glucose self-testing equipment and supplies furnished (regardless of
		  method of delivery) by small retail community pharmacies from Medicare
		  competitive acquisition programs and pricing.</official-title>

		<section id="H40960C074E7741F69DF9B6FEF2ECE5EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Access to Diabetes Supplies Act of
			 2011</short-title></quote>.</text>
		</section><section id="H21D411BBE65042CFBF834E92EB85BDA6"><enum>2.</enum><header>Exemption of
			 blood glucose self-testing equipment and supplies furnished by small retail
			 community pharmacies from Medicare competitive acquisition programs and
			 pricing</header>
			<subsection id="H64851D529C9C43BA97624218DF00D6F6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1847(a)(7) of
			 the Social Security Act (42 U.S.C. 1395w–3(a)(7)) is amended by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H93F2C7E1B8BE4050A5FEFE655CDD5017" style="OLC">
					<subparagraph id="H60A15E83A2414CDBA4458D345D10AFE1"><enum>(C)</enum><header>Certain blood
				glucose self-testing equipment and supplies</header>
						<clause id="HBB508E182063425B9538ACB09F512DF8"><enum>(i)</enum><header>In
				general</header><text>Blood glucose self-testing equipment and supplies
				furnished (regardless of method of delivery) by a retail community pharmacy (as
				defined in section 1927(k)(10)) that is not under common ownership with more
				than 10 other retail community pharmacies.</text>
						</clause><clause id="HBBC3EEC3315545018AF92DCA1A69E146"><enum>(ii)</enum><header>Blood glucose
				self-testing equipment and supplies defined</header><text>For purposes of this
				subparagraph, the term <term>blood glucose self-testing equipment and
				supplies</term> includes blood glucose monitors, blood-testing strips, lancet
				devices and lancets, and glucose control solutions for checking the accuracy of
				the monitors and testing
				strips.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFC95EBEEEB6B4A8CBAEF600A123BD28E"><enum>(b)</enum><header>Inapplicability
			 of competitively bid prices</header><text>Section 1834(a)(1)(F)(ii) of the
			 Social Security Act (42 U.S.C. 1395m(a)(1)(F)(ii)) is amended by striking
			 <quote>use information</quote> and inserting <quote>, except in the case of
			 blood glucose self-testing equipment and supplies exempt from the programs
			 under section 1847 pursuant to subsection (a)(7)(C) of such section, use
			 information</quote>.</text>
			</subsection><subsection id="H479873100EA24A44B1300E2DE8E12F00"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="H107208C447304871A0AEDD8B15B1D0E0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the amendment made by subsections (a) and (b) shall apply on and
			 after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="HF92DF0CC964C4B8784254EE7CAE82211"><enum>(2)</enum><header>Effective date
			 in areas with contracts</header><text display-inline="yes-display-inline">If
			 contracts for a competitive acquisition area for blood glucose self-testing
			 equipment and supplies are (or have been) entered into under a competition for
			 which the close of bidding was on or before the date of the enactment of this
			 Act, the amendment made by subsection (a) shall apply in the area on and after
			 the date on which all such contracts have expired.</text>
				</paragraph><paragraph id="HD0120084DC99445895656BB6BA24B10C"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection—</text>
					<subparagraph id="H393CFB7CB2744EE1A0996DF2841B5E50"><enum>(A)</enum><text>the term
			 <term>close of bidding</term> means the final date specified by the Secretary
			 of Health and Human Services for submission of bids; and</text>
					</subparagraph><subparagraph id="HC9D1471E2A8C4C418D0E0F826E647994"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>competition</term> means a
			 competition conducted pursuant to section 1847(b)(1) of the Social Security Act
			 (42 U.S.C. 1395w–3(b)(1)).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
