		<official-title>To amend title 41, United States Code, to prohibit
		  executive agencies from requiring the disclosure of political contributions by
		  an entity submitting an offer for a Federal contract.</official-title>

		<section id="H03FB486FA05F4519BF77BBEF08AEB6EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness in Federal Contracting Act of
			 2011</short-title></quote>.</text>
		</section><section id="HC445D0CD4E3C4416A8DEB4B1B7D86C24"><enum>2.</enum><header>Prohibition on
			 disclosure of political contributions</header>
			<subsection id="H79572977F0CC455C8437F15129CBF6A0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 47 of title
			 41, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HF3E4540EA0394D1AA7E5E13B7A43BECE" style="USC">
					<section id="HC98CB133BD7649858D25E9D21013C790"><enum>4712.</enum><header>Prohibition on
				disclosure of political contributions</header>
						<subsection id="HE4B88140234B40BAB7760C78AF70F5AE"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An executive agency may not require an
				entity submitting an offer for a Federal contract or otherwise participating in
				acquisition of property or services by the Federal Government to disclose any
				of the following information as a condition of submitting the offer or
				otherwise participating in such acquisition:</text>
							<paragraph id="HC19CEAD20AF54414B64F7F7666F7542D"><enum>(1)</enum><text>Any payment
				consisting of a contribution, expenditure, independent expenditure, or
				disbursement for an electioneering communication that is made by the entity,
				its officers or directors, or any of its affiliates or subsidiaries to a
				candidate for election for Federal office or to a political committee, or that
				is otherwise made with respect to any election for Federal office.</text>
							</paragraph><paragraph id="H9A82C8DAF614492F82DE4983E1234401"><enum>(2)</enum><text>Any disbursement
				of funds (other than a payment described in paragraph (1)) made by the entity,
				its officers or directors, or any of its affiliates or subsidiaries to any
				individual or entity with the intent or the reasonable expectation that the
				individual or entity will use the funds to make a payment described in
				paragraph (1).</text>
							</paragraph></subsection><subsection id="HB96028E1846549FE8F273D9831766A5B"><enum>(b)</enum><header>No effect on
				other disclosure requirements</header><text>Nothing in this section may be
				construed to waive or otherwise affect the application to an entity described
				in subsection (a) of any provision of law (including the Federal Election
				Campaign Act of 1971) that requires the entity to disclose information on
				contributions, expenditures, independent expenditures, or electioneering
				communications.</text>
						</subsection><subsection id="HFD3DF92EF0E441D08CCF3A2FA23DDDB3"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
							<paragraph id="H6FF92EA7FBAD4F7493B1F13A6BD1FD0E"><enum>(1)</enum><text>each of the terms
				<term>contribution</term>, <term>expenditure</term>, <term>independent
				expenditure</term>, <term>electioneering communication</term>,
				<term>candidate</term>, <term>election</term>, and <term>Federal office</term>
				has the meaning given such term in the Federal Election Campaign Act of 1971 (2
				U.S.C. 431 et seq.); and</text>
							</paragraph><paragraph id="HDBFBC970F4E440C59D45CEA7B705D130"><enum>(2)</enum><text>the term
				<term>acquisition</term> has the meaning given that term in section 131 of this
				title.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H81FAB9AE65134856A93AD952F4DF0210"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of contents for chapter 47 of
			 title 41, United States Code, is amended by inserting after the item relating
			 to section 4711 the following new item:</text>
