<section id="H8D3F6ED4B85A45028B7AAA1C5B7BF861"><enum>102.</enum><header>Classified Schedule of Authorizations</header> 
<subsection id="H2A442646F53C47ED821754090041BF1D"><enum>(a)</enum><header>Specifications of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 101 and, subject to section 103, the authorized personnel ceilings as of September 30, 2012, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 101, are those specified in the classified Schedule of Authorizations prepared to accompany the bill H.R. 1892 of the One Hundred Twelfth Congress.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H429E0DF48AEB46218E07EB0C23EF21D1"><enum>(b)</enum><header>Availability of classified Schedule of Authorizations</header> 
<paragraph id="HDF33D8F4BB9142698B61834D8E466FEE"><enum>(1)</enum><header>Availability to committees of Congress</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President.</text></paragraph> 
<paragraph id="HD71ED829FD484CCC9833CA03D09FA3F0"><enum>(2)</enum><header>Distribution by the President</header><text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified Schedule of Authorizations, or of appropriate portions of the Schedule, within the executive branch.</text></paragraph> 
<paragraph id="HAC3A6B9BFC6F44BA89FE6224E1D1BD13"><enum>(3)</enum><header>Limits on disclosure</header><text>In carrying out paragraph (2), the President may disclose only that budget-related information necessary to execute the classified Schedule of Authorizations and shall not disclose the Schedule or any portion of the Schedule publicly.</text></paragraph></subsection></section> 
<section display-inline="no-display-inline" id="HF9F9CC8895AE4322A9D33EEA60BFC0E6" section-type="subsequent-section"><enum>103.</enum><header>Intelligence Community Management Account</header> 
<subsection id="H62432EBDA38C406E943371EDD0DC238E"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2012 the sum of $590,339,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2013.</text></subsection> 
<subsection id="HB069FF50C362408196F34CDA907E8547"><enum>(b)</enum><header>Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 794 full-time or full-time equivalent personnel as of September 30, 2012. Personnel serving in such elements may be permanent employees of the Office of the Director of National Intelligence or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection id="HD2CEE45EC9C245B2A8687B8BAC11D90F"><enum>(c)</enum><header>Classified authorizations</header> 
<paragraph id="HC213991B92F3439D854AF035A545E276"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Community Management Account for fiscal year 2012 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts for advanced research and development shall remain available until September 30, 2013.</text></paragraph> 
<paragraph id="H5B57382AAAE64F8EB225BF7C30209175"><enum>(2)</enum><header>Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2012, there are authorized such additional personnel for the Community Management Account as of that date as are specified in the classified Schedule of Authorizations referred to in section 102(a).</text></paragraph></subsection></section></title> 
<title id="H995819D770044238AE2C91760084C1F3"><enum>II</enum><header>Central Intelligence Agency Retirement and Disability System</header> 
<section commented="no" display-inline="no-display-inline" id="H46679F9BEA834D84971BDC95755FF43C" section-type="subsequent-section"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2012 the sum of $514,000,000.</text></section></title> 
<title id="H4C8EBE79508341F89B1CB6A9B92527B1"><enum>III</enum><header>General provisions</header> 
<section id="H1343584999394982AE4BD7C03183ADC2"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section id="HFDBBA49A99B340B5BEF9529894A0F210"><enum>302.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text></section> 
<section id="H9416C0D616D64F079194E97EF529E0FA"><enum>303.</enum><header>Annual report on hiring of National Security Education Program participants</header> 
<subsection id="H723BBB616FC74805BC9A0D74A59D6600"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Subtitle C of title X of the National Security Act of 1947 (50 U.S.C. 401 et seq.) is amended by adding at the end the following new section:</text> 
<quoted-block style="traditional" id="H6656F9B83A5A4E98B87E2BD3288FFFB8" display-inline="no-display-inline"> 
<section id="H22FF175944F84E329C035C0D812322F2"><enum>1025.</enum><header>Annual report on hiring of National Security Education Program participants</header><text display-inline="yes-display-inline">Not later than 90 days after the end of each fiscal year, the head of each element of the intelligence community shall submit to the congressional intelligence committees a report, which may be in classified form, containing the number of personnel hired by such element during such fiscal year that were at any time a recipient of a grant or scholarship under the David L. Boren National Security Education Act of 1991 (50 U.S.C. 1901 et seq.).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H9F620AAAB2CB4811978E7BF0BAB60A41"><enum>401.</enum><header>Burial allowance</header> 
<subsection id="HD56B5A5D28584BA88DF6603EC92E38FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11 of the Central Intelligence Agency Act of 1949 (50 U.S.C. 403k) is amended—</text> 
<paragraph id="H159D62770D21408DB151F9753D2D4591"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="section" style="traditional">and burial allowance</header-in-text></quote> after <quote><header-in-text level="section" style="traditional">gratuities</header-in-text></quote>; and</text></paragraph> 
<paragraph id="HB2ADF2D3A1884EA4BF1EAF676AFBB968"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="traditional" id="HCE53DD8C1AC14E139A35A6DF04D2EF8F" display-inline="no-display-inline"> 
<subsection id="H00DFFC39E81A4FCB8AC2540587C3D46A"><enum>(c)</enum> 
<paragraph id="H2CECFEB185DF4D98B32D46ED04CE50B3" display-inline="yes-display-inline"><enum>(1)</enum><text>At the request of a representative of the estate of any officer or employee of the Agency (as determined in accordance with the laws of a State) who dies in a manner described in subsection (a)(1), the Director may pay to such estate a burial allowance.</text></paragraph> 
<paragraph id="H37C29794BFD0488B9888CA97A5DE6BBE" indent="up1"><enum>(2)</enum><text>A burial allowance paid under paragraph (1) may be used to cover burial expenses, including recovery, mortuary, funeral or memorial service, cremation, burial costs, and costs of transportation by common carrier to the place selected for final disposition of the deceased.</text></paragraph> 
<paragraph id="H0980514594F0490E992F7A3B478BD56B" indent="up1"><enum>(3)</enum><text>Each payment made under this subsection shall be—</text> 
<subparagraph id="HE36B35DCC16C41BF929F909F2899EEC3"><enum>(A)</enum><text>in an amount not greater than $15,000 plus the actual costs of transportation referred to in paragraph (2); and</text></subparagraph> 
<subparagraph id="HE2324E2DF70B471FA97BD2DB643D1CF4"><enum>(B)</enum><text>in addition to any other benefit that may be due under any other provision of law.</text></subparagraph></paragraph> 
<paragraph id="HD49DEA77544C497DAB46898A754BF38A" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Director may annually increase the amount in paragraph (3)(A) to reflect any increase in the Consumer Price Index occurring during the preceding year.</text></paragraph> 
<paragraph id="H2279D1800E764D3895C88C9D632FC64D" indent="up1"><enum>(5)</enum><text>The Director may pay the burial benefit authorized under this subsection more than once for funeral, memorial, or burial expenses stemming from a single death of an officer or employee of the Agency if the remains of such officer or employee were not recovered, were recovered after considerable delay, or were not recovered intact.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H57E805B1F4854212BD848E6F390DFBA5"><enum>(b)</enum><header>Effective date of authority to increase allowance</header><text display-inline="yes-display-inline">Section 11(c)(4) of the Central Intelligence Agency Act of 1949, as added by subsection (a), shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section> 
<section id="HB1D8DDE14870411C99E4915AC0D0129C" commented="no"><enum>402.</enum><header>Solicitation of gifts</header><text display-inline="no-display-inline">Section 12(a) of the Central Intelligence Agency Act of 1949 (50 U.S.C. 403l(a)) is amended—</text> 
<paragraph id="HDE0F87A0580747DA9CD59D71506F82F1" commented="no"><enum>(1)</enum><text>in the first sentence—</text> 
<subparagraph id="H39223465B750415B89C0E3B45E5BCC05"><enum>(A)</enum><text>by striking <quote>Subject</quote> and inserting <quote>(1) Subject</quote>; and</text></subparagraph>
<subparagraph id="HA91F9195A1644F12B0D225DC13A65A5D"><enum>(B)</enum><text>by striking <quote>may accept</quote> and inserting <quote>may solicit, accept</quote>;</text></subparagraph></paragraph> 
<paragraph id="HA6BA93CAEED942C78B291140011D4B5A" commented="no"><enum>(2)</enum><text>in the second sentence—</text> 
<subparagraph id="H25DD48321FB642D8B0BB3B5FCF2B9ABF" commented="no"><enum>(A)</enum><text>by striking <quote>general</quote>; and</text></subparagraph> 
<subparagraph id="H65CC81F64F7B4559A53058E3AE857982" commented="no"><enum>(B)</enum><text>by striking <quote>employees or dependents of employees of the Agency</quote> and inserting <quote>employees of the Agency, dependents of employees of the Agency, or survivors of deceased employees of the Agency who died in a manner described in section 11(a)(1)</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H7D264568F9874922B6FC1B1C3258723C" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text>

<paragraph id="H8E6AFCE25538420D83D95F1AA2913FC8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Director shall issue regulations to carry out the authority to solicit gifts under paragraph (1). Such regulations shall ensure that any solicitation is consistent with all relevant ethical constraints and principles, including the avoidance of any prohibited conflict of interest or appearance of impropriety.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H407D6C744A5F4429A1A90D96AFCAD77A" commented="no"><enum>403.</enum><header>Acceptance of gifts, devises, and bequests</header><text display-inline="no-display-inline">Section 12 of the Central Intelligence Agency Act of 1949 (50 U.S.C. 403l) is amended by adding at the end the following new subsection:</text>

<subsection id="H59ED58F41B724D96BAF6DE025DC15DAD" commented="no"><enum>(f)</enum> 
<paragraph id="H0925AF478D7145478187C28EEC4C7187" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text>Subject to limitations established by the Director, a covered employee may accept a gift from a source other than a foreign government or an agent of a foreign government.</text></paragraph> 
<paragraph id="HF2F0AE59AD744B398B3701BB84B4303A" indent="up1" commented="no"><enum>(2)</enum><text>The Director shall issue regulations to carry out this subsection. Such regulations shall address any potential counterintelligence concerns with generally accepting gifts under this subsection and prior to the acceptance of any individual gift.</text></paragraph> 
<paragraph id="HA51752EDB2EA4216A76BC31C26B0559B" display-inline="no-display-inline" indent="up1" commented="no"><enum>(3)</enum><text>In this subsection, the term <quote>covered employee</quote> means an employee of the Agency who suffered an injury or illness that—</text> 
<subparagraph id="H2E69112786D54D55B9D291493A569954" commented="no"><enum>(A)</enum><text>resulted from hostile or terrorist activities; or</text></subparagraph> 
<subparagraph id="HECB19E56DD204E649586A7051ADDF594" commented="no"><enum>(B)</enum><text>occurred under other circumstances determined by the Director to be analogous to subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4A7222B16F5B4C4495874A718E2A0017"><enum>404.</enum><header>Creating an official record of the Osama bin Laden operation</header> 
<subsection id="H9C56E8591EA24889AC2E1F2F5BD8719A"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text> 
<paragraph id="H29A06C328B404176A3888C2F3A01823A"><enum>(1)</enum><text display-inline="yes-display-inline">On May 1, 2011, United States personnel killed terrorist leader Osama bin Laden during the course of a targeted strike against his secret compound in Abbottabad, Pakistan.</text></paragraph> 
<paragraph id="H8647CE0A5CA0474DBC1E87FDF3DD6672"><enum>(2)</enum><text>Osama bin Laden was the leader of the al Qaeda terrorist organization, the most significant terrorism threat to the United States and the international community.</text></paragraph> 
<paragraph id="HC8104B2EF5A044EE8A0950F41523D3B7"><enum>(3)</enum><text>Osama bin Laden was the architect of terrorist attacks which killed nearly 3,000 civilians on September 11, 2001, the most deadly terrorist attack against our Nation, in which al Qaeda terrorists hijacked four airplanes and crashed them into the World Trade Center in New York City, the Pentagon in Washington, D.C., and, due to heroic efforts by civilian passengers to disrupt the terrorists, near Shanksville, Pennsylvania.</text></paragraph> 
<paragraph id="HB74490BD72D54FFE9785AE89CBBAF653"><enum>(4)</enum><text>Osama bin Laden planned or supported numerous other deadly terrorist attacks against the United States and its allies, including the 1998 bombings of United States embassies in Kenya and Tanzania and the 2000 attack on the U.S.S. Cole in Yemen, and against innocent civilians in countries around the world, including the 2004 attack on commuter trains in Madrid, Spain and the 2005 bombings of the mass transit system in London, England.</text></paragraph> 
<paragraph id="HC43126E10AD64A409BE587D505D8C770"><enum>(5)</enum><text>Following the September 11, 2001, terrorist attacks, the United States, under President George W. Bush, led an international coalition into Afghanistan to dismantle al Qaeda, deny them a safe haven in Afghanistan and ungoverned areas along the Pakistani border, and bring Osama bin Laden to justice.</text></paragraph> 
<paragraph id="HBA20D516DD3747CDBAECF4D6BC9E3A5E"><enum>(6)</enum><text>President Barack Obama in 2009 committed additional forces and resources to efforts in Afghanistan and Pakistan as <quote>the central front in our enduring struggle against terrorism and extremism</quote>.</text></paragraph> 
<paragraph id="H1563D86829BF46DAA2DB9D2F401CBAD3"><enum>(7)</enum><text>The valiant members of the United States Armed Forces have courageously and vigorously pursued al Qaeda and its affiliates in Afghanistan and around the world.</text></paragraph> 
<paragraph id="H5AF55CC3D7C84C8CB7AC753B609B027F"><enum>(8)</enum><text>The anonymous, unsung heroes of the intelligence community have pursued al Qaeda and affiliates in Afghanistan, Pakistan, and around the world with tremendous dedication, sacrifice, and professionalism.</text></paragraph> 
<paragraph id="H0F20189BCC1547098F39FA1E59DC9C8C"><enum>(9)</enum><text>The close collaboration between the Armed Forces and the intelligence community prompted the Director of National Intelligence, General James Clapper, to state, <quote>Never have I seen a more remarkable example of focused integration, seamless collaboration, and sheer professional magnificence as was demonstrated by the Intelligence Community in the ultimate demise of Osama bin Laden.</quote>.</text></paragraph> 
<paragraph id="HCB9E2C6EA18746A3920078694125FBDA"><enum>(10)</enum><text>While the death of Osama bin Laden represents a significant blow to the al Qaeda organization and its affiliates and to terrorist organizations around the world, terrorism remains a critical threat to United States national security.</text></paragraph> 
<paragraph id="HBAB3C00D5F214EBAB893FE6A25A27035"><enum>(11)</enum><text>President Obama said, <quote>For over two decades, bin Laden has been al Qaeda’s leader and symbol, and has continued to plot attacks against our country and our friends and allies. The death of bin Laden marks the most significant achievement to date in our Nation’s effort to defeat al Qaeda.</quote>.</text></paragraph></subsection> 
<subsection id="HDDFF622428D545D79E4B609F6D5107EE"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HF33AE88486214815840F9069690497A5"><enum>(1)</enum><text>the raid that killed Osama bin Laden demonstrated the best of the intelligence communities capabilities and teamwork;</text></paragraph> 
<paragraph id="HC556E6CAA9F547F2AFEA7F992405FF6E"><enum>(2)</enum><text>for years to come, Americans will look back at this event as a defining point in the history of the United States;</text></paragraph> 
<paragraph id="HE390384EF5BA4938AE191656668AE376"><enum>(3)</enum><text display-inline="yes-display-inline">it is vitally important that the United States memorialize all the events that led to the raid so that future generations will have an official record of the events that transpired before, during, and as a result of the operation; and</text></paragraph> 
<paragraph id="HB5DCE7339D9E4431AF431546E8DDD1C8"><enum>(4)</enum><text display-inline="yes-display-inline">preserving this history now will allow the United States to have an accurate account of the events while those that participated in the events are still serving in the Government.</text></paragraph></subsection> 
<subsection id="HE72947B019A7438194B2455A0BDDFC20"><enum>(c)</enum><header>Report on the operation that killed Osama bin Laden</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Director of the Central Intelligence Agency, in consultation with other agencies and entities involved in the operation that killed Osama bin Laden, shall submit to the congressional intelligence committees a classified report that memorializes such operation including a description of the events leading up to the discovery of the location of Osama bin Laden, the planning and execution of the raid, and the results of the intelligence gained from the raid.</text></subsection> 
<subsection id="H82F23C95F9004BDABFC6AF7324405ECF"><enum>(d)</enum><header>Preservation of records</header><text display-inline="yes-display-inline">The Director of the Central Intelligence Agency shall preserve any records, including intelligence information and assessments, used to generate the report described in subsection (c). </text></subsection></section></subtitle>

<paragraph id="H4D9FB1AB93F64D4D85E547F98B058701"><enum>(1)</enum><text display-inline="yes-display-inline">the intelligence collection efforts of the United States that assess the threat from covered entities that are currently or have previously used public lands in the United States to further their operations; and </text></paragraph> 
<paragraph id="HA3A09312780B47978E51B0CB7B4F57FD"><enum>(2)</enum><text>efforts to protect public lands of the United States from illegal drug grows.</text></paragraph></subsection> 
<subsection id="H1A7A42B260C344D79EE55DA702F8C121"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include the following:</text> 
<paragraph id="HFB6304E016F14CFB8C43CF09C01107B0"><enum>(1)</enum><text display-inline="yes-display-inline">An assessment of the intelligence collection efforts of the United States dedicated to covered entities.</text></paragraph> 
<paragraph id="HD1CC6C43272A4987ADD97F90BBA4247E"><enum>(2)</enum><text>An assessment of any problems that may reduce the overall effectiveness of United States intelligence collection and analysis to identify and protect public lands from illegal drug grows and other activities and threats of covered entities, including—</text> 
<subparagraph id="HF24C18A62FB34C5392808956685F3E3E"><enum>(A)</enum><text>intelligence collection gaps or inefficiencies;</text></subparagraph> 
<subparagraph id="HFFDB3ACC85EA4484ACE8202C13C06850"><enum>(B)</enum><text display-inline="yes-display-inline">information sharing practices in the intelligence community and other agencies, including Federal land management agencies; and</text></subparagraph> 
<subparagraph id="H3043E691FBAD4F2599E67F1E0917CE8F"><enum>(C)</enum><text>cooperation among Federal departments or agencies.</text></subparagraph></paragraph> 
<paragraph id="H8B33ED1F4C4D42D2BC6C3030AFA13288"><enum>(3)</enum><text display-inline="yes-display-inline">A strategic plan prepared by the Director of National Intelligence that describes actions the appropriate elements of the intelligence community can take to close intelligence gaps related to covered entities, and the use by such entities of public lands for illegal purposes, including threat assessments from all Federal land management agencies.</text></paragraph> 
<paragraph id="H72CEFAC9D0234DFDAD4A25BF217267A3"><enum>(4)</enum><text>A description of appropriate goals, schedules, milestones, or metrics to measure the long-term effectiveness of actions implemented to carry out the plan described in paragraph (4).</text></paragraph></subsection> 
<subsection id="HE9C17623995D4FD2A5EDC803C9EC9FD5"><enum>(c)</enum><header>Implementation of strategic plan</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Director of National Intelligence submits the report required by subsection (a), the Director shall begin implementation of the strategic plan described in subsection (b)(4).</text></subsection> 
<subsection id="HEA3A7752C2C0457D905A42B7479E7100"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>

<subsection id="H9B4E89746EE14A3BBCB6745A7BD724B1"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence and the Under Secretary of Defense for Intelligence shall submit to the Permanent Select Committee on Intelligence and the Committee on Armed Services of the House of Representatives and the Select Committee on Intelligence and the Committee on Armed Services of the Senate a report on the training standards of the defense intelligence workforce. Such report shall include—</text> 
<paragraph id="HF5FE95D04674451481EB1B71D0F20166"><enum>(1)</enum><text display-inline="yes-display-inline">a description of existing training, education, and professional development standards applied to personnel of defense intelligence components; and</text></paragraph> 
<paragraph id="H8786C3A8C820444685B7EF3FA32C9551"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the ability to implement a certification program for personnel of the defense intelligence components based on achievement of required training, education, and professional development standards.</text></paragraph></subsection>
