			 of appropriations</header><text display-inline="no-display-inline">Funds are
			 hereby authorized to be appropriated for fiscal year 2012 for the conduct of
			 the intelligence and intelligence-related activities of the following elements
			 of the United States Government:</text>

			 Director of National Intelligence.</text>

				</paragraph></section><section id="HB8852D298F2743BDB8EADD6724F06468"><enum>102.</enum><header>Classified
			 Schedule of Authorizations</header>
				<subsection id="HA71A537C68BE4556BF865893A4631466"><enum>(a)</enum><header>Specifications
			 of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated
			 under section 101 and, subject to section 104, the authorized personnel
			 ceilings as of September 30, 2012, for the conduct of the intelligence
			 activities of the elements listed in paragraphs (1) through (16) of section
			 101, are those specified in the classified Schedule of Authorizations prepared
			 to accompany the bill H.R. 1892 of the One Hundred Twelfth Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HAC851F1E7B144D62821339269F6C916E"><enum>(b)</enum><header>Availability of
			 classified Schedule of Authorizations</header>
					<paragraph id="H986CEC87759E4F07AB705C6B8A2B1CF9"><enum>(1)</enum><header>Availability to
			 committees of Congress</header><text>The classified Schedule of Authorizations
			 referred to in subsection (a) shall be made available to the Committee on
			 Appropriations of the Senate, the Committee on Appropriations of the House of
			 Representatives, and to the President.</text>
					</paragraph><paragraph id="HECB30685E9E543F3ACE56D0F6B4653B5"><enum>(2)</enum><header>Distribution by
			 the President</header><text>Subject to paragraph (3), the President shall
			 provide for suitable distribution of the classified Schedule of Authorizations,
			 or of appropriate portions of the Schedule, within the executive branch.</text>
					</paragraph><paragraph id="H58E337DDED7A4F5FB5FC18C3E6588D22"><enum>(3)</enum><header>Limits on
			 disclosure</header><text display-inline="yes-display-inline">The President
			 shall not publicly disclose the classified Schedule of Authorizations or any
			 portion of such Schedule except—</text>
						<subparagraph id="H84A98421C84145DA9021E1C030AD0443"><enum>(A)</enum><text>as provided in
			 section 601(a) of the Implementing Recommendations of the 9/11 Commission Act
			 of 2007 (50 U.S.C. 415c)</text>
						</subparagraph><subparagraph id="H4A10F97DF5E442EFA573DF6B2520F24C"><enum>(B)</enum><text>to the extent
			 necessary to implement the budget; or</text>
						</subparagraph><subparagraph id="H68AD40F390BE4A408B3F820611CAA517"><enum>(C)</enum><text>as otherwise
			 required by law.</text>
						</subparagraph></paragraph></subsection><subsection id="H565D47EE4C16421589C88239F476CEAE"><enum>(c)</enum><header>Use of funds for
			 certain activities in the classified annex</header><text display-inline="yes-display-inline">In addition to any other purpose authorized
			 by law, the Director of the Federal Bureau of Investigation may expend funds
			 authorized in this Act as specified in the Federal Bureau of Investigation
			 Policy Implementation section of the classified annex accompanying this
			 Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HAE00586186514AF391D345D649BEF3AD" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Personnel ceiling adjustments</header>
				<subsection commented="no" display-inline="no-display-inline" id="HF4669DE653B044779D87FB5AB2CFBC21"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may
			 authorize the employment of civilian personnel in excess of the number of
			 full-time equivalent positions for fiscal year 2012 authorized by the
			 classified Schedule of Authorizations referred to in section 102(a) if the
			 Director of National Intelligence determines that such action is necessary for
			 the performance of important intelligence functions, except that the number of
			 personnel employed in excess of the number authorized under such section may
			 not, for any element of the intelligence community, exceed 3 percent of the
			 number of civilian personnel authorized under such section for such
			 element.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H23B57079B16340DFAD0D259E59044AA0"><enum>(b)</enum><header display-inline="yes-display-inline">Authority for conversion of activities
			 performed by contract personnel</header>
					<paragraph id="H0706CCE5794C43F5AFAD3909D2A8088E"><enum>(1)</enum><header>In
			 general</header><text>In addition to the authority in subsection (a) and
			 subject to paragraph (2), if the head of an element of the intelligence
			 community makes a determination that activities currently being performed by
			 contract personnel should be performed by employees of such element, the
			 Director of National Intelligence, in order to reduce a comparable number of
			 contract personnel, may authorize for that purpose employment of additional
			 full-time equivalent personnel in such element equal to the number of full-time
			 equivalent contract personnel performing such activities.</text>
					</paragraph><paragraph id="HC4721355AD6E410F97D1EA285520CE25"><enum>(2)</enum><header>Concurrence and
			 approval</header><text>The authority described in paragraph (1) may not be
			 exercised unless the Director of National Intelligence concurs with the
			 determination described in such paragraph.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H31C1EE1709074F28BC6744420373714E"><enum>(c)</enum><header display-inline="yes-display-inline">Treatment of certain
			 personnel</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall establish guidelines that govern, for each element
			 of the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such personnel
			 levels, of employment or assignment—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H3B1109507A9C404AB9CAC522C5E08175"><enum>(1)</enum><text display-inline="yes-display-inline">in a student program, trainee program, or
			 similar program;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6F2776ABA59140028AB39130593D49A3"><enum>(2)</enum><text display-inline="yes-display-inline">in a reserve corps or as a reemployed
			 annuitant; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FB737A276164670984C920892DD60BA"><enum>(3)</enum><text display-inline="yes-display-inline">in details, joint duty, or long-term,
			 full-time training.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H49ED65B830CE49E5889FFFBA2A98F67E"><enum>(d)</enum><header display-inline="yes-display-inline">Notice to congressional intelligence
			 committees</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to the initial exercise of an authority
			 described in subsection (a) or (b).</text>
				</subsection></section><section display-inline="no-display-inline" id="H098A67786DC1473E9E6B28ACF45DFAD1" section-type="subsequent-section"><enum>104.</enum><header>Intelligence
			 Community Management Account</header>
				<subsection id="H151E1979FF804FCE8B1A23B033882515"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the Intelligence Community Management Account
			 of the Director of National Intelligence for fiscal year 2012 the sum of
			 $576,393,000. Within such amount, funds identified in the classified Schedule
			 of Authorizations referred to in section 102(a) for advanced research and
			 development shall remain available until September 30, 2013.</text>
				</subsection><subsection id="H9331003819FD47FCA128189FFFB4C93D"><enum>(b)</enum><header>Authorized
			 personnel levels</header><text display-inline="yes-display-inline">The elements
			 within the Intelligence Community Management Account of the Director of
			 National Intelligence are authorized 777 full-time or full-time equivalent
			 personnel as of September 30, 2012. Personnel serving in such elements may be
			 permanent employees of the Office of the Director of National Intelligence or
			 personnel detailed from other elements of the United States Government.</text>
				</subsection><subsection id="H8DAB7A846DFF4A9098ED49D0C3B2F5A7"><enum>(c)</enum><header>Classified
			 authorizations</header>
					<paragraph id="H4D8E88CF93764CE28B3A622F9ACFB1F6"><enum>(1)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2012 such additional amounts as
			 are specified in the classified Schedule of Authorizations referred to in
			 section 102(a). Such additional amounts for advanced research and development
			 shall remain available until September 30, 2013.</text>
					</paragraph><paragraph id="H8E1FA80277834A8E8052E4E07823318C"><enum>(2)</enum><header>Authorization of
			 personnel</header><text display-inline="yes-display-inline">In addition to the
			 personnel authorized by subsection (b) for elements of the Intelligence
			 Community Management Account as of September 30, 2012, there are authorized
			 such additional personnel for the Community Management Account as of that date
			 as are specified in the classified Schedule of Authorizations referred to in
			 section 102(a).</text>
					</paragraph></subsection></section></title><title id="HB13C6633C9D945858451E51AE988D5FC"><enum>II</enum><header>Central
			 Intelligence Agency Retirement and Disability System</header>
			<section commented="no" display-inline="no-display-inline" id="HD37BB7A1462C4376B18FC0AE2FC72AB2" section-type="subsequent-section"><enum>201.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2012 the sum of $514,000,000.</text>
			</section></title><title id="H89CB0238B700433EB5DBFFFA6346B143"><enum>III</enum><header>General
			 provisions</header>
			<section id="HDA7A145770404EAB829420DBB65254D3"><enum>301.</enum><header>Increase in
			 employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text>
			</section><section id="HD844E1DB4AED4860AD36270503BB6AA8"><enum>302.</enum><header>Restriction on
			 conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this
			 Act shall not be deemed to constitute authority for the conduct of any
			 intelligence activity which is not otherwise authorized by the Constitution or
			 the laws of the United States.</text>
			</section><section id="H75B0D6F58E364D0C936F288F5D49BBDC"><enum>303.</enum><header>Annual report
			 on hiring of National Security Education Program participants</header><text display-inline="no-display-inline">Not later than 90 days after the end of each
			 of fiscal years 2012, 2013, and 2014, the head of each element of the
			 intelligence community shall submit to the congressional intelligence
			 committees a report, which may be in classified form, containing the number of
			 personnel hired by such element during such fiscal year that were at any time a
			 recipient of a grant or scholarship under the David L. Boren National Security
			 Education Act of 1991 (50 U.S.C. 1901 et seq.).</text>
			</section><section commented="no" display-inline="no-display-inline" id="HF7EE23A4B23C446794A0E90B73342F6C" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Enhancement of authority for flexible
			 personnel management among the elements of the intelligence
			 community</header><text display-inline="no-display-inline">Section 102A of the
			 National Security Act of 1947 (50 U.S.C. 403–1) is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H65B14F8FE2BF4DEEB5DBF3C86DDF9571" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="HAEF241F3B9D44489B2D6E09188C9176D"><enum>(v)</enum><header display-inline="yes-display-inline">Authority To establish positions in
				excepted service</header><paragraph commented="no" display-inline="yes-display-inline" id="H8125E367E460476B8C3D2AA380D6F0A2"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of National Intelligence, with
				the concurrence of the head of the covered department concerned and in
				consultation with the Director of the Office of Personnel Management,
				may—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H286B2234B02F4D959972B1E92836875C" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">convert competitive service positions, and
				the incumbents of such positions, within an element of the intelligence
				community in such department, to excepted service positions as the Director of
				National Intelligence determines necessary to carry out the intelligence
				functions of such element; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB5D8CE861CB4278B464B31FB1EF2B49" indent="up1"><enum>(B)</enum><text>establish new positions in the
				excepted service within an element of the intelligence community in such
				department, if the Director of National Intelligence determines such positions
				are necessary to carry out the intelligence functions of such element.</text>
							</subparagraph></paragraph><paragraph id="HA5C4AC4F9FB144D1857F6A936CB441E4" indent="up1"><enum>(2)</enum><text>An incumbent occupying a position on
				the date of the enactment of the <short-title>Intelligence
				Authorization Act for Fiscal Year 2012</short-title> selected to be converted
				to the excepted service under this section shall have the right to refuse such
				conversion. Once such individual no longer occupies the position, the position
				may be converted to the excepted service.</text>
						</paragraph><paragraph id="HD9538DBFC4F34D9384CC64EBF66237D8" indent="up1"><enum>(3)</enum><text>In this subsection, the term
				<quote>covered department</quote> means the Department of Energy, the
				Department of Homeland Security, the Department of State, or the Department of
				the Treasury.</text>
						</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</section><section id="HE1C80A582CF64582B5B9F2DBDB534A3C"><enum>305.</enum><header>Preparation of
			 nuclear proliferation assessment statements</header><text display-inline="no-display-inline">Section 102A of the National Security Act of
			 1947 (50 U.S.C. 403–1), as amended by section 304 of this Act, is further
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H543BF0EAFB6842B28AC74ADD2EB2B119" style="OLC">
					<subsection id="H7D4BC44F380F4876BC037433515DA014"><enum>(w)</enum><header>Nuclear
				proliferation assessment statements intelligence community
				addendum</header><text display-inline="yes-display-inline">The Director of
				National Intelligence, in consultation with the heads of the appropriate
				elements of the intelligence community and the Secretary of State, shall
				provide to the President, the congressional intelligence committees, the
				Committee on Foreign Affairs of the House of Representatives, and the Committee
				on Foreign Relations of the Senate an addendum to each Nuclear Proliferation
				Assessment Statement accompanying a civilian nuclear cooperation agreement,
				containing a comprehensive analysis of the country’s export control system with
				respect to nuclear-related matters, including interactions with other countries
				of proliferation concern and the actual or suspected nuclear, dual-use, or
				missile-related transfers to such
				countries.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H2E4D5D66ED20478BB2859079DCE33933"><enum>306.</enum><header>Cost
			 estimates</header>
				<subsection id="H8FDCF5F0220C48FDB863965D5FC2782E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 506A of the
			 National Security Act of 1947 (50 U.S.C. 415a–1) is amended—</text>
					<paragraph id="H518248E35AA245129E15D54DC94AC17C"><enum>(1)</enum><text>in subsection
			 (a)(2)—</text>
						<subparagraph id="H01D4458573D444FF9A37741EDD29EF0E"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>
						</subparagraph><subparagraph id="H3732C0F9E552451284CDFECEF9F70C0A"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>

				requiring a service or capability from another acquisition or program to
				deliver the end-to-end functionality for the intelligence community end users,
				independent cost estimates shall include, to the maximum extent practicable,
				all estimated costs across all pertinent elements of the intelligence
				community. For collection programs, such cost estimates shall include the cost
				of new analyst training, new hardware and software for data exploitation and
				analysis, and any unique or additional costs for data processing, storing, and
				power, space, and cooling across the life cycle of the program. If such costs
				for processing, exploitation, dissemination, and storage are scheduled to be
				executed in other elements of the intelligence community, the independent cost
				estimate shall identify and annotate such costs for such other elements
				accordingly.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H9BAF647EC6EC434F95D3215672BA7FAB"><enum>(2)</enum><text>in subsection
			 (e)(2)—</text>
						<subparagraph id="HE67B18A4EB0F46CDADBAA5A776F4671D"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>;</text>
						</subparagraph><subparagraph id="H75B5675164654F96AB181AA28006C1B5"><enum>(B)</enum><text>in subparagraph
			 (A), as so designated, by striking <quote>associated with the acquisition of a
			 major system,</quote> and inserting <quote>associated with the development,
			 acquisition, procurement, operation, and sustainment of a major system across
			 its proposed life cycle,</quote>; and</text>
						</subparagraph><subparagraph id="H7F657BEEBCB443A1A53A15E51D402DF1"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

				(a)(2)(B), each independent cost estimate shall include all costs required
				across elements of the intelligence community to develop, acquire, procure,
				operate, and sustain the system to provide the end-to-end intelligence
				functionality of the system, including—</text>
									<clause id="H2A391356023347F596208A3BB41325F5"><enum>(i)</enum><text>for collection programs, the cost
				of new analyst training, new hardware and software for data exploitation and
				analysis, and any unique or additional costs for data processing, storing, and
				power, space, and cooling across the life cycle of the program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HFEFE6F92085B4447A546D09DBFDA0791"><enum>(ii)</enum><text>costs for processing,
				exploitation, dissemination, and storage costs are scheduled to be executed in
				other elements of the intelligence community, such element shall identify and
				annotate such costs accordingly.</text>

			 date</header><text>The amendments made by this section shall take effect on the
			 date that is 180 days after the date of the enactment of this Act.</text>

			 intelligence relating to terrorist recidivism of detainees held at United

				<subsection id="H8B1A149DE2AF454284F412F20958A3D4"><enum>(a)</enum><header>Updates and
			 consolidation of language</header>
					<paragraph id="H6D9DFF4088984C79842EF8961A82F1D9"><enum>(1)</enum><header>In
			 general</header><text>Title V of the National Security Act of 1947 (50 U.S.C.
			 413 et seq.) is amended by inserting after section 506H the following new
			 section:</text>

		  Cuba</header><subsection commented="no" display-inline="yes-display-inline" id="HABC8BB9BCBB242FE97A94F96086F3FB7"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director of
				National Intelligence, in consultation with the Director of the Central
				Intelligence Agency and the Director of the Defense Intelligence Agency, shall
				make publicly available an unclassified summary of—</text>
									<paragraph display-inline="no-display-inline" id="H798B19E8B28E45439B86A78B86BCD1B4"><enum>(1)</enum><text display-inline="yes-display-inline">intelligence relating to recidivism of
				detainees currently or formerly held at the Naval Detention Facility at
				Guantanamo Bay, Cuba, by the Department of Defense; and</text>
									</paragraph><paragraph id="H2E6D6BE7996A4772BF3C3C911E5CC820"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the likelihood that such
				detainees will engage in terrorism or communicate with persons in terrorist
				organizations.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H092518B3E5BC46B19F63CE70ACD525D8"><enum>(b)</enum><header>Updates</header><text>Not
				less frequently than once every 6 months, the Director of National
				Intelligence, in consultation with the Director of the Central Intelligence
				Agency and the Secretary of Defense, shall update and make publicly available
				an unclassified summary consisting of the information required by subsection
				(a) and the number of individuals formerly detained at Naval Station,
				Guantanamo Bay, Cuba, who are confirmed or suspected of returning to terrorist
				activities after release or transfer from such Naval
				Station.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HF6917855B5144095BE6BFE42FCE9F732"><enum>(2)</enum><header>Initial
			 update</header><text>The initial update required by section 506I(b) of such
			 Act, as added by paragraph (1) of this subsection, shall be made publicly
			 available not later than 10 days after the date the first report following the
			 date of the enactment of the <short-title>Intelligence
			 Authorization Act for Fiscal Year 2012</short-title> is submitted to members
			 and committees of Congress pursuant to section 319 of the Supplemental
			 Appropriations Act, 2009 (Public Law 111–32; 10 U.S.C. 801 note).</text>

			 authority to manage supply chain risk</header>
				<subsection id="H94556966704F4EF180725FF393DAE6CB"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HB597223E960A4DC48DFB949518D1E067"><enum>(1)</enum><header>Covered
			 agency</header><text>The term <term>covered agency</term> means any element of
			 the intelligence community other than an element within the Department of
			 Defense.</text>
					</paragraph><paragraph id="HE1EF0ED12911405E9F58EE24CC448535"><enum>(2)</enum><header>Covered item of
			 supply</header><text>The term <quote>covered item of supply</quote> means an
			 item of information technology (as that term is defined in section 11101 of
			 title 40, United States Code) that is purchased for inclusion in a covered
			 system, and the loss of integrity of which could result in a supply chain risk
			 for a covered system.</text>
					</paragraph><paragraph id="H16DF6A8606E14D5C8D832DE7172775C9"><enum>(3)</enum><header>Covered
			 procurement</header><text>The term <term>covered procurement</term>
			 means—</text>
						<subparagraph id="HAA7646AC66624458B6790C2DB47B0C06"><enum>(A)</enum><text>a source selection
			 for a covered system or a covered item of supply; or</text>
						</subparagraph><subparagraph id="H08DB2E3779FD49AA8B7353EEB66B3BE0"><enum>(B)</enum><text>any contract
			 action involving a contract for a covered system or a covered item of supply
			 where such contract includes a clause establishing requirements relating to
			 supply chain risk.</text>
						</subparagraph></paragraph><paragraph id="H13645A5E366746899465B50836DCD758"><enum>(4)</enum><header>Covered
			 procurement action</header><text>The term <term>covered procurement
			 action</term> means any of the following actions, if the action takes place in
			 the course of conducting a covered procurement:</text>
						<subparagraph id="HFDB1E6ECA53744EA8D5F577DDF34AF31"><enum>(A)</enum><text>The exclusion of a
			 source for the purpose of reducing supply chain risk in the acquisition of
			 covered systems.</text>
						</subparagraph><subparagraph id="H70D9E8E256A346E3AF6DE31876775AAD"><enum>(B)</enum><text>The exclusion of a
			 source that fails to achieve an acceptable rating with regard to an evaluation
			 factor providing for the consideration of supply chain risk in the evaluation
			 of proposals for the award of a contract or the issuance of a task or delivery
			 order.</text>
						</subparagraph><subparagraph id="H11E05E97B77F427A927DEA587C8C7170"><enum>(C)</enum><text>The decision to
			 withhold consent for a contractor to subcontract with a particular source or to
			 direct a contractor for a covered system to exclude a particular source from
			 consideration for a subcontract under the contract.</text>
						</subparagraph></paragraph><paragraph id="H7B3D9018473047738EDECCF50664E8B9"><enum>(5)</enum><header>Covered
			 system</header>
						<subparagraph id="H324BD40F2B89414DAB79C4FB06F7B165"><enum>(A)</enum><header>In
			 general</header><text>The term <quote>covered system</quote> means any
			 information system (including any telecommunications system) used or operated
			 by an agency or by a contractor of an agency, or other organization on behalf
			 of an agency—</text>
							<clause id="H1CACF94F97604D32859F9F9984DA0896"><enum>(i)</enum><text>the
			 function, operation, or use of which—</text>
								<subclause id="HFF9B7978DCCE4856B74145318E73136F"><enum>(I)</enum><text>involves
			 intelligence activities;</text>
								</subclause><subclause id="HC02C313C0CEE42378991FB665663C808"><enum>(II)</enum><text>involves
			 cryptologic activities related to national security;</text>
								</subclause><subclause id="H7FAD6860D39C4036B8A56586FFBF253B"><enum>(III)</enum><text>involves command
			 and control of military forces;</text>
								</subclause><subclause id="HE8D1FC8D000C45BD83C37150A7737649"><enum>(IV)</enum><text>involves
			 equipment that is an integral part of a weapon or weapons system; or</text>
								</subclause><subclause id="H394755C322D24EDB96900FDE9C49E7B3"><enum>(V)</enum><text>subject to
			 subparagraph (B), is critical to the direct fulfillment of military or
			 intelligence missions; or</text>
								</subclause></clause><clause id="H9F280E302F2A41B78FD8E5A0CD0DA2CD"><enum>(ii)</enum><text>is
			 protected at all times by procedures established for information that have been
			 specifically authorized under criteria established by an Executive order or an
			 Act of Congress to be kept classified in the interest of national defense or
			 foreign policy.</text>
							</clause></subparagraph><subparagraph id="H370E3D934E134B9ABDE04A56C8C55D30"><enum>(B)</enum><header>Exception of
			 administrative and business applications</header><text>Subparagraph (A)(i)(V)
			 does not include a system that is to be used for routine administrative and
			 business applications (including payroll, finance, logistics, and personnel
			 management applications).</text>
						</subparagraph></paragraph><paragraph id="H41C710023B464693AB3821B6D3BD7312"><enum>(6)</enum><header>Supply chain
			 risk</header><text>The term <quote>supply chain risk</quote> means the risk
			 that an adversary may sabotage, maliciously introduce unwanted function, or
			 otherwise subvert the design, integrity, manufacturing, production,
			 distribution, installation, operation, or maintenance of a covered system so as
			 to surveil, deny, disrupt, or otherwise degrade the function, use, or operation
			 of such system.</text>
					</paragraph></subsection><subsection id="H0CB67D4AAA3C4919805C6B48174392EE"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Subject to subsection (c), the head of a
			 covered agency may, in conducting intelligence and intelligence-related
			 activities—</text>
					<paragraph id="H03CD4C1A2DBA4E22B9A95093E1A72190"><enum>(1)</enum><text>carry out a
			 covered procurement action; and</text>
					</paragraph><paragraph id="H2932DB25C2D94B6495255ACB2490407D"><enum>(2)</enum><text>limit,
			 notwithstanding any other provision of law, in whole or in part, the disclosure
			 of information relating to the basis for carrying out a covered procurement
			 action.</text>
					</paragraph></subsection><subsection id="H583C4D13D4024D37A8355B2D8892BC59"><enum>(c)</enum><header>Determination
			 and notification</header><text>The head of a covered agency may exercise the
			 authority provided in subsection (b) only after—</text>
					<paragraph id="H9848C3392BB54748A2867BB9A84E52D8"><enum>(1)</enum><text>any appropriate
			 consultation with procurement or other relevant officials of the covered
			 agency;</text>
					</paragraph><paragraph id="H125905860EFE4EFB9A511C525D352C23"><enum>(2)</enum><text>making a
			 determination in writing, which may be in classified form, that—</text>
						<subparagraph id="H9777176B8CA94A0693A186E2BBD6BA54"><enum>(A)</enum><text>use of the
			 authority in subsection (b)(1) is necessary to protect national security by
			 reducing supply chain risk;</text>
						</subparagraph><subparagraph id="HC850FC0B37DC482393217EA0EAF5F771"><enum>(B)</enum><text>less intrusive
			 measures are not reasonably available to reduce such supply chain risk;
			 and</text>
						</subparagraph><subparagraph id="H4745BD70CA084C13827FA97747DD8A8A"><enum>(C)</enum><text>in a case where
			 the head of the covered agency plans to limit disclosure of information under
			 subsection (b)(2), the risk to national security due to the disclosure of such
			 information outweighs the risk due to not disclosing such information;</text>
						</subparagraph></paragraph><paragraph id="H18701E14A32B44E79D90F3C86EEB4AD7"><enum>(3)</enum><text>notifying the
			 Director of National Intelligence that there is a significant supply chain risk
			 to the covered system concerned, unless the head of the covered agency making
			 the determination is the Director of National Intelligence; and</text>
					</paragraph><paragraph id="H288EAACB27524049BDFA3AA32C3D2B23"><enum>(4)</enum><text>providing a
			 notice, which may be in classified form, of the determination made under
			 paragraph (2) to the congressional intelligence committees that includes a
			 summary of the basis for the determination, including a discussion of less
			 intrusive measures that were considered and why they were not reasonably
			 available to reduce supply chain risk.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H9423433DD7634AFA80A96D90F400425B"><enum>(d)</enum><header>Delegation</header><text display-inline="yes-display-inline">The head of a covered agency may not
			 delegate the authority provided in subsection (b) or the responsibility to make
			 a determination under subsection (c) to an official below the level of the
			 service acquisition executive for the agency concerned.</text>
				</subsection><subsection id="H6494858812934E29AEE041C701B40C15"><enum>(e)</enum><header>Savings</header><text>The
			 authority under this section is in addition to any other authority under any
			 other provision of law. The authority under this section shall not be construed
			 to alter or effect the exercise of any other provision of law.</text>
				</subsection><subsection id="HC4D640F9FCA2451AB4CFD6A13A47B993"><enum>(f)</enum><header>Effective
			 date</header><text>The requirements of this section shall take effect on the
			 date that is 180 days after the date of the enactment of this Act and shall
			 apply to contracts that are awarded on or after such date.</text>
				</subsection><subsection id="H01F38CE4C6D44134B731B67957BB145E"><enum>(g)</enum><header>Sunset</header><text>The
			 authority provided in this section shall expire on the date that section 806 of
			 the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 (Public
			 Law 111–383; 10 U.S.C. 2304 note) expires.</text>
				</subsection></section><section display-inline="no-display-inline" id="HC94ACB0CD5D940C1AB1E3F24EB0734A2" section-type="subsequent-section"><enum>309.</enum><header>Modification of
			 certain reporting requirements</header>
				<subsection id="H923E2AA26B0346EA8514AD455457288B"><enum>(a)</enum><header>Intelligence
			 Reform and Terrorism Prevention Act of 2004</header><text>Section 1041(b) of
			 the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 403–1b(b)) is amended by striking paragraphs (3) and (4).</text>
				</subsection><subsection id="HC132076E8F8147B49129C471E6B9E3D0"><enum>(b)</enum><header>Intelligence
			 Authorization Act for Fiscal Year 2003</header><text>Section 904(d)(1) of the
			 Intelligence Authorization Act for Fiscal Year 2003 (50 U.S.C. 402c(d)(1)) is

				</subsection><subsection id="H674FC5C2B16747F79E40F832142A64DB"><enum>(c)</enum><header>Intelligence
			 Authorization Act for Fiscal Year 1995</header><text>Section 809 of the
			 Intelligence Authorization Act for Fiscal Year 1995 (50 U.S.C. App. 2170b) is

				</subsection></section><section id="HEABB29195C784FF9A59C55A396DD05D8"><enum>310.</enum><header>Counterterrorism
			 Competitive Analysis Commission</header>
				<subsection display-inline="no-display-inline" id="HFE89323076C84687ABF26A72CB6A8F63"><enum>(a)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
					<paragraph id="H0532D992E2E84F44B6D52E15F39F9ADD"><enum>(1)</enum><text>terrorism and
			 domestic radicalization represent evolving and dynamic threats to the United
			 States;</text>
					</paragraph><paragraph id="HF5533AD18D7D4E89A8773790A4A41A5C"><enum>(2)</enum><text>biases and group
			 think can prevent intelligence analysts from detecting important changes in
			 such threats that can prevent the detection and prevention of terrorist
			 attacks; and</text>
					</paragraph><paragraph id="H33BE7DE855514E5AB1929F75444E3AA4"><enum>(3)</enum><text>competitive and
			 alternative intelligence analysis are important tools to prevent biases and
			 group think from resulting in analytical failures and can help the intelligence
			 community and policy makers better understand the nature of complex threats to
			 the United States.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H53BAEA87579E4443BD6594E6DF45F4AB"><enum>(b)</enum><header>Establishment</header><text>There
			 is established a Commission to be known as the <quote>Counterterrorism
			 Competitive Analysis Commission</quote> (in this section referred to as the
			 <quote>Commission</quote>).</text>
				</subsection><subsection id="HD8DB6525E3304D2B903460C1B5AECFFF"><enum>(c)</enum><header>Duties</header>
					<paragraph id="H7895CB6033D64FE0A1F8653E57932E30"><enum>(1)</enum><header>Study</header><text>The
			 Commission shall conduct a study on—</text>
						<subparagraph id="H121CB10B8E66401B909AD9EEE597E0DC"><enum>(A)</enum><text display-inline="yes-display-inline">how the elements of the intelligence
			 community use red teams, alternative analysis, and competitive analysis of
			 foreign intelligence to address domestic radicalization;</text>
						</subparagraph><subparagraph id="H49EEC81BAD3A4CEFA8EFD24D44AC4FD7"><enum>(B)</enum><text display-inline="yes-display-inline">whether such analysis is timely, objective,
			 based upon all sources of available foreign intelligence, and employs the
			 standards of proper analytic tradecraft; and</text>
						</subparagraph><subparagraph id="HB67C3F53CE88488A9161ADA1E8D3884E"><enum>(C)</enum><text>the feasibility
			 and advisability of establishing a permanent entity to—</text>
							<clause display-inline="no-display-inline" id="H1B694E77282D456FB40454CC6038FC02"><enum>(i)</enum><text>advise the
			 Director on matters of policy relating to the threats of international
			 terrorism and domestic radicalization;</text>
							</clause><clause display-inline="no-display-inline" id="HF4BC40E03A3D48D0A92F1C73F6970163"><enum>(ii)</enum><text display-inline="yes-display-inline">prepare competitive analyses of national
			 intelligence estimates prepared by the intelligence community and submit such
			 analyses to the Director and the National Intelligence Commission; and</text>
							</clause><clause display-inline="no-display-inline" id="HF51F2108DC4149E3BC021B6B9D2809E8"><enum>(iii)</enum><text display-inline="yes-display-inline">annually submit to Congress a report in
			 unclassified form, which may include a classified annex, on trends in
			 counterterrorism and domestic radicalization, including a summary of any
			 competitive analyses referred to in clause (ii).</text>
							</clause></subparagraph></paragraph><paragraph id="H82E6CF3DA70F40CF9ECAD42EDD129446"><enum>(2)</enum><header>Report</header><text>Not
			 later than one year after the date of the enactment of this Act, the Commission
			 shall submit to the congressional intelligence committees a report containing
			 the results of the study under paragraph (1).</text>
					</paragraph></subsection><subsection id="H5DC1655D6B4A4F2D9FCEF7E91F46179B"><enum>(d)</enum><header>Members</header>
					<paragraph display-inline="no-display-inline" id="H647B3A6256BF4085AC22645723904D0F"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Commission shall be composed of six
			 members selected on the basis of previous experience with matters of policy
			 relating to international terrorism, intelligence analysis, and domestic
			 radicalization, of whom—</text>
						<subparagraph id="HE42F665047C24754B02F9A33ABA0A8EF"><enum>(A)</enum><text>two members shall
			 be appointed by the President;</text>
						</subparagraph><subparagraph id="H769941B3B24847B2947620FF686A89E1"><enum>(B)</enum><text>one member shall
			 be appointed by the Speaker of the House of Representatives;</text>
						</subparagraph><subparagraph id="HBCAB121C455B4809AB3D0268AA47EAC3"><enum>(C)</enum><text>one member shall
			 be appointed by the minority leader of the House of Representatives;</text>
						</subparagraph><subparagraph id="H41728E0739F64894B2A35BA380AF05DB"><enum>(D)</enum><text>one member shall
			 be appointed by the majority leader of the Senate; and</text>
						</subparagraph><subparagraph id="H16B838C55F0A49BF9F8DCB5AE0B51370"><enum>(E)</enum><text>one member shall
			 be appointed by the minority leader of the Senate.</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HABCB06EF134142ADB386060B1ED2BC20"><enum>(2)</enum><header>Qualifications</header><text>An
			 individual may not be appointed to the Commission under paragraph (1) if such
			 individual has served as an officer or employee of the Federal Government
			 within a three-year period of the date of appointment.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HBFBFC2B3ADA44750B68418C595F740C8"><enum>(3)</enum><header>Compensation</header><text display-inline="yes-display-inline">To the extent provided in advance in
			 appropriation Acts, each member of the Commission shall be paid consistent with
			 the skill and experience of such member at a rate not to exceed the annual rate
			 of basic pay for level V of the Executive Schedule under section 5316 of title
			 5, United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9E01E1970CD442B9EE2A15B047C121F"><enum>(4)</enum><header>Actions of
			 Commission</header><text>Any member of the Commission may, if authorized by
			 the Commission, take any action which the Commission is authorized to take by
			 this section.</text>
					</paragraph></subsection><subsection id="HC0E93C768A094B018C343A487C0B0A0D"><enum>(e)</enum><header>Staff of
			 Commission</header>
					<paragraph display-inline="no-display-inline" id="H39A5DB1AC8904E4AA2297116C49D48E3"><enum>(1)</enum><header>Compensation</header><text display-inline="yes-display-inline">To the extent provided in advance in
			 appropriation Acts, the Commission shall appoint and fix the compensation of a
			 Director and such additional staff as may be necessary to enable the Commission
			 to carry out its duties.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HD389A32386D74EA79860F1A4669E5195"><enum>(2)</enum><header>Rate of
			 pay</header><text display-inline="yes-display-inline">The Director and staff
			 of the Commission may be appointed without regard to the provisions of title 5,
			 United States Code, governing appointments in the competitive service, and may
			 be paid without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of that title relating to classification and General Schedule pay
			 rates, except that the rate of pay fixed for the Director and staff may not
			 exceed the annual rate of basic pay for level V of the Executive Schedule under
			 section 5316 of title 5, United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB2B6607287847249CF95445BAEC2152"><enum>(3)</enum><header>Experts and
			 consultants</header><text>In accordance with rules adopted by the Commission,
			 and to the extent provided in advance in appropriation Acts, the Commission may
			 procure the services of experts and consultants under section 3109(b) of title
			 5, United States Code, but at rates for individuals not to exceed the daily
			 equivalent of the annual rate of basic pay for level V of the Executive
			 Schedule under section 5316 of title 5, United States Code.</text>
					</paragraph></subsection><subsection id="H302BD1B10CF3462286C839E62BC10F56"><enum>(f)</enum><header>Security
			 Clearances</header><text>The Director of National Intelligence shall ensure
			 that the appropriate executive departments and agencies cooperate with the
			 Commission in expeditiously providing to the members and staff appropriate
			 security clearances in a manner consistent with existing procedures and
			 requirements.</text>
				</subsection><subsection id="HC59B99155BA045379F765F7560A040E0"><enum>(g)</enum><header>Termination</header><text>The
			 Commission shall terminate on the date that is 30 days after the date on which
			 the Commission submits the report required under subsection (c)(2), or on the
			 date that is 395 days after the date of the enactment of this Act, whichever is
			 earlier.</text>
				</subsection></section></title><title id="HF71C8200DF974CF4926B3FDAF8BEC159"><enum>IV</enum><header>Matters Relating
			 to Elements of the Intelligence Community</header>
			<subtitle id="H006DDFC8CBC54252BC593F6FEBB9F4F7"><enum>A</enum><header>Office of the
			 Director of National Intelligence</header>
				<section id="H2C33214A880B45AFB78E083F0D0F7494"><enum>401.</enum><header>Intelligence
			 community assistance to counter drug trafficking organizations using public
			 lands</header>
					<subsection id="HCBD37B4BCD2C4BE3BB22461D5A17651E"><enum>(a)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Director of National Intelligence shall
			 consult with the heads of the Federal land management agencies on the
			 appropriate actions the intelligence community can take to assist such agencies
			 in responding to the threat from covered entities that are currently or have
			 previously used public lands in the United States to further the operations of
			 such entities.</text>
					</subsection><subsection id="H58D2359235F44FE5AA9FB0EB5646DEB1"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Director
			 of National Intelligence shall submit to the congressional intelligence
			 committees a report on the results of the consultation under subsection (a).
			 Such report shall include—</text>
						<paragraph id="HE47AD0AD5DF2421F9552C825D5CC4BDC"><enum>(1)</enum><text>an assessment of
			 the intelligence community collection efforts dedicated to covered entities,
			 including any collection gaps or inefficiencies; and</text>
						</paragraph><paragraph id="HF93AB5BBCA4C4D6E80290A7E034FE6AA"><enum>(2)</enum><text>an assessment of
			 the ability of the intelligence community to assist Federal land management
			 agencies in identifying and protecting public lands from illegal drug grows and
			 other activities and threats of covered entities, including through the sharing
			 of intelligence information.</text>
						</paragraph></subsection><subsection id="HD11A10C0485F4A999B5297A030CB728D"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="HF75D936FA4084FF1B76D76F6BC8983F9"><enum>(1)</enum><header>Covered
			 entity</header><text>The term <quote>covered entity</quote> means an
			 international drug trafficking organization or other actor involved in drug
			 trafficking generally.</text>
						</paragraph><paragraph id="H658CDA1B9847457BA061171E11EB8694"><enum>(2)</enum><header>Federal land
			 management agency</header><text>The term <quote>Federal land management
			 agency</quote> includes—</text>
							<subparagraph id="H163AD48E7A934138B6AC3C0F58A135D6"><enum>(A)</enum><text>the Forest Service
			 of the Department of Agriculture;</text>
							</subparagraph><subparagraph id="H9718C847CE3849D8B7DCAA31F28080B5"><enum>(B)</enum><text>the Bureau of Land
			 Management of the Department of the Interior;</text>
							</subparagraph><subparagraph id="H90C0FDB6195B43B68BEAF1E3192865A7"><enum>(C)</enum><text>the National Park
			 Service of the Department of the Interior;</text>
							</subparagraph><subparagraph id="H8484AE7D1B0341FDBF1989244F83461E"><enum>(D)</enum><text>the Fish and
			 Wildlife Service of the Department of the Interior; and</text>
							</subparagraph><subparagraph id="H3B165F984EDD4497A43599F75E84FBB2"><enum>(E)</enum><text>the Bureau of
			 Reclamation of the Department of the Interior.</text>
							</subparagraph></paragraph><paragraph id="H16A08DA4B88D4039B7EE5209FE7C103F"><enum>(3)</enum><header>Public
			 lands</header><text>The term <quote>public lands</quote> has the meaning given
			 that term in section 103 of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1702).</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB481CA9E3D2246CCBDEE26AA4D535DBB" section-type="subsequent-section"><enum>402.</enum><header>Application of
			 certain financial reporting requirements to the Office of the Director of
			 National Intelligence</header><text display-inline="no-display-inline">For each
			 of the fiscal years 2010, 2011, and 2012, the requirements of section 3515 of
			 title 31, United States Code, to submit an audited financial statement shall
			 not apply to the Office of the Director of National Intelligence if the
			 Director of National Intelligence determines and notifies Congress that audited
			 financial statements for such years for such Office cannot be produced on a
			 cost-effective basis.</text>
				</section><section id="H583A2162B9E6481AAE281075CAB09E6D"><enum>403.</enum><header>Public
			 availability of information regarding the Inspector General of the Intelligence
			 Community</header><text display-inline="no-display-inline">Section 103H of the
			 National Security Act of 1947 (50 U.S.C. 403–3h) is amended by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H0DCD0A16A99A49748EAF8FA3D75EE25D" style="OLC">
						<subsection id="H76BCCC14C9574B878C5533F68798D36F"><enum>(o)</enum><header>Information on
				website</header><paragraph commented="no" display-inline="yes-display-inline" id="H92BE9886D0B54529846FFC04981D4CC8"><enum>(1)</enum><text>The Director of National
				Intelligence shall establish and maintain on the homepage of the publicly
				accessible website of the Office of the Director of National Intelligence
				information relating to the Office of the Inspector General of the Intelligence
				Community including methods to contact the Inspector General.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD15D21FB0734A858F83C9383949A763" indent="up1"><enum>(2)</enum><text>The information referred to in
				paragraph (1) shall be obvious and facilitate accessibility to the information
				related to the Office of the Inspector General of the Intelligence
				Community.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HE3EEDD601D97459491D5941BEFF02E9B"><enum>404.</enum><header>Clarification
			 of status of Chief Information Officer in the Executive Schedule</header><text display-inline="no-display-inline">Section 5315 of title 5, United States Code,
			 is amended by inserting after the item relating to the Chief Information
			 Officer, Small Business Administration the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HCA0F4DF940494F2D9E92BEA94A268BEA" style="OLC">
						<paragraph id="HFDF72F0339FB4E48BFA3DF8436F68705"><enum></enum><text>Chief
				Information Officer of the Intelligence

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H1B28951EB671400BB420F6805E7EF9A1"><enum>405.</enum><header>Temporary
			 appointment to fill vacancies within Office of the Director of National
			 Intelligence</header><text display-inline="no-display-inline">Section 103 of
			 the National Security Act of 1947 (50 U.S.C. 403–3) is amended—</text>
					<paragraph id="H0F51221C7C854521B0B47139B521183B"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
					</paragraph><paragraph id="H7CF5CDE185C24B629AE8B8C48B33800A"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following new subsection:</text>

				preceding subparagraph (A), by substituting <quote>an element of the
				intelligence community, as that term is defined in section 3(4) of the National
				Security Act of 1947 (50 U.S.C. 401a(4)),</quote> for <quote>such Executive
				agency</quote>; and</text>
								</paragraph><paragraph id="H959EAE851E0A47998E8034A981BC2354"><enum>(2)</enum><text>in subparagraph
				(A), by substituting <quote>the intelligence community</quote> for <quote>such
				agency</quote>.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section></subtitle><subtitle id="HA166FA4B337A4CB19FE36FDDB7FC5A9F"><enum>B</enum><header>Central
			 Intelligence Agency</header>
				<section id="HF1765E8A5FAB40F6A5ED7269153B077A"><enum>411.</enum><header>Burial
			 allowance</header>
					<subsection id="HC417A127FD0C4AF898F62D277E5C4FEF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 11 of the
			 Central Intelligence Agency Act of 1949 (50 U.S.C. 403k) is amended—</text>
						<paragraph id="H10CF90EE14BA4476B0AA21A8C0C844E7"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting
			 <quote><header-in-text level="section" style="traditional">and burial
			 allowance</header-in-text></quote> after <quote><header-in-text level="section" style="traditional">gratuities</header-in-text></quote>; and</text>
						</paragraph><paragraph id="H7B97585AFA4A48C59C666812B9C8671D"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="H8272D81FE2ED4BF3B8D1DE881C1D2646" style="traditional">
								<subsection id="H5F08C97A80CF408EAA3D4959B02F0DFD"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB8787D6CEADC4050B8BA59F61A2D2E57"><enum>(1)</enum><text>At the request of a
				representative of the estate of any officer or employee of the Agency (as
				determined in accordance with the laws of a State) who dies in a manner
				described in subsection (a)(1), the Director may pay to such estate a burial
				allowance.</text>
									</paragraph><paragraph id="H7D331C127CCC4ED8B1959F54439CF304" indent="up1"><enum>(2)</enum><text>A burial allowance paid under
				paragraph (1) may be used to cover burial expenses, including recovery,
				mortuary, funeral or memorial service, cremation, burial costs, and costs of
				transportation by common carrier to the place selected for final disposition of
				the deceased.</text>
									</paragraph><paragraph id="HF4E146826EEF4087985E099D17189A79" indent="up1"><enum>(3)</enum><text>Each payment made under this
				subsection shall be—</text>
										<subparagraph id="H38523E7E12064DC7BC24D376A8228266"><enum>(A)</enum><text>in an amount not greater than $15,000
				plus the actual costs of transportation referred to in paragraph (2);
				and</text>
										</subparagraph><subparagraph id="H98147E91DBAD4662B8BD089EE5E38D3B"><enum>(B)</enum><text>in addition to any other benefit that
				may be due under any other provision of law.</text>
										</subparagraph></paragraph><paragraph id="HBAF68E9E42294EA3856FAF365B831DAC" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Director may annually increase the
				amount in paragraph (3)(A) to reflect any increase in the Consumer Price Index
				occurring during the preceding year.</text>
									</paragraph><paragraph id="H6BBB47B1C55C4968840BFBCC95D344A5" indent="up1"><enum>(5)</enum><text>The Director may pay the burial
				benefit authorized under this subsection more than once for funeral, memorial,
				or burial expenses stemming from a single death of an officer or employee of
				the Agency if the remains of such officer or employee were not recovered, were
				recovered after considerable delay, or were not recovered
				intact.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H6AA79EDD6A25440FB5934CB9164DE6DE"><enum>(b)</enum><header>Effective date
			 of authority to increase allowance</header><text display-inline="yes-display-inline">Section 11(c)(4) of the Central
			 Intelligence Agency Act of 1949, as added by subsection (a), shall take effect
			 on the date that is one year after the date of the enactment of this
			 Act.</text>
					</subsection></section><section commented="no" id="HD01042F10FB44A148403461ABD89C585"><enum>412.</enum><header>Acceptance of
			 gifts</header><text display-inline="no-display-inline">Section 12 of the
			 Central Intelligence Agency Act of 1949 (50 U.S.C. 403l(a)) is amended—</text>
					<paragraph commented="no" id="HD9AAC9748E2B4BF4A5496AE9C35228DB"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph commented="no" id="H6D9815712A2449D793EE24A0C99DFC73"><enum>(A)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>; and</text>
						</subparagraph><subparagraph commented="no" id="HB51984CC9A6449F783B84EA8B6CF114B"><enum>(B)</enum><text>by striking the
			 second and third sentences and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H20E3573263A24CEB8F11A21D74F69621" style="OLC">
								<paragraph commented="no" id="H157802A0EF6C4A8FB40D5CC839A1A7E3" indent="up1"><enum>(2)</enum><text>Any gift accepted under this section
				(and any income produced by any such gift)—</text>
									<subparagraph commented="no" id="H16F8DDA3BC1E4CB6A68124D01D44CC87"><enum>(A)</enum><text>may be used only
				for—</text>
									</subparagraph></paragraph><after-quoted-block></after-quoted-block></quoted-block>
							<quoted-block display-inline="no-display-inline" id="H09F6A81AA93D49A8B7B52FAABAC349A6" style="OLC">
								<clause commented="no" id="HC463B65C568240319C7966593C04CAB5" indent="up1"><enum>(i)</enum><text>artistic display;</text>
								</clause><clause commented="no" id="H1D4D3B8B5A8643759496746CBC8C8579" indent="up1"><enum>(ii)</enum><text>purposes relating to the general
				welfare, education, or recreation of employees or dependents of employees of
				the Agency or for similar purposes; or</text>
								</clause><clause commented="no" id="H1C41ADE6A10045F0AAA11CAC9AEE31EE" indent="up1"><enum>(iii)</enum><text>purposes relating to the welfare,
				education, or recreation of an individual described in paragraph (3);
				and</text>
								</clause><subparagraph commented="no" id="HFEC8BE0BD94C4D9BB8646650DBC776CE" indent="up1"><enum>(B)</enum><text>under no circumstances may such a gift
				(or any income produced by any such gift) be used for operational
				purposes.</text>
								</subparagraph><paragraph commented="no" id="HF16E312125B344F190EC6A3757AD64CC" indent="up1"><enum>(3)</enum><text>An individual described in this
				paragraph is an individual who—</text>
									<subparagraph commented="no" id="H99E7446C146B496BBFE42ABFC6D4705A"><enum>(A)</enum><text>is an employee or a former employee of
				the Agency who suffered injury or illness while employed by the Agency
				that—</text>
										<clause id="H1B4D2E6B59934533BC21EF5BF112F1B7"><enum>(i)</enum><text>resulted from hostile or terrorist
				activities;</text>
										</clause><clause id="H6BAC41B8B13F464183C413319815A496"><enum>(ii)</enum><text>occurred in connection with an
				intelligence activity having a significant element of risk; or</text>
										</clause><clause id="H206C7625019349FFA40EC34D2422FA36"><enum>(iii)</enum><text>occurred under other
				circumstances determined by the Director to be analogous to the circumstances
				described in clause (i) or (ii);</text>
										</clause></subparagraph><subparagraph commented="no" id="H7C547EFCE2C146FE8AC124D665F36EDF"><enum>(B)</enum><text>is a family member of such an employee
				or former employee; or</text>
									</subparagraph><subparagraph commented="no" id="H8AD0F4F7B84D46CB8F9C45A5E4C6BFFA"><enum>(C)</enum><text>is a surviving family member of an
				employee of the Agency who died in circumstances described in clause (i), (ii),
				or (iii) of subparagraph (A).</text>
									</subparagraph></paragraph><paragraph commented="no" id="H21469E534F4B44D9B69BECE93838A870" indent="up1"><enum>(4)</enum><text>The Director may not accept any gift
				under this section that is expressly conditioned upon any expenditure not to be
				met from the gift itself or from income produced by the gift unless such
				expenditure has been authorized by law.</text>
								</paragraph><paragraph commented="no" id="H5EFF24732DF14B598AC8122CD9FF188A" indent="up1"><enum>(5)</enum><text>The Director may, in the Director's
				discretion, determine that an individual described in subparagraph (A) or (B)
				of paragraph (3) may accept a gift for the purposes described in paragraph
				(2)(A)(iii).</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" id="HAA15A947DE604F6F83BC848670E935B9"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H04D266ABAD254DABAB10FD4931415AF7" style="OLC">
							<subsection commented="no" id="H18A4F388457546A585D96781587EAD8C"><enum>(f)</enum><text>The Director, in
				consultation with the Director of the Office of Government Ethics, shall issue
				regulations to carry out the authority provided in this section. Such
				regulations shall ensure that such authority is exercised consistent with all
				relevant ethical constraints and principles, including—</text>
								<paragraph commented="no" id="H83033EA78E7340C1B41D9A045AD6F974"><enum>(1)</enum><text>the avoidance of
				any prohibited conflict of interest or appearance of impropriety; and</text>
								</paragraph><paragraph commented="no" id="H16B1717C531B4E48ACA921ABB4A26334"><enum>(2)</enum><text>a prohibition
				against the acceptance of a gift from a foreign government or an agent of a
				foreign
				government.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section display-inline="no-display-inline" id="HC8719832A95A4ECE89249001041C9189" section-type="subsequent-section"><enum>413.</enum><header>Foreign language
			 proficiency requirements for Central Intelligence Agency officers</header>
					<subsection id="HBC9020897BFC421A9D7AAECD9486AE98"><enum>(a)</enum><header>In
			 general</header><text>Section 104A(g) of the National Security Act of 1947 (50
			 U.S.C. 403–4a(g)) is amended—</text>

			 Directorate of Intelligence career service or the National Clandestine Service

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H09B6AF2640154BAB87491033D35B7BC6"><enum>(2)</enum><text>did not meet the
			 foreign language requirements specified in section 104A(g)(1) of the National
			 Security Act of 1947 (50 U.S.C. 403–4a(g)(1)) at the time of such
			 transfer.</text>
						</paragraph></subsection></section><section display-inline="no-display-inline" id="HB655E6528CB74A1A84506098B518159C" section-type="subsequent-section"><enum>414.</enum><header>Public availability
			 of information regarding the Inspector General of the Central Intelligence
			 Agency</header><text display-inline="no-display-inline">Section 17 of the
			 Central Intelligence Agency Act of 1949 (50 U.S.C. 403q) is amended by adding
			 at the end the following new subsection:</text>

				paragraph (1) shall be obvious and facilitate accessibility to the information

				</section><section id="HE454712772EA436782114079E0E1553D"><enum>415.</enum><header>Creating an
			 official record of the Osama bin Laden operation</header>
					<subsection id="H651E6A7968D74C578F26F92FBC135E1F"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
						<paragraph id="H1EB095154E3B443FA2B1C954708A92DB"><enum>(1)</enum><text display-inline="yes-display-inline">On May 1, 2011, United States personnel
			 killed terrorist leader Osama bin Laden during the course of a targeted strike
			 against his secret compound in Abbottabad, Pakistan.</text>
						</paragraph><paragraph id="H96EA3B8C73A54016BE2E18B0FC2750D4"><enum>(2)</enum><text>Osama bin Laden
			 was the leader of the al Qaeda terrorist organization, the most significant
			 terrorism threat to the United States and the international community.</text>
						</paragraph><paragraph id="H0E69A17EDF17480686C6B1CF734E30A6"><enum>(3)</enum><text>Osama bin Laden
			 was the architect of terrorist attacks which killed nearly 3,000 civilians on
			 September 11, 2001, the most deadly terrorist attack against our Nation, in
			 which al Qaeda terrorists hijacked four airplanes and crashed them into the
			 World Trade Center in New York City, the Pentagon in Washington, D.C., and, due
			 to heroic efforts by civilian passengers to disrupt the terrorists, near
			 Shanksville, Pennsylvania.</text>
						</paragraph><paragraph id="HB94A0D80147A4D7BBF60E1B42845A659"><enum>(4)</enum><text>Osama bin Laden
			 planned or supported numerous other deadly terrorist attacks against the United
			 States and its allies, including the 1998 bombings of United States embassies
			 in Kenya and Tanzania and the 2000 attack on the U.S.S. Cole in Yemen, and
			 against innocent civilians in countries around the world, including the 2004
			 attack on commuter trains in Madrid, Spain and the 2005 bombings of the mass
			 transit system in London, England.</text>
						</paragraph><paragraph id="H0A13AC720DC64D3EBE9236890870B30C"><enum>(5)</enum><text>Following the
			 September 11, 2001, terrorist attacks, the United States, under President
			 George W. Bush, led an international coalition into Afghanistan to dismantle al
			 Qaeda, deny them a safe haven in Afghanistan and ungoverned areas along the
			 Pakistani border, and bring Osama bin Laden to justice.</text>
						</paragraph><paragraph id="H45964CD5805F4EE8917B6CD04DD9E349"><enum>(6)</enum><text>President Barack
			 Obama in 2009 committed additional forces and resources to efforts in
			 Afghanistan and Pakistan as <quote>the central front in our enduring struggle
			 against terrorism and extremism</quote>.</text>
						</paragraph><paragraph id="HFAE5AE4563CD430B996C0CEAF1F5E023"><enum>(7)</enum><text>The valiant
			 members of the United States Armed Forces have courageously and vigorously
			 pursued al Qaeda and its affiliates in Afghanistan and around the world.</text>
						</paragraph><paragraph id="H66CFA13AA588473ABA5EAA2D77FDD76B"><enum>(8)</enum><text>The anonymous,
			 unsung heroes of the intelligence community have pursued al Qaeda and
			 affiliates in Afghanistan, Pakistan, and around the world with tremendous
			 dedication, sacrifice, and professionalism.</text>
						</paragraph><paragraph id="H2F03FE1B5D3C4055B2BD95EF0C5F09C5"><enum>(9)</enum><text>The close
			 collaboration between the Armed Forces and the intelligence community prompted
			 the Director of National Intelligence, General James Clapper, to state,
			 <quote>Never have I seen a more remarkable example of focused integration,
			 seamless collaboration, and sheer professional magnificence as was demonstrated
			 by the Intelligence Community in the ultimate demise of Osama bin
			 Laden.</quote>.</text>
						</paragraph><paragraph id="HC8FFA37929DB4B5A991910F585FF31E0"><enum>(10)</enum><text>While the death
			 of Osama bin Laden represents a significant blow to the al Qaeda organization
			 and its affiliates and to terrorist organizations around the world, terrorism
			 remains a critical threat to United States national security.</text>
						</paragraph><paragraph id="H06AD2CF37CB04601A6BDFB82C2DCC888"><enum>(11)</enum><text>President Obama
			 said, <quote>For over two decades, bin Laden has been al Qaeda’s leader and
			 symbol, and has continued to plot attacks against our country and our friends
			 and allies. The death of bin Laden marks the most significant achievement to
			 date in our Nation’s effort to defeat al Qaeda.</quote>.</text>
						</paragraph></subsection><subsection id="HD3EECBA35CED408EB6A1FEDCB91865BD"><enum>(b)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
						<paragraph id="H945D9F0CB93E4E34BDC9B4C514950547"><enum>(1)</enum><text>the raid that
			 killed Osama bin Laden demonstrated the best of the intelligence communities
			 capabilities and teamwork;</text>
						</paragraph><paragraph id="H0DF8BB75EB014548B45589DB6B91911B"><enum>(2)</enum><text>for years to come,
			 Americans will look back at this event as a defining point in the history of
			 the United States;</text>
						</paragraph><paragraph id="HF48AC64475864D94BB336B26CF90AC43"><enum>(3)</enum><text display-inline="yes-display-inline">it is vitally important that the United
			 States memorialize all the events that led to the raid so that future
			 generations will have an official record of the events that transpired before,
			 during, and as a result of the operation; and</text>
						</paragraph><paragraph id="H12AAB7D30B164065B97F5EE5BDDED726"><enum>(4)</enum><text display-inline="yes-display-inline">preserving this history now will allow the
			 United States to have an accurate account of the events while those that
			 participated in the events are still serving in the Government.</text>
						</paragraph></subsection><subsection id="H9D3E97798E1442089048049491782BE4"><enum>(c)</enum><header>Report on the
			 operation that killed Osama bin Laden</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Director of the Central Intelligence Agency, in
			 consultation with other agencies and entities involved in the operation that
			 killed Osama bin Laden, shall submit to the congressional intelligence
			 committees a classified report that memorializes such operation including a
			 description of the events leading up to the discovery of the location of Osama
			 bin Laden, the planning and execution of the raid, and the results of the
			 intelligence gained from the raid.</text>
					</subsection><subsection id="HA442D50FCDA3486D839EFE3976A90D7F"><enum>(d)</enum><header>Preservation of
			 records</header><text display-inline="yes-display-inline">The Director of the
			 Central Intelligence Agency shall preserve any records, including intelligence
			 information and assessments, used to generate the report described in
			 subsection (c).</text>
					</subsection></section><section id="H477DBE7A50654F9AB6F2BAC3768C4890"><enum>416.</enum><header>Recruitment of
			 personnel in the Office of the Inspector General</header>
					<subsection id="H535C77846C54481987E7F902D555B856"><enum>(a)</enum><header>Study</header><text>The
			 Director of the Central Intelligence Agency, in consultation with the Inspector
			 General of the Central Intelligence Agency, shall carry out a study of the
			 personnel issues of the Office of the Inspector General. Such study shall
			 include—</text>
						<paragraph id="HAC538749E6A14A8AA2857FDB25605F81"><enum>(1)</enum><text>identification of
			 any barriers or disincentives to the recruitment or retention of experienced
			 investigators within the Office of the Inspector General; and</text>
						</paragraph><paragraph id="HA2327A86481C478E9907EF8744BB2853"><enum>(2)</enum><text>a
			 comparison of the personnel authorities of the Inspector General with personnel
			 authorities of Inspectors General of other agencies and departments of the
			 United States, including a comparison of the benefits available to experienced
			 investigators within the Office of the Inspector General of the Central
			 Intelligence Agency with similar benefits available within the offices of
			 Inspectors General of such other agencies or departments.</text>
						</paragraph></subsection><subsection id="HB69983B9FDAA4E278B725692B12B25CF"><enum>(b)</enum><header>Recommendations</header><text>Not
			 later than 90 days after the date of the enactment of this Act, the Director of
			 the Central Intelligence Agency shall submit to the congressional intelligence
			 committees—</text>
						<paragraph id="HD2122D15A12746CF80C18B2AC15EED6F"><enum>(1)</enum><text>any
			 recommendations of the Director for legislative action based on the results of
			 the study conducted under subsection (a); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCFE1B264C9884BA18536554DDBCC431B"><enum>(2)</enum><text>a description of
			 any administrative actions taken by the Director based on such results.</text>
						</paragraph></subsection></section></subtitle><subtitle id="H1F192201877144159B2FA87CC7B37DD8"><enum>C</enum><header>National Security
			 Agency</header>
				<section display-inline="no-display-inline" id="H012DF753A7A44BB59FAA2E9C9C68BF92" section-type="subsequent-section"><enum>421.</enum><header>Additional
			 authorities for National Security Agency security personnel</header>

			 transport apprehended persons</header><text>Paragraph (5) of section 11(a) of

			 general</header><text>Chapter 21 of title 10, United States Code, is amended by
			 inserting after section 428 the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="H374BF8196B444128B5D4BDB454178539" style="USC">
							<section id="H748BEEB5C71846FC8F69841627D29DBA"><enum>429.</enum><header>Appropriations
				for Defense intelligence elements: accounts for transfers; transfer authority
				</header>
								<subsection id="H622AEB2C0A2741E9A22BE79A7AF9D698"><enum>(a)</enum><header>Accounts for
				appropriations for defense intelligence elements</header><text>The Secretary of
				Defense may transfer appropriations of the Department of Defense which are
				available for the activities of Defense intelligence elements to an account or
				accounts established for receipt of such transfers. Each such account may also
				receive transfers from the Director of National Intelligence if made pursuant
				to Section 102A of the National Security Act of 1947 (50 U.S.C. 403-1), and
				transfers and reimbursements arising from transactions, as authorized by law,
				between a Defense intelligence element and another entity. Appropriation
				balances in each such account may be transferred back to the account or
				accounts from which such appropriations originated as appropriation
				refunds.</text>
								</subsection><subsection id="H9055597850D3424C83234CC43A3277FD"><enum>(b)</enum><header>Recordation of
				transfers</header><text>Transfers made pursuant to subsection (a) shall be
				recorded as expenditure transfers.</text>
								</subsection><subsection id="HBEB210C262A948FAB23C19098180CBE8"><enum>(c)</enum><header>Availability of
				funds</header><text>Funds transferred pursuant to subsection (a) shall remain
				available for the same time period and for the same purpose as the
				appropriation from which transferred, and shall remain subject to the same
				limitations provided in the act making the appropriation.</text>
								</subsection><subsection id="HD2E7277919CD4319B7A63F55C73E8A10"><enum>(d)</enum><header>Obligation and
				expenditure of funds</header><text>Unless otherwise specifically authorized by
				law, funds transferred pursuant to subsection (a) shall only be obligated and
				expended in accordance with chapter 15 of title 31 and all other applicable
				provisions of law.</text>
								</subsection><subsection id="H63BAD9BC9B5449A2B473BC642451988B"><enum>(e)</enum><header>Defense
				intelligence element defined</header><text>In this section, the term
				<quote>Defense intelligence element</quote> means any of the Department of
				Defense agencies, offices, and elements included within the definition of
				<quote>intelligence community</quote> under section 3(4) of the National
				Security Act of 1947 (50 U.S.C.
				401a(4)).</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H0C19C7EE83D14381AACC304565224654"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of subchapter I
			 of such chapter is amended by adding at the end the following new item:</text>

					</subsection></section><section id="H1E7C1F01FDCB40A5BCE3E03B854C1EB9" section-type="subsequent-section"><enum>434.</enum><header>Report on training
			 standards of defense intelligence workforce</header>
					<subsection id="H0FB6670C010F476DA798C08634C3ADB2"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Director of National Intelligence and the Under
			 Secretary of Defense for Intelligence shall submit to the Permanent Select
			 Committee on Intelligence and the Committee on Armed Services of the House of
			 Representatives and the Select Committee on Intelligence and the Committee on
			 Armed Services of the Senate a report on the training standards of the defense
			 intelligence workforce. Such report shall include—</text>
						<paragraph id="HBF428025BC044A459769876AB46A1C67"><enum>(1)</enum><text display-inline="yes-display-inline">a description of existing training,
			 education, and professional development standards applied to personnel of
			 defense intelligence components; and</text>
						</paragraph><paragraph id="H83B1E4059B824FAE9E7ACFD102CBBF79"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the ability to implement a
			 certification program for personnel of the defense intelligence components
			 based on achievement of required training, education, and professional
			 development standards.</text>
						</paragraph></subsection><subsection id="H3D8A8890FC594096A70077FF9A903AF3"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H2374F8951DC24B2BBFCE59E9BD2932A1"><enum>(1)</enum><header>Defense
			 intelligence components</header><text>The term <quote>defense intelligence
			 components</quote> means—</text>
							<subparagraph id="HB93D13E90D1446C0A4EF081011327112"><enum>(A)</enum><text>the National
			 Security Agency;</text>
							</subparagraph><subparagraph id="H0A9F551A667446F9A36C129887949B50"><enum>(B)</enum><text>the Defense
			 Intelligence Agency;</text>
							</subparagraph><subparagraph id="H82B302E116C14327B15740443302186A"><enum>(C)</enum><text>the National
			 Geospatial-Intelligence Agency;</text>
							</subparagraph><subparagraph id="HBCAD1CA45AC74CC9BDC42A182CC56253"><enum>(D)</enum><text>the National
			 Reconnaissance Office;</text>
							</subparagraph><subparagraph id="HC7A65D51E77E458691B1199B27AC3090"><enum>(E)</enum><text>the intelligence
			 elements of the Army, the Navy, the Air Force, and the Marine Corps; and</text>
							</subparagraph><subparagraph id="HBEED38F48B294FC38671F8268D4616B7"><enum>(F)</enum><text>other offices
			 within the Department of Defense for the collection of specialized national
			 intelligence through reconnaissance programs.</text>
							</subparagraph></paragraph><paragraph id="H5FBDC8C03B6F4285864C7A11FD7B0051"><enum>(2)</enum><header>Defense
			 intelligence workforce</header><text>The term <quote>defense intelligence
			 workforce</quote> means the personnel of the defense intelligence
			 components.</text>
						</paragraph></subsection></section></subtitle></title><title id="HEC1046AA8FA94BD1AC058DFE31C83E3C"><enum>V</enum><header>Other
			 matters</header>
			<section id="H45F7335A3D9E4B8EB049F897B77F8119"><enum>501.</enum><header>Report on
			 airspace restrictions for use of unmanned aerial vehicles along the border of
			 the United States and Mexico</header><text display-inline="no-display-inline">Not later than 90 days after the date of the
			 enactment of this Act, the Secretary of Homeland Security shall submit to the
			 congressional intelligence committees, the Committee on Homeland Security of
			 the House of Representatives, and the Committee on Homeland Security and
			 Governmental Affairs of the Senate a report on whether restrictions on the use
			 of airspace are hampering the use of unmanned aerial vehicles by the Department
			 of Homeland Security along the international border between the United States
			 and Mexico.</text>
			</section><section id="H2B1232E515E247709A6CD8AA0B8A1857"><enum>502.</enum><header>Sense of
			 Congress regarding integration of fusion centers</header><text display-inline="no-display-inline">It is the sense of Congress that ten years
			 after the terrorist attacks upon the United States on September 11, 2001, the
			 Secretary of Homeland Security, in consultation with the Director of National
			 Intelligence, should continue to integrate and leverage fusion centers to
			 enlist all of the intelligence, law enforcement, and homeland security
			 capabilities of the United States in a manner that is consistent with the
			 Constitution to prevent acts of terrorism against the United States.</text>
			</section><section id="H85914C257FC2415BBAD46D24E321C043"><enum>503.</enum><header>Strategy to
			 counter improvised explosive devices</header>
				<subsection id="HC12F7C56CBC74466958F02562408243E"><enum>(a)</enum><header>Strategy</header>
					<paragraph id="HE2B4EC1D9E044C3F9838776A7F61DA4C"><enum>(1)</enum><header>Establishment</header><text>The
			 Director of National Intelligence and the Secretary of Defense shall establish
			 a coordinated strategy utilizing all available personnel and assets for
			 intelligence collection and analysis to identify and counter network activity
			 and operations in Pakistan and Afghanistan relating to the development and use
			 of improvised explosive devices.</text>
					</paragraph><paragraph id="HBDFFC038670C45169A8A1C4AEFE81B0C"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The strategy established under paragraph
			 (1) shall identify—</text>
						<subparagraph id="H2B4B0E09562A489FBFE46E99BA8429E0"><enum>(A)</enum><text>the networks that
			 design improvised explosive devices, provide training on improvised explosive
			 device assembly and employment, and smuggle improvised explosive device
			 components into Afghanistan;</text>
						</subparagraph><subparagraph id="H75656CCBC3AE4D3393563769E9331932"><enum>(B)</enum><text>the persons and
			 organizations not directly affiliated with insurgents in Afghanistan who
			 knowingly enable the movement of commercial products and material used in
			 improvised explosive device construction from factories and vendors in Pakistan
			 into Afghanistan;</text>
						</subparagraph><subparagraph id="HF90521AEB3444C13915C33C2E99D540F"><enum>(C)</enum><text>the financiers,
			 financial networks, institutions, and funding streams that provide resources to
			 the insurgency in Afghanistan; and</text>
						</subparagraph><subparagraph id="HD0515BAEFEC841BD8E18AB8C0D579153"><enum>(D)</enum><text>the links to
			 military, intelligence services, and government officials who are complicit in
			 allowing the insurgent networks in Afghanistan to operate.</text>
						</subparagraph></paragraph></subsection><subsection id="H16C648BAB6BE480397A4F9021AF8642C"><enum>(b)</enum><header>Report and
			 implementation</header><text>Not later than 120 days after the date of the
			 enactment of this Act, the Director of National Intelligence and the Secretary
			 of Defense shall—</text>
					<paragraph id="HCA051C4CBABE4A3ABBD01CEC1721CBA0"><enum>(1)</enum><text>submit to the
			 congressional intelligence committees and the Committees on Armed Services of
			 the House of Representatives and the Senate a report containing the strategy
			 established under subsection (a); and</text>
					</paragraph><paragraph id="HA55C664AAF284DB688744E26C9581C7E"><enum>(2)</enum><text>implement such
			 strategy.</text>
					</paragraph></subsection></section><section id="HCB7DBA4687954F30AD8A92CF20A15C21"><enum>504.</enum><header>Sense of
			 Congress regarding the priority of railway transportation
			 security</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="HB8A361C2ED8C4CA69686C248DE1D079C"><enum>(1)</enum><text display-inline="yes-display-inline">the nation’s railway transportation
			 (including subway transit) network is broad and technically complex, requiring
			 robust communication between private sector stakeholders and the intelligence
			 community to identify, monitor, and respond to threats;</text>
				</paragraph><paragraph id="HE29984774D364523A964FBD032852C61"><enum>(2)</enum><text>the Department of
			 Homeland Security Office of Intelligence and Analysis maintains a constructive
			 relationship with other Federal agencies, state and local governments, and
			 private entities to safeguard our railways; and</text>
				</paragraph><paragraph id="HE6CF208276304818BF29B9040411B1EF"><enum>(3)</enum><text>railway
			 transportation security (including subway transit security) should continue to
			 be prioritized in the critical infrastructure threat assessment developed by
			 the Office of Intelligence and Analysis and included in threat assessment
			 budgets of the intelligence community.</text>
				</paragraph></section><section id="H629B962E49CA48D682F49BC88DF65D44"><enum>505.</enum><header>Technical
			 amendments to the National Security Act of 1947</header><text display-inline="no-display-inline">The National Security Act of 1947 (50 U.S.C.
			 401 et seq.) is amended—</text>
				<paragraph id="H102AE69609194CAAA5DE9A207B74FD9A"><enum>(1)</enum><text>in section 3(6)
			 (50 U.S.C. 401a(6)), by striking <quote>Director of Central
			 Intelligence</quote> and inserting <quote>Director of National
			 Intelligence</quote>;</text>
				</paragraph><paragraph id="H602BE8F48FDC4D3AA850CD6673574D1E"><enum>(2)</enum><text>in section 506(b)
			 (50 U.S.C. 415a(b)), by striking <quote>Director of Central
			 Intelligence.</quote> and inserting <quote>Director of National
			 Intelligence.</quote>; and</text>
				</paragraph><paragraph id="HD784C1E43EE24303B0777A2F52B10E9D"><enum>(3)</enum><text>in section
			 506A(c)(2)(C) (50 U.S.C. 415a–1(c)(2)(C), by striking <quote>National Foreign
			 Intelligence Program</quote> both places that term appears and inserting
			 <quote>National Intelligence Program</quote>.</text>
				</paragraph></section><section id="H799107908568430397B7888B915B61E4"><enum>506.</enum><header>Technical
			 amendments to title 18, United States Code</header><text display-inline="no-display-inline">Section 351(a) of title 18, United States
			 Code, is amended—</text>
				<paragraph id="HEA8529C6AE4E43FB8A76FA54832003BF"><enum>(1)</enum><text>by inserting
			 <quote>the Director (or a person nominated to be Director during the pendency
			 of such nomination) or Principal Deputy Director of National
			 Intelligence,</quote> after <quote>in such department,</quote>; and</text>
				</paragraph><paragraph id="H0516DA8652E648C483C59F50E674A5EC"><enum>(2)</enum><text>by striking
			 <quote>Central Intelligence,</quote> and inserting <quote>the Central
			 Intelligence Agency,</quote>.</text>
