		<official-title>To amend title 10, United States Code, to expand the
		  eligibility for concurrent receipt of military retired pay and veterans’
		  disability compensation to include all members of the uniformed services who
		  are retired under chapter 61 of such title for disability, regardless of the
		  members’ disability rating percentage.</official-title>

		<section display-inline="no-display-inline" id="HB2ECD3EEB4864D8A97B7DF0BDABC73AE" section-type="section-one"><enum>1.</enum><header>Expansion of eligibility for
			 concurrent receipt of military retired pay and veterans’ disability
			 compensation to include all chapter 61 disability retirees regardless of
			 disability rating percentage</header>
			<subsection id="HF9DAC6CBFAE74FB3881DA5D4B0EBBA76"><enum>(a)</enum><header>Phased expansion
			 concurrent receipt</header><text>Subsection (a) of section 1414 of title 10,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H52ABC607361344DEB95C464C817A4B47" style="OLC">
					<subsection id="H1F1FACE03AC545DE904DC72A197F8328"><enum>(a)</enum><header>Payment of both
				retired pay and disability compensation</header>
						<paragraph id="H098564617E6E4C9285D29BFC60CCCE6A"><enum>(1)</enum><header>Payment of both
				required</header>
							<subparagraph id="HE09087271D994550AA787AEBFB582633"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to subsection
				(b), a member or former member of the uniformed services who is entitled for
				any month to retired pay and who is also entitled for that month to veterans’
				disability compensation for a qualifying service-connected disability (in this
				section referred to as a <quote>qualified retiree</quote>) is entitled to be
				paid both the retired pay and the veterans’ disability compensation for that
				month without regard to sections 5304 and 5305 of title 38.</text>
							</subparagraph><subparagraph id="H0C361244AB9742A494F283206C31C0C8"><enum>(B)</enum><header>Applicability of
				full concurrent receipt phase-in requirement</header><text display-inline="yes-display-inline">During the period beginning on January 1,
				2004, and ending on December 31, 2013, payment of retired pay to a qualified
				retiree is subject to subsection (c).</text>
							</subparagraph><subparagraph id="HC90AD21AA35246879BE538F17CC39656"><enum>(C)</enum><header>Phase-in
				exception for 100 percent disabled retirees</header><text>The payment of
				retired pay is subject to subsection (c) only during the period beginning on
				January 1, 2004, and ending on December 31, 2004, in the case of the following
				qualified retirees:</text>
								<clause id="H1D2087670244471CB3EE733C5C153DE4"><enum>(i)</enum><text>A
				qualified retiree receiving veterans’ disability compensation for a disability
				rated as 100 percent.</text>
								</clause><clause id="H35C6BFA2F8DE4181906CB025A4CA17A6"><enum>(ii)</enum><text>A
				qualified retiree receiving veterans’ disability compensation at the rate
				payable for a 100 percent disability by reason of a determination of individual
				unemployability.</text>
								</clause></subparagraph><subparagraph id="H4D1EF07491B745CFAB42C275F9909D79"><enum>(D)</enum><header>Phase-in
				exception for certain chapter 61 disability retirees</header><text display-inline="yes-display-inline">Subject to subsection (b), on and after
				January 1, 2012, subsection (c) shall not apply to a qualified retiree who has
				a qualifying service-connected disability described in subparagraph (B) or (C)
				of paragraph (2).</text>
							</subparagraph></paragraph><paragraph id="H0B2366328CFE48A385625F30C060CC7D"><enum>(2)</enum><header>Qualifying
				service-connected disability defined</header><text>In this section, the term
				<quote>qualifying service-connected disability</quote>, with respect to a
				qualified retiree, means the following:</text>
							<subparagraph id="HC16332465B7C481DB4CEDF65504203D7"><enum>(A)</enum><text>In the case of a
				qualified retiree receiving retired pay under any provision of law other than
				chapter 61 of this title, or under chapter 61 with 20 years or more of service
				otherwise creditable under section 1405 or computed under section 12732 of this
				title, a service-connected disability or combination of service-connected
				disabilities that is rated as disabling by the Secretary of Veterans
				Affairs.</text>
							</subparagraph><subparagraph id="H7E397DAD80FB479BB5FBF56668BC6431"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a qualified retiree
				receiving retired pay under chapter 61 of this title with less than 20 years of
				service otherwise creditable under section 1405 or computed under section 12732
				of this title, a service-connected disability or combination of
				service-connected disabilities that is rated by the Secretary of Veterans
				Affairs at the disabling level specified in one of the following clauses (and
				is effective on or after the date specified in the applicable clause):</text>
								<clause id="HA1CF71190E624D1294E2C2AF9A7AC639"><enum>(i)</enum><text>January 1, 2012,
				rated 100 percent, or a rate payable at 100 percent by reason of individual
				unemployability or rated 90 percent.</text>
								</clause><clause id="HA9A69EC528D546F08429A6B4A8E8799C"><enum>(ii)</enum><text>January 1, 2013,
				rated 80 percent or 70 percent.</text>
								</clause><clause id="HA43942F4EEF64A3A977004B803DC342F"><enum>(iii)</enum><text>January 1, 2014,
				rated 60 percent or 50 percent.</text>
								</clause></subparagraph><subparagraph id="H85DE21BF1B9E4FECBFE69D3491FBE767"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a qualified retiree
				receiving retired pay under chapter 61 regardless of years of service, a
				service-connected disability or combination of service-connected disabilities
				that is rated by the Secretary of Veterans Affairs at the disabling level
				specified in one of the following clauses (and is effective on or after the
				date specified in the applicable clause):</text>
								<clause id="HE16E256EF59C44C5BB0580CAA7B56560"><enum>(i)</enum><text>January 1, 2015,
				rated 40 percent or 30 percent.</text>
								</clause><clause id="H350BF6DDD5F942659153CE6EFB9E7003"><enum>(ii)</enum><text>January 1, 2016,
				any
				rating.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HED334086FE614198BE7573B8B1254947"><enum>(b)</enum><header>Conforming
			 amendment to special rules for chapter 61 disability retirees</header><text display-inline="yes-display-inline">Subsection (b) of such section is amended
			 to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H46CF992464CF4C878784D0AA5A4DFB29" style="OLC">
					<subsection id="H964E91BE42D64A11800B5E3F16D2FCA2"><enum>(b)</enum><header>Special rules
				for chapter 61 disability retirees</header>
						<paragraph id="H49C226CE6C4A44B992AFFE79B8F5D9D3"><enum>(1)</enum><header>Career
				retirees</header><text>The retired pay of a member retired under chapter 61 of
				this title with 20 years or more of service otherwise creditable under section
				1405 of this title, or at least 20 years of service computed under section
				12732 of this title, at the time of the member’s retirement, is subject to
				reduction under sections 5304 and 5305 of title 38, but only to the extent that
				the amount of the member’s retired pay under chapter 61 of this title exceeds
				the amount of retired pay to which the member would have been entitled under
				any other provision of law based upon the member’s service in the uniformed
				services if the member had not been retired under chapter 61 of this
				title.</text>
						</paragraph><paragraph id="H141718C6604848B79D4DBA3485CB4436"><enum>(2)</enum><header>Special rule for
				retirees with fewer than 20 years of service</header><text display-inline="yes-display-inline">The retired pay of a member retired under
				chapter 61 of this title with fewer than 20 years of creditable service
				otherwise creditable under section 1405 or computed under section 12732 of this
				title, at the time of the member’s retirement, is subject to reduction under
				sections 5304 and 5305 of title 38, but only to the extent that the amount of
				the member’s retired pay under chapter 61 of this title exceeds the amount
				equal to 2½ percent of the member’s years of creditable service multiplied by
				the member’s retired pay base under section 1406(b)(1) or 1407 of this title,
				whichever is applicable to the
				member.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAB70D7B96F3A4815B85D8B58955B3356"><enum>(c)</enum><header>Full concurrent
			 receipt phase-In</header><text>Subsection (c) of such section is
			 amended—</text>
				<paragraph id="H25A69A3E2244479E9EC34490F8FDF5AD"><enum>(1)</enum><text>by striking
			 <quote>the second sentence of </quote> in the matter preceding paragraph (1);
			 and</text>
				</paragraph><paragraph id="H15DEFD3D686243F781BABF1BC0795339"><enum>(2)</enum><text>in paragraph (1),
			 by adding at the end the following new subparagraph:</text>
					<quoted-block id="H348595A345464B1181D6777646A5E624" style="USC">
						<subparagraph id="HDA9B3376B96F44178F76EF699E9CDD2D"><enum>(G)</enum><text>For a month for
				which the retiree receives veterans’ disability compensation for a disability
				rated as 40 percent or less or has a service-connected disability rated as zero
				percent,
				$0.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA6512C10E57F4920B447BA0B44152FAF"><enum>(d)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H287C9E2DE8F1473899435F5FB49C431A"><enum>(1)</enum><header>Section
			 heading</header><text>The heading of such section is amended to read as
			 follows:</text>

			 such title is amended by striking the item related to section 1414 and
			 inserting the following new item:</text>

				</paragraph></subsection><subsection id="H43B45983BCF34BCE87A4871224CA39DB"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2012.</text>
			</subsection><subsection id="HCAFB90006BCB42079C91E97694E2996D"><enum>(f)</enum><header>Funding
			 Offset</header><text display-inline="yes-display-inline">The Chairman of the
			 Committee on the Budget of the House of Representatives shall provide the
			 necessary adjustments in allocations, aggregates, and other appropriate levels
			 in the concurrent resolution on the budget for fiscal year 2012 to implement
			 this section and the amendments made by this section.</text>
