		<official-title>To direct the Administrator of General Services to
		  establish a small business growth pilot program, and for other
		  purposes.</official-title>

		<section id="HE5C0DEFF0A5F4BCD94B246EBE262D874" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Growth Act</short-title></quote>.</text>
		</section><section id="H3B7E5FE55CAB4771B1D459A50463F206"><enum>2.</enum><header>Small business
			 growth pilot program</header>
			<subsection id="HD8B2665FF70741DF8CA2E27893EAF78A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act, the Administrator of General Services shall establish a
			 small business growth pilot program (in this section referred to as the
			 <quote>program</quote>).</text>
			</subsection><subsection id="H8ADCDF36258B41959D7BD4C2F054342D"><enum>(b)</enum><header>Restricted
			 competition for certain contracts</header><text>Under the program, a
			 contracting officer for the General Services Administration may award a
			 contract on the basis of competition restricted to program participants
			 determined eligible under subsection (c) if—</text>
				<paragraph id="H75942FA40DA342D883E32ED876855F9C"><enum>(1)</enum><text display-inline="yes-display-inline">the anticipated award price of the contract
			 (including options) is reasonably expected to exceed the simplified acquisition
			 threshold;</text>
				</paragraph><paragraph id="HC4C557E3F0A644D4B22E6AF427F28FC8"><enum>(2)</enum><text>the Administrator
			 determines that, if the contract were not awarded under the program, the
			 contract would likely be awarded to an entity other than a small business
			 concern;</text>
				</paragraph><paragraph id="HCCE8266FE11A4E88AFAD6E29F091D559"><enum>(3)</enum><text>there is a
			 reasonable expectation that at least 2 program participants determined eligible
			 under subsection (c) will submit offers with respect to the contract;
			 and</text>
				</paragraph><paragraph id="H9DBE6814DDA74107BAF6ACAE989DC33D"><enum>(4)</enum><text>the contract award
			 can be made at a fair market price.</text>
				</paragraph></subsection><subsection id="H519E51143090442C860D88DA414CDB10"><enum>(c)</enum><header>Program
			 participant eligibility</header><text display-inline="yes-display-inline">The
			 Administrator shall determine an entity to be a participant in the program and
			 eligible to be awarded a contract under subsection (b) if the entity—</text>
				<paragraph id="H8F9CC03AB52F44BA91DBBCAB26E4DBF8"><enum>(1)</enum><text>is enrolling as a
			 mentor in or is participating as a mentor in the Mentor-Protege Program of the
			 Administration related to contracting;</text>
				</paragraph><paragraph id="H4027E667B5F64581846B2FEDEB58EE0C"><enum>(2)</enum><text>if participating
			 as a mentor in the Mentor-Protege Program, has at least one protege that is a
			 small business concern under that program;</text>
				</paragraph><paragraph id="HC0E5571EF0B64DA4AFC80D054652EB0F"><enum>(3)</enum><text>has fewer than
			 1,500 employees; and</text>
				</paragraph><paragraph id="HD7EC1F7193F34B1BA56E6E68698DBD74"><enum>(4)</enum><text>is not a small
			 business concern.</text>
				</paragraph></subsection><subsection id="HB9E5A5ECED9C49EEABEE521436D52D14"><enum>(d)</enum><header>Consideration
			 required</header>
				<paragraph id="HF989B1B4AF194000BE762CDC7D1C9865"><enum>(1)</enum><header>In
			 general</header><text>A contracting officer for the Administration shall
			 consider awarding a contract under subsection (b) before awarding that contract
			 on the basis of full and open competition.</text>
				</paragraph><paragraph id="H50AF70ADA8EE42F89E82776C94E01EE0"><enum>(2)</enum><header>Report to
			 Administrator</header><text>At the request of the Administrator, a contracting
			 officer shall submit to the Administrator a report on the reasons a contract
			 was or was not awarded on the basis of competition restricted to program
			 participants determined eligible under subsection (c).</text>
				</paragraph></subsection><subsection id="H4998442814E347E39AFF9BED272EF45B"><enum>(e)</enum><header>Notice to the
			 public</header><text>With respect to a contract opportunity determined to meet
			 the criteria specified in paragraphs (1) through (4) of subsection (b), a
			 contracting officer for the Administration may provide notice of the contract
			 opportunity on the Web site of the Administration and on any other appropriate
			 Federal Web site relating to contracting. The contracting officer shall ensure
			 that the notice includes the eligibility requirements specified in subsection
			 (c).</text>
			</subsection><subsection id="HB58EAB4C9A054107BA32775C8450B017"><enum>(f)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than one
			 year after the date on which the program is established, and annually
			 thereafter, the Administrator shall submit to Congress a report on the program,
			 which shall include the number of contracts awarded in the prior year on the
			 basis of competition restricted to program participants determined eligible
			 under subsection (c), the value of the contracts, a description of the work
			 carried out under the contracts, and the number of program participants
			 determined eligible under subsection (c).</text>
			</subsection><subsection id="H189D4E97AC4443EE833CB6E9FDD48E17"><enum>(g)</enum><header>Termination</header><text>The
			 program shall terminate on the date that is 5 years after the date on which the
			 program is established.</text>
			</subsection><subsection id="H51712461EACC4C5D9583D4DDB757E02E"><enum>(h)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H8A388A8C52544F73B049B39A1EA2891B"><enum>(1)</enum><header>Contracting
			 officer</header><text display-inline="yes-display-inline">The term
			 <term>contracting officer</term> has the meaning given that term in section
			 2101(1) of title 41, United States Code.</text>
				</paragraph><paragraph id="HF81DB0582DEE40D3A575946057038E85"><enum>(2)</enum><header>Full and open
			 competition</header><text>The term <term>full and open competition</term> has
			 the meaning given that term in section 107 of title 41, United States
			 Code.</text>
				</paragraph><paragraph id="H38EDDE1FC3594869B41E928B751C5BCA"><enum>(3)</enum><header>Simplified
			 acquisition threshold</header><text display-inline="yes-display-inline">The
			 term <term>simplified acquisition threshold</term> has the meaning given that
			 term in section 134 of title 41, United States Code.</text>
				</paragraph><paragraph id="HDEC3EB8A55054DB79BDA047DC2AC57A3"><enum>(4)</enum><header>Small business
			 concern</header><text display-inline="yes-display-inline">The term <term>small
			 business concern</term> has the meaning given that term in section 3(a) of the
			 Small Business Act (15 U.S.C. 632(a)).</text>
				</paragraph></subsection></section></legis-body>
