		<official-title>To amend the Energy Policy Act of 2005 to require the
		  Secretary of Energy to carry out programs to develop and demonstrate 2 small
		  modular nuclear reactor designs, and for other purposes.</official-title>

		<section id="H4333108D68D04F9C99D83486241BB0C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nuclear Power 2021
			 Act</short-title></quote>.</text>
		</section><section id="H7DE893838D3C452EA0D43985210038A9"><enum>2.</enum><header>Nuclear power
			 2021 initiative</header><text display-inline="no-display-inline">Section 952 of
			 the Energy Policy Act of 2005 (42 U.S.C. 16272) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H7E322841D2874001A4A140A8B4CE2FBE" style="OLC">
				<subsection id="HCF543F72D2D34E2EA83B7E72281D68A9"><enum>(f)</enum><header>Nuclear power
				2021 initiative</header>
					<paragraph id="H94BFCD2FF33C4A5AAB98F681D0F432B1"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="H0D6211334F4F4FE8B2544997BD4AFB97"><enum>(A)</enum><header>Combined
				license</header><text>The term <term>combined license</term> has the meaning
				given the term in section 52.1 of title 10, Code of Federal Regulations (or a
				successor regulation).</text>
						</subparagraph><subparagraph id="HC8B34BE0C98240B0A3D4BFE6EC3C1522"><enum>(B)</enum><header>Design
				certification</header><text>The term <term>design certification</term> has the
				meaning given the term in section 52.1 of title 10, Code of Federal Regulations
				(or a successor regulation).</text>
						</subparagraph><subparagraph id="HA92C21971EDC4A139E26967CDDE50608"><enum>(C)</enum><header>Small modular
				reactor</header><text>The term <term>small modular reactor</term> means a
				nuclear reactor—</text>
							<clause id="H4B912E05A56E4159888CC8D9B3FA3BAA"><enum>(i)</enum><text>with a rated
				capacity of less than 300 electrical megawatts; and</text>
							</clause><clause id="H5FA54ED67CBE4C7DA282E8F593938EC6"><enum>(ii)</enum><text>that can be
				constructed and operated in combination with similar reactors at a single
				site.</text>
							</clause></subparagraph></paragraph><paragraph id="H76993833A92E4C3CA364BB0D804DD835"><enum>(2)</enum><header>Duty of
				Secretary</header><text>The Secretary shall carry out, through cooperative
				agreements with private sector partners—</text>
						<subparagraph id="H8B0020243E514404BCA96BEAF4B3CBA4"><enum>(A)</enum><text>a program—</text>
							<clause id="HBDF7255EEB0D4A64A1050CFA462917DD"><enum>(i)</enum><text>to
				develop a standard design for each of 2 small modular reactors; and</text>
							</clause><clause id="H5A39E5ED7DCB4BC1BBFE04E936887DA0"><enum>(ii)</enum><text>to obtain a
				design certification from the Nuclear Regulatory Commission for each of the
				standard designs by January 1, 2018; and</text>
							</clause></subparagraph><subparagraph id="HFCEE1B5A646C471794DA299218A70334"><enum>(B)</enum><text>a program to
				demonstrate the licensing of small modular reactors by—</text>
							<clause id="H01303B10FFD64A568993ACFD2CCA6124"><enum>(i)</enum><text>developing
				applications for a combined license for each of the designs certified pursuant
				to subparagraph (A); and</text>
							</clause><clause id="H1F93C2AD5F4649FB80CF8E0F1E986AC4"><enum>(ii)</enum><text>obtaining a
				combined license from the Nuclear Regulatory Commission for each of the designs
				by January 1, 2021.</text>
							</clause></subparagraph></paragraph><paragraph id="HEAA17C4F05B34E3EA288187E04D47279"><enum>(3)</enum><header>Merit review of
				proposals</header><text>The Secretary shall select proposals for cooperative
				agreements under this subsection—</text>
						<subparagraph id="H1C557AFE993F42FA85F8E7DB17904020"><enum>(A)</enum><text>on the basis of an
				impartial review of the scientific and technical merit of the proposals;
				and</text>
						</subparagraph><subparagraph id="H95D39F13285A4DE7BD514075D2542A66"><enum>(B)</enum><text>through the use of
				competitive procedures.</text>
						</subparagraph></paragraph><paragraph id="H9035A0B635134BD5BEEBB8196263E204"><enum>(4)</enum><header>Technical
				considerations</header><text>In evaluating proposals, the Secretary shall take
				into account the efficiency, cost, safety, and proliferation resistance of
				competing reactor designs.</text>
					</paragraph><paragraph id="HE2E00C9846AC4E47A765B1FE54D88278"><enum>(5)</enum><header>Cost-share
				requirements</header>
						<subparagraph id="H15D0BB805E1A4077B5C7DF7516820193"><enum>(A)</enum><header>Design
				development</header><text>Notwithstanding section 988, the Secretary shall
				require that not less than 50 percent of the cost of the development of each
				small modular reactor design under paragraph (2)(A) be provided by a
				non-Federal source.</text>
						</subparagraph><subparagraph id="HC1A7A39BD4554CE7A8A50C6B51F638E1"><enum>(B)</enum><header>Licensing
				demonstration</header><text>Notwithstanding section 988, the Secretary shall
				require that not less than 75 percent of the cost of the licensing
				demonstration of each small modular reactor design under paragraph (2)(B) be
				provided by a non-Federal source.</text>
						</subparagraph><subparagraph id="H75A641AB1B024A2AB74571D5198CEB54"><enum>(C)</enum><header>Calculation of
				amount</header><text>Non-Federal contributions under this subsection shall be
				calculated in accordance with section
				988(d).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
