		<section display-inline="no-display-inline" id="HA8442670FDE94AA9ADE41C93C5808359" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Up Government Act of
			 2011</short-title></quote>.</text>
		</section><section id="H0FF8CEAC18FB4FCC972F3D297885A48E"><enum>2.</enum><header>Application of
			 mail and wire fraud statutes to licences and other intangible
			 rights</header><text display-inline="no-display-inline">Sections 1341 and 1343
			 of title 18, United States Code, are each amended by striking <quote>money or
			 property</quote> and inserting <quote>money, property, or any other thing of
			 value</quote>.</text>
		</section><section id="H62F40A7F2D5F4C7C96E0E8CC1047E363"><enum>3.</enum><header>Venue for Federal
			 offenses</header><text display-inline="no-display-inline">Section 3237(a) of
			 title 18, United States Code, is amended by inserting after <quote>begun,
			 continued, or completed</quote> the following: <quote>or in any district in
			 which an act in furtherance of an offense is committed</quote>.</text>
		</section><section id="H89F218F4C7C14E68875AFBA5F7119396"><enum>4.</enum><header>Theft or bribery
			 concerning programs receiving Federal financial assistance</header><text display-inline="no-display-inline">Section 666(a) of title 18, United States
			 Code, is amended by striking <quote>10 years</quote> and inserting <quote>20
			 years</quote>.</text>
		</section><section id="H6BB9237D74044862B3546D9FD5239FD7"><enum>5.</enum><header>Penalty for
			 section 641 violations</header><text display-inline="no-display-inline">Section
			 641 of title 18, United States Code, is amended by striking <quote>ten
			 years</quote> and inserting <quote>20 years</quote>.</text>
		</section><section id="H8A66656F00EC47E4A2FCB2C5BBDB7577"><enum>6.</enum><header>Bribery and
			 graft</header><text display-inline="no-display-inline">Section 201 of title 18,
			 United States Code, is amended—</text>
			<paragraph id="H2F4F8320FA6246FBB8893A603104D4D5"><enum>(1)</enum><text>in subsection (b),
			 by striking <quote>fifteen years</quote> and inserting <quote>20 years</quote>;
			 and</text>
			</paragraph><paragraph id="H24EC361156234AC48F99F8E227853246"><enum>(2)</enum><text>in subsection (c),
			 by striking <quote>two years</quote> and inserting <quote>five
			 years</quote>.</text>
			</paragraph></section><section id="H2012460B0FE341E6B92A8DF4EB660CB0"><enum>7.</enum><header>Addition of
			 District of Columbia to theft of public money offense</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code,
			 is amended by inserting <quote>the District of Columbia or</quote> before
			 <quote>the United States</quote> each place such term appears.</text>
		</section><section id="HDE3EB0CF88494EF0AAAC7B7A0F8FC30F"><enum>8.</enum><header>Clarification of
			 crime of illegal gratuities</header><text display-inline="no-display-inline">Subparagraphs (A) and (B) of section
			 201(c)(1) of title 18, United States Code, are each amended by inserting
			 <quote>the official’s or person’s official position or</quote> before
			 <quote>any official act</quote>.</text>
		</section><section id="HD7C6E7AC1D4B4E3C8B95C601DDD419F4"><enum>9.</enum><header>Clarification of
			 definition of <quote>official act</quote></header><text display-inline="no-display-inline">Section 201(a)(3) of title 18, United States
			 Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H110C0C424A57445DB4AEF3D6592F8C08" style="USC">
				<paragraph id="HF92D631684554665A8A93F98C2B37E9A"><enum>(3)</enum><text>the term
				<term>official act</term>—</text>
					<subparagraph id="H5C48B0E728934E0E92A7D8126225A2ED"><enum>(A)</enum><text>includes any act
				within the range of official duty, and any decision, recommendation, or action
				on any question, matter, cause, suit, proceeding, or controversy, which may at
				any time be pending, or which may by law be brought before any public official,
				in such public official’s official capacity or in such official’s place of
				trust or profit;</text>
					</subparagraph><subparagraph id="H8F47F5850D2A45D98F34C198A8FEAC9B"><enum>(B)</enum><text>may be a single
				act, more than one act, or a course of conduct; and</text>
					</subparagraph><subparagraph id="HA652FEF541674C8085FD52490BA8DABC"><enum>(C)</enum><text>includes a
				decision or recommendation that a government should not take
				action.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE54A66EE876044D0B95FB8CEAAF1CE51"><enum>10.</enum><header>Amendment of the
			 sentencing guidelines relating to certain crimes</header>
			<subsection id="H1078339991A14C5DAD4F1637EF365454"><enum>(a)</enum><header>Directive to
			 Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section
			 994(p) of title 28, United States Code, and in accordance with this section,
			 the United States Sentencing Commission forthwith shall review and amend its
			 guidelines and its policy statements applicable to persons convicted of an
			 offense under section 201, 641, 666, 1951, 1952, or 1962 of title 18, United
			 States Code in order to reflect the intent of Congress that such penalties be
			 increased in comparison to those currently provided by guidelines and policy
			 statements.</text>
			</subsection><subsection id="H34CD7092D14B43C68EEC264ED4CF7A87"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this subsection, the
			 Commission shall—</text>
				<paragraph id="H48B06A26D2754D62A89E28416592C989"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect Congress’s intent that the guidelines and policy
			 statements reflect the serious nature of the offenses described in paragraph
			 (1), the growing incidence of such offenses, and the need for an effective
			 deterrent and appropriate punishment to prevent such offenses;</text>
				</paragraph><paragraph id="H87A008A43FDB45DAAA2AAE4847F822FC"><enum>(2)</enum><text display-inline="yes-display-inline">consider the extent to which the guidelines
			 may or may not appropriately account for—</text>
					<subparagraph id="HD5394383D661433EA0F10E51D3CB2465"><enum>(A)</enum><text>the potential and
			 actual harm to the public and the amount of any loss resulting from the
			 offense;</text>
					</subparagraph><subparagraph id="H4EEEBBDA0CF94DD7AC99BFB17D734FAA"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
					</subparagraph><subparagraph id="H8624EE1830FB401BB4DFBF7591D59AE1"><enum>(C)</enum><text>whether the
			 offense was committed for purposes of commercial advantage or private financial
			 benefit;</text>
					</subparagraph><subparagraph id="HC40F24357FC347888BC137D26F310499"><enum>(D)</enum><text>whether the
			 defendant acted with intent to cause either physical or property harm in
			 committing the offense;</text>
					</subparagraph><subparagraph id="H2295E832F2C547B7BA914E6E58257ECD"><enum>(E)</enum><text>the extent to
			 which the offense represented an abuse of trust by the offender and was
			 committed in a manner that undermined public confidence in the Federal, State
			 or local government; and</text>
					</subparagraph><subparagraph id="H0DAD822F47644F9C8AFB5BA3897304F2"><enum>(F)</enum><text>whether the
			 violation was intended to or had the effect of creating a threat to public
			 health or safety, injury to any person or even death;</text>
					</subparagraph></paragraph><paragraph id="HB967D16CDC9342EEBC18538E43CF7E38"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="H90ABDBDC976C4796A7DDD7BAA0F9E317"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="H22A07BBC34CA461EAD84659C0476E803"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
				</paragraph><paragraph id="HD7FDD91D01DC470A86EB0804CFFBF16A"><enum>(6)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection></section><section id="H9C1719C8E28A4AA482C47AC9A8C91B90"><enum>11.</enum><header>Extension of
			 statute of limitations for serious public corruption offenses</header>
			<subsection id="H3D4FBD411D2340D5B500D9D401F6AF49"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">Chapter 213</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D6530838B58465A9180D53670D00E8F" style="USC">
					<section id="HFAAF9AFA8A584A8F85012F51C3581726"><enum>3302.</enum><header>Corruption
				offenses</header><text display-inline="no-display-inline">Unless an indictment
				is returned or the information is filed against a person within 10 years after
				the commission of the offense, a person may not be prosecuted, tried, or
				punished for a violation of, or a conspiracy or an attempt to violate the
				offense in—</text>
						<paragraph id="H9D9BB7855B3D4FFCB2564C89556F5270"><enum>(1)</enum><text>section 201 or
				666;</text>
						</paragraph><paragraph id="HCD1B6955699141AB820E54CF9B4BDC15"><enum>(2)</enum><text>section 1341 or
				1343, when charged in conjunction with section 1346 and where the offense
				involves a scheme or artifice to deprive another of the intangible right of
				honest services of a public official;</text>
						</paragraph><paragraph id="HD20E2825048449C28F6BBAC6046222F5"><enum>(3)</enum><text>section 1951, if
				the offense involves extortion under color of official right;</text>
						</paragraph><paragraph id="H4AFCFA0010264EB4BBA3F001EE4AA695"><enum>(4)</enum><text>section 1952, to
				the extent that the unlawful activity involves bribery; or</text>
						</paragraph><paragraph id="H85189AA60A0946EB8FC098AB91C5748D"><enum>(5)</enum><text>section 1962, to
				the extent that the racketeering activity involves bribery chargeable under
				State law, involves a violation of section 201 or 666, section 1341 or 1343,
				when charged in conjunction with section 1346 and where the offense involves a
				scheme or artifice to deprive another of the intangible right of honest
				services of a public official, or section 1951, if the offense involves
				extortion under color of official
				right.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9DFC75B775AC4C9EA0EFBE1CC0886E2A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 213
			 of title 18, United States Code, is amended by adding at the end the following
			 new item:</text>

			 United States Code, is amended by striking <quote>3 years</quote> and inserting
			 <quote>10 years</quote>.</text>
			</subsection><subsection id="H9B51D47DB9304B2FBEF9D50A5B40FD2A"><enum>(b)</enum><header>Promise of
			 employment for political activity</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/600">Section 600</external-xref> of title 18, United

				self-dealing by public officials</header>
						<subsection id="H5EA485615344480C9A32B668A4BA893C"><enum>(a)</enum><header>Undisclosed
				self-Dealing by public officials</header><text>For purposes of this chapter,
				the term <term>scheme or artifice to defraud</term> also includes a scheme or
				artifice by a public official to engage in undisclosed self-dealing.</text>
						</subsection><subsection id="H84C8E367C7B44606AB6E4555AF87E6CA"><enum>(b)</enum><header>Definitions</header><text>As
				used in this section:</text>
							<paragraph id="H0A650A092B4C450D91687CFDA0B97439"><enum>(1)</enum><header>Official
				act</header><text>The term <term>official act</term>—</text>
								<subparagraph id="H510D29EEC08A4632AE99CC83FF475A6C"><enum>(A)</enum><text>includes any act
				within the range of official duty, and any decision, recommendation, or action
				on any question, matter, cause, suit, proceeding, or controversy, which may at
				any time be pending, or which may by law be brought before any public official,
				in such public official’s official capacity or in such official’s place of
				trust or profit;</text>
								</subparagraph><subparagraph id="H9CD33D25C7A448E68616CCFD8805A46E"><enum>(B)</enum><text>may be a single
				act, more than one act, or a course of conduct; and</text>
								</subparagraph><subparagraph id="H77F7850B3C604230B2F3D278201111CA"><enum>(C)</enum><text>includes a
				decision or recommendation that a government should not take action.</text>
								</subparagraph></paragraph><paragraph id="HFFF6403D3D69488F9E271E50CAD02E3B"><enum>(2)</enum><header>Public
				official</header><text display-inline="yes-display-inline">The term
				<term>public official</term> means an officer, employee, or elected or
				appointed representative, or person acting for or on behalf of the United
				States, a State, or a subdivision of a State, or any department, agency or
				branch of government thereof, in any official function, under or by authority
				of any such department, agency, or branch of government.</text>
							</paragraph><paragraph id="H2ED940FD2CAB4DA7A722207CD0E9AD91"><enum>(3)</enum><header>State</header><text>The
				term <term>State</term> includes a State of the United States, the District of
				Columbia, and any commonwealth, territory, or possession of the United
				States.</text>
							</paragraph><paragraph id="H5CCF8B8F73194D54B82638FEE3CD2325"><enum>(4)</enum><header>Undisclosed
				self-dealing</header><text>The term <term>undisclosed self-dealing</term> means
				that—</text>
								<subparagraph id="H4502E9BAB44B43EA95F4485F4534BBC5"><enum>(A)</enum><text>a public official
				performs an official act for the purpose, in whole or in part, of benefitting
				or furthering a financial interest of—</text>
									<clause id="H2755F5FD91A74543BFAEF32B9B3B506A"><enum>(i)</enum><text>the public
				official;</text>
									</clause><clause id="H59635B3F19F447CFB8942BCDAC6610C9"><enum>(ii)</enum><text>the spouse or
				minor child of a public official;</text>
									</clause><clause id="HAF78A5441070467C926CDF552DA9CA6F"><enum>(iii)</enum><text>a general
				business partner of the public official;</text>
									</clause><clause id="HCFB304021A364499B758EFDDA476B18D"><enum>(iv)</enum><text>a
				business or organization in which the public official is serving as an
				employee, officer, director, trustee, or general partner; or</text>
									</clause><clause id="HFEF783F702B943CB9F568A5109A982A5"><enum>(v)</enum><text>an
				individual, business, or organization with whom the public official is
				negotiating for, or has any arrangement concerning, prospective employment or
				financial compensation; and</text>
									</clause></subparagraph><subparagraph id="HAF0E06D32A054B60A4F31C019BCB231D"><enum>(B)</enum><text display-inline="yes-display-inline">the public official knowingly falsifies,
				conceals, or covers up material information that is required to be disclosed
				regarding that financial interest by any Federal, State, or local statute,
				rule, regulation, or charter applicable to the public official, or knowingly
				fails to disclose material information regarding that financial interest in a
				manner that is required by any Federal, State, or local statute, rule,
				regulation, or charter applicable to the public
				official.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBF5A84714B2B4ED09FF1A3AEED32D867"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 63 of title 18,
			 United States Code, is amended by inserting after the item relating to section
			 1346 the following new item:</text>

			 amendments made by this section apply to acts engaged in on or after the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="H63CCC9AEACAB40DEB52A0FD340358755"><enum>17.</enum><header>Disclosure of
			 information in complaints against judges</header><text display-inline="no-display-inline">Section 360(a) of title 28, United States
			 Code, is amended—</text>
			<paragraph id="H23B367F199EF444899468CA1F2E2BC34"><enum>(1)</enum><text>in paragraph (2)
			 by striking “or”;</text>
			</paragraph><paragraph id="H5EFB28FB631249C39009E669644B83DA"><enum>(2)</enum><text>in paragraph (3),
			 by striking the period at the end, and inserting “; or”; and</text>
			</paragraph><paragraph id="HCAA5F06B0A6D4E9F81E92E1B27DB8DB8"><enum>(3)</enum><text>by inserting after
			 paragraph (3) the following:</text>

			 exemption in certain bribery offenses</header><text display-inline="no-display-inline">Section 666(c) of title 18, United States
			 Code, is amended—</text>
			<paragraph id="H33C775A5D92F4F4CA379D666F2ED7996"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>This section does not
			 apply to</quote>; and</text>
			</paragraph><paragraph id="H95D22F01C6954B55A090EFE7CE57C2D1"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>This subsection shall
			 apply to the giving or receiving of <quote>anything of value</quote> that is
			 corruptly solicited, demanded, accepted or agreed to be accepted in subsection
			 (a)(1)(B) and corruptly given, offered, or agreed to be given in subsection
			 (a)(2) shall not include</quote>, before the words <quote>bona fide
			 salary</quote>.</text>
			</paragraph></section><section commented="no" id="H867E8F5EC7144A33A18B13057D1E577F"><enum>19.</enum><header>Certifications
			 regarding appeals by United States</header><text display-inline="no-display-inline">Section 3731 of title 18, United States
			 Code, is amended by inserting after <quote>United States attorney</quote> the
			 following: <quote>, Deputy Attorney General, Assistant Attorney General, or the
			 Attorney General</quote>.</text>
