		<official-title>To amend title 10, United States Code, to repeal the
		  requirement for reduction of survivor annuities under the Survivor Benefit Plan
		  for military surviving spouses to offset the receipt of veterans dependency and
		  indemnity compensation.</official-title>

		<section id="HB87A4C3C39AF42BAAA8875BA0BD4E5E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Surviving Spouses Equity
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H554370756A5949028B7F561F2D0A5542"><enum>2.</enum><header>Repeal of
			 requirement of reduction of SBP survivor annuities by dependency and indemnity
			 compensation</header>
			<subsection id="HE365F02FA39E4CDA9AB34D85EABBA74D"><enum>(a)</enum><header>Repeal</header>
				<paragraph id="H0332E4C9EC5C4C749FE6BA8DF049F2A3"><enum>(1)</enum><header>Repeal</header><text>Subchapter
			 II of chapter 73 of title 10, United States Code, is amended as follows:</text>
					<subparagraph id="HE55D08B93040404AB5C65B7D54641962"><enum>(A)</enum><text>In section 1450,
			 by striking subsection (c).</text>
					</subparagraph><subparagraph id="H9DFDBB72286D4051A919E93B545F3244"><enum>(B)</enum><text>In section
			 1451(c)—</text>
						<clause id="HADAD6D94B9CF4AD4A5298F673AC2EDE3"><enum>(i)</enum><text>by
			 striking paragraph (2); and</text>
						</clause><clause id="H0D5DC1672F4D43ED9004DF3CA01E96DA"><enum>(ii)</enum><text>by
			 redesignating paragraphs (3) and (4) as paragraphs (2) and (3),
			 respectively.</text>
						</clause></subparagraph></paragraph><paragraph id="H328CB21A0189488D8F7FED8D378CA6C4"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Such subchapter is further amended as follows:</text>
					<subparagraph id="H8C3AAEF51F3B414C8EF4681676F156B1"><enum>(A)</enum><text>In section
			 1450—</text>
						<clause id="H168E0747B1CA440C9A42BD5BC235F236"><enum>(i)</enum><text>by
			 striking subsection (e); and</text>
						</clause><clause id="H5224AD874683448BB483680A4CA455AB"><enum>(ii)</enum><text>by
			 striking subsection (k).</text>
						</clause></subparagraph><subparagraph id="H612F0683F97A4402922B8322C4E18358"><enum>(B)</enum><text>In section
			 1451(g)(1), by striking subparagraph (C).</text>
					</subparagraph><subparagraph id="HD50AD997E21543308AEC400449EEB0A2"><enum>(C)</enum><text>In section
			 1452—</text>
						<clause id="H7AB8735310794B5FBC243F2F6DE5A2B5"><enum>(i)</enum><text>in
			 subsection (f)(2), by striking <quote>does not apply—</quote> and all that
			 follows and inserting <quote>does not apply in the case of a deduction made
			 through administrative error.</quote>; and</text>
						</clause><clause id="HF3729250CBD94414BB18DA575830CCA0"><enum>(ii)</enum><text>by
			 striking subsection (g).</text>
						</clause></subparagraph><subparagraph id="H36FA9E21773C43C0AE065B6F31D1DDA9"><enum>(D)</enum><text>In section
			 1455(c), by striking <quote>, 1450(k)(2),</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HB66A53CA63624F8FA051BF41701480C6"><enum>(b)</enum><header>Prohibition on
			 Retroactive Benefits</header><text>No benefits may be paid to any person for
			 any period before the effective date provided under subsection (f) by reason of
			 the amendments made by subsection (a).</text>
			</subsection><subsection id="H7BE5B455CF454188A29B5C229466C79A"><enum>(c)</enum><header>Prohibition on
			 recoupment of certain amounts previously refunded to SBP
			 recipients</header><text>A surviving spouse who is or has been in receipt of an
			 annuity under the Survivor Benefit Plan under subchapter II of chapter 73 of
			 title 10, United States Code, that is in effect before the effective date
			 provided under subsection (f) and that is adjusted by reason of the amendments
			 made by subsection (a) and who has received a refund of retired pay under
			 section 1450(e) of title 10, United States Code, shall not be required to repay
			 such refund to the United States.</text>
			</subsection><subsection id="H9EF93110B84845BBB40C1E52D05FF394"><enum>(d)</enum><header>Repeal of
			 authority for optional annuity for dependent children</header><text>Section
			 1448(d)(2) of such title is amended—</text>
				<paragraph id="H393AE1F01068496A9D631D26215213E1"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="paragraph" style="OLC">Dependent
			 children</header-in-text>.—</quote> and all that follows through <quote>In the
			 case of a member described in paragraph (1),</quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">Dependent
			 children</header-in-text>.—In the case of a member described in paragraph
			 (1),</quote>; and</text>
				</paragraph><paragraph id="H30D7EC757C904DF8992B3BC4A285B8DC"><enum>(2)</enum><text>by striking
			 subparagraph (B).</text>
				</paragraph></subsection><subsection id="HB9D0F18265D246CEB511081E9E974444"><enum>(e)</enum><header>Restoration of
			 eligibility for previously eligible spouses</header><text>The Secretary of the
			 military department concerned shall restore annuity eligibility to any eligible
			 surviving spouse who, in consultation with the Secretary, previously elected to
			 transfer payment of such annuity to a surviving child or children under the
			 provisions of section 1448(d)(2)(B) of title 10, United States Code, as in
			 effect on the day before the effective date provided under subsection (f). Such
			 eligibility shall be restored whether or not payment to such child or children
			 subsequently was terminated due to loss of dependent status or death. For the
			 purposes of this subsection, an eligible spouse includes a spouse who was
			 previously eligible for payment of such annuity and is not remarried, or
			 remarried after having attained age 55, or whose second or subsequent marriage
			 has been terminated by death, divorce or annulment.</text>
			</subsection><subsection id="HD463CC2217FB417BA1DDC031C8D988E6"><enum>(f)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">This section and the
			 amendments made by this section shall take effect on the later of—</text>
				<paragraph id="H9C5FFE06A3E843208A89A83C9B019771"><enum>(1)</enum><text>October 1, 2011;
			 or</text>
				</paragraph><paragraph id="H61FC779050724B4398B15D8FE4129B02"><enum>(2)</enum><text>the first day of
			 the first month that begins after the date of the enactment of this Act;</text>
				</paragraph></subsection></section></legis-body>
