			 <quote><short-title>National Oilheat Research Alliance
			 Reauthorization Act of 2011</short-title></quote>.</text>
		</section><section id="HB793EF910683456CAA7F25516A4F82E0"><enum>2.</enum><header>Amendments</header>
			<subsection id="H579F1A9F049C42BABC37E57AE8F282A5"><enum>(a)</enum><header>Findings</header><text>Section
			 702 of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note;
			 Public Law 106–469) is amended by striking <quote>oilheat</quote> each place it
			 appears and inserting <quote>oilheat fuel</quote>.</text>
			</subsection><subsection id="H96723E4F11B94F4FBE2F64CD2B2BFC01"><enum>(b)</enum><header>Definitions</header><text>Section
			 703 of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note;
			 Public Law 106–469) is amended—</text>
				<paragraph id="H29A0CB21FBAC440F8D1DB42D1B043A77"><enum>(1)</enum><text>by striking
			 <quote>oilheat</quote> each place it appears (other than paragraph (10)) and
			 inserting <quote>oilheat fuel</quote>;</text>
				</paragraph><paragraph id="HBFBFB0120F5C4C1E92703938BC5392F3"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>,
			 including information on energy conservation strategies, safety, new
			 technologies that reduce consumption or improve safety, and State, local, or
			 Federal programs designed to assist oilheat fuel consumers</quote> after
			 <quote>hot water heating fuels</quote>;</text>
				</paragraph><paragraph id="H382C203AD0B74EFBA42500E45B302815"><enum>(3)</enum><text>by striking
			 paragraph (7) and inserting the following:</text>

								<clause id="H2B6E5199DF22486696923F3CB404F8C8"><enum>(i)</enum><text>No. 1
				distillate;</text>
								</clause><clause id="HA724ABEE00A14D3FA9023C1FE79DB085"><enum>(ii)</enum><text>No. 2 dyed
				distillate;</text>
								</clause><clause id="HBDBD38B812C442F490C3030C6CFA271A"><enum>(iii)</enum><text>a liquid blended
				with No. 1 distillate or No. 2 dyed distillate; or</text>
								</clause><clause id="HD59CEC7238094D43B2268AE66284ADB0"><enum>(iv)</enum><text>a
				biobased liquid; and</text>
								</clause></subparagraph><subparagraph id="H2F23B26473944541BAA220E874CD9CFC"><enum>(B)</enum><text>is used as a fuel
				for nonindustrial commercial or residential space or hot water
				heating.</text>
							</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3DE7B107CC574A3F9AA9C18B969601DB"><enum>(4)</enum><text>in the heading for

			 <quote>oilheat</quote> each place it appears and inserting <quote>oilheat
			 fuel</quote>;</text>
				</paragraph><paragraph id="HB39A170920504773B5D09176C22DD93B"><enum>(2)</enum><text>in subsection
			 (b)(2), by striking <quote>No. 1 distillate and No. 2 dyed distillate</quote>
			 and inserting <quote>oilheat fuel</quote>; and</text>
				</paragraph><paragraph id="HBD4AEAC1B67945C784079F074597D1F5"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following:</text>

				members</header>
							<paragraph id="H34DC0406CD06441FBAA1C09718C270F8"><enum>(1)</enum><header>In
				general</header><text>The membership of the Alliance shall be as
				follows:</text>
								<subparagraph id="H1907ACE29ABD449E8D810E9410D1C9CF"><enum>(A)</enum><text>One member
				representing each State participating in the Alliance.</text>
								</subparagraph><subparagraph id="H54553F6F8E414A89B30367BEFB0A62D2"><enum>(B)</enum><text>Five
				representatives of retail marketers, of whom 1 shall be selected by each of the
				qualified State associations of the 5 States with the highest volume of annual
				oilheat fuel sales.</text>
								</subparagraph><subparagraph id="H025BF49D57C443F7BE3AFC7FB90BF3A4"><enum>(C)</enum><text>Five additional
				representatives of retail marketers.</text>
								</subparagraph><subparagraph id="H49E5FD518C5F4E8D9531D5016A5965A7"><enum>(D)</enum><text>Twenty-one
				representatives of wholesale distributors.</text>
								</subparagraph><subparagraph id="H0DFA4795C3E849849D6BD903DCBFF91F"><enum>(E)</enum><text>Six public
				members, who shall be representatives of significant users of oilheat fuel, the
				oilheat fuel research community, State energy officials, or other groups with
				expertise in oilheat fuel.</text>
								</subparagraph></paragraph><paragraph id="HED3C0E9144FF42F2BF1CC6EF964901C7"><enum>(2)</enum><header>Full-time owners
				or employees</header>
								<subparagraph id="HB11B3BC147F54ACB8724B4898992F4AA"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), other than the
				public members of the Alliance, Alliance members shall be full-time managerial
				owners or employees of members of the oilheat fuel industry.</text>
								</subparagraph><subparagraph id="H59DDCD4ACDAC40359308A06C31909B3E"><enum>(B)</enum><header>Employees</header><text>Members
				described in subparagraphs (B), (C), and (D) of paragraph (1) may be employees
				of the qualified industry organization or an industry trade
				association.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAA4B711DD2C4482FB61C0499629F21D8"><enum>(e)</enum><header>Functions</header><text>Section
			 706 of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note;
			 Public Law 106–469) is amended—</text>
				<paragraph id="HA89B48B4C7E04B54BEA43D8699AEC962"><enum>(1)</enum><text>by striking
			 <quote>oilheat</quote> each place it appears and inserting <quote>oilheat
			 fuel</quote>;</text>
				</paragraph><paragraph id="H950410A54C2C482CA77BB5B311C2B2F2"><enum>(2)</enum><text>in subsection
			 (a)(1)(A)(ii), by inserting <quote>, including providing the cost of installing
			 appliances in low-income households</quote> after <quote>utilization
			 equipment</quote>;</text>
				</paragraph><paragraph id="HA165941E19FD439BA4AB1B45345B153C"><enum>(3)</enum><text>in subsection (a),
			 by adding at the end the following new paragraph:</text>
					<quoted-block id="H6283885D30684A57B2981511B6C64217" style="OLC">
						<paragraph id="H9DBB0EFDD3004985871240C0AD7B70B7"><enum>(4)</enum><header>Training and
				research and development as a priority</header><text display-inline="yes-display-inline">Of the assessments collected by the
				Association pursuant to section 707, not less than 40 percent shall be devoted
				to a category of outlays comprised of training projects and research,
				development, and demonstration projects, with a priority on research,
				development, and demonstration projects that would enhance efficiency through
				the use of biobased liquids. Training and research under this paragraph shall
				include the development and demonstration of advanced
				biofuels.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAA8964383DF74F558E22486712E5630D"><enum>(4)</enum><text>in the heading for
			 subsection (c)(2), by striking <quote><header-in-text level="paragraph" style="OLC">oilheat</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">oilheat
			 fuel</header-in-text></quote>;</text>
				</paragraph><paragraph id="H3E5C87135A9A44EC8AB1842F4FE6F9B8"><enum>(5)</enum><text>by redesignating
			 paragraph (4) of subsection (e) as paragraph (5);</text>
				</paragraph><paragraph id="H6CA2A39AC109435988E56DAEA0752F26"><enum>(6)</enum><text display-inline="yes-display-inline">by inserting after subsection (e)(3) the
			 following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HEE23B6BFD0C648F2A58BA08F49F4B144" style="OLC">
						<paragraph id="H05D64491A5264F9EB51E18AC9C3ED9D1"><enum>(4)</enum><header>Response to
				recommendations</header><text display-inline="yes-display-inline">If the
				Secretary makes recommendations under paragraph (3), the Alliance shall, before
				implementation of the budget with respect to which the recommendations pertain,
				provide to the Secretary and the Congress a report describing the Alliance’s
				response to the
				recommendations.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7533A2DA23854ED4931CFB1F9BE0FF3E"><enum>(7)</enum><text display-inline="yes-display-inline">by amending subsection (f)(2)(C) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H699A2CF0002C45AB9A1D97A5252271A3" style="OLC">
						<subparagraph id="HF52456D6D9B34F159A3935F7AB8431D0"><enum>(C)</enum><header>Procedures to
				ensure compliance</header><text display-inline="yes-display-inline">The
				Alliance shall contract with a qualified accounting firm to develop procedures
				to ensure compliance with the Act. The Alliance shall contract on a yearly
				basis with a qualified accounting firm to evaluate whether such procedures have
				been followed. Such evaluation shall be included in the annual report required
				under subsection (h) and shall be furnished to Congress and to the Secretary of
				Energy.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0CE60F44603841F2903969C0E7E41B86"><enum>(8)</enum><text>in subsection
			 (h)—</text>
					<subparagraph id="H767A5B3E4BC0450AB8C5C5B5624D9FDF"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (1);</text>
					</subparagraph><subparagraph id="H9EB70E7756DF4F28B938744E9BE8BD43"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (2) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HF393EB2CD56941AC99AB02F2BD3B91E7"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="H694CC569C7714CFFAD5456CAA88B30C6" style="OLC">
							<paragraph id="HC7E1666880FC4398B1711C52DB90824B"><enum>(3)</enum><text>provides a
				detailed account of the amounts spent by each qualified State association that
				received funds pursuant to subsection (e) on training, research, development,
				and demonstration, safety, and consumer
				education.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H582EA5F8DEBD456F879890D4ACD468E3"><enum>(f)</enum><header>Assessments</header><text>Section
			 707 of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note;
			 Public Law 106–469) is amended—</text>
				<paragraph id="HD52464D4DCE749F98135FB0EC5EC9768"><enum>(1)</enum><text>by striking
			 <quote>oilheat</quote> each place it appears and inserting <quote>oilheat
			 fuel</quote>;</text>
				</paragraph><paragraph id="H1F75AF75FA044085BAC58B283F854E7C"><enum>(2)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block id="H59262631126F4221BCCCC4EA2A8F0B45" style="OLC">
						<subsection id="HB75919497B874513A99573FC98A7DDD3"><enum>(a)</enum><header>Rate</header>
							<paragraph id="HAE4523D4B19C4D8BA3C4B614B539B4C7"><enum>(1)</enum><header>In
				general</header><text>The assessment rate for calendar years 2012 and 2013
				shall be equal to <fraction>2/10</fraction> of 1 cent per gallon of oilheat
				fuel.</text>
							</paragraph><paragraph id="H7CD274FEA0C445A6B4AA5C081B1C3B0B"><enum>(2)</enum><header>Subsequent
				assessments</header><text>Subject to paragraphs (3) and (4), beginning with
				calendar year 2014, the annual assessment rate shall be sufficient to cover the
				costs of the plans and programs developed by the Alliance.</text>
							</paragraph><paragraph id="HBA1BF7E202CC41F2A5E1FB80050EAE3C"><enum>(3)</enum><header>Limitations on
				increase</header>
								<subparagraph id="H5175319E405845CE99E7D8390E2FD7EE"><enum>(A)</enum><header>In
				general</header><text>The annual assessment shall not exceed
				<fraction>½</fraction> of 1 cent per gallon of oilheat fuel.</text>
								</subparagraph><subparagraph id="H2975009FFC6F458A8539071656C87F8B"><enum>(B)</enum><header>Limitation</header><text>The
				annual assessment may not change by more than <fraction>1/10</fraction> of 1
				cent per gallon of oilheat fuel in any 12 month-period.</text>
								</subparagraph><subparagraph id="H5A11E022755741B78CD2802EC5E9E514"><enum>(C)</enum><header>Approval</header><text>No
				increase in the assessment may occur unless—</text>
									<clause id="H72A8808FB785452CAF83CB508AE439D9"><enum>(i)</enum><text>the increase is
				approved by <fraction>3/4</fraction> of the members voting at a regularly
				scheduled meeting of the Alliance; and</text>
									</clause><clause id="HBCE47ECB3FF24A7AB01298F2CFE81082"><enum>(ii)</enum><text>at least 90 days
				before the date of the meeting of the Alliance, the Alliance provides notice of
				the proposed increase to the Committee on Energy and Natural Resources of the
				Senate and the Committee on Energy and Commerce of the House of
				Representatives.</text>
									</clause></subparagraph><subparagraph id="H6F271258581F4D0BADBA63E15A5BCBD2"><enum>(D)</enum><header>Notice</header><text>The
				Alliance shall provide notice of a change in assessment at least 90 days before
				the date on which the change is to take
				effect.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2D300FBD3B6447D0A738FB8408A5CB74"><enum>(3)</enum><text>in subsections
			 (b)(1) and (c), by striking <quote>No. 1 distillate and No. 2 dyed
			 distillate</quote> each place it appears and inserting <quote>oilheat
			 fuel</quote>;</text>
				</paragraph><paragraph id="H1CE33329EB8D4533AFD1D30BD245F57C"><enum>(4)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HD064857D81F24B4DB7686A4B2316D8F7"><enum>(A)</enum><text>by striking
			 <quote>No. 1 distillate or No. 2 dyed distillate</quote> each place it appears

			 subsection (c), by striking <quote><header-in-text level="subsection" style="OLC">Oilheat</header-in-text></quote> and inserting

				</paragraph></subsection><subsection id="H52BDC22A30274C4683E241F3BE350B08"><enum>(g)</enum><header>Market survey
			 and consumer protection</header><text>Section 708 of the National Oilheat
			 Research Alliance Act of 2000 (42 U.S.C. 6201 note; Public Law 106–469) is
			 repealed.</text>
			</subsection><subsection id="H217518127D794920B99C1BDB6365A454"><enum>(h)</enum><header>Lobbying
			 Prohibition</header><text display-inline="yes-display-inline">Section 710 of
			 the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note; Public
			 Law 106–469) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H15CACE2CD9964A1DA55147EBAA7B179A" style="OLC">
					<section commented="no" id="H2AF9D449225D4924A24B8230C743E787"><enum>710.</enum><header>Lobbying
				prohibition</header><text display-inline="no-display-inline">No funds derived
				from assessments under section 707 collected by the Alliance shall be used
				directly or indirectly to influence Federal, State, or local legislation or
				elections, or the manner of execution of legislation, except that the Alliance
				may use such funds to provide information requested by a Member of Congress, or
				an official of any Federal, State, or local agency, in the course of the
				official business of such Member or
				official.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5C80C12461134EB598A7E801A43C65F1"><enum>(i)</enum><header>Violations</header><text>Section
			 712(a) of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201
			 note; Public Law 106–469) is amended—</text>
				<paragraph id="H2C1C1F0B12DB45579CA9635DC3C84096"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>oilheat</quote> and inserting <quote>oilheat fuel</quote>;
			 and</text>
				</paragraph><paragraph id="H63C92E20A442485580CE7C95A0E7509F"><enum>(2)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>

			 713 of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201 note;
			 Public Law 106–469) is amended by striking <quote>9 years after the date on
			 which the Alliance is established</quote> and inserting <quote>7 years after
			 the date of enactment of the <short-title>National Oilheat
			 Research Alliance Reauthorization Act of 2011</short-title></quote>.</text>
			</subsection></section><section id="H9BFCE21C242E49C9A71BFD9B61E4A996"><enum>3.</enum><header>Renewable fuel
			 content</header>
			<subsection id="H748958C5CA8A4FC691BC731C59D72705"><enum>(a)</enum><header>Renewable fuel
			 research</header><text display-inline="yes-display-inline">Section
			 706(a)(3)(B)(i)(I) of the National Oilheat Research Alliance Act of 2000 (42
			 U.S.C. 6201 note; Public Law 106–469) is amended by inserting <quote>,
			 including research to develop renewable fuels and to examine the compatibility
			 of different renewable fuels with oilheat fuel utilization equipment, with
			 priority given to research on the development and use of advanced
			 biofuels</quote> after <quote>utilization equipment</quote>.</text>
			</subsection><subsection id="HC3F5DCA0313E4E3F8B01A794BD91BFF3"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The National Oilheat Research Alliance
			 shall prepare a report no later than one year after date of enactment of this
			 Act on the use of biofuels in oilheat fuel utilization equipment. This report
			 shall provide information on the environmental benefits, economic benefits, and
			 any technical limitations on the use of biofuels in oilheat fuel utilization
			 equipment. It shall also describe market acceptance of the fuel, and
			 information on State and local governments that are encouraging the use of
			 these fuels in oilheat fuel utilization equipment. The Alliance shall provide
			 this report to the Governor of each State, and other appropriate State leaders,
			 where the Alliance is operating. Additionally, a copy of this report will be
			 furnished to the Administrator of the Environmental Protection Agency and to
			 the Congress.</text>
			</subsection><subsection id="HA8289A6BBBF94A76BC336823C99B3B3A"><enum>(c)</enum><header>Consumer
			 education materials</header><text>The Alliance shall develop consumer education
			 materials in conjunction with an institution or organization engaged in
			 biofuels research describing the benefits of using biofuels as or in oilheat
			 fuel based on the technical information developed pursuant to subsection (b),
			 as well as other information generally available.</text>
