		<official-title display="yes">To authorize the Secretary of Homeland
		  Security and the Secretary of State to refuse or revoke visas to aliens if in
		  the security or foreign policy interests of the United States, to require the
		  Secretary of Homeland Security to review visa applications before adjudication,
		  to provide for the immediate dissemination of visa revocation information, and
		  for other purposes.<pagebreak></pagebreak></official-title>

		<section id="HCFD8BA1BA8BF49AC9CF3C2D4B23B94D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Secure Visas
			 Act</short-title></quote>.</text>
		</section><section id="HD0119F54C8A34FA6B40FE93DD7288B5B"><enum>2.</enum><header>Visa refusal and
			 revocation</header>
			<subsection id="H22927060C522463C86C54F21A9376EDA"><enum>(a)</enum><header>Authority of the
			 Secretary of Homeland Security and the Secretary of State</header>
				<paragraph id="H904FD9EF303F41F381907B5F979F7AD3"><enum>(1)</enum><header>In
			 general</header><text>Section 428 of the Homeland Security Act of 2002 (6
			 U.S.C. 236) is amended by striking subsections (b) and (c) and inserting the
			 following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H4A9B1F1C061247CFA88F5F1C60840D05" reported-display-style="italic" style="OLC">
						<subsection id="HC55237392EE8495DB0B09CC625CBECD9"><enum>(b)</enum><header>Authority of the
				Secretary of Homeland Security</header>
							<paragraph id="H9E8A357ECD5140418C694223CED33DDA"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding section 104(a) of the Immigration and
				Nationality Act (8 U.S.C. 1104(a)) or any other provision of law, and except
				for the authority of the Secretary of State under subparagraphs (A) and (G) of
				section 101(a)(15) of the Immigration and Nationality Act (8 U.S.C.
				1101(a)(15)), the Secretary—</text>
								<subparagraph id="H6D5EA3ECAAD94170BB6737083F4ECE18"><enum>(A)</enum><text>shall have exclusive
				authority to issue regulations, establish policy, and administer and enforce
				the provisions of the Immigration and Nationality Act (8 U.S.C. 1101 et seq.)
				and all other immigration or nationality laws relating to the functions of
				consular officers of the United States in connection with the granting and
				refusal of a visa; and</text>
								</subparagraph><subparagraph id="H0C652279019C49A99E87BA6CA248B791"><enum>(B)</enum><text>may refuse or revoke any
				visa to any alien or class of aliens if the Secretary, or designee, determines
				that such refusal or revocation is necessary or advisable in the security
				interests of the United States.</text>
								</subparagraph></paragraph><paragraph id="HCD8743D4D1A1472DB990A6C5A2FEC543"><enum>(2)</enum><header>Effect of
				revocation</header><text>The revocation of any visa under paragraph
				(1)(B)—</text>
								<subparagraph id="H96FC754C4D1041CC9A388B2D52A536B9"><enum>(A)</enum><text>shall take effect
				immediately; and</text>
								</subparagraph><subparagraph id="HDF8EAB2977C441439E7A9B0727B89E80"><enum>(B)</enum><text>shall automatically
				cancel any other valid visa that is in the alien’s possession.</text>
								</subparagraph></paragraph><paragraph id="HD963FE74B38A4661A605ECE107DF6827"><enum>(3)</enum><header>Judicial
				review</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, including section 2241 of title 28, United States Code,
				or any other habeas corpus provision, and sections 1361 and 1651 of such title,
				no court shall have jurisdiction to review a decision by the Secretary of
				Homeland Security to refuse or revoke a visa, and no court shall have
				jurisdiction to hear any claim arising from, or any challenge to, such a
				revocation.</text>
							</paragraph></subsection><subsection id="H5FAAED47E26A4F1EB700BEFCAEB6C9D2"><enum>(c)</enum><header>Authority of the
				Secretary of State</header>
							<paragraph id="HA2B392BDAB4B4D5CB4780767A971DD85"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				State may direct a consular officer to refuse a visa requested by, or revoke a
				visa issued to, an alien if the Secretary of State determines such refusal or
				revocation to be necessary or advisable in the interests of the United
				States.</text>
							</paragraph><paragraph id="H35ED69D37763431DACEC55996B388A0A"><enum>(2)</enum><header>Limitation</header><text>No
				decision by the Secretary of State to approve a visa may override a decision by
				the Secretary of Homeland Security under subsection
				(b).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE7EFA70594CA481E80288C6DEBBFA446"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall take effect on the
			 date of the enactment of this Act and shall apply to visa refusals and
			 revocations occurring before, on, or after such date.</text>
				</paragraph></subsection><subsection id="H5C83A2591A0B42D3BEC602DD74315D07"><enum>(b)</enum><header>Issuance of visas at
			 designated consular posts and embassies</header>
				<paragraph id="HE5E8FC1A600C45B78E869DE1AC6FED91"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 428(i) of the
			 Homeland Security Act of 2002 (6 U.S.C. 236(i)) is amended to read as
			 follows:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H7AF40C3BC02F49749701FF20EBF62668" reported-display-style="italic" style="OLC">
						<subsection id="HE27CC57C0A7A49D6AA4CBA04CACCDE98"><enum>(i)</enum><header>Visa issuance at
				designated consular posts and embassies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				except section 207 of the Foreign Service Act of 1980 (22 U.S.C. 3927) and the
				process established by the President for determining appropriate staffing at
				diplomatic missions and overseas constituent posts, the Secretary of Homeland
				Security—</text>
							<paragraph id="H4FC0E3B4207D4C7DAC301E080B071DD9"><enum>(1)</enum><text>shall conduct an on-site
				review of all visa applications and supporting documentation before
				adjudication at all visa-issuing posts in Algeria; Canada; Colombia; Egypt;
				Germany; Hong Kong; India; Indonesia; Iraq; Jerusalem, Israel; Jordan; Kuala
				Lumpur, Malaysia; Kuwait; Lebanon; Mexico; Morocco; Nigeria; Pakistan; the
				Philippines; Saudi Arabia; South Africa; Syria; Tel Aviv, Israel; Turkey;
				United Arab Emirates; the United Kingdom; Venezuela; and Yemen; and</text>
							</paragraph><paragraph id="HDCBB709D1E4C4847B8CF307C93223E21"><enum>(2)</enum><text display-inline="yes-display-inline">is authorized to assign employees of the
				Department to each diplomatic and consular post at which visas are issued
				unless, in the Secretary’s sole and unreviewable discretion, the Secretary
				determines that such an assignment at a particular post would not promote
				national or homeland
				security.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H68586CF4DD7740FD9705D502C6ABF2AC"><enum>(2)</enum><header>Expedited clearance and
			 placement of Department of Homeland Security personnel at overseas embassies
			 and consular posts</header><text>The Secretary of State shall accommodate and
			 ensure—</text>
					<subparagraph id="H63E61905645044159774A0A24DB6A1E3"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of the
			 enactment of this Act, that Department of Homeland Security personnel assigned
			 by the Secretary of Homeland Security under section 428(i)(1) of the Homeland
			 Security Act of 2002 have been stationed at post such that the post is fully
			 operational; and</text>
					</subparagraph><subparagraph id="H281B8D2F305C44E38F9A61AA557C909F"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 1 year after the date on
			 which the Secretary of Homeland Security designates an additional consular post
			 or embassy for personnel under section 428(i)(2) of the Homeland Security Act
			 of 2002 that the Department of Homeland Security personnel assigned to such
			 post or embassy have been stationed at post such that the post is fully
			 operational.</text>
					</subparagraph></paragraph></subsection><subsection id="HF61ACE5AA0B74A3B8DEA658C850ED43E"><enum>(c)</enum><header>Visa
			 revocation</header>
				<paragraph id="H8373D9C6F3A2418D9FF6D0595D7397F9"><enum>(1)</enum><header>Information</header><text display-inline="yes-display-inline">Section 428 of the Homeland Security Act of
			 2002 (6 U.S.C. 236) is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H604A521B143E4BB89332F0B3AC1792B1" reported-display-style="italic" style="OLC">
						<subsection id="H5FBDE5E2D6094C578EB633664C12B5D5"><enum>(j)</enum><header>Visa revocation
				information</header><text>If the Secretary of Homeland Security or the
				Secretary of State revokes a visa—</text>
							<paragraph id="HF44682D0EBE24248828405A3ED7FDD16"><enum>(1)</enum><text>the relevant consular,
				law enforcement, and terrorist screening databases shall be immediately updated
				on the date of the revocation; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97ADB27CA9CC4260AEF967C5D984C9C6"><enum>(2)</enum><text>look-out notices shall be
				posted to all Department of Homeland Security port inspectors and Department of
				State consular
				officers.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H875F381BB9AD45768876E0893150B1B5"><enum>(2)</enum><header>Effect of visa
			 revocation; judicial review of visa revocations</header>
					<subparagraph display-inline="no-display-inline" id="HC93CC06F94354FE7A931FCBC886B00C1"><enum>(A)</enum><header>In
			 general</header><text>Section 221(i) of the Immigration and Nationality Act (8
			 U.S.C. 1201(i)) is amended by striking the final sentence and inserting the
			 following: <quote>A revocation under this subsection shall take effect
			 immediately and shall automatically cancel any other valid visa that is in the
			 alien’s possession. Notwithstanding any other provision of law, including
			 section 2241 of title 28, United States Code, or any other habeas corpus
			 provision, and sections 1361 and 1651 of such title, a revocation under this
			 subsection may not be reviewed by any court, and no court shall have
			 jurisdiction to hear any claim arising from, or any challenge to, such a
			 revocation.</quote>.</text>
					</subparagraph><subparagraph id="H5EC7E6653BD349C383307D1178AC73CA"><enum>(B)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subparagraph (A) shall take effect on the date of the enactment of this Act and
			 shall apply to revocations under section 221(i) of the Immigration and
			 Nationality Act (8 U.S.C. 1201(i)) occurring before, on, or after such
			 date.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
