		<official-title display="yes">To decrease the deficit by realigning,
		  consolidating, selling, disposing, and improving the efficiency of Federal
		  buildings and other civilian real property, and for other purposes.

		<section id="H66A470B77E05496C99FF83DCB0487A35" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Civilian Property Realignment
			 Act</short-title></quote> or <quote><short-title>CPRA</short-title></quote>.</text>
		</section><section id="H4F21B630697C451783D17938085545E9"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="H45DFC338A6D44A5288043FBAE770B614"><enum>(1)</enum><text>to consolidate the
			 footprint of Federal buildings and facilities;</text>
			</paragraph><paragraph id="HE9197A2EB97E4602B0DD35A6C7E7089D"><enum>(2)</enum><text display-inline="yes-display-inline">to maximize the utilization rate of Federal
			 buildings and facilities;</text>
			</paragraph><paragraph id="HB5E88B020ECB4847BABF0C56E134132A"><enum>(3)</enum><text display-inline="yes-display-inline">to reduce the reliance on leased
			 space;</text>
			</paragraph><paragraph id="HBFC786CAE0BD4D99B2937935455C361A"><enum>(4)</enum><text display-inline="yes-display-inline">to sell or redevelop high value assets that
			 are underutilized to obtain the highest and best value for the taxpayer and
			 maximize the return to the taxpayer;</text>
			</paragraph><paragraph id="H425DAAAD55014675BE9C2D7DE3009DCB"><enum>(5)</enum><text display-inline="yes-display-inline">to reduce the operating and maintenance
			 costs of Federal civilian real properties through the realignment of real
			 properties by consolidating, co-locating, and reconfiguring space, and other
			 operational efficiencies;</text>
			</paragraph><paragraph id="H77B9ADE732214A69A055DD218805E6E6"><enum>(6)</enum><text display-inline="yes-display-inline">to reduce redundancy, overlap, and costs
			 associated with field offices;</text>
			</paragraph><paragraph id="H4CAC3E619B094AD69112A8B07E0C4DF4"><enum>(7)</enum><text display-inline="yes-display-inline">to create incentives for Federal agencies
			 to achieve greater efficiency in their inventories of civilian real
			 property;</text>
			</paragraph><paragraph id="H9E87711140064ED690EB6B3D31B970E7"><enum>(8)</enum><text display-inline="yes-display-inline">to facilitate and expedite the sale or
			 disposal of unneeded civilian properties; and</text>
			</paragraph><paragraph id="H3B6A623EB5CD43C89B47D261C01C3511"><enum>(9)</enum><text display-inline="yes-display-inline">to assist Federal agencies in achieving the
			 Government’s sustainability goals by reducing excess space, inventory, and
			 energy consumption, as well as by leveraging new technologies.</text>
			</paragraph></section><section id="H978BCFF6B1DA4D63BECDE808FF61F294"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, unless otherwise expressly
			 stated, the following definitions apply:</text>
			<paragraph id="HD4B2FF693100451EBF377993DAD6A976"><enum>(1)</enum><header>Federal civilian
			 real property and civilian real property</header>
				<subparagraph display-inline="no-display-inline" id="H67C4F178EF424D1A88E3014BEE792DAB"><enum>(A)</enum><header>Property</header><text>The
			 terms <term>Federal civilian real property</term> and <term>civilian real
			 property</term> refer to Federal real property assets, including public
			 buildings as defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/40/3301">section
			 3301</external-xref> of title 40, United States Code, occupied and improved
			 grounds, leased space, or other physical structures under the custody and
			 control of any Federal agency.</text>
				</subparagraph><subparagraph id="H5D69BA1673D84FE38F75D37737EE3E4B"><enum>(B)</enum><header>Further
			 exclusions</header><text>Subparagraph (A) shall not be construed as including
			 any of the following types of property:</text>
					<clause id="H1E71A843416E4D00A8479938EC760AC0"><enum>(i)</enum><text display-inline="yes-display-inline">A base, camp, post, station, yard, center,
			 homeport facility for any ship, or any activity under the jurisdiction of the
			 Department of Defense or Coast Guard.</text>
					</clause><clause id="H7A780ADE086D487385FBC864FE17CF94"><enum>(ii)</enum><text>Properties that
			 are excluded for reasons of national security by the Director of the Office of
			 Management and Budget.</text>
					</clause><clause id="H41AD1D9F14544EF496DD54D7169FAA9E"><enum>(iii)</enum><text>Properties that
			 are excepted from the definition of <term>property</term> under
			 <external-xref legal-doc="usc" parsable-cite="usc/40/102">section
			 102(9)</external-xref> of title 40, United States Code.</text>
					</clause><clause id="H061F090B93B24B32A717ADBF4C492335"><enum>(iv)</enum><text display-inline="yes-display-inline">Indian and Native Alaskan properties
			 including—</text>
						<subclause id="H6583588BCFE741FD8050C07EEC4F999E"><enum>(I)</enum><text>any property
			 within the limits of any Indian reservation to which the United States owns
			 title for the benefit of an Indian tribe; and</text>
						</subclause><subclause id="HF05B09DBC025439DABC16E1AA77136BE"><enum>(II)</enum><text>any property
			 title which is held in trust by the United States for the benefit of any Indian
			 tribe or individual or held by an Indian tribe or individual subject to
			 restriction by the United States against alienation.</text>
						</subclause></clause><clause id="H0FC2D62A747A45DB80A4F249585DCD17"><enum>(v)</enum><text>Properties
			 operated and maintained by the Tennessee Valley Authority pursuant to the
			 Tennessee Valley Authority Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/16/831">16 U.S.C. 831 et seq.</external-xref>).</text>
					</clause><clause id="HDF3AD7C0291F458EB35E8C1D6D501ED8"><enum>(vi)</enum><text>Postal properties
			 owned by the United States Postal Service.</text>
					</clause><clause id="H32B27D0B8C0B4BC79F49DAC5D1FE462E"><enum>(vii)</enum><text display-inline="yes-display-inline">Properties used in connection with Federal
			 programs for agricultural, recreational, and conservation purposes, including
			 research in connection with the programs.</text>
					</clause><clause id="HF6C9A4FD2F5E4F9B8CA106D1707455E4"><enum>(viii)</enum><text>Properties used
			 in connection with river, harbor, flood control, reclamation, or power
			 projects.</text>
					</clause><clause id="HD3BB34C41251410984367EA503FEFF55"><enum>(ix)</enum><text display-inline="yes-display-inline">Properties located outside the United
			 States operated or maintained by the Department of State or the United States
			 Agency for International Development.</text>
					</clause></subparagraph></paragraph><paragraph id="H34C211CBB29746AE950712EA8464865A"><enum>(2)</enum><header>Federal
			 agency</header><text>The term <term>Federal agency</term> means an executive
			 department or independent establishment in the executive branch of the
			 Government, and a wholly owned Government corporation.</text>
			</paragraph><paragraph id="H5A387883CC6D4244A0799108ABA385C2"><enum>(3)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of General
			 Services.</text>
			</paragraph><paragraph id="HC59D1A0327614F81BCD0085BBD9D5BCF"><enum>(4)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Civilian Property Realignment
			 Commission.</text>
			</paragraph><paragraph id="H88ADB3F1F99D4D0D859A9652EE53F562"><enum>(5)</enum><header>OMB</header><text>The
			 term <term>OMB</term> means the Office of Management and Budget.</text>
			</paragraph><paragraph id="H9937E68FB8D146D0AC9DEC664B2300BF"><enum>(6)</enum><header>Field
			 office</header><text>The term <term>field office</term> means any Federal
			 office that is not the Headquarters office location for the Federal
			 agency.</text>
			</paragraph></section><section id="HD9869B76C1CF4F2DBD7D0C45E2D0BEB8"><enum>4.</enum><header>Commission</header>
			<subsection id="H9DE8ED7A3C7F43C099FA63D00392C5AB"><enum>(a)</enum><header>Establishment</header><text>There
			 is established an independent commission to be known as the Civilian Property
			 Realignment Commission, referred to in this Act as the
			 <term>Commission</term>.</text>
			</subsection><subsection id="H3F2FA9C25DD447F6A35AC376D091BC12"><enum>(b)</enum><header>Duties</header><text>The
			 Commission shall carry out the duties as specified in this Act.</text>
			</subsection><subsection id="H47AD1A40A6CD4A6092A09EB9458C7F56"><enum>(c)</enum><header>Membership</header>
				<paragraph id="HB535CC5BA145447DBA6600387D0B6B29"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall be composed of a Chairperson
			 appointed by the President, by and with the advice and consent of the Senate,
			 and eight members appointed by the President.</text>
				</paragraph><paragraph id="H7F1D987C74D14AF193C0028488EFF37A"><enum>(2)</enum><header>Appointments</header><text>In
			 selecting individuals for appointments to the Commission, the President shall
			 consult with—</text>
					<subparagraph id="HD55A331135C84CE19D35ED87FA43FD68"><enum>(A)</enum><text>the Speaker of the
			 House of Representatives concerning the appointment of two members;</text>
					</subparagraph><subparagraph id="HD50D38CB1EEE4ADA8262815977E774C8"><enum>(B)</enum><text>the majority
			 leader of the Senate concerning the appointment of two members;</text>
					</subparagraph><subparagraph id="HC115773362034A089176D2A845B30295"><enum>(C)</enum><text>the minority
			 leader of the House of Representatives concerning the appointment of one
			 member; and</text>
					</subparagraph><subparagraph id="H4AD1F891F94742E3BE2207A9C282565D"><enum>(D)</enum><text>the minority
			 leader of the Senate concerning the appointment of one member.</text>
					</subparagraph></paragraph><paragraph id="HD60953C874D64CD4945ADDD6284A1B6D"><enum>(3)</enum><header>Terms</header><text>The
			 term for each member of the Commission shall be 6 years.</text>
				</paragraph><paragraph id="H6ED1FAC7CBF74E28B1F550B21C1ACB88"><enum>(4)</enum><header>Vacancies</header><text>Vacancies
			 shall be filled in the same manner as the original appointment.</text>
				</paragraph><paragraph id="HFEE850B3073E4203BE80B0CE4B1D1C48"><enum>(5)</enum><header>Qualifications</header><text>In
			 selecting individuals for appointment to the Commission, the President shall
			 ensure the Commission contains individuals with expertise representative of the
			 following:</text>
					<subparagraph id="HF68BACABD3F5477AA0EC5DA090D07B09"><enum>(A)</enum><text>Commercial real
			 estate and redevelopment.</text>
					</subparagraph><subparagraph id="H3F144DAD657C4ED483CB44CFCC04F644"><enum>(B)</enum><text>Government
			 management or operations.</text>
					</subparagraph><subparagraph id="H7B3FE742CB98458A9664C6CEDDCE5BC9"><enum>(C)</enum><text display-inline="yes-display-inline">Community development, including
			 transportation and planning.</text>
					</subparagraph><subparagraph id="H5BC151322664455BB9872FA5346F8173"><enum>(D)</enum><text>Historic
			 preservation.</text>
					</subparagraph></paragraph></subsection></section><section id="H6043761E1C96491D8066345B645298CD"><enum>5.</enum><header>Commission
			 meetings</header>
			<subsection id="HAB029550712545E1AA26ECB8D4002150"><enum>(a)</enum><header>Open
			 meetings</header><text>Each meeting of the Commission, other than meetings in
			 which classified information is to be discussed, shall be open to the public.
			 Any open meeting shall be announced in the Federal Register and the Federal
			 website established by the Commission at least 14 calendar days in advance of a
			 meeting. For all public meetings, the Commission shall release an agenda and a
			 listing of materials relevant to the topics to be discussed.</text>
			</subsection><subsection id="H40F75600405A41A5978065B46F96F777"><enum>(b)</enum><header>Quorum and
			 meetings</header><text>Seven Commission members shall constitute a quorum for
			 the purposes of conducting business and three or more Commission members shall
			 constitute a meeting of the Commission.</text>
			</subsection><subsection id="HC0C623FD292B4E97A677D29707AB2AD9"><enum>(c)</enum><header>Transparency of
			 information</header><text>All the proceedings, information, and deliberations
			 of the Commission shall be open, upon request, to the Chairperson and the
			 ranking minority party member, and their respective subcommittee Chairperson
			 and ranking minority party member, of—</text>
				<paragraph id="HED0D11BA3F954BE49A8D8505F464F38F"><enum>(1)</enum><text>the Committee on
			 Transportation and Infrastructure of the House of Representatives;</text>
				</paragraph><paragraph id="H1698686545714BF1A56261FA01BBEF53"><enum>(2)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives;</text>
				</paragraph><paragraph id="HE746270314F4412F9940663334FDCB12"><enum>(3)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate;</text>
				</paragraph><paragraph id="HB3108DC5E7C9486CBDC66922A58D7010"><enum>(4)</enum><text>the Committee on
			 Environmental and Public Works of the Senate; and</text>
				</paragraph><paragraph id="H8D57E9510EC944B5840FB6D98E66020B"><enum>(5)</enum><text>the committees on
			 Appropriations of the House of Representatives and the Senate.</text>
				</paragraph></subsection><subsection id="H14774690F643475691622DB1F455EAE9"><enum>(d)</enum><header>Government
			 Accountability Office</header><text>All proceedings, information, and
			 deliberations of the Commission shall be open, upon request, to the Comptroller
			 General of the United States.</text>
			</subsection></section><section id="HEE355716FC4D48479567F50866CC53EC"><enum>6.</enum><header>Compensation and
			 travel expenses</header>
			<subsection id="HE62FB78321274FA3A80F9D8F6969F181"><enum>(a)</enum><header>Compensation</header>
				<paragraph id="H5348FF9B63D74937B5016749E4BD1CC9"><enum>(1)</enum><header>Rate of pay for
			 members</header><text>Each member, other than the Chairperson, shall be paid at
			 a rate equal to the daily equivalent of the minimum annual rate of basic pay
			 payable for level IV of the Executive Schedule under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section
			 5315</external-xref> of title 5, United States Code, for each day (including
			 travel time) during which the member is engaged in the actual performance of
			 duties vested in the Commission.</text>
				</paragraph><paragraph id="H37E37446A1544D41B4CFBE169DCA2E7F"><enum>(2)</enum><header>Rate of pay for
			 Chairperson</header><text>The Chairperson shall be paid for each day referred
			 to in paragraph (1) at a rate equal to the daily equivalent of the minimum
			 annual rate of basic pay payable for level III of the Executive Schedule under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5314">section
			 5314,</external-xref> of title 5, United States Code.</text>
				</paragraph></subsection><subsection id="HEF7B5AB9364E48EEB95F6B8DFDFAC879"><enum>(b)</enum><header>Travel</header><text>Members
			 shall receive travel expenses, including per diem in lieu of subsistence, in
			 accordance with sections
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5702">5702</external-xref>
			 and <external-xref legal-doc="usc" parsable-cite="usc/5/5703">5703</external-xref> of title 5, United States
			 Code.</text>
			</subsection></section><section id="HB126560DD52149A9811C8F722F183194"><enum>7.</enum><header>Executive
			 director</header>
			<subsection id="H979D547E3D744214BEF0F581D48CEA99"><enum>(a)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Commission shall appoint an Executive
			 Director and may disregard the provisions of title 5, United States Code,
			 governing appointments in the competitive service.</text>
			</subsection><subsection id="H2D9B4553DE924BD9BDA2FE711EA558A2"><enum>(b)</enum><header>Rate of pay for
			 director</header><text display-inline="yes-display-inline">The Executive
			 Director shall be paid at the rate of basic pay payable for level IV of the
			 Executive Schedule under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section
			 5315</external-xref> of title 5, United States Code.</text>
			</subsection></section><section id="H848CB189E23A4239A092168EFA1A2909"><enum>8.</enum><header>Staff</header>
			<subsection id="H77B7C7D218B14170BE96E0291EB0D847"><enum>(a)</enum><header>Additional
			 personnel</header><text display-inline="yes-display-inline">Subject to
			 subsection (b), the Executive Director, with the approval of the Commission,
			 may appoint and fix the pay of additional personnel.</text>
			</subsection><subsection id="H2A709C0FEFAD4E84B839531BA975BBF3"><enum>(b)</enum><header>Detail employees
			 from other agencies</header><text display-inline="yes-display-inline">Upon
			 request of the Executive Director, the head of any Federal agency may detail
			 any of the personnel of that agency to the Commission to assist the Commission
			 in carrying out its duties under this Act.</text>
			</subsection><subsection id="H20123A31C3EB4375ABE8063F8E9B4BE4"><enum>(c)</enum><header>Qualifications</header><text>Appointments
			 shall be made with consideration of a balance of expertise consistent with the
			 qualifications of representatives described in section 4(c)(5).</text>
			</subsection></section><section id="H11B760B4DFF24849B513419033DCCA77"><enum>9.</enum><header>Contracting
			 authority</header>
			<subsection commented="no" id="H57611B451CAB415D83EF3EF2761D88A4"><enum>(a)</enum><header>Experts and
			 consultants</header><text display-inline="yes-display-inline">The Commission,
			 to the extent practicable and subject to appropriations made by law, shall use
			 existing contracts entered into by the Administrator for services necessary to
			 carry out the duties of the Commission.</text>
			</subsection><subsection id="H3E6F6ABCFB994415A73349C395EEF480"><enum>(b)</enum><header>Space</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
			 Commission, shall identify suitable excess space within the Federal space
			 inventory to house the operations of the Commission.</text>
			</subsection><subsection id="H3A610CDCDB50428B99EDCF128188D931"><enum>(c)</enum><header>Personal
			 property</header><text display-inline="yes-display-inline">The Commission shall
			 use personal property already in the custody and control of the
			 Administrator.</text>
			</subsection><subsection id="H8765DE99E4D24A50845D929FFA1B96BD"><enum>(d)</enum><header>Use of small
			 businesses</header><text>In exercising its authorities under this section and
			 section 12, the Commission shall use, to the greatest extent practicable, small
			 businesses as defined by section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C.
			 632</external-xref>).</text>
			</subsection></section><section id="HDCCB6A7F69F14930875CE97B4ABDBC5E"><enum>10.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall cease operations and
			 terminate 6 years after the date of enactment of this Act.</text>
		</section><section id="H42CD8BF17FD54CEEBA90369E79E3E92F"><enum>11.</enum><header>Development of
			 recommendations to the commission</header>
			<subsection id="HAF5BF03782404AC9959C0575261116A8"><enum>(a)</enum><header>Submissions of
			 agency information and recommendations</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 enactment of this Act and 120 days after the beginning of each fiscal year
			 thereafter, the head of each Federal agency shall submit to the Administrator
			 and the Director of OMB the following:</text>
				<paragraph id="H5D9C7A84116E4522A3AF7F03855B6B07"><enum>(1)</enum><header>Current
			 data</header><text display-inline="yes-display-inline">Current data of all
			 Federal civilian real properties owned, leased, or controlled by the respective
			 agency, including all relevant information prescribed by the Administrator and
			 the Director of OMB, including data related to the age and condition of the
			 property, operating costs, history of capital expenditures, sustainability
			 metrics, number of Federal employees and functions housed in the respective
			 property, and square footage (including gross, rentable, and usable).</text>
				</paragraph><paragraph id="H926EC2FF8B0B41AAA301CBF574B465DA"><enum>(2)</enum><header>Agency
			 recommendations</header><text display-inline="yes-display-inline">Recommendations which shall include the
			 following:</text>
					<subparagraph id="H4BE6B61B5463405A8D5FB34B799AFDC3"><enum>(A)</enum><text display-inline="yes-display-inline">Federal civilian properties that can be
			 sold for proceeds and otherwise disposed of, reported as excess, declared
			 surplus, or otherwise no longer meeting the needs of the agency, excluding
			 leasebacks or other such exchange agreements where the property continues to be
			 used by the agency.</text>
					</subparagraph><subparagraph id="H9A9661A0288445D28A135244F9A25B5D"><enum>(B)</enum><text display-inline="yes-display-inline">Federal civilian properties that can be
			 transferred, exchanged, consolidated, co-located, reconfigured, or redeveloped,
			 so as to reduce the civilian real property inventory, reduce the operating
			 costs of the Government, and create the highest value and return for the
			 taxpayer.</text>
					</subparagraph><subparagraph id="H44E0105E8C314981B207B5CB835FCD79"><enum>(C)</enum><text>Operational
			 efficiencies that the Government can realize in its operation and maintenance
			 of Federal civilian real properties.</text>
					</subparagraph></paragraph></subsection><subsection id="H31ADAB87B759492A9448925186F7BE59"><enum>(b)</enum><header>Standards and
			 criteria</header><text display-inline="yes-display-inline">Not later than 60
			 days after the date specified in subsection (a), the Director of OMB, in
			 consultation with the Administrator, shall review agency recommendations
			 submitted pursuant to subsection (a), and develop consistent standards and
			 criteria against which agency recommendations will be reviewed. The Director of
			 OMB and the Administrator shall develop recommendations to the Commission based
			 on those standards and criteria. In developing the standards and criteria, the
			 Director of OMB, in consultation with the Administrator, shall incorporate the
			 following:</text>
				<paragraph id="HC896371051AF42C9AACE607598A2E762"><enum>(1)</enum><text>The extent to
			 which the Federal building or facility could be sold (including property that
			 is no longer meeting the needs of the Federal Government), redeveloped, or
			 otherwise used to produce the highest and best value and return for the
			 taxpayer.</text>
				</paragraph><paragraph id="H718AC21235624362BA4BA37015B98BB1"><enum>(2)</enum><text>The extent to
			 which the operating and maintenance costs are reduced through consolidating,
			 co-locating, and reconfiguring space, and through realizing other operational
			 efficiencies.</text>
				</paragraph><paragraph id="HFD9AA4E51FE24044BCBF1490736C527A"><enum>(3)</enum><text>The extent to
			 which the utilization rate is being maximized and is consistent with
			 non-governmental industry standards for the given function or operation.</text>
				</paragraph><paragraph id="H682B0CF9444F437096204BC5A1DFC930"><enum>(4)</enum><text>The extent and
			 timing of potential costs and savings, including the number of years, beginning
			 with the date of completion of the proposed recommendation.</text>
				</paragraph><paragraph id="H59416C11AA6041C3A24CC55D7328BECA"><enum>(5)</enum><text>The extent to
			 which reliance on leasing for long-term space needs is reduced.</text>
				</paragraph><paragraph id="H4C9EA9A1FC194DCAA5D56880549BEAB5"><enum>(6)</enum><text>The extent to
			 which a Federal building or facility aligns with the current mission of the
			 Federal agency.</text>
				</paragraph><paragraph id="HB3D0606B3F2C4356B9D55AC262D78261"><enum>(7)</enum><text>The extent to
			 which there are opportunities to consolidate similar operations across multiple
			 agencies or within agencies.</text>
				</paragraph><paragraph id="H9B403BE3694840F287C3A65FB9FB8B1C"><enum>(8)</enum><text>The economic
			 impact on existing communities in the vicinity of the Federal building or
			 facility.</text>
				</paragraph><paragraph id="H081F46F6D0624BFFA121177719BFB97D"><enum>(9)</enum><text>The extent to
			 which energy consumption is reduced.</text>
				</paragraph></subsection><subsection id="H757714AC5017447AA16734FC984C9EA9"><enum>(c)</enum><header>Special rule for
			 utilization rates</header><text display-inline="yes-display-inline">Standards
			 developed by the Director of OMB must incorporate and apply clear standard
			 utilization rates consistent throughout each category of space and with
			 nongovernment space utilization rates. To the extent the space utilization
			 rates of a given agency fall below the utilization rates to be applied under
			 this subsection, the Director may recommend realignment, co-location,
			 consolidation, or other type of action to improve space utilization.</text>
			</subsection><subsection id="H748D041D64CC4A0B8E298B39A5615295"><enum>(d)</enum><header>Submission to
			 the commission</header>
				<paragraph id="HE2EFD40231464F7DB56AF0016232D36B"><enum>(1)</enum><header>In
			 general</header><text>The standards, criteria, and recommendations developed
			 pursuant to subsection (b) shall be submitted to the Commission with all
			 supporting information, data, analyses, and documentation.</text>
				</paragraph><paragraph id="H7CF3ECEE36E74300B534B8A0C8640ECE"><enum>(2)</enum><header>Publication</header><text>The
			 standards, criteria, and recommendations shall be published in the Federal
			 Register and transmitted to the committees designated in section 5(c) and to
			 the Comptroller General of the United States.</text>
				</paragraph><paragraph id="H8367F07D803744EFB66CCF7DE259E1A0"><enum>(3)</enum><header>Access to
			 information</header><text display-inline="yes-display-inline">The Commission
			 shall also have access to all information pertaining to the recommendations,
			 including supporting information, data, analyses, and documentation submitted
			 pursuant to subsection (a). Upon request, Federal agencies shall provide, the
			 Commission any additional information pertaining to its properties.</text>
				</paragraph></subsection></section><section id="HF252D473B2A3406D98CB768E91D00DDE"><enum>12.</enum><header>Commission
			 duties</header>
			<subsection id="H702A22B362EB4AC08F7033C7ED153EE9"><enum>(a)</enum><header>Identification
			 of property reduction opportunities</header><text>The Commission shall identify
			 opportunities for the Government to reduce significantly its inventory of
			 civilian real property and reduce costs to the Government.</text>
			</subsection><subsection id="HF7A1596585804E2BA8712D162DBD30ED"><enum>(b)</enum><header>Identification
			 of high value assets</header>
				<paragraph id="HA6287B46CA4344A69A26B0DA78AB3155"><enum>(1)</enum><header>Identification
			 of certain properties</header><text>Not later than 180 days after Commission
			 members are appointed pursuant to section 4, the Commission shall identify not
			 less than 5 Federal properties that are not on the list of surplus or excess as
			 of such date with a total fair market value of not less than $500,000,000 and
			 transmit the list to the President and Congress as Commission recommendations
			 and subject to the approval process described in sections 13 and 14.</text>
				</paragraph><paragraph id="H0541829AE58B46859BF1E3946465E35E"><enum>(2)</enum><header>Information and
			 data</header><text>In order to meet the goal established under paragraph (1),
			 Federal agencies shall provide, upon receipt, any and all information and data
			 regarding its properties to the Commission. The Commission shall notify the
			 committees listed under section 5(c) of any failure by any agency to comply
			 with a request of the Commission.</text>
				</paragraph></subsection><subsection id="H27492FE75123442890A672FBCA64E210"><enum>(c)</enum><header>Analysis of
			 inventory</header><text display-inline="yes-display-inline">The Commission
			 shall perform an independent analysis of the inventory of Federal civilian real
			 property and the recommendations submitted pursuant to section 11. The
			 Commission shall not be bound or limited by the recommendations submitted
			 pursuant to section 11. If, in the opinion of the Commission, an agency fails
			 to provide needed information, data or adequate recommendations that meet the
			 standards and criteria, the Commission shall develop such recommendations as it
			 considers appropriate based on existing data contained in the Federal Real
			 Property Profile or other relevant information.</text>
			</subsection><subsection id="HB608CDEF3C464884B7BBE8CED1614F2F"><enum>(d)</enum><header>Receipt of
			 Information and Proposals</header><text>Notwithstanding any other provision of
			 law, the Commission may receive and consider proposals, information, and other
			 data submitted by State and local officials and the private sector. Such
			 information shall be made publically available.</text>
			</subsection><subsection id="H7630DB882AFD46DA80E0B5214F73319D"><enum>(e)</enum><header>Accounting
			 system</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Commission shall identify or develop and implement a system of
			 accounting to be used to independently evaluate the costs of and returns on the
			 recommendations. Such accounting system shall be applied in developing the
			 Commission’s recommendations and determining the highest return to the
			 taxpayer. In applying the accounting system, the Commission shall set a
			 standard performance period.</text>
			</subsection><subsection id="H4D118478B7384441A477D660A5481B8D"><enum>(f)</enum><header>Public
			 hearing</header><text>The Commission shall conduct public hearings. All
			 testimony before the Commission at a public hearing under this paragraph shall
			 be presented under oath.</text>
			</subsection><subsection id="H560ABE1D6C224C39B6E84958617C2768"><enum>(g)</enum><header>Reporting of
			 information and recommendations</header>
				<paragraph id="HBF561E1BDE7147319E736D8F079F1BBF"><enum>(1)</enum><header>In
			 general</header><text>Not later than 120 days after the receipt of
			 recommendations pursuant to section 11, and annually thereafter, the Commission
			 shall transmit to the President, and publicly post on a Federal website
			 maintained by the Commission a report containing the Commission’s findings,
			 conclusions, and recommendations for the consolidation, exchange, co-location,
			 reconfiguration, lease reductions, sale, and redevelopment of Federal civilian
			 real properties and for other operational efficiencies that can be realized in
			 the Government’s operation and maintenance of such properties.</text>
				</paragraph><paragraph id="H188C6527309F4EAEBE5EC02C4599AF59"><enum>(2)</enum><header>Recommendations
			 for sale or disposal of property</header><text display-inline="yes-display-inline">To the extent the Commission
			 recommendations include the sale or disposal of real property, these properties
			 may be reported as excess, declared surplus, or determined as no longer meeting
			 the needs of the Federal Government, excluding leasebacks or other such
			 exchange agreements where the property continues to be used by the Federal
			 Government.</text>
				</paragraph><paragraph id="H24FEFFD702D9401EBB4562649B728387"><enum>(3)</enum><header>Consensus in
			 majority</header><text>The Commission shall seek to develop consensus
			 recommendations, but if a consensus cannot be obtained, the Commission may
			 include in its report recommendations that are supported by a majority of the
			 Commission.</text>
				</paragraph></subsection><subsection id="H7C9FDB846E624103B712E19E4F29D9E4"><enum>(h)</enum><header>Federal
			 website</header><text>The Commission shall establish and maintain a Federal
			 website for the purposes of making relevant information publically
			 available.</text>
			</subsection><subsection id="H413CD6898E004E968E3B032932D2DA41"><enum>(i)</enum><header>Review by
			 GAO</header><text>The Comptroller General of the United States shall transmit
			 to the Congress and to the Commission a report containing a detailed analysis
			 of the recommendations and selection process.</text>
			</subsection></section><section id="H0D3A864C7B3F45778BF633E590049664"><enum>13.</enum><header>Review by the
			 president</header>
			<subsection id="HBE52CC42CD334D629D23B4997271828E"><enum>(a)</enum><header>Review of
			 recommendations</header><text>Upon receipt of the Commission’s recommendations,
			 the President shall conduct a review of such recommendations.</text>
			</subsection><subsection id="H2249E1931FF942898ECC9369EA20030D"><enum>(b)</enum><header>Report to
			 commission and congress</header><text>Not later than 30 days after receipt of
			 the Commission’s recommendations, the President shall transmit to the
			 Commission and Congress a report that sets forth the President’s approval or
			 disapproval of the Commission’s recommendations.</text>
			</subsection><subsection id="H1BD423DBB8DE476EB34D3DDDD0D54591"><enum>(c)</enum><header>Approval or
			 disapproval</header><text>If the President—</text>
				<paragraph id="HB7DB6F2F6A8A443397CE14DDB0D991CB"><enum>(1)</enum><text>approves of the
			 Commission’s recommendations, the President shall transmit a copy of the
			 recommendations to Congress, together with a certification of such
			 approval;</text>
				</paragraph><paragraph id="H11754F3F012048C89F22606293AF75C6"><enum>(2)</enum><text>disapproves of the
			 Commission’s recommendations, in whole or in part, the President shall also
			 transmit to the Commission and Congress the reasons for such disapproval. The
			 Commission shall then transmit to the President, not later than 30 days
			 following the disapproval, a revised list of recommendations;</text>
				</paragraph><paragraph id="H7BC4D638EC984EB5B0B481B676F2764B"><enum>(3)</enum><text>approves all of
			 the revised recommendations of the Commission, the President shall transmit a
			 copy of such revised recommendations to Congress, together with a certification
			 of such approval; or</text>
				</paragraph><paragraph id="HD09AFF9D083441F7A15928D2A8B1AF14"><enum>(4)</enum><text>does not transmit
			 to the Congress an approval and certification described in paragraphs (1) or
			 (3) within 30 days of receipt of the Commission’s recommendations or revised
			 recommendations, as the case may be, the process shall terminate until the
			 following year.</text>
				</paragraph></subsection></section><section commented="no" id="H21B8D11D730E43BF83B217D0FCC13C93"><enum>14.</enum><header>Congressional
			 consideration of the recommendations</header>
			<subsection commented="no" id="HC25445EB5CC2458289DF1AA76897D5B0"><enum>(a)</enum><header>Joint resolution
			 of approval</header><text display-inline="yes-display-inline">If a House of
			 Congress has not taken a vote on final passage of a joint resolution as
			 described in subsection (c) within 45 days after the President’s transmission
			 to that House of the approved recommendations pursuant to section 13, then such
			 vote shall be taken on the next day of session following the expiration of the
			 45-day period.</text>
			</subsection><subsection commented="no" id="H69A1450FEDB2461C97641BE214616D4A"><enum>(b)</enum><header>Computation of
			 time period</header><text>For the purposes of this section, the days on which
			 either House of Congress is not in session because of adjournment of more than
			 three days shall be excluded in the computation of the period of time.</text>
			</subsection><subsection commented="no" id="HDE02B9832209406C8AB23C7B216921BE"><enum>(c)</enum><header>Terms of the
			 resolution</header><text>For purposes of this section, the term <term>joint
			 resolution</term> means only a joint resolution—</text>
				<paragraph commented="no" id="H9A2545FB16394B58B79F1F663505EFA1"><enum>(1)</enum><text>which does not
			 have a preamble;</text>
				</paragraph><paragraph commented="no" id="H3A2FEF558EDC473A96114C1B780429F1"><enum>(2)</enum><text>the matter after
			 the resolving clause of which is as follows: <quote>That Congress approves the
			 recommendations of the Civilian Property Realignment Commission as submitted by
			 the President on _________, and notwithstanding any other provision of law, the
			 Federal agencies shall implement and carry out all of the Commission’s
			 recommendations pursuant to section 15 of the Civilian Property Realignment
			 Act</quote>, the blank space being filled in with the appropriate date;</text>
				</paragraph><paragraph commented="no" id="HCF3B989A78CA41D19052DD4F1ED39E62"><enum>(3)</enum><text>the title of which
			 is as follows: <quote>Joint resolution approving the recommendations of the
			 Civilian Property Realignment Commission</quote>; and</text>
				</paragraph><paragraph id="H54DE3F711A1540E6AFC999F73085F513"><enum>(4)</enum><text>which is
			 introduced pursuant to subsection (d).</text>
				</paragraph></subsection><subsection id="HFD1503FCD77D483FA898AB36894C97A0"><enum>(d)</enum><header>Introduction</header><text display-inline="yes-display-inline">After a House of Congress receives the
			 President’s transmission of approved recommendations pursuant to section 13,
			 the majority leader of that House (or a designee) shall introduce (by request,
			 if appropriate) a joint resolution described in subsection (c)—</text>
				<paragraph id="H5A7DA64B2D804CD5AEB7E1C973C61B31"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of the House of
			 Representatives, within three legislative days; and</text>
				</paragraph><paragraph id="HE7E6BC609113496BBCA85220DC67FCEE"><enum>(2)</enum><text>in the case of the
			 Senate, within three session days.</text>
				</paragraph></subsection><subsection commented="no" id="HBE3C95C7C4C04EE0B3B730238E3B05A1"><enum>(e)</enum><header>Consideration in
			 the House of Representatives</header>
				<paragraph id="HEAE934222D1243C8801FC92A3AD112AD"><enum>(1)</enum><header>Referral and
			 reporting</header><text display-inline="yes-display-inline">Any committee of
			 the House of Representatives to which a joint resolution is referred shall
			 report it to the House without amendment not later than the tenth legislative
			 day after the date of its introduction. If a committee fails to report the
			 joint resolution within that period, it shall be in order to move that the
			 House discharge the committee from further consideration of the joint
			 resolution. Such a motion shall be in order only at a time designated by the
			 Speaker in the legislative schedule within three legislative days after the day
			 on which the proponent announces his intention to offer the motion. Notice may
			 not be given on an anticipatory basis. Such a motion shall not be in order
			 after the House has disposed of a motion to discharge a joint resolution. The
			 previous question shall be considered as ordered on the motion to its adoption
			 without intervening motion except twenty minutes of debate equally divided and
			 controlled by the proponent and an opponent. If such a motion is adopted, the
			 House shall proceed immediately to consider the joint resolution in accordance
			 with paragraph (3). A motion to reconsider the vote by which the motion is
			 disposed of shall not be in order.</text>
				</paragraph><paragraph id="H3DFD67ED904C4FD881C73F0631895063"><enum>(2)</enum><header>Proceeding to
			 consideration</header><text display-inline="yes-display-inline">After the last
			 committee authorized to consider a joint resolution reports it to the House or
			 has been discharged (other than by motion) from its consideration, it shall be
			 in order to move to proceed to consider the joint resolution in the House. Such
			 a motion shall be in order only at a time designated by the Speaker in the
			 legislative schedule within three legislative days after the day on which the
			 proponent announces his intention to offer the motion. Notice may not be given
			 on an anticipatory basis. Such a motion shall not be in order after the House
			 has disposed of a motion to proceed with respect to that transmittal of
			 recommendations. The previous question shall be considered as ordered on the
			 motion to its adoption without intervening motion. A motion to reconsider the
			 vote by which the motion is disposed of shall not be in order.</text>
				</paragraph><paragraph id="H9F9ADB80A9D14AA592AAC75454BC1270"><enum>(3)</enum><header>Consideration</header><text display-inline="yes-display-inline">The joint resolution shall be considered as
			 read. All points of order against a joint resolution and against its
			 consideration are waived. The previous question shall be considered as ordered
			 on a joint resolution to its passage without intervening motion except five
			 hours of debate equally divided and controlled by the proponent and an opponent
			 and one motion to limit debate on the joint resolution. A motion to reconsider
			 the vote on passage of the joint resolution shall not be in order.</text>
				</paragraph><paragraph id="HD2C68B1F656347CCBEBF640C5FCF7396"><enum>(4)</enum><header>Post sine
			 die</header><text display-inline="yes-display-inline">If the House has adopted
			 a concurrent resolution providing for adjournment sine die at the end of a
			 Congress, a motion to discharge under paragraph (1) or a motion to proceed
			 under subparagraph (2) shall be in order as applicable.</text>
				</paragraph></subsection><subsection commented="no" id="H3F3D3B2D9F9B49BA876FAFEFA1E10AE0"><enum>(f)</enum><header>Consideration in
			 the Senate</header>
			</subsection><subsection id="H3286DEE4214B44B6AE4CABDD2D8FD4EC"><enum>(g)</enum><header>Amendments
			 prohibited</header><text display-inline="yes-display-inline">No amendment to,
			 or motion to strike a provision from, a joint resolution considered under this
			 section shall be in order in either the Senate or the House of
			 Representatives.</text>
			</subsection><subsection id="H3D1C1137EAD143069F9E579730383798"><enum>(h)</enum><header>Consideration by
			 other House</header>
				<paragraph id="H759853E4376E41C892404054C2474C50"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If, before the
			 passage by one House of a joint resolution of that House described in
			 subsection (c), that House received from the other House a joint resolution
			 described in subsection (c), then the following procedures shall apply:</text>
					<subparagraph id="H579632F0BE7D4D97BEB2E004B3A4335D"><enum>(A)</enum><header>No committee
			 referral</header><text display-inline="yes-display-inline">The joint resolution
			 of the other House shall not be referred to a committee and may not be
			 considered in the House receiving it except in the case of final passage as
			 provided in subparagraph (B).</text>
					</subparagraph><subparagraph id="H177561A3F8BC4F31B789721B27B3E3C1"><enum>(B)</enum><header>Joint resolution
			 procedure</header><text display-inline="yes-display-inline">With respect to a
			 joint resolution described in subsection (c) of the House receiving the joint
			 resolution the procedure in that House shall be the same as if no joint
			 resolution had been received from the other House, but the vote on final
			 passage shall be on the joint resolution of the other House.</text>
					</subparagraph></paragraph><paragraph id="H6595601718E74774AE3D6541C67526D2"><enum>(2)</enum><header>No
			 consideration</header><text display-inline="yes-display-inline">Upon
			 disposition of the joint resolution received from the other House, it shall no
			 longer be in order to consider the joint resolution that originated in the
			 receiving House.</text>
				</paragraph><paragraph id="HD553AD1232194B92A01E16A99BC7B134"><enum>(3)</enum><header>Exception</header><text>This
			 subsection shall not apply to the House of Representatives if the joint
			 resolution received from the Senate is a revenue measure.</text>
				</paragraph></subsection><subsection id="HF47F47BFAA14429A9878EE9747F8B2AD"><enum>(i)</enum><header>Rules of the
			 Senate and House</header><text display-inline="yes-display-inline">This section
			 is enacted by Congress—</text>
				<paragraph id="HE7C2545CC6FC4AAEA38E414E0B97D7D4"><enum>(1)</enum><text>as an exercise of
			 the rulemaking power of the Senate and House of Representatives, respectively,
			 and as such it is deemed a part of the rules of each House, respectively, but
			 applicable only with respect to the procedure to be followed in that House in
			 the case of a joint resolution described in this section, and it supersedes
			 other rules only to the extent that it is inconsistent with such rules;
			 and</text>
				</paragraph><paragraph id="H2E58C396645547EAB95CD72DD88D7CE3"><enum>(2)</enum><text>with full
			 recognition of the constitutional right of either House to change the rules (so
			 far as relating to the procedure of that House) at any time, in the same
			 manner, and to the same extent as in the case of any other rule of that
			 House.</text>
				</paragraph></subsection></section><section id="H6851CA57303041C288042CA7BBFA17FF"><enum>15.</enum><header>Implementation
			 of commission recommendations</header>
			<subsection id="H1548BB0CD1DD42449EED0EB3EE00B3E7"><enum>(a)</enum><header>Carrying out
			 recommendations</header><text>Upon the enactment of a joint resolution
			 described in section 14(c), Federal agencies shall immediately begin
			 preparation to carry out the Commission’s recommendations and shall initiate
			 all activities no later than 2 years after the date on which the President
			 transmits the recommendations to Congress. Federal agencies shall complete all
			 recommended actions no later than the end of the 6-year period beginning on the
			 date on which the President transmits the Commission’s recommendations to
			 Congress. All actions shall be economically beneficial and be cost neutral or
			 otherwise favorable to the Government. For actions that will take longer than
			 the 6-year period due to extenuating circumstances, each Federal agency shall
			 notify the President and Congress as soon as the extenuating circumstance
			 presents itself with an estimated time to complete the relevant action.</text>
			</subsection><subsection id="H82CC62C4AC6745F99DCC5BEB4599CC0F"><enum>(b)</enum><header>Actions of
			 Federal agencies</header><text>In taking actions related to any Federal
			 building or facility under this Act, Federal agencies may, pursuant to
			 subsection (c), take all such necessary and proper actions, including—</text>
				<paragraph id="H14D7880C158E400D912930CD2FDA1F44"><enum>(1)</enum><text>acquiring land,
			 constructing replacement facilities, performing such other activities, and
			 conducting advance planning and design as may be required to transfer functions
			 from a Federal asset or property to another Federal civilian property;
			 and</text>
				</paragraph><paragraph id="H6FE63C38F5E342ADB43B21C48211B23A"><enum>(2)</enum><text>reimbursing other
			 Federal agencies for actions performed at the request of the Commission.</text>
				</paragraph></subsection><subsection id="HDE9356637C334811B02594B438672251"><enum>(c)</enum><header>Necessary and
			 Proper actions</header><text display-inline="yes-display-inline">When acting on
			 a recommendation of the Commission, a Federal agency shall continue to act
			 within their existing legal authorities, whether such authority has been
			 delegated by the Administrator, or must work in partnership with the
			 Administrator to carry out such actions. The Administrator may take such
			 necessary and proper actions, including the sale, conveyance, or exchange of
			 civilian real property, as required to implement the Commission recommendations
			 in the time period required under subsection (a).</text>
			</subsection><subsection id="H08F082BB957645C989FA62915064DBF1"><enum>(d)</enum><header>Discretion of
			 Administrator regarding transactions</header><text>For any transaction
			 identified, recommended, or commenced as a result of this Act, any otherwise
			 required legal priority given to, or requirement to enter into, a transaction
			 to convey a Federal civilian real property for less than fair market value, for
			 no consideration at all, or in a transaction that mandates the exclusion of
			 other market participants, shall be at the discretion of the
			 Administrator.</text>
			</subsection><subsection id="H011DAA929AC54DC587EE5A000626C404"><enum>(e)</enum><header>McKinney-Vento
			 homeless assistance act review</header><text display-inline="yes-display-inline">Upon the enactment of a joint resolution
			 described in section 14(c) and for not more than 90 days after such enactment,
			 the Secretary of Housing and Urban Development shall apply section 501 of the
			 McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411</external-xref>) to the extent
			 practicable, to any buildings identified for disposal in the approved
			 recommendations that are not more than 25,000 square feet or valued at less
			 than $5,000,000.</text>
			</subsection></section><section commented="no" id="H92EF10FA19A94C19ACF557438051F492"><enum>16.</enum><header>Authorization of
			 appropriations</header>
			<subsection commented="no" id="H1464872A814F4396AD83C56A44956B38"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is authorized a
			 one-time appropriation to carry out this Act in the following amounts:</text>
				<paragraph commented="no" id="HE0DB5E2169A94CF3A59DE5F4A6CE5C10"><enum>(1)</enum><text>$20,000,000 for
			 salaries and expenses of the Commission.</text>
				</paragraph><paragraph commented="no" id="HF814E8F93BE3408EB4EEC2C85E583FF3"><enum>(2)</enum><text>$62,000,000 to be
			 deposited into the Asset Proceeds and Space Management Fund for activities
			 related to the implementation of the Commission recommendations.</text>
				</paragraph></subsection><subsection commented="no" id="HA778A43428A0480EBA865477EB902950"><enum>(b)</enum><header>Federal
			 Buildings Fund</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated from the Federal Buildings Fund established under
			 <external-xref legal-doc="usc" parsable-cite="usc/40/592">section
			 592</external-xref> of title 40, United States Code, for construction and
			 acquisition activities $0 for fiscal year 2012.</text>
			</subsection></section><section id="H96955A774E944139AC62A9EA018E7D57"><enum>17.</enum><header>Funding</header>
			<subsection id="HE5C06CBE8D6B408393308E29B7A70B0C"><enum>(a)</enum><header>Creation of
			 salaries and expenses account</header>
				<paragraph id="HB6DD1DA59DE142A4AFFA4FD988AB20F7"><enum>(1)</enum><header>Establishment of
			 account</header><text display-inline="yes-display-inline">There is hereby
			 established on the books of the Treasury an account to be known as the
			 <quote>Civilian Property Realignment Commission—Salaries and Expenses</quote>
			 account.</text>
				</paragraph><paragraph id="H17B66E57AE504E42BFC3DAEBEC34EF57"><enum>(2)</enum><header>Necessary
			 payments</header><text>There shall be deposited into the account such amounts,
			 as are provided in appropriations Acts, for those necessary payments for
			 salaries and expenses to accomplish the administrative needs of the
			 Commission.</text>
				</paragraph></subsection><subsection id="H435972EA329C4D69AFDF01C5DE053E50"><enum>(b)</enum><header>Creation of
			 asset proceeds and space management fund</header><text display-inline="yes-display-inline">There is hereby established within the
			 Federal Buildings Fund established under
			 <external-xref legal-doc="usc" parsable-cite="usc/40/592">section
			 592</external-xref> of title 40, United States Code, an account to be known as
			 the <quote>Civilian Property Realignment Commission—Asset Proceeds and Space
			 Management Fund</quote> which shall be used solely for the purposes of carrying
			 out actions pursuant to the Commission recommendations approved under section
			 14. Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/40/3307">section 3307</external-xref> of title 40, United
			 States Code, the following amounts shall be deposited into the account and made
			 available for obligation or expenditure only as provided in advance in
			 appropriations Acts for the purposes specified:</text>
				<paragraph id="H20F2C816F10942DC8C33BC1E080D25AE"><enum>(1)</enum><text>Such amounts as
			 are provided in appropriations Acts, to remain available until expended, for
			 the consolidation, co-location, exchange, redevelopment, re-configuration of
			 space, disposal, and other actions recommended by the Commission for Federal
			 agencies.</text>
				</paragraph><paragraph id="HD19FCDCC7D804E0E897029F84CA6F4F6"><enum>(2)</enum><text display-inline="yes-display-inline">Amounts received from the sale of any
			 civilian real property action taken pursuant to a recommendation of the
			 Commission under section 15. As provided in appropriations Acts, such proceeds
			 may be made available to cover necessary costs associated with implementing the
			 recommendations pursuant to section 15, including costs associated with—</text>
					<subparagraph id="H084F779D397F46E188B245749E8CF7AD"><enum>(A)</enum><text display-inline="yes-display-inline">sales transactions;</text>
					</subparagraph><subparagraph id="H25F24B0068ED4E01A109FC5C997E8506"><enum>(B)</enum><text display-inline="yes-display-inline">acquiring land, construction, constructing
			 replacement facilities, conducting advance planning and design as may be
			 required to transfer functions from a Federal asset or property to another
			 Federal civilian property;</text>
					</subparagraph><subparagraph id="H50A9F613C5984358A37948AC083E4224"><enum>(C)</enum><text>co-location,
			 redevelopment, disposal, and reconfiguration of space; and</text>
					</subparagraph><subparagraph id="H0CC8F307F2C54360A815AA19B06923B6"><enum>(D)</enum><text display-inline="yes-display-inline">other actions recommended by the Commission
			 for Federal agencies.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HB0B8C8FE35F64B3EA098EDE00A22498A"><enum>(c)</enum><header>Additional
			 requirement for budget contents</header><text display-inline="yes-display-inline">The President’s budget submitted pursuant
			 to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section
			 1105</external-xref> of title 31, United States Code, shall include an estimate
			 of proceeds that are the result of the Commission’s recommendations and the
			 obligations and expenditures needed to support such recommendations.</text>
			</subsection></section><section id="H1597AF2A71F9452DA3C5C68151F08524"><enum>18.</enum><header>Disposal of real
			 properties</header>
			<subsection id="H96666A8C09B840A08FC35A30997561AB"><enum>(a)</enum><header>Environmental
			 considerations</header>
				<paragraph commented="no" id="H4CFB837142D74DE990AB98ACB2AE1464"><enum>(1)</enum><header>Applicability of
			 other law</header><text display-inline="yes-display-inline">Public Law 91–190,
			 as amended, shall not apply to activities under section 11 of this Act.</text>
				</paragraph><paragraph commented="no" id="H7F54B47D72AC47DDAA598503C1829FA4"><enum>(2)</enum><header>Civil
			 action</header><text display-inline="yes-display-inline">A civil action for
			 judicial review, with respect to any requirement of
			 <external-xref legal-doc="public-law" parsable-cite="pl/91/190">Public Law
			 91–190</external-xref>, as amended, to the extent such public law is applicable
			 to the actions under section 15 of this Act, of any act or failure to act by a
			 Federal agency during the closing, realigning, or relocating of functions under
			 this Act, may not be brought more than 60 days after the date of such act or
			 failure to act.</text>
				</paragraph><paragraph id="H9995197ACF9F464DB3FBBA1DF660CD83"><enum>(3)</enum><header>Transfer of real
			 property</header>
					<subparagraph id="H3B1DD4A3425A4E1190DC949B9E44ED68"><enum>(A)</enum><header>In
			 general</header><text>When implementing the recommended actions pursuant to
			 section 15 for properties that have been identified in the Commission’s
			 recommendations and in compliance with the Comprehensive Environmental
			 Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et
			 seq.</external-xref>), including section 120(h) thereof (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)</external-xref>),
			 Federal agencies may enter into an agreement to transfer by deed real property
			 with any person.</text>
					</subparagraph><subparagraph id="H891F66D732054C2F815A6D1B0A13AF6D"><enum>(B)</enum><header>Additional
			 terms</header><text>The head of the disposing agency may require any additional
			 terms and conditions in connection with an agreement authorized by subparagraph
			 (A) as the head of the disposing agency considers appropriate to protect the
			 interests of the United States. Such additional terms and conditions shall not
			 affect or diminish any rights or obligations of the federal agencies under
			 CERCLA section 120(h) (including, without limitation, the requirements CERCLA
			 section 120(h)(3)(A) and CERCLA section 120(h)(3)(C)(iv)).</text>
					</subparagraph></paragraph><paragraph id="H565D5D5A5F8D45EF9110878487D55740"><enum>(4)</enum><header>Information
			 disclosure</header><text>As part of an agreement pursuant to this Act, the
			 agency shall disclose to the person to whom the property or facilities will be
			 transferred any information of the Federal agency regarding the environmental
			 restoration, waste management, and environmental compliance activities
			 described in this Act that relate to the property or facilities. The agency
			 shall provide such information before entering into the agreement.</text>
				</paragraph></subsection><subsection id="H1554060C37074C829F81477DF6ADAC5E"><enum>(b)</enum><header>Construction of
			 certain Acts</header><text>Nothing in this section shall be construed to
			 modify, alter, or amend the Comprehensive Environmental Response, Compensation,
			 and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) or the
			 Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>).</text>
			</subsection></section><section id="H5FB95C67BA7F4EFD96964FFE40136E75"><enum>19.</enum><header>Congressional
			 approval of proposed projects</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307(b)</external-xref> of
			 title 40, United States Code is amended—</text>
			<paragraph id="H16179EFBABAD4668A1F53C00B561D049"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
			</paragraph><paragraph id="HF6F1CA5739864C5BAFC0CC0E146C3FC9"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="HFEA2BB70E21145D8B79D941123B68427"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HB8B98C09C8C640A6A1A9581A44D8BFD6">
					<paragraph id="H1F307337F11E4D4BB9233B2F6334DF7B"><enum>(8)</enum><text>a statement of how
				the proposed project is consistent with section 11(b) of the Civilian Property
				Realignment
				Act.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H53360AA26A304422AECC19F57C50E4EC"><enum>20.</enum><header>Limitation of
			 certain leasing authorities</header>
			<subsection id="H74610D41E065423BB0E8E9B701A7BEAD"><enum>(a)</enum><header>Limitation on
			 certain leasing authorities</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H55E9C0B4D58841A29847EA4D9C8BEB26" style="USC">
					<section id="H1D15B6D5E7C64EF8A609C5FBA578F2AC" section-type="undesignated-section"><enum>§ 3317.</enum><header>Limitation on
				leasing authority of other agencies</header>
						<subsection id="HB1F0FAA155D7480B9282198EACC1BC5E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, no executive agency may lease space for the purposes of
				a public building as defined under section 3301, except as provided under
				section 585, and the provisions in this chapter.</text>
						</subsection><subsection id="H493DEBC014F14BA4BB7112D0E69C040F"><enum>(b)</enum><header>Public
				building</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <term>public building</term> shall include leased
				space.</text>
						</subsection><subsection id="HF31C8B21ED1B4AE8AB3CEE62393A76F3"><enum>(c)</enum><header>Further
				exclusions</header><text display-inline="yes-display-inline">This section shall
				not apply to—</text>
							<paragraph id="HD0548D1BA7CF4C8D8FDF99695086C9E8"><enum>(1)</enum><text>properties that
				are excluded for reasons of national security by the President; and</text>
							</paragraph><paragraph id="HEDBBE405E0DE4002AE51C162D8EC2C5E"><enum>(2)</enum><text>properties of the
				Department of Veterans Affairs.</text>
							</paragraph></subsection><subsection id="H8B6442F7865B4F32BE5ACE542D39EF80"><enum>(d)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				as creating new authority for executive agencies to enter into leases or limit
				the authority of the Administration under section
				3314.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEF3482D4C6994B8ABE4A644899344501"><enum>(b)</enum><header>Small
			 businesses</header><text display-inline="yes-display-inline">When using
			 commercial leasing services, the Administrator shall adhere to the requirements
			 of the Small Business Act (15 U.S.C. et seq.).</text>
			</subsection><subsection id="H324D149C1D2F4C5FA5176A25DEF2BBC5"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end:</text>
				<quoted-block display-inline="no-display-inline" id="H0352D8A693B44806B46D15E7CF8FAF86" style="USC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">3317. Limitation on leasing authority of
				other
				agencies.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H91EBCD8C4E4E45979E90E689F4E5AF33"><enum>21.</enum><header>Implementation
			 review by GAO</header><text display-inline="no-display-inline">Upon transmittal
			 of the Commission’s recommendations from the President to the Congress under
			 section 13, the Comptroller General of the United States at least annually
			 shall monitor, review the implementation activities of Federal agencies
			 pursuant to section 15, and report to Congress any findings and
			 recommendations.</text>
		</section><section id="HC57463B3DF4642FE8A8573E2417D80AA"><enum>22.</enum><header>Sense of
			 Congress and reports</header>
			<subsection id="H3FF6BAC3814D4CC79864381BD97FA1A2"><enum>(a)</enum><header>Sense of
			 congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="H14D602EBD2E04863947369B378146E63"><enum>(1)</enum><text display-inline="yes-display-inline">the Civilian Property Realignment
			 Commission, should take steps to provide assistance to small, minority, and
			 woman-owned businesses seeking to be awarded contracts to redevelop federal
			 property;</text>
				</paragraph><paragraph id="HBBB6211AC8164ED4AD406331C5F55746"><enum>(2)</enum><text display-inline="yes-display-inline">the Civilian Property Realignment
			 Commission and other appropriate Federal officials should conduct a public
			 information campaign to advise small, minority, and women-owned business firms
			 with respect to contracts for the sale or redevelopment of Federal property;
			 and</text>
				</paragraph><paragraph id="H4A4BD25568B34F6B9A8735BF7EADCAAA"><enum>(3)</enum><text>firms that are
			 awarded contracts pertaining to the redevelopment of Federal property should,
			 to the maximum extent practicable, seek to award subcontracts for such
			 contracts to small, minority, and women-owned business firms.</text>
				</paragraph></subsection><subsection id="H36A2EDAB235E45F6934AB9A44924ACB4"><enum>(b)</enum><header>Progress
			 reports</header><text>Every 6 months, the Civilian Property Realignment
			 Commission shall submit to the appropriate committees of Congress and the
			 President, a report regarding contracting. Each such report shall indicate, as
			 of the date of the submission of such report, the size of all business firms
			 awarded contracts by the Commission and the size of all business firms awarded
			 subcontracts under such contracts.</text>
			</subsection></section><section commented="no" id="HE540E9FCA7FF4B729D501FC8C19402BB"><enum>23.</enum><header>Consideration of
			 Life-Cycle<enum-in-header></enum-in-header> cost required</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3305">Section 3305</external-xref> of
			 title 40, United States Code, is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HD886047B2D574C90832F04B82E29EFD1" style="USC">
				<subsection id="HB1F1C353D7074F2B99ECC7B7ABB12199"><enum>(d)</enum><header>Consideration of
				life-<enum-in-header>C</enum-in-header>ycle cost required</header>
					<paragraph commented="no" id="HB2B567DCCDED4CF4AA36F2AB96F6AA4F"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Administrator shall ensure that the
				life-cycle cost of a public building is considered in the construction or lease
				of a public building described in paragraph (2).</text>
					</paragraph><paragraph commented="no" id="HDEEB2387E46C4635B0B0DD0E1665A25B"><enum>(2)</enum><header>Federal
				buildings subject to requirement</header><text>A public building is subject to
				the requirement under paragraph (1) if—</text>
						<subparagraph commented="no" id="H5D0022D0751B4200BD62AD32CF045F7B"><enum>(A)</enum><text>construction or
				lease of the building begins after the date of the enactment of the Civilian
				Property Realignment Act;</text>
						</subparagraph><subparagraph commented="no" id="H034DBC59DED24B89890EE1B747DB6DF0"><enum>(B)</enum><text>the estimated
				construction costs of the building exceed $1,000,000;</text>
						</subparagraph><subparagraph id="H5B26F915414D47F29AC639F4FAD9760C"><enum>(C)</enum><text>in the case of a
				lease, the square footage of the property is more than 25,000 square feet;
				and</text>
						</subparagraph><subparagraph commented="no" id="HC93F1CEE5A2741FBBD8950F63467E916"><enum>(D)</enum><text>Federal funding
				comprises more than 50 percent of the funding for the estimated construction or
				lease costs of the building.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H16FF4667ADC441B2B7DCCCB17A44B573"><enum>(3)</enum><header>Definitions</header><text>In
				this subsection, the following definitions apply:</text>
						<subparagraph commented="no" id="HB84714748EC94BA99D108AB62A2375BF"><enum>(A)</enum><header>Life-cycle
				cost</header><text display-inline="yes-display-inline">The term
				<term>life-cycle cost</term> means the sum of the following costs, as estimated
				for the lifetime of a building:</text>
							<clause commented="no" id="H0F928BE220C444AFB36B00E96E8834B1"><enum>(i)</enum><text>Investment
				costs.</text>
							</clause><clause commented="no" id="H21C242E25B8B4D30A5F632ACF68BEF31"><enum>(ii)</enum><text>Capital
				costs.</text>
							</clause><clause commented="no" id="HA90A5DAFCD744985A965E8DBB0842999"><enum>(iii)</enum><text>Installation
				costs.</text>
							</clause><clause commented="no" id="H1A914F02C9E84FC193AA68E82DC84323"><enum>(iv)</enum><text>Energy
				costs.</text>
							</clause><clause commented="no" id="H345A3C5932E044AC9D2B7485EC0E5477"><enum>(v)</enum><text>Operating
				costs.</text>
							</clause><clause commented="no" id="H6D3A9FFA9DC34A11AC71F8439B255081"><enum>(vi)</enum><text>Maintenance
				costs.</text>
							</clause><clause commented="no" id="H0192070C2BF94624B7ECEFB88EF5434B"><enum>(vii)</enum><text>Replacement
				costs.</text>
							</clause></subparagraph><subparagraph commented="no" id="H04C32E25D9834ABABFF0582C4ECB6CD0"><enum>(B)</enum><header>Lifetime of a
				building</header><text>The term <term>lifetime of a building</term> means, with
				respect to a building, the greater of—</text>
							<clause id="H1D36DC2DC2774D9B934509C5C633D29E"><enum>(i)</enum><text>the period of time
				during which the building is projected to be utilized; or</text>
							</clause><clause id="H624EB9B38993441AAD30DE6FED4335C6"><enum>(ii)</enum><text display-inline="yes-display-inline">50
				years.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD98773320CE7440BB161E04F847679A1"><enum>24.</enum><header>Long-term
			 savings through life-cycle cost analysis</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307(b)</external-xref> of
			 title 40, United States Code, as amended by section 19, is further
			 amended—</text>
			<paragraph id="HF4E41F52902B4925BC1754060C9D650B"><enum>(1)</enum><text>in paragraph (7),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H380D7F300D2A4A4DBA5B5DC9301CBF42"><enum>(2)</enum><text>in paragraph (8),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="H5AB27E52FB98423F921915B6E14A3364"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HAF5CED34A3C145E78EA7AB437BBC3E8E" style="OLC">
					<paragraph id="H10028A41084043E8B2AFFA216499E9BC"><enum>(9)</enum><text display-inline="yes-display-inline">with respect to any prospectus for the
				construction, alteration, or acquisition of any building or space to be leased,
				a statement by the Administrator describing the use of life-cycle cost analysis
				and any increased design, construction, or acquisition costs identified by such
				analysis that are offset by lower long-term
				costs.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
