		<section id="HF0D283BD831C4B6BA4459F1AF0B57E3B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nuclear Disaster Preparedness Act</short-title></quote>.</text>
		</section><section id="HBE7C603FDB214C6B98C8A6ACFA55445E" section-type="subsequent-section"><enum>2.</enum><header>Guidance for response
			 to a nuclear disaster</header>
			<subsection id="HF8D46DB6DC3044FCA57D0E0FA607D5CC"><enum>(a)</enum><header>Issuance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the President, in consultation with the Secretary of
			 Energy, the Secretary of Defense, the Administrator of the Environmental
			 Protection Agency, the Nuclear Regulatory Commission, the Secretary of Homeland
			 Security, and the Administrator of the Federal Emergency Management Agency,
			 shall issue guidance on Federal response to nuclear disasters described in
			 subsection (b).</text>
			</subsection><subsection id="HD8CCE513F594460C84151E1DB8F7F00E"><enum>(b)</enum><header>Nuclear
			 disasters described</header><text>The guidance issued pursuant to subsection
			 (a) shall be with respect to any nuclear disaster that—</text>
				<paragraph id="H633DE2E56DB84C4E891A46C432EFB3B5"><enum>(1)</enum><text>may be caused by a
			 natural catastrophe, an accident, or a terrorist or other attack;</text>
				</paragraph><paragraph id="H104F4427DBD443BB9C7B38CB7CED71FA"><enum>(2)</enum><text>occurs initially
			 at a nuclear power plant; and</text>
				</paragraph><paragraph id="H2F04D187B46B4E4FA95E1B4F8FB14612"><enum>(3)</enum><text>disperses
			 radiation off the reactor site and into the surrounding area.</text>
				</paragraph></subsection><subsection id="H18082E64CE7F4B288713339A717C759A"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">The guidance issued pursuant to subsection
			 (a) shall—</text>
				<paragraph id="HD8DCFE6BAF1E4F5DBEDB500158883438"><enum>(1)</enum><text display-inline="yes-display-inline">designate the Federal agency that is
			 responsible for coordinating the Federal Government’s efforts in response to a
			 nuclear disaster (in this Act referred to as the <quote>Coordinating
			 Agency</quote>), including making a formal declaration that a nuclear disaster
			 exists;</text>
				</paragraph><paragraph id="H8D17D5816F594CC4893983C79EAD8643"><enum>(2)</enum><text>identify the
			 circumstances under which a formal declaration described in paragraph (1) will
			 occur;</text>
				</paragraph><paragraph id="H66098EE709F34728A1BA90704CD3AD68"><enum>(3)</enum><text display-inline="yes-display-inline">designate the Federal agency that is
			 responsible for recommending to the Coordinating Agency the evacuation of an
			 area surrounding a nuclear power plant in response to a nuclear
			 disaster;</text>
				</paragraph><paragraph id="HDC51CFFD2A844131AA53E3ECD7606CD3"><enum>(4)</enum><text>identify the
			 circumstances under which a recommendation described in paragraph (3) will be
			 made;</text>
				</paragraph><paragraph id="HFD6B5ED7EC9944E89B98003B66E86DAB"><enum>(5)</enum><text>designate the
			 Federal agency that is responsible for conducting an evacuation described in
			 paragraph (3) when directed to do so by the Coordinating Agency;</text>
				</paragraph><paragraph id="H401DE1D2E6304E37B9623624560C9EB9"><enum>(6)</enum><text>designate the
			 Federal agency that is responsible for recommending to the Coordinating Agency
			 that evacuees may return following a nuclear disaster;</text>
				</paragraph><paragraph id="HB786E603D7C64CC88D3A6DBE8B86191B"><enum>(7)</enum><text>identify the
			 circumstances under which a recommendation described in paragraph (6) will be
			 made;</text>
				</paragraph><paragraph id="H4A56BFEEB02B434FAF958CB179E85AF1"><enum>(8)</enum><text display-inline="yes-display-inline">identify what cleanup standards will apply
			 for a nuclear disaster;</text>
				</paragraph><paragraph id="HD2DD28D00CAB4EE683AC36E183BEEDDE"><enum>(9)</enum><text>designate the
			 Federal agency that is responsible for conducting cleanup of a nuclear disaster
			 when directed to do so by the Coordinating Agency; and</text>
				</paragraph><paragraph commented="no" id="H605E8D83BF9946F7B3079D9233D84DA3"><enum>(10)</enum><text>identify any
			 other roles and responsibilities of any Federal agency involved in the response
			 effort to a nuclear disaster.</text>
				</paragraph></subsection></section></legis-body>
