			 period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the
			 committee concerned</action-desc>

		<legis-type>A BILL</legis-type>
		<official-title>To require the use of American iron, steel, and
		  manufactured goods in the construction, alteration, and repair of public water
		  systems and treatment works.</official-title>

		<section id="HF431EA7ECA1E4408B3772309A2D8AA56" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keep American Jobs from Going Down the
			 Drain Act</short-title></quote>.</text>
		</section><section id="H84101965B7564DC2A378B5143BAF2D80"><enum>2.</enum><header>Requirement for
			 use of American materials in public water systems</header><text display-inline="no-display-inline">Section 1452(a) of the Safe Drinking Water
			 Act (42 U.S.C. 300j–12(a)) is amended by adding at the end the
			 following:</text>
			<quoted-block id="HE703B0959D5E47D0883E1FE7F16F41FF" style="OLC">
				<paragraph id="HB5E530CF47CC43C1B0EE243F58C8EFE4"><enum>(4)</enum><header>Requirement for
				use of American materials</header>
					<subparagraph id="H1600840DE4D04C06B56924C921941D81"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, none of the
				funds made available by a State loan fund as authorized under this section may
				be used for a project for the construction, alteration, maintenance, or repair
				of a public water system unless the steel, iron, and manufactured goods used in
				such project are produced in the United States.</text>
					</subparagraph><subparagraph id="H2FEDC5419A0843B79944CAD8F06C4BC8"><enum>(B)</enum><header>Waivers</header><text>Subparagraph
				(A) shall not apply in any case in which the Administrator, in consultation
				with the Governor of the State, finds that—</text>
						<clause id="HF98BA0C8902447C7A888B77179520464"><enum>(i)</enum><text>applying
				subparagraph (A) would be inconsistent with the public interest;</text>
						</clause><clause id="H884236673D874ABBAE824CDF79440DDD"><enum>(ii)</enum><text>the steel, iron,
				and manufactured goods are not produced in the United States in sufficient and
				reasonably available quantities and of a satisfactory quality; or</text>
						</clause><clause id="HDD2FACD2B7CB4AE5983F64F89ADD9445"><enum>(iii)</enum><text>inclusion of
				steel, iron, and manufactured goods produced in the United States will increase
				the cost of the overall project by more than 25 percent.</text>
						</clause></subparagraph><subparagraph id="H5E1674DE4DAD4AC7A616B5FE8C2476EC"><enum>(C)</enum><header>Public
				notification and written justification for waiver</header><text>If the
				Administrator determines that it is necessary to waive the application of
				subparagraph (A) based on a finding under subparagraph (B), the Administrator
				shall—</text>
						<clause id="H01C3CDA7C60148C08D0732592EDFD884"><enum>(i)</enum><text>not less than 15
				days prior to waiving the application of subparagraph (A), provide public
				notice and the opportunity to comment on the Administrator’s intent to issue
				such waiver; and</text>
						</clause><clause id="H2B37C6632D714DF2B68578E746B570BC"><enum>(ii)</enum><text>upon issuing such
				waiver, publish in the Federal Register a detailed written justification as to
				why the provision is being waived.</text>
						</clause></subparagraph><subparagraph id="H81C1F8C9EE4F4CEE9944DFA4DEAE594F"><enum>(D)</enum><header>Consistency with
				international agreements</header><text>This paragraph shall be applied in a
				manner consistent with United States obligations under international
				agreements.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0980E279ACB24BE7A5056C5B981FECED"><enum>3.</enum><header>Requirement for
			 use of American materials in treatment works</header><text display-inline="no-display-inline">Title VI Federal Water Pollution Control Act
			 (33 U.S.C. 1381 et seq.) is amended—</text>
			<paragraph display-inline="no-display-inline" id="H96A6500C9B6744D58B7340BA73958080"><enum>(1)</enum><text>by redesignating
			 section 607 as section 608; and</text>
			</paragraph><paragraph id="H53C0DDE351A14C5DAD81B98AF3EA7A09"><enum>(2)</enum><text>by inserting after
			 section 606 the following:</text>
				<quoted-block id="HE70888A2E9964A6FB0A5B571CEBA478F" style="OLC">
					<section id="H3B1D96AACC4F48CC86979D03C119F1E7"><enum>607.</enum><header>Requirement for
				use of American materials</header>
						<subsection id="H2A9BEE4C14CF4F42951CEEB4007198C1"><enum>(a)</enum><header>In
				General</header><text>Notwithstanding any other provision of law, none of the
				funds made available by a State water pollution control revolving fund as
				authorized under this title may be used for the construction, alteration,
				maintenance, or repair of treatment works unless the steel, iron, and
				manufactured goods used in such treatment works are produced in the United
				States.</text>
						</subsection><subsection id="H157D994D89B04432A8987559339F657C"><enum>(b)</enum><header>Waivers</header><text>Subsection
				(a) shall not apply in any case in which the Administrator, in consultation
				with the Governor of the State, finds that—</text>
							<paragraph id="HAE0636533C044073BA20D0A938007137"><enum>(1)</enum><text>applying
				subsection (a) would be inconsistent with the public interest;</text>
							</paragraph><paragraph id="H7103FD919E3D49C09D0B8A7167A482DC"><enum>(2)</enum><text>the steel, iron,
				and manufactured goods are not produced in the United States in sufficient and
				reasonably available quantities and of a satisfactory quality; or</text>
							</paragraph><paragraph id="H3475C4DE88D8412EAB99B8DB371DD77B"><enum>(3)</enum><text>inclusion of
				steel, iron, and manufactured goods produced in the United States will increase
				the cost of the overall project by more than 25 percent.</text>
							</paragraph></subsection><subsection id="HFECFDC1C03194B028E8ECD01F2D6595D"><enum>(c)</enum><header>Public
				Notification and Written Justification for Waiver</header><text>If the
				Administrator determines that it is necessary to waive the application of
				subsection (a) based on a finding under subsection (b), the Administrator
				shall—</text>
							<paragraph id="H5C2DFC02E38C45E1A1782661F8B6FD59"><enum>(1)</enum><text>not less than 15
				days prior to waiving application of subsection (a), provide public notice and
				the opportunity to comment on the Administrator’s intent to issue such waiver;
				and</text>
							</paragraph><paragraph id="H925F59FABC9F48C089AFAE4C0FB8E87A"><enum>(2)</enum><text>upon issuing such

				why the provision is being waived.</text>
							</paragraph></subsection><subsection id="H6BC906E6B2D64E27888E40A7883EBA5B"><enum>(d)</enum><header>Consistency With
				International Agreements</header><text>This section shall be applied in a
				manner consistent with United States obligations under international
				agreements.</text>
