			</subsection></section><section id="H6D606FBC786F455C9082CE8321120D5B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H3B75F4176726487A89D5C765A3873D47"><enum>(1)</enum><text>Academically
			 gifted and talented students make up an estimated 6 to 10 percent of the
			 prekindergarten through grade 12 student population, totaling between 3,000,000
			 and 6,000,000 students.</text>
			</paragraph><paragraph id="H5EE2AF0ECED443D0BDD1CB1A099FCBD4"><enum>(2)</enum><text>There is a growing
			 gap at the highest levels of achievement between the performance of subgroups
			 of students, particularly between the performance of students who are
			 African-American or Hispanic and the performance of White students, on
			 statewide assessments and on the National Assessment of Educational
			 Progress.</text>
			</paragraph><paragraph id="H60D500643BDF403C90D9ED09B4E9E135"><enum>(3)</enum><text>Students with
			 gifts and talents, and high-ability students who have not been formally
			 identified for gifted education services, require modifications to the general
			 education curriculum to fully meet their potential.</text>
			</paragraph><paragraph id="H4CC3623E62E1472EA6F10E7D061ED92B"><enum>(4)</enum><text>Effective
			 assessment and instruction of students with gifts and talents requires
			 educators to have specialized knowledge and skills.</text>
			</paragraph><paragraph id="HF57752144F2745AA939070CCA047FC43"><enum>(5)</enum><text>Ninety percent of
			 teachers nationwide want more professional development focused on the skills
			 necessary for teaching advanced students.</text>
			</paragraph><paragraph id="H60B3AA8B795249A9BC3F19EBE4DB9791"><enum>(6)</enum><text>Interventions and
			 strategies that have been demonstrated to be successful with gifted and
			 talented students can be modified to improve the achievement of all
			 students.</text>
			</paragraph><paragraph id="H6A00472F9F3E47E9B8D387958BF92FD9"><enum>(7)</enum><text>The availability
			 of gifted education programs and services to students who require such services
			 is unequal and often relies solely on local resources and leadership, leaving
			 many high-ability students from rural areas or who are English language
			 learners or Hispanic, African-American, or Native American, among others,
			 without access to appropriate services.</text>
			</paragraph><paragraph id="H6B40A87E430146A186F463780DEC04AF"><enum>(8)</enum><text>There are an
			 estimated 360,000 students in the United States who are both gifted and have a
			 disability. These <quote>twice exceptional</quote> children present special
			 challenges because their disability often masks their academic potential or
			 their academic strengths may mask their disability, resulting in a lack of
			 services and supports for this student population.</text>
			</paragraph><paragraph id="H3EBE9E334EFD4060B87FBF84976AAD4C"><enum>(9)</enum><text>The development
			 and dissemination of research and national data on gifted and talented students
			 is necessary to—</text>
				<subparagraph id="H112F6603353A4415987BADEE3672362C"><enum>(A)</enum><text>guide
			 evidence-based classroom practices vital to meeting the unique needs of this
			 population of students; and</text>
				</subparagraph><subparagraph id="H283119A556C44C44ABC38A9D0D9CA15A"><enum>(B)</enum><text>contribute to the
			 decisionmaking of educators, families, and policymakers.</text>
				</subparagraph></paragraph></section><section id="H43B08222414B4A9392D49A00635BA9EC"><enum>3.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Elementary and
			 Secondary Education Act (20 U.S.C. 6301 et seq.).</text>
		</section><title id="H70398F8D1C2747579C1D93E4615CDADF"><enum>I</enum><header>Improving basic
			 program requirements</header>
			<section id="H57D13CA6C1CE4D229BE5B9CF83A7979E"><enum>101.</enum><header>State
			 plans</header>
				<subsection id="H19E8E7634E904BA6AE0D5B696BE94E1C"><enum>(a)</enum><header>Accountability</header><text display-inline="yes-display-inline">Section 1111(b)(2)(A) (20 U.S.C.
			 6311(b)(2)(A)) is amended—</text>
					<paragraph id="HEFEFFEEC17E24FC79B663187780E98C9"><enum>(1)</enum><text>in clause (ii), by
			 striking <quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="HF81D2016EEE04663A781F4A330589A2C"><enum>(2)</enum><text>in clause (iii),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

				in subparagraph (C)(v), significantly increase the proportion of students
				scoring at or above the advanced level of achievement on the State academic
				assessments under subsection (a)(3).</text>

					</paragraph></subsection><subsection id="HCA0A4F839B8C40CBB0F616CD70BF8FDD"><enum>(b)</enum><header>State
			 assessments</header><text>Section 1111(b)(3) (20 U.S.C. 6311(b)(3)) is
			 amended—</text>
					<paragraph id="H2771610D0B1F4635AA3438625A64925B"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
						<subparagraph id="H8D29BFC6B96743398BFC5D9E52584A51"><enum>(A)</enum><text>by inserting
			 <quote>vertically scaled,</quote> after <quote>high-quality,</quote>;
			 and</text>
						</subparagraph><subparagraph id="H1A7123AEC57341319239CFEB061DDCDD"><enum>(B)</enum><text>by inserting
			 <quote>and exceed</quote> after <quote>children to meet</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H0B5B65EDA269409EAD339453B0A1CD3B"><enum>(2)</enum><text>in subparagraph
			 (C)—</text>

				in alignment with the State academic content standards and student academic
				achievement standards; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H4D7226C3540648A8996991A1CD2CB7D5"><enum>(II)</enum><text>able to determine
				student mastery of content standards above the grade level in which the student
				is
				enrolled.</text>
									</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="HA56816B5EBDA4D5EA5BE91F997F5748E"><enum>(c)</enum><header>Accountability
			 system</header><text>Section 1111(b) (20 U.S.C. 6311(b)) is amended—</text>
					<paragraph id="H84F72FE33E5740FD8E7BD61763186495"><enum>(1)</enum><text>in paragraph
			 (8)—</text>
						<subparagraph id="H859C71F6698640B0A4693826B3CF36AD"><enum>(A)</enum><text>in subparagraph
			 (D), by striking <quote>and</quote> after the semicolon;</text>
						</subparagraph><subparagraph id="HCF9A99D26CCA4CBF94C32C2E3A82F7C4"><enum>(B)</enum><text>by redesignating
			 subparagraph (E) as subparagraph (F); and</text>
						</subparagraph><subparagraph id="HBE2D75EAF9FA442984951BE49B76A8F5"><enum>(C)</enum><text>by inserting after
			 subparagraph (D) the following:</text>

				advanced level of achievement on the State academic assessments described in
				paragraph (3); or</text>
									</clause><clause id="H56DAED42079C403F9E4D2CE6F4460814"><enum>(ii)</enum><text>are gifted and
				talented (including high-ability students who have not been formally identified
				for gifted education services); and</text>
									</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA1ED703293C4FE19A9DB0EB26C97BBC"><enum>(2)</enum><text>in paragraph
			 (10)(B), by inserting <quote>, including students who score at the advanced
			 level of achievement on State academic assessments described in paragraph (3)
			 and students who are gifted and talented (including high-ability students who
			 have not been formally identified for gifted education services)</quote> before
			 the period at the end.</text>
					</paragraph></subsection></section><section id="H6CC17AC92DC743C9BE948BEDA88AFF91"><enum>102.</enum><header>Annual State
			 report cards</header><text display-inline="no-display-inline">Section
			 1111(h)(1)(C) (20 U.S.C. 6311(h)(1)(C)) is amended—</text>
				<paragraph id="H770F0B4084C746E28885D14B6F3FAE21"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (vii), by striking <quote>;
			 and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="HC0F79AFB38F1468FB780A7C4A2D0C525"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating clause (viii) as clause
			 (ix); and</text>
				</paragraph><paragraph id="H4779155028784F43BA452372E09BD29C"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after clause (vii) the
			 following:</text>

				2-year trend in student achievement for students scoring in the highest 10
				percent on the State academic assessments under subsection (a)(3), in each
				subject area, and each grade level, for which such assessments are required,
				disaggregated by each of the categories described in subsection (b)(2)(C)(v);
				and</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H16854BBDF8E74EDB8063F9CE74AC7700"><enum>103.</enum><header>Local
			 educational agency plans</header>
				<subsection id="H4E4C86CB1D4E41E2B8F030266A5368C1"><enum>(a)</enum><header>Plan
			 provisions</header><text display-inline="yes-display-inline">Section 1112(b)(1)
			 (20 U.S.C. 6312(b)(1)) is amended—</text>
					<paragraph id="H862B18717C6F4EABBB9C29D608BD7F70"><enum>(1)</enum><text>in subparagraph
			 (P), by striking <quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="H284E78DC6D264E098B824563E10AA2EB"><enum>(2)</enum><text>in subparagraph
			 (Q), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

					</paragraph></subsection><subsection id="H2A22A31F755346189C3DD97B33A561BF"><enum>(b)</enum><header>Schoolwide
			 programs</header><text display-inline="yes-display-inline">Section 1114(b)(1)
			 (20 U.S.C. 6314(b)(1)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H937CD76CFD324513B0B1DE23EB5AC213" style="OLC">
						<subparagraph id="HB527ACCF9EE84983B049E29F7734C53D"><enum>(K)</enum><text>A description of
				how the school will identify gifted and talented students, including
				high-ability students who have not previously been formally identified for
				gifted education services, and provide services to support such students'
				learning needs to ensure that such students make appropriate learning
				gains.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H7A5C3FA1180B495CB4E009912B59ECE8"><enum>(c)</enum><header>Targeted
			 assistance schools</header><text>Section 1115(c)(1) (20 U.S.C. 6315(c)(1)) is
			 amended—</text>
					<paragraph id="H902B1C5E6CB74C14AF78C28A7C61A24D"><enum>(1)</enum><text>in subparagraph
			 (G), by striking <quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="H922EC1E2422A4BBAB8F3445C6530E056"><enum>(2)</enum><text>in subparagraph
			 (H), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

					</paragraph></subsection></section></title><title id="H06831951B3F94FBB8AC35D813B03CE54"><enum>II</enum><header>Improving
			 teaching for gifted and talented students</header>
			<section id="HF115E2AEA24A4BBCB531FF737C602697"><enum>201.</enum><header>State
			 plans</header><text display-inline="no-display-inline">Section 2112(b)(5) (20
			 U.S.C. 6612(b)(5)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0888B6D505A1456E931EB1105291B85B" style="OLC">
					<subparagraph id="H392E98D27C784C4BBEE4EEB138F7AC03" indent="up1"><enum>(C)</enum><text>A description of the comprehensive
				strategy the State educational agency will use to improve the teaching skills
				of teachers, principals, pupil services personnel, and other instructional
				leaders in order to enable them to employ strategies that focus on—</text>
						<clause id="HFACFD762634048A29492F827783F83CF"><enum>(i)</enum><text>the identification of students'
				specific learning needs, particularly students with disabilities, students who
				are limited English proficient, students who are gifted and talented, and
				students with low literacy levels; and</text>
						</clause><clause id="H87CA0220FDF443388562C374019570E9"><enum>(ii)</enum><text>the tailoring of academic
				instruction to such
				needs.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEB97C1E351C849CCA3A5A58D079B6AB9"><enum>202.</enum><header>Local
			 plans</header><text display-inline="no-display-inline">Section 2122(b)(2) (20
			 U.S.C. 6622(b)(2)) is amended—</text>
				<paragraph id="H9ACB6B109C7A459C852C8B515D06663F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>to eliminate the
			 achievement</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="yes-display-inline" id="H72B3DD2E259A4C4A94DC3E5BF2EBD75B" style="OLC">
						<text>to

				</paragraph></section></title><title id="HFCFEE0B02C8B4D4CBA9541A4DCFC8570"><enum>III</enum><header>Gifted and
			 talented students in rural schools</header>
			<section id="H39D86A213115458CB41D53EA0705360C"><enum>301.</enum><header>Small rural
			 school achievement program</header><text display-inline="no-display-inline">Section 6211 (20 U.S.C. 7345) is amended by
			 inserting <quote>, including supporting gifted and talented students, including
			 high-ability students who have not been formally identified for gifted
			 education services,</quote> after <quote>local activities</quote>.</text>
			</section><section id="HCC6CE8996F9B4EEBB19E190E04193021"><enum>302.</enum><header>Rural and
			 low-income school program</header><text display-inline="no-display-inline">Section 6222(a)(2) (20 U.S.C. 7351a(a)(2))
			 is amended by striking <quote>and to</quote> and inserting <quote>, train
			 teachers to meet the unique learning needs of gifted and talented students,
			 including high-ability students who have not been formally identified for
			 gifted education services, and</quote>.</text>

			 high-ability learners by empowering the Nation’s teachers</header>
			<section id="H2F689FC4D80845F486E6836F43213440"><enum>401.</enum><header>Establishment
			 of TALENT program</header>
				<subsection id="HD0C2D01CBC4B40F9BBF2AF92C126F0B7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title II (20 U.S.C.
			 6601 et seq.) is amended by adding at the end the following:</text>

						<part id="H2793DCC25D6941349F0BFE0356FF8905"><enum>E</enum><header>Aiding gifted and
				high-ability learners by empowering the Nation’s teachers</header>
							<section id="H367DF22A42FE4F159AA136DB2B209DC8"><enum>2501.</enum><header>Establishment
				of TALENT program</header>
								<subsection id="H576C191EC54C4303B086E042273B221B"><enum>(a)</enum><header>Purposes and
				objectives</header>
									<paragraph id="H232F51E7619C4514B42CC9D4E3429B28"><enum>(1)</enum><header>Purposes</header><text>The
				purposes of this part are—</text>
										<subparagraph id="H4C5C2B3FE1D5408398521379790F461C"><enum>(A)</enum><text>to address the
				urgent need for innovation in teaching gifted and talented students, including
				high-ability students who have not been formally identified for gifted
				education services, by initiating a coordinated program of high-quality
				professional development for teachers (including gifted and talented teachers),
				principals, pupil services personnel, and other instructional leaders, to
				support the identification and education of gifted and talented students,
				including high-ability students who have not previously been formally
				identified for gifted education services;</text>
										</subparagraph><subparagraph id="HC5B709FC908F4BF3851E76D1A54A165A"><enum>(B)</enum><text>to spur the
				development and dissemination of evidence-based best practices that elementary
				and secondary schools and families can use to improve instruction and learning
				by initiating evidence-based demonstration projects that investigate the
				effectiveness of services and programs to meet the special education needs of
				gifted and talented students, including high-ability students who have not been
				formally identified for gifted education services; and</text>
										</subparagraph><subparagraph id="H1E512CCE315442FCA1559A9F4FDA830B"><enum>(C)</enum><text>to establish a
				National Research and Dissemination Center for the Education of the Gifted and
				Talented to conduct and synthesize research and disseminate practical
				information on improving education outcomes for gifted and talented students,
				including high-ability students who have not been formally identified for
				gifted education services.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" id="H547E0400B5624786B7A494F77E7E5C67"><enum>(b)</enum><header>Applicability to
				all gifted students</header><text>The provisions of this part apply to all
				gifted and talented students, including high-ability students, without regard
				as to whether such students have been formally identified as gifted and
				talented or selected for gifted education services.</text>
								</subsection><subsection id="HFDA8B7965DCE4495B672A368EF153ED4"><enum>(c)</enum><header>Professional
				development and best practices grant program</header>
									<paragraph id="H882CCAA40EE84677840D1B76DEED45EF"><enum>(1)</enum><header>Definition of
				eligible entity</header><text>In this subsection, the term <term>eligible
				entity</term> means an institution of higher education or State educational
				agency acting in a partnership that—</text>
										<subparagraph id="HB0BD181AAE214E71BE779E15D77581B6"><enum>(A)</enum><text>includes a State
				educational agency, local educational agency, consortium of local educational
				agencies, or an institution of higher education; and</text>
										</subparagraph><subparagraph id="H7BFCA6A820914C81A98D09197EEB5190"><enum>(B)</enum><text>may include other
				public agencies, private entities, or organizations, that have demonstrated
				expertise in gifted education pedagogy.</text>
										</subparagraph></paragraph><paragraph id="HF28DB279D7B943CB83B9A8509F98207C"><enum>(2)</enum><header>Program
				authorized</header>
										<subparagraph id="HC09F43C77A5A4457A12D65DD4D33BD5E"><enum>(A)</enum><header>In
				general</header><text>From the amounts appropriated to carry out this
				subsection under section 5202(b)(2), the Secretary, after consultation with
				experts in the field of gifted and talented education, is authorized to award,
				on a competitive basis, grants to eligible entities to enable the eligible
				entities to carry out activities supporting the purposes of subparagraph (A) or
				(B) of subsection (a)(1).</text>
										</subparagraph><subparagraph id="H309A9E72AB1E4EF6BBB4F64B65932279"><enum>(B)</enum><header>Duration of
				demonstration project grants</header><text>A grant awarded to carry out the
				purpose described in subsection (a)(1)(B) shall be for a period of not less
				than 3 years nor more than 5 years.</text>
										</subparagraph></paragraph><paragraph id="H7CAC347E94344F9C823FDA9ABEBA3053"><enum>(3)</enum><header>Applications</header><text>Each
				entity seeking a grant under this subsection shall submit an application to the
				Secretary at such time, in such manner, and containing such information as the
				Secretary may reasonably require. Each such application shall describe—</text>
										<subparagraph id="H0046F61DA49D4E4D8092DDE04D04F0D5"><enum>(A)</enum><text>in the case of an
				application for a grant for the purpose described in subsection (a)(1)(A), how
				the proposed professional development program is designed in response to a
				needs assessment;</text>
										</subparagraph><subparagraph id="HF4455B92FFF8482E913ADCE430524A4D"><enum>(B)</enum><text>in the case of an
				application for a grant for the purpose described in subsection
				(a)(1)(B)—</text>
											<clause id="H4FAC34979CC04E25B0F9F80349BE28AE"><enum>(i)</enum><text>how the proposed
				demonstration project will support the development and dissemination of
				evidence-based strategies and practices that local educational agencies and
				families can use to improve the identification and education of gifted and
				talented students, including high-ability students who have not previously been
				formally identified for gifted education services; and</text>
											</clause><clause id="H10741FFFD33E4218AEC79E7CE6C1C968"><enum>(ii)</enum><text>how the grantee
				proposes to disseminate project findings and outcomes to general education and
				gifted and talented education professionals and to parents;</text>
											</clause></subparagraph><subparagraph id="H3C7F69281220492EA31DC095F0749DE2"><enum>(C)</enum><text>where appropriate,
				how the professional development program or demonstration project can be
				adapted for use with all students; and</text>
										</subparagraph><subparagraph id="H88A1F4C4CF894097A05A0D78A3B3B8A1"><enum>(D)</enum><text>how the proposed
				professional development program or demonstration project will be
				evaluated.</text>
										</subparagraph></paragraph><paragraph id="HD2CE40A0ADD74130A16334778457C428"><enum>(4)</enum><header>Review of
				demonstration project applications</header><text>In reviewing applications for
				grants for the purpose described in subsection (a)(1)(B), the Secretary shall
				select eligible entities for such grants based on one or more of the following
				priorities:</text>
										<subparagraph id="HDECF9E4F49434FA39ADA4F2CACEC56CE"><enum>(A)</enum><text>Improving methods
				and techniques for identifying and serving gifted and talented students,
				including high-ability students who have not previously been formally
				identified for gifted education services, from underserved populations
				(including economically disadvantaged individuals, individuals with limited
				English proficiency, individuals with disabilities, and individuals from rural
				geographic areas).</text>
										</subparagraph><subparagraph id="H31E8068B37D34A77BBAA905EEC99ABB5"><enum>(B)</enum><text>Developing valid
				and reliable formative and summative assessment instruments that accurately
				measure student performance above grade level.</text>
										</subparagraph><subparagraph id="H3D4B792BBB83489584A2B3C452DB3934"><enum>(C)</enum><text>Increasing the
				ability of teachers in general education settings to identify and instruct
				gifted and talented students, including high-ability students who have not
				previously been formally identified for gifted education services.</text>
										</subparagraph><subparagraph id="H1F10A25C9B2D428E86C79D2B85513466"><enum>(D)</enum><text>Exploring the
				impact on achievement of various school- and classroom-based educational
				strategies such as multi-tiered supports and services, accelerated learning
				opportunities, and enrichment.</text>
										</subparagraph><subparagraph id="HF6364C27B5724AA7BC2241B2E676034C"><enum>(E)</enum><text>Improving—</text>
											<clause id="HAE8B04F502F44EE78FA8B432569693F4"><enum>(i)</enum><text>access to advanced
				programs and services by traditionally underserved populations; and</text>
											</clause><clause id="H3706FD096A344FA3B64B134AFF8849D2"><enum>(ii)</enum><text>the effectiveness
				of the programs and services for such populations.</text>
											</clause></subparagraph><subparagraph id="HE1EB0AFEB54B4CAC84E78ED4A629A4E8"><enum>(F)</enum><text>Replicating, on a
				larger scale, successful evidence-based practices.</text>
										</subparagraph></paragraph><paragraph id="H10D22CC7E4E34D30B4DBF85BEEF62246"><enum>(5)</enum><header>Authorized use
				of funds</header>
										<subparagraph id="H6E4D6C79174F4116ACE4DA47878F44B2"><enum>(A)</enum><header>Ensuring
				necessary teaching skills</header><text>An eligible entity receiving a grant
				for the purpose described in subsection (a)(1)(A) shall use grant funds to
				ensure that school personnel, including teachers, principals, pupil services
				personnel, and other instructional leaders, have the necessary teaching skills
				and educational strategies to ensure that gifted and talented students,
				including high-ability students who have not been formally identified for
				gifted education services, are achieving at levels commensurate with the
				students' ability or aptitude, by implementing a professional development
				program that—</text>
											<clause id="H5F6670C7E69B4FAEA6CC9E685551D8DE"><enum>(i)</enum><text>enables school
				personnel to recognize the learning differences, developmental milestones, and
				cognitive and affective characteristics of gifted and talented students,
				including gifted and talented students from diverse backgrounds and
				high-ability students who have not been formally identified for gifted
				education services, and to identify the students' related academic and
				social-emotional needs;</text>
											</clause><clause id="HD55C0A936E4C4C2AB01E64BA403F68E6"><enum>(ii)</enum><text>enables educators
				to—</text>
												<subclause id="H7A7867BCABDC4E1FA28B17FE8FF4AC56"><enum>(I)</enum><text>understand, plan,
				and implement a range of evidence-based strategies to assess students who are
				gifted and talented, including high-ability students who have not previously
				been formally identified for gifted education services, to differentiate
				instruction, content, and assignments for such students (including the use of
				higher-order critical and creative thinking skills), and to nominate such
				students for advanced programs or academic acceleration, as needed; and</text>
												</subclause><subclause id="H33AF9F0C8BA143E687EF849EC8FF4D36"><enum>(II)</enum><text>understand how,
				if appropriate, such strategies may be adapted for the use of all students;
				and</text>
												</subclause></clause><clause id="H5980596FE4AA4A128DEC8A3C87CAE722"><enum>(iii)</enum><text>builds the
				capacity of teachers, principals, pupil services personnel, and other
				instructional leaders to identify and serve such students.</text>
											</clause></subparagraph><subparagraph id="H6B6D71D755324450879BE579DC5C4CC7"><enum>(B)</enum><header>Supporting
				evidence-based research demonstration projects</header><text>An eligible entity
				receiving a grant for the purpose described in subsection (a)(1)(B) shall use
				grant funds to—</text>
											<clause id="H06B90C2DE17840CE929C8E09E2C80FE5"><enum>(i)</enum><text>conduct
				field-based research to develop innovative practices, assessment tools for
				gifted identification, materials, and other practices and strategies, that are
				designed specifically to address the needs of gifted and talented students,
				including high-ability students who have not been formally identified for
				gifted education services; and</text>
											</clause><clause id="H1C62B60E788D4841B8F87A9CD1C4C72A"><enum>(ii)</enum><text>provide research
				findings and other grant results to the National Research and Dissemination
				Center established under subsection (d) not later than 12 months after the
				completion of the grant period for synthesis and dissemination.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="HFBB73460C9F54C368F52272169D407AA"><enum>(d)</enum><header>National
				research and dissemination center for the education of the gifted and
				talented</header>
									<paragraph id="HCA6DBC32053A4392A1E411C536A24817"><enum>(1)</enum><header>Definition of
				eligible entity</header><text>In this subsection, the term <term>eligible
				entity</term> means a partnership composed of not less than one of each of the
				following:</text>
										<subparagraph id="H1AA4E647B44145EAA03208C424D832B8"><enum>(A)</enum><text>An institution of
				higher education with expertise in gifted and talented education.</text>
										</subparagraph><subparagraph id="HC67F12CE505A45D599487696F4D46E14"><enum>(B)</enum><text>A nonprofit
				organization with an established national network of stakeholders, including
				parents and classroom educators, interested in serving the unique learning
				needs of gifted and talented students, including high-ability students who have
				not been formally identified for gifted education services.</text>
										</subparagraph></paragraph><paragraph id="H50CFF3D77A324886A0B7C7D72B44370E"><enum>(2)</enum><header>Establishment of
				national research and dissemination center</header><text>From the amounts
				appropriated under section 2502(b)(1) to carry out this subsection, the
				Secretary, through a competitive grant process, is authorized to award a grant
				to an eligible entity to enable the eligible entity to establish a National
				Research and Dissemination Center for the Education of the Gifted and Talented
				that is focused on the unique needs of gifted and talented students, including
				high-ability students who have not been formally identified for gifted
				education services.</text>
									</paragraph><paragraph id="H9B4427C97C3D4878BF7F7F82EC21167D"><enum>(3)</enum><header>Authorized use
				of funds</header><text>An eligible entity that receives a grant under this
				subsection shall use the funds provided under the grant to carry out all of the
				following activities:</text>
										<subparagraph id="HD624A1324A7249F28CAC73DB6DB165CE"><enum>(A)</enum><text>Conduct
				evidence-based research on methods and techniques for identifying and serving
				gifted and talented students, including high-ability students who have not
				previously been formally identified for gifted education services and, where
				appropriate, for using the methods and techniques to serve all students.</text>
										</subparagraph><subparagraph commented="no" id="H26307D28F30747069094859358D0763E"><enum>(B)</enum><text>Develop and
				disseminate evidence-based resources on the unique learning needs of students
				who are gifted and talented, including high-ability students who have not been
				formally identified for gifted education services, in order to—</text>
											<clause commented="no" id="H82C33A15073D435480F41152EE01FBF3"><enum>(i)</enum><text>support teacher
				training and professional development strategies to improve the teaching skills
				of teachers (including general education, gifted and talented, and special
				education teachers); and</text>
											</clause><clause commented="no" id="HC4BB554930684BE0932887360FAE8478"><enum>(ii)</enum><text>assist parents in
				supporting their gifted and talented children’s education.</text>
											</clause></subparagraph><subparagraph id="HBABD3D2B7B504B0FB73C6C0390E907FA"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H2E526CEF7AED4ACDA71A776C7B022B6C"><enum>(i)</enum><text>Synthesize research
				findings and strategies (including research produced under grants awarded under
				subsection (c)) on meeting the needs of gifted and talented students, including
				high-ability students who have not been formally identified for gifted
				education services.</text>
											</clause><clause id="H5029F6A709AA4915BB91D9D731B2C398" indent="up1"><enum>(ii)</enum><text>Disseminate such research findings
				and strategies widely, including to—</text>
												<subclause id="H52BCA4C146CF4269AE7DFC1D4B851A6E"><enum>(I)</enum><text>the regional comprehensive centers
				authorized under section 203 of the Educational Technical Assistance Act of
				2002 that provide technical assistance to States and local educational
				agencies; and</text>
												</subclause><subclause id="HBAE01C994FDF48F590BC88C71765CE5A"><enum>(II)</enum><text>the technical assistance and
				dissemination centers and parent training and information centers authorized
				under sections 663 and 671, respectively, of the Individuals with Disabilities
				Education Act.</text>
												</subclause></clause></subparagraph></paragraph></subsection><subsection id="HA36BEC41C5A94123853A852412AAF4F5"><enum>(e)</enum><header>Annual
				reporting</header><text>Each entity receiving a grant under this part shall
				submit an annual report to the Secretary that describes the number of students
				served and the activities supported with funds provided under this part.</text>
								</subsection><subsection id="H681C178F3DFE4C2FAA280A76E18B2909"><enum>(f)</enum><header>Rule of
				construction</header><text>Nothing in this part shall be construed to prohibit
				a recipient of funds under this part from serving gifted and talented students
				simultaneously with students with similar educational needs, in the same
				educational settings where appropriate.</text>
								</subsection><subsection id="H638BAA3C0782476C961E9F14019920DC"><enum>(g)</enum><header>Program
				priorities</header><text>In carrying out this part, the Secretary shall ensure
				that not less than 50 percent of the applications approved under subsection (c)
				in a fiscal year address one or more of the following priorities:</text>
									<paragraph id="HA3A98FB12A5C4D9387BF28E0B559A521"><enum>(1)</enum><text>Improving the
				capability of schools to plan and conduct targeted gifted and talented
				interventions and academic services to ensure that the rate of growth in
				academic achievement of subgroups of gifted and talented or high-ability
				students who may not be identified and served through traditional assessment
				methods (including economically disadvantaged individuals, individuals with
				limited English proficiency, and individuals with disabilities) is commensurate
				with their aptitude or ability.</text>
									</paragraph><paragraph id="H717579897BB4469886EEEDB2B4FB5F90"><enum>(2)</enum><text>Assisting rural
				schools and local educational agencies in providing services to gifted and
				talented students, including high-ability students who have not previously been
				formally identified for gifted education services.</text>
									</paragraph></subsection><subsection id="H6D9ED189FCB248FEAB52E15B9428F922"><enum>(h)</enum><header>General
				provisions</header>
									<paragraph id="H0A8AB8AA921A44C7AD7390136A134E32"><enum>(1)</enum><header>Review,
				dissemination, and evaluation</header><text>The Secretary shall—</text>
										<subparagraph id="H0C7699FC03AB4599A00C1FADE4FE64D5"><enum>(A)</enum><text>use a peer review
				process in reviewing applications under this part;</text>
										</subparagraph><subparagraph id="HB695FBFA367C4B42BAFEA75C07D044E5"><enum>(B)</enum><text>ensure that
				information on the activities and results of programs and projects funded under
				this part is disseminated to State educational agencies, local educational
				agencies, institution of higher education teacher preparation programs, and
				other appropriate organizations, including nonprofit organizations; and</text>
										</subparagraph><subparagraph id="HEC3B2DED86D54372AB249BA1844F8860"><enum>(C)</enum><text>evaluate the
				effectiveness of programs under this part in accordance with section 9601, in
				terms of the impact on students traditionally served in separate gifted and
				talented programs and on other students, and submit the results of such
				evaluation to Congress not later than 2 years after the date of enactment of
				the <short-title>To Aid Gifted and High-Ability Learners
				by Empowering the Nation's Teachers Act</short-title>.</text>
										</subparagraph></paragraph><paragraph id="H87DA5AE6262A43ECB3DDE3E1A51AD96A"><enum>(2)</enum><header>Program
				operations</header><text>The Secretary shall ensure that the programs under
				this part are administered within the Department by a person who has recognized
				professional qualifications and experience in the field of gifted and talented
				education. Such individual shall—</text>
										<subparagraph id="HEDF60D8F85E84D25BB2C35EE79715505"><enum>(A)</enum><text>administer and
				coordinate the programs authorized under this part;</text>
										</subparagraph><subparagraph id="HF6C47CB4B17E487AB2B393646F9CD72C"><enum>(B)</enum><text>serve as a focal
				point of national leadership and information on the educational needs of gifted
				and talented students, including high-ability students who have not been
				formally identified for gifted education services, and the availability of
				educational services and programs designed to meet such needs;</text>
										</subparagraph><subparagraph id="HB1E73619EF3647B5A2667C264B33E7B9"><enum>(C)</enum><text>assist the
				Director of the Institute of Education Sciences in identifying research and
				data collection priorities that reflect the needs of gifted and talented
				students, including high-ability students who have not been formally identified
				for gifted education services, and would facilitate appropriate decisionmaking
				by local educational agencies;</text>
										</subparagraph><subparagraph id="H3B91ECDD2F0743B2ADDE2B4F05499679"><enum>(D)</enum><text>consult with other
				offices within the Department of Education and in other Federal departments or
				agencies regarding issues involving gifted and talented education, and
				disseminate information on gifted and talented education to such offices and
				the public; and</text>
										</subparagraph><subparagraph id="H31A0AD0394E344879E084FC75C8362EE"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="HC0BBC4427D6E47F5906358D6C33D23D7"><enum>(i)</enum><text>every 2 years, prepare
				and submit to the Committee on Health, Education, Labor, and Pensions of the
				Senate and the Committee on Education and the Workforce of the House of
				Representatives, a report on the outcomes and promising practices developed
				through programs or projects funded under this part, as well as the condition
				of gifted and talented students in the United States; and</text>
											</clause><clause id="H870A3002010241AD9A881846BA62B94F" indent="up1"><enum>(ii)</enum><text>share such report with the
				Institute for Education Sciences and the National Research and Dissemination
				Center for the Education of the Gifted and Talented established under
				subsection (d), in order for the report to be disseminated nationally.</text>
											</clause></subparagraph></paragraph></subsection></section><section id="H0C77AADBE3404518BBE428BC207036F4"><enum>2502.</enum><header>Authorization
				of appropriations</header>
								<subsection id="HAC648484E2E24598A3E338FD9D697A49"><enum>(a)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out this
				part $10,000,000 for fiscal year 2013 and such sums as may be necessary for
				each succeeding fiscal year.</text>
								</subsection><subsection id="H230A7EF37207488DB2C28D93D04C0011"><enum>(b)</enum><header>Allocation of
				funding</header><text>Of the amounts appropriated under subsection (a) for a
				fiscal year, the Secretary—</text>
									<paragraph id="H20D2BDF28E3B4AD79227D61E04BFC1C8"><enum>(1)</enum><text>shall allocate an
				amount not to exceed 20 percent of the funds to carry out section 2501(d);
				and</text>
									</paragraph><paragraph commented="no" id="H3C017C5A6C424BF6BDF373D9C74A3A2F"><enum>(2)</enum><text>shall, from the
				amount remaining after the allocation under paragraph (1)—</text>
										<subparagraph commented="no" id="HD7C0F963B2854C9DAFD1CDB02BD9725D"><enum>(A)</enum><text>allocate 60
				percent of such remaining amount to carry out grants described in section
				2501(a)(1)(A); and</text>
										</subparagraph><subparagraph id="H6F53DAD9AB4F41D3950D722F797AC96F"><enum>(B)</enum><text>allocate 40
				percent of the remaining amount to carry out grants described in section
				2501(a)(1)(B).</text>
										</subparagraph></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>

			 Jacob K. Javits gifted and talented program</header>
				<subsection id="H313770002B3840959148451212F3F10C"><enum>(a)</enum><header>In
			 general</header><text>Subpart 6 of part D of title V (20 U.S.C. 7253 et seq.)

			 any other provision of law, the Secretary of Education shall take such steps as
			 are necessary to provide for the orderly transition to the authority of part E
			 of title II of the Elementary and Secondary Education Act of 1965 (as enacted
			 by title IV of this Act), from any authority under subpart 6 of part D of title
			 V of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7253 et
			 seq.) (as such subpart was in effect on the day before the effective date of
			 this Act).</text>

			 conforming amendments</header>

			 contents</header><text>The table of contents in section 2 of the Elementary and
			 Secondary Education Act of 1965 is amended—</text>
