		<official-title>To amend title 23, United States Code, to establish a
		  disincentive with respect to States funneling proceeds from license plate sales
		  to partisan political organizations, and for other purposes.</official-title>

		<section id="H4CDECD4CB9E645C7B3BC1DEA2E4EE10E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>License Plate Political Slush Fund Prevention Act of
			 2011</short-title></quote>.</text>
		</section><section id="H894AD78B741E466F89FDC3B7680F8B72"><enum>2.</enum><header>License plate
			 sales and political activity</header>
			<subsection id="H7AE9234AB2BD4F59B9C799F9B82D31FD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 1 of title
			 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H505555BF12894DE29202F90FCBD34BF7" style="USC">
					<section id="HE8EACC9C6A5F477A9DFC3290BEACFB03"><enum>167.</enum><header>License plate
				sales and political activity</header>
						<subsection id="HC28E5C731145414C9E67958AE0CE7992"><enum>(a)</enum><header>Withholding of
				apportionments for noncompliance</header><text display-inline="yes-display-inline">The Secretary shall withhold 15 percent of
				the amount required to be apportioned to any State under each of paragraphs
				(1), (3), and (4) of section 104(b) on October 1 of the first fiscal year
				beginning after the date of enactment of this Act, and on October 1 of each
				fiscal year thereafter, if the State does not meet the requirement of
				subsection (b) on that date.</text>
						</subsection><subsection id="HEF90CD40BA74488C989F2A63063327C6"><enum>(b)</enum><header>Requirement</header><text>A
				State meets the requirement of this subsection if the chief executive of the
				State certifies to the Secretary that the State, as of the date of the
				certification, does not provide to an organization that engages in covered
				political activity any proceeds resulting from the sale of a license plate in
				that State.</text>
						</subsection><subsection id="H0BBD5AC1695647459F4571CEDF63A29D"><enum>(c)</enum><header>Effect of
				noncompliance</header><text>Funds withheld from a State under subsection (a)
				shall lapse and shall be deposited in the Treasury and used for deficit
				reduction (or, if there is no Federal budget deficit, for reducing the Federal
				debt, in such manner as the Secretary of the Treasury considers
				appropriate).</text>
						</subsection><subsection id="H76E5F1845F45469BAC04B444F8A32E6D"><enum>(d)</enum><header>Covered
				political activity defined</header><text>In this section, the term
				<term>covered political activity</term> means the advocacy of the election or
				defeat of a candidate with respect to an election for a Federal, State, or
				local
				office.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2390488618D14F659720199D9821BF23"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The analysis for
			 chapter 1 of title 23, United States Code, is amended by adding at the end the
			 following:</text>
