		  borrowers in low- to moderate-income communities, and for other

		<section id="HAF8BFC982BF64824ABA53C14D59B7340" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bank Accessibility Act</short-title></quote>.</text>
		</section><section id="H4ADEDE7976544FEDAEB8E217617295AD"><enum>2.</enum><header>Financial
			 institution involvement with low-income borrowers and communities</header>
			<subsection id="H61A9E290324744978F724F3C6E33D25E"><enum>(a)</enum><header>Additional
			 factors</header><text display-inline="yes-display-inline">Section 804 of the
			 Community Reinvestment Act of 1977 (12 U.S.C. 2903) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE778F514FB1C4C6692DEE3DF18E7BF14" style="OLC">
					<subsection display-inline="no-display-inline" id="H078D27E5919A4BB298C3BC5A65DA2867"><enum>(e)</enum><header>Branch
				distribution and services in low- to moderate-Income
				communities</header><text>In assessing and taking into account, under
				subsection (a), the record of a financial institution, the appropriate Federal
				financial supervisory agency shall consider as factors—</text>
						<paragraph id="H6C0C715AD4754532842859A9F8112DB9"><enum>(1)</enum><text>the branch
				distribution of such institutions in low- to moderate-income communities;
				and</text>
						</paragraph><paragraph id="HA0EDE466BF3042A28D21A542F11F40AF"><enum>(2)</enum><text>the services
				provided to borrowers in such communities by such institutions,
				including—</text>
							<subparagraph id="HD2B9661F5AC741EFB84D13E7628BCF7C"><enum>(A)</enum><text>checking and
				savings accounts with no monthly fee, low or no minimum balance requirements,
				and no overdraft or insufficient funds fees;</text>
							</subparagraph><subparagraph id="HC23F64246CD745719E5AF4431ED59FCA"><enum>(B)</enum><text>free check
				cashing;</text>
							</subparagraph><subparagraph id="H2DB1AFB1467545FAA1729992E712EC09"><enum>(C)</enum><text>debit card and ATM
				services; and</text>
							</subparagraph><subparagraph id="HCBF0E0A556004772B1CC51BE6616278F"><enum>(D)</enum><text>low or no fee
				money order and wire
				transfers.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB80D38C04A874DAABDDFD908EAC40936"><enum>(b)</enum><header>Effect on
			 rating</header><text display-inline="yes-display-inline">Section 807(b) of such
			 Act (12 U.S.C. 2906(b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC7DE5EA0328E469EAA25318233D25AF7" style="OLC">
					<paragraph id="H9AC6F876CA324876895A8F10C866AEFA"><enum>(3)</enum><header>Factors
				considered</header><text display-inline="yes-display-inline">The consideration
				of the factors described in section 804(e) shall be weighted to account for
				approximately 33 percent of the institution’s rating referred to in paragraph
				(1)(A)(iii).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H2BC1A19A865741B9B09DC77C49669690" section-type="subsequent-section"><enum>3.</enum><header>Regulations</header>
			<subsection id="H007AEC2C029C47979B7FD4779986F1D4"><enum>(a)</enum><header>In
			 general</header><text>The appropriate Federal financial supervisory agency
			 shall prescribe regulations that, in the case of any regulated financial
			 institution that receives a low rating (as determined by the such agency) with
			 respect to the factors described in section 804(e) of the Community
			 Reinvestment Act of 1977 (12 U.S.C. 2903(e)), as added by section 2(a) of this
			 Act—</text>
				<paragraph id="H6DD178E0F97146A0AC8A245EB2911ED8"><enum>(1)</enum><text>deny any merger or
			 expansion requests by such institution; and</text>
				</paragraph><paragraph id="HB75AFB2274C646AFB1A29B0C4C88CC8F"><enum>(2)</enum><text>impose a civil
			 money penalty on such institution in an amount determined by such
			 agency.</text>
				</paragraph></subsection><subsection id="H181116E020C64D7687EBA5D10F77D7EE"><enum>(b)</enum><header>Use of civil
			 money penalties collected</header><text display-inline="yes-display-inline">Any
			 civil money penalties collected under regulations prescribed pursuant to
			 subsection (a)(2) shall be deposited in accounts established by the appropriate
			 Federal financial supervisory agency, and the amounts in such accounts shall be
			 made available to such agency to carry out its responsibilities under the
			 Community Reinvestment Act of 1977 (12 U.S.C. 2901 et seq.), including
			 distributing rewards pursuant to subsection (c) of this section.</text>
			</subsection><subsection id="H743A250F492046659237341353C31AA6"><enum>(c)</enum><header>Rewards</header><text display-inline="yes-display-inline">The appropriate Federal financial
			 supervisory agency shall prescribe regulations that reward a regulated
			 financial institution that receives a high rating (as determined by such
			 agency) with respect to the factors described in section 804(e) of the
			 Community Reinvestment Act of 1977 (12 U.S.C. 2903(e)), as added by section
			 2(a) of this Act.</text>
			</subsection><subsection id="H844090AA8703406B9158DB5CE70E6510"><enum>(d)</enum><header>Definitions</header><text>In
			 this section, the terms <term>appropriate Federal financial supervisory
			 agency</term> and <term>regulated financial institution</term> have the same
			 meanings as are given such terms in section 803 of the Community Reinvestment
			 Act of 1977 (12 U.S.C. 2902).</text>
