<official-title display="yes">To amend title 38, United States Code, to furnish hospital care and medical services to veterans who were stationed at Camp Lejeune, North Carolina, while the water was contaminated at Camp Lejeune, to improve the provision of housing assistance to veterans and their families, and for other purposes.</official-title>

<paragraph commented="no" display-inline="no-display-inline" id="H22D26A8597C746A7B209B96BCAC72D90"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 1710(e) is amended by adding at the end the following new subparagraph:</text>

<subsection commented="no" display-inline="no-display-inline" id="H29393E074D074E9F8CCD8174429E095E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), a family member of a veteran described in subparagraph (F) of section 1710(e)(1) of this title who resided at Camp Lejeune, North Carolina, for not fewer than 30 days during the period described in such subparagraph or who was in utero during such period while the mother of such family member resided at such location shall be eligible for hospital care and medical services furnished by the Secretary for any of the illnesses or conditions described in such subparagraph, notwithstanding that there is insufficient medical evidence to conclude that such illnesses or conditions are attributable to such residence.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE31E951D3E964161A7A68B662379728B"><enum>(b)</enum><header>Limitations</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2B8855C37DD3480586D4E211933222FC"><enum>(1)</enum><text>The Secretary may only furnish hospital care and medical services under subsection (a) to the extent and in the amount provided in advance in appropriations Acts for such purpose.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H83484A81147A471681B92C4969755E66" indent="up1"><enum>(2)</enum><text>Hospital care and medical services may not be furnished under subsection (a) for an illness or condition of a family member that is found, in accordance with guidelines issued by the Under Secretary for Health, to have resulted from a cause other than the residence of the family member described in that subsection.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCE16EE778E8F4571A5B34BE745415457" indent="up1"><enum>(3)</enum><text>The Secretary may provide reimbursement for hospital care or medical services provided to a family member under this section only after the family member or the provider of such care or services has exhausted without success all claims and remedies reasonably available to the family member or provider against a third party (as defined in section 1725(f) of this title) for payment of such care or services, including with respect to health-plan contracts (as defined in such section).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph commented="no" display-inline="no-display-inline" id="H0B6AF42DE62A41D4AE1AE9C7BA28BDEC"><enum>(1)</enum><header>In general</header><text>Not later than December 31 of each of 2013, 2014, and 2015, the Secretary of Veterans Affairs shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the care and services provided under sections 1710(e)(1)(F) and 1787 of title 38, United States Code (as added by subsections (a) and (b)(1), respectively).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6B02F69E57DA4BD6B80F752D22ACD87B"><enum>(2)</enum><header>Elements</header><text>Each report under paragraph (1) shall set forth the following:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB925973B079D4E59A73B80F4E0D57C29"><enum>(A)</enum><text>The number of veterans and family members provided hospital care and medical services under the provisions of law specified in paragraph (1) during the period beginning on October 1, 2012, and ending on the date of such report.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H487E4E2E88ED4A7CB42D37C67901BF12"><enum>(B)</enum><text>The illnesses, conditions, and disabilities for which care and services have been provided such veterans and family members under such provisions of law during that period.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0C2C62BFCDE34D37AB8A76EAE39C9316"><enum>(C)</enum><text>The number of veterans and family members who applied for care and services under such provisions of law during that period but were denied, including information on the reasons for such denials.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4CD664777AAC49B38ABBD427731DBC65"><enum>(D)</enum><text>The number of veterans and family members who applied for care and services under such provisions of law and are awaiting a decision from the Secretary on eligibility for such care and services as of the date of such report.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HEB2FE6E006F94E3CAF995693881BDF08"><enum>(d)</enum><header>Effective date</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H8152C951130B443F8AC90468B1054248"><enum>(1)</enum><header>In general</header><text>The provisions of this section and the amendments made by this section shall take effect on the date of the enactment of this Act.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBBBEB067DFFF4A9E89AA8145549FB5D6"><enum>(2)</enum><header>Applicability</header><text>Subparagraph (F) of section 1710(e)(1) of such title, as added by subsection (a), and section 1787 of title 38, United States Code, as added by subsection (b)(1), shall apply with respect to hospital care and medical services provided on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H357E38664A47493BB8091CA45BBF26F0" section-type="subsequent-section"><enum>103.</enum><header>Authority to waive collection of copayments for telehealth and telemedicine visits of veterans</header> 
<subsection id="H8A114E51607C4B8BB23DA2B7DEAAAE25"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 17 is amended by inserting after section 1722A the following new section:</text>

<subsection commented="no" display-inline="no-display-inline" id="H88F21EAED56148EAB8788A1A5B087AB1"><enum>(a)</enum><header>In general</header><text>Beginning one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall commence a three-year initiative to assess the feasibility and advisability of paying under section 111(a) of title 38, United States Code, the actual necessary expenses of travel or allowances for travel from a residence located in an area that is designated by the Secretary as highly rural to the nearest Vet Center and from such Vet Center to such residence.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H31A9DCA33A1E4856AACF39074AF503A3"><enum>(b)</enum><header>Report</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H8171465305D14751A2A93510335F114D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the completion of the initiative, the Secretary shall submit to Congress a report on the findings of the Secretary with respect to the initiative required by subsection (a).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H667DF9EF6AD34693802C366BBD992FA2"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include the following:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD66AA388D6394119B60931D0A33D41B3"><enum>(A)</enum><text>A description of the individuals who benefitted from payment under the initiative.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9E338579F6F04CBF9B4EB907D558A424"><enum>(B)</enum><text>A description of any impediments to the Secretary in paying expenses or allowances under the initiative.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCE4FA337B1D94FB89E93CC4F3E7F0A49"><enum>(C)</enum><text>A description of any impediments encountered by individuals in receiving such payments.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB648B55B7DDB43E18380B45E17C54DC7"><enum>(D)</enum><text>An assessment of the feasibility and advisability of paying such expenses or allowances.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H685889EAAEA14CA2B9CDF0191010B034"><enum>(E)</enum><text>An assessment of any fraudulent receipt of payment under the initiative and the recommendations of the Secretary for legislative or administrative action to reduce such fraud.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H703674D89E33416DA96898912D2C26A8"><enum>(F)</enum><text>Such recommendations for legislative or administrative action as the Secretary considers appropriate with respect to the payment of expenses or allowances as described in subsection (a).</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H01AAE419F4F04F2FAFA6E6414B240C8B"><enum>(c)</enum><header>Vet Center defined</header><text>In this section, the term <term>Vet Center</term> means a center for readjustment counseling and related mental health services for veterans under section 1712A of title 38, United States Code.</text></subsection></section> 
<section id="H46F00DE1F39445BE95457322A51353FF"><enum>105.</enum><header>Contracts and agreements for nursing home care</header> 
<subsection id="H97DF18FEEC3D4AD0B3C0E66EF9295983"><enum>(a)</enum><header>Contracts</header><text>Section 1745(a) is amended—</text> 
<paragraph id="H17DBA15BE36E40E9BC60D34CD2AFFA59"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>The Secretary shall pay each State home for nursing home care at the rate determined under paragraph (2)</quote> and inserting <quote>The Secretary shall enter into a contract (or agreement under section 1720(c)(1) of this title) with each State home for payment by the Secretary for nursing home care provided in the home</quote>; and</text></paragraph> 
<paragraph id="HC1919F50D8E44F54987AB8C70562416E"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following new paragraph (2):</text>

<paragraph id="H2BC37F4E9F804D85958CE4385F790650" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Payment under each contract (or agreement) between the Secretary and a State home under paragraph (1) shall be based on a methodology, developed by the Secretary in consultation with the State home, to adequately reimburse the State home for the care provided by the State home under the contract (or agreement).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3E0EC2B168154D18B528AB33E8F7E2C4"><enum>(b)</enum><header>Agreements</header><text>Section 1720(c)(1)(A) is amended—</text> 
<paragraph id="H8DCFD2C6EBBF42B0AD449B350743973C"><enum>(1)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H6580A2B0F3BB4F24B7B0FFD9E4B3D18A"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H4DF514A031C3460D857E8DAB86E51D32"><enum>(3)</enum><text>by adding at the end the following new clause:</text>

<subsection commented="no" display-inline="no-display-inline" id="HD2E64D7258B643CD9B4C897CDEBAA1DE"><enum>(c)</enum><header>Effective date</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HFE594B2DB9074C3E9AE2ACEE46CA5C64"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to care provided on or after the date that is 180 days after the date of the enactment of this Act.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE8B92F0D4DC24587975D306B1182D08B"><enum>(2)</enum><header>Maintenance of prior methodology of reimbursement for certain State homes</header><text display-inline="yes-display-inline">In the case of a State home that provided nursing home care on the day before the date of the enactment of this Act for which the State home was eligible for pay under section 1745(a)(1) of title 38, United States Code, at the request of any State home, the Secretary shall offer to enter into a contract (or agreement described in such section) with such State home under such section, as amended by subsection (a), for payment for nursing home care provided by such State home under such section that reflects the overall methodology of reimbursement for such care that was in effect for such State home on the day before the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H59D3810A09934B2FABE87B013A63BF0E" section-type="subsequent-section"><enum>106.</enum><header>Comprehensive policy on reporting and tracking sexual assault incidents and other safety incidents</header> 
<subsection id="HB76BDFC8D6BC42D597C92B33D0470DBB"><enum>(a)</enum><header>Policy</header><text display-inline="yes-display-inline">Subchapter I of chapter 17 is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2CA6B1D7DFAF42B6A7A13AC2F4DFD955" style="USC"> 
<section id="HB1E97476DCC24695B19D10092F7CDC2F"><enum>1709.</enum><header>Comprehensive policy on reporting and tracking sexual assault incidents and other safety incidents</header> 
<subsection id="HEF0E7AD0C0EF45B9B5E6FD3408156732"><enum>(a)</enum><header>Policy required</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H10F6350496B5457EB532E1B5CF6E5805"><enum>(1)</enum><text>Not later than September 30, 2012, the Secretary shall develop and implement a centralized and comprehensive policy on the reporting and tracking of sexual assault incidents and other safety incidents that occur at each medical facility of the Department, including—</text> 
<subparagraph id="HB7EA20DBB67D4A19A00EF9EC14EB2248" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">suspected, alleged, attempted, or confirmed cases of sexual assault, regardless of whether such assaults lead to prosecution or conviction;</text></subparagraph> 
<subparagraph id="HEEEE8CDB2170440AB69D74BC0E51063F" indent="up1"><enum>(B)</enum><text>criminal and purposefully unsafe acts;</text></subparagraph> 
<subparagraph id="H8B1535F0C0C645C5A1CC58542E4332ED" indent="up1"><enum>(C)</enum><text>alcohol or substance abuse related acts (including by employees of the Department); and</text></subparagraph> 
<subparagraph id="H98064D16F5DD4D4099AC10E3D4A6D2BA" indent="up1"><enum>(D)</enum><text>any kind of event involving alleged or suspected abuse of a patient.</text></subparagraph></paragraph> 
<paragraph id="H9F1D0198A9754F9F9AFFDF85FFEFB0E3" indent="up1"><enum>(2)</enum><text>In developing and implementing a policy under paragraph (1), the Secretary shall consider the effects of such policy on—</text> 
<subparagraph id="HF27D293DDB8B4080B203BB11A07007F1"><enum>(A)</enum><text>the use by veterans of mental health care and substance abuse treatments; and</text></subparagraph> 
<subparagraph id="H00F4667E18794989B8F3CA3E87D45F52"><enum>(B)</enum><text>the ability of the Department to refer veterans to such care or treatment.</text></subparagraph></paragraph></subsection> 
<subsection id="HE2C6E116C6C84D50A715CC5DF797F725"><enum>(b)</enum><header>Scope</header><text>The policy required by subsection (a) shall cover each of the following:</text> 
<paragraph id="H4A16C5AAE27C485D9172CDF8E6FC92DC"><enum>(1)</enum><text display-inline="yes-display-inline">For purposes of reporting and tracking sexual assault incidents and other safety incidents, definitions of the terms—</text> 
<subparagraph id="HCFE07752B7D94027BD23D8F278FB7B97"><enum>(A)</enum><text><term>safety incident</term>;</text></subparagraph> 
<subparagraph id="H31D6E1CB302E48DA96D560AA2BF72FEC"><enum>(B)</enum><text><term>sexual assault</term>; and</text></subparagraph> 
<subparagraph id="H12064B595AD8449EA2DC56354B614734"><enum>(C)</enum><text><term>sexual assault incident</term>.</text></subparagraph></paragraph> 
<paragraph id="HF5BABC0439FD4583A1781D7A7162DF2D"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HA68781FB381945F795FC9594E591604D"><enum>(A)</enum><text display-inline="yes-display-inline">The development and use of specific risk-assessment tools to examine any risks related to sexual assault that a veteran may pose while being treated at a medical facility of the Department, including clear and consistent guidance on the collection of information related to—</text> 
<clause id="H0DF602F1C1E246DAB00215BB787381C8" indent="up1"><enum>(i)</enum><text>the legal history of the veteran; and</text></clause> 
<clause id="H65766FEC049D4E7191BCB9252657BD9B" indent="up1"><enum>(ii)</enum><text>the medical record of the veteran.</text></clause></subparagraph> 
<subparagraph id="H8246458AA53144F68FC13656325C42B9" indent="up1"><enum>(B)</enum><text>In developing and using tools under subparagraph (A), the Secretary shall consider the effects of using such tools on the use by veterans of health care furnished by the Department.</text></subparagraph></paragraph> 
<paragraph id="HBA21AD21DA04449E82E3A7FF95159C3A"><enum>(3)</enum><text display-inline="yes-display-inline">The mandatory training of employees of the Department on security issues, including awareness, preparedness, precautions, and police assistance.</text></paragraph> 
<paragraph id="HCB946B73BBBA4C76B3DD4571F2B571B3"><enum>(4)</enum><text display-inline="yes-display-inline">The mandatory implementation, use, and regular testing of appropriate physical security precautions and equipment, including surveillance camera systems, computer-based panic alarm systems, stationary panic alarms, and electronic portable personal panic alarms.</text></paragraph> 
<paragraph id="HF0EFFF6364214090A2B454525501E90F"><enum>(5)</enum><text display-inline="yes-display-inline">Clear, consistent, and comprehensive criteria and guidance with respect to an employee of the Department communicating and reporting sexual assault incidents and other safety incidents to—</text> 
<subparagraph id="HE880BDB2B24E4DDD9E450A1EDB2999E1"><enum>(A)</enum><text display-inline="yes-display-inline">supervisory personnel of the employee at—</text> 
<clause id="HFD15DE29196B41E19403FC0E4A8CF8BA"><enum>(i)</enum><text>a medical facility of the Department;</text></clause> 
<clause id="H9DB64656FED64D52ACD946FB48DEBA5B"><enum>(ii)</enum><text>an office of a Veterans Integrated Service Network; and</text></clause> 
<clause id="H0F233054ED6F44D19D6642A83CB0795D"><enum>(iii)</enum><text>the central office of the Veterans Health Administration; and</text></clause></subparagraph> 
<subparagraph id="HF7776EB7837B45F196DEFFA1117C89C9"><enum>(B)</enum><text display-inline="yes-display-inline">a law enforcement official of the Department.</text></subparagraph></paragraph> 
<paragraph id="HEB9EA022191F4EFF90D38769A4580D67"><enum>(6)</enum><text display-inline="yes-display-inline">Clear and consistent criteria and guidelines with respect to an employee of the Department referring and reporting to the Office of Inspector General of the Department sexual assault incidents and other safety incidents that meet the regulatory criminal threshold prescribed under sections 901 and 902 of this title.</text></paragraph> 
<paragraph id="H89DE13D4C1884115AE48FBD98EF80383"><enum>(7)</enum><text display-inline="yes-display-inline">An accountable oversight system within the Veterans Health Administration that includes—</text> 
<subparagraph id="HA657C9C6FC82428ABF87A41B07D35898"><enum>(A)</enum><text display-inline="yes-display-inline">systematic information sharing of reported sexual assault incidents and other safety incidents among officials of the Administration who have programmatic responsibility; and</text></subparagraph> 
<subparagraph id="HBB3B11F4664541CB9A07E909CD424883"><enum>(B)</enum><text>a centralized reporting, tracking, and monitoring system for such incidents.</text></subparagraph></paragraph> 
<paragraph id="H142C6023DF5846F0A8359F286E89D132"><enum>(8)</enum><text display-inline="yes-display-inline">Consistent procedures and systems for law enforcement officials of the Department with respect to investigating, tracking, and closing reported sexual assault incidents and other safety incidents.</text></paragraph> 
<paragraph id="H372DFD5AC86847ACBED9C831E3B8CEF1"><enum>(9)</enum><text display-inline="yes-display-inline">Clear and consistent guidance for the clinical management of the treatment of sexual assaults that are reported more than 72 hours after the assault.</text></paragraph></subsection> 
<subsection id="H6BCC957955DE4811B8B147886330FCB1"><enum>(c)</enum><header>Updates to policy</header><text display-inline="yes-display-inline">The Secretary shall review and revise the policy required by subsection (a) on a periodic basis as the Secretary considers appropriate and in accordance with best practices.</text></subsection> 
<subsection id="H1C011FF9D1934D688FBC1C3239A5BDCB"><enum>(d)</enum><header>Annual Report</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB142F7BFFCC046F3AA73C610CDFE10EE"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date on which the Secretary develops the policy required by subsection (a) and not later than October 1 of each year thereafter, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the implementation of the policy.</text></paragraph> 
<paragraph id="H40D34339689D47169C75DE98E6085087" indent="up1"><enum>(2)</enum><text>The report required by paragraph (1) shall include—</text> 
<subparagraph id="H438DDF9FCAE04A7AA19BA06A1BCA72BB"><enum>(A)</enum><text display-inline="yes-display-inline">the number and type of sexual assault incidents and other safety incidents reported by each medical facility of the Department;</text></subparagraph> 
<subparagraph id="HC27C4DE49391436D9950EF9032102CAA"><enum>(B)</enum><text>a detailed description of the implementation of the policy required by subsection (a), including any revisions made to such policy from the previous year; and</text></subparagraph> 
<subparagraph id="H3B5EB77461254D0DA4D5791F834FB929"><enum>(C)</enum><text display-inline="yes-display-inline">the effectiveness of such policy on improving the safety and security of the medical facilities of the Department, including the performance measures used to evaluate such effectiveness.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDAD284E0E8B044758142CA77D2936231"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by adding after the item relating to section 1708 the following new item:</text>

<subsection id="HC4928B01310E4C8ABFFD2A4F2D204972"><enum>(a)</enum><header>Rehabilitation plans and services</header><text>Section 1710C is amended—</text> 
<paragraph id="H96553241EB4E4C0990D3D949137B2D46"><enum>(1)</enum><text>in subsection (a)(1), by inserting before the semicolon the following: <quote>with the goal of maximizing the individual’s independence</quote>;</text></paragraph>

<paragraph commented="no" display-inline="yes-display-inline" id="H2A5EADF836AA4105BDCFD360B5D5A298"><enum>(1)</enum><text>The Secretary shall carry out an initiative of teleconsultation for the provision of remote mental health and traumatic brain injury assessments in facilities of the Department that are not otherwise able to provide such assessments without contracting with third-party providers or reimbursing providers through a fee basis system.</text></paragraph> 
<paragraph id="H77A448B5BF3A4B9BB5686CD4B066CA07" indent="up1"><enum>(2)</enum><text>The Secretary shall, in consultation with appropriate professional societies, promulgate technical and clinical care standards for the use of teleconsultation services within facilities of the Department.</text></paragraph> 
<paragraph id="H5C9EEDAE0F1641ACB655D14EB474D0E5" indent="up1"><enum>(3)</enum><text>In carrying out an initiative under paragraph (1), the Secretary shall ensure that facilities of the Department are able to provide a mental health or traumatic brain injury assessment to a veteran through contracting with a third-party provider or reimbursing a provider through a fee basis system when—</text> 
<subparagraph id="H7C27BA4C003E4D2FBDE7E3D20EA48726"><enum>(A)</enum><text>such facilities are not able to provide such assessment to the veteran without—</text> 
<clause id="H8B9FE0316746470BB93CD11A8108E4BE"><enum>(i)</enum><text>such contracting or reimbursement; or</text></clause> 
<clause id="H998876B8B07D4F23A6F3462A58090DDB"><enum>(ii)</enum><text>teleconsultation; and</text></clause></subparagraph> 
<subparagraph id="HD9C08CA2FE49405BAB9994AA1829CF30"><enum>(B)</enum><text>providing such assessment with such contracting or reimbursement is more clinically appropriate for the veteran than providing such assessment with teleconsultation.</text></subparagraph></paragraph></subsection> 
<subsection id="HC47184B5C4A748C9BEC99596B59654C5"><enum>(b)</enum><header>Teleconsultation defined</header><text>In this section, the term <term>teleconsultation</term> means the use by a health care specialist of telecommunications to assist another health care provider in rendering a diagnosis or treatment.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2FC370C832534FC4993A0FCCAFB280A1"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 is amended by inserting after the item relating to section 1709, as added by section 106(b), the following new item:</text>

The Secretary shall consult with the Accreditation Council for Graduate Medical Education and with universities with which facilities of the Department have a major affiliation to determine the feasibility and advisability of making telehealth a mandatory component of medical residency programs.</text></paragraph> 
<paragraph id="H1469C1FDF6F64A2BABCFBDC78CA80D75"><enum>(2)</enum><header>Telemedicine defined</header><text>In this subsection, the term <term>telemedicine</term> means the use by a health care provider of telecommunications to assist in the diagnosis or treatment of a patient's medical condition.</text></paragraph></subsection></section> 
<section id="H547AD04B80A24ADCBB02C96CBF22D067"><enum>109.</enum><header>Use of service dogs on property of the Department of Veterans Affairs</header><text display-inline="no-display-inline">Section 901 is amended by adding at the end the following new subsection:</text>

<paragraph id="HE7DEFC7FA95C4A7BB1785D687A52266F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, a covered service dog is a service dog that has been trained by an entity that is accredited by an appropriate accrediting body that evaluates and accredits organizations which train guide or service dogs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<section id="H7CD262E1CA784135BAB473149A3C27F5"><enum>111.</enum><header>Improvements for recovery and collection of amounts for Department of Veterans Affairs Medical Care Collections Fund</header> 
<subsection id="HE9FCBF2AB9654AB4B0A501BBB3DC3802"><enum>(a)</enum><header>Development and implementation of plan for recovery and collection</header> 
<paragraph id="HA4315E60E53A4E09BB53E8513F3B9452"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall develop and implement a plan to ensure the recovery and collection of amounts under the provisions of law described in section 1729A(b) of title 38, United States Code, for deposit in the Department of Veterans Affairs Medical Care Collections Fund.</text></paragraph> 
<paragraph id="HB25071CB256A4596817AC7B14E741F65"><enum>(2)</enum><header>Elements</header><text>The plan required by paragraph (1) shall include the following:</text> 
<subparagraph id="H50F6F87FFFE84CD994592AB4941B4A0E"><enum>(A)</enum><text>An effective process to identify billable fee claims.</text></subparagraph> 
<subparagraph id="H30482A5E42354798AB558B5CB33AA0B0"><enum>(B)</enum><text>Effective and practicable policies and procedures that ensure recovery and collection of amounts described in section 1729A(b) of such title.</text></subparagraph> 
<subparagraph id="H98D184F4E19A492DA8263B8FE861D513"><enum>(C)</enum><text>The training of employees of the Department, on or before September 30, 2013, who are responsible for the recovery or collection of such amounts to enable such employees to comply with the process required by subparagraph (A) and the policies and procedures required by subparagraph (B).</text></subparagraph> 
<subparagraph id="HECCB79A497B842A69F1595867BD438CA"><enum>(D)</enum><text>Fee revenue goals for the Department.</text></subparagraph> 
<subparagraph id="H51730296D3F044F890CC967D7E361B7C"><enum>(E)</enum><text>An effective monitoring system to ensure achievement of goals described in subparagraph (D) and compliance with the policies and procedures described in subparagraph (B).</text></subparagraph></paragraph></subsection>

<subparagraph commented="no" display-inline="no-display-inline" id="H74A630606EDF4CF0B7226C090A8809A8" indent="up1"><enum>(B)</enum><text>The criteria described in this subparagraph are as follows:</text> 
<clause commented="no" display-inline="no-display-inline" id="H5F102E803A5147D783434921912D0723"><enum>(i)</enum><text>The disability is due to the loss, or loss of use, of both lower extremities such as to preclude locomotion without the aid of braces, crutches, canes, or a wheelchair.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H50D5692C41EA40E2971C68258E9557A4"><enum>(ii)</enum><text>The disability is due to—</text> 
<subclause id="H10CD84D89EA243009BFB79533199C301"><enum>(I)</enum><text>blindness in both eyes, having only light perception, plus (ii) loss or loss of use of one lower extremity.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H7E3602C2C17C4F608F36D5F7F226BA2F"><enum>(iii)</enum><text>The disability is due to the loss or loss of use of one lower extremity together with—</text> 
<subclause id="H7844592BF87A4A929C1B0D6BEC34311A"><enum>(I)</enum><text>residuals of organic disease or injury; or</text></subclause> 
<subclause id="HD07B91F8380A43DE82DF6A7A17A9FB52"><enum>(II)</enum><text>the loss or loss of use of one upper extremity,</text></subclause><continuation-text continuation-text-level="clause" indent="paragraph">which so affect the functions of balance or propulsion as to preclude locomotion without the aid of braces, crutches, canes, or a wheelchair.</continuation-text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H2792A1103C3241E79C00D85303815D84"><enum>(iv)</enum><text>The disability is due to the loss, or loss of use, of both upper extremities such as to preclude use of the arms at or above the elbows.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H93C4800E9D2C4FDEAED7B214FB282363"><enum>(v)</enum><text>The disability is due to a severe burn injury (as determined pursuant to regulations prescribed by the Secretary).</text></clause></subparagraph> 
<subparagraph id="H800AE76E8569490CBAFA94E35A8627F6" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The criterion described in this subparagraph is that the disability—</text> 
<clause id="H40555036CB214A17B6EF78C315525E65"><enum>(i)</enum><text display-inline="yes-display-inline">was incurred on or after September 11, 2001; and</text></clause> 
<clause id="H993EEFBFC4514C06B75FE052291D77B1"><enum>(ii)</enum><text display-inline="yes-display-inline">is due to the loss or loss of use of one or more lower extremities which so affects the functions of balance or propulsion as to preclude ambulating without the aid of braces, crutches, canes, or a wheelchair.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H90983AE91E5048DB9F6E3D8B87C79843"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2012.</text></subsection>

<subsection commented="no" display-inline="no-display-inline" id="HAE1ABF024D2C4692A5A937E065EF6113"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (2) of section 2101(b) is amended to read as follows:</text>

<paragraph commented="no" display-inline="no-display-inline" id="HF4984994EF584DB0B62E0A110BA42B95" indent="up1"><enum>(2)</enum><text>A veteran is described in this paragraph if the veteran is entitled to compensation under chapter 11 of this title for a service-connected disability that meets any of the following criteria:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H6021889A68E14397AE1252B4ED240342"><enum>(A)</enum><text>The disability is due to blindness in both eyes, having central visual acuity of 20/200 or less in the better eye with the use of a standard correcting lens. For the purposes of this subparagraph, an eye with a limitation in the fields of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees shall be considered as having a central visual acuity of 20/200 or less.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H861E0AFC5AA04692960EA309E64C18BF"><enum>(B)</enum><text>A permanent and total disability that includes the anatomical loss or loss of use of both hands.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H56A1947946764A93A0DB57AD58AA4206"><enum>(C)</enum><text>A permanent and total disability that is due to a severe burn injury (as so determined).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HBEED62D6F2A445CABD848482D317732C"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2012.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H18B165F0EEC14D2E9E35D64CD1653F85"><enum>204.</enum><header>Revised limitations on assistance furnished for acquisition and adaptation of housing for disabled veterans</header>

<paragraph commented="no" display-inline="no-display-inline" id="HAB977C1F85BD45C8A82C767A39CE7155" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The aggregate amount of assistance available to an individual under section 2101(b) of this title shall be limited to $12,756.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H204B7530218B44699AC30154F61AD7A5" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No veteran may receive more than three grants of assistance under this chapter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H180CEF6CCC1442FBA5FE27FCD18F7B25"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is one year after the date of the enactment of this Act and shall apply with respect to assistance provided under sections 2101(a), 2101(b), and 2102A of title 38, United States Code, after such date.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H67946E242D144BE789985173FEBB7D64"><enum>(c)</enum><header>Maintenance of higher rates</header><text>The amendment made by subsection (a) shall not be construed to decrease the aggregate amount of assistance available to an individual under the sections described in subsection (b), as most recently increased by the Secretary pursuant to section 2102(e) of such title.</text></subsection></section>

<section id="HC9E6713E90FF4AAFA59AC2FCFEE27051"><enum>206.</enum><header>Department of Veterans Affairs housing loan guarantees for surviving spouses of certain totally disabled veterans</header> 
<subsection id="H191B22ADA9E8462698C07E56E1A68A7E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3701(b) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="HBF5E83CC3FC24A70994567D64608AE90" style="USC"> 
<paragraph id="H6E0D6762A97D4CB59955AF24417D442D"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>veteran</term> also includes, for purposes of home loans, the surviving spouse of a veteran who died and who was in receipt of or entitled to receive (or but for the receipt of retired or retirement pay was entitled to receive) compensation at the time of death for a service-connected disability rated totally disabling if—</text> 
<subparagraph id="HC3E4B8EF9EE3459689889C739C058E81"><enum>(A)</enum><text display-inline="yes-display-inline">the disability was continuously rated totally disabling for a period of 10 or more years immediately preceding death;</text></subparagraph> 
<subparagraph id="HFF270DC36F5B4209A4A4F28B5864DE5B"><enum>(B)</enum><text>the disability was continuously rated totally disabling for a period of not less than five years from the date of such veteran’s discharge or other release from active duty; or</text></subparagraph> 
<subparagraph id="HF9617CB354544613B6D29A57D6658634"><enum>(C)</enum><text>the veteran was a former prisoner of war who died after September 30, 1999, and the disability was continuously rated totally disabling for a period of not less than one year immediately preceding death.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2C44BB0621D349B8A814DB743DC0BB9E"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to a loan guaranteed after the date of the enactment of this Act.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC6C4222E502842E7A6E19FA7F3B5C5D3"><enum>(c)</enum><header>Clarification with respect to certain fees</header><text>Fees shall be collected under section 3729 of title 38, United States Code, from a person described in paragraph (6) of section 3701(b) of such title, as added by subsection (a) of this section, in the same manner as such fees are collected from a person described in paragraph (2) of section 3701(b) of such title.</text></subsection></section> 
<section id="HE3668DE08C9947FBBC45C743DB03F721"><enum>207.</enum><header>Occupancy of property by dependent child of veteran for purposes of meeting occupancy requirement for Department of Veterans Affairs housing loans</header><text display-inline="no-display-inline">Paragraph (2) of section 3704(c) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HCF84F7A2B73A44D190A32CDBA6D23A08" style="OLC"> 
<paragraph id="H5346FC4AFBAD40B6AF07887358A5FC1D" indent="up1"><enum>(2)</enum><text>In any case in which a veteran is in active-duty status as a member of the Armed Forces and is unable to occupy a property because of such status, the occupancy requirements of this chapter shall be considered to be satisfied if—</text> 
<subparagraph id="H387FA077EA2740B78448B92DCCD9E169"><enum>(A)</enum><text>the spouse of the veteran occupies or intends to occupy the property as a home and the spouse makes the certification required by paragraph (1) of this subsection; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4757F4B4FBA148F3821C0BB3F9773C6D"><enum>(B)</enum><text>a dependent child of the veteran occupies or will occupy the property as a home and the veteran’s attorney-in-fact or legal guardian of the dependent child makes the certification required by paragraph (1) of this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H79BA5D2C6221461B816FD3C9AB700468"><enum>208.</enum><header>Making permanent project for guaranteeing of adjustable rate mortgages</header><text display-inline="no-display-inline">Section 3707(a) is amended by striking <quote>demonstration project under this section during fiscal years 1993 through 2012</quote> and inserting <quote>project under this section</quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H92FFDF196CC0452EB1F8C2A084141258"><enum>209.</enum><header>Making permanent project for insuring hybrid adjustable rate mortgages</header><text display-inline="no-display-inline">Section 3707A(a) is amended by striking <quote>demonstration project under this section during fiscal years 2004 through 2012</quote> and inserting <quote>project under this section</quote>.</text></section> 
<section id="H086FBF2D59EF4B9BA364C28329EF0AA9"><enum>210.</enum><header>Waiver of loan fee for individuals with disability ratings issued during pre-discharge programs</header><text display-inline="no-display-inline">Paragraph (2) of section 3729(c) is amended to read as follows:</text>

<subparagraph id="H19FA320C93404FB995FC087F4B9328A2" indent="up1"><enum>(B)</enum><text>A veteran described in this subparagraph is a veteran who is rated eligible to receive compensation—</text> 
<clause id="H495DF26AD214453BBD1C979EA3A58F86"><enum>(i)</enum><text>as the result of a pre-discharge disability examination and rating; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H772916F83D0041F8B99DF922F34FFB0A"><enum>(ii)</enum><text>based on a pre-discharge review of existing medical evidence (including service medical and treatment records) that results in the issuance of a memorandum rating.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section commented="no" display-inline="no-display-inline" id="H8AB36514A34841F8A8DBA4B16ACD9D7D"><enum>211.</enum><header>Modification of authorities for enhanced-use leases of real property</header> 
<subsection commented="no" display-inline="no-display-inline" id="HE50109B2420443CB9BBDB7D5588C7D9A"><enum>(a)</enum><header>Supportive housing defined</header><text display-inline="yes-display-inline">Section 8161 is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="HD6470B0EFA304C92A66F8E5E1CF729CF" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="HB8152C1F6B38463DAF8CED7348D8C758"><enum>(3)</enum><text>The term <term>supportive housing</term> means housing that engages tenants in on-site and community-based support services for veterans or their families that are at risk of homelessness or are homeless. Such term may include the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H55554343C2A944E1B493C3AD3BFFE2C7"><enum>(C)</enum><text>Permanent housing.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAFAF7707403049788156C88F93241707"><enum>(D)</enum><text>Congregate living housing.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H466E7CC8A99B4C28AA4076AE9A1E38DB"><enum>(E)</enum><text>Independent living housing.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H815A34D41C4743369646486ACCCBE80A"><enum>(F)</enum><text>Assisted living housing.</text></subparagraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H819C0861D7754394B9D96D760688683F"><enum>(B)</enum><header>Previous leases</header><text>Any enhanced-use lease that the Secretary has entered into prior to the date described in subparagraph (A) shall be subject to the provisions of subchapter V of chapter 81 of such title, as in effect on the day before the date of the enactment of this Act.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7CA9AF7442C2470F936D51CDA86C8998"><enum>(c)</enum><header>Consideration for and terms of enhanced-use leases</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H60BC1420254A4F40A9EE8781B03159C5"><enum>(1)</enum><header>In general</header><text>Section 8162(b) is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFCDBA264548A4714995C2649456114F2"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(A) If the Secretary</quote> and all that follows through <quote>under subparagraph (A).</quote> and inserting the following: <quote>If the Secretary has determined that a property should be leased to another party through an enhanced-use lease, the Secretary shall, at the Secretary's discretion, select the party with whom the lease will be entered into using such selection procedures as the Secretary considers appropriate.</quote>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H75E7B4C2118C4788BF8FDCDDADA13999"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text>

<subparagraph commented="no" display-inline="yes-display-inline" id="H908FFF801D3F4DAA912C8063E0DCA5F3"><enum>(A)</enum><text>For any enhanced-use lease entered into by the Secretary, the lease consideration provided to the Secretary shall consist solely of cash at fair value as determined by the Secretary.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8349CC4F249B40D68CA0C74EB2D4C796" indent="up1"><enum>(B)</enum><text>The Secretary shall receive no other type of consideration for an enhanced-use lease besides cash.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H483823E6472F4F70B8B2F9673F187344" indent="up1"><enum>(C)</enum><text>The Secretary may enter into an enhanced-use lease without receiving consideration.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4159B37305CB41288C8131FD4E21D2BF"><enum>(C)</enum><text>in paragraph (4), by striking <quote>Secretary to</quote> and all that follows through <quote>use minor</quote> and inserting <quote>Secretary to use minor</quote>; and</text></subparagraph>

<paragraph id="H2D8D59884518415E9C6FAF9D9150DA3C" indent="up1"><enum>(6)</enum><text>The Secretary may not enter into an enhanced-use lease without certification in advance in writing by the Director of the Office of Management and Budget that such lease complies with the requirements of this subchapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7CB94700BF9A43A095402AB57BED389C"><enum>(2)</enum><header>Effective date</header><text>Paragraph (3) of section 8162(b), as amended by paragraph (1)(B) of this subsection, shall take effect on January 1, 2012, and shall apply with respect to enhanced-use leases entered into on or after such date.</text></paragraph></subsection>

<subsection commented="no" display-inline="no-display-inline" id="HEB3675E7BCAA42E78DDA9507F952BECB"><enum>(b)</enum><header>Underlying fee title interest exempted</header><text display-inline="yes-display-inline">The underlying fee title interest of the United States in any land subject to an enhanced-use lease shall not be subject, directly or indirectly, to any provision of State or local law relating to taxation, fees, or assessments.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE6E1FBF59E054472941B9A1BD57F2C33"><enum>(i)</enum><header>Annual reports</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H9727622FB3154714917FB8966410D033"><enum>(1)</enum><header>In general</header><text>Subchapter V of chapter 81 is amended by inserting after section 8167 the following new section:</text>

<subsection id="H76004742FEA8465B8BBBFE9FF8EA154C"><enum>(a)</enum><header>Report on administration of leases</header><text>Not later than 120 days after the date of the enactment of the <short-title>Honoring America’s Veterans and Caring for Camp Lejeune Families Act of 2012</short-title> and not less frequently than once each year thereafter, the Secretary shall submit to Congress a report identifying the actions taken by the Secretary to implement and administer enhanced-use leases.</text></subsection> 
<subsection id="H0D096ED1261C4912953B465090A2E32A"><enum>(b)</enum><header>Report on lease consideration</header><text>Each year, as part of the annual budget submission of the President to Congress under section 1105(a) of title 31, the Secretary shall submit to Congress a detailed report of the consideration received by the Secretary for each enhanced-use lease under this subchapter, along with an overview of how the Secretary is utilizing such consideration to support veterans.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF63337B6163C41CEAE1184F61BAAC430"><enum>(2)</enum><header>Elements of initial report</header><text>The first report submitted by the Secretary under section 8168(a) of title 38, United States Code, as added by paragraph (1), shall include a summary of those measures the Secretary is taking to address the following recommendations from the February 9, 2012, audit report of the Department of Veterans Affairs Office of Inspector General on enhanced-use leases under subchapter V of chapter 81 of title 38, United States Code:</text> 
<subparagraph id="HBB1E488BD6ED49D6BBDB2ADA9A2226D3"><enum>(A)</enum><text>Improve standards to ensure complete lease agreements are negotiated in line with strategic goals of the Department of Veterans Affairs.</text></subparagraph> 
<subparagraph id="H44F85128AC8E4860B1CDA343676072C7"><enum>(B)</enum><text>Institute improved policies and procedures to govern activities such as monitoring enhanced-use lease projects and calculating, classifying, and reporting on enhanced-use lease benefits and expenses.</text></subparagraph>

<subclause commented="no" display-inline="no-display-inline" id="HCCAADF324EE84CE58D627504BA8D87A5"><enum>(I)</enum><text display-inline="yes-display-inline">that has received, or has temporary clearance to receive, tax-exempt status under paragraph (2), (3), or (19) of section 501(c) of the Internal Revenue Code of 1986;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H1A2EFB15F10F415CA818355501B16B7C"><enum>(II)</enum><text display-inline="yes-display-inline">for which no part of the net earnings of the institution, organization, or foundation inures to the benefit of any member, founder, or contributor of the institution, organization, or foundation; and</text></subclause>

<paragraph commented="no" display-inline="no-display-inline" id="HDD20FC80919D46DE9216366078EA31AB"><enum>(1)</enum><header display-inline="yes-display-inline">Study and development of fiscal controls and payment method</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4118702F5E924584B2D830A8905BF264"><enum>(A)</enum><text display-inline="yes-display-inline">complete a study of all matters relating to the method used by the Secretary to make per diem payments under section 2012(a) of title 38, United States Code, including changes anticipated by the Secretary in the cost of furnishing services to homeless veterans and accounting for costs of providing such services in various geographic areas;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H32C06141CC4B439E84E6A9624F42B995"><enum>(B)</enum><text display-inline="yes-display-inline">develop more effective and efficient procedures for fiscal control and fund accounting by recipients of grants under sections 2011, 2012, and 2061 of such title; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5805498B30EF4826912C8D8501DD93A7"><enum>(C)</enum><text display-inline="yes-display-inline">develop a more effective and efficient method for adequately reimbursing recipients of grants under section 2011 of such title for services furnished to homeless veterans.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H64E15082D1854E58AA3B17852DE50DD5"><enum>(2)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">In developing the method required by paragraph (1)(C), the Secretary may consider payments and grants received by recipients of grants described in such paragraph from other departments and agencies of Federal and local governments and from private entities.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H93E359F820E44DF49C9AAA91562F58E9"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary shall submit to Congress a report on—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HACB3F5DA974349E1A9CAF93268575715"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the Secretary with respect to the study required by subparagraph (A) of paragraph (1);</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H627A7CBD42CF457DBE0D565ABDBC53D7"><enum>(B)</enum><text display-inline="yes-display-inline">the methods developed under subparagraphs (B) and (C) of such paragraph; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDDB2C346DBFE4AE8BE64E389B7E891A0"><enum>(C)</enum><text display-inline="yes-display-inline">any recommendations of the Secretary for revising the method described in subparagraph (A) of such paragraph and any legislative action the Secretary considers necessary to implement such method.</text></subparagraph></paragraph></subsection></section>

<subsection id="HA8F7FDAAAB65483FBA3A601ED9E13847"><enum>(a)</enum><header>Inclusion of entities eligible for comprehensive service program grants and per diem payments for services to homeless veterans</header><text>Subsection (a) of section 2061 is amended—</text> 
<paragraph id="H4E20A0C0EE8B42D08EA9F128ECD6E324"><enum>(1)</enum><text>by striking <quote>to grant and per diem providers</quote> and inserting <quote>to entities eligible for grants and per diem payments under sections 2011 and 2012 of this title</quote>; and</text></paragraph>

<paragraph id="H089BCEDD4E91461F8A3CD31ED4EC8B66"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="H0521548476C9486086CF2A5D08652530"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text> 
<quoted-block display-inline="no-display-inline" id="HCA65E9DC308C4090916A35EC258BF2FA" style="OLC"> 
<subsection id="HB98CDCC341CB4B8B9A8E41862D691218"><enum>(c)</enum><header>Provision of services to dependents</header><text>A recipient of a grant under subsection (a) may use amounts under the grant to provide services directly to a dependent of a homeless veteran with special needs who is under the care of such homeless veteran while such homeless veteran receives services from the grant recipient under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HD1BBD91F424F40CB8740A7EFC978E170"><enum>304.</enum><header>Collaboration in provision of case management services to homeless veterans in supported housing program</header> 
<subsection id="H19B450C6B8454FCEA48E73E9353A4D26"><enum>(a)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall consider entering into contracts or agreements, under sections 513 and 8153 of title 38, United States Code, with eligible entities to collaborate with the Secretary in the provision of case management services to covered veterans as part of the supported housing program carried out under section 8(o)(19) of the United States Housing Act of 1937 (42 U.S.C. 1437f(o)(19)) to ensure that the homeless veterans facing the most significant difficulties in obtaining suitable housing receive the assistance they require to obtain such housing.</text></subsection> 
<subsection id="H961ADA85C69F4BC99A71F731A82874CD"><enum>(b)</enum><header>Covered veterans</header><text>For purposes of this section, a covered veteran is any veteran who, at the time of receipt of a housing voucher under such section 8(o)(19)—</text> 
<paragraph id="H899542ACC4DF497AAB9C3D553017B306"><enum>(1)</enum><text>requires the assistance of a case manager in obtaining suitable housing with such voucher; and</text></paragraph> 
<paragraph id="H2750E3A326804B1586FFA8728859B019"><enum>(2)</enum><text>is having difficulty obtaining the amount of such assistance the veteran requires, including because—</text> 
<subparagraph id="HAFAEEB78F90E4CCC9E6963C41440B882"><enum>(A)</enum><text>the veteran resides in an area that has a shortage of low-income housing and because of such shortage the veteran requires more assistance from a case manager than the Secretary otherwise provides;</text></subparagraph> 
<subparagraph id="H792AAB631B8B451997B974E3D442314B"><enum>(B)</enum><text>the location in which the veteran resides is located at such distance from facilities of the Department of Veterans Affairs as makes the provision of case management services by the Secretary to such veteran impractical; or</text></subparagraph> 
<subparagraph id="HDE4394D4FF1240E5924970F6D8FD8E12"><enum>(C)</enum><text>the veteran resides in an area where veterans who receive case management services from the Secretary under such section have a significantly lower average rate of successfully obtaining suitable housing than the average rate of successfully obtaining suitable housing for all veterans receiving such services.</text></subparagraph></paragraph></subsection> 
<subsection id="H5BB50839F9ED4394B058F4622C629FED"><enum>(c)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is any State or local government agency, tribal organization (as such term is defined in section 4 of the Indian Self Determination and Education Assistance Act (25 U.S.C. 450b)), or nonprofit organization that—</text> 
<paragraph id="H648A6367D57444AEBF53EFF547CF6EFC"><enum>(1)</enum><text>under a contract or agreement described in subsection (a), agrees—</text> 
<subparagraph id="H7BC233B1F7B64A8198408BC5DC3B5BCD"><enum>(A)</enum><text>to ensure access to case management services by covered veterans on an as-needed basis;</text></subparagraph> 
<subparagraph id="H2A081E2844BB40B19ABFD21B4FFE1B67"><enum>(B)</enum><text>to maintain referral networks for covered veterans for purposes of assisting covered veterans in demonstrating eligibility for assistance and additional services under entitlement and assistance programs available for covered veterans, and to otherwise aid covered veterans in obtaining such assistance and services;</text></subparagraph> 
<subparagraph id="H9F0D04838E0F4F26A0E6A9B7962EA171"><enum>(C)</enum><text>to ensure the confidentiality of records maintained by the entity on covered veterans receiving services through the supported housing program described in subsection (a);</text></subparagraph> 
<subparagraph id="HB01D4821AE6347FEA446895D03EAE321"><enum>(D)</enum><text>to establish such procedures for fiscal control and fund accounting as the Secretary of Veterans Affairs considers appropriate to ensure proper disbursement and accounting of funds under a contract or agreement entered into by the entity as described in subsection (a);</text></subparagraph> 
<subparagraph id="H1743BC1CFE0B49148FF3A96F7020B209"><enum>(E)</enum><text>to submit to the Secretary each year, in such form and such manner as the Secretary may require, a report on the collaboration undertaken by the entity under a contract or agreement described in such subsection during the most recent fiscal year, including a description of, for the year covered by the report—</text> 
<clause id="HCF41F663889B48E4B6C5D141C67BCB86"><enum>(i)</enum><text>the services and assistance provided to covered veterans as part of such collaboration;</text></clause> 
<clause id="HB09DADA41C6C44B1807505E9124B0A8D"><enum>(ii)</enum><text>the process by which covered veterans were referred to the entity for such services and assistance;</text></clause> 
<clause id="H5EDD9556AE1E452495403708CCA52B0B"><enum>(iii)</enum><text>the specific goals jointly set by the entity and the Secretary for the provision of such services and assistance and whether the entity achieved such goals; and</text></clause> 
<clause id="H34E2C6B2A2BC46EB898AB9E44A957CA8"><enum>(iv)</enum><text>the average length of time taken by a covered veteran who received such services and assistance to successfully obtain suitable housing and the average retention rate of such a veteran in such housing; and</text></clause></subparagraph> 
<subparagraph id="H7856F91041B847C49548C255D93C061F"><enum>(F)</enum><text>to meet such other requirements as the Secretary considers appropriate for purposes of providing assistance to covered veterans in obtaining suitable housing; and</text></subparagraph></paragraph> 
<paragraph id="H780C9C10428A4F3FA699A716196B90CC"><enum>(2)</enum><text>has demonstrated experience in—</text> 
<subparagraph id="H5EDB3D835F894EE7964AE0141542687F"><enum>(A)</enum><text>identifying and serving homeless veterans, especially those who have the greatest difficulty obtaining suitable housing;</text></subparagraph> 
<subparagraph id="H44B226B92A864C0998273F888FE58652"><enum>(B)</enum><text>working collaboratively with the Department of Veterans Affairs or the Department of Housing and Urban Development;</text></subparagraph> 
<subparagraph id="H82203E2BAA3E4CA9A11AB41D8960F39C"><enum>(C)</enum><text>conducting outreach to, and maintaining relationships with, landlords to encourage and facilitate participation by landlords in supported housing programs similar to the supported housing program described in subsection (a);</text></subparagraph> 
<subparagraph id="H6EBD3A47358140AFA47C16E89BD9FE50"><enum>(D)</enum><text>mediating disputes between landlords and veterans receiving assistance under such supported housing program; and</text></subparagraph> 
<subparagraph id="H0DA769FB22374B349C98CAABFBB2986F"><enum>(E)</enum><text>carrying out such other activities as the Secretary of Veterans Affairs considers appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H0DF4E2EB6E98424C9BC2F6BFF5FDDE5D"><enum>(d)</enum><header>Consultation</header><text>In considering entering into contracts or agreements as described in subsection (a), the Secretary of Veterans Affairs shall consult with—</text> 
<paragraph id="HA20824EBB6E444809F37FFDE64537E7A"><enum>(1)</enum><text>the Secretary of Housing and Urban Development; and</text></paragraph> 
<paragraph id="HB5C9DB8FA6C844DE8D084D5CC537B6AC"><enum>(2)</enum><text>third parties that provide services as part of the Department of Housing and Urban Development continuum of care.</text></paragraph></subsection> 
<subsection id="H6378E3CA4AB048C58ED471F1F2BA54A8"><enum>(e)</enum><header>Technical assistance for collaborating entities</header> 
<paragraph id="HCDB65350AF5E4BE89BA863CFA634860C"><enum>(1)</enum><header>In general</header><text>The Secretary may provide training and technical assistance to entities with whom the Secretary collaborates in the provision of case management services to veterans as part of the supported housing program described in subsection (a).</text></paragraph> 
<paragraph id="H0BC357B3CA034039B87252658A627E5B"><enum>(2)</enum><header>Grants</header><text>The Secretary may provide training and technical assistance under paragraph (1) through the award of grants or contracts to appropriate public and nonprofit private entities.</text></paragraph> 
<paragraph id="H0D391F69EE9344C2BCF1228FC6B00485"><enum>(3)</enum><header>Funding</header><text>From amounts appropriated or otherwise made available to the Secretary in the Medical Services account in a year, $500,000 shall be available to the Secretary in that year to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H945A0CED704940558122FCC006D7CEA3"><enum>(f)</enum><header>Annual report</header> 
<paragraph id="H1561D5ED6F454708A285749B2FE3C8E8"><enum>(1)</enum><header>In general</header><text>Not later than 545 days after the date of the enactment of this Act and not less frequently than once each year thereafter, the Secretary of Veterans Affairs shall submit to Congress a report on the collaboration between the Secretary and eligible entities in the provision of case management services as described in subsection (a) during the most recently completed fiscal year.</text></paragraph> 
<paragraph id="H4C4356AC4BD645989F66144BED1E8A48"><enum>(2)</enum><header>Elements</header><text>Each report required by paragraph (1) shall include, for the period covered by the report, the following:</text> 
<subparagraph id="H01836CB1D1264EF39DCECA847292842E"><enum>(A)</enum><text>A discussion of each case in which a contract or agreement described in subsection (a) was considered by the Secretary, including a description of whether or not and why the Secretary chose or did not choose to enter into such contract or agreement.</text></subparagraph> 
<subparagraph id="HE81E08892228473CA632EACC701C5A89"><enum>(B)</enum><text>The number and types of eligible entities with whom the Secretary has entered into a contract or agreement as described in subsection (a).</text></subparagraph> 
<subparagraph id="HA2BC2E49915B4641BB03975D00B5B511"><enum>(C)</enum><text>A description of the geographic regions in which such entities provide case management services as described in such subsection.</text></subparagraph> 
<subparagraph id="HCC4B91E087DC44A2B65BCEDF11A76E48"><enum>(D)</enum><text>A description of the number and types of covered veterans who received case management services from such entities under such contracts or agreements.</text></subparagraph>

<paragraph commented="no" display-inline="no-display-inline" id="H55873A8EB91045F8AE7F813C214AEFC0"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), in the case of an individual whose period of entitlement to assistance under a provision of law referred to in section 3695(a) of title 38, United States Code (other than chapter 35 of such title), as in effect on September 30, 2013, was reduced under such section 3695(a), as so in effect, by reason of the utilization of entitlement to assistance under chapter 35 of such title before October 1, 2013, the period of entitlement to assistance of such individual under such provision shall be determined without regard to any entitlement so utilized by the individual under chapter 35 of such title.</text></paragraph>

<subsection id="HD69B3B23D12946839180F3A466176A39"><enum>(a)</enum><header>Reports required</header> 
<paragraph id="HDDD1D673456D4DDA8B1E3AA1E9339FB2"><enum>(1)</enum><header>In general</header><text>Subchapter III of chapter 33 is amended by adding at the end the following new section:</text>

<paragraph id="HF184BF33E92D43CAAAFDF5EDF7B02010"><enum>(1)</enum><text>the Secretary of Defense shall submit to Congress a report on the operation of the program provided for in this chapter; and</text></paragraph> 
<paragraph id="HF1E3F2C5A1CD40789C67CD88D0722AC3"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary shall submit to Congress a report on the operation of the program provided for in this chapter and the program provided for under chapter 35 of this title.</text></paragraph></subsection> 
<subsection id="HC207ACC86A0945DDB5D5F13BBF68A821"><enum>(b)</enum><header>Contents of Secretary of Defense reports</header><text>The Secretary of Defense shall include in each report submitted under this section—</text> 
<paragraph id="HFD0CDA4952934026B18297375C17FBB7"><enum>(1)</enum><text>information—</text> 
<subparagraph id="H9261DC53E28C432184B3BF807F48C741"><enum>(A)</enum><text>indicating the extent to which the benefit levels provided under this chapter are adequate to achieve the purposes of inducing individuals to enter and remain in the Armed Forces and of providing an adequate level of financial assistance to help meet the cost of pursuing a program of education;</text></subparagraph> 
<subparagraph id="H5FA3D6576B394E1F912185C7DC85123B"><enum>(B)</enum><text>indicating whether it is necessary for the purposes of maintaining adequate levels of well-qualified active-duty personnel in the Armed Forces to continue to offer the opportunity for educational assistance under this chapter to individuals who have not yet entered active-duty service; and</text></subparagraph> 
<subparagraph id="HBF997E37B57D4A6C993982FD9D18ED2E"><enum>(C)</enum><text>describing the efforts under section 3323(b) of this title to inform members of the Armed Forces of the active duty service requirements for entitlement to educational assistance under this chapter and the results from such efforts; and</text></subparagraph></paragraph> 
<paragraph id="H551E2EA1B14B4F3B8783A9C5A134F9A7"><enum>(2)</enum><text>such recommendations for administrative and legislative changes regarding the provision of educational assistance to members of the Armed Forces and veterans, and their dependents, as the Secretary of Defense considers appropriate.</text></paragraph></subsection> 
<subsection id="HF81A1581C93C4294B946E5E167AB0CC2"><enum>(c)</enum><header>Contents of Secretary of Veterans Affairs reports</header><text>The Secretary shall include in each report submitted under this section—</text> 
<paragraph id="H63B3ED6C8B544320AC3A08C98A2659E7"><enum>(1)</enum><text>information concerning the level of utilization of educational assistance and of expenditures under this chapter and under chapter 35 of this title;</text></paragraph> 
<paragraph id="H950F270E7C4143A3A6A7B29FC7A6D3AD"><enum>(2)</enum><text>appropriate student outcome measures, such as the number of credit hours, certificates, degrees, and other qualifications earned by beneficiaries under this chapter and chapter 35 of this title during the academic year covered by the report; and</text></paragraph> 
<paragraph id="HBC0687D750204A91A8495CEF59DFD8F8"><enum>(3)</enum><text>such recommendations for administrative and legislative changes regarding the provision of educational assistance to members of the Armed Forces and veterans, and their dependents, as the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HEDB21161175E4657B5CCF6DB1539CE41"><enum>(d)</enum><header>Termination</header><text>No report shall be required under this section after January 1, 2021.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subparagraph id="H8C21AE41FCD94253850A3A04290A375B"><enum>(A)</enum><text>provides sufficient notice of the information and evidence necessary to substantiate such subsequent claim; and</text></subparagraph> 
<subparagraph id="H6457544BA5B046A1974B761772813D6A"><enum>(B)</enum><text>was sent within one year of the date on which the subsequent claim was filed.</text></subparagraph></paragraph> 
<paragraph id="H19DB57310E054EBABB46B7CBD8C15F2A" indent="up1"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H95107499AFA44D48B61325AB3F7D9801"><enum>(A)</enum><text>This section shall not apply to any claim or issue where the Secretary may award the maximum benefit in accordance with this title based on the evidence of record.</text></subparagraph> 
<subparagraph id="HF64D9F324CB843C883792DD034622665" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>maximum benefit</term> means the highest evaluation assignable in accordance with the evidence of record, as long as such evidence is adequate for rating purposes and sufficient to grant the earliest possible effective date in accordance with section 5110 of this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD15BF2EA1564401C98119DEB57861A61"><enum>(b)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in the amendments made by subsection (a) shall be construed as eliminating any requirement with respect to the contents of a notice under section 5103 of title 38, United States Code, that is required under regulations prescribed pursuant to subsection (a)(2) of such section as of the date of the enactment of this Act.</text></subsection> 
<subsection id="H70144B28DD6E408D88411FA87748DB07"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="H2BA515B1D8DA4E959BFD6290D911FC2F"><enum>(1)</enum><header>In general</header><text>The amendments made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act and shall apply with respect to notification obligations of the Secretary of Veterans Affairs on or after such date.</text></paragraph> 
<paragraph id="HAF2F8FAD56DC4410ABDFC440259B0581"><enum>(2)</enum><header>Construction regarding applicability</header><text>Nothing in this section or the amendments made by this section shall be construed to require the Secretary to carry out notification procedures in accordance with requirements of section 5103 of title 38, United States Code, as in effect on the day before the effective date established in paragraph (1) on or after such effective date.</text></paragraph></subsection></section> 
<section id="HBB772983BC4F4D40A48B1679C22E666E"><enum>505.</enum><header>Duty to assist claimants in obtaining private records</header> 
<subsection id="H11053EC6C3BD4892B8BE6A996457C5B3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (b) of section 5103A is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HB4F1603530C7474DBE71B73D93BA8877" style="USC"> 
<subsection id="HE49636D022624C8F93E56C011BFADEBE"><enum>(b)</enum><header>Assistance in obtaining private records</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB541A572B4DD4A8A9EF7620A34E9027D"><enum>(1)</enum><text display-inline="yes-display-inline">As part of the assistance provided under subsection (a), the Secretary shall make reasonable efforts to obtain relevant private records that the claimant adequately identifies to the Secretary.</text></paragraph> 
<paragraph display-inline="no-display-inline" id="HBC421B563AC0450C82953C3AEC453552" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HD86A6E07B09B4DE58CB5EC0F5373FDBD"><enum>(A)</enum><text>Whenever the Secretary, after making such reasonable efforts, is unable to obtain all of the relevant records sought, the Secretary shall notify the claimant that the Secretary is unable to obtain records with respect to the claim. Such a notification shall—</text> 
<clause display-inline="no-display-inline" id="HBE02C3B24D9B4F2891C4F15B709F5858" indent="up1"><enum>(i)</enum><text>identify the records the Secretary is unable to obtain;</text></clause> 
<clause display-inline="no-display-inline" id="H56029A193D8C473DAA3B2F25B5720DF1" indent="up1"><enum>(ii)</enum><text>briefly explain the efforts that the Secretary made to obtain such records; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H804198BE3CC14ABE9D60D4451F7131E0" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">explain that the Secretary will decide the claim based on the evidence of record but that this section does not prohibit the submission of records at a later date if such submission is otherwise allowed.</text></clause></subparagraph> 
<subparagraph commented="no" id="HCB2424C170FC457BA397D22DA1F40BBB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall make not less than two requests to a custodian of a private record in order for an effort to obtain relevant private records to be treated as reasonable under this section, unless it is made evident by the first request that a second request would be futile in obtaining such records.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HD1BC845C097540029B7FC007F84932AE" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H317B439507AD488293C228AD6F3A180A"><enum>(A)</enum><text>This section shall not apply if the evidence of record allows for the Secretary to award the maximum benefit in accordance with this title based on the evidence of record.</text></subparagraph> 
<subparagraph id="H01C5948AAD414D7CBC44A8F0C917E291" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the term <term>maximum benefit</term> means the highest evaluation assignable in accordance with the evidence of record, as long as such evidence is adequate for rating purposes and sufficient to grant the earliest possible effective date in accordance with section 5110 of this title.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H3B4D88F0B2744F67BC868D4AEEED1E49" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the Secretary, the Secretary—</text> 
<subparagraph id="HA28AD20225E44BB5BA4CFE54DE74B634"><enum>(A)</enum><text>shall encourage claimants to submit relevant private medical records of the claimant to the Secretary if such submission does not burden the claimant; and</text></subparagraph> 
<subparagraph commented="no" id="H31C41056B6AC41F1BFC48305ABA24D8F"><enum>(B)</enum><text display-inline="yes-display-inline">in obtaining relevant private records under paragraph (1), may require the claimant to authorize the Secretary to obtain such records if such authorization is required to comply with Federal, State, or local law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7C97A967301943AD8C76E07B099FDA19"><enum>(b)</enum><header>Public records</header><text display-inline="yes-display-inline">Subsection (c) of such section is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H374CD43FB06B4374B1A040CD4186772C" style="USC"> 
<subsection id="HFFC42544972149CA9F426EA72B42EB2D"><enum>(c)</enum><header>Obtaining Records for Compensation Claims</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H24ED0E6F55E548619D09B13BB186CAEB"><enum>(1)</enum><text>In the case of a claim for disability compensation, the assistance provided by the Secretary under this section shall include obtaining the following records if relevant to the claim:</text> 
<subparagraph id="H95C06EA02E5F4F379A7B19BE8A17DF94" indent="up1"><enum>(A)</enum><text>The claimant's service medical records and, if the claimant has furnished the Secretary information sufficient to locate such records, other relevant records pertaining to the claimant's active military, naval, or air service that are held or maintained by a governmental entity.</text></subparagraph> 
<subparagraph id="H9B0506407EC1477CB5E0CA3B293C9666" indent="up1"><enum>(B)</enum><text>Records of relevant medical treatment or examination of the claimant at Department health-care facilities or at the expense of the Department, if the claimant furnishes information sufficient to locate those records.</text></subparagraph> 
<subparagraph id="H4A5F0029B7D74BB5B5D850987984C085" indent="up1"><enum>(C)</enum><text>Any other relevant records held by any Federal department or agency that the claimant adequately identifies and authorizes the Secretary to obtain.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H84BF2CA1987A4BEA83261D5F449BCDF5" indent="up1"><enum>(2)</enum><text>Whenever the Secretary attempts to obtain records from a Federal department or agency under this subsection, the efforts to obtain those records shall continue until the records are obtained unless it is reasonably certain that such records do not exist or that further efforts to obtain those records would be futile.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H042CDA72C14E423FB20F93DB9F65AFD5"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="HFD4D895FDD2F4997863387C7E307BB41"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a) and (b) shall take effect on the date that is 180 days after the date of the enactment of this Act and shall apply with respect to assistance obligations of the Secretary of Veterans Affairs on or after such date.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1E7D06CEC95E4B1C87C892E110BBA5BB"><enum>(2)</enum><header>Construction</header><text>Nothing in this section or the amendments made by this section shall be construed to require the Secretary to carry out assistance in accordance with requirements of section 5103A of title 38, United States Code, as in effect on the day before the effective date established in paragraph (1) on or after such effective date.</text></paragraph></subsection></section> 
<section id="H3FB8CCF3F17B4B5491AA9BA8C6B26BBF" section-type="subsequent-section"><enum>506.</enum><header>Authority for retroactive effective date for awards of disability compensation in connection with applications that are fully-developed at submittal</header><text display-inline="no-display-inline">Section 5110(b) is amended—</text> 
<paragraph id="H8369A0EC97F44AC28132E2B908D9A257"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></paragraph> 
<paragraph id="HCA9349D2E0444DAAB7DEC66B4BF15346"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraph (2):</text>

<subparagraph commented="no" display-inline="yes-display-inline" id="HB4D1A715A9A94C1DAE53BCEBFDD9E6F1"><enum>(A)</enum><text>The effective date of an award of disability compensation to a veteran who submits an application therefor that sets forth an original claim that is fully-developed (as determined by the Secretary) as of the date of submittal shall be fixed in accordance with the facts found, but shall not be earlier than the date that is one year before the date of receipt of the application.</text></subparagraph> 
<subparagraph id="HCE6A850AA8684AA3A1BE48EB041DC408" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, an original claim is an initial claim filed by a veteran for disability compensation.</text></subparagraph> 
<subparagraph id="H6C6E7D96B7E942B3A6D4305BDB332598" indent="up1"><enum>(C)</enum><text>This paragraph shall take effect on the date that is one year after the date of the enactment of the <short-title>Honoring America’s Veterans and Caring for Camp Lejeune Families Act of 2012</short-title> and shall not apply with respect to claims filed after the date that is three years after the date of the enactment of such Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H31B7209891BD45C894A4AA51B320D297" section-type="subsequent-section"><enum>507.</enum><header>Modification of month of death benefit for surviving spouses of veterans who die while entitled to compensation or pension</header> 
<subsection id="H9BCA8F9379654715A68B8408C7DE2AC3"><enum>(a)</enum><header>Surviving spouse benefit for month of veteran's death</header><text>Subsections (a) and (b) of section 5310 are amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H5CB9A236E9B04470B1D099B077F0B82C" style="OLC"> 
<subsection id="H1AFFB989B32642C783EE43027CED693B"><enum>(a)</enum><header>In general</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HE3723766995E47C38B63CBB959F1E529"><enum>(1)</enum><text>A surviving spouse of a veteran is entitled to a benefit for the month of the veteran's death if—</text> 
<subparagraph id="H0B53B724F74B4AB1A8A68E5ABAADE6B4" indent="up1"><enum>(A)</enum><text>at the time of the veteran's death, the veteran was receiving compensation or pension under chapter 11 or 15 of this title; or</text></subparagraph> 
<subparagraph id="HDD8A6F2F522545A4B90842869D095EEB" indent="up1"><enum>(B)</enum><text>the veteran is determined for purposes of section 5121 or 5121A of this title as having been entitled to receive compensation or pension under chapter 11 or 15 of this title for the month of the veteran's death.</text></subparagraph></paragraph> 
<paragraph id="H0F55D1A6740742C992CF7A23FF58C4FB" indent="up1"><enum>(2)</enum><text>The amount of the benefit under paragraph (1) is the amount that the veteran would have received under chapter 11 or 15 of this title, as the case may be, for the month of the veteran's death had the veteran not died.</text></paragraph></subsection> 
<subsection id="H085DD7C9CFF44989A684B75E9E72474E"><enum>(b)</enum><header>Claims pending adjudication</header><text>If a claim for entitlement to compensation or additional compensation under chapter 11 of this title or pension or additional pension under chapter 15 of this title is pending at the time of a veteran's death and the check or other payment issued to the veteran's surviving spouse under subsection (a) is less than the amount of the benefit the veteran would have been entitled to for the month of death pursuant to the adjudication of the pending claim, an amount equal to the difference between the amount to which the veteran would have been entitled to receive under chapter 11 or 15 of this title for the month of the veteran's death had the veteran not died and the amount of the check or other payment issued to the surviving spouse shall be treated in the same manner as an accrued benefit under section 5121 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4142E0CB99DD4DF1B186183C39B61EA8"><enum>(b)</enum><header>Month of death benefit exempt from delayed commencement of payment</header><text>Section 5111(c)(1) is amended by striking <quote>apply to</quote> and all that follows through <quote>death occurred</quote> and inserting the following: <quote>not apply to payments made pursuant to section 5310 of this title</quote>.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H009466EEE1F64196ACB984F5F07A7493"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act, and shall apply with respect to deaths that occur on or after that date.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H430474AFCFF34704A13EDF16EAD813E9"><enum>508.</enum><header>Increase in rate of pension for disabled veterans married to one another and both of whom require regular aid and attendance</header> 
<subsection commented="no" display-inline="no-display-inline" id="HCAEB5DB9EDB341289E6F47D66F425209"><enum>(a)</enum><header>In general</header><text>Section 1521(f)(2) is amended by striking <quote>$30,480</quote> and inserting <quote>$32,433</quote>.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HA262A961F36A423EBBF4AFCC8FC506E7"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="HB12928DC1F0F413FA649E1C47204124D"><enum>509.</enum><header>Exclusion of certain reimbursements of expenses from determination of annual income with respect to pensions for veterans and surviving spouses and children of veterans</header> 
<subsection id="H476643A361E94239AC9F5027B6AC1C27"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (5) of section 1503(a) of title 38, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H453E9E8EFA9F44BAB46767C719977D30" style="OLC"> 
<paragraph id="H484B733164F64F568B306EBEE25346D4"><enum>(5)</enum><text display-inline="yes-display-inline">payments regarding reimbursements of any kind (including insurance settlement payments) for expenses related to the repayment, replacement, or repair of equipment, vehicles, items, money, or property resulting from—</text> 
<subparagraph id="H555F9C0A97F440CF807A02BFACD607F2"><enum>(A)</enum><text display-inline="yes-display-inline">any accident (as defined by the Secretary), but the amount excluded under this subclause shall not exceed the greater of the fair market value or reasonable replacement value of the equipment or vehicle involved at the time immediately preceding the accident;</text></subparagraph> 
<subparagraph id="H26FD81FB7D784B9FAB2BCA78CFFC10B4"><enum>(B)</enum><text display-inline="yes-display-inline">any theft or loss (as defined by the Secretary), but the amount excluded under this subclause shall not exceed the greater of the fair market value or reasonable replacement value of the item or the amount of the money (including legal tender of the United States or of a foreign country) involved at the time immediately preceding the theft or loss; or</text></subparagraph> 
<subparagraph id="H491432C2BBDF46018FB4578AF7C85946"><enum>(C)</enum><text display-inline="yes-display-inline">any casualty loss (as defined by the Secretary), but the amount excluded under this subclause shall not exceed the greater of the fair market value or reasonable replacement value of the property involved at the time immediately preceding the casualty loss;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF7D4C09053834B37B171135F4384E913"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></title> 
<title id="H44697CE0C5BE47D8BF0A0670F75C1436"><enum>VI</enum><header>Memorial, burial, and cemetery matters</header> 
<section commented="no" display-inline="no-display-inline" id="H7F067B60A2914D8A89A10B7F900E7E12"><enum>601.</enum><header>Prohibition on disruptions of funerals of members or former members of the Armed Forces</header> 
<subsection id="HC1EFE1AF60884A8EA2EA98B0583B2D75"><enum>(a)</enum><header>Purpose and authority</header> 
<paragraph id="H63BEFAE0B2C5477187DD5928D7E5E676"><enum>(1)</enum><header>Purpose</header><text>The purpose of this section is to provide necessary and proper support for the recruitment and retention of the Armed Forces and militia employed in the service of the United States by protecting the dignity of the service of the members of such Forces and militia, and by protecting the privacy of their immediate family members and other attendees during funeral services for such members.</text></paragraph> 
<paragraph id="H23E2BA873D5E4CF28400193449FF03F6"><enum>(2)</enum><header>Constitutional authority</header><text>Congress finds that this section is a necessary and proper exercise of its powers under the Constitution, article I, section 8, paragraphs 1, 12, 13, 14, 16, and 18, to provide for the common defense, raise and support armies, provide and maintain a navy, make rules for the government and regulation of the land and naval forces, and provide for organizing and governing such part of the militia as may be employed in the service of the United States.</text></paragraph></subsection> 
<subsection id="HD1703524EC854E34B897F1AA6C2FA042"><enum>(b)</enum><header>Amendment to title 18</header><text>Section 1388 of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H4E1AB8D808F4465685758F8B51387162" style="USC"> 
<section id="HC9B0380B2F4543B4B4ECA0D7A9C70A49"><enum>1388.</enum><header>Prohibition on disruptions of funerals of members or former members of the Armed Forces</header> 
<subsection id="HD7BFE1BC22D04850A92BB155768D5B46"><enum>(a)</enum><header>Prohibition</header><text>For any funeral of a member or former member of the Armed Forces that is not located at a cemetery under the control of the National Cemetery Administration or part of Arlington National Cemetery, it shall be unlawful for any person to engage in an activity during the period beginning 120 minutes before and ending 120 minutes after such funeral, any part of which activity—</text> 
<paragraph id="H2663F0B324B34830892F4F09EBD2EF2E"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H26529002F31749B6A092543CE71523B4"><enum>(A)</enum><text>takes place within the boundaries of the location of such funeral or takes place within 300 feet of the point of the intersection between—</text> 
<clause id="HF5A12C5729A240A69DC1EDBB07BC0EC0" indent="up1"><enum>(i)</enum><text>the boundary of the location of such funeral; and</text></clause> 
<clause id="H3BEB4C85AAF44094AD5C9DDA0B1F8D2D" indent="up1"><enum>(ii)</enum><text>a road, pathway, or other route of ingress to or egress from the location of such funeral; and</text></clause></subparagraph> 
<subparagraph id="H69F5DB2D6A46420AAD6946ADAC86DD24" indent="up1"><enum>(B)</enum><text>includes any individual willfully making or assisting in the making of any noise or diversion—</text> 
<clause id="H52C3B67CC1F1481284A36AAAEB1542BF"><enum>(i)</enum><text>that is not part of such funeral and that disturbs or tends to disturb the peace or good order of such funeral; and</text></clause> 
<clause id="H237B97B368124E809D6CEEE8B1D1843D"><enum>(ii)</enum><text>with the intent of disturbing the peace or good order of such funeral;</text></clause></subparagraph></paragraph> 
<paragraph id="HD2CB501ABC0E43CA9E1ED083163823F0"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H0E9FDC29BF2C4F6CAA3AB87AD2F1FB36"><enum>(A)</enum><text>is within 500 feet of the boundary of the location of such funeral; and</text></subparagraph> 
<subparagraph id="H115E50AAC5E04623A15F24AF0ACA3867" indent="up1"><enum>(B)</enum><text>includes any individual—</text> 
<clause id="H49DCA5ACB0BE498696E0DDF984C72011"><enum>(i)</enum><text>willfully and without proper authorization impeding or tending to impede the access to or egress from such location; and</text></clause> 
<clause id="H70EA386CBE7F4753A1777BA34A7940AD"><enum>(ii)</enum><text>with the intent to impede the access to or egress from such location; or</text></clause></subparagraph></paragraph> 
<paragraph id="H9BB3937A68144090BB60FB58BACA3940"><enum>(3)</enum><text>is on or near the boundary of the residence, home, or domicile of any surviving member of the deceased person's immediate family and includes any individual willfully making or assisting in the making of any noise or diversion—</text> 
<subparagraph id="HCAED8C2F367F4E939E711F9BD502F7DC"><enum>(A)</enum><text>that disturbs or tends to disturb the peace of the persons located at such location; and</text></subparagraph> 
<subparagraph id="H870D7B1F4D3F4BBA9E8867BFD56F6ADB"><enum>(B)</enum><text>with the intent of disturbing such peace.</text></subparagraph></paragraph></subsection> 
<subsection id="H440F165662DE439CB4BD58C5AF0BA8E0"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined under this title or imprisoned for not more than 1 year, or both.</text></subsection> 
<subsection id="HECD62AAE3CA34BD0929A40CA190EC24A"><enum>(c)</enum><header>Civil remedies</header> 
<paragraph id="HF12060B1EC3F4A0EBBCD8778825B3FAB"><enum>(1)</enum><header>District courts</header><text>The district courts of the United States shall have jurisdiction—</text> 
<subparagraph id="HCB8A34E397A94809A335899668AA9CB6"><enum>(A)</enum><text>to prevent and restrain violations of this section; and</text></subparagraph> 
<subparagraph id="H9E982F9E331D4FB983CF26F1A1104C71"><enum>(B)</enum><text>for the adjudication of any claims for relief under this section.</text></subparagraph></paragraph> 
<paragraph id="H5A6EDDFE271F436880B48D7E7B9C3047"><enum>(2)</enum><header>Attorney general</header><text>The Attorney General may institute proceedings under this section.</text></paragraph> 
<paragraph id="H3B5AEF3F68CA4E018D6EE1D396AA145E"><enum>(3)</enum><header>Claims</header><text>Any person, including a surviving member of the deceased person's immediate family, who suffers injury as a result of conduct that violates this section may—</text> 
<subparagraph id="H1152DCDB82B347F288B55536F64F3552"><enum>(A)</enum><text>sue therefor in any appropriate United States district court or in any court of competent jurisdiction; and</text></subparagraph> 
<subparagraph id="H439260D474194651ADFF7F86CB53F99D"><enum>(B)</enum><text>recover damages as provided in subsection (d) and the cost of the suit, including reasonable attorneys’ fees.</text></subparagraph></paragraph> 
<paragraph id="H624EA384E6BC44E7A09B8EFEF6F50C05"><enum>(4)</enum><header>Estoppel</header><text>A final judgment or decree rendered in favor of the United States in any criminal proceeding brought by the United States under this section shall estop the defendant from denying the essential allegations of the criminal offense in any subsequent civil proceeding brought by a person or by the United States.</text></paragraph></subsection> 
<subsection id="HC90A1140CA894743A666A21C7691CF88"><enum>(d)</enum><header>Actual and statutory damages</header> 
<paragraph id="H4D0DE172EB0345719A6B8B6C1F4C7C88"><enum>(1)</enum><header>In general</header><text>In addition to any penalty imposed under subsection (b), a violator of this section is liable in an action under subsection (c) for actual or statutory damages as provided in this subsection.</text></paragraph> 
<paragraph id="H6046E73ED1EA49509BEC7BC8F052595C"><enum>(2)</enum><header>Actions by private persons</header><text>A person bringing an action under subsection (c)(3) may elect, at any time before final judgment is rendered, to recover the actual damages suffered by him or her as a result of the violation or, instead of actual damages, an award of statutory damages for each violation involved in the action.</text></paragraph> 
<paragraph id="H0B3BD8F0BDFC480BA8EEA556945E0840"><enum>(3)</enum><header>Actions by Attorney General</header><text>In any action under subsection (c)(2), the Attorney General is entitled to recover an award of statutory damages for each violation involved in the action notwithstanding any recovery under subsection (c)(3).</text></paragraph> 
<paragraph id="H8A169DF326524E5FA6186DA37D17A629"><enum>(4)</enum><header>Statutory damages</header><text>A court may award, as the court considers just, statutory damages in a sum of not less than $25,000 or more than $50,000 per violation.</text></paragraph></subsection> 
<subsection id="H2F8E89E5E747412FACDAA464C4AD63F4"><enum>(e)</enum><header>Rebuttable presumption</header><text>It shall be a rebuttable presumption that the violation was committed willfully for purposes of determining relief under this section if the violator, or a person acting in concert with the violator, did not have reasonable grounds to believe, either from the attention or publicity sought by the violator or other circumstance, that the conduct of such violator or person would not disturb or tend to disturb the peace or good order of such funeral, impede or tend to impede the access to or egress from such funeral, or disturb or tend to disturb the peace of any surviving member of the deceased person's immediate family who may be found on or near the residence, home, or domicile of the deceased person's immediate family on the date of the service or ceremony.</text></subsection> 
<subsection id="H4912B1CFEC9D40FF8ACD926A6A950187"><enum>(f)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H3ABDB2C844054DE0AFF6851A9020540C"><enum>(1)</enum><text>the term <term>Armed Forces</term> has the meaning given the term in section 101 of title 10 and includes members and former members of the National Guard who were employed in the service of the United States; and</text></paragraph> 
<paragraph id="H5BED350A9FFF48B0B66FE5FEEF210505"><enum>(2)</enum><text>the term <term>immediate family</term> means, with respect to a person, the immediate family members of such person, as such term is defined in section 115 of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2B1DD0F1887646FFB5A5CE7342D2FD35"><enum>(c)</enum><header>Amendment to title 38</header> 
<paragraph id="HAD27CA0E1EE749029501AF016F1CE389"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2413 is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HC3EF67C866B64FAA9D0294058F7C0251" style="USC"> 
<section id="HA24C508C066B4E4C8D950C8097C482AE"><enum>2413.</enum><header>Prohibition on certain demonstrations and disruptions at cemeteries under control of the National Cemetery Administration and at Arlington National Cemetery</header> 
<subsection id="H9FF6A87ACF174B4AA03B0C85635B65C6"><enum>(a)</enum><header>Prohibition</header><text>It shall be unlawful for any person—</text> 
<paragraph id="H69452677812C41189078EC33E0B303DA"><enum>(1)</enum><text>to carry out a demonstration on the property of a cemetery under the control of the National Cemetery Administration or on the property of Arlington National Cemetery unless the demonstration has been approved by the cemetery superintendent or the director of the property on which the cemetery is located; or</text></paragraph> 
<paragraph id="H4254237BA15641879F89163D4CC5D804"><enum>(2)</enum><text>with respect to such a cemetery, to engage in a demonstration during the period beginning 120 minutes before and ending 120 minutes after a funeral, memorial service, or ceremony is held, any part of which demonstration—</text> 
<subparagraph id="H2AD505DBF24343B1B173AEB9DC120B8B"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HB6DE46B6D89A42FD82FF9197B003ECE9"><enum>(i)</enum><text>takes place within the boundaries of such cemetery or takes place within 300 feet of the point of the intersection between—</text> 
<subclause id="H8EC23517B3E9493E83F2201509EE189F" indent="up1"><enum>(I)</enum><text>the boundary of such cemetery; and</text></subclause> 
<subclause id="H3371CF7E080A4E7CBECE38933DC60275" indent="up1"><enum>(II)</enum><text>a road, pathway, or other route of ingress to or egress from such cemetery; and</text></subclause></clause> 
<clause id="HB67D50EE57E9409E90CC4ABD6F5B8D1E" indent="up1"><enum>(ii)</enum><text>includes any individual willfully making or assisting in the making of any noise or diversion—</text> 
<subclause id="H67762EB6CBAB49B296C82AC7AF31F5B0"><enum>(I)</enum><text>that is not part of such funeral, memorial service, or ceremony and that disturbs or tends to disturb the peace or good order of such funeral, memorial service, or ceremony; and</text></subclause> 
<subclause id="H5036937B63114516BC9C7BD26C187628"><enum>(II)</enum><text>with the intent of disturbing the peace or good order of such funeral, memorial service, or ceremony; or</text></subclause></clause></subparagraph> 
<subparagraph id="HE9E39FF8ADA54145B747A09F5D86AC9F"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H64DB831E3DBE44DEA9A03D77B0E2D08A"><enum>(i)</enum><text>is within 500 feet of the boundary of such cemetery; and</text></clause> 
<clause id="H1E11BC014BB5489DBBF8437469BD1E82" indent="up1"><enum>(ii)</enum><text>includes any individual—</text> 
<subclause id="HB0399BB2447C459C808FCF9A0B3A1696"><enum>(I)</enum><text>willfully and without proper authorization impeding or tending to impede the access to or egress from such cemetery; and</text></subclause> 
<subclause id="H17CF115E42EF48AEAB1083C8F892844D"><enum>(II)</enum><text>with the intent to impede the access to or egress from such cemetery.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H30F9BB3E22664C53A33E8B1D65216985"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined under title 18 or imprisoned for not more than one year, or both.</text></subsection> 
<subsection id="HA16AE2048E604C8DB726C40391F218C9"><enum>(c)</enum><header>Civil remedies</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H256A2BB70C2E408F9B2CB641E4915593"><enum>(1)</enum><text>The district courts of the United States shall have jurisdiction—</text> 
<subparagraph id="HB26399799C29457A89F413E85A612FBB" indent="up1"><enum>(A)</enum><text>to prevent and restrain violations of this section; and</text></subparagraph> 
<subparagraph id="H9E1CB58344004D6DB11E19AB6D6BFF4B" indent="up1"><enum>(B)</enum><text>for the adjudication of any claims for relief under this section.</text></subparagraph></paragraph> 
<paragraph id="HB36B3250E1ED48B9A6FB8585A866C06E" indent="up1"><enum>(2)</enum><text>The Attorney General of the United States may institute proceedings under this section.</text></paragraph> 
<paragraph id="HDF550B48E8644D498E819675048DB6CD" indent="up1"><enum>(3)</enum><text>Any person, including a surviving member of the deceased person's immediate family, who suffers injury as a result of conduct that violates this section may—</text> 
<subparagraph id="HBF16843990734B78B27023BCCF048328"><enum>(A)</enum><text>sue therefor in any appropriate United States district court or in any court of competent jurisdiction; and</text></subparagraph> 
<subparagraph id="HB8775EA25D554CDC9F8E207E5268B380"><enum>(B)</enum><text>recover damages as provided in subsection (d) and the cost of the suit, including reasonable attorneys’ fees.</text></subparagraph></paragraph> 
<paragraph id="HA6552A0D2FFB411E8E3F629256577D01" indent="up1"><enum>(4)</enum><text>A final judgment or decree rendered in favor of the United States in any criminal proceeding brought by the United States under this section shall estop the defendant from denying the essential allegations of the criminal offense in any subsequent civil proceeding brought by a person or by the United States.</text></paragraph></subsection>

<paragraph id="H3B213CC729B64CCFBD69BDF706050D29"><enum>(2)</enum><text>impede or tend to impede the access to or egress from such funeral, memorial service, or ceremony.</text></paragraph></subsection> 
<subsection id="H573EA5BAFDCD4EFA9C283611A64C0244"><enum>(f)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H33B7E71888B641B09BE47BE31EE5B92C"><enum>(1)</enum><text>the term <term>demonstration</term> includes—</text> 
<subparagraph id="H64D76C9FCECD4BE0A864767B5E56C825"><enum>(A)</enum><text>any picketing or similar conduct;</text></subparagraph> 
<subparagraph id="H01489A9F703E495CBC1F946730DBEF47"><enum>(B)</enum><text>any oration, speech, use of sound amplification equipment or device, or similar conduct that is not part of a funeral, memorial service, or ceremony;</text></subparagraph> 
<subparagraph id="H786324CC98F74803BAB2BA5DEF35CB0B"><enum>(C)</enum><text>the display of any placard, banner, flag, or similar device, unless such a display is part of a funeral, memorial service, or ceremony; and</text></subparagraph> 
<subparagraph id="HC242A51311C84DC1A2E69211B41CE1BA"><enum>(D)</enum><text>the distribution of any handbill, pamphlet, leaflet, or other written or printed matter other than a program distributed as part of a funeral, memorial service, or ceremony; and</text></subparagraph></paragraph> 
<paragraph id="H6D184235381A42E18D92659AA2761E3F"><enum>(2)</enum><text>the term <term>immediate family</term> means, with respect to a person, the immediate family members of such person, as such term is defined in section 115 of title 18.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9BBB73B7969D4927B364C74E6CD2126D"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 24 is amended by striking the item relating to section 2413 and inserting the following new item:</text>

<subsection id="H8ABC46B86D3C467FA2C26E822A71A006"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 24 is amended by inserting after section 2410 the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="HD8E7895494D7473584B177BC74DEAE23" style="USC"> 
<section id="H873EF153F42144BAB128FF915B13F1F2"><enum>2410A.</enum><header>Arlington National Cemetery: other administrative matters</header> 
<subsection id="HABABEFD0A32144448A46634C1A310CD7"><enum>(a)</enum><header>One gravesite</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HDC6B0BDFAFE248AFBE7BB84ED7DE2ADE"><enum>(1)</enum><text>Not more than one gravesite may be provided at Arlington National Cemetery to a veteran or member of the Armed Forces who is eligible for interment or inurnment at such cemetery.</text></paragraph> 
<paragraph id="HDF589243CDD84854BC49425BA6EC50A6" indent="up1"><enum>(2)</enum><text>The Secretary of the Army may waive the prohibition in paragraph (1) as the Secretary of the Army considers appropriate.</text></paragraph></subsection> 
<subsection id="H4C559E92F44C493AA98F28A1ED28552B"><enum>(b)</enum><header>Prohibition against reservation of gravesites</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H9325C0113F144C69B7ACC685C8399050"><enum>(1)</enum><text>A gravesite at Arlington National Cemetery may not be reserved for an individual before the death of such individual.</text></paragraph> 
<paragraph id="H0276D2E05CE7488D9F66EAEC9C8A72A6" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HF9D8A21D902C42B58BECA34E2FE6D47A"><enum>(A)</enum><text>The President may waive the prohibition in paragraph (1) as the President considers appropriate.</text></subparagraph> 
<subparagraph id="HC8B432297A3F41BC86CA153E8921F72B" indent="up1"><enum>(B)</enum><text>Upon waiving the prohibition in paragraph (1), the President shall submit notice of such waiver to—</text> 
<clause id="HCF2F88ADCD024775B126C9C175174A98"><enum>(i)</enum><text>the Committee on Veterans' Affairs and the Committee on Armed Services of the Senate; and</text></clause> 
<clause id="HEBB94F41CA5C45C19B11234F7A55EEA1"><enum>(ii)</enum><text>the Committee on Veterans' Affairs and the Committee on Armed Services of the House of Representatives.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF28DE0D1126646E4A2E543AF2027C675"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2410 the following new item:</text>

<subsection id="HB7B0336CC43F487CA6162F4BABB1CD50"><enum>(c)</enum><header>Applicability</header> 
<paragraph id="H03434FCB9D4645228AAC6B72DB08330B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), section 2410A of title 38, United States Code, as added by subsection (a), shall apply with respect to all interments at Arlington National Cemetery after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HD8B59FD13DE94CB18D1034D4EEE57816"><enum>(2)</enum><header>Exception</header><text>Subsection (b) of such section, as so added, shall not apply with respect to the interment of an individual for whom a request for a reserved gravesite was approved by the Secretary of the Army before January 1, 1962.</text></paragraph></subsection> 
<subsection id="H1BF88C131BA74B3BA88A1EE8E325CD73"><enum>(d)</enum><header>Report</header> 
<paragraph id="HCB0E5D807F6E4A16B7B61ED23E8203AE"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of the Army shall submit to Congress a report on reservations made for interment at Arlington National Cemetery.</text></paragraph> 
<paragraph id="HEBFC3717DE474D70A40CCCD5AF76092C"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include the following:</text> 
<subparagraph id="HB3CA225D1FFD4857ABE84D51234D1423"><enum>(A)</enum><text>The number of requests for reservation of a gravesite at Arlington National Cemetery that were submitted to the Secretary of the Army before January 1, 1962.</text></subparagraph> 
<subparagraph id="H2C85A763D57F4BFA80EFAAA8FC3D0E0C"><enum>(B)</enum><text>The number of gravesites at such cemetery that, on the day before the date of the enactment of this Act, were reserved in response to such requests.</text></subparagraph> 
<subparagraph id="H0929AA102D9C4B55A12EC7A7A28053E1"><enum>(C)</enum><text>The number of such gravesites that, on the day before the date of the enactment of this Act, were unoccupied.</text></subparagraph> 
<subparagraph id="H1ED4C53E20224A1D881B856DB64B2818"><enum>(D)</enum><text>A list of all reservations for gravesites at such cemetery that were extended by individuals responsible for management of such cemetery in response to requests for such reservations made on or after January 1, 1962.</text></subparagraph> 
<subparagraph id="H45ECFEB8D105403F86B6E3F9222C2301"><enum>(E)</enum><text>A description of the measures that the Secretary is taking to improve the accountability and transparency of the management of gravesite reservations at Arlington National Cemetery.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H04F8C086D1EF4A018A61B8C430C88C20"><enum>(F)</enum><text>Such recommendations as the Secretary may have for legislative action as the Secretary considers necessary to improve such accountability and transparency.</text></subparagraph></paragraph></subsection></section> 
<section id="H7E1D1AC070804D3F8111B6A9D60BA194"><enum>603.</enum><header>Expansion of eligibility for presidential memorial certificates to persons who died in the active military, naval, or air service</header><text display-inline="no-display-inline">Section 112(a) is amended—</text> 
<paragraph id="H6C86D441B6F248278ABD39F52CC74387"><enum>(1)</enum><text>by inserting <quote>and persons who died in the active military, naval, or air service,</quote> after <quote>under honorable conditions,</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6BAEC3627E6443ACB1F6B63C235FB403"><enum>(2)</enum><text>by striking <quote>veteran’s</quote> and inserting <quote>deceased individual’s</quote>.</text></paragraph></section> 
<section id="HCAC62AFA46E04BC8A6CDA044AD47C2CE" section-type="subsequent-section"><enum>604.</enum><header>Requirements for the placement of monuments in Arlington National Cemetery</header><text display-inline="no-display-inline">Section 2409(b) is amended—</text> 
<paragraph id="H478A10E3BD484B8EA0BBCFE6689A3446"><enum>(1)</enum><text>by striking <quote>Under</quote> and inserting <quote>(1) Under</quote>;</text></paragraph> 
<paragraph id="H974ED4CF669E4B96A56445CEA4AD8E13"><enum>(2)</enum><text>by inserting after <quote>Secretary of the Army</quote> the following: <quote>and subject to paragraph (2)</quote>; and</text></paragraph> 
<paragraph id="H7ECF48A13E834BEEB549FDDC5AD8464C"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text> 
<quoted-block display-inline="no-display-inline" id="HEF266BB77B0F4657A31A841986E3F55F" style="USC"> 
<paragraph display-inline="no-display-inline" id="H8AAE18CF9E0B4E0BA9BEED68C73993D3" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H4E7D69FC28F040B3BD1617DD25374B46"><enum>(A)</enum><text display-inline="yes-display-inline">Except for a monument containing or marking interred remains, no monument (or similar structure, as determined by the Secretary of the Army in regulations) may be placed in Arlington National Cemetery except pursuant to the provisions of this subsection.</text></subparagraph> 
<subparagraph id="H4CADD1188D604245BBD61292761F1B3E" indent="up1"><enum>(B)</enum><text>A monument may be placed in Arlington National Cemetery if the monument commemorates—</text> 
<clause id="H4D08A5B9E9A0475B9738DD008B4477C1"><enum>(i)</enum><text>the service in the Armed Forces of the individual, or group of individuals, whose memory is to be honored by the monument; or</text></clause> 
<clause id="H0C40A4A1EFB44C1EAFEDC103EA70F84F"><enum>(ii)</enum><text>a particular military event.</text></clause></subparagraph> 
<subparagraph id="HE9D19B604F3C4F2F83E9E0E395D5334D" indent="up1"><enum>(C)</enum><text>No monument may be placed in Arlington National Cemetery until the end of the 25-year period beginning—</text> 
<clause id="H218D3F10A98A43FEA559F54E072E5B67"><enum>(i)</enum><text>in the case of the commemoration of service under subparagraph (B)(i), on the last day of the period of service so commemorated; and</text></clause> 
<clause id="HDE1D2FF7654A42B6BD97D55586DDA057"><enum>(ii)</enum><text>in the case of the commemoration of a particular military event under subparagraph (B)(ii), on the last day of the period of the event.</text></clause></subparagraph> 
<subparagraph id="H7DBC97EE7B954DB7AF5D53D9F5E9FFF8" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">A monument may be placed only in those sections of Arlington National Cemetery designated by the Secretary of the Army for such placement and only on land the Secretary determines is not suitable for burial.</text></subparagraph> 
<subparagraph id="H24D3AA79F0EE4CF28EA7B1D74537B8D2" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">A monument may only be placed in Arlington National Cemetery if an appropriate nongovernmental entity has agreed to act as a sponsoring organization to coordinate the placement of the monument and—</text> 
<clause id="H2F2E24C4997049CDBC55B1544B45524A"><enum>(i)</enum><text>the construction and placement of the monument are paid for only using funds from private sources;</text></clause> 
<clause display-inline="no-display-inline" id="H4BD9B390796B436AB9C1209A46A6C4C3"><enum>(ii)</enum><text>the Secretary of the Army consults with the Commission of Fine Arts and the Advisory Committee on Arlington National Cemetery before approving the design of the monument; and</text></clause> 
<clause id="H8C1B4A6F363C4B909606152760D528B1"><enum>(iii)</enum><text>the sponsoring organization provides for an independent study on the availability and suitability of alternative locations for the proposed monument outside of Arlington National Cemetery.</text></clause></subparagraph></paragraph> 
<paragraph id="HC76E823B2E5A4905802BA974D826D177" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HEB29E26D0DC04204B13B8F9DB3919C4D"><enum>(A)</enum><text>The Secretary of the Army may waive the requirement under paragraph (2)(C) in a case in which the monument would commemorate a group of individuals who the Secretary determines—</text> 
<clause id="H12C63C72AF83403788D0200F8CE81B4A" indent="up1"><enum>(i)</enum><text>has made valuable contributions to the Armed Forces that have been ongoing and perpetual for longer than 25 years and are expected to continue on indefinitely; and</text></clause> 
<clause id="HB0A98226D6C44FC68DA1E577DBF161FC" indent="up1"><enum>(ii)</enum><text>has provided service that is of such a character that the failure to place a monument to the group in Arlington National Cemetery would present a manifest injustice.</text></clause></subparagraph> 
<subparagraph id="H66A0B161A7A94260AF5F206F7727B042" indent="up1"><enum>(B)</enum><text>If the Secretary waives such requirement under subparagraph (A), the Secretary shall—</text> 
<clause id="HF4FFF77194F046448BCC2B86F1789D9D"><enum>(i)</enum><text>make available on an Internet website notification of the waiver and the rationale for the waiver; and</text></clause> 
<clause id="HF696C305F236475E9F3A95D365DFD877"><enum>(ii)</enum><text display-inline="yes-display-inline">submit to the Committee on Veterans’ Affairs and the Committee on Armed Services of the Senate and the Committee on Veterans’ Affairs and the Committee on Armed Services of the House of Representatives written notice of the waiver and the rationale for the waiver.</text></clause></subparagraph></paragraph> 
<paragraph id="HA7046BBF309D4C03AE5D14DD2BFFCBBA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary of the Army shall provide notice to the Committee on Veterans’ Affairs and the Committee on Armed Services of the Senate and the Committee on Veterans’ Affairs and the Committee on Armed Services of the House of Representatives of any monument proposed to be placed in Arlington National Cemetery. During the 60-day period beginning on the date on which such notice is received, Congress may pass a joint resolution of disapproval of the placement of the monument. The proposed monument may not be placed in Arlington National Cemetery until the later of—</text> 
<subparagraph id="H78AE8B411AED4F638F66726531D3FC29"><enum>(A)</enum><text>if Congress does not pass a joint resolution of disapproval of the placement of the monument, the date that is 60 days after the date on which notice is received under this paragraph; or</text></subparagraph> 
<subparagraph id="H7049C3F70621438EAD4CFE4593644AE3"><enum>(B)</enum><text>if Congress passes a joint resolution of disapproval of the placement of the monument, and the President signs a veto of such resolution, the earlier of—</text> 
<clause id="HF649CBC21C3F4AB59657D5234E67E638"><enum>(i)</enum><text>the date on which either House of Congress votes and fails to override the veto of the President; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HC12ECFD3636041129BA9594DB20CFA76"><enum>(ii)</enum><text>the date that is 30 session days after the date on which Congress received the veto and objections of the President.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="HA04F1DA57EDA4CCABAE545E7AE99AF20"><enum>VII</enum><header>Other matters</header> 
<section id="HEDDCFE0785BF4D939FE8F98AE863C326" section-type="subsequent-section"><enum>701.</enum><header>Assistance to veterans affected by natural disasters</header> 
<subsection id="H39B7CFAA8CD54878A01201808B21B764"><enum>(a)</enum><header>Additional grants for disabled veterans for specially adapted housing</header> 
<paragraph id="H6CBFC456A49948B298A7230362CE40E5"><enum>(1)</enum><header>In general</header><text>Chapter 21 is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H7D43E5F0C9E84299A3326C3FAED8DE3F" style="USC"> 
<section id="H72F9C45593B541558CF7F70E5C4F7433"><enum>2109.</enum><header>Specially adapted housing destroyed or damaged by natural disasters</header> 
<subsection id="HB202978B4AEC4C36AAE941FD37EAF56A"><enum>(a)</enum><header>In general</header><text>Notwithstanding the provisions of section 2102 and 2102A of this title, the Secretary may provide assistance to a veteran whose home was previously adapted with assistance of a grant under this chapter in the event the adapted home which was being used and occupied by the veteran was destroyed or substantially damaged in a natural or other disaster, as determined by the Secretary.</text></subsection> 
<subsection id="H6CB2ABC191FE4447B84920BF3F76C517"><enum>(b)</enum><header>Use of funds</header><text>Subject to subsection (c), assistance provided under subsection (a) shall—</text> 
<paragraph id="HDEA0BA720B8344BCBF2136F6EB13BBAE"><enum>(1)</enum><text>be available to acquire a suitable housing unit with special fixtures or moveable facilities made necessary by the veteran's disability, and necessary land therefor;</text></paragraph> 
<paragraph id="H9BB56E6360824B2897F08C5B4C95F772"><enum>(2)</enum><text>be available to a veteran to the same extent as if the veteran had not previously received assistance under this chapter; and</text></paragraph> 
<paragraph id="H019A52025C064028B667831B3E456E5A"><enum>(3)</enum><text>not be deducted from the maximum uses or from the maximum amount of assistance available under this chapter.</text></paragraph></subsection> 
<subsection id="H5DD26ADDC7C74F14B92E462F4FA022D9"><enum>(c)</enum><header>Limitations</header><text>The amount of the assistance provided under subsection (a) may not exceed the lesser of—</text> 
<paragraph id="HD77B2595E53943559B5925568AAD2704"><enum>(1)</enum><text>the reasonable cost, as determined by the Secretary, of repairing or replacing the damaged or destroyed home in excess of the available insurance coverage on such home; or</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE9E680398C3245C183698590BB4A77E4"><enum>(2)</enum><text>the maximum amount of assistance to which the veteran would have been entitled under sections 2101(a), 2101(b), and 2102A of this title had the veteran not obtained previous assistance under this chapter.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H06AC849F3F8B416191CC26F8F4C46C15"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2108 the following new item:</text>

<subparagraph id="HA06904B9D557423794B80B54B38513C0" indent="up2"><enum>(B)</enum><text>In any case in which the Secretary determines that a veteran described in subparagraph (A) has been displaced as the result of a natural or other disaster while being paid a subsistence allowance under that subparagraph, as determined by the Secretary, the Secretary may extend the payment of a subsistence allowance under such subparagraph for up to an additional two months while the veteran is satisfactorily following a program of employment services described in such subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2BED6CDA2AB345B8BC007A89CD9E3FCC"><enum>(c)</enum><header>Waiver of limitation on program of independent living services and assistance</header><text>Section 3120(e) is amended—</text> 
<paragraph id="H611A5593DC9C465C973A6427630D93A9"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>Programs</quote>; and</text></paragraph> 
<paragraph id="H6403893B7CCE4D5D95097FA3D0C72F4C"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H13CDE25C29844C2290B25F8160BB4D1E" style="OLC"> 
<paragraph id="HB837B305694644C6B613A45A246C9A38" indent="up1"><enum>(2)</enum><text>The limitation in paragraph (1) shall not apply in any case in which the Secretary determines that a veteran described in subsection (b) has been displaced as the result of, or has otherwise been adversely affected in the areas covered by, a natural or other disaster, as determined by the Secretary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7F201098BB814F0DA3CD544CF15158BE"><enum>(d)</enum><header>Covenants and liens created by public entities in response to disaster-Relief assistance</header><text>Paragraph (3) of section 3703(d) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H94ADB083CB2B48FBB8656883B000DA09" style="OLC"> 
<paragraph id="H0E4CA7AF2D94451CBCD41B2048A8BD1B" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H6F7A95D88B4E43F6AB0B8BD3B890322F"><enum>(A)</enum><text>Any real estate housing loan (other than for repairs, alterations, or improvements) shall be secured by a first lien on the realty. In determining whether a loan is so secured, the Secretary may either disregard or allow for subordination to a superior lien created by a duly recorded covenant running with the realty in favor of either of the following:</text> 
<clause id="HA0B68F1A51D04346A36237AD940830E2" indent="up1"><enum>(i)</enum><text>A public entity that has provided or will provide assistance in response to a major disaster as determined by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H473DB48CC9484499BA01937CFC78285C" indent="up1"><enum>(ii)</enum><text>A private entity to secure an obligation to such entity for the homeowner's share of the costs of the management, operation, or maintenance of property, services, or programs within and for the benefit of the development or community in which the veteran's realty is located, if the Secretary determines that the interests of the veteran borrower and of the Government will not be prejudiced by the operation of such covenant.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB4C87221F25147078074B45D855AB886" indent="up1"><enum>(B)</enum><text>With respect to any superior lien described in subparagraph (A) created after June 6, 1969, the Secretary's determination under clause (ii) of such subparagraph shall have been made prior to the recordation of the covenant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2B5E2BF464D743E3918A93969580FFCD"><enum>(e)</enum><header>Automobiles and other conveyances for certain disabled veterans and members of the Armed Forces</header><text>Section 3903(a) is amended—</text> 
<paragraph id="HE27129B23722483882FA89492B1681C4"><enum>(1)</enum><text>by striking <quote>No</quote> and inserting <quote>(1) Except as provided in paragraph (2), no</quote>; and</text></paragraph>

<subparagraph id="H63D4139D6A5849F08BEBBE9100ECD280"><enum>(A)</enum><text>the Secretary receives satisfactory evidence that the automobile or other conveyance previously purchased with assistance under this chapter was destroyed—</text> 
<clause id="H78E7A5903FC241AE8DDF8AA071640337"><enum>(i)</enum><text>as a result of a natural or other disaster, as determined by the Secretary; and</text></clause> 
<clause id="HD08EC377C0464E09BB145329AF0B6273"><enum>(ii)</enum><text>through no fault of the eligible person; and</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0CBF0ED193214C7796B4858B3B1BF88C"><enum>(B)</enum><text>the eligible person does not otherwise receive from a property insurer compensation for the loss.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5F22680A911A4A13BF94047DCC8F0935"><enum>(f)</enum><header>Annual report</header> 
<paragraph id="HF8B89B820CAF4B4C8AE524FC58DE01E0"><enum>(1)</enum><header>In general</header><text>Each year, the Secretary of Veterans Affairs shall submit to Congress a report on the assistance provided or action taken by the Secretary in the last fiscal year pursuant to the authorities added by the amendments made by this section.</text></paragraph> 
<paragraph id="HC108124F48904FD990A1DC67A02A0C02"><enum>(2)</enum><header>Elements</header><text>Each report submitted under paragraph (1) shall include the following for the fiscal year covered by the report:</text> 
<subparagraph id="H1415B245B12A44DEBA3CA186F740F29F"><enum>(A)</enum><text>A description of each natural disaster for which assistance was provided or action was taken as described in paragraph (1).</text></subparagraph> 
<subparagraph id="H71B09AE81B484996AFBB506FE040C7D3"><enum>(B)</enum><text>The number of cases or individuals, as the case may be, in which or to whom the Secretary provided assistance or took action as described in paragraph (1).</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0DD87763DD7444C6A0B380C289D7A6B7"><enum>(C)</enum><text>For each such case or individual, a description of the type or amount of assistance or action taken, as the case may be.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HBF0444AABF374A7F8A5FB27641470170"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section>

<paragraph id="HAD752B6D51CB42BD885FA5487F7DC1F0"><enum>(1)</enum><text display-inline="yes-display-inline">regularly assess the skills and competencies of appropriate employees and managers of the Veterans Benefits Administration who are responsible for processing claims for compensation and pension benefits administered by the Secretary;</text></paragraph> 
<paragraph id="HB76214DD6D2F4D0DA061607EDD6A833F"><enum>(2)</enum><text>provide training to those employees whose skills and competencies are assessed as unsatisfactory by the regular assessment described in paragraph (1), to remediate deficiencies in such skills and competencies;</text></paragraph> 
<paragraph id="H93075648F4844990861D79B1FA1BB42F"><enum>(3)</enum><text>reassess the skills and competencies of employees who receive training as described in paragraph (2); and</text></paragraph> 
<paragraph id="H7D16BEC20F774A098DD3FABD737F97E1"><enum>(4)</enum><text>take appropriate personnel action if, following training and reassessment as described in paragraphs (2) and (3), respectively, skills and competencies remain unsatisfactory.</text></paragraph></section>

<subsection id="HAA017033DA2F4B63B6693A69C1538540"><enum>(a)</enum><header>Quarterly reports required</header><text display-inline="yes-display-inline">Not later than 30 days after the end of each fiscal quarter, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on covered conferences.</text></subsection> 
<subsection id="H40E39C156CD7487BB626EFE9FBB2F173"><enum>(b)</enum><header>Matters included</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include the following:</text> 
<paragraph id="H7E9EFCFC24664E319B73E78612F15C09"><enum>(1)</enum><text>An accounting of the final costs to the Department of each covered conference occurring during the fiscal quarter preceding the date on which the report is submitted, including the costs related to—</text> 
<subparagraph id="HECE6E21DD2594D1EADA7F3C0E4A17F47"><enum>(A)</enum><text>transportation and parking;</text></subparagraph> 
<subparagraph id="H09280054661C466B90D728B267420FE8"><enum>(B)</enum><text>per diem payments;</text></subparagraph> 
<subparagraph id="HDDF3FE3BB6EF4542B6D8E49DBE36957B"><enum>(C)</enum><text>lodging;</text></subparagraph> 
<subparagraph id="HB9D00C81351643FE8A06DE698652F3FF"><enum>(D)</enum><text>rental of halls, auditoriums, or other spaces;</text></subparagraph> 
<subparagraph id="H31DBDDC23FEC4CF18F37B598232AF4BA"><enum>(E)</enum><text>rental of equipment;</text></subparagraph> 
<subparagraph id="H21BC5D94564C46EE90E66FC1B9B6F966"><enum>(F)</enum><text>refreshments;</text></subparagraph> 
<subparagraph id="H8A43DA4709564AA9AA005745C470BF13"><enum>(G)</enum><text>entertainment;</text></subparagraph> 
<subparagraph id="H5D60DDF4C04F4C65B9B824294FA7E7CB"><enum>(H)</enum><text>contractors; and</text></subparagraph> 
<subparagraph id="HF93DDAC29FF241FFA7783541A79CCA79"><enum>(I)</enum><text>brochures or other printed media.</text></subparagraph></paragraph> 
<paragraph id="H3C47971D768D4407AB81DC14C364685C"><enum>(2)</enum><text display-inline="yes-display-inline">The total estimated costs to the Department for covered conferences occurring during the fiscal quarter in which the report is submitted.</text></paragraph></subsection> 
<subsection id="H1EA36AB242B34D5CB45B66B645AE4CFB"><enum>(c)</enum><header>Covered conference defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered conference</term> means a conference, meeting, or other similar forum that is sponsored or co-sponsored by the Department and is—</text> 
<paragraph id="HBD009900E5F9470C86A9EBD0F51CBF20"><enum>(1)</enum><text>attended by 50 or more individuals, including one or more employees of the Department; or</text></paragraph> 
<paragraph id="H90AF37823AB7495F9F982A5D4D98253F"><enum>(2)</enum><text>estimated to cost the Department at least $20,000.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7D4E97F714CD43E2BB12BB0D91114A2E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding after the item relating to section 516 the following:</text>

<subsection id="H9F5E052862D84D5FA8649D32309D75CF"><enum>(c)</enum><header>Effective date</header><text>Section 517 of title 38, United States Code, as added by subsection (a), shall take effect on October 1, 2012, and shall apply with respect to the first quarter of fiscal year 2013 and each quarter thereafter.</text></subsection></section> 
<section id="H040EA9904E9545FF9278DDAE1C29E477"><enum>708.</enum><header>Publication of data on employment of certain veterans by Federal contractors</header><text display-inline="no-display-inline">Section 4212(d) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H01F14099E6C24F16A4E02A1677468B1B" style="USC"> 
<paragraph id="HA2D2A93C2B2D4F7DB515591045EFAC78" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Labor shall establish and maintain an Internet website on which the Secretary of Labor shall publicly disclose the information reported to the Secretary of Labor by contractors under paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD0DFD642897B4D0892B4C954FB3913F3" section-type="subsequent-section"><enum>709.</enum><header>VetStar Award Program</header> 
<subsection id="H2395B8AB4A1A412F8D354078CAA04ADF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 532 is amended—</text>

<paragraph id="H2F32386434E747ACACA3A939F1A8119A" indent="up1"><enum>(2)</enum><text>The Secretary shall establish a process for the administration of the award program, including criteria for—</text> 
<subparagraph id="HE682D2A6C4664CB6A20A6975BDE49BC0"><enum>(A)</enum><text>categories and sectors of businesses eligible for recognition each year; and</text></subparagraph> 
<subparagraph id="HBF2C11BD96CB422CB090AE710BCD19FB"><enum>(B)</enum><text>objective measures to be used in selecting businesses to receive the award.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

App. 533), as in effect on July 29, 2008, are hereby revived.</text></paragraph></subsection> 
<subsection id="H3430A456493E4887A6113A5364FE1FD7"><enum>(e)</enum><header>Report</header> 
<paragraph id="HC287DEADDB664387ABCBFAE180CF0C6D"><enum>(1)</enum><header>In general</header><text>Not later than 540 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the protections provided under section 303 of such Act (50 U.S.C. App 533) during the five-year period ending on the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HF3444CD39C264B539399E40EB5DFC810"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include, for the period described in such paragraph, the following:</text> 
<subparagraph id="HEC0935BD09784684AE68E158393503B2"><enum>(A)</enum><text>An assessment of the effects of such section on the long-term financial well-being of servicemembers and their families.</text></subparagraph> 
<subparagraph id="H6E50DE12FE5449838C7200FEC361304B"><enum>(B)</enum><text>The number of servicemembers who faced foreclosure during a 90-day period, 270-day period, or 365-day period beginning on the date on which the servicemembers completed a period of military service.</text></subparagraph> 
<subparagraph id="HE9814D544148438D8EE3C9F86B988455"><enum>(C)</enum><text>The number of servicemembers who applied for a stay or adjustment under subsection (b) of such section.</text></subparagraph> 
<subparagraph id="H24E495A97AB947D39A4584E04B5AF8BB"><enum>(D)</enum><text>A description and assessment of the effect of applying for a stay or adjustment under such subsection on the financial well-being of the servicemembers who applied for such a stay or adjustment.</text></subparagraph> 
<subparagraph id="HDF6EDAE4ED6947D7AD8BDC58161070FC"><enum>(E)</enum><text>An assessment of the Secretary of Defense's partnerships with public and private sector entities and recommendations on how the Secretary should modify such partnerships to improve financial education and counseling for servicemembers in order to assist them in achieving long-term financial stability.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H08E70C961A48408B97BA7EACB5999384"><enum>(3)</enum><header>Period of military service and servicemember defined</header><text>In this subsection, the terms <term>period of military service</term> and <term>servicemember</term> have the meanings given such terms in section 101 of such Act (50 U.S.C. App. 511).</text></paragraph></subsection></section></title>
