		  ambient air quality standard for ozone with respect to extreme nonattainment
		  areas, and for other purposes.</official-title>

		<section id="H0C208667D17E42CF829B428DB6C18B85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commonsense Ozone Regulation
			 Act</short-title></quote>.</text>
		</section><section id="HA726FC54B03745EC84E70F046519C5B1"><enum>2.</enum><header>Exclusive
			 application of 8-hour NAAQS to covered extreme ozone nonattainment
			 areas</header>
			<subsection id="H703C2B23510A45D592BEA1BA4ED53EAA"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding section 172(e) of the Clean Air Act (42
			 U.S.C. 7502(e)), any covered extreme ozone nonattainment area shall not be
			 subject to any control (as defined in section 4(2)) pursuant to the 1-hour
			 national primary ambient air quality standard for ozone.</text>
			</subsection><subsection id="H1B027028AFA2434699EC5FE0ED53CAB1"><enum>(b)</enum><header>Retroactive
			 applicability</header><text display-inline="yes-display-inline">Subsection (a)
			 applies as of the effective date of the classification of the area involved as
			 extreme pursuant to the 8-hour national primary ambient air quality standard
			 for ozone promulgated on July 18, 1997 (62 Fed. Reg. 38856).</text>
			</subsection></section><section id="HBD9B4EF800F74B12B56AADA31268B87E"><enum>3.</enum><header>Postponement of
			 future ozone standards for covered extreme ozone nonattainment areas</header>
			<subsection id="HFC44C4BE41764336BB04B508822C1EF2"><enum>(a)</enum><header>Postponement of
			 standard</header><text display-inline="yes-display-inline">With respect to any
			 covered extreme ozone nonattainment area—</text>
				<paragraph id="HBF12288F03D34764B63FF84DB66D6136"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator may take such steps as
			 are necessary to classify the area pursuant to any rule setting the level of
			 the 8-hour national primary ambient air quality standard for ozone below 0.08
			 parts per million; and</text>
				</paragraph><paragraph id="H305D93BA95AB4A5987E123EDD4108429"><enum>(2)</enum><text display-inline="yes-display-inline">until the date that is 6 months after a
			 report on the feasability of compliance in the area with the rule described in
			 paragraph (1) is submitted to the Congress and the Administrator under
			 subsection (b)(4)—</text>
					<subparagraph id="HF943EF2DBA5848978CAEA0703156D3D8"><enum>(A)</enum><text>the rule described
			 in paragraph (1) shall not otherwise apply; and</text>
					</subparagraph><subparagraph id="H13220218445440E19BBB0D5C08479D46"><enum>(B)</enum><text display-inline="yes-display-inline">the 8-hour national primary ambient air
			 quality standard for ozone in effect as of January 1, 2011, shall continue to
			 apply.</text>
					</subparagraph></paragraph></subsection><subsection id="HA7517B3C802548E187CDE5FF921A6C28"><enum>(b)</enum><header>Local advisory
			 committees</header>
				<paragraph id="HF08E48392E5E4BD1899EDDD8E7B20238"><enum>(1)</enum><header>Establishment
			 and applicability</header><text display-inline="yes-display-inline">Subsection
			 (a) applies with respect to a covered extreme ozone nonattainment area only if
			 the governing board of the responsible local air agency agrees to establish, in
			 accordance with this subsection, a local advisory committee to study the
			 feasibility of compliance in such area with a rule described in subsection
			 (a)(1).</text>
				</paragraph><paragraph id="H13B273E95CDF42EA95F7C312B546E386"><enum>(2)</enum><header>Members</header><text display-inline="yes-display-inline">Each local advisory committee under this
			 subsection shall be composed of the following members, to be appointed by the
			 governing board of the responsible local air agency:</text>
					<subparagraph id="H2A8C3ED2ACB547CAB377E497A29D606F"><enum>(A)</enum><text display-inline="yes-display-inline">A representative of the governing board of
			 the responsible local air agency.</text>
					</subparagraph><subparagraph id="H0683A5D0A3224E26B8E19279133449C2"><enum>(B)</enum><text>A local
			 representative of the energy industry.</text>
					</subparagraph><subparagraph id="HA550CCDE7BC54E5E9DA10CB32005B359"><enum>(C)</enum><text>A local
			 representative of the agriculture industry.</text>
					</subparagraph><subparagraph id="HECADF0F705564E6EA41BDA5F52C690B3"><enum>(D)</enum><text>A local
			 representative of the manufacturing and processing industry.</text>
					</subparagraph><subparagraph id="H9FD81CD2760348479118CC53C9227687"><enum>(E)</enum><text>A local
			 representative of the transportation industry.</text>
					</subparagraph><subparagraph id="H78DC6DD43E394331836E95171AB6314A"><enum>(F)</enum><text>A local
			 representative of local government.</text>
					</subparagraph><subparagraph id="H39F5F89A16674DCCA8918B878170E4A9"><enum>(G)</enum><text>A local
			 representative of the health care industry.</text>
					</subparagraph><subparagraph id="H59A1EC5A2E374F69B1F772823E5D5E73"><enum>(H)</enum><text>A local
			 environmental justice representative.</text>
					</subparagraph></paragraph><paragraph id="H6EEEF53F0C284D8E8393C60286FEB828"><enum>(3)</enum><header>Study</header>
					<subparagraph id="H922DA4D27EEE4AB1BFE2130001BE3D03"><enum>(A)</enum><header>Feasibility of
			 compliance with rule</header><text>Each local advisory committee under this
			 subsection shall conduct a study on the feasability of compliance in the
			 applicable covered extreme ozone nonattainment area with a rule described in
			 subsection (a)(1), taking into account—</text>
						<clause id="H9DF1052410C24B60B33565399B6C1CB5"><enum>(i)</enum><text display-inline="yes-display-inline">topography of the area;</text>
						</clause><clause id="H0A559BECD0F2423E99B88797F04607E0"><enum>(ii)</enum><text>weather in the
			 area;</text>
						</clause><clause id="H3582E0E8E34E4875BFAC69EA2AAE1B64"><enum>(iii)</enum><text>foreign sources
			 of pollution (both stationary and mobile) that cause ozone formation in the
			 area;</text>
						</clause><clause id="HF073348F37284041909AE182A7C1C43A"><enum>(iv)</enum><text>pass-through
			 traffic and its impact on ozone formation in the area;</text>
						</clause><clause id="H11F9A5E77CEA45FDAA03421264926542"><enum>(v)</enum><text display-inline="yes-display-inline">exceptional events in the area;</text>
						</clause><clause id="H8D83C1C2D91A4D0C941D4AA37B88A08A"><enum>(vi)</enum><text>current and
			 future technologies needed to bring the area into compliance with the rule;
			 and</text>
						</clause><clause id="H4F2AAD539BD249A7B0571E63F25191B2"><enum>(vii)</enum><text>natural ozone
			 background levels in the area.</text>
						</clause></subparagraph><subparagraph id="H16253DFAC34A4BC9B28783A91A4B3331"><enum>(B)</enum><header>Costs of
			 compliance with rule</header><text display-inline="yes-display-inline">Each
			 study described in subparagraph (A) shall address the potential adverse
			 employment impacts of, and the costs of compliance with, a rule described in
			 subsection (a)(1) for local businesses, agriculture operations, and residents
			 in the applicable covered extreme ozone nonattainment area.</text>
					</subparagraph></paragraph><paragraph id="H62139D8CE3B74940B11C12889C1D75C9"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 5 years after a rule
			 described in subsection (a)(1) is promulgated as final—</text>
					<subparagraph id="H866056B649644ECE971D0E81C170B002"><enum>(A)</enum><text>each local
			 advisory committee under this subsection shall submit to the governing board of
			 the responsible local air agency a report on the results of the study by the
			 committee under paragraph (3), including any findings and recommendations of
			 the committee; and</text>
					</subparagraph><subparagraph id="H2F7B163B87424E37AF101C5D947C48BB"><enum>(B)</enum><text>such governing
			 board shall immediately submit such report, without change, to the Congress and
			 the Administrator.</text>
					</subparagraph></paragraph></subsection></section><section id="H85FEBA6CB9EE41CD886B6B6B39990040"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H4B96396221DA4FBF872FDFD8B93BD0ED"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="H744DD63E3B654FF88E0346BAA0A64446"><enum>(2)</enum><header>Control</header><text>The
			 term <term>control</term> has the meaning given to such term for purposes of
			 section 172(e) of the Clean Air Act (42 U.S.C. 7502(e)) and includes any fee or
			 penalty under section 185 of such Act (42 U.S.C. 7511d)).</text>
			</paragraph><paragraph id="H5CCC36C100384B098C4D468B728AA93D"><enum>(3)</enum><header>Covered extreme
			 ozone nonattainment area</header><text display-inline="yes-display-inline">The
			 term <term>covered extreme ozone nonattainment area</term> means a
			 nonattainment area for ozone classified as extreme as of January 1, 2011,
			 pursuant to the 8-hour national primary ambient air quality standard for ozone
			 promulgated on July 18, 1997 (62 Fed. Reg. 38856).</text>
			</paragraph><paragraph id="H73F692E7D65E45828D2B98579EB1D41F"><enum>(4)</enum><header>Exceptional
			 event</header><text display-inline="yes-display-inline">The term
			 <term>exceptional event</term> has the meaning given such term in section
			 319(b) of the Clean Air Act (42 U.S.C. 7619(b)).</text>
			</paragraph><paragraph id="HFEDFF8638DDF475C8CA958C46D7D343C"><enum>(5)</enum><header>Responsible
			 local air agency</header><text display-inline="yes-display-inline">The term
			 <term>responsible local air agency</term> means the local air district or other
			 local government agency or authority with responsibility for enforcing
			 requirements relating to the prevention and regulation of air pollution for the
			 area involved.</text>
