		<section id="H3C86324F7DE7404480519757D5B6CBBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Servicemembers from
			 Mortgage Abuses Act of 2011</short-title></quote>.</text>
		</section><section id="HF626815D22E3456D9BD278AA81982326"><enum>2.</enum><header>Enhanced
			 protections for members of uniformed services relating to mortgages, mortgage
			 foreclosure, and eviction</header>
			<subsection id="H35D19105114C493E8A92132580AE302F"><enum>(a)</enum><header>Extended period
			 of protections</header>
				<paragraph id="H7F239AFB6D0C4B4885B9A6AA55A9BD74"><enum>(1)</enum><header>Stay of
			 proceedings and period of adjustment of obligations relating to real or
			 personal property</header><text>Section 303(b) of the Servicemembers Civil
			 Relief Act (50 U.S.C. App. 533(b)) is amended by striking <quote>within 9
			 months</quote> and inserting <quote>within 24 months</quote>.</text>
				</paragraph><paragraph id="HCEC077F251834A258D0FE807F6C38A30"><enum>(2)</enum><header>Period of relief
			 from sale, foreclosure, or seizure</header><text>Section 303(c) of such Act (50
			 U.S.C. App. 533(c)) is amended by striking <quote>within 9 months</quote> and
			 inserting <quote>within 24 months</quote>.</text>
				</paragraph><paragraph id="HE1970FD944884BB09382E42F05252BF2"><enum>(3)</enum><header>Repeal of
			 sunset</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 2203 of the Housing and Economic Recovery Act of 2008 (Public Law
			 110–289; 50 U.S.C. App. 533 note) is amended to read as follows:</text>

				date</header><text>The amendments made by subsection (a) shall take effect on

				</paragraph></subsection><subsection id="H88C193050AD349BEA03AE96527EC7E20"><enum>(b)</enum><header>Increased
			 criminal penalties</header>
				<paragraph id="HAB673332635C41B7A4D8D1C56D12D2B5"><enum>(1)</enum><header>Felony for
			 unlawful eviction or distress</header>
					<subparagraph id="H1A365E5CA9554BFEB59BCE8423B1E081"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 301 of the Servicemembers Civil Relief Act (50 U.S.C. App. 531(c)) is
			 amended by striking <quote>not more than one year</quote> and inserting
			 <quote>not more than two years</quote>.</text>
					</subparagraph><subparagraph id="HAF485CB0A0B54620A6F733154E654A54"><enum>(B)</enum><header>Clerical
			 amendment</header><text>The heading of such subsection is amended by striking
			 <quote><header-in-text level="subsection" style="OLC">Misdemeanor</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Felony</header-in-text></quote>.</text>
					</subparagraph></paragraph><paragraph id="HF0834F920D824124B619AE6F874AE9B7"><enum>(2)</enum><header>Felony for
			 unlawful sale, foreclosure, or seizure</header>
					<subparagraph id="H032DAD0733564D81B3ACC0B0EFF36467"><enum>(A)</enum><header>In
			 general</header><text>Subsection (d) of section 303 of such Act (50 U.S.C. App.
			 533(d)) is amended by striking <quote>not more than one year</quote> and
			 inserting <quote>not more than two years</quote>.</text>
					</subparagraph><subparagraph id="HC34DA1D27C204551AF0FC11536D6B1FF"><enum>(B)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The heading of such
			 subsection is amended by striking <quote><header-in-text level="subsection" style="OLC">Misdemeanor</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Felony</header-in-text></quote>.</text>
					</subparagraph></paragraph><paragraph id="HB7DFC1D17E5947AF8A4C32FAB3D4FF50"><enum>(3)</enum><header>Review of
			 Federal Sentencing Guidelines</header><text>Pursuant to the authority under
			 section 994 of title 28, United States Code, the United States Sentencing
			 Commission shall review the Federal Sentencing Guidelines and policy statements
			 applicable to offenses under section 301(c) and 303(d) of the Servicemembers
			 Civil Relief Act (50 U.S.C. App. 501 et seq.) to reflect the amendments made by
			 paragraphs (1) and (2).</text>
				</paragraph></subsection><subsection id="H6D0A459615F9402D9CE1F8D0DDDC50EC"><enum>(c)</enum><header>Increased civil
			 penalties generally</header><text>Section 801(b)(3) of such Act (50 U.S.C. App.
			 597(b)(3)) is amended—</text>
				<paragraph id="H260E7642C30745B58628EA46D8C87F41"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>$55,000</quote> and inserting <quote>$110,000</quote>;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H881684E2EED74474B5670917D10A12D6"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>$110,000</quote> and inserting
			 <quote>$220,000</quote>.</text>
				</paragraph></subsection></section></legis-body>
