		<official-title>To prohibit funding for the Environmental Protection
		  Agency to be used to implement or enforce a cap-and-trade program for
		  greenhouse gases, and for other purposes.</official-title>

		<section id="HD0A3CE9C21DE4AB38FD59BA77DD4E58C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ensuring Affordable Energy
			 Act</short-title></quote>.</text>
		</section><section id="H1B0DDE97238A4AA5896B0FB111CA5DE6"><enum>2.</enum><header>Prohibition of
			 funding for cap-and-trade program for greenhouse gases</header>
			<subsection id="HD127D9DA80A64EF88A67C30834FE630D"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 no funds appropriated or otherwise available for the Administrator of the
			 Environmental Protection Agency may be used to implement or enforce—</text>
				<paragraph id="HD410FD12F3C7448988EA319BD04FB9F8"><enum>(1)</enum><text>a
			 cap-and-trade program; or</text>
				</paragraph><paragraph commented="no" id="H7E88C278DBE149B5B9B80F72408039FA"><enum>(2)</enum><text display-inline="yes-display-inline">any statutory or regulatory requirement
			 pertaining to emissions of one or more greenhouse gases from stationary sources
			 that is issued or becomes applicable or effective after January 1, 2011,
			 including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HE4AD01DA53974A638FCF7B8058C57438"><enum>(A)</enum><text display-inline="yes-display-inline">any such requirement under section 111 of
			 the Clean Air Act (42 U.S.C. 7411) or part C of title I of such Act (42 U.S.C.
			 7470 et seq.); and</text>
					</subparagraph><subparagraph commented="no" id="HEAD26C1DC47E4FA0850FD79409AEDAD5"><enum>(B)</enum><text>any such
			 permitting requirement under the Clean Air Act (42 U.S.C. 7401 et seq.).</text>
					</subparagraph></paragraph></subsection><subsection id="H5F5E3FF9C4104C09AA4774D82A686E95"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text>
				<paragraph id="H86A8A2B021374D12932461782B14C3CA"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>cap-and-trade program</term>
			 means any regulatory program established after the date of enactment of this
			 Act that provides for the sale, auction, or other distribution of a limited
			 amount of allowances that permit the emission of one or more greenhouse
			 gases.</text>
				</paragraph><paragraph id="HE8C0BAD4D36A40D3A17D07247B8F7B26"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>greenhouse gas</term>
			 includes, with respect to a cap-and-trade program under subsection (a)(1) or a
			 requirement under subsection (a)(2), any of the following:</text>
					<subparagraph id="HD0176884B58F4AD7A3D3C91AC141CAD2"><enum>(A)</enum><text>Carbon
			 dioxide.</text>
					</subparagraph><subparagraph id="H36BFEE91B00B419883F715D89A5900FC"><enum>(B)</enum><text>Methane.</text>
					</subparagraph><subparagraph id="HDB78DABB5B3F4E34AB2674333A508BB6"><enum>(C)</enum><text>Nitrous
			 oxide.</text>
					</subparagraph><subparagraph id="H4EA6E968ED6D43C8B97CADA6021D7CAF"><enum>(D)</enum><text display-inline="yes-display-inline">Sulfur hexafluoride.</text>
					</subparagraph><subparagraph id="HAFC909A30B864B11875F574181991029"><enum>(E)</enum><text>Hydrofluorocarbons.</text>
					</subparagraph><subparagraph id="H3A0A08F88C924382B913980CA550B36D"><enum>(F)</enum><text>Perfluorocarbons.</text>
					</subparagraph><subparagraph id="HEEB66C5F93274EBDBF5276CDE609A9D5"><enum>(G)</enum><text>Any other
			 anthropogenic gas designated as a greenhouse gas for purposes of such
			 cap-and-trade program or such requirement.</text>
					</subparagraph></paragraph><paragraph id="H2E43D1966EE44A40BD8A6F71D525DDB9"><enum>(3)</enum><text>The term
			 <term>stationary source</term> has the meaning given such term in section
			 111(a)(3) of the Clean Air Act (42 U.S.C. 7411(a)(3)).</text>
