		<official-title>To amend the DNA Analysis Backlog Elimination Act of 2000
		  to provide for Debbie Smith grants for auditing sexual assault evidence
		  backlogs and to establish a Sexual Assault Forensic Evidence Registry, and for
		  other purposes.</official-title>

		<section id="H90B483AB28E7475ABA598C5C8065C497" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sexual Assault Forensic Evidence
			 Registry Act of 2011</short-title></quote> or the <quote><short-title>SAFER Act of 2011</short-title></quote>.</text>
		</section><section id="H9DDC0A876A614781B888AFED29DEE918"><enum>2.</enum><header>Debbie Smith
			 grants for auditing sexual assault evidence backlogs</header><text display-inline="no-display-inline">Section 2 of the DNA Analysis Backlog
			 Elimination Act of 2000 (42 U.S.C. 14135) is amended—</text>
			<paragraph id="HA66326B884CC445D8975BCFAE9896E9B"><enum>(1)</enum><text>in subsection (a),
			 by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF0A145837AFC402C99A78E4C0BD9669E" style="OLC">
					<paragraph id="HDEB8A3BD9AF7460FA6CDC26A594C2708"><enum>(6)</enum><text display-inline="yes-display-inline">To conduct an audit consistent with
				subsection (n) of the samples of sexual assault evidence that are in the
				possession of the State or unit of local government and are awaiting
				testing.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H982AA9DD81664401B32E76E514AE8D3D"><enum>(2)</enum><text>in subsection (c),
			 by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H3FEA1311322046B3BB5AA6BE08FACE25" style="OLC">
					<paragraph id="HE2E5F545343A40FCB5502EF423B10273"><enum>(4)</enum><header>Allocation of
				grant awards for audits</header><text display-inline="yes-display-inline">For
				each of fiscal years 2012 through 2016, not less than 7 percent of the grant
				amounts distributed under paragraph (1) shall be awarded for purposes described
				in subsection (a)(6).</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="H0ACF76849F414613A733507F3ACE1189"><enum>(3)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H6FC4907C80E940A5972056E70C6D657B" style="OLC">
					<subsection commented="no" id="HD1380C1B877C4691B94C855D797C7BFA"><enum>(n)</enum><header>Use of funds for
				auditing sexual assault evidence backlogs</header>
						<paragraph commented="no" id="H66CFF6F4FA174369A9E624DBD41078DA"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">The Attorney General may award a grant
				under this section to a State or unit of local government for the purpose
				described in subsection (a)(6) only if the State or unit of local
				government—</text>
							<subparagraph commented="no" id="H40233F3CA9EA4C599E26FF673F01FAAE"><enum>(A)</enum><text>submits a plan for
				performing the audit of samples described in such subsection; and</text>
							</subparagraph><subparagraph id="H9C09BED19C924EC29FCC53F46C25A928"><enum>(B)</enum><text>includes in such
				plan a good-faith estimate of the number of such samples.</text>
							</subparagraph></paragraph><paragraph id="HEB3CB8F59B0D4E5F82002AC2B12134BB"><enum>(2)</enum><header>Grant
				conditions</header><text>A State or unit of local government receiving a grant
				for the purpose described in subsection (a)(6) shall—</text>
							<subparagraph id="H62B9452017EE48C5B3C28C707052D489"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after receiving such
				grant—</text>
								<clause id="HBF11F8E086614EAD8B75FAF8F1A3CCC9"><enum>(i)</enum><text>complete the audit
				referred to in paragraph (1)(A) in accordance with the plan submitted under
				such paragraph; and</text>
								</clause><clause id="HF53CB73ADC6A4DE7B4F11729358AB429"><enum>(ii)</enum><text display-inline="yes-display-inline">for each sample of sexual assault evidence
				identified in such audit, subject to paragraph (4), enter into the Sexual
				Assault Forensic Evidence Registry established under section 3 of the SAFER Act
				of 2011 the information listed in subsection (b)(1) of such section;</text>
								</clause></subparagraph><subparagraph id="H11F156279E3B476D80FFC9D91DD47EA9"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 14 days after receiving
				possession of a sample of sexual assault evidence that was not in the
				possession of the State or unit of local government at the time of such audit,
				subject to paragraph (4), enter into such Registry the information listed in
				such subsection with respect to the sample; and</text>
							</subparagraph><subparagraph id="H32F3B79F62A945789FAB2D1D94E60EFB"><enum>(C)</enum><text>not later than 30
				days after a change in the status referred to in subparagraph (E) of such
				subsection of a sample with respect to which the State or unit of local
				government has entered information into such Registry, update such
				status.</text>
							</subparagraph></paragraph><paragraph id="HF7778E1E31034E9198A1367D705C2681"><enum>(3)</enum><header>Extension of
				initial deadline</header><text>The Attorney General may grant an extension of
				the deadline in paragraph (2)(A) to a State or unit of local government that
				demonstrates that more time is required for compliance with such
				paragraph.</text>
						</paragraph><paragraph id="HDAA27A19DA1F46CF9101C9E4B79E0A74"><enum>(4)</enum><header>Samples exempt
				from Registry requirement</header><text display-inline="yes-display-inline">A
				State or unit of local government is not required under paragraph (2) to enter
				into the Registry described in such paragraph information with respect to a
				sample of sexual assault evidence if—</text>
							<subparagraph id="H24ADD4BB3BE64C6E8F3C37FFBBD2BBE6"><enum>(A)</enum><text>the sample is not
				considered criminal evidence (such as a sample collected anonymously from a
				victim who is unwilling to make a criminal complaint); or</text>
							</subparagraph><subparagraph id="H27AABAC11BA24073B705DE571A092D14"><enum>(B)</enum><text display-inline="yes-display-inline">the sample relates to a sexual assault for
				which the prosecution of each perpetrator is barred by a statute of
				limitations.</text>
							</subparagraph></paragraph><paragraph id="H3F6CB83F5DD442CA988D81DA20CB301A"><enum>(5)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="HE921EC131F684A478F9EDA6CC24CFCB2"><enum>(A)</enum><header>Awaiting
				testing</header><text>The term <term>awaiting testing</term> means, with
				respect to a sample of sexual assault evidence, that—</text>
								<clause id="H2C598DF59A00456F8AF96892F496590D"><enum>(i)</enum><text>the sample has
				been collected and is in the possession of a State or unit of local
				government;</text>
								</clause><clause id="H81E3D026DA98401D8537DDAA4FAA4BD4"><enum>(ii)</enum><text display-inline="yes-display-inline">DNA and other appropriate forensic analyses
				have not been performed on such sample; and</text>
								</clause><clause id="HC28881112344405691528158B8E5D3CF"><enum>(iii)</enum><text>the sample is
				related to a criminal case or investigation in which final disposition has not
				yet been reached.</text>
								</clause></subparagraph><subparagraph id="H32FA5E13D6344EFF94452B8FA76B08A2"><enum>(B)</enum><header>Final
				disposition</header><text>The term <term>final disposition</term> means, with
				respect to a criminal case or investigation to which a sample of sexual assault
				evidence relates—</text>
								<clause id="H9F0A492AA5F5464A97D49F1747C877CB"><enum>(i)</enum><text>the conviction or
				acquittal of all suspected perpetrators of the crime involved;</text>
								</clause><clause id="H53D4AF07141F4F128E70869B643724F1"><enum>(ii)</enum><text>a
				determination by the State or unit of local government in possession of the
				sample that the case is unfounded; or</text>
								</clause><clause id="H56E28472B3684FCBBD35FCF69B3DE04F"><enum>(iii)</enum><text>a declaration by
				the victim of the crime involved that the act constituting the basis of the
				crime was not committed.</text>
								</clause></subparagraph><subparagraph id="H3B45AC8B38014A21865DEB4C2A901431"><enum>(C)</enum><header>Possession</header><text display-inline="yes-display-inline">The term <term>possession</term>, used with
				respect to possession of a sample of sexual assault evidence by a State or unit
				of local government, includes possession by an individual who is acting as an
				agent of the State or unit of local government for the collection of the
				sample.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB59EEC98344140DDB7207D3636A4FE7A"><enum>3.</enum><header>Sexual Assault
			 Forensic Evidence Registry</header>
			<subsection commented="no" id="H123F62FA02F04FE6AC332A7CC81BAAEE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2 of the DNA
			 Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135), as amended by
			 section 2 of this Act, is further amended by adding at the end the following
			 new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA6C30EDB709745829CA37055F189D7B7" style="OLC">
					<subsection commented="no" id="H3F80648AF4DD47B3B46150AE97531FB7"><enum>(o)</enum><header>Sexual Assault
				Forensic Evidence Registry</header>
						<paragraph commented="no" id="H9EAD32ECB67347869226748D1D44F873"><enum>(1)</enum><header>In
				general</header><text>Subject to subsection (j), not later than 1 year after
				the date of the enactment of this Act, the Attorney General shall establish a
				Sexual Assault Forensic Evidence Registry (in this section referred to as the
				<quote>Registry</quote>) that—</text>
							<subparagraph commented="no" id="H9106AD6C82ED4BADB17D01A82792BF58"><enum>(A)</enum><text display-inline="yes-display-inline">allows States and units of local government
				to enter information into the Registry about samples of sexual assault evidence
				that are in the possession of such States or units of local government and are
				awaiting testing; and</text>
							</subparagraph><subparagraph commented="no" id="HB3E50111E6F0445BBF3E4D5E5D2CAA9C"><enum>(B)</enum><text>tracks the testing
				and processing of such samples.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HD0454768129644E59DACB76F390F4B34"><enum>(2)</enum><header>Information in
				Registry</header>
							<subparagraph commented="no" id="HB265DEC244B14E559B5C7D883912BF6C"><enum>(A)</enum><header>In
				general</header><text>A State or unit of local government that chooses to enter
				information into the Registry about a sample of sexual assault evidence shall
				include the following information:</text>
								<clause commented="no" id="H34651268F35F4D3FBDA23F587F1FE377"><enum>(i)</enum><text>The date of the
				sexual assault to which the sample relates.</text>
								</clause><clause commented="no" id="H606F7336D632438B9B56ACD31DDE62E8"><enum>(ii)</enum><text>The city, county,
				or other appropriate locality where the sexual assault occurred.</text>
								</clause><clause commented="no" id="HCE01CD35195648B6B20DF3D4B6BE569B"><enum>(iii)</enum><text>The date on
				which the sample was collected.</text>
								</clause><clause commented="no" id="HC48EDB707AB64076926A1D83E6BE9CC2"><enum>(iv)</enum><text>The date on which
				information about the sample was entered into the Registry.</text>
								</clause><clause commented="no" id="H1D228E4E17E24FFC9E94E647CA2F3CCE"><enum>(v)</enum><text>The status of the
				progression of the sample through testing and other stages of the evidentiary
				handling process, including the identity of the entity in possession of the
				sample.</text>
								</clause><clause commented="no" id="H4AEF9052184547E5B3E3CB76633913A4"><enum>(vi)</enum><text>The date or dates
				after which the State or unit of local government would be barred by any
				applicable statutes of limitations from prosecuting a perpetrator of the sexual
				assault for the sexual assault.</text>
								</clause><clause commented="no" id="H31DF15C9C3FC4A4CBF3FF9B508BDAD3D"><enum>(vii)</enum><text>Such other
				information as the Attorney General considers appropriate.</text>
								</clause></subparagraph><subparagraph commented="no" id="H758619C9541141ED99792AC1F0BF30DB"><enum>(B)</enum><header>Personally
				identifiable information</header><text>The Attorney General shall ensure that
				the Registry does not include personally identifiable information or details
				about a sexual assault that might lead to the identification of the individuals
				involved, except the information listed in subparagraph (A).</text>
							</subparagraph></paragraph><paragraph commented="no" id="HD47FFFEAFB11482F9255B0CD1331E46D"><enum>(3)</enum><header>Sample
				identification number</header><text display-inline="yes-display-inline">A State
				or unit of local government that chooses to enter information about a sample of
				sexual assault evidence into the Registry shall assign to the sample a unique
				numeric or alphanumeric identifier. In assigning the identifier, a State or
				unit of local government may use a case-numbering system used for other
				purposes, but the Attorney General shall ensure that the identifier assigned to
				each sample is unique with respect to all samples entered by all States and
				units of local government.</text>
						</paragraph><paragraph commented="no" id="HD293F9325484481FB92029B412432CE5"><enum>(4)</enum><header>Update of
				information</header><text display-inline="yes-display-inline">A State or unit
				of local government that chooses to enter information about a sample of sexual
				assault evidence into the Registry shall, not later than 30 days after a change
				in the status of the sample referred to in paragraph (2)(A)(v), update such
				status.</text>
						</paragraph><paragraph commented="no" id="HBAAD1050FF314EA2A60C624F78CA1B0E"><enum>(5)</enum><header>Internet
				access</header><text>The Attorney General shall make the Registry accessible to
				the public on an appropriate Internet website.</text>
						</paragraph><paragraph commented="no" id="HA882F014A9EC4648AD1D6DD228D005CB"><enum>(6)</enum><header>Technical
				assistance</header><text>The Attorney General shall—</text>
							<subparagraph commented="no" id="HDD9BEE72CF59475FB6018E0E16F81387"><enum>(A)</enum><text>provide a means by
				which an entity that does not have access to the Internet may enter information
				into the Registry; and</text>
							</subparagraph><subparagraph commented="no" id="H39D4CDFD2F044B4580C79962826FE680"><enum>(B)</enum><text display-inline="yes-display-inline">provide the technical assistance necessary
				to allow States and units of local government to participate in the
				Registry.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEAC0B7DEC0BA4A4088B4512B2A3C0647"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">Section 2(j) of the DNA Analysis Backlog
			 Elimination Act of 2000 (42 U.S.C. 14135(j)) is amended—</text>
				<paragraph id="H717BAF44BAC54E77A77E21EF8744CBAA"><enum>(1)</enum><text>by inserting
			 <quote>and for carrying out subsection (o)</quote> after <quote>for grants
			 under subsection (a)</quote>; and</text>
				</paragraph><paragraph id="H46F66B0C12B845BFB3663EAA1CC74F83"><enum>(2)</enum><text>by adding at the
			 end the following new sentence: <quote>For each of the fiscal years 2012
			 through 2016, not less than 1 percent of the amount authorized to be
			 appropriated under the previous sentence for such fiscal year shall be for
			 carrying out subsection (o).</quote></text>
				</paragraph></subsection></section><section id="H2A0CB5D655FE488896AE2AE0E0934E77"><enum>4.</enum><header>Report on best
			 practices for testing and use of DNA evidence</header>
			<subsection id="H26B3DFF108974A36B5F337D9A8E7F691"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of the enactment of this Act, the Attorney General shall
			 develop and disseminate to law enforcement agencies and other appropriate
			 entities a report on best practices for the testing and use of DNA evidence
			 collected as part of the criminal investigation of sexual assault cases. In
			 developing the best practices, the Attorney General shall take into account
			 that sexual assault perpetrators are often habitual offenders, may commit many
			 acts of sexual violence against both strangers and victims known to them, and
			 may commit other violent crimes and crimes against property.</text>
			</subsection><subsection id="H4C4F2BBE94934F98B1CE489761B8FF67"><enum>(b)</enum><header>Content</header><text>The
			 best practices developed under subsection (a) shall—</text>
				<paragraph id="HCCEF4F9821AE412AAB526F3987FE02AF"><enum>(1)</enum><text>establish the
			 appropriate prioritization of testing of samples of sexual assault evidence,
			 including samples related to—</text>
					<subparagraph id="H9DF3B69368C549B5BF7590616BD31EA3"><enum>(A)</enum><text display-inline="yes-display-inline">cases in which a suspect has been
			 identified and cases in which a suspect has not been identified; and</text>
					</subparagraph><subparagraph id="H96868D38B8E54F4F896D3E9A1C159DBD"><enum>(B)</enum><text display-inline="yes-display-inline">cases in which the assault was committed by
			 a stranger and cases in which the assault was committed by someone known to the
			 victim;</text>
					</subparagraph></paragraph><paragraph id="H4B28ED4515DE4C51BCC05EFEB81F5CDF"><enum>(2)</enum><text display-inline="yes-display-inline">describe the protocols for appropriately
			 handling and storing samples of sexual assault evidence;</text>
				</paragraph><paragraph id="HB2446E150E7C4992805B0FEBA215FE17"><enum>(3)</enum><text display-inline="yes-display-inline">describe the evidentiary value of and make
			 recommendations pertaining to testing all samples of sexual assault evidence,
			 including samples related to—</text>
					<subparagraph id="H46F38CB8639B42B7B10BDC480854403F"><enum>(A)</enum><text>cases in which a
			 suspect has been identified and cases in which a suspect has not been
			 identified;</text>
					</subparagraph><subparagraph id="H77085B78FD3C46BEB324B6A33F4FFA95"><enum>(B)</enum><text>cases in which the
			 assault was committed by a stranger and cases in which the assault was
			 committed by someone known to the victim;</text>
					</subparagraph><subparagraph id="HDE2F5C42B3D1498B8A5B0E6E88BBA301"><enum>(C)</enum><text>cases in which
			 prosecution of a perpetrator is barred by an applicable statute of limitations;
			 and</text>
					</subparagraph><subparagraph id="H140D40EA2C644B6C8098AFF0D74DCCC3"><enum>(D)</enum><text>cases in which
			 forensic evidence has been collected from a victim who, pursuant to section
			 2010(d)(1) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796gg–4(d)(1)), chooses not to participate in the criminal justice system or
			 cooperate with law enforcement; and</text>
					</subparagraph></paragraph><paragraph id="H8867C94393B24409AEAD1BC6E969D274"><enum>(4)</enum><text display-inline="yes-display-inline">make recommendations with respect to
			 notifying a victim that the sample of sexual assault evidence of the victim has
			 been tested, including victims in cases—</text>
					<subparagraph id="HE0CBFA4B59274A68A6C066831CC9AAD1"><enum>(A)</enum><text>that are actively
			 being investigated (including cases being actively investigated after a period
			 of dormancy); and</text>
					</subparagraph><subparagraph id="H660A359157CD4EF89FBB8B9968FDB0BB"><enum>(B)</enum><text display-inline="yes-display-inline">in which prosecution of a perpetrator is
			 barred by an applicable statute of limitations.</text>
					</subparagraph></paragraph></subsection><subsection id="H5978AAE9F01C49F5981E15E98E2E1C4B"><enum>(c)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that law enforcement agencies and other appropriate entities should
			 use the best practices developed and disseminated under subsection (a) to
			 develop, evaluate, and improve DNA evidence protocols.</text>
			</subsection></section><section id="H17BDCA92E422477C95B37847CE50EDCE"><enum>5.</enum><header>Reports to
			 Congress</header><text display-inline="no-display-inline">Not later than 90
			 days after the end of each fiscal year for which a grant is made for the
			 purpose described in section 2(a)(6) of the DNA Analysis Backlog Elimination
			 Act of 2000, as added by section 2(1) of this Act, the Attorney General shall
			 submit to Congress a report that—</text>
			<paragraph id="H441318EF0A2E40ECA61F3DA7B5CCB9ED"><enum>(1)</enum><text display-inline="yes-display-inline">lists the States and units of local
			 government that have been awarded such grants and the amount of the grant
			 received by each such State or unit of local government;</text>
			</paragraph><paragraph id="H76828F684853485B970858F4CE9440BB"><enum>(2)</enum><text display-inline="yes-display-inline">states the number of extensions granted by
			 the Attorney General under section 2(n)(3) of such Act, as added by section
			 2(2) of this Act; and</text>
			</paragraph><paragraph id="HBAC46A377BB044C18F3882041EEA09C3"><enum>(3)</enum><text display-inline="yes-display-inline">summarizes the processing status of the
			 samples of sexual assault evidence on which information has been entered into
			 the Sexual Assault Forensic Evidence Registry established under section 2(o) of
			 the DNA Analysis Backlog Act of 2000, as added by section 3 of this Act,
			 including the number of samples that have not been tested.</text>
			</paragraph></section></legis-body>
