		<official-title display="yes">To amend title 49, United States Code, to
		  direct the Assistant Secretary of Homeland Security (Transportation Security
		  Administration) to establish an Aviation Security Advisory Committee, and for
		  other purposes.</official-title>

		<section id="H52989F81E1294DA896FA851C52C7FD2D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aviation Security Stakeholder
			 Participation Act of 2012</short-title></quote>.</text>
		</section><section id="H70CDBDCFE5514958A65087AB4A51CFD1"><enum>2.</enum><header>Aviation Security
			 Advisory Committee</header>
			<subsection id="HCEEFE94F866F415F95640D7384F70B27"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H56FD5D6D961F4C57BDD93DD5E4D576C2" style="USC">
					<section id="HC3E8332C61DB475A852AC7E66D4ADA93"><enum>44946.</enum><header>Aviation
				Security Advisory Committee</header>
						<subsection id="H81986067B8A149B9B3D652383854150A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish
				within the Transportation Security Administration an advisory committee to be
				known as the Aviation Security Advisory Committee.</text>
						</subsection><subsection id="H1F10815FEB514765BF785BD0B33963F8"><enum>(b)</enum><header>Duties</header>
							<paragraph id="H06C0E948237740A8AB267A546843CEFC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Advisory
				Committee shall be consulted by and advise the Assistant Secretary on aviation
				security matters, including the development and implementation of policies,
				programs, rulemaking, and security directives pertaining to aviation
				security.</text>
							</paragraph><paragraph id="HB1B8C2169F64433D95C40A590DD9B4D7"><enum>(2)</enum><header>Recommendations</header>
								<subparagraph id="H07034D2C588D403EAA4127F94BA8C48C"><enum>(A)</enum><header>In
				general</header><text>The Advisory Committee shall develop, at the request of
				the Assistant Secretary, recommendations for improvements to aviation
				security.</text>
								</subparagraph><subparagraph id="H685561BF3B87431581FC8AB57FECE1E9"><enum>(B)</enum><header>Recommendations
				of working groups</header><text>Recommendations agreed upon by the working
				groups established under this section shall be approved by the Advisory
				Committee for transmission to the Assistant Secretary.</text>
								</subparagraph></paragraph><paragraph id="HADCA910CD449440C9C5E180D56B67CC9"><enum>(3)</enum><header>Periodic
				reports</header><text>The Advisory Committee shall periodically submit to the
				Assistant Secretary—</text>
								<subparagraph id="HBDD133A8A7B04241A48C1F56244EF4CA"><enum>(A)</enum><text>reports on matters
				identified by the Assistant Secretary; and</text>
								</subparagraph><subparagraph id="H9C97FD0E3E0946A588B06EE403B85260"><enum>(B)</enum><text>reports on other
				matters identified by a majority of the members of the Advisory
				Committee.</text>
								</subparagraph></paragraph><paragraph id="HE0221302C2E340DFBE43728BD817608D"><enum>(4)</enum><header>Annual
				report</header><text>The Advisory Committee shall submit to the Assistant
				Secretary an annual report providing information on the activities, findings,
				and recommendations of the Advisory Committee, including its working groups,
				for the preceding year.</text>
							</paragraph></subsection><subsection id="H8554499CF860445F8F5D3D1F42EAB427"><enum>(c)</enum><header>Membership</header>
							<paragraph id="HA2540553E102464FAB3CA48EFC44846F"><enum>(1)</enum><header>Appointment</header>
								<subparagraph id="HA464D5B8BCBC44D6B3E9F38E5EEACC49"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this section, the Assistant Secretary shall appoint the members of the Advisory
				Committee.</text>
								</subparagraph><subparagraph id="H252D367F3DD64E2C962073363E2F35A0"><enum>(B)</enum><header>Composition</header><text>The
				membership shall consist of individuals representing not more than 27 member
				organizations. Each organization shall be represented by one individual (or the
				individual’s designee).</text>
								</subparagraph><subparagraph id="HC8CA83DE44D94A1589A0F989A7A6D977"><enum>(C)</enum><header>Representation</header><text>The
				membership shall include representatives of air carriers, all cargo air
				transportation, indirect air carriers, labor organizations representing air
				carrier employees, aircraft manufacturers, airport operators, general aviation,
				privacy, the travel industry, and the aviation technology security industry,
				including biometrics.</text>
								</subparagraph></paragraph><paragraph id="HAC1EACF9976D429FBCE6D49886EEA609"><enum>(2)</enum><header>Removal</header><text>The
				Assistant Secretary may review the participation of a member of the Advisory
				Committee and remove the member for cause at any time.</text>
							</paragraph><paragraph id="H33DDA0BBCF554554B3ECD4BC851F98D7"><enum>(3)</enum><header>Prohibition on
				compensation</header><text>The members of the Advisory Committee shall not
				receive pay, allowances, or benefits from the Government by reason of their
				service on the Advisory Committee.</text>
							</paragraph><paragraph id="HFD549440BEB54832B8969434B0887C20"><enum>(4)</enum><header>Meetings</header><text>The
				Assistant Secretary shall require the Advisory Committee to meet at least
				semiannually and may convene additional meetings as necessary.</text>
							</paragraph></subsection><subsection id="HE3AB631D23E844B795F28059E98C9B26"><enum>(d)</enum><header>Air cargo
				security working group</header>
							<paragraph id="H4B50869D19E34D1D8E43122228745F28"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall establish within the
				Advisory Committee an air cargo security working group to provide
				recommendations on air cargo security issues, including the implementation of
				the air cargo security programs established by the Transportation Security
				Administration to screen air cargo on passenger aircraft and all-cargo aircraft
				in accordance with established cargo screening mandates.</text>
							</paragraph><paragraph id="H0A4B728E74004AE6B302702A151567CD"><enum>(2)</enum><header>Meetings and
				reporting</header><text>The working group shall meet at least quarterly and
				submit information, including recommendations, regarding air cargo security to
				the Advisory Committee for inclusion in the annual report. The submissions
				shall include recommendations to improve the Administration’s cargo security
				initiatives established to meet the requirements of section 44901(g).</text>
							</paragraph><paragraph id="HCB75F75ED1114BA8B2B59171D7CB1A95"><enum>(3)</enum><header>Membership</header><text>The
				working group shall—</text>
								<subparagraph id="H7AA07F3FEB50440DBA883FB522BCE633"><enum>(A)</enum><text>include members of
				the Advisory Committee with expertise in air cargo operations; and</text>
								</subparagraph><subparagraph id="HEB9D64D1329C4EA398838D000200561D"><enum>(B)</enum><text>be cochaired by a
				Government and industry official.</text>
								</subparagraph></paragraph></subsection><subsection id="H202D08E61D134C928F8DC2944F35CDAC"><enum>(e)</enum><header>General aviation
				security working group</header>
							<paragraph id="H62CF7F1B29144154A26E5FB58213E3C0"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall establish within the Advisory Committee a general aviation
				working group to provide recommendations on transportation security issues for
				general aviation facilities, general aviation aircraft, and helicopter
				operations at general aviation and commercial service airports.</text>
							</paragraph><paragraph id="H11AB5E49375C4C0EA48D4BCC7FEB3E56"><enum>(2)</enum><header>Meetings and
				reporting</header><text display-inline="yes-display-inline">The working group
				shall meet at least quarterly and submit information, including
				recommendations, regarding aviation security at general aviation airports to
				the Advisory Committee for inclusion in the annual report.</text>
							</paragraph><paragraph id="H0333B916636940BA91803982A8967E7E"><enum>(3)</enum><header>Membership</header><text>The
				working group shall—</text>
								<subparagraph id="HFC564C20E7594B4B966E329B20BE4AD0"><enum>(A)</enum><text>include members of
				the Advisory Committee with expertise in general aviation; and</text>
								</subparagraph><subparagraph id="HF3EFFDACE8284952A993D0029572522E"><enum>(B)</enum><text>be cochaired by a
				Government and industry official.</text>
								</subparagraph></paragraph></subsection><subsection id="H757AA5DBE7BC485C99C8CDC7625A3436"><enum>(f)</enum><header>Perimeter
				security working group</header>
							<paragraph id="H6F573CD667B741B7A7D71178751360F7"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall establish within the
				Advisory Committee an airport perimeter security working group to provide
				recommendations on airport perimeter security and access control issues.</text>
							</paragraph><paragraph id="H5035E2CB6BD04888ABFCFCD0B95B0CDD"><enum>(2)</enum><header>Meetings and
				reporting</header><text>The working group shall meet at least quarterly and
				submit information, including recommendations, regarding improving perimeter
				security and access control procedures at commercial service and general
				aviation airports to the Advisory Committee for inclusion in the annual
				report.</text>
							</paragraph><paragraph id="H5ACBDC85A0BD47C2B976537729CC4457"><enum>(3)</enum><header>Membership</header><text>The
				working group shall—</text>
								<subparagraph id="HDB7C489C844D4BD5BCF0431464DB462E"><enum>(A)</enum><text>include members of
				the Advisory Committee with expertise in airport perimeter security and access
				control issues; and</text>
								</subparagraph><subparagraph id="H076EC750ADE44F80BE9A14077EFC08D9"><enum>(B)</enum><text>be cochaired by a
				Government and industry official.</text>
								</subparagraph></paragraph></subsection><subsection id="H5CE8EC8F81654757AA4D5C9EAF762507"><enum>(g)</enum><header>Nonapplicability
				of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				not apply to the Advisory Committee or its working groups.</text>
						</subsection><subsection id="HAACA0AA72965441C8CDE471C67AA2FE9"><enum>(h)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<paragraph id="H10AEC6A9BD0B496296B0802824547DC7"><enum>(1)</enum><header>Advisory
				Committee</header><text display-inline="yes-display-inline">The term
				<quote>Advisory Committee</quote> means the Aviation Security Advisory
				Committee to be established under subsection (a).</text>
							</paragraph><paragraph id="H9D1515E911494A35AEE0083ECCA2345B"><enum>(2)</enum><header>Annual
				report</header><text>The term <quote>annual report</quote> means the annual
				report required under subsection (a).</text>
							</paragraph><paragraph id="H3F9C8A6877BE4091AF8ECEB134F3EF09"><enum>(3)</enum><header>Assistant
				Secretary</header><text display-inline="yes-display-inline">The term
				<quote>Assistant Secretary</quote> means the Assistant Secretary of Homeland
				Security (Transportation Security Administration).</text>
							</paragraph><paragraph id="HD6537E7578C1421182F9E7D0CD2A014B"><enum>(4)</enum><header>Perimeter
				security</header><text>The term <quote>perimeter security</quote>—</text>
								<subparagraph id="H0F05CC19582842DB913991E45081DA84"><enum>(A)</enum><text display-inline="yes-display-inline">means procedures or systems to monitor,
				secure, and prevent unauthorized access to an airport, including its airfield
				and terminal; and</text>
								</subparagraph><subparagraph id="H7AFA072C3ACD4472AFCED5B8F8AEC142"><enum>(B)</enum><text display-inline="yes-display-inline">includes the fence area surrounding an
				airport, access gates, and access
				controls.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.<pagebreak></pagebreak></after-quoted-block></quoted-block>
			</subsection><subsection id="HFEC49CDCFC7849F1B6C8C795EEEDA92D"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such subchapter is amended by adding
			 at the end the following:</text>
