		<section id="H56545A4D28E14F21A73AB70C5D6955CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Activity Based Total
			 Accountability Act of 2011</short-title></quote>.</text>
		</section><section id="HED1765148D4B466FB36AE41183E96854"><enum>2.</enum><header>Findings and
			 Purpose</header>
			<subsection id="H10277A7F640547B8B16F80FFB7A61E1E"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds as follows:</text>
				<paragraph id="HFD18E3FD169243BA8E1F8EA821071A13"><enum>(1)</enum><text display-inline="yes-display-inline">The Federal Government sends hundreds of
			 billions of dollars to the States each and every year.</text>
				</paragraph><paragraph id="H4A4D04B18D7748F7A186237074FC6E21"><enum>(2)</enum><text>In fiscal year
			 2009, among the money sent to the States were $325 billion for health and human
			 services, $57 billion for transportation, $47 billion for housing and urban
			 development, $45 billion for education, and $31 billion for agriculture.</text>
				</paragraph><paragraph id="H447588E2F1934BEBBDD47851C03530DF"><enum>(3)</enum><text>States receive
			 money from the Federal Government through grants, loans, loan guarantees,
			 property, cooperative agreements, interest subsidies, insurance, food
			 commodities, and direct appropriations, among others means.</text>
				</paragraph><paragraph id="H43490558AD3D4E2E87FF2CC52F71763B"><enum>(4)</enum><text>Every State spends
			 money for common activities such as health care, transportation, housing,
			 education, agriculture and other issues, yet some States are more effective
			 than others when spending these Federal taxpayer dollars.</text>
				</paragraph><paragraph id="HEBBD69BDB28C47419587405B8FAC39D0"><enum>(5)</enum><text>Taxpayers,
			 legislators, and agencies should be able to objectively and reliably share data
			 comparing apples-to-apples performance measurements that identify what
			 government does and what it really costs.</text>
				</paragraph><paragraph id="H07D658B74CA949B59B6FDE3C1C64EC17"><enum>(6)</enum><text>Activity-based
			 total accountability will show which States are the most effective with
			 taxpayer dollars and lead to competition among States.</text>
				</paragraph><paragraph id="HDB72933B05DF499EAB7771DCD1BD2458"><enum>(7)</enum><text>States
			 demonstrating that they are more efficient with tax dollars by having lower
			 activity costs will serve as models for others to ensure that there is more
			 accountability for how tax dollars are spent and to ensure that the taxpayer is
			 getting the best value for their dollar.</text>
				</paragraph></subsection><subsection id="H8FBF34F177D24182B3E84B544F6DF673"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to improve the
			 policymaking process and government accountability at the State level by
			 requiring annual accountings from State governments in a format that uses total
			 accountability measures, including unit-cost data.</text>
			</subsection></section><section id="H502F57B67C804CCBA784762D7C60FB1E"><enum>3.</enum><header>State fiscal
			 accounting reports</header>
			<subsection id="H540DDCE4DC1545D29318C2B9DD507A11"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 15
			 days before the end of a Federal fiscal year, each State government that
			 receives Federal financial assistance in that Federal fiscal year shall submit
			 a State fiscal accounting report for the Federal fiscal year to the Director of
			 the Office of Management and Budget (hereinafter in this Act referred to as the
			 <quote>Director</quote>).</text>
			</subsection><subsection id="HA8E2977CC3F94E70B7A631AA00EF8F56"><enum>(b)</enum><header>Contents of
			 report</header><text display-inline="yes-display-inline">Each State fiscal
			 accounting report shall include—</text>
				<paragraph id="H1E4001D41951485F859E5B0A8CC7638D"><enum>(1)</enum><text>a
			 one-page summary that lists the total funding and expenditures of each budget
			 entity of the State government; and</text>
				</paragraph><paragraph id="H8DF63B06484B49F5ABDD335B8F572675"><enum>(2)</enum><text display-inline="yes-display-inline">for each budget entity of the State
			 government, a unit-cost summary for the Federal fiscal year.</text>
				</paragraph></subsection><subsection id="H013F48C68CBA4AF58DA411D538857EF6"><enum>(c)</enum><header>Publication of
			 reports</header><text>The Director shall publish each report received under
			 this section on an Internet Web site of the Director not later than 30 days
			 after receiving that report.</text>
			</subsection></section><section id="HAD97DBA36B28453CBD848DB252766B9B"><enum>4.</enum><header>Standardization
			 of State fiscal accounting reports</header>
			<subsection id="H223CDB8CB116453FB24673B2EC0400E5"><enum>(a)</enum><header>Standardization
			 of reports</header><text>The Director shall ensure that each State fiscal
			 accounting report is in such standardized form as the Director may prescribe.
			 Such form shall permit the comparison of the information contained in a State
			 fiscal accounting report with the information contained in every other State
			 fiscal accounting report.</text>
			</subsection><subsection id="H3D9966C8A7E04A66B4632450D4D8A905"><enum>(b)</enum><header>Initial
			 reports</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, each State government that is
			 required to submit a report under section 3 shall submit to the Director a
			 description of the programs and other activities carried out by each budget
			 entity of that State government over that fiscal year, including such
			 information on those programs or activities as the Director may require.</text>
			</subsection><subsection commented="no" id="HDB039BB57E53460F92991131F6808A2A"><enum>(c)</enum><header>Classification
			 system</header><text display-inline="yes-display-inline">Based on the
			 descriptions submitted under subsection (b) and on what the Director determines
			 to be the most relevant data available (including data from the most recent
			 census), the Director shall by rule do the following:</text>
				<paragraph commented="no" id="H929EB0841EBF4973A9DFFAA22780FED2"><enum>(1)</enum><text display-inline="yes-display-inline">Establish a uniform system for classifying
			 such programs and activities within categories (hereinafter in this Act
			 referred to as <quote>agency activities</quote>) identified by the
			 Director.</text>
				</paragraph><paragraph commented="no" id="HAE8A595243CC4DC58F1BCB07190F2F6A"><enum>(2)</enum><text display-inline="yes-display-inline">For each agency activity, identify conduct
			 (hereinafter in this Act referred to as an <quote>activity unit</quote>) that,
			 in the determination of the Director, constitutes a completed instance of such
			 agency activity.</text>
				</paragraph><paragraph commented="no" id="H81E79A89F51E4C8AB6003882ADD81921"><enum>(3)</enum><text>For each agency
			 activity, identify, to the extent practicable, performance measures for that
			 agency activity, and, in publishing a report under section 3(c), link
			 electronically such performance measures to that agency activity.</text>
				</paragraph></subsection></section><section id="HF10CE3B7307C400F8DD1197365D7D0D7"><enum>5.</enum><header>Unit-cost
			 summary</header><text display-inline="no-display-inline">Each unit-cost summary
			 for a budget entity of a State government shall be in such form as the Director
			 may prescribe, be one page long, and include the following:</text>
			<paragraph id="H5DD03FD5EF0544ADA36AB581BBFF4A6E"><enum>(1)</enum><text>A
			 statement of funds available, as described under section 6.</text>
			</paragraph><paragraph id="HD921874CE7A2432DA0670D0812D3CC9C"><enum>(2)</enum><text display-inline="yes-display-inline">For each agency activity that the budget
			 entity began, attempted, continued, or completed, a line-item listing as
			 described under section 7.</text>
			</paragraph><paragraph id="H469CE742E9F24B14A858837F924A097D"><enum>(3)</enum><text display-inline="yes-display-inline">A reconciliation of funds available with
			 adjusted expenditures as described under section 8.</text>
			</paragraph></section><section id="HDF06F873E895436B9FBE4C784657A55B"><enum>6.</enum><header>Statement of
			 funds available</header>
			<subsection id="H194929B2E9AD453E86B94D40516BA767"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A statement of funds
			 available shall identify—</text>
				<paragraph id="H29E90595B792430B8535435E7BF7BCD2"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with subsection (b), each
			 source of funds available for expenditure or obligation by the budget entity
			 and the amount of such funds; and</text>
				</paragraph><paragraph id="H32C164DBC99B4F588ADB4BB94D7B3CCE"><enum>(2)</enum><text>the sum of all
			 amounts identified under paragraph (1).</text>
				</paragraph></subsection><subsection id="H12C87E6E13AE4B4DA151D91B1E9B6E5C"><enum>(b)</enum><header>Identification
			 of sources</header><text display-inline="yes-display-inline">In identifying the
			 sources of funds available for expenditure or obligation by the budget entity,
			 the budget entity shall include the following:</text>
				<paragraph id="H7A7BD5BB1A4C401EA78AA29512A85D65"><enum>(1)</enum><text>All funds made
			 available by State appropriations laws.</text>
				</paragraph><paragraph id="H1690B00F991B4A2BA93CE958505D8659"><enum>(2)</enum><text display-inline="yes-display-inline">Any Federal financial assistance provided
			 by a Federal department or agency.</text>
				</paragraph><paragraph id="H730883BA4BE24AB09AD76E5C2EE53CFD"><enum>(3)</enum><text>Any other sources
			 the Director determines appropriate.</text>
				</paragraph></subsection></section><section id="H4855A979A58F48D28BE294C8909AE084"><enum>7.</enum><header>Agency activity
			 line item listings</header>
			<subsection commented="no" id="HB6C79CFEFB5442ABACAACE8C1B786E50"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A line item listing
			 for an agency activity shall—</text>
				<paragraph commented="no" id="H5982E24546264C84B4B0F849EB02CF23"><enum>(1)</enum><text>identify—</text>
					<subparagraph commented="no" id="H04548EF432364FB38E4F159D9B8B405F"><enum>(A)</enum><text display-inline="yes-display-inline">the agency activity;</text>
					</subparagraph><subparagraph commented="no" id="H11C8782478944F87921B221332597E41"><enum>(B)</enum><text>in accordance with
			 subsection (b), the total amount of funds that the budget entity expended in
			 carrying out the agency activity;</text>
					</subparagraph><subparagraph commented="no" id="HCC74E2AAEE6C461BA82356F1916FBAD0"><enum>(C)</enum><text>the number of
			 activity units of the agency activity the budget entity began, attempted,
			 continued, or completed; and</text>
					</subparagraph><subparagraph commented="no" id="H1088AC64FABB4D77B2DFF37B88FB66F1"><enum>(D)</enum><text>the unit-cost of
			 the agency activity, determined in accordance with subsection (c); and</text>
					</subparagraph></paragraph><paragraph commented="no" id="HF1931C6D1BC6428A836A47F861346FB7"><enum>(2)</enum><text>describe as many
			 of the following as are relevant to the agency activity:</text>
					<subparagraph commented="no" id="HA996A5828F2B40559A0A4CFC955B7130"><enum>(A)</enum><text>What conduct
			 constitutes an activity unit.</text>
					</subparagraph><subparagraph commented="no" id="H9A00E05DFF4E493BA65B01EE7F05BD30"><enum>(B)</enum><text>Each purpose for
			 which the budget entity engaged in that agency activity.</text>
					</subparagraph><subparagraph commented="no" id="H085A15E2786142D594EE075ED3BBA353"><enum>(C)</enum><text>Each person that
			 is an intended beneficiary of that agency activity.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H6B0F820EFFA640928ED2FEF6E50FA416"><enum>(b)</enum><header>Special rules
			 for determination of expenditures</header>
				<paragraph id="HFE66DA9F19D845A7AF999530E3CDDD98"><enum>(1)</enum><header>Allocation of
			 expenditures for certain agency activities</header><text>If the Director
			 determines that there is an agency activity for which no method of measuring
			 the accomplishment of the agency activity exists, an expenditure for that
			 agency activity must be consistently allocated to what is, in the determination
			 of the Director, a sufficiently similar agency activity for which such a method
			 exists.</text>
				</paragraph><paragraph id="H62DE04BEA9804852AE48F940554D2D47"><enum>(2)</enum><header>Payments to
			 contractors or subordinate entities included</header><text>An identification of
			 the total amount of funds that a budget entity expended shall include any
			 amounts paid to a contractor or subordinate entity.</text>
				</paragraph></subsection><subsection id="H3A4329C1CA7040AAA75438F103C5E490"><enum>(c)</enum><header>Determination of
			 unit-Cost</header>
				<paragraph id="HC7ACC9801276457590C99366C59DBDBE"><enum>(1)</enum><header>In
			 general</header><text>The unit-cost of an agency activity shall be determined
			 in accordance with the following formula:</text>

			 terms in formula</header><text display-inline="yes-display-inline">For purposes
			 of the formula in paragraph (1)—</text>
					<subparagraph id="HF7E553BC09A7465F888D6AB6BB4205A6"><enum>(A)</enum><text>UC is the
			 unit-cost of the agency activity;</text>
					</subparagraph><subparagraph id="H12D8870BEE3946AE8904E6DE6B174FD5"><enum>(B)</enum><text display-inline="yes-display-inline">µ is the amount described in subsection
			 (a)(1)(B); and</text>
					</subparagraph><subparagraph id="H1A62322DD32A4BEE8FA2872683AC54A1"><enum>(C)</enum><text display-inline="yes-display-inline">φ is the number described in subsection
			 (a)(1)(C).</text>
					</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H93D22185118A4FBD8B56143EB4B3E251"><enum>8.</enum><header>Reconciliation of
			 funds available with adjusted expenditures</header>
			<subsection id="H09334DC7BEB74DBA8558F2C0A29092EE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A reconciliation of
			 funds available with adjusted expenditures shall—</text>
				<paragraph id="H7C58EED4F2C849459E462B807481D94D"><enum>(1)</enum><text>identify the
			 adjusted expenditures of the budget entity; and</text>
				</paragraph><paragraph id="HE15643BE0BF04F70894B7C6585B03726"><enum>(2)</enum><text>explain any
			 difference between the adjusted expenditures and the sum of all funds available
			 for expenditure or obligation by the budget entity (determined in accordance
			 with section 6).</text>
				</paragraph></subsection><subsection id="H9894C70C10BD407586CACD0AA72ECF12"><enum>(b)</enum><header>Determination of
			 adjusted expenditures</header>
				<paragraph id="HB21916F8AED246948305F5CDB8903715"><enum>(1)</enum><header>In
			 general</header><text>The adjusted expenditures of the budget entity shall be
			 determined in accordance with the following formula:</text>

			 terms in formula</header><text>For purposes of the formula in paragraph
			 (1)—</text>
					<subparagraph id="HDBAFC4C2C8B94C9A954C35271F2712BB"><enum>(A)</enum><text display-inline="yes-display-inline">AE is the adjusted expenditures;</text>
					</subparagraph><subparagraph id="HDB6B84CAFE7445D98DED5125B6370924"><enum>(B)</enum><text>EXP is the sum of
			 all expenditures by the budget entity for agency activities;</text>
					</subparagraph><subparagraph id="HC1413BC7E582412AA5CE50CD3F3947AF"><enum>(C)</enum><text display-inline="yes-display-inline">PT is the sum of all pass-throughs
			 identified by the budget entity under subsection (c); and</text>
					</subparagraph><subparagraph id="HE12DD4099303461C8C35C5791C31AE36"><enum>(D)</enum><text display-inline="yes-display-inline">REV is the sum of all reversions identified
			 by the budget entity under subsection (c).</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H498A70BD4C8546B995B579FB93F63EB8"><enum>(c)</enum><header>Identification
			 of Pass-Throughs and Reversions</header><text display-inline="yes-display-inline">A budget entity may identify an amount as a
			 pass-through or a reversion if the amount satisfies criteria established by the
			 Director.</text>
			</subsection></section><section id="H0676A9D3E3DF4865929018F1684AE45F"><enum>9.</enum><header>Noncompliance</header><text display-inline="no-display-inline">If the Director determines that a State
			 government has failed, with respect to a Federal fiscal year, to file a
			 sufficient and timely State fiscal accounting report under this Act, the
			 Director shall so inform the head of each Federal department or agency. Each
			 such head shall withhold 10 percent of any Federal financial assistance
			 provided to the State government for the next Federal fiscal year.</text>
		</section><section id="H1AC9C4A7F3734A0593A9FE6600549FF3"><enum>10.</enum><header>Rules</header><text display-inline="no-display-inline">The Director is authorized to make such
			 rules as may be necessary to carry out this Act.</text>
		</section><section id="H5DF3E0C4927A4298A42D024E71EE51C8"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H6BB8979479EB41D3879FC66634C2C84F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>State government</term>
			 means the government of each of the several States, the District of Columbia,
			 and any commonwealth, territory, or possession of the United States.</text>
			</paragraph><paragraph id="H0E0A807FC0914A75B51EC18016EBA770"><enum>(2)</enum><text>The term
			 <term>budget entity</term> means a State agency or the State judiciary.</text>
			</paragraph><paragraph id="HAACE149C3C404378B3D5E5CCAE3AC324"><enum>(3)</enum><text>The term
			 <term>agency activity</term> means major operational activities carried out by
			 a budget entity.</text>
			</paragraph><paragraph id="HDFC113C4C24647B896C5AD4FC45BACB4"><enum>(4)</enum><text>The term
			 <term>Federal financial assistance</term> has the meaning given such term in
			 section 7501 of title 31, United States Code, and also includes any other
			 amounts that the Director determines appropriate.</text>
