		<official-title display="yes">To return unused or reclaimed funds made
		  available for broadband awards in the American Recovery and Reinvestment Act of
		  2009 to the Treasury of the United States.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HE0DB6570F9A045B18D76998143187033" style="OLC">
		<section id="HC696724603E4427CAD93801BABAD2AE0" section-type="section-one"><enum>1.</enum><header>Accountability for broadband
			 stimulus funds</header>
			<subsection id="HD35055B5CAA8428B9FE0329E82391B28"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Administrator of the Rural Utilities Service or the
			 Assistant Secretary of Commerce for Communications and Information shall take
			 prompt and appropriate action to terminate for cause any award made under the
			 Broadband Initiatives Program or the Broadband Technology Opportunities
			 Program, respectively, established pursuant to the American Recovery and
			 Reinvestment Act of 2009, if the Administrator or Assistant Secretary
			 determines that cause exists to terminate the award. Such cause may include an
			 insufficient level of performance, wasteful spending, or fraudulent
			 spending.</text>
			</subsection><subsection id="HA68CAD8694C6431186F9542DEB4B43B6"><enum>(b)</enum><header>Deobligation and
			 return of funds to Treasury</header>
				<paragraph id="HE7E5B5B169284B20B385B270A5EDEA2E"><enum>(1)</enum><header>Deobligation</header><text display-inline="yes-display-inline">Upon terminating an award under subsection
			 (a), the Administrator or the Assistant Secretary shall immediately deobligate
			 an amount equivalent to such award, less allowable costs, to the extent funds
			 with respect to such award are available in the account relating to the
			 Broadband Initiatives Program or the Broadband Technology Opportunities
			 Program, respectively. If the Administrator or the Assistant Secretary
			 subsequently recovers any additional amounts from such award, the Administrator
			 or the Assistant Secretary shall deobligate such additional amounts immediately
			 upon receipt.</text>
				</paragraph><paragraph id="HB2936CD3225B48F8BD537C03BE7E7568"><enum>(2)</enum><header>Return to
			 Treasury</header><text display-inline="yes-display-inline">Not later than 30
			 days after deobligating an amount under paragraph (1), the Administrator or the
			 Assistant Secretary shall, without exception, return such amount to the general
			 fund of the Treasury of the United States.</text>
				</paragraph><paragraph id="H96484739E87E4E6BB7B21E269BE1E18B"><enum>(3)</enum><header>No expenditures
			 during termination process</header><text>The Administrator or the Assistant
			 Secretary shall promptly pursue available corrective measures to ensure that
			 funds received through an award terminated under subsection (a) are not
			 expended during the termination process.</text>
				</paragraph><paragraph id="H109CBFF028074C828986506D3310EA38"><enum>(4)</enum><header>Accounting by
			 award recipient</header><text>The Administrator or the Assistant Secretary
			 shall direct the recipient of an award terminated under subsection (a) to
			 provide to the Administrator or the Assistant Secretary a complete and accurate
			 accounting, which may include an independent accounting, for any award funds
			 that, as of the date of termination, the recipient has received but has not
			 expended on allowable costs.</text>
				</paragraph></subsection></section><section id="H1620556E6B294AA88E0EB59DE9AEEF53"><enum>2.</enum><header>Disposition of
			 unused funds</header><text display-inline="no-display-inline">The Administrator
			 of the Rural Utilities Service or the Assistant Secretary of Commerce for
			 Communications and Information shall return to the general fund of the Treasury
			 of the United States an amount equivalent to any award, less allowable costs,
			 made under the Broadband Initiatives Program or the Broadband Technology
			 Opportunities Program, respectively, established pursuant to the American
			 Recovery and Reinvestment Act of 2009, if such award has been returned to the
			 Administrator or Assistant Secretary or disclaimed by the award recipient at
			 any time after the date of enactment of such Act.</text>
		</section><section id="HB6300104538E44949E3CF13F5707D8CA"><enum>3.</enum><header>Oversight and
			 reporting requirements</header>
			<subsection id="H4801B997DB5240AE85586D1B54A80974"><enum>(a)</enum><header>Action on
			 information from OIG or GAO</header><text display-inline="yes-display-inline">If the Administrator of the Rural Utilities
			 Service or the Assistant Secretary of Commerce for Communications and
			 Information receives information from an official described in subsection (b)
			 with respect to an award made under the Broadband Initiatives Program or the
			 Broadband Technology Opportunities Program, respectively, established pursuant
			 to the American Recovery and Reinvestment Act of 2009, and such information
			 pertains to material noncompliance with the award terms or provisions or
			 improper usage of award funds, the Administrator or the Assistant Secretary
			 shall—</text>
				<paragraph id="H0FDAE53EFD7E4682985D4A4B2C6918AA"><enum>(1)</enum><text>immediately review
			 such information; and</text>
				</paragraph><paragraph id="H4DD334C0698D429BBFE151887D838B21"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after receiving such
			 information, determine whether cause exists to terminate such award under
			 section 1(a), unless the official who provided such information recommends that
			 the Administrator or the Assistant Secretary limit or not make such a
			 determination.</text>
				</paragraph></subsection><subsection id="HD2F2C0A7E19A4300913885D79F1FD6A1"><enum>(b)</enum><header>Officials
			 described</header><text display-inline="yes-display-inline">The officials
			 described in this subsection are the following:</text>
				<paragraph id="H707C09C845C54E7FAE505FD9D0FB02C0"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to the Broadband Initiatives
			 Program, the Inspector General of the Department of Agriculture.</text>
				</paragraph><paragraph id="H7E2335CC79D04DDF9D9A99DFA5542311"><enum>(2)</enum><text>With respect to
			 the Broadband Technology Opportunities Program, the Inspector General of the
			 Department of Commerce.</text>
				</paragraph><paragraph id="HCDD2E036EA844D3BBB894593EB56C692"><enum>(3)</enum><text>The Comptroller
			 General of the United States.</text>
				</paragraph></subsection><subsection id="H568E9932D458458CAA9994F2D0A1165F"><enum>(c)</enum><header>Congressional
			 notification</header>
				<paragraph id="HFB3E26BEADFD4C50AEF7B1C08017C62C"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 days after making a determination
			 described in subsection (a)(2), the Administrator or the Assistant Secretary
			 shall provide a notification of such determination to—</text>
					<subparagraph id="H8D6A11454BA248949697983A02C4C734"><enum>(A)</enum><text>the Committee on
			 Agriculture of the House of Representatives and the Committee on Agriculture of
			 the Senate or the Committee on Energy and Commerce of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation of
			 the Senate, respectively; and</text>
					</subparagraph><subparagraph id="H9176ECDEBBFD45AFA31F303BAFB82DC7"><enum>(B)</enum><text>the official who
			 provided the information described in subsection (a).</text>
					</subparagraph></paragraph><paragraph id="HD8C7CBF810E5435FA23552499BA11321"><enum>(2)</enum><header>Contents of
			 notification</header><text>The notification required by paragraph (1) shall
			 include an explanation of—</text>
					<subparagraph id="H1C4D5E6E596747F8A9C591BA4BC81197"><enum>(A)</enum><text>the determination
			 described in subsection (a)(2); and</text>
					</subparagraph><subparagraph id="HB2D5B7291DB3420A8377F761FA8FED81"><enum>(B)</enum><text>any action taken
			 as a result of the determination or why no action was necessary.</text>
					</subparagraph></paragraph><paragraph id="H3B044F475D974EDEA558DEECE21D3710"><enum>(3)</enum><header>Confidential
			 notification under certain circumstances</header><text display-inline="yes-display-inline">In the case of a determination by the
			 Administrator or the Assistant Secretary under subsection (a)(2) that cause
			 does not exist to terminate the award, the Administrator or the Assistant
			 Secretary may make the congressional notification required by paragraph (1)(A)
			 on a confidential basis, if the Administrator or the Assistant Secretary
			 determines, after consultation with the official who provided the information
			 described in subsection (a), that—</text>
					<subparagraph id="H7454676096E240A18F8B1E8BDBFC48D7"><enum>(A)</enum><text>there is no merit
			 to such information; and</text>
					</subparagraph><subparagraph id="H18B101B07C024C19B661C32929CEB187"><enum>(B)</enum><text>notification on a
			 public basis would cause irreparable harm to any person the information is
			 regarding.</text>
					</subparagraph></paragraph></subsection></section><section id="H4596790C1A86481FB03BF840775A28AC"><enum>4.</enum><header>Conforming
			 amendments</header><text display-inline="no-display-inline">Section 6001(i)(4)
			 of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/47/1305">47 U.S.C. 1305(i)(4)</external-xref>) is
			 amended—</text>
			<paragraph id="H9C50F2EB01DF4145B2FAA641120D348D"><enum>(1)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
			</paragraph><paragraph id="HB172319A83884DD4A58F2E3EB4CF14C3"><enum>(2)</enum><text>by striking
			 <quote>, and award these funds competitively to new or existing applicants
			 consistent with this section</quote>.</text>
			</paragraph></section><section id="H55E2848FE7574EF1A9943724CE4830D2"><enum>5.</enum><header>Award
			 defined</header><text display-inline="no-display-inline">In this Act, the term
			 <term>award</term> includes grants and loans.</text>
