		<section id="H4BA436EFB1F54ADDAE6F42DC06114405" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gulf Coast Economic and Tourism
			 Restoration Act</short-title></quote>.</text>
		</section><section commented="no" id="HAB38779ADC394BA3A62965242007ECBF"><enum>2.</enum><header>Gulf Coast
			 Economic Restoration Fund</header>
			<subsection commented="no" id="HDA3994A7BF9641EF8FDA8417C517753C"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 Gulf Coast Economic Restoration Fund.</text>
			</subsection><subsection commented="no" id="H3CB4BE20DA3343A6B3A49B091A34C2D2"><enum>(b)</enum><header>Transfers to
			 Fund</header><text>Notwithstanding any other provision of law, the Secretary of
			 the Treasury shall deposit into the Fund amounts equal to not less than 40
			 percent of any amounts collected by the United States before, on, or after the
			 date of the enactment of this Act as penalties, settlements, or fines under
			 sections 309 and 311 of the Federal Water Pollution Control Act (33 U.S.C.
			 1319, 1321) in relation to the Gulf oil spill.</text>
			</subsection><subsection commented="no" id="H63BE08EA049F41AE901D5FFDFEC1B5BD"><enum>(c)</enum><header>Authorized
			 Uses</header>
				<paragraph commented="no" id="HBDDD351DC33443E6A25BF41B999B95F4"><enum>(1)</enum><header>In
			 general</header><text>The Fund shall be available to the Task Force, as
			 provided in appropriations Acts, only for activities related to Gulf coast
			 economic development and tourism promotion.</text>
				</paragraph><paragraph commented="no" id="H5AF891D3C7874B08ACB2CBB5B02627C8"><enum>(2)</enum><header>Grants to
			 States</header>
					<subparagraph commented="no" id="H54A962E565C244D99C9B9FB962FC349A"><enum>(A)</enum><header>In
			 general</header><text>The Task Force shall distribute the amounts made
			 available for expenditure from the Fund to the Gulf States to be used in
			 accordance with this subsection.</text>
					</subparagraph><subparagraph commented="no" id="H953BDCD415334053A4041A2FD840592D"><enum>(B)</enum><header>Allocation among
			 States</header><text>The Task Force shall allocate the amounts to be
			 distributed to each Gulf State under this paragraph such that no single Gulf
			 State receives less than 5 percent, nor more than 30 percent, of the available
			 amounts.</text>
					</subparagraph><subparagraph commented="no" id="H272A4631BB4848309896C27C2D96544D"><enum>(C)</enum><header>Allocation
			 within States</header><text>The Governor of each Gulf State shall allocate
			 amounts distributed to the State as follows:</text>
						<clause commented="no" id="HBABF6F2A908E42D19F38F99C73708EE6"><enum>(i)</enum><text>Not more than 25
			 percent of such amounts may be used by the Governor for statewide economic
			 development and tourism promotion activities.</text>
						</clause><clause commented="no" id="H46BE9D63E03140B4B961C18A4E0CDE27"><enum>(ii)</enum><text display-inline="yes-display-inline">Not less than 75 percent of such amounts
			 shall be distributed to local governments in counties directly affected by the
			 Gulf oil spill for local economic development and tourism promotion
			 activities.</text>
						</clause></subparagraph></paragraph></subsection></section><section commented="no" id="HBAE62752B9554DD3862AEF848CB72EC4"><enum>3.</enum><header>Gulf Coast
			 Economic Restoration Task Force</header>
			<subsection commented="no" id="H69039F26BA9446A2A4F152D419188CF1"><enum>(a)</enum><header>Establishment</header><text>There
			 is established the Gulf Coast Economic Restoration Task Force.</text>
			</subsection><subsection commented="no" id="HA21B4DC9D8914CBEB3611372A968B518"><enum>(b)</enum><header>Membership</header><text>The
			 Task Force shall consist of the following members, or in the case of a Federal
			 agency, a designee at the level of Assistant Secretary or the
			 equivalent:</text>
				<paragraph commented="no" id="HF7B0D9C7EC81416FBD02B042AD753267"><enum>(1)</enum><text>The Secretary of
			 the Interior.</text>
				</paragraph><paragraph commented="no" id="HD2660BEE0DBE4F659AB9B9C536657F77"><enum>(2)</enum><text>The Secretary of
			 Commerce.</text>
				</paragraph><paragraph commented="no" id="HD7732128C6F346FC86D712F7E1102624"><enum>(3)</enum><text>The Secretary of
			 the Army.</text>
				</paragraph><paragraph commented="no" id="H54B5F57E09724654A95E1D7891002335"><enum>(4)</enum><text>The Attorney
			 General.</text>
				</paragraph><paragraph commented="no" id="HD1562430686640259FBEAF38D28AD1FD"><enum>(5)</enum><text>The Secretary of
			 Homeland Security.</text>
				</paragraph><paragraph commented="no" id="H8F6087FD26C44E3C942AA811454216D3"><enum>(6)</enum><text>The Administrator
			 of the Environmental Protection Agency.</text>
				</paragraph><paragraph commented="no" id="HE2112AA57B974B9089797B79B880A4B1"><enum>(7)</enum><text>The Commandant of
			 the Coast Guard.</text>
				</paragraph><paragraph commented="no" id="H63A03F495B294EB8B8223B8192FFBA9B"><enum>(8)</enum><text>The Secretary of
			 Transportation.</text>
				</paragraph><paragraph commented="no" id="H01A3C1D0E9E8425DAFE98BDBCAAE6835"><enum>(9)</enum><text>The Secretary of
			 Agriculture.</text>
				</paragraph><paragraph id="H536D1C203E6E42BEA1F45916680D09CF"><enum>(10)</enum><text>The Secretary of
			 the Navy.</text>
				</paragraph><paragraph commented="no" id="H7C1631AC3AC0481E9E49CE969ED79D68"><enum>(11)</enum><text>Two
			 representatives of each of the Gulf States, appointed by the Governor of each
			 such State.</text>
				</paragraph><paragraph commented="no" id="H41CEFBFEF69E4623A88940EEE09A9A82"><enum>(12)</enum><text>Two
			 representatives, from within each of the Gulf States, of local governments
			 having jurisdiction over areas directly affected by the Gulf oil spill,
			 appointed by the Governor of each State, respectively.</text>
				</paragraph></subsection><subsection commented="no" id="H232A7A6142714ECF98D93AAB85BF0DAB"><enum>(c)</enum><header>Duties</header><text>The
			 Task Force shall administer the Fund in accordance with section 2.</text>
			</subsection></section><section commented="no" id="H25597246FA1C49419D73B4BDCEC66B03"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 180 days after receiving
			 funds under section 2, the Governor of each Gulf State shall submit to Congress
			 a report describing the use of such funds.</text>
		</section><section id="H6077F9047BCF42298613BD5DF935943E" section-type="subsequent-section"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="HBE5B39F9B77C4BC5AAC46FA47CAC4408"><enum>(1)</enum><header>Fund</header><text display-inline="yes-display-inline">The term <quote>Fund</quote> means the Gulf
			 Coast Economic Restoration Fund established by section 2(a).</text>
			</paragraph><paragraph id="HF6AA637D92B84BB8AD62C7943BE2A538"><enum>(2)</enum><header>Task
			 Force</header><text display-inline="yes-display-inline">The term <quote>Task
			 Force</quote> means the Gulf Coast Economic Restoration Task Force established
			 by section 3(a).</text>
			</paragraph><paragraph id="HE4BD49E5DADF4C85B8F9F254FFDCD3DF"><enum>(3)</enum><header>Gulf
			 States</header><text>The term <quote>Gulf States</quote> means the States of
			 Alabama, Florida, Louisiana, Mississippi, and Texas.</text>
			</paragraph><paragraph id="H4D067B3E1E1A4603BF813AE1815BA996"><enum>(4)</enum><header>Gulf Oil
			 Spill</header><text>The term <quote>Gulf oil spill</quote> means the oil spill
			 in the Gulf of Mexico caused by the mobile offshore drilling unit Deepwater
			 Horizon that began on April 20, 2010.</text>
