		<official-title>To amend title XVIII of the Social Security Act to
		  provide for coverage of qualified acupuncturist services under part B of the
		  Medicare Program, and to amend title 5, United States Code, to provide for
		  coverage of such services under the Federal Employees Health Benefits

		<section display-inline="no-display-inline" id="H23B4EA08572D4CADA572B2A8F7721F2C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Acupuncture Coverage Act of
			 2011</short-title></quote>.</text>
		</section><section id="H89DF37A2048740A4B990BCF3B5841DC2"><enum>2.</enum><header>Coverage of
			 acupuncturist services under Medicare</header>
			<subsection id="HA63C98502E714EEAB480C6160171A3F9"><enum>(a)</enum><header>In
			 general</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x(s)(2)) is
			 amended—</text>
				<paragraph id="HB2C90B0B336648A9BA84B746EE7B4BA0"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (EE);</text>
				</paragraph><paragraph id="H103C348991784C4EA24F395BBEF62020"><enum>(2)</enum><text>by inserting
			 <quote>and</quote> at the end of subparagraph (FF); and</text>
				</paragraph><paragraph id="H0834DD2AD7DE430F8CEAB7EBC8485545"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>

						<subparagraph id="H339F3937F5764168A09AF5C569D04967" indent="up1"><enum>(GG)</enum><text>qualified acupuncturist services (as
				defined in subsection
				(iii));</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H034225A28087426C9EC3AB1EFEC6E20C"><enum>(b)</enum><header>Services
			 described</header><text>Section 1861 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x) is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block act-name="Social Security Act" id="HD9ACAF8E9B9041A38E32CC8586442715" other-style="archaic" style="other">
					<subsection id="H4CD1ACA69E3B455882EE1D69909313C3"><enum>(iii)</enum><header>Qualified acupuncturist services</header><paragraph commented="no" display-inline="yes-display-inline" id="HE4A0455626524519860107CB0334236D"><enum>(1)</enum><text>The term <term>qualified
				acupuncturist services</term> means such services furnished by a qualified
				acupuncturist (as defined in paragraph (2)) and such services and supplies
				furnished as an incident to services furnished by the qualified acupuncturist
				which the qualified acupuncturist is legally authorized to perform under State
				law (or the State regulatory mechanism provided by State law).</text>
						</paragraph><paragraph id="HE6415CDE202E47F5BF8DE10509D8EAE4" indent="up1"><enum>(2)</enum><text>The term <term>qualified
				acupuncturist</term> means an individual who has been certified, licensed, or
				registered as an acupuncturist by a State (or the State regulatory mechanism
				provided by State
				law).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H16B527A97D5F471389C54C8ACCBBBA84"><enum>(c)</enum><header>Payment
			 rules</header>
				<paragraph id="HC1A7B9ECA45544CBA270D23807B995E1"><enum>(1)</enum><header>Determination of
			 amount of payment</header><text>Section 1833(a)(1) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395l(a)(1)) is amended—</text>
					<subparagraph id="HE9D5226944CE453485D5D36C30958B91"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(Z)</quote>; and</text>
					</subparagraph><subparagraph id="HA7C1F4D1F7B44888BED5AB6E513B2035"><enum>(B)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (AA) with respect
			 to qualified acupuncturist services described in section 1861(s)(2)(GG)), the
			 amounts paid shall be the amount determined by a fee schedule established by
			 the Secretary for purposes of this clause (but in no event shall such amount
			 exceed the fee schedule amount provided under section 1848 for the same service
			 performed by a physician);</quote>.</text>
					</subparagraph></paragraph><paragraph id="H11F06EE381DF4BD386E7768FBDD3E2D4"><enum>(2)</enum><header>Separate payment
			 for services of institutional providers</header><text>Section 1833(a)(2)(B) of
			 such Act (42 U.S.C. 1395l(a)(2)(B)) is amended, in clauses (i) and (ii), by
			 inserting <quote>and in the case of qualified acupuncturist services furnished
			 at any time</quote> after <quote>1999,</quote> each place it appears.</text>
				</paragraph></subsection><subsection id="HA8A97AF7EDD4430B817CE12F6B808160"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to services
			 furnished on or after January 1, 2012.</text>
			</subsection></section><section id="H9072D21C9E734D619DCB569D61C63AC2"><enum>3.</enum><header>Coverage of
			 acupuncturist services under Federal employees health benefit plans</header>
			<subsection id="H40E6298184D848FD88C53970AFD0C515"><enum>(a)</enum><header>In
			 general</header><text>Section 8902(k)(1) of title 5, United States Code, is
			 amended by inserting <quote>acupuncturist,</quote> after <quote>nurse
			 midwife,</quote> each place it appears.</text>
			</subsection><subsection id="H27E5B3067EAE4A029D2F63B2057BB5D0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) applies with respect to
			 services provided on or after January 1, 2012.</text>
