<section id="HE5A6707371C241E4BD3469C748495E90"><enum>101.</enum><header>Provision of taxpayer receipt</header> 
<subsection display-inline="no-display-inline" id="HF7186A8BE9444F5BB41365207D4E9036"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 77 of the Internal Revenue Code of 1986 (relating to miscellaneous provisions) is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H4928220673F9408AB9AEA95055A8ABDD" style="OLC"> 
<section id="H18282414A7A7447BA4BE71BF3EF434DE"><enum>7529.</enum><header>Taxpayer receipt</header> 
<subsection id="H7DED090A69BA441C9C26BF8137B689F5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than October 15, 2012, and annually thereafter, the Secretary shall provide via United States mail a Tax Receipt to each taxpayer (other than a trust, estate, partnership, or corporation) who made a return with respect to income taxes under chapter 1 for the preceding taxable year and for whom a current mailing address can be determined through such methods as the Secretary determines to be appropriate.</text> </subsection> 
<subsection id="HAB130010B7B2421481D3FE9C18B0B166"><enum>(b)</enum><header>Tax Receipt</header><text display-inline="yes-display-inline">For purposes of this section, each Tax Receipt shall—</text> 
<paragraph id="H4D3CECEB55DF4B3084A3FC40409F7177"><enum>(1)</enum><text>state the amount of taxes paid (even if $0) and refund made to the taxpayer and state (by each filing status specified in subsections (a) through (d) of section 1) the average amount of tax paid by taxpayers in each tax bracket, and</text> </paragraph> 
<paragraph id="H3D6761639F4E43EFB7521E453D0E453C"><enum>(2)</enum><text>contain a table listing—</text> 
<subparagraph id="H87CEF68723044D328485472ABB57AD9B"><enum>(A)</enum><text>each of the spending categories described in <internal-xref idref="H76455B366DBE456E8234400B814A351B" legis-path="7529.(c)">subsection (c)</internal-xref>,</text> </subparagraph> 
<subparagraph id="HA8AAE0849B2E4B6FB2BCEB028AE568F3"><enum>(B)</enum><text>with respect to each spending category described in <internal-xref idref="H76455B366DBE456E8234400B814A351B" legis-path="7529.(c)">subsection (c)</internal-xref>—</text> 
<clause commented="no" id="HACE2B8320D2B48FB90D8DDE6816E94BD"><enum>(i)</enum><text display-inline="yes-display-inline">the ratio (expressed as a percentage) which bears the same percentage of the taxpayer’s income tax liability for the preceding taxable year to such category as the ratio that such category bears to the total of the spending categories described in <internal-xref idref="H76455B366DBE456E8234400B814A351B" legis-path="7529.(c)">subsection (c) </internal-xref>for the fiscal year ending in the preceding taxable year, and</text> </clause> 
<clause id="H4217AD98C3AF4A9FBE40A45AC4FE0F3C"><enum>(ii)</enum><text display-inline="yes-display-inline">the proportional amount (expressed in dollars) of the taxpayer’s income tax liability spent on that category, and</text> </clause></subparagraph> 
<subparagraph id="H727C249EF723459EA1CD1E2AB32D6685"><enum>(C)</enum><text display-inline="yes-display-inline">the percentage change the results under clauses (i) and (ii) of subparagraph (B) are from the preceding year (expressed in positives and negatives),</text> </subparagraph></paragraph> 
<paragraph id="H4C688DD4252149A7B42156516F1E00CF"><enum>(3)</enum><text>contain a table listing—</text> 
<subparagraph id="HFEB9CD6C49F9469E9BFF5C71FDA83D06"><enum>(A)</enum><text>each of the spending categories described in <internal-xref idref="H76455B366DBE456E8234400B814A351B" legis-path="7529.(c)">subsection (c)</internal-xref>,</text> </subparagraph> 
<subparagraph id="HA3E9898EFF7145AD825259046B072275"><enum>(B)</enum><text>the percentage each such category is of the total Federal outlays for the fiscal year ending in the preceding taxable year and the dollar amount of each such category, and</text> </subparagraph> 
<subparagraph id="HC1A7DCF401CE4469B8BC9B060AF3241F"><enum>(C)</enum><text display-inline="yes-display-inline">the percentage change the results under subparagraph (B) are from the preceding year (expressed in positives and negatives),</text> </subparagraph></paragraph> 
<paragraph id="H6A0968CF8281487096935DC0B5626C06"><enum>(4)</enum><text display-inline="yes-display-inline">contain a table of the 10 most costly tax expenditures, and the cost of such expenditures, with respect to individuals (not corporations) for the fiscal year ending in the preceding taxable year,</text> </paragraph> 
<paragraph id="HDB0C9047B776415AA4ACF75E38F8162E"><enum>(5)</enum><text>contain the annual budget review described in <internal-xref idref="H16CAEAB4601640CFB48169481FF40B30" legis-path="7529.(e)">subsection (e)</internal-xref>,</text> </paragraph> 
<paragraph id="H6B270F50D8F447A491BDA5DFCD9638DF"><enum>(6)</enum><text display-inline="yes-display-inline">contain the graphs described in paragraphs (1) and (2) of section 7523(a) for the fiscal year ending in the preceding taxable year,</text> </paragraph> 
<paragraph id="H6AF61F042D3741B7B7BE49493CE0B0D5"><enum>(7)</enum><text>be not more than 4 pages in length, and</text> </paragraph> 
<paragraph id="HA93DBAC970A14CF8BE5BF17099392B5C"><enum>(8)</enum><text>contain the Internet address of the website of the Department of the Treasury described in <internal-xref idref="HF37BCC066D2F45A28F6DD516EC797D85" legis-path="7529.(f)">subsection (f)</internal-xref>.</text> </paragraph></subsection>

<subparagraph id="H33CA8B3DC6DC4BEFBB982DBA881C08B0"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1)—</text> 
<clause id="HED7F9ADA4E224A018E6B5301021004F6"><enum>(i)</enum><text>the spending categories shall be set forth in order of cost, with the greatest expense stated first, and</text> </clause> 
<clause id="H1BEA50289D764858A403B0AAC55BE564"><enum>(ii)</enum><text display-inline="yes-display-inline">each spending category shall have a one sentence, general description of the programs, projects, and activities comprising that spending category.</text> </clause></subparagraph> 
<subparagraph id="HCB0B73A0A4CE437C8659BD56A2918E54"><enum>(B)</enum><header>Programs, projects, and activities</header><text display-inline="yes-display-inline">The Secretary shall assign each Federal program, project, or activity to one of the categories described in <internal-xref idref="HF8F931A650FB4B6C9D7842468387FF99" legis-path="7529.(c)(1)">paragraph (1)</internal-xref>. Once assigned, the program, project, or activity cannot be moved to a different spending category in subsequent years. If a program, project, or activity changes in material substance, the Secretary may, in consultation with Congress, move the program, project, or activity to the appropriate spending category.</text> </subparagraph></paragraph></subsection> 
<subsection id="H8852E1DC82BE4F7593707272E9CB73DB"><enum>(d)</enum><header>Tax expenditures</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>tax expenditure</term> shall have the meaning given such term by section 3(3) of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/621">2 U.S.C. 621</external-xref>).</text> </subsection> 
<subsection id="H16CAEAB4601640CFB48169481FF40B30"><enum>(e)</enum><header>Annual Budget Review</header><text display-inline="yes-display-inline">The annual budget review described in this subsection with respect to a fiscal year shall be prepared by the Secretary in consultation with the Congressional Budget Office and shall—</text> 
<paragraph id="H22D8A95DD0DF420EBADE8C64A0684769"><enum>(1)</enum><text>use the budget projections prepared by the Congressional Budget Office, and</text> </paragraph> 
<paragraph id="H4C14EC487D1145E8B97ED91C18CB69CB"><enum>(2)</enum><text>include—</text> 
<subparagraph id="H3B14C562EA6841D3991CC7EBC279A722"><enum>(A)</enum><text>an estimate of total Federal receipts and outlays for the current fiscal year,</text> </subparagraph> 
<subparagraph id="HC62C0C375670441AAA79DED05220D64A"><enum>(B)</enum><text>actual Federal receipts and outlays for the preceding 5 fiscal years, and</text> </subparagraph> 
<subparagraph id="H3CF6E8B357794DC481A9FBB11C4EB2B2"><enum>(C)</enum><text>projections of Federal receipts and outlays for the succeeding 10 fiscal years.</text> </subparagraph></paragraph></subsection> 
<subsection id="H4F0157A5C9AE43E0BD85A5B238F93CAA"><enum>(f)</enum><header>Rule relating to nonresident aliens</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to an individual who is a nonresident alien (within the meaning of section 7701(b)(1)(B)).</text> </subsection> 
<subsection id="HF37BCC066D2F45A28F6DD516EC797D85"><enum>(g)</enum><header>Website</header> 
<paragraph id="HD9C79FB030B44985A37F2888A122FF8C"><enum>(1)</enum><header>In general</header><text>The website referred to in this subsection is a website on which a taxpayer can input his Federal income tax liability and see more detailed information concerning each of the categories contained in his Tax Receipt.</text> </paragraph> 
<paragraph id="H645F6A0FBA7941A8939363AC6CFA69B3"><enum>(2)</enum><header>Period for maintaining Tax Receipts</header><text>The website shall maintain a copy of the receipt for each taxpayer for the previous 5 years.</text> </paragraph> 
<paragraph id="H59C4780F25D54704B25997ED2F5139FF"><enum>(3)</enum><header>Protection of taxpayer information</header><text display-inline="yes-display-inline">In making information available on a website pursuant to this section, the Secretary shall ensure proper access to online taxpayer records and shall protect the security and privacy of taxpayer information online.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<paragraph id="H8177D744B781417D84B8706C8258F57E"><enum>(4)</enum><text>retiree health benefits; and</text> </paragraph> 
<paragraph id="H7EF3E8F742AA4882AF552EC682C21E02"><enum>(5)</enum><text>other budget items where accrual-based accounting would feasibly capture significant future cash resource requirements that are not reflected in the cash-based budget; where appropriate and reasonable.</text> </paragraph></subsection> 
<subsection id="H31186334F6D540839A1A78A72F302748"><enum>(b)</enum><header>Report</header><text>Within one year of the date of enactment of this Act, the Director of the Office of Management and Budget shall submit a report to Congress setting forth the legislation necessary for the implementation of an accrual-based accounting system for part of the budget, along with any recommendations regarding its proposed legislation.</text> </subsection></section></subtitle></title>

<subtitle id="HC77151098E534EDDA55CBF072EAFF41F"><enum>A</enum><header>Reform of the President’s Budget</header> 
<section id="H5FA9C8A3345F40B5B29F2A7D10FFC61F"><enum>401.</enum><header>Long-term fiscal responsibility</header><text display-inline="no-display-inline">Section 1105 of title 31, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H06F0F8929D7249ACA42293C4960260B0"><enum>(i)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H01160EBEE2E54BDFAABA1741E30CFF46"><enum>(1)</enum><text display-inline="yes-display-inline">The budget transmitted pursuant to subsection (a) for a fiscal year shall include—</text> 
<subparagraph id="H8141C204F9F24128BBD17F88ED6FF4F6" indent="up1"><enum>(A)</enum><text>a scorecard of progress in meeting the debt and deficit reduction targets set forth in subparagraph (B);</text> </subparagraph> 
<subparagraph id="H845CE2361C7B4B9DAD3BE4F21C66667A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a plan for long-term fiscal sustainability, defined as reducing to within 10 fiscal years and then maintaining a debt to potential gross domestic product (GDP) ratio, as defined by the Director of the Office of Management and Budget, of not more than 60 percent and an annual deficit to GDP ratio of not more than three percent;</text> </subparagraph> 
<subparagraph id="HAD5A863405154D94971BF5A7AF57A7FB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">a supplemental report from the Director of the Office of Management and Budget of the nonbudgeted fiscal exposures of the Government, which may be included in the Analytical Perspectives report, and shall include—</text> 
<clause id="H3FC5CBA3A67E4033A90E5FB1A8E653D0"><enum>(i)</enum><text>explicit liabilities and implicit promises embedded in the structure of current programs, including Federal credit programs; and</text> </clause> 
<clause id="H6A9D44561BA44BBF8C24977098C3765C"><enum>(ii)</enum><text>a concise description of, including cost information for, such exposures; and</text> </clause></subparagraph> 
<subparagraph id="H19D2C8443D2146399B5E705D9329C728" indent="up1"><enum>(D)</enum><text>explicit goals for carrying out the long-term fiscal sustainability plan for the first fiscal year after the fiscal year of the budget submission and each of the nine ensuing fiscal years.</text> </subparagraph></paragraph> 
<paragraph id="H36E742B7C56B4542A9A8187F76A4A60F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Unless the supplemental report is included in the Analytical Perspectives report referred to in paragraph (1)(C), then not later than March 15 of each calendar year, the Director of the Office of Management and Budget shall transmit such report to the President and to Congress.</text> </paragraph>

When such plan is submitted to the Committees on the Budget, the Director shall place it on the public Web site of the Congressional Budget Office.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section></subtitle>

<section id="H6481C127FA704CCB918EC4D3985C321B"><enum>421.</enum><header>OMB quadrennial reports</header><text display-inline="no-display-inline">The Director of the Office of Management and Budget, in consultation with the Secretary of the Treasury, shall publically issue, including by publishing on its Web site, a Quadrennial Fiscal Sustainability Report not later than April 1, 2013, and April 1 of every fourth year thereafter. The report shall address the long-term fiscal sustainability of the Government, including its ability to manage finances to meet spending commitments, with a detailed analysis of social insurance programs, for the budget year and for the 30-year period commencing with the budget year.</text> </section></subtitle> 
<subtitle id="HE5B6C36DA8F94FA5994A1552730EE068"><enum>D</enum><header>Presidential address to Congress on fiscal sustainability</header> 
<section id="H80F93748AE1648919435FC391F133440"><enum>431.</enum><header>Presidential address on long-term fiscal sustainability</header><text display-inline="no-display-inline">During October 2011 and each October thereafter, there shall be convened a joint session of Congress at which the President shall be invited to give an address on the long-term fiscal sustainability of the Government. As used in the preceding sentence, the term <term>long-term fiscal sustainability</term> means the ability of the Government to achieve and then maintain a debt to gross domestic product ratio of not more than 60 percent and an annual deficit to gross domestic product ratio of not more than 3 percent.</text> </section></subtitle></title>

<paragraph commented="no" display-inline="yes-display-inline" id="H84B14BC732F44DD9ABC17A04CED59039"><enum>(1)</enum><text>It shall not be in order in the House of Representatives or the Senate to consider any bill or joint resolution reported by the Committee on Ways and Means of the House or the Committee on Finance of the Senate that proposes to amend the Internal Revenue Code of 1986 to establish a new tax expenditure unless the committee report includes—</text> 
<subparagraph id="HC41A952FAA9A4DECA145239E9A64CF86" indent="up1"><enum>(A)</enum><text>a clear statement of the purpose of the tax expenditure, including a justification of why this purpose is best achieved through the tax system rather than as an outlay;</text> </subparagraph> 
<subparagraph id="HDA4A83D46DFB44A9BF6DF9073918B35D" indent="up1"><enum>(B)</enum><text>an explanation of how the tax expenditure will be implemented and integrated with other related tax expenditures and outlays;</text> </subparagraph> 
<subparagraph id="HC2D1E34CE20D499DA3BA4EE6DA1592B7" indent="up1"><enum>(C)</enum><text>a macroeconomic impact analysis; and</text> </subparagraph> 
<subparagraph id="H4D87FECC83224CFA9FF1D03493057257" indent="up1"><enum>(D)</enum><text>a statement from the Joint Committee on Taxation explaining why a macroeconomic analysis is not calculable.</text> </subparagraph></paragraph> 
<paragraph id="H3829F8280C4E416D8B443A1D1C9A5090" indent="up1"><enum>(2)</enum><text>As used in paragraph (1), the term <term>macroeconomic impact analysis</term> means—</text> 
<subparagraph id="H9BB0C4EF17354643832EF8B757207660"><enum>(A)</enum><text display-inline="yes-display-inline">an estimate prepared by the Joint Committee on Taxation of the changes in economic output, employment, capital stock, and tax revenues expected to result from enactment of the applicable bill or joint resolution; and</text> </subparagraph> 
<subparagraph id="HAE9097787A294CEAB6478BD2ACEAE524"><enum>(B)</enum><text display-inline="yes-display-inline">a statement from the Joint Committee on Taxation identifying the critical assumptions and the source of data underlying that estimate.</text> </subparagraph></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </section></subtitle> 
<subtitle id="HE0C05AC33F724EA9ADFC20F2DFD774D0"><enum>C</enum><header>Point of order against tax expenditures unless they sunset within ten years</header>

<subsection id="H7C8920554C004544A93A3E9069582F97"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 312 of the Congressional Budget Act of 1974 is amended by adding at the end the following new subsection:</text>

<paragraph id="HFE0BE5A0EB764E1E89E612D19A759C7B"><enum>(1)</enum><text>establishing a new tax expenditure unless that tax expenditure terminates within ten years; or</text></paragraph> 
<paragraph id="HA9B3114189374756928C885991B1E78F"><enum>(2)</enum><text>extending an existing tax expenditure for more than ten years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9E5F051488984EF28F94C4F4265AAE53"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Subsections (c)(1) and (d)(2) of section 904 of the Congressional Budget Act of 1974 are each amended by inserting <quote>312(g),</quote> after <quote>310(d)(2),</quote>. </text></subsection></section></subtitle> 
<subtitle id="HB62539D93B2941099E9EA1A3AF159946"><enum>D</enum><header>Tax expenditure performance reviews</header> 
<section id="H13447CB59046401AA7E207E4F67A4068"><enum>531.</enum><header>Tax expenditure performance reviews</header> 
<subsection id="H87FE544F128349E1AA9107DA383064BE"><enum>(a)</enum><header>Performance review schedule and reports</header> 
<paragraph id="H5DD78512287A4EC6B1D745825CA77870" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of the Treasury (hereinafter in this section referred to as the <quote>Secretary</quote>), in conjunction with the Director of the Office of Management and Budget (hereinafter in this section referred to as the <quote>Director</quote>), shall conduct performance reviews of tax expenditures, as identified by the Joint Committee on Taxation, on an ongoing basis. The Secretary shall develop the schedule for these reviews, such that each tax expenditure is reviewed at least once in every four-year period. A four-year schedule shall be submitted by the Secretary to Congress and to the Director during January of each calendar year.</text></paragraph> 
<paragraph id="HB722C78E5FEC42668C917F186504BB51" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Within three months after the enactment of any new tax expenditure, the Secretary shall revise the most recent four-year schedule of tax expenditure performance reviews and submit them to Congress and to the Director.</text> </paragraph> 
<paragraph id="HFA807BA39B914F8794D50118FD72AB8E" indent="up1"><enum>(3)</enum><text>Not later than one year after the enactment of this Act, the Secretary shall have submitted to Congress and to the Director the first four-year schedule and begin the first performance reviews under paragraph (1).</text> </paragraph> 
<paragraph id="HAC60A76983FD49C78BFF741C6F0A13F8" indent="up1"><enum>(4)</enum><text>The Secretary shall endeavor to develop a four-year schedule that provides for the simultaneous review of tax expenditures that have similar policy objectives.</text> </paragraph></subsection> 
<subsection id="H355F0BAF14A741A38E1A420FE58D1898"><enum>(b)</enum><header>Reports</header> 
<paragraph id="H26D43622D77045A49AC9A6CF6EA2F36D"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall report each of its performance reviews of tax expenditures to Congress and to the Director in quarterly reports and containing all of the performance reviews conducted since the preceding report.</text> </paragraph> 
<paragraph id="HF86AACF16BED4A12A272F3937C3C43EE"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may conduct expedited performance reviews for any tax expenditure that has an estimated annual fiscal impact of less than $1 billion, annually adjusted for inflation, unless the Director requests or the chairs and ranking minority members of the Committees on the Budget of the House of Representatives and the Senate jointly request, in writing, a full review.</text> </paragraph> 
<paragraph id="H220E4FAA4A1F44A696A92221FA5819E1"><enum>(3)</enum><text display-inline="yes-display-inline">Each performance review, except for expedited performance reviews, shall include the following explanations, descriptions, estimates, analyses, and recommendations:</text> 
<subparagraph id="H5F1A47C0691B4F0EA8666A823902758B"><enum>(A)</enum><text display-inline="yes-display-inline">An explanation of the tax expenditure and any relevant economic, social, or other context under which it was first enacted.</text> </subparagraph> 
<subparagraph id="H15AF4CD0876F441BB146033C17984B40"><enum>(B)</enum><text>A description of the intended purpose of the tax expenditure.</text> </subparagraph> 
<subparagraph id="H609814E07F10488E8B92389E734BD50A"><enum>(C)</enum><text>An analysis of the overall success of the tax expenditure in achieving such purpose, and evidence supporting such analysis.</text> </subparagraph> 
<subparagraph id="H129ACE1B3E0E493D9794A06CB1FC9226"><enum>(D)</enum><text>An analysis of the extent to which further extending the tax expenditure, or making it permanent, would contribute to achieving such purpose.</text> </subparagraph> 
<subparagraph id="HCCA56E2A0C0E4E279AB3AFD6B2638A13"><enum>(E)</enum><text>A description of the direct and indirect beneficiaries of the tax expenditure, also specifying—</text> 
<clause id="H52EFF03FA47F4C0FBC0BFAD5D37E53D7"><enum>(i)</enum><text>any unintended beneficiaries of the tax expenditure;</text> </clause> 
<clause id="H0D3DBB1000284CD9901975D7AEC20DBA"><enum>(ii)</enum><text>the classes of individuals, types of organizations, or types of industries whose Federal tax liabilities are directly affected by the tax expenditure;</text> </clause> 
<clause id="H02DC54567AE84F5DB9ED06618F33EBE9"><enum>(iii)</enum><text>the extent to which terminating the tax expenditure may have negative effects on the category of taxpayers that currently benefit from the tax preference and on the economy; and</text> </clause> 
<clause id="HD8BAB4A67CF84D0E90D8E3856C1EB87E"><enum>(iv)</enum><text>the extent to which the termination of the tax expenditure would affect the distribution of liability for payments of Federal taxes.</text> </clause></subparagraph> 
<subparagraph id="H0BF08DC5A7084516848F24A56DE5227D"><enum>(F)</enum><text>An analysis of whether the tax expenditure is the most cost-effective method for achieving the purpose for which it was intended, and a description of any more cost-effective methods through which such purpose could be accomplished, and in particular the extent to which a direct spending program might be preferable to a tax expenditure, including—</text> 
<clause id="H7BF67061D4434E74A3A47A7BEC98A7F7"><enum>(i)</enum><text display-inline="yes-display-inline">whether an outlay program might achieve the same policy objectives as a tax expenditure;</text> </clause> 
<clause id="HB14EC67E6C7C42288AC6FD5849666258"><enum>(ii)</enum><text>whether an outlay program might reduce deadweight losses and improve economic efficiency in the national economy; and</text> </clause> 
<clause id="H8F79CBD2E39042C28B6EF11245449CCB"><enum>(iii)</enum><text>whether a direct spending program might be more or less expense to administer.</text> </clause></subparagraph> 
<subparagraph id="HCD3825F7E646429B9960CD0F24A44BD9"><enum>(G)</enum><text>A description of any unintended effects of the tax expenditure that is useful in understanding the tax expenditure’s overall value.</text> </subparagraph> 
<subparagraph id="HA4E81546D7F34C2FAFD25DA38EA8A5F0"><enum>(H)</enum><text>A description of any interactions (actual or potential) with other tax expenditures or direct spending programs in the same or related budget function that should be studied further.</text> </subparagraph> 
<subparagraph id="H91DC0090AE1E42F08CC2F1C617D80578"><enum>(I)</enum><text>An estimate of the annual cost in forgone revenues of the tax expenditure, as well as a projection of the cost in foregone revenues for the ensuing ten fiscal years.</text> </subparagraph> 
<subparagraph id="H87E4C06EF4CF40528E4177F33CBE6AF6"><enum>(J)</enum><text>A description of any further information needed to complete a more thorough examination and analysis of the tax expenditure, and what is necessary to make such information available.</text> </subparagraph> 
<subparagraph id="H7B0905E8E07A4BE996EE83948B9E8EDC"><enum>(K)</enum><text display-inline="yes-display-inline">A specific recommendation, based on analysis conducted in the performance review, as to whether the tax expenditure should be continued without modification, modified (including converted fully or partly into a direct spending program), scheduled for sunset, reviewed at a later date, or terminated immediately. The Secretary may decline to provide a specific recommendation, but in each such case shall provide an explanation of why a recommendation has not been given.</text> </subparagraph></paragraph> 
<paragraph id="H4668F3BE322049FC8C8920734992D2B9"><enum>(4)</enum><text display-inline="yes-display-inline">An expedited performance review shall include at least the explanations, descriptions, estimates, analyses, and recommendations as listed in subparagraphs (A), (B), (C), (D), (I), (J), and (K) of paragraph (3).</text> </paragraph></subsection> 
<subsection id="HA97C609C183D43D8A0AFDCED1CFEDB2D"><enum>(c)</enum><header>Committee hearings</header><text display-inline="yes-display-inline">Not later than 60 days after the submission of any performance review report under subsection (b), the Committees on Ways and Means of the House of Representatives and the Committee on Finance of the Senate shall hold public hearings to consider the performance review recommendations contained in that report. The Committees on the Budget of the House of Representatives and the Senate may also hold hearings on such performance review recommendations.</text></subsection> 
<subsection id="HD1F2477E69DE43A08352DB196B4FE4F2"><enum>(d)</enum><header>CBO comments</header><text>Not later than 60 days after submission of a performance review report pursuant to section 204(b) of the Congressional Budget Act of 1974, the Director of the Congressional Budget Office shall provide to Congress, the Secretary, and the Director detailed, written comments on the performance review recommendations, stating whether the Director of the Congressional Budget Office agrees or disagrees with all or any part of the report or, if no opinion is given, providing an explanation of why he has no opinion or has not given one.</text> </subsection></section></subtitle> 
<subtitle id="H75C4D129F248465DA96C9F62678E3B2C"><enum>E</enum><header>Studies To improve the use of IRS data in evaluating tax expenditures</header> 
<section id="HF2DA11E26DC84456B8166E645E3AB3B1"><enum>541.</enum><header>GAO report on tax expenditures</header> 
<subsection id="HF9FFA2D73C324F9B80399BF15A6838A7"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Comptroller General shall submit to Congress and publish a written report that assesses improvements the Internal Revenue Service could make to facilitate the evaluation of tax expenditures, including a description of how the improvements could be implemented and the potential effects of such improvements on the Internal Revenue Service, taxpayers, and other relevant parties determined by the Comptroller General. </text></subsection> 
<subsection id="H1AFEF2081A0D4AC6A26BB804F4036EF6"><enum>(b)</enum><header>Tax expenditures defined</header><text display-inline="yes-display-inline">The term <quote>tax expenditures</quote> has the meaning given that term in section 3(3) of the Congressional Budget and Impoundment Control Act of 1974 (2 U.S.C. 622(3)).</text> </subsection></section></subtitle> 
<subtitle id="H673263228CE94F1DBAC85BD62A2FB930"><enum>F</enum><header>Executive branch reporting of tax expenditures</header> 
<section id="H6609A79202904C1E90E42C0D91E7CBE4"><enum>551.</enum><header>Executive branch reporting of tax expenditures</header> 
<subsection commented="no" id="H5EB8115E50B94A23B996104B05E0F5A2"><enum>(a)</enum><header>OMB guidance regarding tax expenditures</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall develop clear and consistent guidance to agencies on how to incorporate tax expenditures in their strategic plans, annual performance plans, and performance and accountability reports, to provide a broader perspective and more cohesive plan of the Government’s goals and strategies.</text> </subsection> 
<subsection id="HA018D5FBC2464D1CB7507061EEA56F88"><enum>(b)</enum><header>Reporting of tax expenditure data</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall require agencies to report tax expenditure data related to their overall mission in their annual financial statements.</text> </subsection> 
<subsection id="HAA8A2A83A6844C6AB050A426A3BF3C3C"><enum>(c)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="H6A7DF42D17F645D19A17DDD4558E5F1C"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given to such term in paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code; and</text> </paragraph> 
<paragraph id="H4BF8E28398194017A763B1D763A1DE20"><enum>(2)</enum><text>the term <term>tax expenditure</term> has the meaning given to such term in paragraph (3) of section 3 of the Congressional Budget and Impoundment Control Act of 1974.</text> </paragraph></subsection></section></subtitle></title>
