		  certain increases in fees for military health care before fiscal year

		<section id="H8E0EB8A85D104C87B9DF82F128569F0D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Health Care Affordability
			 Act</short-title></quote>.</text>
		</section><section id="H0D300D04D63D4917933FFE608F15578D"><enum>2.</enum><header>Findings and
			 sense of congress</header>
			<subsection id="H2F3A020A6DA64EB99EF5B79274104770"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H6D103E31E4294DF6B15C5DBBA3C20E85"><enum>(1)</enum><text display-inline="yes-display-inline">America’s warriors offer a life of supreme
			 devotion in service to their Nation, and through generations of war-fighting,
			 their dedication has proven honorable, their sacrifice immeasurable, and their
			 record of excellence undeniable.</text>
				</paragraph><paragraph id="H9964E848B53949A9BD525353B30EA31F"><enum>(2)</enum><text display-inline="yes-display-inline">No American goes to war alone—the burden of
			 every Soldier, Sailor, Airman, and Marine is shared, in part, by all of his or
			 her loved ones.</text>
				</paragraph></subsection><subsection id="H6E7327BA4FBD41839E329687C7F97E07"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that—</text>
				<paragraph id="HD5A3C4823D3E486E9825707D5F84D623"><enum>(1)</enum><text display-inline="yes-display-inline">so long as the United States sends men and
			 women into battle, the United States will be faithful to care for them upon
			 their return;</text>
				</paragraph><paragraph id="HC4248BE9389B49BB89FA7544B5EBF98D"><enum>(2)</enum><text display-inline="yes-display-inline">as the veteran answered the call of duty,
			 so too, is the United States duty-bound to answer the call of the
			 veteran;</text>
				</paragraph><paragraph id="H17C68CE258A94D7185FCD5D70112F5CB"><enum>(3)</enum><text display-inline="yes-display-inline">the Department of Defense and the
			 Department of Veterans Affairs have the tools and ingenuity to provide
			 continued excellent health care without increasing TRICARE payments from the
			 veteran before fiscal year 2014; and</text>
				</paragraph><paragraph id="H014947A79FB54B17AD74092B8EC6A32B"><enum>(4)</enum><text display-inline="yes-display-inline">in the words of President Abraham Lincoln,
			 <quote>let us strive on to finish the work we are in, to bind up the nation's
			 wounds, to care for him who shall have borne the battle and for his widow and
			 his orphan, to do all which may achieve and cherish a just and lasting peace
			 among ourselves and with all nations.</quote>.</text>
				</paragraph></subsection></section><section id="H324700203AB447A09B8643219A150B6B"><enum>3.</enum><header>Prohibition on
			 increases of certain health costs and restrictions on health benefit
			 adjustments for members and retirees of the uniformed services and their
			 dependents</header>
			<subsection id="H407C1BA3240A4D458FB579F094AABDCC"><enum>(a)</enum><header>Prohibition on
			 increase in charges under contracts for medical care</header><text>Section
			 1097(e) of title 10, United States Code, is amended by striking
			 <quote>September 30, 2011</quote> and inserting <quote>September 30,
			 2013</quote>.</text>
			</subsection><subsection id="HBA75122EB82B4ECABEB2C3796F250057"><enum>(b)</enum><header>Prohibition on
			 increase in amount of cost sharing requirement under pharmacy benefits
			 program</header><text display-inline="yes-display-inline">Section
			 1074g(a)(6)(A) of title 10, United States Code, is amended by adding at the end
			 the following: <quote>The dollar amount of a cost sharing requirement (whether
			 established as a percentage or a fixed dollar amount) may not be increased
			 during the period beginning on October 1, 2011, and ending on September 30,
			 2013.</quote>.</text>
			</subsection><subsection id="H2505C560007042DB82A934079F7A5EB9"><enum>(c)</enum><header>Prohibition on
			 increase in charges for inpatient care</header><text display-inline="yes-display-inline">Section 1086(b)(3) of title 10, United
			 States Code, is amended by striking <quote>September 30, 2011</quote> and
			 inserting <quote>September 30, 2013</quote>.</text>
			</subsection><subsection id="H515D80EB6A0747C49AC961AA56C1BDAC"><enum>(d)</enum><header>Prohibition on
			 increase in premiums under TRICARE coverage for certain members in the Selected
			 Reserve</header><text>Section 1076d(d)(3) of title 10, United States Code, is
			 amended—</text>
				<paragraph id="H1E128755B2FA432EBF1ACFF7B4B869EC"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>The monthly</quote> and inserting <quote>Except as
			 provided by subparagraph (C), the monthly</quote>; and</text>
				</paragraph><paragraph id="H19D046ED866D45E5B8D72799D877D425"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H1D2EFA2745E143B2B6BA620EEBF12C86" style="USC">
						<paragraph id="H4489B57980C6421AAC11C67C09249D95" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">During the period beginning on October 1,
				2011, and ending on September 30, 2013, the monthly amount of the premium for
				TRICARE Standard coverage under this section may not be increased to be more
				than the amount in effect for the month of September
				2011.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H65470E29E3E1466B830DC6D4CA834695"><enum>(e)</enum><header>Prohibition on
			 increase in premiums under TRICARE coverage for certain members of the Retired
			 Reserve</header><text display-inline="yes-display-inline">Section 1076e(d) of
			 title 10, United States Code, is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H00B344DD5A4D4A75B72D9EC2CA682F6F" style="USC">
					<paragraph id="H548C57DD29F844DE9370B0FA055FA6C1" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">During the period beginning on October 1,
				2011, and ending on September 30, 2013, the monthly amount of the premium for
				TRICARE Standard coverage under this section may not be increased to be more
				than the amount in effect for the month of September
				2011.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H158CBED6E8A8499798AD1E0330A0F21A"><enum>(f)</enum><header>Prohibition on
			 increase in premiums under TRICARE coverage for certain
			 dependents</header><text display-inline="yes-display-inline">Section 1110b(c)
			 of title 10, United States Code, is amended by adding at the end the following
			 new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HA31B07C8A1594C209EEDB5B178CC31C3" style="USC">
					<paragraph id="H1CAF7BACF2CD45F5AB9474AB629AF640" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">During the period beginning on October 1,
				2011, and ending on September 30, 2013, the monthly amount of the premium for
				coverage under the TRICARE program provided pursuant to this section may not be
				increased to be more than the amount in effect for the month of September
				2011.</text>
