		<official-title>To amend title XVIII of the Social Security Act to apply
		  the additional Medicare HITECH payment provisions to hospitals in Puerto
		  Rico.</official-title>

		<section id="H04EA62AA870449ABA13A7BB786F48F4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Puerto Rico Hospital HITECH Amendments
			 of 2011</short-title></quote>.</text>
		</section><section id="H0A6AAEB9932B468A946C8D96914C9DC2"><enum>2.</enum><header>Application of
			 Medicare HITECH payments to hospitals in Puerto Rico</header>
			<subsection id="HF546137F081C4082BEC6AEFE4301CAC4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (n)(6)(B)
			 of section 1886 of the Social Security Act (42 U.S.C. 1395ww) is amended by
			 striking <quote>subsection (d) hospital</quote> and inserting <quote>hospital
			 that is a subsection (d) hospital or a subsection (d) Puerto Rico
			 hospital</quote>.</text>
			</subsection><subsection id="HFAEA07EBF0EE414DAEB4D3B9FD2D9957"><enum>(b)</enum><header>Offsetting
			 reduction</header><text>Subsection (n)(2) of such section is amended by adding
			 at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H462913F705724B0D81F9488E0B59E82C" style="OLC">
					<subparagraph id="H49EC93CFBD6B4AA2BCC570325D36AF83"><enum>(H)</enum><header>Budget
				neutrality adjustment</header><text display-inline="yes-display-inline">The
				Secretary shall reduce the applicable amounts that would otherwise be
				determined under this subsection with respect to—</text>
						<clause id="HB556A996CAE243B188701A6881CBA760"><enum>(i)</enum><text>fiscal year 2012
				by an amount that the Secretary estimates would ensure that estimated aggregate
				payments under this subsection for fiscal years 2011 and 2012 are not increased
				as a result of the amendment made by subsection (a) of section 2 of the Puerto
				Rico Hospital HITECH Amendments of 2011; or</text>
						</clause><clause id="H04B2A9D7DBF242529DE74F1C38B373C7"><enum>(ii)</enum><text display-inline="yes-display-inline">a succeeding fiscal year by an amount that
				the Secretary estimates would ensure that estimated aggregate payments under
				this subsection for such fiscal year are not increased as a result of the
				amendments made by subsections (a) and (c) of such
				section.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H447774E2FA234CBABEEDD27C0A694B6F"><enum>(c)</enum><header>Conforming
			 amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H128697603334447789748BD43D4518D2"><enum>(1)</enum><text>Subsection (b)(3)(B)(ix)
			 of such section is amended—</text>
					<subparagraph id="H4BA04F6FFD074C0395054AF0223456DC" indent="up1"><enum>(A)</enum><text>in subclause (I), by striking
			 <quote>(n)(6)(A)</quote> and inserting <quote>(n)(6)(B)</quote>; and</text>
					</subparagraph><subparagraph id="H7BF07C8744B64DC38E55414FC2EB1B06" indent="up1"><enum>(B)</enum><text>in subclause (II), by striking
			 <quote>subsection (d) hospital</quote> and inserting <quote>an eligible
			 hospital</quote>.</text>
					</subparagraph></paragraph><paragraph id="H938747522AD84C95B3A35882863FE8AE" indent="up1"><enum>(2)</enum><text>Paragraphs (2) and (4)(A) of section
			 1853(m) of the Social Security Act (42 U.S.C. 1395w–23(m)) are each amended by
			 striking <quote>1886(n)(6)(A)</quote> and inserting
			 <quote>1886(n)(6)(B)</quote>.</text>
				</paragraph></subsection><subsection id="H32B04F5EEB5A4129A217F2A25FF06F55"><enum>(d)</enum><header>Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Health and Human Services may implement the amendments made by
			 subsections (a), (b) and (c) by program instruction or otherwise.</text>
			</subsection><subsection id="HAE2906AB093645879936F30BE6A1DD7C"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply as if
			 included in the enactment of the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–3).</text>
