			</subsection></section><section id="HB6CEAAF32C70461787299B215D9ED3A9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="H9431A56BBCE24EB389B75C2C542855BA"><enum>(1)</enum><text>the term
			 <term>Postal Service</term> means the United States Postal Service;</text>
			</paragraph><paragraph id="HD3EEF426A6FE4ADA937C3ABDD2BD3459"><enum>(2)</enum><text>the term
			 <term>market-dominant product</term> has the meaning given such term by section
			 102 of title 39, United States Code;</text>
			</paragraph><paragraph id="HA85933850ED44E478B28300B4BB257D0"><enum>(3)</enum><text>the term
			 <term>Postal fleet</term> means that portion of the Federal fleet (within the
			 meaning of section 303(b) of the Energy Policy Act of 1992 (42 U.S.C. 13212(b))
			 which is owned, operated, leased, or otherwise controlled by or assigned to the
			 Postal Service and used primarily in the delivery of mail;</text>
			</paragraph><paragraph id="H19DA0421164547548FBE07228B3EC869"><enum>(4)</enum><text>the term
			 <term>motor vehicle</term> means any self-propelled vehicle designed for
			 transporting persons or property on a street or highway;</text>
			</paragraph><paragraph id="HD36CAD5D90554B8AB7DA149482B6F3A5"><enum>(5)</enum><text>the term
			 <term>electric motor vehicle</term> means a motor vehicle powered solely by an
			 electric motor that draws current from rechargeable storage batteries, fuel
			 cells, photovoltaic arrays, or other sources of electric current;</text>
			</paragraph><paragraph id="H9FDA0FD4A2924143B71824033F1CAF52"><enum>(6)</enum><text>the term
			 <term>small business concern</term> means a small business as defined pursuant
			 to section 3 of the Small Business Act (15 U.S.C. 632) and relevant regulations
			 promulgated pursuant thereto;</text>
			</paragraph><paragraph commented="no" id="H09B7FA07E87F4657A24AB64D4F27310F"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>State</term> includes the
			 District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands,
			 Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any
			 other territory or possession of the United States; and</text>
			</paragraph><paragraph id="H547E03C0EF2C4D70814EAD404781FF09"><enum>(8)</enum><text>the term
			 <term>United States</term>, as used in a geographical sense, includes the
			 District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands,
			 Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any
			 other territory or possession of the United States.</text>
			</paragraph></section><section id="HEA01C297020D49FB9E38A00905BE671E"><enum>3.</enum><header>Assistance to
			 facilitate voting by mail</header><text display-inline="no-display-inline">It
			 is the sense of Congress that the Postal Service should consider a simplified
			 rate structure for election ballots sent by voters by mail as part of its
			 review of potential new election mail products.</text>
		</section><section id="H95A017982803404595D7FFA454A05A17"><enum>4.</enum><header>Provisions
			 relating to the postal delivery vehicle fleet</header>
			<subsection display-inline="no-display-inline" id="HF36901C81E804BE294D707B36ACEF055"><enum>(a)</enum><header>Electric
			 vehicles</header><text display-inline="yes-display-inline">The Postal Service
			 shall implement a plan, which it shall present in advance to Congress, to
			 replace or convert 2,000 gasoline-powered delivery vehicles with electric
			 vehicles by January 1, 2017.</text>
			</subsection><subsection id="HCE06C8EC9F244149B124EAF6A8935741"><enum>(b)</enum><header>Conversion to
			 electric motor vehicles</header>
				<paragraph id="H6A6DC1829A3E440D9F215DE1EE400AD5"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that the Postal Service should—</text>
					<subparagraph id="H1E21C08E2B574F1182296A23379B0D79"><enum>(A)</enum><text>during each year
			 in the 10-year period beginning on the date of enactment of this Act, replace
			 at least 10 percent of the gasoline-powered motor vehicles in the Postal fleet
			 with electric motor vehicles;</text>
					</subparagraph><subparagraph id="HD4BEB61AD6E54C959A872AAC1EDEBC22"><enum>(B)</enum><text>take such measures
			 as may be necessary to ensure that, by the end of the 10-year period described
			 in subparagraph (A), at least 75 percent of the Postal fleet is comprised of
			 electric motor vehicles; and</text>
					</subparagraph><subparagraph id="H36CA4CCA11394E91A3774C84EE3A1109"><enum>(C)</enum><text>carry out the
			 preceding provisions of this paragraph, in coordination with local electric
			 distribution companies, in a manner consistent with the goals of—</text>
						<clause id="HCAA2D9BE6D4B4BC4AF008C63D0103E27"><enum>(i)</enum><text>maintaining
			 electric grid reliability; and</text>
						</clause><clause id="H6887E03E5D7A4F1787211A5A3645AE8F"><enum>(ii)</enum><text>minimizing
			 charging costs of electric motor vehicles in the Postal fleet.</text>
						</clause></subparagraph></paragraph><paragraph id="H166003ED06AF427DAACE8C0BC51FC3AC"><enum>(2)</enum><header>Buy
			 American</header><text>Notwithstanding any other provision of law, electric
			 motor vehicles acquired to carry out this subsection shall be electric motor
			 vehicles manufactured in the United States. The Postal Service shall ensure
			 that manufacturers of electric motor vehicles so acquired solicit competitive
			 bids for electric drive components and storage devices from domestic
			 manufacturers that participate in the Department of Energy’s Electric Drive
			 Vehicle Battery and Component Manufacturing Initiative (or successor program,
			 as determined by the Postal Service in consultation with the Secretary of
			 Energy).</text>
				</paragraph><paragraph id="HDDB1F3D43A8A412FA6517F892D8305E2"><enum>(3)</enum><header>Borrowing
			 authority</header>
					<subparagraph id="H2CD37414681C4034A6BB8FD349563E15"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Postal Service
			 may borrow money and issue and sell such obligations as it determines necessary
			 to carry out this subsection.</text>
					</subparagraph><subparagraph id="H5960E3B79C5248A8A00D2F893D0C6C49"><enum>(B)</enum><header>Terms and
			 conditions</header><text>The authority under subparagraph (A) shall be
			 available to the Postal Service, subject to the provisions of sections 2005
			 through 2007 of title 39, United States Code, to the same extent and in the
			 same manner as if it were the corresponding authority described in the first
			 sentence of subsection (a)(1) of such section 2005, except that—</text>
						<clause id="HC68FC94A5F904A7C8E3668530FBDB13B"><enum>(i)</enum><text>the
			 amount of obligations outstanding under this paragraph shall not be taken into
			 account nor subject to—</text>
							<subclause id="H85CED3CD600B4932981BF65EBFE86991"><enum>(I)</enum><text>the last sentence
			 of subsection (a)(1) of such section 2005;</text>
							</subclause><subclause id="HAB8F6C7BF05B4249B1F652FA509E86E1"><enum>(II)</enum><text>subsection (a)(2)
			 of such section 2005, except as provided in clause (iv); or</text>
							</subclause><subclause id="HA6F58715AB3F4FCB94BF11AA3603B618"><enum>(III)</enum><text>the
			 dollar-amount limitation set forth in section 2006(b) of such title;</text>
							</subclause></clause><clause id="HA4D0B8CCDFA34D21B8BA604EF0CFCAAC"><enum>(ii)</enum><text>obligations
			 issued by the Postal Service under this paragraph shall mature within a period
			 not to exceed 10 years from the date of issuance;</text>
						</clause><clause id="HFE55B8FF8EAE4B32BCC794F43468E319"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H98B743343DDE408085C17B364DAB2869"><enum>(I)</enum><text>if the Secretary of the
			 Treasury makes an election under section 2006(a) to purchase such obligations,
			 the rate of interest on such obligations shall be zero; and</text>
							</subclause><subclause id="H8399FEFFB5B540A692470EC716971925" indent="up1"><enum>(II)</enum><text>if those obligations are issued and sold
			 under the last sentence of section 2006(a) to a party or parties other than the
			 Secretary of the Treasury, any interest on such obligations shall be payable by
			 the Government of the United States and not by the Postal Service;</text>
							</subclause></clause><clause id="H5416AD099FF34897916A382A3DB49E5C"><enum>(iv)</enum><text>if
			 the Postal Service does not repay the principal of any obligations under this
			 paragraph (whether sold in the manner described in clause (iii)(I) or issued in
			 the manner described in clause (iii)(II)) in timely fashion—</text>
							<subclause id="H5F86AF9723314600951F6A3307627BCA"><enum>(I)</enum><text>the unpaid portion
			 of such principal shall, after the deadline for repayment, be taken into
			 account for purposes of section 2005(a)(2) of such title 39; and</text>
							</subclause><subclause id="H6EE5A7872F894FDE9DE9A5CC31F0F2B6"><enum>(II)</enum><text>if the
			 application of subclause (I) causes the aggregate amount of obligations, issued
			 by the Postal Service, which are outstanding at any one time to exceed the
			 maximum amount allowable under such section 2005(a)(2), the further exercise of
			 any borrowing authority under this paragraph shall be suspended until such
			 aggregate amount is reduced to a level that does not exceed that maximum amount
			 allowable; and</text>
							</subclause></clause><clause id="H69D97DED8B674A9FBE581FE8976A1703"><enum>(v)</enum><text>the
			 aggregate amount of obligations outstanding under this paragraph at any one
			 time shall not exceed $6,000,000,000.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H5BE6B4A327E54309BC80975C57EB0109"><enum>(c)</enum><header>Authority To use
			 fleet vehicles for certain purposes besides mail delivery</header>
				<paragraph id="H155129883D594461A8FFD93FB68937A7"><enum>(1)</enum><header>In
			 general</header><text>Section 404(a) of title 39, United States Code, is
			 amended—</text>
					<subparagraph id="HEED126E1268347A28F3DBD009A93FC3F"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (6) through (8)
			 as paragraphs (7) through (9), respectively; and</text>
					</subparagraph><subparagraph id="H85F8EE8AF7964476A53B639B4B9914FC"><enum>(B)</enum><text>by inserting after
			 paragraph (5) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HB63490B78E114EAAA701F5CD10720557" style="USC">
							<paragraph commented="no" id="HFC40D25313EE4B82A0D657CF4081BB8D"><enum>(6)</enum><text display-inline="yes-display-inline">to provide services, other than postal
				services (as defined in section 102(5)) and in a manner that generates revenue
				for the Postal Service, if the Postal Service determines that the provision of
				that service would utilize the processing, transportation, delivery, retail
				network, or technology of the Postal Service in a manner that is consistent
				with the public interest;</text>
							</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HBC02E98A4B31445E8D343A24F9907C6C"><enum>(2)</enum><header>Reporting
			 requirement</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Postal Service shall submit to Congress a written report on the
			 operation of the amendment made by paragraph (1). Such report shall
			 specifically include a description of any agreements or other arrangements
			 entered into by the Postal Service for the purpose of allowing vehicles in the
			 Postal fleet to be used for purposes relating to monitoring weather conditions
			 (including air pollution) or road conditions. Such report shall—</text>
					<subparagraph id="HF97973447BEB43138CBB6BF115C0E7C9"><enum>(A)</enum><text>to the extent that
			 it relates to monitoring weather conditions, be prepared in consultation with
			 the National Weather Service;</text>
					</subparagraph><subparagraph id="H5A20A8CC9F0C42F0B3D5978A0AF2AF07"><enum>(B)</enum><text>to the extent that
			 it relates to monitoring air pollution, be prepared in consultation with the
			 Environmental Protection Agency; and</text>
					</subparagraph><subparagraph id="H60C29783E9F149389FECBD737E566475"><enum>(C)</enum><text>to the extent that
			 it relates to monitoring road conditions, be prepared in consultation with the
			 Department of Transportation.</text>
					</subparagraph></paragraph></subsection></section><section id="HF137DE02FA0F4B0CAE860B8DB8BCE6BB"><enum>5.</enum><header>Forever
			 box</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the Postal Service should consider creating a “Forever Box” for
			 customers to mail parcels of a certain size, analogous to the “Forever
			 Stamp”.</text>
		</section><section id="HC05B270547674C2092C9117D4B3DCD69"><enum>6.</enum><header>Nonpostal
			 products and services</header>
			<subsection id="HECE41B41F8D24D5CB8325226C3CCE2A0"><enum>(a)</enum><header>Co-Location of
			 post offices at retail facilities</header>
				<paragraph id="HB5D862B02B83471B8573DA07B157EB68"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Postal Service shall submit a plan on the co-location of post
			 offices at retail facilities to—</text>
					<subparagraph id="HE3D08936EC194873B70AA3722AC545C9"><enum>(A)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H44BD267F497A4B61BD1D66C0375D0C9B"><enum>(B)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="HDA340852E4E645309B767865780FC393"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The plan under paragraph (1) shall—</text>
					<subparagraph id="H44C5A48DEBFA49A78348716C1643A441"><enum>(A)</enum><text display-inline="yes-display-inline">be developed in consultation with the
			 Postal Regulatory Commission;</text>
					</subparagraph><subparagraph id="H92648FF9AC3B45778BBF02699DA2C9F6"><enum>(B)</enum><text display-inline="yes-display-inline">provide for an increase in the co-location
			 of post offices at retail facilities to enable the United States Postal Service
			 to offer its products and services at those locations;</text>
					</subparagraph><subparagraph id="HC5E26C22AB6F4D59AC341B66E6800949"><enum>(C)</enum><text>consider the
			 impact of any co-location decisions on small communities and rural areas before
			 taking actions to co-locate post offices; and</text>
					</subparagraph><subparagraph id="H244E54F0D6354B9FA9DCBDFA87B32413"><enum>(D)</enum><text>ensure
			 that—</text>
						<clause id="HC99354CD6AAB465383A7B536586CC7A5"><enum>(i)</enum><text>service shall
			 continue in small communities and rural areas after implementation of the
			 plan;</text>
						</clause><clause id="H680C1386138D407CA5D9790B9BAB88CA"><enum>(ii)</enum><text>the
			 United States Postal Service solicits community input before making decisions
			 about co-location;</text>
						</clause><clause id="H94480ACB160B45E88B6070C7DFB6B0E4"><enum>(iii)</enum><text>the quality of
			 products and services offered in co-located facilities are consistent with
			 those offered in post offices;</text>
						</clause><clause commented="no" id="H30153CC1091541C8A6D6AA63B7FF1EA3"><enum>(iv)</enum><text>products and
			 services provided in co-located facilities will be provided through the
			 employment of employees of the Postal Service, to the same extent as if such
			 products and services had not been relocated from a post office; and</text>
						</clause><clause commented="no" id="H678BF0FE3EC54F069BDDD7ECA2EE16B2"><enum>(v)</enum><text>co-location shall
			 be permitted only to the extent that the Postal Service determines (and the
			 Postal Regulatory Commission concurs) that net revenues will increase with
			 respect to the operations of the post office or post offices so
			 co-located.</text>
						</clause></subparagraph></paragraph><paragraph id="H533D7534B3F34F1F902E31BE5C1446BD"><enum>(3)</enum><header>Reporting
			 requirement</header><text>The Postal Service shall submit a report, once every
			 2 years, on the progress of implementing the plan on the co-location of post
			 offices at retail facilities under this subsection to—</text>
					<subparagraph id="HF77A79E5C7B94DD2BC72C1084375EE9A"><enum>(A)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1ACAA6CAD519431086582165CBDEBDE1"><enum>(B)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives.</text>
					</subparagraph></paragraph></subsection><subsection id="H38268F4BF4FF4FB583789CD0F83F460E"><enum>(b)</enum><header>Specific
			 powers</header><text>Section 404(a) of title 39, United States Code, is
			 amended—</text>
				<paragraph id="H2E3D5CF8C39644ACADBE39D440A30779"><enum>(1)</enum><text>by redesignating
			 paragraphs (6) through (8) as paragraphs (7) through (9), respectively;
			 and</text>
				</paragraph><paragraph id="H82F8B3BFC4BE4E45BC4A05B9BAEE1433"><enum>(2)</enum><text>by inserting after
			 paragraph (5) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBD85A97CB4ED4CB689951043EFF814C1" style="USC">
						<paragraph id="H51F1A43757864A1B91333EB4858756EE"><enum>(6)</enum><text display-inline="yes-display-inline">to provide services other than postal
				services, but only after determining that the provision of those other services
				would use the processing, transportation, delivery, retail network, and
				technology of the Postal Service (whichever apply) in a manner that is
				consistent with the public interest;</text>
						</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H12E1A514545040A09D9D344085F34052"><enum>(c)</enum><header>Wine and beer
			 shipping</header>
				<paragraph id="H235F8FE52012472F92B7F2697906513A"><enum>(1)</enum><header>Amendments to
			 title 18, United States Code</header>
					<subparagraph id="H4DB9A61A93EA468193BE4D86C03DBDC8"><enum>(A)</enum><header>Nonmailable
			 articles</header><text display-inline="yes-display-inline">Section 1716(f) of
			 title 18, United States Code, is amended by striking <quote>mails</quote> and
			 inserting <quote>mails, except to the extent that the mailing is allowable
			 under section 3001(p) of title 39</quote>.</text>
					</subparagraph><subparagraph id="H86CFA37A487F4DFE90A679427CA6C518"><enum>(B)</enum><header>Intoxicants</header><text display-inline="yes-display-inline">Section 1154(a) of title 18, United States
			 Code, is amended by inserting <quote>or, with respect to the mailing of wine or
			 malt beverages, to the extent allowed under section 3001(p) of title 39</quote>
			 after <quote>mechanical purposes</quote>.</text>
					</subparagraph></paragraph><paragraph id="HD81BFD87B379405182D9CFE85DEDD1A2"><enum>(2)</enum><header>Amendment to
			 title 39, United States Code</header><text>Section 3001 of title 39, United
			 States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H95C5EB51E7104D348BD0ADE1F0412688" style="USC">
						<subsection id="HA4B4FCD4E4DB4DD4AA86FBC98B61AAEF"><enum>(p)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H35776C292284430299034CF427864D93"><enum>(1)</enum><text display-inline="yes-display-inline">Wine or malt beverages shall be considered
				mailable if mailed by a licensed winery or brewery, in accordance with
				applicable regulations under paragraph (2).</text>
							</paragraph><paragraph id="H420B7CE484584037A95D4928B1C3FF05" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Postal Service shall prescribe such
				regulations as may be necessary to carry out this subsection, including
				regulations providing that—</text>
								<subparagraph id="HE7C37F6CA3464B1D94A1B26A586D8AD8"><enum>(A)</enum><text display-inline="yes-display-inline">the mailing shall be by a means established
				by the Postal Service to ensure direct delivery to the addressee or a duly
				authorized agent at a postal facility;</text>
								</subparagraph><subparagraph id="H13364FF640F94A629DBF31E2157AE976"><enum>(B)</enum><text display-inline="yes-display-inline">the addressee shall be an individual at
				least 21 years of age, and shall present a valid, government-issued photo
				identification at the time of delivery;</text>
								</subparagraph><subparagraph id="H0068234DF3D54916ABAF57E46342CAC6"><enum>(C)</enum><text display-inline="yes-display-inline">the wine or malt beverages may not be for
				resale or other commercial purpose; and</text>
								</subparagraph><subparagraph id="H28C044E9E7184A07AADACB3C15A632E4"><enum>(D)</enum><text display-inline="yes-display-inline">the winery or brewery involved
				shall—</text>
									<clause id="HA8E5546485714AE0B439E50BA2CCF809"><enum>(i)</enum><text display-inline="yes-display-inline">certify in writing to the satisfaction of
				the Postal Service that the mailing is not in violation of any provision of
				this subsection or regulation prescribed under this subsection; and</text>
									</clause><clause id="H8DA90722EF27428F88F2B940CF32DE48"><enum>(ii)</enum><text display-inline="yes-display-inline">provide any other information or
				affirmation that the Postal Service may require, including with respect to the
				prepayment of State alcohol beverage taxes.</text>
									</clause></subparagraph></paragraph><paragraph id="H751B32F5A5E2429B89717FEFCFCBEC4D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this subsection, a winery
				or brewery shall be considered to be licensed if it holds an appropriate basic
				permit issued under the Federal Alcohol Administration
				Act.</text>
							</paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCCF7F5611F4F4D02BE6AFE527AFCC025"><enum>(3)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall take effect 180 days after the date of enactment of this
			 Act.</text>
				</paragraph></subsection></section><section id="H3EFBDBE1C4B0434798C91E67B6C3935C"><enum>7.</enum><header>Study relating to
			 consolidated mailings</header>
			<subsection id="HADA3172C11564D91AB852F3092DB04D7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text>
				<paragraph id="H1D9F0A3079E845AD801F50B8085295D8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>transpromotional
			 mailing</term> refers to the use of a single mailing to provide, in addition to
			 information provided by the mailing source, other information of potential
			 interest to the recipient from a different source; and</text>
				</paragraph><paragraph id="HCA9613B098E945129AE48F4EC6AEEA67"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>consolidated mailing</term>
			 refers to a combined mailing, contained in a single envelope or cover,
			 comprised of mail matter from more than one Federal agency.</text>
				</paragraph></subsection><subsection id="H16FF44E9B67D4B8490B19BA9DB796B4D"><enum>(b)</enum><header>Study</header><text>The
			 Postal Service shall conduct a study and submit to Congress, within 2 years
			 after the date of enactment of this Act, a report on ways to promote the use of
			 transpromotional or consolidated mailings. Included as part of such report
			 shall be—</text>
				<paragraph id="H528563701302417F9BECCA1AD9B33B8A"><enum>(1)</enum><text>findings regarding
			 the effect that the greater use of transpromotional or consolidated mailings is
			 likely to have in terms of—</text>
					<subparagraph id="H8D74EF50D34E4A17974543B7BB68D79D"><enum>(A)</enum><text>expanded mail
			 volume;</text>
					</subparagraph><subparagraph id="HEFEBDFCD795F45B6BFB580A846412BFF"><enum>(B)</enum><text>efficiencies in
			 the dissemination of information by Federal agencies; and</text>
					</subparagraph><subparagraph id="H4AEE57A68F3C479A86967D6A0F35622C"><enum>(C)</enum><text>other relevant
			 measures; and</text>
					</subparagraph></paragraph><paragraph id="H5703F9B77F8D4F3C8DFA38173A814949"><enum>(2)</enum><text>recommendations
			 for such legislation or other actions as the Postal Service considers necessary
			 to achieve the optimal levels of transpromotional or consolidated
			 mailings.</text>
				</paragraph></subsection></section><section id="H9B234C40AB4648099612BA751B9645E6"><enum>8.</enum><header>Study relating to
			 the cost of Government mailings</header>
			<subsection id="HD27FABD9FD0041AD8E1E06E93AB2D733"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Within 1 year after
			 the date of enactment of this Act, there shall be submitted to Congress the
			 results of a study relating to the mailing costs, attributable to each agency
			 or other entity in the executive branch of the Government, of sending mail by
			 using the Postal Service, as compared to the services of a carrier other than
			 the Postal Service. The report shall include, for the Postal Service and each
			 of the other respective carriers—</text>
				<paragraph id="H85AEFDE177134E709073CFC5A02CE341"><enum>(1)</enum><text>an estimate of the
			 per-mile mailing costs for each class of mail; and</text>
				</paragraph><paragraph id="H1B68D03DFE68404BBA93A2D5F550582F"><enum>(2)</enum><text>such other
			 information as may be necessary to allow meaningful comparisons to be
			 made.</text>
				</paragraph></subsection><subsection id="H5BA74BCBA99C4B5BAA018814848871E4"><enum>(b)</enum><header>Regulations</header><text>The
			 requirements of this section shall be carried out in such manner as the
			 President may require.</text>
			</subsection></section><section id="H8711620D3D024799B7671ED4FBD8AE00"><enum>9.</enum><header>Packaging of
			 postal services and products</header><text display-inline="no-display-inline">It is the sense of Congress that the Postal
			 Service should consider—</text>
			<paragraph id="HF8BD6E9B00CB4EB484EA54EADDF87CD0"><enum>(1)</enum><text>establishing
			 packages of postal services and products; and</text>
			</paragraph><paragraph id="H19787549824B43EA8845829CFB38F332"><enum>(2)</enum><text>marketing those
			 packages to small businesses and other potential users.</text>
			</paragraph></section><section id="HF36C2DCFEEE74DEC84ABBDAF7AD8F33E"><enum>10.</enum><header>After-delivery
			 payment arrangements</header><text display-inline="no-display-inline">Nothing
			 in title 39, United States Code, or any other provision of law, shall prevent
			 the Postal Service from entering into arrangements whereby the sender of a
			 mailing may be allowed to defer payment of postage until after the item
			 involved has been delivered.</text>
		</section><section id="H238AF508AED3498E89DC88E4819C0C19"><enum>11.</enum><header>Small business
			 mailing pools</header>
			<subsection id="H2832F585F21C4A388EF87FBE94DF827A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Nothing in title 39,
			 United States Code, or any other provision of law, shall prevent the Postal
			 Service from promoting, or providing technical assistance in connection with,
			 the creation of small business and other mailing pools, the purpose of which is
			 to allow each member of such pool to take advantage of postage rates applicable
			 to bulk mailings and other discounts.</text>
			</subsection><subsection id="HED1CA8F03A54476281AA3A8D83D7CA0E"><enum>(b)</enum><header>Reporting
			 requirement</header><text>The Postal Service shall submit a written report to
			 Congress, at least once every 3 years, on the operation of this section.</text>
			</subsection></section><section id="H898B52031F4244CF9350DD7EDD6193FA"><enum>12.</enum><header>Electronic post
			 office box services</header>
			<subsection id="H342731F428574BDDA552AB4B7B19FB95"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Postal Service
			 may, in partnership with a private sector provider of electronic mail services,
			 carry out a pilot program which is designed to test the feasibility and
			 desirability of an integrated electronic system for the receipt, storage,
			 transport, and delivery of mail directed to physical addresses and post office
			 boxes.</text>
			</subsection><subsection id="H9CB79ABE5E5249C8AA40F99637D0FA84"><enum>(b)</enum><header>Reporting
			 requirement</header>
				<paragraph id="H27A32595FBCC41BCBEC76C7DEA395EA9"><enum>(1)</enum><header>In
			 general</header><text>Within 3 years after the date of enactment of this Act,
			 the Postal Service shall submit to Congress a report describing the design,
			 operation, and recommendations of the Postal Service with respect to the pilot
			 program under this section.</text>
				</paragraph><paragraph id="H3D7DB74CADD24796B7A21D8B64E94E90"><enum>(2)</enum><header>Role of
			 PRC</header><text>At least 6 months before submitting its report to Congress,
			 the Postal Service shall transmit a copy of its report to the Postal Regulatory
			 Commission for comments. The Postal Service shall append to the report any
			 written comments received from the Postal Regulatory Commission under this
			 paragraph.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H49EC88990DE440C7AB3668D8BA151DE0" section-type="subsequent-section"><enum>13.</enum><header>Contracting
			 provisions</header>
			<subsection id="H3440371E6B334A0A9D420B1E8B164A77"><enum>(a)</enum><header>In

						<paragraph id="HDB42119F68D24082A8B5C5CD252A9D38"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>contracting officer</term>
				means an employee of a covered postal entity who has authority to enter into a
				postal contract;</text>
						</paragraph><paragraph id="H2E71AFD6DD474E02BF572BCB58FD2D3D"><enum>(2)</enum><text>the term
				<term>covered postal entity</term> means—</text>
							<subparagraph id="H270506B3BC534450B8D7B4CF3AFA636D"><enum>(A)</enum><text>the United States
				Postal Service; or</text>
							</subparagraph><subparagraph id="H57D9F02B16F9441CA4DC8EBF2B7C8751"><enum>(B)</enum><text>the Postal
				Regulatory Commission;</text>
							</subparagraph></paragraph><paragraph id="H90E001E6D270454A83B776DC2A4E6F5E"><enum>(3)</enum><text>the term
				<term>head of a covered postal entity</term> means—</text>
							<subparagraph id="HEACEE7BEBD4E44A796B4D01219A048FE"><enum>(A)</enum><text>in the case of the
				United States Postal Service, the Postmaster General; or</text>
							</subparagraph><subparagraph id="H2445149C16DE4B9A8C8E8AD0DF5A7F99"><enum>(B)</enum><text>in the case of the
				Postal Regulatory Commission, the Postal Regulatory Commission;</text>
							</subparagraph></paragraph><paragraph id="H3983AC14A68B4208B8A41C6604DDE7F2"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>postal contract</term> means
				any contract (including any agreement or memorandum of understanding) entered
				into by a covered postal entity for the procurement of goods or services;
				and</text>
						</paragraph><paragraph id="HCC94A6C5787E488D9D8142507511FEA8"><enum>(5)</enum><text>the term
				<term>senior procurement executive</term> means the senior procurement
				executive of a covered postal entity.</text>
						</paragraph></section><section id="HA11CC9C0CA3744B4BEF2A3E8E8B2E963"><enum>702.</enum><header>Advocate for
				competition</header>
						<subsection id="H056F0234B9E24FD9836DDA800858875C"><enum>(a)</enum><header>Establishment
				and designation</header>
							<paragraph id="H546C6CCF1A044CDB98749D0E3AF9317A"><enum>(1)</enum><text>There is
				established in each covered postal entity an advocate for competition.</text>
							</paragraph><paragraph id="HC5562CAEDAEF45EB882A7BDDB32D3D05"><enum>(2)</enum><text>The head of each
				covered postal entity shall—</text>
								<subparagraph id="H83F60DF7AE5045ACA19E371E6D08ACEC"><enum>(A)</enum><text>designate for the
				covered postal entity and for each procuring activity of the covered postal
				entity 1 officer or employee (other than the senior procurement executive) to
				serve as the advocate for competition;</text>
								</subparagraph><subparagraph id="HF76F28A6031C4F6190CFDB5050BC5E13"><enum>(B)</enum><text>not assign such
				officer or employee any duties or responsibilities that are inconsistent with
				the duties and responsibilities of the advocates for competition; and</text>
								</subparagraph><subparagraph id="HA78620A0056A4505935587994E7FF30D"><enum>(C)</enum><text>provide such
				officer or employee with such staff or assistance as may be necessary to carry
				out the duties and responsibilities of the advocate for competition, such as
				persons who are specialists in engineering, technical operations, contract
				administration, financial management, supply management, and utilization of
				small and disadvantaged business concerns.</text>
								</subparagraph></paragraph></subsection><subsection id="H4AADC38AF1714ED5B52FF07619158B44"><enum>(b)</enum><header>Duties and
				functions</header><text>The advocate for competition of each covered postal
				entity shall—</text>
							<paragraph id="HC94074E0F67543D1B323FBCF5A8A38D0"><enum>(1)</enum><text>be responsible for
				challenging barriers to and promoting full and open competition in the
				procurement of goods and services by the covered postal entity;</text>
							</paragraph><paragraph id="H32F8C97219B84853A38458C7A1CF0CC0"><enum>(2)</enum><text>review the
				procurement activities of the covered postal entity;</text>
							</paragraph><paragraph id="H1201B0D1FAD54F0BB3A29A8E131CD9AB"><enum>(3)</enum><text>identify and
				report to the senior procurement executive—</text>
								<subparagraph id="H8D52E65EAC4A420F837668F386D7BB16"><enum>(A)</enum><text>opportunities and
				actions taken to maximize full and open competition in the procurement
				activities of the covered postal entity; and</text>
								</subparagraph><subparagraph id="HB037174F5C58474EA9F9F59EF4F34AF8"><enum>(B)</enum><text>any condition or
				action which has the effect of unnecessarily restricting competition in the
				procurement actions of the covered postal entity;</text>
								</subparagraph></paragraph><paragraph id="HF1D802E11BBC4583959C801ADCA1B9D0"><enum>(4)</enum><text>prepare and
				transmit to the head of each covered postal entity, the Board of Governors of
				the United States Postal Service, and Congress an annual report
				describing—</text>
								<subparagraph id="H57578E2849EE43CFAD6DF80666E49309"><enum>(A)</enum><text>the activities of
				the advocate under this section;</text>
								</subparagraph><subparagraph id="HE442EB38C05D4D4EB62075A8D73D64A6"><enum>(B)</enum><text>initiatives
				required to increase competition; and</text>
								</subparagraph><subparagraph id="HA574DF3F8B8F4B4A90348F0CC58CE70B"><enum>(C)</enum><text>barriers to the
				use of full and open competition to the maximum extent practicable;</text>
								</subparagraph></paragraph><paragraph id="HA5F57D199CDB462A85DA7C8E1B8DE86E"><enum>(5)</enum><text>recommend to the
				senior procurement executive the goals and the plans for increasing competition
				on a fiscal year basis;</text>
							</paragraph><paragraph id="HC2D8E7375D444FF38ECE930CE70858E6"><enum>(6)</enum><text>recommend to the
				senior procurement executive a system of personal and organizational
				accountability for competition, which may include the use of recognition and
				awards to motivate program managers, contracting officers, and others in
				authority to promote competition in procurement programs; and</text>
							</paragraph><paragraph id="H8E656B7E74A846338737885159D6BBC7"><enum>(7)</enum><text>describe other
				ways in which the covered postal entity has emphasized competition in programs
				for procurement training and research.</text>
							</paragraph></subsection><subsection id="H2434228EE7A54C10A9CB41A1756131AB"><enum>(c)</enum><header>Responsibilities</header><text>The
				advocate for competition for each procuring activity shall be responsible for
				promoting full and open competition, promoting the acquisition of commercial
				items, and challenging barriers to such acquisition, including such barriers as
				unnecessarily restrictive statements of need, unnecessarily detailed
				specifications, and unnecessarily burdensome contract clauses.</text>
						</subsection></section><section id="H2C55DBB4819C4D75B4FC7C9A11FE9C18"><enum>703.</enum><header>Delegation of
				contracting authority</header>
						<subsection id="HAE71BF902B72451C915FF0FA8B413840"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="HA2E15CC14D1548CAAD1E315B7F74D67C"><enum>(1)</enum><header>Policy</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
				enactment of the <short-title>U.S. Postal Service
				Improvements Act of 2010</short-title>, the head of each covered postal entity
				shall issue a policy on contracting officer delegations of authority for the
				covered postal entity.</text>
							</paragraph><paragraph id="HABB2A98AB71B4BA8AC8E1C1EA1C93224"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The policy issued under paragraph (1) shall
				require that—</text>
								<subparagraph id="HD94A5417F4B54C3FA6521E235ABEAE58"><enum>(A)</enum><text>notwithstanding
				any delegation of contracting authority, the ultimate responsibility and
				accountability for the award and administration of postal contracts resides
				with the senior procurement executive; and</text>
								</subparagraph><subparagraph id="HA920198ED4C146019242B1052658931A"><enum>(B)</enum><text>a contracting
				officer shall maintain an awareness of and engagement in the activities being
				performed on postal contracts for which that officer has cognizance
				notwithstanding any delegation of authority that may have been executed.</text>
								</subparagraph></paragraph></subsection><subsection id="H0E9E569BF12540D3B454485490FAC322"><enum>(b)</enum><header>Posting of
				delegations</header>
							<paragraph id="HE850DC69871B45B7BE3B1088013E3CF9"><enum>(1)</enum><header>In
				general</header><text>The head of each covered postal entity shall make any
				delegation of authority outside the functional contracting unit for the
				procurement of goods or services which exceeds the simplified acquisition
				threshold, as defined under section 4(11) of the Office of Federal Procurement
				Policy Act (41 U.S.C. 403(11)) including any adjustment under section 35A of
				that Act (41 U.S.C. 431A), available on the website of the covered postal
				entity.</text>
							</paragraph><paragraph id="H142CBFB428E14C609DEF3A065EB6F871"><enum>(2)</enum><header>Effective
				date</header><text>This paragraph shall apply to any delegation of authority
				made on or after 30 days after the date of enactment of the
				<short-title>U.S. Postal Service Improvements Act of
				2010</short-title>.</text>
							</paragraph></subsection></section><section id="H727DC92CA2494AF49CB65DA7F028A5F7"><enum>704.</enum><header>Posting of
				justifications of noncompetitive contracts</header>
						<subsection id="HC68C13DB7B4D43328E75DDE8F8246F3F"><enum>(a)</enum><header>In
				general</header><text>Not later than 14 days after the date of the award of any
				noncompetitive contract which exceeds the simplified acquisition threshold, as
				defined under section 4(11) of the Office of Federal Procurement Policy Act (41
				U.S.C. 403(11)) including any adjustment under section 35A of that Act (41
				U.S.C. 431A), or within 30 days if the justification and approval for that
				contract is urgent and compelling, a covered postal entity shall make publicly
				available the documents containing the justification and approval of that
				contract.</text>
						</subsection><subsection id="H0A96163D57A64EF6A93A2154F8E36391"><enum>(b)</enum><header>Website</header>
							<paragraph id="H5AD2BD833CFA4DBCAF93F14052A6E85F"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the documents described under
				subsection (a) shall be made available on the website of the covered postal
				entity.</text>
							</paragraph><paragraph id="H37D8481BF4EB4676BA9CC79F9A5D8AEA"><enum>(2)</enum><header>Protection of
				proprietary information</header><text>The covered postal entity shall carefully
				screen all justifications for proprietary data, and any references and
				citations as are necessary to protect the proprietary data, or security related
				information and remove all such data or information before making the
				justifications available.</text>
							</paragraph></subsection></section><section id="H3B4895509C8541E3961DFA6AA64C9AB9"><enum>705.</enum><header>Review of
				ethical issues</header><text display-inline="no-display-inline">If a
				contracting officer identifies any ethical issues relating to a proposed
				contract and submits those issues and that proposed contract to the designated
				ethics official for the covered postal entity before the awarding of that
				contract, that ethics official shall—</text>
						<paragraph id="HEB7931DFD48E416F85308FCE22120D08"><enum>(1)</enum><text>review the
				proposed contract; and</text>
						</paragraph><paragraph id="H332EEE9AC8224337BFCB0EAB6748DDA2"><enum>(2)</enum><text>advise the
				contracting officer on the appropriate resolution of ethical issues.</text>
						</paragraph></section><section id="HC37097024E244B22B57DAB3C92BF2F0F"><enum>706.</enum><header>Ban on certain
				contracts</header>
						<subsection id="HF2A1BD7A92A944499FCBAB2248855418"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="HDD5A340B58F44C3089135509E737936A"><enum>(1)</enum><text>the term
				<term>covered employee</term> means—</text>
								<subparagraph id="H17F4F12756394FD2BFCA905027B60B7E"><enum>(A)</enum><text>a contracting
				officer; or</text>
								</subparagraph><subparagraph id="H75C64158B1B44B05AFBE745567AA9F5A"><enum>(B)</enum><text>any employee of a
				covered postal entity whose decisionmaking affects a postal contract as
				determined by regulations prescribed by the head of a covered postal entity;
				and</text>
								</subparagraph></paragraph><paragraph id="H1A76D3E1FEFA4AA482D5AD8AC3CB3E11"><enum>(2)</enum><text>the term
				<term>final conviction</term> means a conviction, whether entered on a verdict
				or plea, including a plea of nolo contendere, for which a sentence has been
				imposed;</text>
							</paragraph></subsection><subsection id="HEB567FFEAFCD4F2A94B107FB99E4F4C4"><enum>(b)</enum><header>In
				general</header>
							<paragraph id="H04444172B817498DAA8BB88D6EA6EA5E"><enum>(1)</enum><header>Regulations</header><text>The
				head of each covered postal entity shall prescribe regulations that—</text>
								<subparagraph id="H8F79A98E781B4BA2A3EF6C5BA1E27C33"><enum>(A)</enum><text>prohibit a covered
				employee from entering into a postal contract with any party with whom that
				covered employee is closely affiliated in a nongovernmental capacity,
				regardless of whether or not the postal contract is for private gain;</text>
								</subparagraph><subparagraph id="HD600FCC5C5764C36BC3030E332AF0CDF"><enum>(B)</enum><text>require a
				contractor to timely disclose to the chief ethics officers of the covered
				postal entity any relationship described under subparagraph (A) with a covered
				employee in a bid, solicitation, award, or performance of a postal contract;
				and</text>
								</subparagraph><subparagraph id="HBA241635E74F4676B96E5BCF8BC3500C"><enum>(C)</enum><text>include authority
				for the head of the covered postal entity to a grant waiver to any prohibition
				or requirement under subparagraph (A) or (B).</text>
								</subparagraph></paragraph><paragraph id="H084D08B6109E474FB2A48A75DD777D53"><enum>(2)</enum><header>Posting of
				waivers</header><text>Not later than 30 days after the head of a covered postal
				entity grants a waiver described under paragraph (1)(C), the head of the
				covered postal entity shall make the waiver available on the website of the
				covered postal entity.</text>
							</paragraph></subsection><subsection id="HC57AF4889D854A33822D0D15D43F55D4"><enum>(c)</enum><header>Contract
				voidance and recovery</header>
							<paragraph id="H8AB478FD4A7D4ED58459D867C4843332"><enum>(1)</enum><header>Bribery and
				graft convictions</header><text>In any case in which there is a final
				conviction for a violation of any provision of chapter 11 of title 18 relating
				to a postal contract, the head of a covered postal entity may—</text>
								<subparagraph id="H7DB6307969CA42F0BB313EBE8D717565"><enum>(A)</enum><text>void that
				contract; and</text>
								</subparagraph><subparagraph id="H1FDA8732F9284E10AE6FC8DD86F816C0"><enum>(B)</enum><text>recover the
				amounts expended and property transferred by the covered postal entity under
				that contract.</text>
								</subparagraph></paragraph><paragraph id="H3394FC49078041E9B3B556FC22B9589E"><enum>(2)</enum><header>Obtaining or
				disclosing procurement information</header>
								<subparagraph id="H063EF37F5F04462FB4B693161B30C8B7"><enum>(A)</enum><header>In
				general</header><text>In any case described under subparagraph (B) relating to
				a postal contract, the head of a covered postal entity may—</text>
									<clause id="H2DC2A1DBBA0245AA98C4C6CD520A4E2C"><enum>(i)</enum><text>void that
				contract; and</text>
									</clause><clause id="HA4E3DCBB449848C8881919AC3D01F5FC"><enum>(ii)</enum><text>recover the
				amounts expended and property transferred by the covered postal entity under
				that contract.</text>
									</clause></subparagraph><subparagraph id="H23D965EAB61642E3B3532B7F9F4D0BEA"><enum>(B)</enum><header>Conviction or
				administrative determination</header><text>A case described under subparagraph
				(A) is any case in which—</text>
									<clause id="HC08EA10631D84BEBA356F1AB4A7F0884"><enum>(i)</enum><text>there is a final
				conviction for an offense punishable under section 27(e) of the Office of
				Federal Procurement Policy Act (41 U.S.C. 423(e)); or</text>
									</clause><clause id="HD7A984F2058640C89281EBA98DD3FE02"><enum>(ii)</enum><text>the head of a
				covered postal entity determines, based upon a preponderance of the evidence,
				that the contractor or someone acting for the contractor has engaged in conduct
				constituting an offense punishable under section 27(e) of that
				Act.</text>
									</clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H61D96CA6C2D84AE38FE7DEC6E302F8B8"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of chapters for part I of title
			 39, United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section display-inline="no-display-inline" id="H58A424091D944173B953B0C772307A89" section-type="subsequent-section"><enum>14.</enum><header>Supervisory and other
			 managerial organizations of the Postal Service</header><text display-inline="no-display-inline">Section 1004 of title 39, United States
			 Code, is amended—</text>
			<paragraph id="HE2A0993846A049ACA6373B97BA056D61"><enum>(1)</enum><text>in subsection (a),
			 by inserting <quote>to ensure reasonable and sustainable workloads and
			 schedules for supervisory and management employees;</quote> after <quote>other
			 managerial personnel;</quote>;</text>
			</paragraph><paragraph id="H60D385412C5D4038837AFE2B4448A656"><enum>(2)</enum><text>in subsection (b)
			 (in the second sentence), by inserting <quote>as provided under subsection (d)
			 and any changes in, or termination of, pay policies and schedules and fringe
			 benefit programs for members of the supervisors’ organization as provided under
			 subsection (e)</quote> before the period; and</text>
			</paragraph><paragraph id="HBEA3388D7FCD443EBB927845E1657A92"><enum>(3)</enum><text>in subsection
			 (e)(1), by inserting <quote>, or termination of,</quote> after <quote>any
			 changes in</quote>.</text>
			</paragraph></section><section id="HD8DF9591028D43F38E904401ABC3DB54"><enum>15.</enum><header>Energy
			 efficiency projects</header>
			<subsection id="HF91D17B3B50349F390E778F5B9D993C8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In order to help
			 finance energy efficiency projects with respect to postal operations and
			 facilities, the Postal Service shall have available to it the authority
			 described in subsection (b).</text>
			</subsection><subsection id="H501697497E6E434F9A9EB77EE6F0DC5B"><enum>(b)</enum><header>Authority
			 described</header><text>The authority described in this subsection is the
			 authority to borrow money and to issue and sell obligations. The authority
			 described in the preceding sentence shall be available to the Postal
			 Service—</text>
				<paragraph id="HDB0D924C757A4635B7F59AA22B37DDB3"><enum>(1)</enum><text>in order to carry
			 out subsection (a), subject to the same terms and conditions as apply with
			 respect to the corresponding authority made available under paragraph (3) of
			 section 4(a) in order to carry out the purposes of such section 4(a); except
			 that</text>
				</paragraph><paragraph id="H37521F2DA9EE4E049695800CDC9A53D4"><enum>(2)</enum><text>the aggregate
			 amount of obligations outstanding under this paragraph at any one time shall
			 not exceed $1,000,000,000.</text>
				</paragraph></subsection><subsection id="H93AEC963863842C893B8AD39C4E12A22"><enum>(c)</enum><header>Reporting
			 requirement</header><text>The Postal Service shall submit a written report to
			 Congress, once every 2 years, on the operation of this section.</text>
			</subsection></section><section commented="no" id="H10ED4904710741988F72D5EDBA8C3D1D"><enum>16.</enum><header>Required period
			 for notice and comment with respect to changes in mailing rules</header>
			<subsection commented="no" id="HD724FA3800DA4170B9C39833DB26340E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Postal Service
			 shall by regulation establish procedures under which, before adding,
			 eliminating, or modifying any mailing rules—</text>
				<paragraph commented="no" id="H44BF29935F9A4949A57D0DE1FF39042A"><enum>(1)</enum><text>notice of the
			 proposed change shall be provided by publication in the Federal Register;
			 and</text>
				</paragraph><paragraph commented="no" id="H9A2FC6112B2B4F71BA387BFC2AD477BF"><enum>(2)</enum><text>a minimum of 30
			 days shall be provided, after the date of such publication, for public
			 comment.</text>
				</paragraph></subsection><subsection commented="no" id="H9AC713888DDA4DD2919465492C90BB0E"><enum>(b)</enum><header>Exceptions</header><text>Subsection
			 (a)—</text>
				<paragraph commented="no" id="H0CF54A96EB44400FB273D45049C5DECE"><enum>(1)</enum><text display-inline="yes-display-inline">shall not apply to any classification or
			 other rules changes that must be brought before the Postal Regulatory
			 Commission; and</text>
				</paragraph><paragraph commented="no" id="HA743330790CE482E8AA67695586462DF"><enum>(2)</enum><text display-inline="yes-display-inline">shall not apply to any change that the
			 Postmaster General certifies has a cumulative cost, to users of the mail, of
			 less than $5,000,000 per year.</text>
				</paragraph></subsection><subsection commented="no" id="HE3F12F842D7B4ED6B7EDB59F9F9C3B81"><enum>(c)</enum><header>Mailing rules
			 defined</header><text display-inline="yes-display-inline">For purposes of this
			 section, the term “mailing rules” means any rules or other requirements of the
			 Postal Service—</text>
				<paragraph commented="no" id="H74CAAE2EBC28491C9F24BC6CF007E814"><enum>(1)</enum><text>for qualifying,
			 entering, accepting, certifying, or validating mail for specific rates,
			 products, or services; or</text>
				</paragraph><paragraph commented="no" id="HABC51B8D6217459BAB03F46C4BA077FA"><enum>(2)</enum><text>otherwise
			 affecting utilization of the postal system, by a business, nonprofit mailer, or
			 other person.</text>
				</paragraph><continuation-text commented="no" continuation-text-level="subsection">Such term includes any rule or other
			 requirement that increases the cost of compliance with existing rules or
			 requirements, whether or not reflected in any discount provided.</continuation-text></subsection></section><section id="H0CB3716D83464DC7B5ACED06ADFA1AF3"><enum>17.</enum><header>Negotiated
			 service agreements for market-dominant products</header><text display-inline="no-display-inline">The Postal Service shall submit a written
			 report to Congress, once every 2 years, on measures taken, progress achieved,
			 and any impediments encountered, with respect to the implementation of the
			 special classifications and agreements (as described in section subsection
			 (c)(10) of section 3622 of title 39, United States Code), in connection with
			 the establishment and operation of a system for regulating rates and classes
			 for market-dominant products.</text>
		</section><section id="H04C9D5FDE65A48E0801C27AC71C82C64"><enum>18.</enum><header>Electronic
			 communication products</header><text display-inline="no-display-inline">The
			 Postal Service and Postal Regulatory Commission shall, within 12 months after
			 the date of the enactment of this Act, report to Congress on the advisability
			 of creating a not-for-profit venture capital program to help the Postal Service
			 identify and develop electronic communication products that would increase net
			 revenue for the Postal Service.</text>
