		<official-title>To amend title 5, United States Code, to provide that
		  civilian employees of the Department of Defense performing unsatisfactory work
		  shall not be eligible for annual nationwide adjustments to pay
		  schedules.</official-title>

		<section id="HBAE4EA0C108E4B92927E25C157B0DFEB" section-type="section-one"><enum>1.</enum><header>Denial of pay adjustments for
			 unsatisfactory performance</header>
			<subsection id="HC5CF6D87C4A5404D8BDCC1AAA0FE700F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5303 of title
			 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7E2170D4D1134C4B9F8ED2FA1DCA366A" style="USC">
					<subsection id="H9AF6F36204094EAAAC08443C45303D4B"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0D03BFD5808F4643B55D842BA66A9332"><enum>(1)</enum><text>Notwithstanding any
				other provision of this section, an adjustment under this section shall not be
				made in the case of any employee of the Department of Defense having an
				unacceptable performance rating.</text>
						</paragraph><paragraph id="HA56DC95C899846D98FBFF10F0B55C905" indent="up1"><enum>(2)</enum><text>For purposes of administering any
				provision of law, rule, or regulation which—</text>
							<subparagraph id="H1E1C60E1027A49C49144DA375511E28B"><enum>(A)</enum><text>provides premium pay, retirement, life
				insurance, or any other employee benefit which requires any deduction or
				contribution,</text>
							</subparagraph><subparagraph id="HF3B219C5FA9F43AA8A0E69D5FE547AC0"><enum>(B)</enum><text>imposes any requirement or limitation,
				or</text>
							</subparagraph><subparagraph id="HA62505164B414F0D91EBF5F77AAA476B"><enum>(C)</enum><text>requires any other computation (such
				as under section 5304(c)(1)(B)),</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">on the
				basis of a rate of basic pay, the rate of basic pay payable after the
				application of paragraph (1) shall be treated as the rate of basic pay for the
				employee
				involved.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5B6ECBB31C2D4EF987BBD852AF5D3C8B"><enum>(b)</enum><header>Regulations</header><text>The
			 Secretary of Defense, in consultation with the Director of the Office of
			 Personnel Management, may prescribe any regulations necessary to carry out the
			 purposes of this section.</text>
