		<official-title>To extend to the Mayor of the District of Columbia the
		  same authority over the National Guard of the District of Columbia as the
		  Governors of the several States exercise over the National Guard of those
		  States with respect to administration of the National Guard and its use to
		  respond to natural disasters and other civil disturbances, while ensuring that
		  the President retains control of the National Guard of the District of Columbia
		  to respond to homeland defense emergencies.</official-title>

		<section id="H169CF3B1060E47EE8DCFA2F47F0584A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>District of Columbia National Guard
			 Home Rule Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H2A213DD839AD49708819ECD19294DBC3"><enum>2.</enum><header>Extension of
			 National Guard authorities to Mayor of the District of Columbia</header>
			<subsection id="HBB6E415743364FADAA3BA20CD42850D0"><enum>(a)</enum><header>Mayor as
			 Commander-in-Chief</header><text>Section 6 of the Act entitled <quote>An Act to
			 provide for the organization of the militia of the District of Columbia, and
			 for other purposes</quote>, approved March 1, 1889 (sec. 49–409, D.C. Official
			 Code), is amended by striking <quote>President of the United States</quote> and
			 inserting <quote>Mayor of the District of Columbia</quote>.</text>
			</subsection><subsection id="HB91BD9B1010440E2AFD283C8EF82F234"><enum>(b)</enum><header>Reserve
			 corps</header><text>Section 72 of such Act (sec. 49–407, D.C. Official Code) is
			 amended by striking <quote>President of the United States</quote> each place it
			 appears and inserting <quote>Mayor of the District of Columbia</quote>.</text>
			</subsection><subsection id="HA932D6F07FB6403896997046AC533577"><enum>(c)</enum><header>Appointment of
			 commissioned officers</header><paragraph commented="no" display-inline="yes-display-inline" id="HEA7CFB5EB370438C90D2076F7F7E61A5"><enum>(1)</enum><text>Section 7(a) of such Act
			 (sec. 49–301(a), D.C. Official Code) is amended—</text>
					<subparagraph id="H2C5079184B5A463D9FD4518FB5D6468B" indent="up1"><enum>(A)</enum><text>by striking <quote>President of the
			 United States</quote> and inserting <quote>Mayor of the District of
			 Columbia</quote>; and</text>
					</subparagraph><subparagraph id="HAD8E02044485424A8B68C843F7D4BE09" indent="up1"><enum>(B)</enum><text>by striking <quote>President.</quote>
			 and inserting <quote>Mayor.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC1D221FDA507439BA98BCB50DEA138F1" indent="up1"><enum>(2)</enum><text>Section 9 of such Act (sec. 49–304,
			 D.C. Official Code) is amended by striking <quote>President</quote> and
			 inserting <quote>Mayor of the District of Columbia</quote>.</text>
				</paragraph><paragraph id="H4346CCBD754C491AAC492FE59D7A6996" indent="up1"><enum>(3)</enum><text>Section 13 of such Act (sec. 49–305,
			 D.C. Official Code) is amended by striking <quote>President of the United
			 States</quote> and inserting <quote>Mayor of the District of
			 Columbia</quote>.</text>
				</paragraph><paragraph id="H5736B9E890054686B83E3B87A75A32CC" indent="up1"><enum>(4)</enum><text>Section 19 of such Act (sec. 49–311,
			 D.C. Official Code) is amended—</text>
					<subparagraph id="H2637DF755D6845FFB9AF32C90A860751"><enum>(A)</enum><text>in subsection (a), by striking
			 <quote>to the Secretary of the Army</quote> and all that follows through
			 <quote>which board</quote> and inserting <quote>to a board of examination
			 appointed by the Commanding General, which</quote>; and</text>
					</subparagraph><subparagraph id="H7EEAAEA2750243B1AB2EE38D2A1C71BB"><enum>(B)</enum><text>in subsection (b), by striking
			 <quote>the Secretary of the Army</quote> and all that follows through the
			 period and inserting <quote>the Mayor of the District of Columbia, together
			 with any recommendations of the Commanding General.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HE3AEF972BAAD4AE083B43EF1BF8EC18B" indent="up1"><enum>(5)</enum><text>Section 20 of such Act (sec. 49–312,
			 D.C. Official Code) is amended—</text>
					<subparagraph id="HA35D04BE791C4CD2871B71FD4D5816E4"><enum>(A)</enum><text>by striking <quote>President of the
			 United States</quote> each place it appears and inserting <quote>Mayor of the
			 District of Columbia</quote>; and</text>
					</subparagraph><subparagraph id="HD7BD5D09C5FE4392B96E819BFB4841D7"><enum>(B)</enum><text>by striking <quote>the President may
			 retire</quote> and inserting <quote>the Mayor may retire</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HC4BAAC70065345019857307C60EC3C88"><enum>(d)</enum><header>Call for
			 duty</header><paragraph commented="no" display-inline="yes-display-inline" id="H88F6E644C7AE49F0881AE90CA936B0A0"><enum>(1)</enum><text>Section 45 of such Act
			 (sec. 49–103, D.C. Official Code) is amended by striking <quote>, or for the
			 United States Marshal</quote> and all that follows through <quote>shall
			 thereupon order</quote> and inserting <quote>to order</quote>.</text>
				</paragraph><paragraph id="HE7CE708D80D647DFA57400B188D59FEA" indent="up1"><enum>(2)</enum><text>Section 46 of such Act (sec. 49–104,
			 D.C. Official Code) is amended by striking <quote>the President</quote> and
			 inserting <quote>the Mayor of the District of Columbia</quote>.</text>
				</paragraph></subsection><subsection id="HE14BE634EB984E37BE714F3226D1D807"><enum>(e)</enum><header>General courts
			 martial</header><text>Section 51 of such Act (sec. 49–503, D.C. Official Code)
			 is amended by striking <quote>the President of the United States</quote> and
			 inserting <quote>the Mayor of the District of Columbia</quote>.</text>
			</subsection></section><section id="HDD89C0D862CD4EFB97620FA11391498E"><enum>3.</enum><header>Retention of
			 Presidential authority over use of National Guard of the District of Columbia
			 to respond to homeland defense emergencies</header>
			<subsection id="H9F4D6E5DBB9C43629DB6E2B5295943E4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 9 of title
			 32, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H811C9277A1074D428158530B614E5AE4" style="USC">
					<section id="HF49EDEE186E44676AEE7C12832AFC91B"><enum>909.</enum><header>Control of
				National Guard of the District of Columbia for homeland defense
				activities</header><text display-inline="no-display-inline">Notwithstanding the
				authority of the Mayor of the District of Columbia as the Commander-in-Chief of
				the National Guard of the District of Columbia, as provided by section 6 of the
				Act entitled <quote>An Act to provide for the organization of the militia of
				the District of Columbia, and for other purposes</quote>, approved March 1,
				1889 (sec. 49–409, D.C. Official Code), the President retains control over
				units and members of the National Guard of the District of Columbia to conduct
				homeland defense activities that the President determines to be necessary and
				appropriate for participation by the National Guard units or
				members.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA8B9E376B1D5483BAB15071DA48EB871"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

			<subsection id="H02741226C4A84DEFA0D45DB44CDD3544"><enum>(a)</enum><header>Failure to
			 satisfactorily perform prescribed training</header><text>Section 10148(b) of
			 such title is amended by striking <quote>the commanding general of the District
			 of Columbia National Guard</quote> and inserting <quote>the Mayor of the
			 District of Columbia</quote>.</text>
			</subsection><subsection id="HA6D58C4B20004CC7BBD8AC3E47741532"><enum>(b)</enum><header>Appointment of
			 chief of National Guard bureau</header><text>Section 10502(a)(1) of such title
			 is amended by striking <quote>the commanding general of the District of
			 Columbia National Guard</quote> and inserting <quote>the Mayor of the District
			 of Columbia</quote>.</text>
			</subsection><subsection id="H49943482381B4C11B1D30218850F857D"><enum>(c)</enum><header>Vice chief of
			 National Guard bureau</header><text>Section 10505(a)(1)(A) of such title is
			 amended by striking <quote>the commanding general of the District of Columbia
			 National Guard</quote> and inserting <quote>the Mayor of the District of
			 Columbia</quote>.</text>
			</subsection><subsection id="HDDD3C6AA29D64C2686866A909832C81F"><enum>(d)</enum><header>Other senior
			 National Guard bureau officers</header><text>Section 10506(a)(1) of such title
			 is amended by striking <quote>the commanding general of the District of
			 Columbia National Guard</quote> both places it appears and inserting <quote>the
			 Mayor of the District of Columbia</quote>.</text>
			</subsection><subsection id="H88894B2F33D94BF6BBC498AEEEC51FE9"><enum>(e)</enum><header>Consent for
			 active duty or relocation</header><paragraph commented="no" display-inline="yes-display-inline" id="H51033B38FB244361993B7E908C302BC0"><enum>(1)</enum><text>Section 12301 of title
			 10, United States Code, is amended—</text>
					<subparagraph id="H5A9E3400A0A04747A3DEFB147078B7A5" indent="up1"><enum>(A)</enum><text>in subsection (b), by striking
			 <quote>commanding general of the District of Columbia National Guard</quote> in
			 the second sentence and inserting <quote>Mayor of the District of
			 Columbia</quote>; and</text>
					</subparagraph><subparagraph id="HEBB0D4D771F84EBAA3F6780A9D50EF7F" indent="up1"><enum>(B)</enum><text>in subsection (d), by striking
			 <quote>governor or other appropriate authority of the State concerned</quote>
			 and inserting <quote>governor of the State (or, in the case of the District of
			 Columbia National Guard, the Mayor of the District of Columbia)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H101315F210BC4B1D87DF26F76BF7A296" indent="up1"><enum>(2)</enum><text>Section 12406 of such title is
			 amended by striking <quote>the commanding general of the National Guard of the
			 District of Columbia</quote> and inserting <quote>the Mayor of the District of
			 Columbia</quote>.</text>
				</paragraph></subsection><subsection id="HAACDAA036D0241E48F5A5CF5F051D35C"><enum>(f)</enum><header>Consent for
			 relocation of units</header><text>Section 18238 of such title is amended by
			 striking <quote>the commanding general of the National Guard of the District of
			 Columbia</quote> and inserting <quote>the Mayor of the District of
			 Columbia</quote>.</text>
			</subsection></section><section id="H5F4150253BD44DB5A13B91B055310FAA"><enum>5.</enum><header>Conforming
			 amendments to title <enum-in-header>32</enum-in-header>, United States
			 Code</header>
			<subsection id="HA3305892C5C64E4DB7FADE525EAF72F5"><enum>(a)</enum><header>Maintenance of
			 other troops</header><text>Section 109(c) of title 32, United States Code, is
			 amended by striking <quote>(or commanding general in the case of the District
			 of Columbia)</quote>.</text>
			</subsection><subsection id="H6C5D1145D7EC44DFA3731ACBED819214"><enum>(b)</enum><header>Drug
			 interdiction and Counter-Drug activities</header><text>Section 112(h)(2) of
			 such title is amended by striking <quote>the Commanding General of the National
			 Guard of the District of Columbia</quote> and inserting <quote>the Mayor of the
			 District of Columbia</quote>.</text>
			</subsection><subsection id="HD514919FEF8641398B1F3898FEEA6663"><enum>(c)</enum><header>Additional
			 assistance</header><text>Section 113 of such title is amended by adding at the
			 end the following new subsection:</text>
