		<section id="HF97A2B818BF94856A8DF2C03CFFFF8C9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Marine Debris Act Amendments of
			 2012</short-title></quote>.</text>
		</section><section id="H1925D8DCF3D949198F34E8A485DCB455"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment is expressed as an amendment to a section or
			 other provision, the reference shall be considered to be made to a section or
			 other provision of the Marine Debris Research, Prevention, and Reduction Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1951">33 U.S.C. 1951 et
			 seq.</external-xref>), as in effect immediately before the enactment of this
			 Act.</text>
		</section><section id="H53291CE27F5B46448E701C7D75254C00"><enum>3.</enum><header>Short title
			 amendment</header><text display-inline="no-display-inline">Section 1
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1951">33 U.S.C.
			 1951</external-xref> note) is amended by striking <quote>Research, Prevention,
			 and Reduction</quote>.</text>
		</section><section id="H6C4FED0B98EE4B078AA56F2B4C523B06"><enum>4.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 2 (<external-xref legal-doc="usc" parsable-cite="usc/33/1951">33 U.S.C. 1951</external-xref>) is amended to read
			 as follows:</text>

				<section id="H9729D629E1644218B3A29B8BB202C30F"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to address the
				adverse impacts of marine debris on the United States economy, the marine
				environment, and navigation safety through identification, determination of
				sources, assessment, prevention, reduction, and removal of marine
				debris.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2138AD8FDC9B4151BC72CC084B351A36"><enum>5.</enum><header>NOAA Marine
			 Debris Program</header>
			<subsection id="H1702C0D450824719BF4847D877EE1A90"><enum>(a)</enum><header>Name of
			 program</header>
				<paragraph id="H966C673320724DBCBD229B10062EB176"><enum>(1)</enum><header>In
			 general</header><text>Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended—</text>
					<subparagraph commented="no" id="H8F34B1B797504C568640662DC244574D"><enum>(A)</enum><text>in the section
			 heading by striking <quote><header-in-text level="section" style="OLC">prevention and removal</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HA8854938FFB64B4F8CABC2296756DB0B"><enum>(B)</enum><text>in subsection
			 (a)—</text>
						<clause id="H302F4433F98948DDA1D78DB80DDFA3B4"><enum>(i)</enum><text>by
			 striking <quote>Prevention and Removal Program to reduce and prevent</quote>
			 and inserting <quote>Program to identify, determine sources of, assess,
			 prevent, reduce, and remove</quote>;</text>
						</clause><clause id="HE734240459BB44ABA87717E8755D35EC"><enum>(ii)</enum><text>by
			 inserting <quote>the economy of the United States,</quote> after <quote>marine
			 debris on</quote>; and</text>
						</clause><clause id="H053AE2ADC5274D2AA9BF0E3665430BDC"><enum>(iii)</enum><text>by
			 inserting a comma after <quote>environment</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="H8C33BB5DD48B4A0E914AE23C3D316EE5"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Paragraph (7) of section 7 (<external-xref legal-doc="usc" parsable-cite="usc/33/1956">33 U.S.C. 1956</external-xref>) is
			 amended by striking <quote>Prevention and Removal</quote>.</text>
				</paragraph></subsection><subsection id="H05A0843B4F4A42858C5BB3211BC12FE1"><enum>(b)</enum><header>Program
			 components</header><text>Section 3(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(b)</external-xref>) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H07B033CEECF44634AF213D6379FE02B5" style="OLC">
					<subsection id="H5DABA44BAFDF43AA8C15DCA3AB563AD0"><enum>(b)</enum><header>Program
				components</header><text display-inline="yes-display-inline">The Administrator,
				acting through the Program and subject to the availability of appropriations,
				shall—</text>
						<paragraph commented="no" id="HA4626449A2524EF380868EEDB0B586B3"><enum>(1)</enum><text>identify,
				determine sources of, assess, prevent, reduce, and remove marine debris, with a
				focus on marine debris posing a threat to living marine resources and
				navigation safety;</text>
						</paragraph><paragraph id="HA751B112EC5B4C93BCC58B0577752BF0"><enum>(2)</enum><text>provide national
				and regional coordination to assist States, Indian tribes, and regional
				organizations in identification, determination of sources, assessment,
				prevention, reduction, and removal of marine debris;</text>
						</paragraph><paragraph id="H4006D0AAFEA640C88E7F7D28B4F489CB"><enum>(3)</enum><text>undertake efforts
				to reduce adverse impacts of lost and discarded fishing gear on living marine
				resources and navigation safety, including—</text>
							<subparagraph id="H3BDF85DCAC224052A3C4D482544188E2"><enum>(A)</enum><text>research and
				development of alternatives to gear posing threats to the marine environment,
				and methods for marking gear used in specific fisheries to enhance the
				tracking, recovery, and identification of lost and discarded gear; and</text>
							</subparagraph><subparagraph id="HF7A34894C16A42C78B4DDD6C6512DE95"><enum>(B)</enum><text>development of
				effective nonregulatory measures and incentives to cooperatively reduce the
				volume of lost and discarded fishing gear and to aid in its recovery;
				and</text>
							</subparagraph></paragraph><paragraph id="HE7BA95C6E62F47C19869D4820717F4BD"><enum>(4)</enum><text>undertake outreach
				and education of the public and other stakeholders on sources of marine debris,
				threats associated with marine debris, and approaches to identify, determine
				sources of, assess, prevent, reduce, and remove marine debris and its adverse
				impacts on the United States economy, the marine environment, and navigational
				safety, including outreach and education activities through public-private
				initiatives.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBE90F8CE52DB4E83B7093D677AD9F1CC"><enum>(c)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 2204 of the Marine Plastic
			 Pollution Research and Control Act of 1987 and the item relating to that
			 section in the table of contents contained in section 2 of the United
			 States-Japan Fishery Agreement Approval Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/33/1915">33 U.S.C. 1915</external-xref>) are
			 repealed.</text>
			</subsection><subsection id="H8C10907A79944EFCAD82C328AF79E6F9"><enum>(d)</enum><header>Grant criteria
			 and guidelines</header><text>Section 3(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(c)</external-xref>) is
			 amended—</text>
				<paragraph id="HA905F2A6DD364FD6BD96BE1E0BB526C8"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>section 2(1)</quote> and inserting <quote>section
			 2</quote>;</text>
				</paragraph><paragraph id="HDC9F72CFD717458A9E081764A5A779E0"><enum>(2)</enum><text>by repealing
			 paragraph (5); and</text>
				</paragraph><paragraph id="H5EA90598FCE24DEB93D3672E122E7869"><enum>(3)</enum><text>by redesignating
			 paragraphs (6) and (7) as paragraphs (5) and (6).</text>
				</paragraph></subsection></section><section id="H4D17AAA9B71B4909803F3D2E8AF54A33"><enum>6.</enum><header>Repeal of
			 obsolete provisions</header><text display-inline="no-display-inline">Section 4
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1953">33 U.S.C.
			 1953</external-xref>) is amended—</text>
			<paragraph id="H9CD3FEE0089544C5B24765B051C1EDB8"><enum>(1)</enum><text>by striking
			 <quote>(a) <header-in-text level="subsection" style="OLC">Strategy.—</header-in-text></quote>; and</text>
			</paragraph><paragraph id="H646E410FF59644F5A7EDBF37B8D731E4"><enum>(2)</enum><text>by repealing
			 subsections (b) and (c).</text>
			</paragraph></section><section id="H7C885667ECB8411DBBFAEB3E845AF43E"><enum>7.</enum><header>Amendments to
			 definitions</header>
			<subsection id="HC7D31B2F88894F519B233A08A39B0F02"><enum>(a)</enum><header>Interagency
			 Marine Debris Coordinating Committee</header>
				<paragraph id="HDC003A3CD3F74C9C819E28469FF75FD3"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in subsection (b), section 2203 of the
			 Marine Plastic Pollution Research and Control Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/33/1914">33 U.S.C. 1914</external-xref>) is
			 redesignated and moved to replace and appear as section 5 of the Marine Debris
			 Research, Prevention, and Reduction Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1954">33 U.S.C. 1954</external-xref>).</text>
				</paragraph><paragraph id="HFB3736E8FAA94D9F9E42F44F024A8E1C"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The item relating
			 to section 2203 in the table of contents contained in section 2 of the United
			 States-Japan Fishery Agreement Approval Act of 1987 is repealed.</text>
				</paragraph></subsection><subsection id="HECB14A94D7F34105B69A9D516D261D19"><enum>(b)</enum><header>Biennial
			 progress reports</header><text>Section 5(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/33/1954">33 U.S.C. 1954(c)(2)</external-xref>), as in effect
			 immediately before the enactment of this Act—</text>
				<paragraph id="H8E6E0E685CFE46868DCE4A2D0540AB56"><enum>(1)</enum><text>is redesignated as
			 subsection (e) of section 5, as redesignated and moved by the amendment made by
			 subsection (a) of this section; and</text>
				</paragraph><paragraph id="H3E432AEE490344929742DF62320D460B"><enum>(2)</enum><text>is amended—</text>
					<subparagraph id="H4818D2F2179D444D819E7D0091FE7FA6"><enum>(A)</enum><text>by striking
			 <quote><header-in-text level="paragraph" style="OLC">Annual progress
			 reports</header-in-text>.—</quote> and all that follows through
			 <quote>thereafter</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Biennial progress
			 reports</header-in-text>.—Bienially</quote>;</text>
					</subparagraph><subparagraph id="H6460D08FA71843A2BB9C00AA5DD74EF9"><enum>(B)</enum><text>by inserting
			 <quote>Natural</quote> before <quote>Resources</quote>;</text>
					</subparagraph><subparagraph id="H36A4460042974C708D9C93C4462E49F8"><enum>(C)</enum><text>by redesignating
			 subparagraphs (A) through (E) as paragraphs (1) through (5) of such subsection;
			 and</text>
					</subparagraph><subparagraph id="H82638BA0B53A41C394178257AF6DB658"><enum>(D)</enum><text>by moving such
			 subsection 2 ems to the left.</text>
					</subparagraph></paragraph></subsection></section><section id="H3FAB204FC7664B1F8AE62C520CA70EA7"><enum>8.</enum><header>Confidentiality
			 of submitted information</header><text display-inline="no-display-inline">Section 6(2) (<external-xref legal-doc="usc" parsable-cite="usc/33/1955">33 U.S.C. 1955(2)</external-xref>) is amended by
			 striking <quote>by the fishing industry</quote>.</text>
		</section><section id="H6E0263692CA9403EB0C75C4990BE7ED3"><enum>9.</enum><header>Marine debris
			 definition</header><text display-inline="no-display-inline">Section 7
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1956">33 U.S.C.
			 1956</external-xref>) is amended—</text>
			<paragraph id="H33E61BFD4D1C4933B11085F86892FE1A"><enum>(1)</enum><text>by redesignating
			 paragraph (3) as paragraph (9), and moving such paragraph to appear after
			 paragraph (8); and</text>
			</paragraph><paragraph id="H5281A5F95CA945D8970E19C9BB75FAE4"><enum>(2)</enum><text>by inserting after
			 paragraph (2) the following:</text>
				<quoted-block id="H3E36287CE72D4661B50B5F09B2FD8617" style="OLC">
					<paragraph id="H037D8236B8B141FCA1A7FCF3A1DC4CAD"><enum>(3)</enum><header>Marine
				debris</header><text>The term <quote>marine debris</quote> means any persistent
				solid material that is manufactured or processed and directly or indirectly,
				and intentionally or unintentionally, disposed of or abandoned into the marine
				environment or the Great
				Lakes.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H3F979B5236B148D096075D55C4D36350"><enum>10.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">Section 9
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1958">33 U.S.C.
			 1958</external-xref>) is amended—</text>
			<paragraph id="H2CB15E37547A4AF8B2F007351CB42BB9"><enum>(1)</enum><text>by striking
			 <quote>are</quote> and inserting <quote>is</quote>;</text>
			</paragraph><paragraph id="H93348A3F7FE840FF922F30ECE7677A8C"><enum>(2)</enum><text>by striking
			 <quote>2006 through 2010</quote> and all that follows through
			 <quote>(1)</quote> and inserting <quote>through fiscal year
			 2015</quote>;</text>
