			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Welfare Reform Restoration
			 Act</short-title></quote>.</text>
			</section><section id="HAE0A9FE41D3D45D6A3C6F3F59B9755AA"><enum>102.</enum><header>Elimination of
			 temporary modification of the caseload reduction credit</header>
				<subsection display-inline="no-display-inline" id="HA9CA01EB57D3478E8EC5B1300324F8BC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 407(b)(3)(A)(i) of the Social Security Act (42 U.S.C. 607(b)(3)(A)(i)) is
			 amended by striking <quote>(or if the immediately preceding fiscal year is
			 fiscal year 2008, 2009, or 2010, then, at State option, during the emergency
			 fund base year of the State with respect to the average monthly assistance
			 caseload of the State (within the meaning of section 403(c)(9)), except that,
			 if a State elects such option for fiscal year 2008, the emergency fund base
			 year of the State with respect to such caseload shall be fiscal year
			 2007))</quote>.</text>
				</subsection><subsection id="HD3E2D3C744EB4AAEBA7552569A61517C"><enum>(b)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 2101 of
			 the American Recovery and Reinvestment Act of 2009 (123 Stat. 448–449; Public
			 Law 111–5) is amended—</text>
					<paragraph id="H6299E9D39D96444095EEF12139C24C45"><enum>(1)</enum><text>in subsection
			 (a)(2), by striking <quote>, except that paragraph (9) of such subsection shall
			 remain in effect until October 1, 2011, but only with respect to section
			 407(b)(3)(A)(i) of such Act</quote>; and</text>
					</paragraph><paragraph id="H1A25DFD94C864911B0C58123897F20ED"><enum>(2)</enum><text>by striking
			 subsection (d)(2).</text>
					</paragraph></subsection></section><section id="H4170D3F4E1674496A94E876E91718443"><enum>103.</enum><header>Reduction in
			 funding of State family assistance grants</header><text display-inline="no-display-inline">Section 403(a)(1)(C) of the Social Security
			 Act (42 U.S.C. 603(a)(1)(C)) is amended by striking <quote>2003
			 $16,566,542,000</quote> and inserting <quote>2011 and each succeeding fiscal
			 year $15,566,042,000, notwithstanding any other provision of
			 law</quote>.</text>
			</section></title><title id="H71D0DEAA944B4F51B5851A3221EF933A"><enum>II</enum><header>Work
			 Requirements for the Food Stamp Program</header>
			<section id="HFA7ECCF345194087AA107D920EC28A7B"><enum>201.</enum><header>Restoration of
			 Act short title and references to the food stamp program</header><text display-inline="no-display-inline">Effective on the date of the enactment of
			 this Act, the Food and Nutrition Act of 2008 (7 U.S.C. 2011 et seq.), and each
			 provision of law amended by section 4001 or 4002 of the Food, Conservation, and
			 Energy Act of 2008 (Public Law 110–246; 122 Stat. 1651), are restored as if
			 sections 4001 and 4002 of the Food, Conservation, and Energy Act of 2008 had
			 not been enacted.</text>
			</section><section id="HE2936C84DF654584A1FC583AAC400ECD"><enum>202.</enum><header>Amendments</header>
				<subsection id="H3339FF3AF9BC4CECA3E4957CCB1BBB1D"><enum>(a)</enum><header>Declaration of
			 policy</header><text display-inline="yes-display-inline">Section 2 of the Food
			 and Nutrition Act of 2008 (7 U.S.C. 2011) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H57D83831CB614E82A81F50E09DECFB52" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="section">Congress
				further finds that it should also be the goal of the food stamp program to
				increase employment, to encourage healthy marriage, and to promote prosperous
				self-sufficiency which shall mean the ability of households to maintain an
				income above the poverty level without Government services and
				benefits.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HC5A2F76BF1714CB8B2FD956AE344C59E"><enum>(b)</enum><header>Definitions</header><text>Section
			 3 of the Food and Nutrition Act of 2008 (7 U.S.C. 2012) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC4F6BF8D36DB4B06AB8FE65D91BE407C" style="OLC">
						<subsection id="HAB0215B67D7B4CD8BC9FFF095B8549DC"><enum>(w)</enum><header>Able-Bodied,
				work-Eligible adult</header><text>The term <term>able-bodied, work-eligible
				adult</term> means an individual who—</text>
							<paragraph id="H03CC1E389874442CB1763AA19EBF5A3A"><enum>(1)</enum><text>is more than 18,
				and less than 63, years of age;</text>
							</paragraph><paragraph id="HEA752AF5184345DA8EF28464A9450D6E"><enum>(2)</enum><text>is not physically
				or mentally incapable of work; and</text>
							</paragraph><paragraph id="H897B39F5169544489E336C9E55E1A3E4"><enum>(3)</enum><text>is not the
				full-time caretaker of a disabled adult dependent.</text>
							</paragraph></subsection><subsection id="H77BC52A73DA94E2FA07DF05BD72D1D53"><enum>(x)</enum><header>Physically or
				mentally incapable of work</header><text>The term <term>physically or mentally
				incapable of work</term> shall mean an individual—</text>
							<paragraph id="H74A02D643A64418BBFC41628B4C356E6"><enum>(1)</enum><text>who currently
				receives benefits from the Supplemental Security Income program or another
				program that provides recurring benefits to individuals because the individual
				is disabled and unable to work; or</text>
							</paragraph><paragraph id="H79DC20B101C2475B8961C003D90D0844"><enum>(2)</enum><text>who has been
				medically certified as physically or mentally incapable of work and who has a
				credible pending application for enrollment in the Supplemental Security Income
				program or another program that provides recurring benefits to individuals
				because the individual is disabled and unable to work.</text>
							</paragraph></subsection><subsection id="HC726681EAC3F472FACF6ACE450DFB27F"><enum>(y)</enum><header>Family with
				dependent children</header><text>The term <term>family with dependent
				children</term> means a unit consisting of a family head, one or more dependent
				children, and in some cases, the married spouse of the family head, all of whom
				share meals and reside within a single household. There may be more than one
				family with dependent children within a single household.</text>
						</subsection><subsection id="HD82007025F5A40E190E54BD852498516"><enum>(z)</enum><header>Family
				head</header><text>The term <term>family head</term> means—</text>
							<paragraph id="HB439ED4FE4A045FFAF1742D11083E2BD"><enum>(1)</enum><text>a biological
				parent who is lawfully present in the United States and resides within a
				household with one or more dependent children who are biological offspring;
				or</text>
							</paragraph><paragraph id="HFFE0FD1399EC421797FD9FF86BE2CB7D"><enum>(2)</enum><text>in the absence of
				a biological parent, a step parent, guardian, or adult relative who resides
				with and provides care to the child or the children and is lawfully present in
				the United States.</text>
							</paragraph></subsection><subsection id="H7DCC79913CA74C449F8064F008AB45E2"><enum>(aa)</enum><header>Family
				unit</header><text>The term <term>family unit</term> means—</text>
							<paragraph id="HC50F5B4F443F45DDB6F960E0FF8B2872"><enum>(1)</enum><text>an adult residing
				without dependent children;</text>
							</paragraph><paragraph id="H4B2A573AA1B24BE0AC29CF188701DB97"><enum>(2)</enum><text>a single-headed
				family with dependent children; or</text>
							</paragraph><paragraph id="HC1F7738B600A49CE967CE9C56DB3368A"><enum>(3)</enum><text>a married couple
				family with dependent children.</text>
							</paragraph></subsection><subsection id="H7681DB79E3A5441A87D9864E8C216566"><enum>(bb)</enum><header>Married couple
				family with dependent children</header><text>The term <term>married couple
				family with dependent children</term> means a family with dependent children
				which has both a family head and the married spouse of the family head residing
				with the family.</text>
						</subsection><subsection id="H0BBA5EE99B534F0BBAF70334CBC8DB14"><enum>(cc)</enum><header>Married spouse
				of the family head</header><text>The term <term>married spouse of the family
				head</term> means the lawfully married spouse of the family head who resides
				with the family head and dependent children and is lawfully present in the
				United States.</text>
						</subsection><subsection id="HC6FDE4E5E61541CB9B45CAE52AFB24B8"><enum>(dd)</enum><header>Member of a
				family</header><text>The term <term>member of a family</term> means the family
				head, married spouse if present, and all dependent children within a family
				with dependent children</text>
						</subsection><subsection id="HE2B95009189C4FA09D54DB428C848EC8"><enum>(ee)</enum><header>Monthly
				potential work activation population</header><text>The term <term>monthly
				potential work activation population</term> means the sum of—</text>
							<paragraph id="HF9ECE16EF9354DA29EE54BE791894327"><enum>(1)</enum><text>all able bodied
				work eligible individuals without dependents who have received food stamp
				benefits and who have maintained less than 60 hours of paid employment during a
				month;</text>
							</paragraph><paragraph id="H0FDF7484C3574B26A67B439C7E9C5BF8"><enum>(2)</enum><text>all work eligible
				single-headed families with dependent children which have received food stamp
				benefits during the month and have maintained less than 120 hours of paid
				employment by the family head during the month; and</text>
							</paragraph><paragraph id="H9DD150A2B9044A95853D60AF63CD67A2"><enum>(3)</enum><text>all work eligible
				married couples with dependent children which have received food stamp benefits
				during the month and have maintained less than 120 combined hours of paid
				employment between the family head and the married spouse, summed together and
				counted jointly, during the month.</text>
							</paragraph></subsection><subsection id="H6EEB18A1021A4B2B8374075EA5843042"><enum>(ff)</enum><header>Monthly work
				activation participants</header><text>The term <term>monthly work activation
				participants</term> means the sum of—</text>
							<paragraph id="H534255FCF9D944788C4FEE683CFBEDEC"><enum>(1)</enum><text>all able bodied
				work eligible individuals without dependents who have received food stamp
				benefits and who have maintained—</text>
								<subparagraph id="H368356D67C51447BB58A1A6F8E0FC182"><enum>(A)</enum><text>less than 60 hours
				of paid employment during a month; and</text>
								</subparagraph><subparagraph id="H1787923B06A240ACB79512CF2B1B2347"><enum>(B)</enum><text>more than 60 hours
				of combined paid employment and work activation activity during the
				month;</text>
								</subparagraph></paragraph><paragraph id="H1826C988E00949519EBF412EACDE1B7A"><enum>(2)</enum><text>all work eligible
				single-headed families with dependent children which have received food stamp
				benefits during the month and contain a family head who has maintained—</text>
								<subparagraph id="HADE0A8B9A917498E95287F73DD054204"><enum>(A)</enum><text>less than 120
				hours of paid employment during the month; and</text>
								</subparagraph><subparagraph id="HE379E2012B9F4D86BB0AE66CCC327FF3"><enum>(B)</enum><text display-inline="yes-display-inline">more than 120 hours of combined paid
				employment and work activation activity during the month; and</text>
								</subparagraph></paragraph><paragraph id="HFAE5EA8C3DB94050AADFBC12D8291851"><enum>(3)</enum><text>all work eligible
				married couples with dependent children which have received food stamp benefits
				during the month, and have maintained—</text>
								<subparagraph id="HEC64A5157993454787E63926FB878C2D"><enum>(A)</enum><text>less than 120
				combined hours of paid employment between the family head and the spouse,
				summed together and counted jointly, during the month; and</text>
								</subparagraph><subparagraph id="H7D990C2B25B445709A034014075E1B5E"><enum>(B)</enum><text>more than 120
				hours of combined paid employment and work activation activity between the
				family head and the married spouse, summed together and counted jointly, during
				the month.</text>
								</subparagraph></paragraph></subsection><subsection id="H7D37F29C72D74B1C9632BEE7828FAFB2"><enum>(gg)</enum><header>Single-Headed
				family with dependent children</header><text>The term <term>single-headed
				family with dependent children</term> means a family with dependent children
				which contains a family head residing with the family but does not have a
				married spouse of the family head residing with the family.</text>
						</subsection><subsection id="HDA5959E8583F4496AF1A163755975D56"><enum>(hh)</enum><header>Supervised job
				search</header><text>The term <term>supervised job search</term> means a job
				search program which has the following characteristics:</text>
							<paragraph id="H9A41643367F843CDB0DF4E0A0F571BDD"><enum>(1)</enum><text>The job search
				occurs at an official location where the recipient’s presence and activity can
				be directly observed, supervised, and monitored.</text>
							</paragraph><paragraph id="HD28FB3D0EBC64B7DA9EFF4AA5D908AD2"><enum>(2)</enum><text>The recipient’s
				entry, time on site, and exit from the official job search location are
				recorded in a manner which prevents fraud.</text>
							</paragraph><paragraph id="H3E68A744478C44B8BDD553456A395EDC"><enum>(3)</enum><text>The recipient is
				expected to remain and undertake job search activities at the job search center
				except for brief, authorized departures for specified off-site
				interviews.</text>
							</paragraph><paragraph id="H5911538F47F44A3D96765F5108793DF6"><enum>(4)</enum><text>The amount of time
				the recipient is observed and monitored engaging in job search at the official
				location is recorded for purposes of compliance with section 29.</text>
							</paragraph></subsection><subsection id="H61398EECCB194534B552F2781D51C7E3"><enum>(ii)</enum><header>Work
				activation</header><text>The term <term>work activation</term> means—</text>
							<paragraph id="H52A29B57C4F449C9974AA35DA9B4BC9A"><enum>(1)</enum><text>supervised job
				search;</text>
							</paragraph><paragraph id="HB7784EA0368C44C1B489F679D72773AB"><enum>(2)</enum><text>community service
				activities;</text>
							</paragraph><paragraph id="HA330248C752F431F9905CCDBF86E9B60"><enum>(3)</enum><text>education and job
				training for individuals who are family heads or married spouses of family
				heads;</text>
							</paragraph><paragraph id="H44D71D02792146AC8FDBD8DED2A0734B"><enum>(4)</enum><text>workfare under
				section 20; or</text>
							</paragraph><paragraph id="H8E6956F1898B48A18418B6BF125D8A4F"><enum>(5)</enum><text>drug or alcohol
				treatment.</text>
							</paragraph></subsection><subsection id="HE32305FDAC1447A983759741379EB8BE"><enum>(jj)</enum><header>Work activation
				ratio</header><text>The term <term>work activation ratio</term> means the
				number of work activation participants in a given month divided by the
				potential work activation population for the same month.</text>
						</subsection><subsection id="H7E72235C02304176B7CC608F40AB1C7E"><enum>(kk)</enum><header>Work
				activities</header><text>The term <term>work activities</term> means paid
				employment, work activation, or a combination of both paid employment and work
				activation.</text>
						</subsection><subsection id="HEEF87A1A566A4D159695F6A919037481"><enum>(ll)</enum><header>Work eligible
				family unit</header><text>The term <term>work eligible family unit</term>
				means—</text>
							<paragraph id="H9D4C04D1F57D413B9456D434EAAE090E"><enum>(1)</enum><text>an able-bodied,
				work eligible adult without dependent children;</text>
							</paragraph><paragraph id="H18121C754A754C9C9E420C2483E045ED"><enum>(2)</enum><text>a work eligible
				single-headed family with dependent children; or</text>
							</paragraph><paragraph id="H98434ACE297B4AC782C482233F6C69DE"><enum>(3)</enum><text>a work eligible
				married couple family with dependent children.</text>
							</paragraph></subsection><subsection id="HF7CBCB4682304982807E0EDAEABB3708"><enum>(mm)</enum><header>Work eligible
				adult without dependent children</header><text>The term <term>work eligible
				adult without dependent children</term> means an individual who—</text>
							<paragraph id="H77F056727E214A5EB8D3011841D526AB"><enum>(1)</enum><text>is an able-bodied
				work eligible individual; and</text>
							</paragraph><paragraph id="H0D57D24B951C4A5D8F58FC642309BFDC"><enum>(2)</enum><text display-inline="yes-display-inline">is not a family head or the married spouse
				of a family head.</text>
							</paragraph></subsection><subsection id="HC54051A3AA5F48E182D01F28F45A110C"><enum>(nn)</enum><header>Work eligible
				married couple family with dependent children</header><text>The term <term>work
				eligible married couple family with dependent children</term> means a married
				couple with dependent children which contains at least one work eligible adult
				able-bodied adult who is—</text>
							<paragraph id="H97E2F7DBD451478189A9DD3336525E3A"><enum>(1)</enum><text>the family head;
				or</text>
							</paragraph><paragraph id="HC864854011614BB4972836137B838D01"><enum>(2)</enum><text>the married spouse
				of the family head.</text>
							</paragraph></subsection><subsection id="HC861B8AF90CA46789595532D283C27D1"><enum>(oo)</enum><header>Work eligible
				single headed family with dependent children</header><text>The term <term>work
				eligible single headed family with dependent children</term> means a single
				headed family with dependent children which has a family head who is an able
				bodied work eligible
				adult.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCCBE436BC9D148A4A69D5375BB0D808E"><enum>(c)</enum><header>Conditions of
			 participation</header><text>Section 6(d) of the Food and Nutrition Act of 2008
			 (7 U.S.C. 2015(d)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H7C2A51F9DABE41C9AE94D768AAFD1C1A" style="OLC">
						<subsection id="HD41B4B73613A470BB8CA6DDAB70642C7"><enum>(d)</enum><header>Conditions of
				participation</header>
							<paragraph id="HF36C4B4D5D2246C1AFBBD7A5CD3F548E"><enum>(1)</enum><header>Work
				requirements</header>
								<subparagraph id="H058BABCCD4664EAB8451AA38EFB6DE39"><enum>(A)</enum><header>In
				general</header><text>No able-bodied work eligible adult shall be eligible to
				participate in the food stamp program if the individual—</text>
									<clause id="H43F8AD0F5E954DD6989127219D6D8832"><enum>(i)</enum><text>refuses, at the
				time of application and every 12 months thereafter, to register for employment
				in a manner prescribed by the Secretary;</text>
									</clause><clause id="HDCC37972E55F440790DD249B1C9F7859"><enum>(ii)</enum><text>refuses without
				good cause to accept an offer of employment, at a site or plant not subject to
				a strike or lockout at the time of the refusal, at a wage not less than the
				higher of—</text>
										<subclause id="H943EC968E07D4B1FBB5E06960B6AB114"><enum>(I)</enum><text>the applicable
				Federal or State minimum wage; or</text>
										</subclause><subclause id="HDDFB6CA1072D4BD4B8DC7BA4FF7E01EC"><enum>(II)</enum><text>80 percent of the
				wage that would have governed had the minimum hourly rate under section 6(a)(1)
				of the Fair Labor Standards Act of 1938 (29 U.S.C. 206(a)(1)) been applicable
				to the offer of employment;</text>
										</subclause></clause><clause id="HDA783339A0B243D28CCA481560541C60"><enum>(iii)</enum><text>refuses without
				good cause to provide a State agency with sufficient information to allow the
				State agency to determine the employment status or the job availability of the
				individual; or</text>
									</clause><clause id="HD9BBECBA1C8840C6BBCB75F3066B9460"><enum>(iv)</enum><text>voluntarily—</text>
										<subclause id="H1552B970617E4E00B1CEAA68D9141497"><enum>(I)</enum><text>quits a job;
				or</text>
										</subclause><subclause id="H930F7CCD42F34FABBEBE7C0DBE5D4C21"><enum>(II)</enum><text>reduces work
				effort and, after the reduction, the individual is working less than 30 hours
				per week, unless another adult in the same family unit increases employment at
				the same time by an amount equal to the reduction in work effort by the first
				adult.</text>
										</subclause></clause></subparagraph><subparagraph id="HCEDB1F72DDC24636B1894CF993FC81A7"><enum>(B)</enum><header>Family unit
				ineligibility</header><text>If an able-bodied work eligible adult is ineligible
				to participate in the food stamp program because of subparagraph (A), then no
				other member of the family unit to which that adult belongs shall be eligible
				to participate.</text>
								</subparagraph><subparagraph id="HCD697CCEE0C74098AC41E951343BD96B"><enum>(C)</enum><header>Duration of
				ineligibility</header><text>An able-bodied work eligible adult who becomes
				ineligible under subparagraph (A), and members of the family unit who become
				ineligible under subparagraph (B), shall remain ineligible for three months
				after the date at which they became ineligible.</text>
								</subparagraph><subparagraph id="H0C214F4C75EF4D5ABBA06E5FE0D4FBE1"><enum>(D)</enum><header>Restoration of
				eligibility</header><text>At the end of three months of ineligibility under
				subsection (c), members of a work eligible family unit may have their
				eligibility to participate in the food stamp program restored, if—</text>
									<clause id="H8D87063883814897AD52C749879FFD51"><enum>(i)</enum><text>the family unit is
				no longer a work eligible family unit; or</text>
									</clause><clause id="H2CEE3F7DDEF341F9BA6DA6D5FA6F1620"><enum>(ii)</enum><text>the adult members
				of the family unit begin and maintain any combination of paid employment and
				work activation sufficient to meet the appropriate standards for resumption of
				benefits in section 29(c)(2).</text>
									</clause></subparagraph></paragraph><paragraph id="H4650164B17A14E5A8F3C17E2D7E4739D"><enum>(2)</enum><header>Strike against a
				government</header><text>For the purpose of subparagraph (A)(iv), an employee
				of the Federal Government, a State, or a political subdivision of a State, who
				is dismissed for participating in a strike against the Federal Government, the
				State, or the political subdivision of the State shall be considered to have
				voluntarily quit without good cause.</text>
							</paragraph><paragraph id="H91262B7997CD4FD1BF811936C5F815E2"><enum>(3)</enum><header>Striking workers
				ineligible</header><text>Notwithstanding any other provision of law, no member
				of a family unit shall participate in the food stamp program at any time that
				any able-bodied work eligible adult member of such household is on strike as
				defined in the Labor Management Relations Act, 1947 (29 U.S.C. 142(2)), because
				of a labor dispute (other than a lockout) as defined in section 2(9) of the
				National Labor Relations Act (29 U.S.C. 152(9)): <italic>Provided</italic>,
				That a family unit shall not lose its eligibility to participate in the food
				stamp program as a result of one of its members going on strike if the
				household was eligible immediately prior to such strike, however, such family
				unit shall not receive an increased allotment as the result of a decrease in
				the income of the striking member or members of the household: <italic>Provided
				further</italic>, That such ineligibility shall not apply to any family unit
				that does not contain a member on strike, if any of its members refuses to
				accept employment at a plant or site because of a strike or
				lockout.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HED871F050C0A4652BACDF871E12DC4AD"><enum>(d)</enum><header>Termination of
			 funding</header><text>Section 6 of the Food and Nutrition Act of 2008 (7 U.S.C.
			 2015) is amended by striking subsection (h).</text>
				</subsection><subsection id="H39007F38544542F2B015A6087E9EAB1E"><enum>(e)</enum><header>Eligibility of
			 students with dependent children</header><text display-inline="yes-display-inline">Section 6(e)(8) of the Food and Nutrition
			 Act of 2008 (7 U.S.C. 2015(e)(8)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HCDBA856408FE425D8A5C50FA542BCE6E" style="traditional">
						<paragraph id="H446441E6E5E34FF680BFB427624D61FA"><enum>(8)</enum><text>is enrolled
				full-time in an institution of higher education, as determined by the
				institution, and—</text>
							<subparagraph id="H1623173CEB194AA998FA60D8A37F3619"><enum>(A)</enum><text>is a single parent
				with responsibility for the care of a dependent child under 12 years of age;
				or</text>
							</subparagraph><subparagraph id="H1B1564B490174DDDB1DC78C9A4C01A50"><enum>(B)</enum><text>is a family head
				or married spouse of a family head in a married couple family with dependent
				children and has a dependent child under age 12 residing in the
				home.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD5A8BBEFAE994244A9C4A1725FCC2E35"><enum>(f)</enum><header>Work
			 requirement</header><text display-inline="yes-display-inline">Section 6(o) of
			 the Food and Nutrition Act of 2008 (7 U.S.C. 2015(o)) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H72F3A35F84F94E6783C88313B911B14C" style="OLC">
						<subsection id="HAACC5CDF0167493AB7E94B5CD21ECC32"><enum>(o)</enum><header>Fulfillment of
				employment and work activation requirements</header>
							<paragraph id="H0DF9466C93FC464289A16E30B7BA646C"><enum>(1)</enum><header>In
				general</header><text>If an adult or adults within a work eligible family unit
				are required by the State agency to participate in work activation under
				section 29, no member of the family unit shall be eligible for food stamp
				benefits unless the employment and work activation standards for the family
				unit are fulfilled.</text>
							</paragraph><paragraph id="HF799F9D415694C95AD319232D53D3E36"><enum>(2)</enum><header>Sanctions and
				resumption of benefits</header><text>If an adult or adults within a work
				eligible family unit who are required by the State agency to participate in
				work activation under section 29 during a given month, fail to fulfill the work
				activation standards, benefits for all members of the family unit will be
				terminated in accordance with section 29(c)(1) and may be resumed upon
				compliance with the provisions of section
				29(c)(2).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6DB17672F5584612B76F7048ECAC733D"><enum>(g)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Section 6 of the Food and Nutrition Act of
			 2008 (7 U.S.C. 2015) is amended by adding at the end the following:</text>
					<quoted-block id="H2FD38B79CB144AF0BEDC29E945B636F6">
						<subsection id="H17D8D773E67A46578EB347625729B37F"><enum>(r)</enum><header>Minor
				children</header><text display-inline="yes-display-inline">No child less than
				age 18 years of age may participate in the food stamp program unless that child
				is a member of a family with dependent children and resides with an adult who
				is—</text>
							<paragraph id="HFA1E3166D07F426587BBD27E48E01667"><enum>(1)</enum><text>the family head of
				the same family of which the child is also a member;</text>
							</paragraph><paragraph id="HF61DF89D9D864967A5EAE14E8C458617"><enum>(2)</enum><text>eligible to
				participate, and is participating, in the food stamp program as a member of the
				same household as the child; and</text>
							</paragraph><paragraph id="HCA848C5941AD455583E739BEA53A00C1"><enum>(3)</enum><text>lawfully residing,
				and is eligible to work, in the United
				States.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDB7241D1B5CF49CE9E11A8B8001EB297"><enum>(h)</enum><header>Hearing and
			 determination</header><text>Section 11(e)(10) of the Food and Nutrition Act of
			 2008 (7 U.S.C. 2020(e)(10)) is amended by striking <quote>:
			 <italic>Provided</italic></quote> and all that follows through
			 <quote>hearing;</quote>, and inserting a semicolon.</text>
				</subsection><subsection id="H544484778FF94A148783651B94C1F2B4"><enum>(i)</enum><header>Work
			 requirements and activation program</header><text>The Food and Nutrition Act of
			 2008 (7 U.S.C. 2011 et seq.) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HFC1421EB3CA745599D2B18E017F38959" style="OLC">
						<section id="H128CBD9932664721BC5FBC46E0BD39EA"><enum>29.</enum><header>Work
				requirements and activation program</header>
							<subsection id="HF552A105DF63420C960ABC26B404E716"><enum>(a)</enum><header>Employment and
				work activation standards</header><text>Family units with adult members that
				are required to participate in work activation under section 29(b) during a
				full month of participation in the food stamp program shall be expected to
				fulfill the following levels of work activity during that month:</text>
								<paragraph id="H62179921808142FEA9130D4B302C9BF8"><enum>(1)</enum><text>Each able-bodied
				work eligible adult without dependent children shall be required to perform
				work activities for at least 60 hours per month.</text>
								</paragraph><paragraph id="H7C5D7796FAE94A1E83684120F837C4BC"><enum>(2)</enum><text>Each family head
				of a work eligible single-headed family with dependent children shall be
				required to perform work activities for at least 120 hours per month.</text>
								</paragraph><paragraph id="HD60F8EBF81334637938763680FA4A0AC"><enum>(3)</enum><text>In each work
				eligible married couple family with dependent children, the family head and
				married spouse shall be required to perform work activities which when added
				together for the two adults equal at least 120 hours per month:
				<italic>Provided</italic>, That the 120-hour requirement shall be a single
				joint obligation for the married couple as a whole in which the activities of
				both married partners shall be combined together and counted jointly.</text>
									<subparagraph id="HA9A399D157194132A7F70C112FA194C4"><enum>(A)</enum><text>For purposes of
				meeting this requirement the paid employment and work activation of the family
				head shall be added to the paid employment and work activation of the married
				spouse, and the requirement shall be fulfilled as long as the sum of the work
				activities of the two individuals when added together equals or exceeds 120
				hours per month.</text>
									</subparagraph><subparagraph id="HF22AF7F997F14BE3BD03FE277AA3A825"><enum>(B)</enum><text>The work
				requirement for married couple with dependent children may be fulfilled
				by—</text>
										<clause id="H85AE17D4989B46AB8E4E8410ACC2DD2E"><enum>(i)</enum><text>120 or more hours
				of work activity by the family head;</text>
										</clause><clause id="HA2DE0230144C428BA2499A3BB02E3043"><enum>(ii)</enum><text>120 or more hours
				of work activities by the married spouse; or</text>
										</clause><clause id="HB4B67A74CEFB4C7293343DD3606033FF"><enum>(iii)</enum><text>the combined
				work activities of the family head and married spouse which when added together
				equal or exceed 120 hours.</text>
										</clause></subparagraph><subparagraph id="H42964EF46E0B48308D8E7BBCE8E3D49C"><enum>(C)</enum><text>Neither the family
				head nor the married spouse in a married couple with dependent children shall
				be subject to a separate work activation requirement as individuals.</text>
									</subparagraph></paragraph></subsection><subsection id="H912CC0E8D8A846378200DC56F6A0B84F"><enum>(b)</enum><header>Pro rata
				reduction in employment and work activation standard during a partial
				month</header>
								<paragraph id="HE9C4FA8C5FB74B6BA942E86CF5A88712"><enum>(1)</enum><text>A work eligible
				family unit shall be subject to a pro-rated work activity standard, if the
				family unit—</text>
									<subparagraph id="H6D0AEAB2BC2748FFA8784C24B4E57D54"><enum>(A)</enum><text>receives a
				pro-rated monthly allotment during the initial month of enrollment under
				section 8(c); and</text>
									</subparagraph><subparagraph id="H432689100E7948E8AF403032E2113781"><enum>(B)</enum><text>is required by the
				State to participate in the work activation program during that month.</text>
									</subparagraph></paragraph><paragraph id="H39DF02A61C83475C9C345C6B349E2D2A"><enum>(2)</enum><text>The pro-rated work
				activity standard shall be a number of hours of work activity having a value
				which bears the same ratio to the employment and work activation requirement
				for that family unit for a full month under subsection (a) as the ratio of the
				pro-rated monthly allotment received by the household for the partial month
				under section 8(c) bears to the full allotment the same household would receive
				for a complete month.</text>
								</paragraph><paragraph id="H454B6574B6E4423BAD15343F4B3A8356"><enum>(3)</enum><text>For purposes of
				fulfilling the pro-rated work activity requirement during an initial month of
				enrollment in the food stamp program, only those hours of adult work activity
				which occurred during the portion of the month in which the family unit was
				participating in the food stamp program shall be counted.</text>
								</paragraph></subsection><subsection id="H11950212EE0D48588140F262FC5BC766"><enum>(c)</enum><header>Sanction for
				noncompliance</header>
								<paragraph id="HE63481ED5DFF48988AE0DF90B7ACA185"><enum>(1)</enum><header>In
				general</header><text>If a member or members of a work eligible family unit are
				required to participate in the work activation program under subsection (e) in
				a given calendar month and the individual or individuals fail to fulfill the
				work activity standard under subsection (a) or (b) for that month, then no
				member of the family unit shall be eligible to receive food stamp benefits
				during the subsequent calendar month.</text>
									<subparagraph id="H04D5E7CBC9C248CE8CF3C8F4C85DAA6F"><enum>(A)</enum><header>Administration
				of sanction</header><text>If a member or members of a work eligible family unit
				is required to participate in the work activation program under subsection (e)
				in a given calendar month and the individual or individuals fail to fulfill the
				work activity standard for that month, then the State agency must eliminate the
				food stamp benefit payment for all members of the family unit that otherwise
				would have been issued at the beginning of the next month except as provided in
				subparagraph (B).</text>
									</subparagraph><subparagraph id="HFD22C27F20924B639C1D66778CF927B6"><enum>(B)</enum><header>Administrative
				delay of sanction</header><text>If it is administratively infeasible for the
				State to eliminate the food stamp benefit that would be issued at the beginning
				of the first month after the month of noncompliance, then the State must
				eliminate the payment to all members of the family unit that otherwise would
				have been made at the beginning of the second month after the month of
				noncompliance: <italic>Provided</italic>, That the sanction of benefits must
				occur no later than 32 days after the end of the month of noncompliance, and:
				<italic>Provided further</italic>, That at least one monthly payment to all
				members of the family unit must be eliminated for each month of noncompliance
				under paragraph (1).</text>
									</subparagraph></paragraph><paragraph id="HDA9D90821A5146C9A17C453AC6E9DBD2"><enum>(2)</enum><header>Resumption of
				benefits after sanction</header>
									<subparagraph id="H2063215885714A59A9B705E77DB4B7C0"><enum>(A)</enum><header>In
				general</header><text>If a family unit has had its monthly benefit eliminated
				due to noncompliance with a work activity requirement under subsection (b) then
				the family unit shall not be eligible to receive future benefits under the food
				stamp program, until—</text>
										<clause id="HBC63EBDFBC164B3E8DBC6F83FCB9696A"><enum>(i)</enum><text>the work eligible
				member or members of the family unit have participated in the work activation
				program under subsection (e) for four consecutive subsequent weeks and
				fulfilled the work activity standard for the family unit for that same four
				week period; or</text>
										</clause><clause id="H044C0D477CD24E86B04C8547B73FA15A"><enum>(ii)</enum><text>the family unit
				no longer contains any able bodied work eligible adults.</text>
										</clause></subparagraph><subparagraph id="HA4E2FFF5E2294834873F015D9C4D2BE6"><enum>(B)</enum><header>Limitation</header><text>The
				resumed benefits cannot restore or compensate for the benefits that were
				eliminated due to the sanction imposed in subsection (c)(1).</text>
									</subparagraph></paragraph></subsection><subsection id="HD0C4B6C18A1142C4B4D3F6E680B7A53B"><enum>(d)</enum><header>Work activation
				is not employment</header><text>Participation in work activation activities
				under this section shall not be deemed employment and shall not be subject to
				any law pertaining to wages, compensation, hours, or conditions of employment
				under any law administered by the Department of Labor.</text>
							</subsection><subsection id="H820F7C2325F740EA81D805CDB62D6A60"><enum>(e)</enum><header>Work activation
				program</header>
								<paragraph id="H07DCD358DA034C0EBA14E518252D02A2"><enum>(1)</enum><header>Program</header><text>States
				will run a work activation program.</text>
								</paragraph><paragraph id="HB7C171DAA3B543818C9B03522A89ED42"><enum>(2)</enum><header>Purpose</header><text>The
				goal of the program shall be to increase the employment of work eligible
				able-bodied adult food stamp recipients. To accomplish this goal, each State
				shall require able-bodied adult food stamp recipients who are unemployed or
				under-employed to engage in work activation.</text>
								</paragraph><paragraph id="H4CB86D614B494F0D9ABBA536CB6A0280"><enum>(3)</enum><header>Target work
				activation ratios</header>
									<subparagraph id="H2FAF360B3A55438DA56272DA29323789"><enum>(A)</enum><header>In
				general</header><text>Commencing no later than six months after the effective
				date of this section, the State shall engage able-bodied food stamp recipients
				in work activation each month in sufficient numbers to meet the following
				monthly target work activation ratios:</text>
										<clause id="H89E27DB40E16434B8D3A652AAFD55B08"><enum>(i)</enum><text>In
				2012 the monthly target work activation ratio shall be 4 percent.</text>
										</clause><clause id="HCDD12059CF254482935AD632A1C7AE6C"><enum>(ii)</enum><text>In 2013 and in
				subsequent years the monthly target work activation ratio shall be 7
				percent.</text>
										</clause></subparagraph><subparagraph id="H62E621FC04B5434FAC116C8CB3EDD309"><enum>(B)</enum><header>Limitation on
				education and training as a component of work activation</header><text>For
				purposes of compliance by the State with the work activation ratios, not more
				than 20 percent of the monthly work activation participants counted by the
				State may be engaged in employment and training as a means of fulfilling their
				employment and work activation standards.</text>
									</subparagraph></paragraph><paragraph id="H71620FDBB2444CBC80150EB8C1A5EF6C"><enum>(4)</enum><header>Work activation
				priority populations</header>
									<subparagraph id="HDEECD26A2ADF449DB5628ACE56136A7F"><enum>(A)</enum><header>In
				general</header><text>In operating the work activation program, States shall
				give priority to participation by the following recipient groups:</text>
										<clause id="H0CB1E4EEFFCB4F72BCBF90E8CB903F62"><enum>(i)</enum><text>Work eligible
				adults without dependent children.</text>
										</clause><clause id="H25ADDC664A0A4049AC0DD1183E90D2CF"><enum>(ii)</enum><text>Work eligible
				adults who are also recipients of housing assistance.</text>
										</clause><clause id="H20C75A13555B4B62A0FA790FCE164F16"><enum>(iii)</enum><text>Other work
				eligible recipients at the time of initial application for benefits.</text>
										</clause></subparagraph><subparagraph id="H224C70D87B2D48BA949A58AD4A38E5B6"><enum>(B)</enum><header>Participation
				share</header><text>Except as provided in paragraph (C), at least 80 percent of
				the participants in work activation should belong to the three priority groups
				listed in paragraph (A).</text>
									</subparagraph><subparagraph id="HE40499430C384450AC42384EB2E410D9"><enum>(C)</enum><header>Exception</header><text>The
				numeric requirement in paragraph (B) shall not pertain if the number of
				recipients in the three priority groups in paragraph is insufficient to meet
				that requirement, but in those circumstances, the State will continue to give
				priority to any recipients who belong to the three priority groups.</text>
									</subparagraph></paragraph><paragraph id="HB3DAD4C857C84F12AFA2BDF2FECBE1CB"><enum>(5)</enum><header>Reimbursable
				expenses of participants</header>
									<subparagraph id="HA08A1D73E02C4909BA07AC667F06F529"><enum>(A)</enum><text>The State agency
				shall provide payments or reimbursements to participants in work activation
				carried out under this section for—</text>
										<clause id="HDED3217685AD480EA74ED4B8133D874A"><enum>(i)</enum><text>the actual costs
				of transportation and other actual costs (other than dependent care costs) that
				are reasonably necessary and directly related to participation in the work
				activation components of the program; and</text>
										</clause><clause id="H93846C31811545428C661F5EF34E1132"><enum>(ii)</enum><text>the actual costs
				of such dependent care expenses that are determined by the State agency to be
				necessary for the participation of an individual in the work activation
				components of the program (other than an individual who is the caretaker
				relative of a dependent in a family receiving benefits under part A of title IV
				of the Social Security Act (42 U.S.C. 601 et seq.)) in a local area where an
				employment, training, or education program under title IV of such Act (42
				U.S.C. 601 et seq.) is in operation, except that no such payment or
				reimbursement shall exceed the applicable local market rate.</text>
										</clause></subparagraph><subparagraph id="H88E3A286B359415784E5CA457894B47F"><enum>(B)</enum><text>In lieu of
				providing reimbursements for dependent care expenses under clause (i), a State
				agency may, at its option, arrange for dependent care through providers by
				providing vouchers to the household allowing the recipient to choose between
				all lawful providers. The value of the voucher shall not exceed the average
				local market rate.</text>
									</subparagraph><subparagraph id="H01D88D9C7B2643D7B8A6C50525A40EA3"><enum>(C)</enum><text>The value of any
				dependent care services provided for or arranged under paragraph (1) or (2), or
				any amount received as a payment or reimbursement under (1), shall—</text>
										<clause id="HA876FF6DB38042DC8A35AC7345ACF450"><enum>(i)</enum><text>not be treated as
				income for the purposes of any other Federal or federally assisted program that
				bases eligibility for, or the amount of benefits on, need; and</text>
										</clause><clause id="H2027D823F62A41198303A12201EBC81A"><enum>(ii)</enum><text>not be claimed as
				an employment-related expense for the purposes of the credit provided under
				section 21 of title 26.</text>
										</clause></subparagraph></paragraph><paragraph id="H78A20758506241CEB12FBD967990B8A1"><enum>(6)</enum><header>Penalties for
				inadequate State performance</header><text display-inline="yes-display-inline">If, in a given month, a State fails to
				engage food stamp recipients in work activation in sufficient numbers to meet
				or exceed the appropriate work activation ratio provided in subsection (e)(3),
				the Federal food stamp funding provided to the State in a subsequent penalty
				month will be reduced as follows: <italic>Provided,</italic> That, the month in
				which the State failed to engage food stamp recipients in work activation in
				sufficient numbers to meet or exceed the appropriate target work activation
				ratio shall be designated the non-performance month, and:
				<italic>Provided</italic><italic>further</italic>, That the month in which the
				State is penalized shall be designated the penalty month:</text>
									<subparagraph id="H3B12A031AC0A4ADD948FA2BBF9E3F676"><enum>(A)</enum><text>The penalty month
				shall be no later than four months after the non-performance month.</text>
									</subparagraph><subparagraph id="H6B3A45E19D1F4CD1A141856CC08C7E1E"><enum>(B)</enum><text>The amount of
				Federal food stamp funding the State shall receive for the penalty month shall
				equal the amount of Federal food stamp funds the State would otherwise have
				received multiplied by a fraction equaling—</text>
										<clause id="HDD4EBC53E50847F682D4AE6203336621"><enum>(i)</enum><text>the actual monthly
				work activation ratio achieved by the State in the penalty month; divided
				by</text>
										</clause><clause id="H66ED10E01F4D46E999557FD339D8F985"><enum>(ii)</enum><text>the target
				monthly work activation ratio for the penalty month.</text>
										</clause></subparagraph></paragraph><paragraph id="H1B20A7B013CE46098F95E27963C4CDE3"><enum>(7)</enum><header>Rewards to
				States for reducing government dependence</header><text>If, in any future year,
				a State reduces its food stamp caseload below the levels which existed in
				calendar year 2006, the State shall receive a financial reward for reducing
				dependence.</text>
									<subparagraph id="H067AE676E7CC44F3A84D71E56D61FC75"><enum>(A)</enum><text>The reward shall
				equal one quarter of the savings to the Federal Government for that year that
				resulted from the caseload reduction.</text>
									</subparagraph><subparagraph id="HDFF151104272473CA0952B774A86A6C6"><enum>(B)</enum><text>The State may use
				its reward funding for any purpose it chooses that provides benefits or
				services to individuals with incomes below 200 percent of the Federal poverty
				level, improves social outcomes in low-income populations, encourages healthy
				marriage, or increases self-sufficiency and reduces dependence.</text>
									</subparagraph></paragraph><paragraph id="HA5F3BAC3D26D4CF185AD7407617E03A5"><enum>(8)</enum><header>Authorization of
				funding</header>
									<subparagraph id="HBF574D1F5EDF483B8148E661B15C2C11"><enum>(A)</enum><header>In
				general</header><text>In fiscal year 2012, and in each subsequent fiscal year
				there is authorized to be appropriated $2,500,000,000 to be provided to State
				governments for the purpose of administering a work activation program in
				accordance with this section.</text>
									</subparagraph><subparagraph id="HDFD341A80E404AB093AD7FD5ECDCC3B4"><enum>(B)</enum><header>Allocation among
				States</header><text>The sum provided in subparagraph (A) shall be allocated to
				the States in proportion to each State’s share of total funding for the food
				stamp program under this Act in fiscal year
				2007.</text>

			 means-tested welfare spending</header><text display-inline="no-display-inline">Section 3 of the Congressional Budget and
			 Impoundment Control Act of 1974 is amended by adding at the end the following

				eligibility;</text>
							</clause><clause id="HFD547AED8CDD4CB6893FC4140A7AAB4C" indent="up1"><enum>(ii)</enum><text>is not need-based;</text>
							</clause><clause id="HB9D43DCCA1164E7FBF7A30AEB422145E" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">is a program designed exclusively or

								</subclause></clause></subparagraph><subparagraph id="H929CD7BD084747D9AE8973E5CC2B2E1D" indent="up1"><enum>(C)</enum><text>For purposes of this paragraph, the
				term <term>means-tested welfare spending</term> shall not include—</text>
							<clause id="H2CBEA3D89D474B6195B538F068677C86"><enum>(i)</enum><text display-inline="yes-display-inline">the Social Security Disability Insurance
				program;</text>
							</clause><clause id="HACAB911928DA4DD39AA728FB000344E1"><enum>(ii)</enum><text>Medicare;</text>
							</clause><clause id="H7207BBBD2E244C87A0E314A5602126F1"><enum>(iii)</enum><text>retirement insurance benefits and
				survivor benefits under the Social Security program;</text>
							</clause><clause id="H5A0AB781583D47729356770F73AF2F00"><enum>(iv)</enum><text>any program designed exclusively
				or primarily for veterans of military service;</text>
							</clause><clause id="H2A3E075384EE4DA683066A2C02433759"><enum>(v)</enum><text>unemployment insurance benefits
				provided under title K; and</text>
							</clause><clause id="HED30CCE504554926A5C223FF474068FF"><enum>(vi)</enum><text>programs designed specifically to
				provide benefits to workers to compensate for job-related injuries or
				illnesses.</text>
							</clause></subparagraph><subparagraph id="H83CCDF88252042F381F66A61868D3605" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>spending on means-tested welfare programs</term> shall mean the full cost
				of benefits and services provided by the program, as well as the administrative
				costs for operating the program, subject to the limitations in subparagraph
				(E).</text>
						</subparagraph><subparagraph id="H610BF5AD2EFA449C8299DEBF786674FA" indent="up1"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="HB71DCF8F5AEE4C838E0F6559D5AD9BBC"><enum>(i)</enum><text display-inline="yes-display-inline">For purposes of this paragraph only the
				refundable portion of the following tax credits shall be counted as
				means-tested welfare expenditures:</text>
								<subclause id="H177793D8B1534F71B5BFDCBE81DBC06E" indent="up1"><enum>(I)</enum><text>The earned income tax
				credit.</text>
								</subclause><subclause id="H10A6C95735B5483E9947AF1E0EDBC366" indent="up1"><enum>(II)</enum><text>The child tax credit.</text>
								</subclause><subclause id="H96B46B2F11C84681BA4F7FBA8EEE433B" indent="up1"><enum>(III)</enum><text>The making work pay tax
				credit.</text>
								</subclause></clause><clause id="H450CE567F02A47FE9F906CA7C93313A1" indent="up1"><enum>(ii)</enum><text>For purposes of this paragraph only
				the refundable portion of the premium and out of pocket health care subsidies
				to be paid under the Patient Protection and Affordable Health Care Act shall be
				counted as means-tested welfare expenditures; the refundable portion of these
				subsidies shall mean the portion of the credit which is paid to an individual
				in excess of the amount of Federal income tax owed by the individual.</text>
							</clause><clause id="H837E88EB02504409B03CAEBE3318A203" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">For purposes of this paragraph only the
				costs of the free and reduced price segments of the school lunch and school
				breakfast programs shall be included.</text>
							</clause></subparagraph><subparagraph id="HA8972627FE70426B9207ED6EC3B8A969" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">For purposes of this paragraph expenditures
				by state and local governments of funds that are:</text>
							<clause id="H73F60DEF348F4E86BC8A2A101634A725"><enum>(i)</enum><text display-inline="yes-display-inline">obtained by the State and local government
				from taxes, fees, or other sources of revenue established by the State or local
				government; and</text>
							</clause><clause id="H8EF3E8FCC1254EE5A98DCF630AEAD3B4"><enum>(ii)</enum><text>are not received as any form of
				grant from the Federal Government,</text>
							</clause><continuation-text continuation-text-level="subparagraph">shall
				not be considered as Federal means-tested welfare spending even if such state
				and local expenditures take the form of contributions to Federal programs
				listed or defined in subparagraphs (A) and
				(B).</continuation-text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE92ED24BC8F8450C99D06ED59B276161"><enum>402.</enum><header>Reports to
			 budget committees</header><text display-inline="no-display-inline">Section
			 202(e)(1) of the Congressional Budget Act of 1974 is amended by inserting
			 <quote>(A)</quote> after <quote>(1)</quote> and by inserting at the end the
			 following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H01E47DC638E84EC280A853DF2B532D2F" style="OLC">
					<subparagraph id="H9D63821480974EC28DB711113DAA5632" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Beginning with the first fiscal year that
				begins after the date of enactment of this subsection and after any monthly
				rate of unemployment during the immediately preceding fiscal year is below 6.5
				percent, the Director shall include in each report submitted to the Committees
				on the Budget of the House of Representatives and the Senate under subparagraph
				(A) the following information for the fiscal year commencing on October 1 of
				the year in which the report is submitted and for each of the ensuing 4 fiscal
				years:</text>
						<clause id="HCBC8CE2E2A814A6DBCBFA5055A4D1645"><enum>(i)</enum><text>The Congressional Budget Office
				baseline level of Federal spending for aggregate means-tested welfare
				programs.</text>
						</clause><clause id="H2A76A107C076428AA54E0607178ADD91"><enum>(ii)</enum><text display-inline="yes-display-inline">The aggregate level of Federal means-tested
				welfare spending computed by taking the aggregate level of means-tested welfare
				spending for fiscal year 2007 and adjusting that for inflation using the
				Consumer Price Index for All Urban Consumers, U.S. City Average, All Items, Not
				Seasonally Adjusted (CPI–U), as computed by the Bureau of Labor Statistics, for
				all fiscal years occurring after fiscal year 2007 and before the applicable
				fiscal
				year.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H1047F35CD21847199AE883F4A5E91149"><enum>403.</enum><header>Content of
			 concurrent resolutions on the budget</header><text display-inline="no-display-inline">Section 301 of the Congressional Budget Act
			 of 1974 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HED599FF4394D4AFC8411E93A91D508D3" style="OLC">
					<subsection id="HF35642368D6044E7922E91685BC8E41C"><enum>(j)</enum><header>Means-Tested
				welfare spending</header><text display-inline="yes-display-inline">Beginning
				with the first fiscal year that begins after the date of enactment of this
				subsection and after any monthly rate of unemployment during the immediately
				preceding fiscal year is below 6.5 percent, the concurrent resolution on the
				budget for the applicable fiscal year shall set forth the appropriate level for
				aggregate means-tested welfare spending for the first fiscal year of that
				concurrent resolution and for at least each of the 4 ensuing fiscal years. Such
				level shall not exceed the aggregate level of Federal means-tested welfare
				spending for fiscal year 2007, adjusted for inflation using the Consumer Price
				Index for All Urban Consumers, U.S. City Average, All Items, Not Seasonally
				Adjusted (CPI–U), as computed by the Bureau of Labor Statistics, for all fiscal
				years occurring after fiscal year 2007 and before the applicable fiscal
				year.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE7FDA3290EFB4C81BFF83EC3EE1B405F"><enum>404.</enum><header>Allocations of
			 means-tested welfare spending</header>
				<subsection id="H8265A86F58134FD1A3FFAC3AE1B7BFFA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 302 of the
			 Congressional Budget Act of 1974 is amended by adding at the end the following
			 new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H7D76EFF148CE4C9B8A62B2387A5CFB50" style="OLC">
						<subsection id="H7E832F23FB1D48969BD1A9A9B33DC56B"><enum>(h)</enum><header>Means-Tested
				welfare spending limit</header>
							<paragraph id="H54119936288A44459D21653FC38D5912"><enum>(1)</enum><header>Further division
				of amounts</header><text>For any concurrent resolution on the budget for which
				levels for aggregate means-tested welfare spending are set forth under section
				301(j), in the House of Representatives and the Senate, the amounts allocated
				under subsection (a) shall be further divided to establish an allocation
				of—</text>
								<subparagraph id="H91B9185D7C0C4B93A233866A14CB375F"><enum>(A)</enum><text display-inline="yes-display-inline">total new budget authority and total
				outlays for discretionary means-tested welfare spending in appropriation
				measures for the first fiscal year of the resolution on the budget; and</text>
								</subparagraph><subparagraph id="H7DC1CE35A14E4211AC4A6E01EEC568AB"><enum>(B)</enum><text display-inline="yes-display-inline">total new budget authority and total
				outlays for mandatory means-tested welfare spending for the first fiscal year
				of the resolution on the budget and at least each of the ensuing 4 fiscal years
				to all other committees of the House of Representatives and the Senate that
				have jurisdiction over legislation providing mandatory means-tested welfare
				spending.</text>
								</subparagraph></paragraph><paragraph id="H49FAB4D20B1D4415A763899A30E60024"><enum>(2)</enum><header>Point of
				order</header><text>It shall not be in order in the House of Representatives or
				the Senate to consider any bill, joint resolution, or amendment if—</text>
								<subparagraph id="H80435CF6E58847C3B25A1E8828467247"><enum>(A)</enum><text>the enactment of
				such bill or resolution as reported;</text>
								</subparagraph><subparagraph id="H71A3E450D63543B9AC2433CB39D287E0"><enum>(B)</enum><text>the adoption and
				enactment of such amendment; or</text>
								</subparagraph><subparagraph id="H7B9B0594F696478682B57BA92EE2DA28"><enum>(C)</enum><text>the enactment of
				such bill or resolution in the form recommended in such conference
				report,</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">would
				cause the applicable allocation of new budget authority or outlays made under
				subparagraph (A) or (B) of paragraph (1) for a fiscal year to be
				exceeded.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDFFBFD97E5314E8D8B912BCAF9CFBF1A"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 302(b) of the Congressional Budget Act of 1974
			 is amended by striking <quote>under subsection (a)</quote> and inserting
			 <quote>under subsections (a) and (h)</quote>.</text>
				</subsection></section><section id="HFA0C17DDC1FC4F5BA5199436DAC7CC14"><enum>405.</enum><header>Reconciliation</header><text display-inline="no-display-inline">Section 310(a) of the Congressional Budget
			 Act of 1974 is amended as follows:</text>
				<paragraph id="HB42956F2ACE64F78B5266B90FA4BE283"><enum>(1)</enum><text>Strike
			 <quote>or</quote> at the end of paragraph (3) and strike the period at the end
			 of paragraph (4) and insert <quote>; and</quote>.</text>
				</paragraph><paragraph id="HAEEDEB9B66624F40A7CD86460FA8162C"><enum>(2)</enum><text>Redesignate
			 paragraph (4) as paragraph (5), and in paragraph (5) as redesignated, strike
			 <quote>and (3)</quote> and insert <quote>(3), and (4)</quote>.</text>
				</paragraph><paragraph id="HBB7CA24388FA44EE858980DA2D8413BE"><enum>(3)</enum><text>After paragraph
			 (3), insert the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H067A45F8613143569DB9B254D57DC6DB" style="OLC">
						<paragraph id="HDED3E9DE741448818BE63454F4CD9F43"><enum>(4)</enum><text display-inline="yes-display-inline">specify the total amount by which new
				budget authority for such fiscal year for mandatory means-tested welfare
				spending contained in laws, bills, and resolutions within the jurisdiction of a
				committee is to be changed and direct that committee to determine and recommend
				changes to accomplish a change of such total amount, which amount shall be the
				amount by which the Congressional Budget Office baseline level of spending for
				aggregate mandatory means-tested welfare programs exceeds the allocation made
				pursuant to section 302(h)(1)(B) for such fiscal
				year.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H78CCDE5705BF4016B59542360877A282"><enum>V</enum><header>Grants to promote
			 self-sufficiency</header>
			<section id="H8B3BFB7514864F33A2476BBF94C44083"><enum>501.</enum><header>Grants to
			 States</header>
				<subsection id="H7CE5B4D4874349DB81F62C838F1F2A24"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to encourage
			 States to develop policies to promote self-sufficiency and prosperity and to
			 reduce poverty and Government dependence.</text>
				</subsection><subsection id="H3189F7F9BF144E48988407298DB0A188"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Social Security Act is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H205B885777874671A321418C59E60313" style="OLC">
						<title id="HA119A44EF2964A748AFDCF18BECF3585"><enum>XXII</enum><header>Grants to
				States to Promote Self-Sufficiency and Prosperity and to Reduce
				Dependence</header>
							<section id="HC26CF7FB12124BF1818BE43384090AA4"><enum>2201.</enum><header>Grants to
				States</header>
								<subsection id="HDEEC19322BD6437FA68BFA6D6ED5344F"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				provide grants to States to reward reductions in poverty and Government
				dependence and increases in self-sufficiency.</text>
								</subsection><subsection id="H7C180B8080374188A65C1E4957D27F02"><enum>(b)</enum><header>Allocation of
				grants to states</header><text>For each fiscal year for which funds are made
				available under subsection (e), the Secretary shall make a grant in an amount
				equal to $100,000,000 to each of the 3 States with the greatest percentage
				increases in the self-sufficiency ratio of the State for the preceding fiscal
				year over the self-sufficiency ratio of the State for fiscal year 2007, as
				compared with the changes in that ratio for each other State, subject to
				subsection (c).</text>
								</subsection><subsection id="H1158A256AFC444F5AAC9E7401FCC7F8E"><enum>(c)</enum><header>Limitation on
				eligibility for grants</header><text>A State shall not be eligible for a grant
				under this title for a fiscal year unless the self-sufficiency ratio of the
				State for the fiscal year is greater than the self-sufficiency ratio of the
				State for fiscal year 2007.</text>
								</subsection><subsection id="H240AC65A4521432098D7C77DE001F766"><enum>(d)</enum><header>Definitions</header><text>In
				this title:</text>
									<paragraph id="H33912A44467A49A693DB11A4B589005C"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>self-sufficient
				family</term> means a family (including a 1-person family) whose combined
				income, excluding receipt of means-tested welfare spending (as defined in
				section 3(11)(A) of the Congressional Budget and Impoundment Control Act of
				1974), exceeds the poverty line (within the meaning of section 673(2) of the
				Omnibus Budget Reconciliation Act of 1981, including any revision required by
				such section applicable to a family of the size involved).</text>
									</paragraph><paragraph id="H530AD040C7424EDD816B4805D7399B32"><enum>(2)</enum><text>The term
				<term>self-sufficiency ratio</term> means, with respect to a State and a fiscal
				year—</text>
										<subparagraph id="HB324FF60FADC46CAB564BFD30D3EB364"><enum>(A)</enum><text>the number of
				self-sufficient families residing in the State during the fiscal year that are
				headed by able-bodied individuals who have not attained 63 years of age;
				divided by</text>
										</subparagraph><subparagraph id="HA26BEFB6AE18411AAF9D03221D5DD060"><enum>(B)</enum><text display-inline="yes-display-inline">the total number of families residing in
				the State during the fiscal year that are headed by able-bodied individuals who
				have not attained 63 years of age.</text>
										</subparagraph></paragraph><paragraph id="H14261B1E139E44EF9E1929DB9BBB2CB8"><enum>(3)</enum><text>The term
				<term>State</term> means the 50 States and the District of Columbia.</text>
									</paragraph></subsection><subsection display-inline="no-display-inline" id="H2619653A6134431FA6B14B934D3385B5"><enum>(e)</enum><header>Limitations on
				authorization of appropriations</header><text>For grants under this title,
				there are authorized to be appropriated to the Secretary $300,000,000 for
				fiscal year 2012 and each succeeding fiscal
				year.</text>
								</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="HED9C68F488CA49E0943AE8BCE67D4DD2"><enum>VI</enum><header>Prohibition on
			 funding of abortion</header>
			<section id="H93CACD939CD3487C89896832C71BBC7D"><enum>601.</enum><header>Prohibition on
			 funding for abortions</header><text display-inline="no-display-inline">No funds
			 authorized or appropriated by Federal law, and none of the funds in any trust
			 fund to which funds are authorized or appropriated by Federal law, shall be
			 expended for any abortion.</text>
			</section><section id="H40C24DBFD8A84CFF846FE69457229A60"><enum>602.</enum><header>Prohibition on
			 funding for health benefits plans that cover abortion</header><text display-inline="no-display-inline">None of the funds authorized or appropriated
			 by Federal law, and none of the funds in any trust fund to which funds are
			 authorized or appropriated by Federal law, shall be expended for health
			 benefits coverage that includes coverage of abortion.</text>
			</section><section id="H158698A4986F4AE591186943C646E6ED"><enum>603.</enum><header>Prohibition on
			 tax benefits relating to abortion</header><text display-inline="no-display-inline">For taxable years beginning after the date
			 of the enactment of this section, no credit shall be allowed under the internal
			 revenue laws with respect to amounts paid or incurred for an abortion or with
			 respect to amounts paid or incurred for a health benefits plan (including
			 premium assistance) that includes coverage of abortion.</text>
			</section><section id="H535FE37331A14BA29136186A9C8F82C3"><enum>604.</enum><header>Construction
			 relating to separate coverage</header><text display-inline="no-display-inline">Nothing in this title shall be construed as
			 prohibiting any individual, entity, or State or locality from purchasing
			 separate abortion coverage or health benefits coverage that includes abortion
			 so long as such coverage is paid for entirely using only funds not authorized
			 or appropriated by Federal law and such coverage shall not be purchased using
			 matching funds required for a federally subsidized program, including a State's
			 or locality's contribution of Medicaid matching funds.</text>
			</section><section id="H1DDB72C7864542F98B7DCD196AF8C33C"><enum>605.</enum><header>Construction
			 relating to the use of non-Federal funds for health coverage</header><text display-inline="no-display-inline">Nothing in this title shall be construed as
			 restricting the ability of any non-Federal health benefits coverage provider
			 from offering abortion coverage, or the ability of a State or locality to
			 contract separately with such a provider for such coverage, so long as only
			 funds not authorized or appropriated by Federal law are used and such coverage
			 shall not be purchased using matching funds required for a federally subsidized
			 program, including a State's or locality's contribution of Medicaid matching
			 funds.</text>
			</section><section id="HFF3B613EE58F4AEFBFAE829BBF817678"><enum>606.</enum><header>Treatment of
			 abortions related to rape, incest, or preserving the life of the
			 mother</header><text display-inline="no-display-inline">The limitations
			 established in this title shall not apply to an abortion—</text>
				<paragraph id="H3C7B71031AFE4457B4C4C0316EC158D0"><enum>(1)</enum><text>if the pregnancy
			 is the result of an act of rape or incest; or</text>
				</paragraph><paragraph id="H296CACADFB394337B119124AD4ACD621"><enum>(2)</enum><text>in the case where
			 a woman suffers from a physical disorder, physical injury, or physical illness
			 that would, as certified by a physician, place the woman in danger of death
			 unless an abortion is performed, including a life-endangering physical
			 condition caused by or arising from the pregnancy itself.</text>
